Good afternoon and welcome to our meeting for January 22, 2019. Regular meetings
are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at
7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Board of
Supervisors meetings can also be viewed online through Roanoke County’s website at
www.RoanokeCountyVA.gov.Our meetings areclosed-captioned, so it is important for

RESOLUTION OF APPRECIATION TO MARTHA B. HOOKER FOR HER
SERVICE AS CHAIRMAN OF THE BOARD OF SUPERVISORS IN 2018
WHEREAS, Martha B. Hooker served as Chairman of the Roanoke County Board of
Supervisors during 2018; and
term as Chairman, the County achieved a variety
of accomplishments, including:
New construction, renovation and expansion projects representing more than $26
million in new investment and the creation and retention of more than 330 jobs
including; Magnets USA, Harris Corporation and Blue Ridge Beverage
Completion of the redevelopment of the former Vinton library and the grand
opening of a new Macados Restaurant
The grand opening of the new Tru by Hilton hotel in Hollins
Sale of the former Cox Communications building to VFP Inc. for a new corporate
headquarters
Sale and redevelopment of the former LSC Communications, the former
R.R.Donnelly building to Camrett Logistics for their operations
Implementation of Explore Park's adventure plan to include the opening of
Mayflower Hills Disc Golf Course, cabin and yurt campground, primitive

WHEREAS, Chairman Hooker emphasized sound financial strategies and practices
and promoted regional projects and initiatives to benefit all the residents of the Roanoke
Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, does hereby extend its deepest appreciation to Martha B. Hooker for her
collaborative and steady leadership of the Board of Supervisors as Chairman during 2018
and for her belief in democracy and championing of citizen participation in local
government.

ISSUE:
Briefing for the Board of Supervisors regarding the County Administrator's Proposed
Fiscal Year 2020-2029 Capital Improvement Program (CIP).
BACKGROUND:
As part of the annual budget process, the County Administrator presents a ten-year
Capital Improvement Program (CIP) for consideration by the Board of Supervisors. This
briefing provides an overview of the ten-year CIP. The Board of Supervisors will
deliberate the priorities, projects, and funding sources included in the proposed CIP
through budget adoption on May 28, 2019.
DISCUSSION:
This time has been scheduled to provide the Board of Supervisors with a briefing on the
County Administrator's Proposed Fiscal Year 2020-2029 CIP. The proposed CIP
document and the presentation providing an overview of the CIP will be distributed to
the Board of Supervisors at the January 22, 2019 meeting. A work session has also
been scheduled for February 26, 2019 to continue discussion on the proposed CIP.

FISCAL IMPACT:
There is no fiscal impact associated with the briefing. The fiscal impact of the CIP will be
determined at adoption of the fiscal year 2019-2020 budget on May 28, 2019. The
Board of Supervisors will adopt for appropriation the first year of the ten-year CIP as
part of the annual budget ordinances.
STAFF RECOMMENDATION:
Staff recommends the Board of Supervisors receive information regarding the County
Administrator's Proposed Fiscal Year 2020-2029 Capital Improvement Program.

AGENDA ITEM: Ordinance enacting a new Section 13-14 of the Roanoke
County Code, prohibiting the use of automobiles as sleeping
quarters

ISSUE:
Whether to amend the County Code to prohibit the use of automobiles as sleeping
quarters.
BACKGROUND:
At present, the Roanoke County Code does not prohibit the use of automobiles as
sleeping quarters. County staff (including representatives of the Departments of Fire
and Rescue, Police, Social Services, Development Services, Planning, and County
Administration) recently met to review safety concerns and effects on residential
neighborhoods that result from the use of automobiles as sleeping quarters. At the
conclusion of the meeting, it was proposed that the Board be presented with an
amendment to the County Code that would prohibit such a practice.
DISCUSSION:
Recognizing that the use of automobiles as sleeping quarters poses safety risks
(particularly during winter months) and can have a negative effect on neighborhood
aesthetics, it is proposed the Board amend the County Code, enacting a new Section
13-14, prohibiting the use of automobiles as sleeping quarters.
The proposed ordinance would not prohibit napping in an automobile; it would prohibit

using an automobile for sleeping quarters, in place of a residence, hotel or other similar
accommodations.
Rather than make such conduct a violation of the zoning ordinance (in which the
property owner could be held responsible), it is proposed that the violation be classified
as a "general offense", so that the violator can be held responsible.
The proposed ordinance makes such a violation a class 4 misdemeanor, which is
punishable by a fine that cannot exceed $250.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of this ordinance and scheduling the
second reading and public hearing for February 12, 2019.

ORDINANCE ENACTING SECTION 13-14 OF THE ROANOKE COUNTY
CODE, PROHIBITING THE USE OF AUTOMOBILES AS SLEEPING
QUARTERS
WHEREAS, in the interest of public health, public safety, and the for the promotion
of the general welfare, it is proposed that the Roanoke County Code be amended to
prohibit the use of automobiles as sleeping quarters; and
WHEREAS, the first reading of this ordinance was held on January 22, 2019, and
the public hearing and second reading was held on February 12, 2019.
NOW THEREFORE BE IT ORDAINED by the Roanoke County Board of
Supervisors:
1. That Chapter 13, Article I of the Roanoke County Code be amended to
enact a new Section 13-14 as follows:
Sec. 13-14. Automobiles as Sleeping Quarters.
It shall be unlawful and a Class 4 misdemeanor for any person to use an
automobile for sleeping quarters, in place of a residence, hotel or other similar
accommodations, within the County.

ISSUE:
Ordinance authorizing the granting of a new public drainage easement by Shirley
Lee Manning, located at 4737 Little Bear Road (Tax Map No. 054.02-
04-20.00-0000), Catawba Magisterial District, to the Board of Supervisors of Roanoke
County, for the purpose of drainage improvements.
BACKGROUND / DISCUSSION:
Shirley Lee Manning is willing to grant the Board of Supervisorsa
20' wide, 8,424 sq. ft. public drainage easement, located on her property at
4737 LIttle Bear Road (Tax Map No. 054.02-04-20.00-0000), Catawba Magisterial
District.
Improvements to Glenvar High School have contributed to drainage problems on Ms.
Manning's property. Roanoke County School Administration and County staff have
proposed to help Ms. Manning remedy such drainage problems, but such assistance
would require that Ms. Manning grant the Board a drainage easement (to allow the
County to construct and maintain improvements).
Ms. Manning has agreed to grant such an easement, and has signed a deed of
easement ("Attachment 1"). The location and scope of the easement is more particularly

set forth on the attached plat ("Exhibit A"). If the Board accepts the conveyance,
Roanoke County School Administration will reconstruct an existing channel to
accommodate the storm water run-off from the Glenvar High School. Roanoke County
will thereafter assume responsibility for ongoing maintenance of the channel.
FISCAL IMPACT:
Roanoke County School Administration will complete the initial improvements to the
existing drainage channel at no cost to Roanoke County.
The County will thereafter maintain the drainage easement utilizing existing funding
designated for stormwater maintenance.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of this ordinance and scheduling the
public hearing and second reading for February 12, 2019.

WHEREAS, it appears that improvements to Glenvar High School have
contributed to drainage problem on property belonging to Shirley Lee Manning
054.02-04-20.00-0000) in
the Catawba Magisterial District; and
WHEREAS, in order to assist Manning with correcting such drainage problems,
the County has requested that Manning grant a new public drainage easement on
her property; and
WHEREAS, Manning has agreed to convey the new public drainage easement to
the County; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition and conveyance of real estate interests be accomplished by ordinance; the
first reading of this ordinance was held on January 22, 2019, and the second reading
and public hearing was held on February 12, 2019.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the conveyance of a new public drainage easement by Manning to
the Roanoke County Board of Supervisors, in the Catawba Magisterial District, located
at 4737 Little Bear Road (Tax Map No. 054.02-04-20.00-0000), containing 8,424 square

feet, and shown on the attached plat prepared by Frank B. Caldwell, dated December
11, 2018, is hereby authorized and approved.
2. That the County Administrator, or any Assistant County Administrators,
either of whom may act, are authorized to execute, deliver and record the deeds, and
any other documents on behalf of the County and to take all such further action as any
of them may deem necessary or desirable in connection with this project. The form of
the deed is hereby approved with such completions, omissions, insertions and changes
as the County Administrator may approve, whose approval shall be evidenced
conclusively by the execution and delivery thereof, all of which shall be approved as to
form by the County Attorney.

ISSUE:
To allow Phase II of the Plantation Road Bicycle, Pedestrian and Streetscape
Improvement Project to proceed, the following Board actions are requested:
1) Accept and appropriate $1,752,213 in VDOT SMART SCALE Grant funds;
2) Grant signatory authority to the County Administrator, or his designee, to execute
VDOT project documents; and
3) Extend an existing contract with Whitman, Requardt and Associates (WRA) to
provide professional services to complete project design and provide right of way
and construction phase services in an amount not to exceed $444,797.31.
BACKGROUND:
The Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project
(Plantation Road Project) was originally envisioned in 2009 to extend from Williamson

Road (Route 11) to Interstate 81 on both sides of Plantation Road. A competitive
selection process was used to select WRA as the consulting engineer and resulted in
the execution of Contract No. 2013-087. As the project was designed, public input was
received and funding was obtained, the project was split into multiple phases to fit within
funding parameters. Phase I was completed in October 2018.
Phase II has been partially designed by WRA from Walrond Drive to Gander Way.
Phase II includes:
1) Curb, gutter, sidewalk and street trees;
2) Walrond Drive intersection improvements; and
3) Pedestrian signals at the Gander Way/Plantation Road/Friendship Lane
intersection.
Roanoke County was awarded $1,752,213 in SMART SCALE Grant funds for Phase II
of the project in 2017, with funding allocated over multiple fiscal years. This project is
being locally administered by Roanoke County because 90 percent engineering design
plans and most right-of-way acquisition were completed prior to the project being split
into two phases. The VDOT SMART SCALE Grant request included an estimate to
complete preliminary engineering, right-of-way (utility relocation) and to begin and
complete construction.
DISCUSSION:
Phase II Preliminary Engineering is scheduled for fiscal year 2019. In order to move
forward, several actions are needed.
Since the project is locally administered with Roanoke County to be reimbursed for
project costs, an ordinance must be approved to accept and allocate VDOT SMART
SCALE Grant funding.
When Roanoke County administers a VDOT funded project, VDOT requires an
Appendix A and a Standard Project Administration Agreement to be completed between
the County and VDOT. For County staff to execute the agreements, VDOT requires
documentation of signatory authority. The proposed ordinance includes language to
grant signatory authority to the County Administrator, or his designee, to execute these
documents on behalf of Roanoke County.
Additionally, Roanoke County Staff recommends that the original project engineers,
WRA, be retained to complete engineering design, assemble bid documents, assist with
the RFP process and administer construction of the project. To accomplish this, the
Board of Supervisors must approve the extension of the existing contract with WRA in

an amount not to exceed $444,797.31. If the contract extension is not approved, a new
federally compliant consultant selection process would be required. This process would
result in additional costs to the County and a project delay.
SMART SCALE Grant funding is 100 percent federal funding with no County match
required. In light of escalating construction costs since the 2016 estimate, storm water
management challenges for this phase and the desire to budget a greater construction
contingency, the current project estimate exceeds available funding by $139,000.
A $300,000 Capital Improvement Program (CIP) request was submitted to cover a
project contingency. Staff is also investigating other means of funding, to include:
1) Requesting additional VDOT SMART SCALE Grant funding within the
2) Transferring surplus funds from completed County transportation projects; and/or
3) Submitting a request in September 2019 for Regional Surface Transportation
Program (RSTP) funding.
If additional funds can be secured through any of these means, CIP funding will not be
needed.
FISCAL IMPACT:
In order to provide for a sufficient project contingency, a request for $300,000 in local
(County) funds was submitted as part of the CIP budget development process. The
request for project contingency funding ($300,000) was included in fiscal year 2021 of
the County Administrator's Proposed Fiscal Year 2020 - Fiscal Year 2029 CIP. Should
the County identify alternative funding sources to provide for the project contingency,
this funding may be removed from next year's CIP.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of an ordinance to:
1) Accept and appropriate $1,752,213 in VDOT SMART SCALE Grant funds;
2) Grant signatory authority to the County Administrator, or his designee, to execute
VDOT project documents; and
3) Extend existing Contract 2013-087 with Whitman, Requardt and Associates to

ISSUE:
Appropriation of funds in the amount of $187,000 from Capital Reserves to provide
resources to complete the County Facilities Assessment.
BACKGROUND:
Section 5-3 of the County's Comprehensive Financial Policy adopted by the Board of
Supervisors on April 24, 2018 states the County "...shall obtain an independent,
professional, and comprehensive facilities assessment to ascertain the present
condition of each facility, and to assist the County and the Schools in forecasting capital
funding requirements to address deficiencies. The assessment shall also be used to
establish priorities for the maintenance, repair, enhancement, or replacement of
facilities and their component systems, and to be used in the development of the Capital
Maintenance Program and Capital Improvement Program." The assessment is tobe
performed every seven to ten years.
DISCUSSION:
County staff has completed contract negotiations with its preferred vendor and is ready

to initiate work on the County Facilities Assessment. The vendor will produce an
independent, professional and comprehensive facilities assessment to ascertain the
condition, useful life, deficiencies, and cost estimates for County facilities, systems, and
major components. The assessment will also provide a resource for the development of
priorities and funding requirements for the maintenance, repair, enhancement, or
replacement of facilities and their component systems. The assessment will be utilized
in the development of future Capital Improvement Programs.
The County Facilities Assessment will assess 39 County government facilities totaling
over 865,000 square feet; infrastructure and support facilities at 36 Parks, Recreation,
and Tourism locations; and other County support facilities such as communication tower
sites.
Completion of work will result in a comprehensive report that includes all findings,
recommendations, and analysis. The deliverables also include a fully customizable
capital asset planning and management software application. The software application
will provide a tool for staff to update condition metrics based on both work completed or
deferred. The reporting platform includes significant reporting capabilities and allows for
the update of cost estimating factors.
After appropriation of funds and based on a 23 week completion timeline, it is estimated
that all work would be completed and deliverables presented by July 12, 2019. County
staff would then schedule a work session with the Board of Supervisors to review the
results and begin a project and funding prioritization process.
Before a contract can be executed and work can begin, an appropriation of funds must
be approved by the Board of Supervisors.
The attached PowerPoint presentation will be reviewed at the January 22, 2019, Board
of Supervisors meeting.
FISCAL IMPACT:
The estimated cost of all work and deliverables associated with the County Facilities
Assessment is $170,000. County staff also recommends adding a 10% project
contingency, or $17,000 to the total estimated cost. The total appropriation request is for
$187,000. County staff recommends utilization of current County Capital Reserves to
provide resources for completion of the assessment.

Staff recommends approval of the ordinance with waiver of second reading to

Request for authorization to adjust the precinct boundaries between Precinct 103

BACKGROUND:
The Roanoke County Electoral Board requests that the Board of Supervisors approve
the following recommendations:
1) that the boundaries between Precinct 103 (Glenvar) and Precinct 106 (Green
Hill) be adjusted so that their voting age populations are roughly equivalent;

2) that Precinct 405 (Lindenwood) be divided into two separate precincts; and
3) that the voting location for Precinct 201 (Plantation) be moved from
Shenandoah Baptist Church to Summerdean Church of the Brethren, located
at 6604 Planation Road.
Sections 24.2-306, 24.2-307 and 24.2-310 of the Code of Virginia (1950), as amended,
authorize the governing body of each county to increase or decrease the number of
precincts, alter precinct boundaries, and establish one polling place for each precinct in
that jurisdiction by ordinance.
DISCUSSION:
Precinct 106 (Green Hill) be adjusted so that their voting age populations are roughly
precinct size. As of November 1, Precinct 106 contains 3,298 voters while a much
smaller number, 1,883, vote in the adjoining Precinct 103. The voters of Green Hill
regularly turn out to vote at higher than average rates and they often experience long
lines. These lines typically snake into their polling place, Green Hill Baptist Church,
wind through the foyer, and regularly extend either outside the entrance of the polling
place or into areas that are less than ideal for voter traffic. For example, during
elections with particularly heavy participation, lines of voters have extended through the
exterior of the building. At the Glenvar Precinct, however, which votes in the Glenvar
Middle School cafeteria (during non-presidential elections) or gymnasium (during
better accommodate any voters who may be forced to wait in line. Given the proximity
of these two precincts and their polling places, making a slight change to the boundary
between them to shift some voters into Precinct 103 is a common-sense solution.

result during all hours of polling, and heightened burden these things place on certain
classes of voters. As of November 1, Precinct 405 has 3,886 voters. With lines that
reportedly lasted longer than 1 hour and 45 minutes during much of the 2016
presidential election, that extended beyond 30-45 minutes for much of the time that
they were during the last presidential election, voters are frustrated and becoming
discouraged. During most of the elections over the past two years, large numbers of

the trends in voter registration continue at a rate similar to that of 2017 and 2018, about
4,050 voters will face these conditions during the 2019 general election and well over
that number will be forced to endure them during the 2020 presidential election. Unlike
several other precincts in Roanoke County that have grown to serve over 3,500 voters
(i.e. Precinct 205 - Orchards, 305 - Castle Rock, and 507 - Hunting Hills, in which
changes in the boundaries or subdivision of precincts would be more difficult and best
addressed during the decennial redistricting process), an easy, common-sense solution
also exists for the problems plaguing Precinct 405. Namely, by dividing Lindenwood
into two separate precincts, keeping one precinct at William Byrd High School, and
establishing a second at William Byrd Middle School, both precincts would remain on
the same campus while minimizing voter confusion.
Finally, the Electoral Bo
(Plantation) be moved from Shenandoah Baptist Church to Summerdean Church of the
number of complaints about voter accessibility brought by elderly voters and those with
limited mobility or their assistants. Some of the issues reported include difficulty
navigating the sloped parking area, an uneven sidewalk to the building, and the narrow
hallway leading from
complaints have dealt with the limited amount of flat floor space available inside the
voting room and that the entrance to the same is restricted by permanent risers which
necessitates that voters make a fairly tight left turn, which is particularly hard on those
voters using walkers, wheelchairs, or who require other assistance due to limited
mobility. The Board has identified Summerdean Church of the Brethren as an
alternative to Plantati
boundaries of Precinct 201 and is willing make their fellowship hall available to the
from a large, flat parking lot and is fully ADA accessible.
Precinct 201 would be in the best interest of not only the over 11,500 voters affected,
but also the officers of election who serve them on election day.
In accordance with the Code of Virginia Section 24.2-309.2, No county, city, or town
shall create, divide, abolish, or consolidate any precincts, or otherwise change the
boundaries of any precinct, effective during the period from February 1, 2019, to May
15, 2021, except as (I) provided by law upon a change in the boundaries of the county,
city, or town, (ii) the result of a court order, (iii) the result of a change in the form of
government, or (iv) the result of an increase or decrease in the number of local election
districts other than at-large districts. Any ordinance required to comply with the
requirements of § 24.2-307 <https://law.lis.virginia.gov/vacode/24.2-307/> shall be
adopted on or before February 1, 2019. Accordingly to these time constraints, it is

recommended that the Board waive the second reading with a 4/5

FISCAL IMPACT:
The cost of establishing a new precinct is estimated at $21,000. This cost includes
$5,800 for a Unisyn OpenElect Voting Optical Scan (OVO) machine, $5,500 for the
Unisyn OpenElect Optical Voting Interface (OVI), which is the ADA-accessible ballot
marking machine, $1,600 for 10 additional Pollmaster II voting booths and $8,100, of
additional costs associated with printing and mailing.
After consultation and review with the Office of Management and Budget and
Administration, the cost of $21,000 can be absorbed by the Office of Voter Registration
-personnel operating budget for fiscal year 2018-2019. No
additional appropriation is required for this action.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of this ordinance and waiving the second
reading due to the time constraints.

(PLANTATION) FROM SHENANDOAH BAPTIST CHURCH TO
SUMMERDEAN CHURCH OF THE BRETHERN, AT 6604
PLANTATION ROAD IN THE HOLLINS MAGISTERIAL DISTRICT
WHEREAS, Sections 24.2-306, 24.2-307 and 24.2-310 of the Code of Virginia
(1950), as amended, authorize the governing body of each county to establish the
polling place for each precinct in that jurisdiction by ordinance, to increase or decrease
the number of precincts, and to alter precinct boundaries, and to change the location of
polling places; and
WHEREAS, the citizens of Roanoke County, as well as the election officials, will
be better served by:
1) adjusting the precinct boundaries between Precinct 103 (Glenvar) and
Precinct 106 (Green Hill) to equate the voting age population of both
precincts;
2) splitting Precinct 405 (Lindenwood) into two precincts; and

3) moving the voting location for Precinct 201 (Plantation) from Shenandoah
Baptist Church to Summerdean Church of the Brethren, located at 6604
Planation Road; and
WHEREAS, the election officials have determined that the proposed polling place
for Precinct 201 will provide more space for voting equipment, higher security to assure
citizen and equipment safety, additional and more convenient parking and better
accessibility for citizens for all future elections; and
WHEREAS, the first reading and public hearing for this ordinance were held on
January 22, 2019; and the second reading has been dispensed with, upon an
affirmative vote of 4/5ths of the members of the Board, this being deemed to be an
emergency measure pursuant to Section 18.04 of the Roanoke County Charter and
Section 24.2-309.2 of the Code of Virginia (which prohibits precinct changes during the
period of February 1, 2019 to May 15, 2021).
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the relocation of the following polling places be and are hereby
approved as follows:
(a) The boundaries of Precinct 106 (Green Hill) and Precinct 103
(Glenvar), which are both located in the Catawba Magisterial
District, shall be adjusted to equate the voting age population of
both precincts;

(b) Precinct 405 (Lindenwood), which is located in the Vinton
Magisterial District, shall be split into two precincts; and
(c) Precinct 201 (Plantation), which is located in the Hollins Magisterial
District, shall be moved from the Shenandoah Baptist Church to the
Summerdean Church of the Brethren, located at 6604 Plantation
Road.
2. That the General Registrar for the County of Roanoke, Virginia is
hereby authorized to take all measures necessary to comply with
Virginia law and regulations regarding changes in polling precincts,
and to provide reasonable notification to the voters of the changes in
their respective polling locations.
3. That the County Administrator, or any assistant County Administrator,
and the General Registrar are hereby authorized and directed to take
such others actions as may be necessary to accomplish the intent of
this ordinance.
4. That this ordinance shall take effect immediately.

ISSUE:
The Fire & Rescue Department would like to accept $2,000 in grant funds from a local
Walmart store for the purchase of fire and rescue equipment for North County Station
#1.
BACKGROUND:
The Walmart Foundation awards grants to local organizations making a difference on
key issues in communities where Walmart stores, clubs, and distribution center
associates live and work.
DISCUSSION:
In the past, Walmart has selected the Fire & Rescue Department on several occasions
as a benefactor of their grant program. This time, we would like to use the $2,000 grant
funds to purchase fire and rescue equipment for North County Station #1.
FISCAL IMPACT:
Funds are being provided by Walmart and there is no local match required.

The postage allocation represents a request to the Compensation Board to help offset

The funds received from the Commonwealth of Virginia have been earmarked for
postage needs.

speed measurement devices from the fiscal year 2018 154AL Grants
BACKGROUND:
The Department of Motor Vehicles (DMV) had split money from a previously approved
grant to administratively create a new grant. The speed measurement devices has
already been purchased. This was done for administrative purposes for DMV.
DISCUSSION:
The Department of Motor Vehicles awarded $5,685 with a local match of $2,842.50 to
the Roanoke County Police Department to purchase speed measurement devices.
FISCAL IMPACT:
The awarded grant funds total $8,527.50, which includes a required local match of
$2,842.50

RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY TO DARRYL BURKS,
BATTALION CHIEF, UPON HIS RETIREMENT AFTER MORE THAN
TWENTY-EIGHT (28) YEARS OF SERVICE
WHEREAS, Chief Burks was employed by Roanoke County on April 9, 1990; and
WHEREAS, Chief Burks retired on January 1, 2019, after twenty-eight years and
nine months of devoted, faithful and expert service to Roanoke County; and
WHEREAS, during Chief Burks tenure he has served as a Firefighter/EMT, Fire
Lieutenant, Fire Captain and Battalion Chief-Operations and served with professionalism
and dedication in providing services to the citizens of Roanoke County;
WHEREAS, Chief Burch has been instrumental in selecting our current work-force
through his many years of active involvement in the employment process to lead the
s Coordinator;
WHEREAS, Chief Burks provided leadership for various behind the scenes
programs that allows the Department to function at the highest levels from selection of fire
nozzles, personal protective clothing, uniforms, and self-contained breathing apparatus
(SCBA).
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to Battalion Chief DARRYL L. BURKS for more than twenty-eight years of capable,
loyal and dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy and
productive retirement.

ISSUE:

BACKGROUND:
As part of financial best practices, County staff annually provides the Board of
Supervisors a mid-year update regarding budget to actual revenues and expenditures
for the current fiscal year. The attached presentation provides information on revenues
and expenditures through the second quarter (December 31, 2018) of fiscal year 2018-
2019.
DISCUSSION:
This time has been scheduled to discuss fiscal year 2018-2019 mid-year revenues and

ISSUE:
Agenda item for public hearing and second reading of ordinances to amend the
proffered conditions on commercial property.
BACKGROUND:
· In 1989, the property was rezoned from R-2, Duplex-Residential District to B-1,
Office (now the equivalent of C-1, Low Intensity Commercial,) for the purpose of
building a medical office park which was never constructed.
· Many development-related conditions were proffered at this time addressing
specific issues (stormwater, screening, buffers, utilities, land disturbance, etc.)
that are now handled by current County development regulations.
DISCUSSION:
The Planning Commission held a public hearing on this request on January 2, 2019.
There were no citizens to speak on this item during the public hearing. The applicant
clarified that there would be a 45-foot sewer easement along the back property line to
serve this project and the residential properties along the rear property line. The
applicant also clarified that the building would be setback 25 feet from the front property
line instead of 20 feet, and that the middle building shown on the concept plan would be

the first building constructed.
The Planning Commission discussed building setbacks, sidewalk, sewer easement,
screening and buffering, and the concept plan. The Planning Commission recommends
approval to amend the proffered conditions. The new proffered conditions would be:
1. The site will be developed in general conformance with the titled Preliminary Site
Schematic Plan for Ogden Road, Professional Park concept plan as prepared by
Craighead and Associates, dated 10/23/2018.
2. All freestanding pole mounted site lighting will not ex
grade.
FISCAL IMPACT:
There is no fiscal impact on this agenda item.

Staff recommends that the Board approve the second reading of the ordinance
amending the proffered conditions.

Petitioner: Virginia Interventional Pain & Spine Center
Request: To amend the proffered conditions on approximately 3.2 acres zoned C-1C, Low
Intensity Commercial, District with conditions. The amended proffers would amend
the concept plan and freestanding light pole height. Proffers dealing with building
square footage, building height, signage, screening and buffering, stormwater
management, development phasing, sewer easements, and use restrictions would
be deleted.

disturbed by cutting, grading or other site preparation activity and on which
construction of improvements will be deferred until a later phase of development
will be reasonably restored to a presentable appearance by seeding with grass or
other appropriate groundcover.
9. Upon the request of the Director of Public Utilities for Roanoke County within two

years from the date as of which the land is rezoned, petitioners will grant Roanoke
County a sewer easement not to exceed twenty feet in width and situated adjacent
to the eastern boundary line of the land and extending the entire depth of the land
between the northern and southern boundary lines. Installation of pipe and related
appliances within the easement will be at no expense to the Petitioners. Any
installation will be coordinated in such a manner as wil
intended construction, and any improvements that are damaged or displaced
during the initial construction or subsequent maintenance or replacement activity
will be restored to their former condition at no expense to the Petitioners. The
easement will be otherwise in customary form.
10. Freestanding light poles will be no higher than sixteen feet, and the intensity of
area lighting will not exceed one foot candle on the ground beneath the lamp. Area
lighting will not incorporate metal-halide or halogen lamps.
11. The development will include no commercial banking facility which incorporates
teller service for drive-through vehicle traffic.

EXECUTIVE SUMMARY:
Virginia Interventional Pain & Spine Center is requesting to amend the existing proffered conditions on property that
was rezoned in 1989. The property was never developed and is currently vacant. The applicant is proposing to
amend two of the eleven (11) proffered conditions and remove the other nine (9) conditions. The amended proffered
conditions relate to conformance with the concept plan and the height of freestanding light poles. At this time, only
construction of one building is proposed, although the conceptual plan shows three buildings.
The 1989 rezoning occurred prior to our current Zoning Ordinance being adopted in 1992. Many of the existing
proffered conditions current development
regulations (zoning, stormwater, erosion and sediment control, etc.). The main changes to the development are to
provide for an increase in the overall building square footage allowed, to remove the maximum building height, and to
offer a different layout of the site with the building locations moving closer to Ogden Road with parking to the side or
rear of the buildings.
This site is designated Transition on the future land use map of the Roanoke County Comprehensive Plan. Transition
is a future land use area where orderly development of highway frontage parcels is encouraged. Transition areas
generally serve as developed buffers between highways and nearby or adjacent lower intensity development. Some
appropriate land use types are office, institutional, retail, and multifamily development.
1.APPLICABLE REGULATIONS
The C-1, Low Intensity Commercial, District permits a variety of office and commercial uses as by right uses

(the C-1 District regulations are attached).
2. ANALYSIS OF EXISTING CONDITIONS
Background In 1989, the property was rezoned from R-2, Duplex-Residential District to B-1, Office (now
the equivalent of C-1, Low Intensity Commercial,) for the purpose of building a medical office park which
was never constructed. Many development-related conditions were proffered at this time addressing specific
issues (stormwater, building height, utilites, land disturbance, etc.) that are now handled by current County
development regulations.
Topography/Vegetation The site slopes up from Ogden Road, then is generally flat. There is an additional
slope which is moderately wooded at the rear of the property adjacent to the residential homes, which acts
as a buffer.
Surrounding Neighborhood Single family homes are located to the north and are zoned R-1, Low Density
Residential. The property to the west has an office building on it and is zoned C-1, Low Intensity
Commercial. Properties to the south, across Ogden Road, are zoned R-3, Medium Density Multi-family
Residential, R-4, High Density Multi-family Residential, and C-1, and include vacant land, apartments, and
single family homes. The property to the east is located within the City of Roanoke, is zoned MXPUD,
Mixed Use Planned Unit Development. An assisted living facility is currently under construction on this
property.
3. ANALYSIS OF PROPOSED DEVELOPMENT
Site Layout/Architecture According to the preliminary site schematic submitted with the application, the
professional office park would contain three office buildings located along the Ogden Road frontage.
Parking would be located to the side or rear of the buildings. A substantial portion of the natural buffer along
the rear property line would remain. The applicant has submitted proffered conditions dealing with
conformance with the preliminary site schematic and limiting freestanding light poles to a maximum of 18
feet above grade. A concept sketch of the middle building was provided for informational purposes. Only
one of the buildings (the middle building) would be constructed immediately. The other buildings would be
constructed at a later time.
Access/Traffic Circulation The proposed development would only have one entrance off of Ogden Road.
VDOT has reviewed the application and will require a minor traffic study for possible impacts to Ogden
Road (Route 681). This would be required for any development on this site regardless of the rezoning.
According to VDOT, a full traffic impact analysis would not be warranted for this proposed layout.
Agency Comments:
Economic Development: Economic Development supports the rezoning request by Virginia
Interventional Pain & Spine Center to develop new commercial office buildings on the Ogden Road
site. The proposed development eliminates outdated proffers, is consistent with neighboring
commercial development and supports the economic development goals of the County.
4.CONFORMANCE WITH ROANOKE COUNTY COMMUNITY PLAN
This site is designated Transition on the future land use map of the Roanoke County Comprehensive Plan.
Transition areas are intended to be buffers between major roadways or heavy development and

neighborhood areas. This site is situated between a low density residential development and a heavily
trafficked road and office is a suitable use in Transition future land use areas. This proposal is consistent
with the Comprehensive Plan.
5.STAFF CONCLUSIONS
Virginia Interventional Pain & Spine Center is requesting to amend existing proffered conditions related to a
rezoning from 1989 form R-2 to B-1 for the intention of building a professional office park. The property was
never developed after the previous rezoning and many of the conditions no longer apply as they are
regulated by County ordinances. The parcel is situated between a medical office and an assisted living
facility and is located on major road. This proposed use in consistent with the surrounding land uses and
any impact of the residential property in the rear can be mitigated through the required buffer yard.

SEC. 30-53. C-1 LOW INTENSITY COMMERCIAL DISTRICT.
Sec. 30-53-1. Purpose.
(A) The purpose of the C-1 low intensity commercial district is to provide for the
development of attractive and efficient office and commercial uses in the urban service
area which serve both community and county-wide needs. The C-1 district allows for
varying intensities of office and commercial development as part of either a planned
office complex or, to a limited degree, small scale office and commercial uses. The C-1
districts are most appropriately found along or near major arterial streets where existing
commercial development has occurred and/or where commercial zoning has been
established, or near existing residential development where it would serve as a logical
buffer strip between conflicting land use types. Land uses permitted in the C-1 district are
generally consistent with the recommendations set forth in the transition and core land
use categories of the comprehensive plan. Site development standards are intended to
ensure compatibility with adjacent land uses.

Sec. 30-53-3. Site Development Regulations.
General Standards. For additional, modified, or more stringent standards for specific uses, see
Article IV, Use and Design Standards.
(A) Minimum lot requirements.
1. Lots served by private well and sewage disposal system;
a. Area: 1 acre (43,560 square feet).
b. Frontage: 100 feet on a publicly owned and maintained street.
2. Lots served by either public sewer or water, or both:
a. Area: 15,000 square feet.
b. Frontage: 75 feet on a publicly owned and maintained street.
(B) Minimum setback requirements.
1. Front yard:
a. Principal structures: 30 feet, or 20 feet when all parking is located behind
the front building line.
b. Accessory structures: Behind front building line.
2. Side yard: None.
3. Rear yard:
a. Principal structures: 15 feet.
b. Accessory structures: 3 feet.
4. Where a lot fronts on more than one (1) street, front yard setbacks shall apply to
all streets.
(C) Maximum height of structures.

1. Height limitations:
a. Principal structures: When adjoining property zoned R-1 or R-2, forty-five
(45) feet, including rooftop mechanical equipment. The maximum height
may be increased, provided each required side and rear yard adjoining the
R-1 or R-2 district is increased two (2) feet for each foot in height over
forty-five (45) feet. In all other locations the height is unlimited unless
otherwise restricted by this ordinance.
b. Accessory structures: 15 feet.
(D) Maximum coverage.
1. Building coverage: 50 percent of the total lot area.
2. Lot coverage: 80 percent of the total lot area.

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER ON THURSDAY, JANUARY 22, 2019
ORDINANCE AMENDING PROFFERED CONDITIONSON
APPROXIMATELY 3.2 ACRES ZONED C-1C (LOW INTENSITY
COMMERCIAL DISTRICT WITH CONDITIONS), LOCATED IN OR
NEAR THE 3300, 3400, AND 3500 BLOCKS OF OGDEN ROAD, CAVE
SPRING MAGISTERIAL DISTRICT(TAX MAPNO. 077.11-01-58.00-
0000)
WHEREAS,the property located at 0 Ogden Road (Tax Map No. 077.11-01-
58.00-0000), in the Cave Spring Magisterial District, was rezoned in 1989 from R-2
(Duplex Residential District) to B-1 (Office District, which is now the equivalent the
County’s present classification of C-1, Low Intensity Commercial District), fur the
purpose of building a medical office park which was never constructed; and
WHEREAS, many development-related conditions were proffered in 1989 at the
time of rezoning, addressing specific issues that are now addressed by the County’s
current development regulations; and
WHEREAS, Virginia Interventional Pain and Spine Center is requesting to amend
the proffered conditions associated with this property by removing all prior conditions
and replacing them with the following conditions:
1.The site will be developed in general conformance with the titled Preliminary Site
Schematic Plan for Ogden Road, Professional Park concept plan as prepared by
Craighead and Associates, dated 10/23/2018, and
2.All freestanding pole mounted site lighting will not exceed eighteen (18’) feet from
grade; and

WHEREAS, the first reading of this ordinance was held onDecember 18, 2018,
and the second reading and public hearing were held on January 22, 2019; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on January2, 2019,and subsequently recommended approval of the
application; and
WHEREAS, legal notice and advertisement has been provided as required by
law.
BE IT ORDAINEDby the Board of Supervisors of Roanoke County, Virginia, as
follows:
1.The request to amendthe proffered conditions on property located at 0
Ogden Road (Tax Map No. 077.11-01-58.00-0000), in the Cave Spring
Magisterial District,is approved. The prior proffered conditions associated
with this property are removed and replaced with the followingnew proffered
conditions:
a.The site will be developed in general conformance with the titled
Preliminary Site Schematic Plan for Ogden Road, Professional Park
concept plan as prepared by Craighead and Associates, dated
10/23/2018, and
b.All freestanding polemounted site lighting will not exceed eighteen
(18’) feet from grade.
2.In approving the above, the Board finds that:

a.The amendments to the proffered conditions are consistent with the
purpose and intent of the County’s Comprehensive Plan and good
zoning practice;
b.The 1989 rezoning gave rise for the need for the originally proffered
conditions;
c.The County’s Zoning Ordinance was subsequently adopted in 1992
and covers many of the issues raised in the originally proffered
conditions;
d.The new proffered conditions have a reasonable relation to the 1989
rezoning, are in conformity with the Comprehensive Plan, are clearly
understood and enforceable, and do not require or allow a design or
standard that is less restrictive than the general provisions of the
County’s Zoning Ordinance; and
e.All of the other prior proffered conditions that are proposed to be
removed are now covered under the County’s current development
regulations or are no longer desirable.
3.This ordinance shall be in full force and effect thirty (30) days after its final
passage. All ordinances or part of ordinances in conflict with the provisions of
this ordinance shall be, and the same hereby are, repealed. The Zoning
Administrator is directed to amend the zoning district map to reflect the
changesauthorized by this ordinance.
