AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER ON WEDNESDAY, NOVEMBER 7, 2018
ORDINANCE 110718-1AUTHORIZING THE ACQUISITION BY THE
BOARD OF SUPERVISORS OF ROANOKE COUNTY OFANEW
PRIVATE WATER LINE EASEMENT ON PROPERTY OWNED BY WM
BYRD, LLC, (LOCATED AT 100HIGHLAND ROAD;TAX MAP
NO.060.11-04-20.00),IN THE VINTON MAGISTERIAL DISTRICT
WHEREAS,Roanoke County has requested that WM Byrd LLCgrant the County
a new ten (10’) foot private water line easement acrossitspropertylocated at 100
Highland Road(Tax Map No.060.11-04-20.00),in the VintonMagisterial District; and
WHEREAS, the County owns property located at 156 Highland Road, adjacent to
100 Highland Road; the waterline easement will enable the County to make
improvements, as needed, to the water line providing service to its property at 156
Highland Road; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition and conveyance of real estate interests be accomplished by ordinance; the
first reading of this ordinance was held on October 23, 2018, and the second reading
washeld on November 7, 2018.
NOW, THEREFORE, BE IT ORDAINEDby the Board of Supervisors of Roanoke
County, Virginia, as follows:
1.That the acquisition ofa new ten foot (10’)private water lineeasement across
property belonging to WM Byrd LLC, located at 100 Highland Road(Tax Map No.
060.11-04-20.00),in the VintonMagisterial District,as shown on the attached
plat labelled “Easement Exhibit From Records Showing a New 20’ Public Water
Line Easement and a New 10’ Private Water Line Easement Located on Lot B1

ORDINANCE 110718-2APPROVING AN AMENDMENT TO THE LEASE
OF THE BENT MOUNTAINCOMMUNITY CENTER TO EXPAND THE
LEASED PREMISES TO THE ENTIRETY OF THE BUILDING AND GAIN
THE FLEXIBILITY TO SUB-LEASE THE EXPANDED PREMISES
WHEREAS, during the December 11, 2012, meeting the Roanoke County Board
of Supervisors approved a lease with the Bent Mountain Center, Inc., for a portion of the
Bent Mountain Elementary School for use as a community center; and
WHEREAS, the Bent Mountain Center Inc. is a 501C3 organization consisting of
residents of the Bent Mountain community who are interested in preserving the
structure as a community center and will benefit the community; and
WHEREAS, the original Leased Premises were identified as the
“gym/stage/kitchen/cafeteria/parking area” and noted in “Exhibit A” of the original Deed
of Lease Agreement.
WHEREAS, representatives from the Bent Mountain Center, Inc. requested an
amendment to the lease to expand the Leased Premises to the entirety of the building
and gain the flexibility to sub-lease the expanded premises; and
WHEREAS, the first reading of this ordinance was heldon October 23, 2018 and
the second reading and public hearing was held on November 7, 2018.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia as follows:

1.The 2Amendment shall now read that the Leased Premises shall be
identified as the entire building and shown as REVISED EXHIBIT A –LEASED

PREMISES. The Exhibit clearly shows the Original Leased Premisesand the
Additional Leased Premises.
2. Section 4, Use of Leased Premises is hereby amended to removethe
language “shall not use or permit or suffer the use of the Leased Premises for any
elementary or secondary school….”
3.Section 10, MAINTENANCE, REPAIRS, ALTERATIONS AND
REPLACEMNTS, paragraph one now reads “County shall at County’s sole cost,
procure andmaintain heating and/or air conditioning systems” the language “for the
scope of the original leased premises however, shall not include the Additional
Leased Premises granted by this amendment” is added.
4. Section 18, RESERVED RIGHTS, (e) second paragraph now reads
“Tenant reserves the right to cancel the Lease or reduce the use of the Leased Premise
with thirty (30) days written notification to the County. Such cancellation or reduction in
the amount of Leased Premises shall be at the sole discretionof the Tenant”.
5.Section 18, RESERVED RIGHTS (e) last paragraph is deleted in its
entirety and is replaced with: “County and Tenant shall each have the right to
cancel the Lease or reduce the physical Leased Premises with (180) days’ written
notification to the other party. The Tenant shall disclose this right to cancel to
any sub-lessee, whose rights shall be no greater than the rights of the Tenant’s”.
6.That this ordinance shall be in full force and effect from and after its
adoption.
7.The County Administrator, or an Assistant County Administrator, has the
authority to execute any and all documents related to this action.

RESOLUTION 110718-3ENDORSING AVIRGINIA DEPARTMENT OF
TRANSPORTATION (VDOT)COMPREHENSIVE ROADSIDE
MANAGEMENT PROJECT FOR THE BRAMBLETON TRIANGLEAT
ROUTE 419 IN ROANOKE COUNTY, VIRGINIA
WHEREAS, One Earth Landscapeshascommitted to install and maintain
landscaping and signage for five(5)years at the Brambleton Trianglein Roanoke
County, Virginia; and
WHEREAS, this landscaping and signage project would implement the 2005
Roanoke County Community Plan; and
WHEREAS, these improvement activities fall under the Virginia Department of
Transportation Comprehensive Roadside Management Program; and
WHEREAS, this VDOT program requires support of the local governing body
with the adoption of a Resolution of Endorsementprior to project approval by VDOT;
and,
WHEREAS, the Board held a public hearing on this project after advertisement
as required by law onNovember 7,2018.
BE IT RESOLVED BY THE BOARD OF SUPERVISORSOF ROANOKE COUNTY,
VIRGINIA, AS FOLLOWS:
1.That the Board finds that this landscaping and signage project at the Brambleton
Triangleis consistent with the goals of the 2005 Roanoke County Community
Plan.

ISSUE:
Acceptance of an eighteen month old German Shepherd (named Ordi) to the Police
Department for the use as a detection K-9.
DISCUSSION:
The Police Department has been offered a donation from the Roanoke County Police
Foundation of an eighteen month old German Shepherd (named Ordi) to the Police
Department for use as a detection K-9. The value of the canine is approximately $6,000.
The Police Department intends to assign Ordi to a police officer handler in the K-9 Unit
where she will be trained as an explosives detection K-9.
FISCAL IMPACT:
The Police Department will supply necessary training, equipment, and a vehicle from its
existing funds. No additional funding is requested.
STAFF RECOMMENDATION:
Staff recommends acceptance of this donation.

ADMINISTRATOR’S DECLARATION OF A LOCAL EMERGENCY DUE TO
SEVERE WEATHER
WHEREAS, Virginia CodeSection 44-146.21 provides that“inthe event the
governing body cannot convene due to \[a\] disaster or other exigent circumstances, the
\[local\] director \[of emergency services\] . . . may declare the existence of a local
emergency, subject to confirmation by the governing body at its next regularly scheduled
meeting or at a special meeting within fourteen days of the declaration, whichever occurs
first; and
WHEREAS, in conformity with the Commonwealth of Virginia Emergency Services
and Disaster Law of 2000 (Virginia Code Section 44-146.13 et seq.), the Board of
Supervisors by adoption of Resolution No. 111798-2,adopted an Emergency Operations
Plan for Roanoke County, and designated the County Administrator as the Director of
Emergency Services; and
WHEREAS, by virtue of the authority vested in him by Section44-146.21, the
County Administrator, as the County’s Director of Emergency Services, issued a
Declaration of Local Emergency onOctober 25, 2018, in response to the effects of
Hurricane Michael.
NOW, THEREFORE, BE IT RESOLVEDBY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA:
That pursuant to Virginia Code Section 44-146.21 Board of Supervisorshereby
ratifies and confirms the Declaration of Local Emergency issued by the County

ASSISTANT DIRECTOR OF INFORMATION TECHNOLOGY,UPON HER
RETIREMENT AFTER MORE THAN FORTY (40)YEARS OF SERVICE
WHEREAS,Ms. Wilsonwasemployed by Roanoke County on May 22, 1978; and
WHEREAS,Ms.WilsonretiredonNovember1, 2018, after fortyyears andfive
monthofdevoted, faithful and expertserviceto Roanoke County; and
WHEREAS,during Ms.Wilson’stenure she has served in the Roanoke County
Schools Data Processing Department, as a Computer Programmer, then as a Programmer
Analyst, a Lead Programmer Analyst, Systems Design/Programming Manager,Business
Architect,and Assistant Director of Information Technologyfor the County of Roanokeand
servedwith professionalism and dedication in providing services to the citizens of Roanoke
County;
WHEREAS,Ms. Wilson,through her employment with Roanoke County, has been
instrumental in improving the quality of life and providing services to the citizens of
Roanoke County; and
WHEREAS, during Ms. Wilson’s time with Roanoke County as an applications
developer, served as systems analyst over business critical applications such as Personal
Property, Payroll/Human Resources, Utility Billing, Cashiering and Computer Aided
Dispatch systems.She led the successful Year 2000 (Y2K)Project that involved modifying
many lines of code in multiple business systems to ensure systems were operable for the
year 2000.Ms. Wilson alsolead the multi-year migration from HP mainframe to client-
server computing which involved moving from in-house developed applications to the

ISSUE:
Acceptance of letter of resignation and approve severance agreement.
DISCUSSION:
During the closed session, Mr. Gates submitted his resignationto the Board with an
effective date of January 4, 2018.
VOTE:
SupervisorHooker moved to acceptthethe letter of resignation and to approve a
severance agreement as outlined in closed session.Supervisor McNamaraseconded
the motion and the motion was approved.
