Billed as a revolutionary new brand in the Hilton portfolio, the new Tru by Hilton made its entry into the Roanoke market in 2018. This is the first hotel in the region for this corporate brand. The 4 story hotel has 82 new rooms with an $8 million investment and has created more than 30 new jobs. The opening of this hotel is exactly the type of business investment Roanoke County encourages in the Hollins area. It also coincides with the Plantation Road Transportation Enhancement Project as a key economic development strategy for the Page 1 of 2 Hollins Planning Study Area. In addition to the review and comments related to the County's legislative agenda, staff will present an overview of initiatives undertaken by staff to complement the services provided by Eldon James & Associates. BACKGROUND: Each year, the Roanoke County Board of Supervisors adopts a formal agenda of Legislative Issues for the upcoming General Assembly Session. That process begins legislative issues over the summer months to be addressed during the upcoming General Assembly session. Draft legislative issues are developed in conjunction with our legislative liaison, citizens who provide input, regional group dialogues and discussions with local legislators. Members of the Board of Supervisors are also requested to provide input into the draft legislative agenda. Development of the legislative agenda culminates with a presentation to the Board of Supervisors, typically in October of each year, and a request of the Board for formal adoption of the agenda. Subsequent to adoption of the County's legislative agenda, staff works with Board Page 1 of 2 Members, our local legislative delegation and our legislative liaison to promote the interests of the County. DISCUSSION: While awaiting resolution of the 2019 session of the Virginia General Assembly, staff began its annual process of identifying and researching legislative issues for the 2020 session. Staff has identified the following legislative issues to monitor: a) Budget/State revenues b) Local fiscal stress study c) Federal health care decisions and their impact on the Commonwealth and region d) Local mandates e) Federal withholding of regional transit funding f) Public notices legislation g) Behavioral Health work group h) Wireless infrastructure work group i) Transportation j.) Explore Park Following is a draft legislative calendar for the 2020 General Assembly session: May 14, 2019 Briefing with Board of Supervisors June-August 2019 Staff development of potential issues Preliminary meetings with local legislators September 2019 Regional legislative agenda discussions Development of draft County legislative agenda October 2019 Formal Adoption of Legislative Agenda by BOS November-December 2019 Follow-up meetings with local legislators January-February 2020 General Assembly Session Staff will provide regular updates on issues identified in the legislative briefing and will schedule additional opportunities for the Board to discuss potential initiatives for the 2020 Legislative Agenda. E.1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 14, 2019 AGENDA ITEM: Request to amend the scope of services for the Professional Engineering Services Contact with Draper Aden Associates for the Dixie Caverns Landfill Leachate Management Upgrade SUBMITTED BY: Tarek Moneir Acting Director of Development Services APPROVED BY: County Administrator ISSUE: To amend the Professional Engineering Services Contact with Draper Aden in excess of 125% of the original contract award amount. Under State Code, Board approval is required before the County may execute this amendment. BACKGROUND: Roanoke County has an on-going project, approved by the Board under its Capital Improvement Program, to upgrade the leachate management system at the Dixie Caverns landfill. The purpose of this upgrade is to increase the capacity of the existing leachate management system and enhance the ability to store excess leachate generated by significant rain events. The project would also replace aging equipment and system controls. DAA was selected through a qualifications based, competitive process to provide engineering services for this project. The identified services included initial investigations, concept and preliminary (65%) design, final design, bidding services, and construction phase services. Due to a number of unknowns in the scope of the project at its outset, only the concept and preliminary design phase services were initially authorized. After this initial work was completed the original plan was to add the additional scopes of work as the overall Page 1 of 3 scope and design of the project was better understood based on an evaluation of the existing system and a geotechnical investigation. The original contract was executed on August 31, 2015, for a lump sum of $51,233 for concept planning and preliminary design services. On January 1, 2016, based on the initial investigatory work, Amendment 1 was executed for additional geotechnical services to further investigate and identify sources of subsurface water. The cost of Amendment 1 was $12,825 which increased the total contract cost to $64,058. DAA has completed all of their contracted tasks included in the initially awarded work. On May 23, 2017, the Board amended the original contract following recommendation from the staff. This amendment increased the contract by $103,077 ($75,535 final design and bidding services and $27,542 for construction phase services) with an additional $12,000 project contingency which brought the total contract amount to $179,135. During this design process, it was determined that there may be other alternatives that would be more appropriate and result in long-term cost savings to the County. The requested authorization to amend this contract would allow DAA to perform required testing, analysis, and other support activities to evaluate alternatives. This additional study is needed to select the option that will provide the best value to the County and deliver it to construction. Once the preferred alternative is determined, staff will report back to the Board prior to proceeding with construction. Amendment Requested Total $249,135.00 Page 2 of 3 DISCUSSION: DAA was originally selected to provide professional services through a competitive, qualification based selection process. As a result of the proposed contract amendment exceeding 125% of the original award amount, staff has considered the option of re- procuring these services in a second process. However, it is the opinion of staff that such an exercise would neither produce a substantively more qualified bidder nor reduce the expected project costs. Further, re-procuring these professional services will likely result in additional commitment of staff time to administer a second procurement process, potentially increase consultant costs, and delay project implementation. For these reasons, staff is recommending the Board authorize the recommended contract amendments. FISCAL IMPACT: Funding for this project is fully appropriated through the County's Capital Improvement Program. Approval of this item as requested will not result in additional fiscal impact to the County. BACKGROUND: State Code requires a public hearing to receive written and oral comments on the proposed fiscal year 2019-2020 Operating Budget and the proposed fiscal year 2020- 2029 Capital Improvement Program. A public hearing on the operating and capital budgets was held on April 9, 2019, thereby satisfying State Code requirements. This public hearing provides an additional opportunity for citizen comment on the proposed operating and capital budgets in advance of first reading of budget ordinances scheduled for May 14, 2019. DISCUSSION: This time has been set aside for a public hearing on the proposed annual budget for fiscal year 2019-2020 and the proposed fiscal year 2020-2029 Capital Improvement Program. The public hearing was advertised in the Roanoke Times on April 30, 2019 and May 7, 2019. The budget documents can be found on the Roanoke County website at www.roanokecountyva.gov, at any of the County libraries, and at the Roanoke County Office of Management and Budget or Office of the Clerk of the Board of Page 1 of 2 Supervisors, located at 5204 Bernard Drive, Roanoke, Virginia 24018. FISCAL IMPACT: There is no fiscal impact associated with this public hearing. STAFF RECOMMENDATION: Staff recommends conducting the public hearing to receive citizen comments on the proposed annual budget for fiscal year 2019-2020 and the proposed fiscal year 2020- 2029 Capital Improvement Program. BACKGROUND: The fiscal year 2019-2020 operating budget was presented to the Board of Supervisors on March 12, 2019. Prior to that, the fiscal year 2020-2029 Capital Improvement Program (CIP) was presented to the Board of Supervisors on January 22, 2019. Budget work sessions with the Board of Supervisors were held on February 12, 2019, February 26, 2019, March 26, 2019, April 9, 2019 and April 23, 2019. Public hearings on the budget were held on April 9, 2019 and May 14, 2019, to receive written and oral comment from the public concerning the proposed fiscal year 2019- Page 1 of 3 2020 budget and the proposed fiscal year 2020-2029 Capital Improvement Program. Details of all proposed changes by the Board of Supervisors since the County Administrator proposed the capital budget on January 22, 2019, and operating budget on March 12, 2019, are included as an attachment to this board report form. Attached for your approval are five budget appropriation ordinances for fiscal year 2019- 2020 and the Classification and Pay Plan for fiscal year 2019-2020. In order to separate RCPS funding from County funding and more clearly distinguish the appropriations of the Board of Supervisors, County staff has divided the appropriation into five ordinances. Each ordinance will be voted on separately. DISCUSSION: The total County budget for fiscal year 2019-2020 is $462,618,662, which includes all inter-fund and intra-fund transfers and all Schools funds. The County General Government Fund totals $196.94 million and is appropriated as part of the County's operations ordinance ($115.50 million) and the transfers to and on behalf of Schools ordinance ($81.44 million). The budget is recommended to be appropriated in five separate budget ordinances. (a) The first budget ordinance provides funding in the amount of $168,955,692 in fiscal year 2019-sfers to and on behalf of the Schools. The ordinance also approves the County's Classification and Pay Plan for fiscal year 2019-2020. (b) The second budget ordinance provides funding in the amount of $27,524,873 in fiscal year 2019-2020 for the County's capital budget including the first year of the ten-year Capital Improvement Program. (c) The third budget ordinance provides funding in the amount of $81,441,128 in fiscal year 2019-2020 for transfer to and on behalf of Roanoke County Public Schools. Transfers include operating funding as part of the County and Schools revenue sharing agreement, and transfers on behalf of the Schools to the Debt Fund and Children's Services Act Fund. (d) The fourth budget ordinance provides funding in the amount of $182,849,469 in fiscal year 2019-2020 for Schools operations and School Debt Fund. (e) The fifth budget ordinance provides funding in the amount of $1,847,500 in fiscal year 2019-2020 for the Schools' capital budget including the first year of the ten- year Capital Improvement Program. Page 2 of 3 FISCAL IMPACT: Approval of the fiscal year 2019-2020 budget appropriation ordinances provides funding for County and Schools operations, transfers and capital budgets effective July 1, 2019. STAFF RECOMMENDATION: Staff recommends approval of the first reading of the five fiscal year 2019-2020 budget appropriation ordinances. Staff also recommends approval of the attached Classification and Pay Plan for fiscal year 2019-2020 and scheduling second reading of the five (5) ordinances for May 28, 2019. Page 3 of 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 14, 2019 ORDINANCE APPROPRIATING FUNDS FOR THE 2019-2020 FISCAL YEAR OPERATIONS BUDGET AND APPROVAL OF THE CLASSIFICATION AND PAY PLAN FOR FISCAL YEAR 2019-2020 FOR ROANOKE COUNTY, VIRGINIA WHEREAS, upon notice duly published in the newspaper, public hearings were held on April 9, 2019 and May 14, 2019, concerning the adoption of the annual budget for Roanoke County for fiscal year 2019-2020; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved said budget on May 28, 2019, pursuant to the provisions of Section 13.02 of the Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as amended; and WHEREAS, the first reading of this appropriation ordinance was held on May 14, 2019, and the second reading of this ordinance was held on May 28, 2019, pursuant to the provisions of Section 18.04 of the Roanoke County Charter. G.2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 14, 2019 AGENDA ITEM: Ordinance amending Section 10-3 (Levying of License Fees and Taxes) of the Roanoke County Code, raising the threshold of annual gross receipts for those entities required to pay the County Business License Tax (from $125,000 or more to $135,000 or more); and requiring entities that are below the threshold to pay only an annual $50 license fee SUBMITTED BY: Rebecca Owens Assistant County Administrator APPROVED BY: County Administrator ISSUE: Amending Section 10-3 of the Roanoke County Code to raise the threshold of annual gross receipts from $125,000 to $135,000 for entities required to pay the County's Business, Professional, and Occupational License (BPOL) Tax. Entities below the new $135,000 gross receipts threshold will pay only an annual $50 dollar license fee. BACKGROUND: The County of Roanoke currently levies a $50 annual license fee for entities operating in the County with gross receipts under $125,000. Entities with gross receipts over $125,000 pay an annual business license tax, with rates based on the category of business. During the fiscal year 2019-2020 budget development process, information on the Business, Professional, and Occupational License (BPOL) Tax was requested by the Board of Supervisors. That information was provided through budget memos #5 and #7 and is attached for reference. Page 1 of 2 DISCUSSION: At the April 23, 2019 budget work session, the Board of Supervisors achieved consensus on raising the gross receipts threshold from $125,000 to $135,000 for which only a $50 fee is levied. To make this change, County Code will be required to be amended, and the County Administrator's proposed budget revised to account for a reduction in BPOL revenue. FISCAL IMPACT: Increasing the gross receipts threshold from $125,000 to $135,000 for which only a $50 fee is levied is estimated to reduce BPOL revenue by approximately $31,000. County staff has accounted for that revenue reduction in the fiscal year 2019-2020 County operating budget ordinance to be presented for consideration at the May 14, 2019 Board of Supervisors meeting. STAFF RECOMMENDATION: Amending the County Code to adjust the gross receipts threshold requires a public hearing and two readings of an ordinance. Staff recommends approval of the first reading of this ordinance, and scheduling a public hearing and second reading for May 28, 2019. Page 2 of 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 14, 2019 ORDINANCE AMENDING SECTION 10-3 (LEVYING OF LICENSE FEES AND TAXES) OF THE ROANOKE COUNTY CODE, RAISING THE THRESHOLD OF ANNUAL GROSS RECEIPTS FOR THOSE ENTITIES REQUIRED TO PAY THE COUNTY BUSINESS LICENSE TAX (FROM $125,000 OR MORE TO $135,000 OR MORE); AND REQUIRING ENTITIES THAT ARE BELOW THE THRESHOLD TO PAY ONLY AN ANNUAL $50 LICENSE FEE WHEREAS, Section 58.1-3703 of the Code of Virginia (1950), as amended, authorizes localities to enact an ordinance levying a local license tax and/or fee for issuing a business license; and WHEREAS, Section 10-3(1) of the County Code presently imposes a fifty dollar ($50) annual license fee upon those entities whose annual gross receipts (during the prior year) are less than one hundred twenty-five thousand dollars ($125,000); and WHEREAS, Section 10-3(2) of the County Code presently imposes an annual license tax upon those entities whose annual gross receipts (during the prior year) from a business, trade, profession, occupation or calling are one hundred twenty-five thousand dollars ($125,000) or greater; and WHEREAS, in order to encourage and benefit small businesses in Roanoke County, it is proposed that the above County Code provisions be amended to 1) raise the threshold of annual gross receipts for those entities required to pay the County business license tax from one hundred twenty-five thousand dollars ($125,000) or more to one hundred thirty-five thousand dollars ($135,000) or more, and 2) require that entities below the threshold to pay only the annual fifty dollar ($50) license fee; and Page 1 of 3 WHEREAS, the first reading of this ordinance was held on May 14, 2019, and the public hearing and second reading was held on May 28, 2019. NOW THEREFORE BE IT ORDAINED by the Roanoke County Board of Supervisors as follows: 1. That Sections 10-3(a)(1) and (2) of the Roanoke County Code are hereby amended as follows: Sec. 10-3. - Levying of license fees and taxes. (a) Subject to the limitations provided in § 58.1-3703.C. of the Code of Virginia (1950, as amended), and except as otherwise specifically provided for in this chapter of the Roanoke County Code, there are hereby imposed and levied for each and every year, beginning with January 1 of each year and ending December 31 following, and there shall be collected the following license fees and taxes upon the privilege of doing business or exercising a profession, trade, occupation or calling, including all phases thereof, in the county, which license fees and taxes shall be for the support of the county government, payment of the county debt, and for other county and public purposes: (1) There is hereby imposed and there shall be collected an annual license fee in the amount of fifty dollars ($50.00) for issuance of a license on businesses, trades, professions, occupations and callings and upon the persons, firms and corporations engaged therein within the county; provided, however, that this license fee shall not be charged to any person whose gross receipts from a business, trade, profession, occupation or calling are one hundred twenty-five thousand dollars ($125,000.00) one hundred thirty-five thousand dollars ($135,000.00) or greater during the preceding calendar year and who is subject to levy and payment of the annual license taxes as provided in subsection (a)(2) hereof; and (2) There is hereby levied and there shall be collected the annual license taxes at the rates and in the amounts hereinafter set forth in this chapter upon any person, firm, or corporation engaged in a business, trade, profession, occupation or calling subject to licensure in the county. Except as may be otherwise authorized by specific or special provisions of chapter 37 (§ 58.1-3700 et seq.) of the Code of Virginia, 1950, as amended, and this chapter of the Roanoke County Code, the annual license taxes shall not be imposed upon any person whose gross receipts from a business, profession, trade, occupation or calling are less than one hundred twenty-five thousand dollars ($125,000.00) one hundred thirty-five thousand dollars ($135,000.00) during the preceding calendar year. BACKGROUND: · In 2005, the Explore Park (EP) Zoning District was amended to address Virginia resort. · In 2013, Roanoke County assumed responsibility for the stewardship of the Explore Park property, and the development of recreational amenities for public enjoyment of the Park. · In 2016, the Board of Supervisors adopted the Explore Park Adventure Plan. DISCUSSION: Over the past six (6) months, Planning staff has worked with Parks, Recreation and Tourism staff, the Virginia Recreational Facilities Authority and the Planning Commission on proposed amendments to the EP Zoning District. The proposed amendments would update the zoning regulations to be consistent with the adopted Explore Park Adventure Plan, while removing other regulations that were established for The proposed amendments would revise the EP District in Article III (District Page 1 of 2 Standards): by amending the purpose, applicability, and permitted use sections; by adding development regulations; and by deleting the rezoning application process. The proposed amendments would also revise the use and design standards in Article IV (Use and Design Standards) for the following uses in the EP District: public maintenance and service facilities, automobile rental/leasing, minor automobile repair services, campground, convenience store, gasoline station, drive-in or fast food restaurant, and transportation terminal. The Planning Commission held a public hearing on the proposed amendments on May 6, 2019. No citizens spoke during the public hearing. The Planning Commission regarding the Explore Park (EP) District. FISCAL IMPACT: There is no funding issue on this agenda item. STAFF RECOMMENDATION: Staff recommends that the Board of Supervisors approve the first reading of the ordinance to amend the Roanoke County Zoning Ordinance and schedule the public hearing and second reading for May 28, 2019. Portions of this section (30-71-3 (C) 1 a & b) have been added to the Site Development Regulations (30-71-4 (G)). Subsections 30-71-3 (C) 1 c & d were deleted. 30-71-3 (D) Permitted Uses Deleted entire section since uses allowed by special use have been moved to the revised 30-71-3 (B). 30-71-4 (Old) Rezoning Deleted entire section. This section was established Application for Virginia Living Histories, Inc. to go through the Process rezoning process in 2005. Sec. 30-71-2. Applicability. (A) These regulations shall only apply to land in the County of Roanoke owned or leased by the Virginia Recreational Facilities Authority (VRFA), Virginia Living Histories, Inc. or the County of Roanoke associated with Explore Park, and to any facilities, and/or operations on such land. Sec. 30-71-3. Permitted Uses. (A) The following uses are permitted by right subject to all other applicable requirements contained in this ordinance. Buildings and other structures, streets and other paving, utilities, filling, grading, and excavating shall be included in the calculation of developed area. b. Any pasture, crop land, forested areas, trails, ponds other than stormwater detention areas, recreated natural features, buffers and similar open or yard areas shall not be calculated as developed areas. c. During site development review, the limits of disturbance for each development shall be identified in order to calculate developed areas. In addition, the identification and calculation of open space, forested space, trails, buffers and natural areas shall be provided on an ongoing basis in order to confirm compliance with the 70%/30% ratio. d. So long as the 70%/30% ratio is maintained, the location of open space, forested space, trails, buffers or natural areas may be shifted as development proceeds. (D) The following uses are allowed only by special use permit pursuant to section 30-19. (A) Prior to submitting an application for review and approval under these provisions, the applicant and the county staff shall confer to discuss the requirements of this section. The purpose of the meeting is to obtain a mutual understanding of the application requirements and process. (B) Any application to rezone land to the EP designation shall constitute an amendment to the zoning ordinance pursuant to Section 30-14. Once the board of supervisors has approved the master plan described below, all submitted and accepted proffers shall constitute conditions pursuant to the provisions of this ordinance. Development shall occur in substantial conformity with the specifics set out in the master plan. (C) To initiate an amendment, the applicant shall complete a rezoning application packet. This information shall be accompanied by graphic and written information which shall constitute a master plan. All information submitted shall be of sufficient clarity, detail, Page 6 of 12 and scale to clearly and accurately identify the location, nature and character of the proposed district. The information shall include: 1. A legal description of the proposed site. This may be a metes and bounds description and plat, or a tabular summary of all tax map parcels proposed for rezoning. If tax parcels are used, a composite plan shall be submitted, showing the limits of the proposed district and the location of each parcel within the district. Should survey or title work disclose that any parcel or portions thereof were erroneously included in the rezoning application, then the applicant may remove said parcels from the application without invalidating the rezoning of the other submitted parcels 2. Current information on the existing zoning and land use of each parcel proposed for the Park. 3. A topographical survey of the proposed site including information on flood plains and natural water courses. 4. Minimum buffers between the Park and its neighbors and general details on the landscaping within such buffers. 5. Information on open space, including how such space might be utilized for hiking, biking and riding trails or other park uses. 6. Generalized statements pertaining to architectural and community design guidelines. 7. Description of transportation objectives, identifying current and proposed connections with state maintained roads with maintenance responsibility for non- state maintained roads identified. Include connections to intermodal transportation systems as shown in the Community Plan. 8. Information on proposed plans for public utilities. 9. Inventory of historic resources. (D) The completed rezoning application and supporting master plan shall be submitted to the planning commission for review and analysis. The commission shall review this information and make a report of its findings to the board of supervisors. The commission shall as part of its review hold a public hearing pursuant to section 15.2-2204 of the Code of Virginia, as amended. (E) The commission shall make a report of its findings to the board of supervisors within 90 days of the receipt of the materials, unless the applicant requests, or agrees to an extension of this time frame. The commission's report shall recommend approval, approval with modifications, or disapproval of the master plan for the Park. Failure of the Page 7 of 12 commission to make a report of its findings to the board of supervisors within this period shall constitute a commission recommendation of approval. (F) If the commission recommends denial of the master plan or approval with modifications, the applicant shall, upon its request, have up to sixty (60) days to make any modifications. If the applicant desires to make any modifications to the master plan, the board of supervisors' review and action shall be delayed until such changes are made and submitted for review. (G) The board of supervisors shall review the master plan and act to approve or deny the plan within ninety (90) days from the date of the planning commission's action unless the applicant requests or agrees to an extension of this time frame. The plan approved by the board of supervisors shall constitute the approved master plan for the Park. Once approved by the board of supervisors, the administrator shall authorize the revisions to the official zoning map to indicate the establishment of the EP district. (H) Should major changes to the master plan be desired, the applicant has the right to amend the master plan by following the process detailed in sections D through G above. (I) Following the approval of the master plan (which approval signifies that the proposed site is rezoned to the EP district), the applicant shall be required to submit preliminary and final site development plans prior to construction for approval. Final site development plans for any phase or component of the Park that involves the construction of structures or facilities shall be approved prior to the issuance of a building permit and the commencement of construction. Sec. 30-71-4. Site Development Regulations. General Standards. For additional, modified, or more stringent standards for specific uses, see Article IV, Use and Design Standards. (A) Setbacks. Minimum setback requirements for structures from exterior lot lines and public roads: 1. Front yard: 30 feet, or 20 feet when all parking is located behind the front building line. 2. Side yard: 10 feet. 3. Rear yard: 15 feet. (B) Height. Maximum structure height shall be 45 feet including rooftop mechanical. The maximum height may be increased provided each required yard (front, side, rear, or buffer) from an exterior property line is increased two (2) feet for each foot in height over forty-five (45) feet, up to a maximum height of 125 feet. Zip line towers and observation towers shall be exempt from this section. Page 8 of 12 (C) Signage. All visible signs from public right-of-way shall be no higher than 25 feet and shall have a consistent design treatment. (D) Buffers. When Explore Park development adjoins a residential or civic use type exterior to the Explore Park District boundaries, a Type C buffer yard in accordance with section 30-92 shall be provided along the property line which adjoins the residential or civic use type. (E) Lighting. All exterior lighting fixtures shall be designed, located and arranged so as not to direct glare on adjoining streets or surrounding properties. The lighting intensity at adjoining properties exterior to the Explore Park District shall not exceed 0.5 foot candles. (F) Roads. Roads within the Explore Park District may be public or private. Private roads shall provide for emergency access. (G) Open Space/Developed Area. Within the Park, there shall be limits on developed areas in order to ensure that at least 30% of the acreage of the Park, within the jurisdiction of the County of Roanoke, consists of open space, forested space, trails, buffers or natural areas. To achieve that objective, those uses which are identified in Sec. 30-71-3 (A) and (B) shall not exceed 70% of the Park's acreage in the County of Roanoke. 1. Calculation of Developed Area ratio. a. (A) In the EP district, these facilities shall be used to service and maintain only EP district properties and/or access thereto. SEC. 30-85. COMMERCIAL USES. Page 9 of 12 Sec. 30-85-4.5. Automobile Rental/Leasing. (A) In the EP district: 1. Shall be permitted only with a special use permit. Sec. 30-85-6. Automobile Repair Services, Minor. (A) General standards: 1. Exterior display or storage of new or used automobile parts is prohibited. 2. Equipment and vehicles stored overnight on the premises shall be behind the front building line or at least thirty-five (35) feet from the public right-of-way, whichever is greater. (C) Additional standards in the EP district. 1. There shall be a maximum of four (4) service bays, one (1) of which may be oversized to permit a bus or recreational vehicle to pull though for service. 2. Where adjoining a residential or civic use type, a minimum one hundred-foot setback shall be required. 3. No independent advertising through local media shall call attention to the Explore Park location of the business. Sec. 30-85-8.5. Business Support Services. (A) In the EP district, the following shall apply: 1. No independent advertising through local media shall call attention to the Explore Park location of the business. Sec. 30-85-9. Campground. (B) In the EP district, the following shall apply: 1. Year-round residence(s), including a manufactured home or recreational vehicle, or residence in addition to other facilities on the property. Sec. 30-85-13. Convenience Store. (A) General standards: Page 10 of 12 1. Limited sale of foods prepared on the premises may be allowed provided no more than twenty (20) percent of the floor areas is devoted to seating facilities. Seating areas in excess of this shall constitute a fast food restaurant. 2. Exterior display of merchandise for sale is allowed under the following conditions: a. On a paved walkway within three (3) feet of the building. b. Ice machines and soft drink vending machines, in operating condition, shall be stored under roofed areas. 3. The display of vehicles "for sale" is prohibited. (D) Additional standards in the EP district: 1. No convenience store shall exceed three thousand (3,000) square feet of gross floor area. 2. Where adjoining a residential or civic use type, a minimum one hundred-foot setback shall be required. 3. No independent advertising through local media shall call attention to the Explore Park location of the business. Sec. 30-85-16. Gasoline Station. (A) General standards: 1. Bulk storage of fuel shall be underground pursuant to the standards established by the National Fire Prevention Association (NFPA) and the U.S. Environmental Protection Agency (EPA). 2. Fuel dispensers shall be located at least thirty (30) feet from any public street right-of-way, and shall be located at least one hundred (100) feet from any adjoining residential use type. 3. When adjoining a residential use type, a Type C buffer yard in accordance with section 30-92 shall be provided along the property line which adjoins the residential use type. (C) Additional standards in the EP district: 1. No more than four (4) stations designed for dispensing fuel shall be located on site. Page 11 of 12 2. Where adjoining a residential or civic use type, a minimum one hundred-foot setback shall be required. 3. No independent advertising through local media shall call attention to the Explore Park location of the business. Sec. 30-85-24. Restaurant, Drive-in or Fast Food. (A) General standards: 1. All drive-through windows shall comply with the standards for drive-through facilities contained in Section 30-91-6. 2. A special use permit shall not be required for any fast food restaurant that is located within a shopping center. 3. Expansions of existing uses are permitted by right. (B) In the EP District: 1. A special use permit shall be required for any drive through facilities. Sec. 30-85-24.5. Retail Sales. (B) In the EP District: 1. A special use permit shall be required for any retail sales use, building or structure that exceeds fifty thousand (50,000) square feet of gross floor area. SEC. 30-86. INDUSTRIAL USES. Sec. 30-86-11. Transportation Terminal. (A) In the EP district the following standards shall apply: 1. This use is provided to allow various visitor transportation access options to be constructed within the Park. 2. Typical uses include train depot, marina, bus loading and unloading areas, and visitor shuttle services. 2. That this ordinance shall be in full force and effect immediately. Page 12 of 12 ACTION NO. H.1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 14, 2019 AGENDA ITEM: Ordinance approving a lease with Anbaja Enterprisesto provide food and beverage services in Explore Park at Brugh Tavern SUBMITTED BY: Doug Blount Director of Parks Recreation and Tourism APPROVED BY: County Administrator ISSUE: Approve a lease with Anbaja Enterprises to provide food, beverage and retail services at Brugh Tavern in Explore Park BACKGROUND: Roanoke County signed a 99-year lease for Explore Park in 2013 with the Virginia Recreational Facilities Authority. As a part of the lease requirements, Roanoke County developed a master plan for the park. The master plan laid out a detailed approach to providing recreational amenities through public and private offerings to develop the park into a destination for local citizens and tourists from outside of Virginia's Blue Ridge. In 2016, the Roanoke County Board of Supervisors approved the Adventure Plan for Explore Park, which outlined the direction for the park's development. As a part of the Adventure Plan and Business Plan for Explore Park, it outlined the public-private partnerships necessary for the park to develop into a destination facility. One of the services identified in the Adventure Plan was providing food and beverage services in Brugh Tavern. Brugh Tavern was built between 1792-1800 and originally located near the Great Wagon Road in Botetourt County. Brugh Tavern was relocated to Explore Park and dedicated on April 28, 1998, as an upscale, historic-ambiance restaurant. The main body of the building and industrial kitchen were added when the building was relocated. Page 1 of 3 One of the main highlights of the beautiful building is a basement area with stone walls and floors. Roanoke County issued a Request for Proposal #2019-058 on November 9, 2018 for Food, Beverage, Programming, RV Camping and Retail Services at Roanoke County's Explore Park. Roanoke County received two proposals for RFP #2019-058. Proposals were due on January 9, 2019. Anbaja Enterprises, doing business as Twin Creeks Brewing Co. is an existing Roanoke County business operating a craft brewery in the Town of Vinton. DISCUSSION: Twin Creeks Brewing Co. submitted a proposal to operate a craft brewery and bistro in Brugh Tavern as their second Roanoke County location. Twin Creeks Brewing Co. will brew beer onsite with a 1/2 BBL brewhouse as well as offer cider and Virginia wines. In the beginning phase of the project, Twin Creeks Brewing Co. will partner with local food trucks to offer a variety of food options. In 2020, they will open a kitchen in Brugh Tavern with a local sourced menu as a bistro. Twin Creeks Brewing Co. plans to open the Brugh Tavern on a seasonal basis starting in late summer/early fall. Brugh Tavern will be open on Friday evenings, Saturdays and Sundays. Brugh Tavern will be open to compliment the special events at Explore Park such as Halloween events and Illuminights. Twin Creeks Brewing Co. will also offer Explore Park specific merchandise. Twin Creeks Brewing Co. will work with Roanoke County Parks, Recreation and Tourism and other Explore Park vendors to create cooperative marketing campaigns and travel packages for tourists. Twin Creeks Brewing Co. will offer weekend music entertainment outside of Brugh Tavern on the lawn. They will build six (6) fire pits on the lawn of Brugh Tavern for placemaking. Twin Creeks Brewing Co. will construct, maintain and supervise the fire pit operation. With this expansion of the craft brewery, it will create 4-6 new jobs. Roanoke County will construct a new grease trap for Brugh Tavern and install electrical outlets for food truck operations. This provides approximately $15,000 investment to support the opening of Brugh Tavern. Roanoke County will also start up the building systems, elevator and outside refrigeration equipment and maintain them during the lease. Page 2 of 3 Twin Creeks Brewing Co. is responsible for the maintenance of the commercial food equipment in the building as well as all utility costs of Brugh Tavern. Twin Creeks is also responsible for any damages to the building from their lease. The initial lease is for three (3) years with two-five (5) year extensions for a maximum of thirteen (13) years. There has been one change since the first reading of the ordinance on April 23, 2019. Twin Creeks Brewing Co. has requested to be the exclusive, fixed-location restaurant with on-premise dining at Explore Park for the initial term of the agreement. This is to ensure that the company is able to meet food sales requirements. Roanoke County staff agrees with the change. FISCAL IMPACT: Twin Creeks Brewing Co. will pay 2% of NET profits for the first 6 months of operations, thereafter the percentage escalates to 4% of NET profits for the initial term of the lease. Roanoke County Parks, Recreation and Tourism will incur the startup costs for Brugh Tavern by servicing all building systems, elevator and commercial refrigeration equipment. Page 3 of 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 14, 2019 ORDINANCE APPROVING A LEASE WITH ANBAJA ENTERPRISES, TO PROVIDE FOOD AND BEVERAGE SERVICES IN EXPLORE PARK AT BRUGH TAVERN WHEREAS, the County is the Lessee of a ninety-nine year lease for Explore political subdivision of the Commonwealth of Virginia; and WHEREAS, the purpose of the lease between the County and the VRFA is for the County to provide and promote a high quality recreational attraction in the western part of the Commonwealth; expand the historical knowledge of adults and children; promote tourism and economic development in the Commonwealth; set aside and conserve scenic and natural areas along the Roanoke River; preserve open-space land; and enhance and expand research and educational programs; and WHEREAS, the Roanoke County Department of Parks, Recreation and Tourism for the land leased by the County in Explore Park to achieve the purpose of the County / VRFA Lease; and WHEREAS, the Adventure Plan calls for design and implementation of various outdoor recreation activities, including different types of food and beverage services; specifically a craft brewery and bistro; and WHEREAS, the County has solicited and negotiated contracts with various vendors for ground leases and event contracts to implement the Adventure Plan; and Page 1 of 3 WHEREAS, Anbaja Enterprises Request for Proposal (RFP) for, among other things, food and beverage services for visitors to Explore Park at Brugh Tavern; and WHEREAS, the County has agreed to lease Brugh Tavern to Anbaja Enterprises, so that the company may provide food and beverage services to visitors of Explore Park; and WHEREAS, such a lease will provide tangible and intangible benefits to the County in the form of revenue and economic development. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Sections 2.01 and 2.03 of the Charter of Roanoke County, the County is authorized to acquire property, including the lease of real estate; and 2. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke County, the acquisition of any interest in real estate shall be accomplished by ordinance, the first reading of this ordinance was held on April 23, 2019, and the second reading of this ordinance was held on May 14, 2019. 3. That the execution of a Lease Agreement with Anbaja Enterprises to lease Brugh Tavern in Explore Park is authorized. 4. That the lease term shall commence on May 20, 2019, and continue for a period of three years, with the option to renew for additional two successive 5-year periods for a maximum of thirteen years, upon the same terms and conditions contained in the Agreement, unless terminated as provided in the Agreement. The terms of said lease are incorporated by reference herein. Whereas, the provisions of Section 15.2-1811 of the Dpef!pg!Wjshjojb, 1950, as amended, allow the County to operate a public park and recreation facility; Whereas, the purpose of the lease agreement between the County and the VRFA is for the County to provide and promote a high quality recreational attraction in the western part of the Commonwealth; expand the historical knowledge of adults and children; promote tourism and economic development in the Commonwealth; set aside and conserve scenic and natural areas along the Roanoke River; preserve open-space land; and enhance and expand research and educational programs, this Agreement between County and Company is consistent with the and strategic plan for Explore Park. Whereas, the County wishes to provide, among other things, food and beverage services in Brugh Tavern, and the Company is willing to plan, direct, operate, host, construct and manage such services in the form of a nano-brewery and bistro in Brugh Tavern at the Park, at expense; and WHEREAS, Company is willing and able to render said services pursuant to the provisions of this Agreement; and Whereas, this Lease RFP 2019-058 NOW, THEREFORE, in consideration of the mutual covenants contained herein, the County and the Lessee agree to the following: 1. Term This Agreement shall commence on ______________, 2019, and shall continue for a period of three years, terminating on December 31, 2022 The parties may extend the term of this Agreement for no more than two successive five-year terms upon the completion of the terms and conditions of this Agreement. The total renewable terms of this Agreement shall be no more than thirteen calendar years. Company agrees to perform the Services as stated in Exhibit A in exchange for the County authorizing Company to utilize identified space in Explore Park for conduct of business and for further consideration as described in this Agreement. During the Initial Term, Company will be an exclusive vendor for beer, cider and wine services in Explore Park. Company will also be the exclusive fixed location restaurant with on-premise dining at Explore Park for the initial term of the agreement. Operation and Quality of Operation The Company shall plan, direct, operate, host, and manage food and beverage services and any related support facilities and services in accordance with this Agreement to such an extent and in a manner considered satisfactory by the County. The Services to be provided under the terms of this Agreement will complement other recreational services to be provided by other vendors and further, that Company shall work collaboratively with other vendors in Explore Park to provide travel packages to Explore Park visitors. Travel packages are defined as discount offers for products and or services for park visitors that can be bundled through multiple Explore Park service providers. The entirety of the fee arrangement between the County and Company is set forth in Exhibit B, which is incorporated by reference herein. The County shall notbe responsible for any costs of building and operating infrastructure and equipment necessary for the Services to be provided by Company, except as outlined in this Agreement. Manner of Payment Company agrees to pay said compensation amount to the County on a quarterly basis under the terms of this Agreement. Payment is due 30 days after the completion of the quarter. Leased Premises The areas of Explore Park to be leased by Company from the County to provide the Services outlined in this Agreement are more fully described in Exhibit C, incorporated by reference herein. the Leased Premises. Company will clean up and restore property at the conclusion of each installation or repair process during the term of this Agreement. 5. Construction or Installation of Real Property Improvements The Company may construct or install in Explore Park only those real property improvements that are determined by the County to be necessary and appropriate for the administration and operation of the food and beverage services by the Company. All real property improvements constructed or installed by the Company shall be deemed fixtures and will immediately become the property of the County. 6. Marketing Company will work with the County to market Company at Explore Park. Company shall have a limited, non-of its venue and services, subject to Virginia Alcohol and Beverage Control statutes and regulations and any requisite federal regulations. Company will work collaboratively with the County to combine marketing funds from varies park partners and Roanoke County when appropriate. Company gives County a non-exclusive license to use logo and marks to promote Brugh Tavern and Explore Park. 7. Maintenance Company will keep and maintain the Leased Premises and all improvements located thereon, and all appurtenances thereto, in good repair and in safe and sanitary condition, ordinary wear and tear excepted; and will make all necessary repairs, replacements and renewals, which shall be substantially equal in quality and class to the original work. Company will notify County of any safety issues in the leased premises. Company will conform with and do all things necessary to comply with every valid law, regulation, order and requirement of any governmental authority Page 3 of 12 relating to the Leased Premises, and will hold and save liabilities, including but not limited to consequential damages, for the breach thereof or failure to comply therewith. 8. Standard of Performance and Compliance with Applicable Laws Company warrants and represents that it possesses the special skill and professional competence, expertise and experience to undertake the obligations imposed by this Agreement. Company agrees to perform in a diligent, efficient, competent and skillful manner commensurate with the highest standards of the profession, and to otherwise perform as is necessary to undertake the Services required by this Agreement. Company warrants and represents that it will, at all times, observe and comply with all federal, state, local and municipal ordinances, rules, regulations, relating to the provisionof the Services to be provided by Company hereunder or which in any manner affect this Agreement. 9. Insurance At all times during the term of this Agreement, the Company shall maintain a policy of general commercial liability insurance with limits of liability of two million dollars ($2,000,000). The Company shall name the County as an additional insured, by endorsement, on this policy and shall provide a certificate of insurance to County. At all times during the term of this Agreement, the 10. Relationship of the Parties Independent Contractors Nothing contained herein shall be deemed to create any relationship other than that of the Company as an independent contractor with County. This Agreement shall not constitute, create, or otherwise imply an employment, joint venture, partnership, agency or similar arrangement between the County and Company. It is expressly agree that Company is acting as an independent contractor and not as an employee of the County in providing the Services under this Agreement. Employee Benefits Company shall not be eligible for any benefit available to employees of County including,but not limited to, workers' compensation insurance, state disability insurance, unemployment insurance, group health and life insurance, vacation pay, sick pay, severance pay, bonus plans, pension plans, or savings plans. Payroll Taxes Company shall be responsible for all FICA, federal and state withholding taxes and workers' compensation coverage for any individuals assigned to perform the Services in furtherance of this Agreement. Indemnification Company agrees to defend, indemnify and hold harmless the County, its governing body, officers, employees, officials and agents, from and against any and all claims, suits, liens, judgments, damages, losses and expenses including reasonable legal fees and costs arising in whole or in part and in any manner against any and all liabilities, claims, demands, actions, costs, and expenses of any kind and nature whatsoever, which may arise, in whole or in part, as a result of any physical damage to person or property as a result of the Services provided by Company herein, or out of a breach by Company of its obligations under this Agreement. The County shall have no liability over any event or injury that may occur as a result of beer and cider brewing and service. The County further disclaims all liability associated with the Services provided herein, and make no warranties as to the safety of Explore Park for conducting said Services. 12. Force Majeure Neither party shall be liable for any delay or failure to perform its obligations (other than a failure to comply with payment obligations) hereunder if such delay or failure is caused by an unforeseeable event beyond the reasonable control of a party, including without limitation: act of God; fire; flood; earthquake; labor strike; sabotage; fiber cut; embargoes; power failure, e.g., omissions of telecommunications common carriers; material shortages or unavailability or other delay in delivery; lack of or delay in transportation; government codes, ordinances, laws, rules, regulations or restrictions; war or civil disorder, or act of terrorism. Force majeure also includes any closure of the Blue Ridge Parkway by the National Park Service. 13. Assignment Company shall not assign this Agreement without the prior express written consent of the County. Any attempted assignment by Company without the prior express written approval of County shall at sole option terminate this Agreement without any noticeto Company of such termination. 14. Waiver of Breach The waiver by either party of a breach or violation of any provision of this Agreement shall not operate or be construed to constitute a waiver of any subsequent breach or violation of the same or other provision thereof. 15. Governing Law This Agreement shall be construed and governed by the laws of the Commonwealth of Virginia, without giving effect to the principles of conflicts of laws. The venue for any disputes arising out of this Agreement shall be the Circuit Court for Roanoke County or in the United States Federal District Court for the Western District of Virginia, Roanoke Division. Company is responsible for construction, maintenance and operating this recreational amenity and adhering to any County ordinances related to open burning and fire regulations. 2. Company will be responsible for the cost of electric, water, sewer, internet and telecommunication lines to service Brugh Tavern. 3. Company may sell food, beverage and retail services at Brugh Tavern. Company will obtain all necessary licenses and permits and pay all applicable taxes associated with such sales. 4. Company will be responsible for any damages to Brugh Tavern Building, building systems and grounds from t 5. Company is responsible for maintenance of all food and beverage equipment. This includes all walk in coolers and freezers. 6. Company is responsible for painting and window treatments of interior of Brugh Tavern. 7. Company is responsible for any building improvements on the Leased Premises and securing occupancy permits through Roanoke County. 8. Company shall be responsible for its point of sale and credit card processing systems. 9. Company shall conduct a criminal conviction screening and shall review and analyze the results of such screening for all its employees, agents, and subcontractors. Company shall not employ any registered sex offenders to work or provide services at any of the Leased Premises. Company shall provide the results of any of the results of background screenings for Company employees at the request of the County. Company acknowledges that park parking will be limited during Halloween park events and Illuminights. Company agrees to participate in events by having facility open to event goers. Company is encouraged to have food and beverage specials for park special events. 21. Any food truck scheduled at Explore Park must be communicated 72 hours in advance to Roanoke urism Manager. 26. Company is allowed to place signage on Brugh Tavern and lawn. All signage must be designed in period specific style to Brugh Tavern with similar materials. All signage must be approved in advance by the Director of Parks, Recreation and Tourism. 27. Company will allow County to decorate the exterior of Brugh Tavern for Halloween and Christmas. Decorating will begin 30 days prior to an event. Page 8 of 12 County, pursuant to the terms of this Agreement, shall be responsible for the following: 1. County will maintain all building systems in Brugh Tavern. This will include HVAC systems, elevator and the outdoor refrigeration equipment. 2. County will maintain the exterior of Brugh Tavern to include roof, siding, painting/staining, grease trap, electric lines and water and sewer lines. 3. County will provide wayfinding signage in Explore Park to promote Twin Creeks Brewing Co. 4. County will inspect and repair all food and beverage equipment in Brugh Tavern prior to the operation commencing to ensure all food and beverage equipment are in good working repair. Once Brugh Tavern opens to the public, the Company is responsible for maintaining all food and beverage equipment. 5. County will provide all grounds maintenance of Brugh Tavern lawn. The maintenance of Inmate Program. The maintenance schedule of the grounds is set by Parks, Recreation and Tourism. 6. County will provide a grease trap for Brugh Tavern. 7. County will provide four (4) 50 amp, 110-electric outlets along the Brugh Tavern Service Road for food truck connections. County will also provide 2 (two) outlets behind Brugh Tavern. 8. County will provide Company a portion of Brugh Tavern lawn as identified on Exhibit C for fire pits. 9. County will be responsible for approving all hours of operation for the facility. 10. County will provide a six (6) foot privacy fence along the west side of Brugh Tavern boarding the Forester Trail. County is responsible for the maintenance of the privacy fence. 11. County will provide use of its mobile stage for four weekends throughout the year at no charge. The stage must be requested 30 days in advance and must not be committed to another event. Page 9 of 12 EXHIBIT B Fee Agreement Company agrees that, duties associated with food and beverage services as described in this Agreement, Company shall hold harmless and indemnify County for any claims resulting from the failure of Company to make prompt payments to all persons or entities providing equipment, labor, services, or tools in connection with Services Company is obligated to provide under this Agreement. 1. Company shall pay the County 2% for the first six month of operation and then escalates to 4% (four pe annual net revenue from its operations at Explore Park during the Initial Term of this Agreement. 2. Company shall remit such payments as described herein to County on a quarterly basis, with the last annual payment no later than June 30 during each year during the term of this Agreement. 3. Company shall apply for and at all times during the course of this Agreement, shall maintain a business license, as issued by the Roanoke County Commissioner of the Revenue. 4. Company shall remit to the Roanoke County Commissioner of Revenue or Roanoke County Treasurer all applicable Business, Professional and Occupational License taxes, business personal property taxes, and other applicable local, state, and federal taxes as mandated by the Code of Virginia and the federal Code during the term of this Agreement. 5. Company shall collect from its customers and remit all applicable local, state, and federal taxes to the Roanoke County Commissioner of the Revenue, the County Treasurer, or other applicable government officials at all times during the term of this Agreement. 6. In administering this Agreement, the County Finance director may request that Company provide reports and sufficient data regarding revenue to determine whether Company is complying with terms of the revenue-sharing agreement. In the event County Finance director requests reports or other documents to conduct such an audit, such information shall be produced by Company in a reasonable time, not to exceed thirty days from the date of the request. 7. Company agrees that, to the extent it contracts with third parties to perform any of Agreement, Company shall hold harmless and indemnify County for any claims resulting from the failure of Company to make prompt payment to all persons or entities providing equipment, labor, services, or tools in connection with the Services Company is obligated to provide under this Agreement. The layout of fire pits may be revised with agreement of Company and County. 2. The fire pits will have an onsite supervisor during operation with approved fire extinguishers on hand. 3. The trail will be made of stone pavers. 4. Company is responsible for the construction and maintenance of the trail. Any erosion of the trail will be repaired by Company. 5. Company will comply with all Roanoke County ordinances concerning open burn and fire safety. 6. Fire pits will be constructed of cast iron and no larger than 36 inches in diameter or they can be constructed of stacked decorative block. Fire pits may be piped for natural gas. The Trail, Route #17 in the Greenway Plan, opened in 1999 as one of the early greenway projects in the Roanoke Valley. The trail is a 1.7 mile-long cinder surface, and hosts many runners and walkers each day. It runs parallel to Kessler Mill Road, adjacent to the Roanoke County Public Service Center, under I-81, adjacent to numerous business and residences. The City of Salem has funding to extend the trail south to the existing portions of Mason Creek Greenway (Route #23) near GE and ultimately the trail will connect to the Roanoke River Greenway (Route #31). The existing Hanging Rock Battlefield Trail will be the direct linkage to the proposed Hinchee Trail, providing the greenway connection to this new trail from businesses, residential, and commercial areas. Page 1 of 5 Carvins Cove Natural Reserve is a 12,463-acre watershed property protecting Carvins Cove Reservoir. The reservoir and lands immediately surrounding it, approximately 1100 acres, are owned and operated by the Western Virginia Water Authority; the remaining lands above the 1200-foot contour are owned and managed by the City of aced on and Blue Ridge Land Conservancy. These easements are on the lands above the 1200- foot contour and protect the land for watershed, recreation, open space, natural habitat, biological diversity, and forest use. Carvins Cove is a destination outdoor recreation area. The Hinchee Trail would provide a new connection to Carvins Cove from the urban area, allowing access without an automobile. Brushy Mountain Fire Road is an existing, single lane, unsurfaced road with ditches, running from Timberview Road at Hanging Rock to Happy Valley Trail at the Bennett Springs gate (Route 740) for Carvins Cove, a distance of over 12 miles. Two miles of the road are in private ownership designated on property plats in various ways, management system was installed, all roads were named and the ¼ mile at the bottom of the road which serves three houses was named Virginia Deer Road. The road is gated on each end and near the Hinchee/Carvins Cove line. The portion within Carvins Cove is open for trail use by bicycles, hikers, and equestrians, but the 1.97-mile portion on private land has always been closed. The road is also an access route for emergency management for fire and rescue. The goal of this project is to connect the Roanoke Valley Greenway network to the 12,463-acre Carvins Cove Natural Reserve. This project is in Roanoke County, half a mile from Exit 141 of I-81 and a mile from the City of Salem. The project would provide the opportunity for users to bicycle, walk, or ride horses from the Hanging Rock Battlefield Trail to Carvins Cove, thus connecting an urban area to a very rural, natural preserve. On December 19, 2017, the Roanoke County Board of Supervisors approved and appropriated grants in the amount of $93,532 from Virginia Land Conservation Fund and Preservation Trust Fund for this project. On November 20, 2018, the Roanoke County Board of Supervisors approved the purchase of 1.706 acres of land from the Margaret R. Hinchee Revocable Living Trust and Lloyd M. Hinchee Revocable Living Trust for this project. DISCUSSION: The Hinchee family has been in discussions with the Roanoke Valley Greenway Page 2 of 5 Coordinator and Roanoke County for several years. Hinchee & Pace, LLC has agreed to donate its ½ interest of the seven land tracts, called the mountain properties, to Roanoke County for the greenway and preservation of the mountain. Pathfinders for Greenways has purchased the other ½ interest in the mountain properties from the Lloyd M. Hinchee Revocable Trust, and has sole ownership of one parcel (34.217 acres with frontage on Mason Creek). The seven tracts of mountain properties being donated by Hinchee & Pace, LLC (1/2 interest) and Pathfinders for Greenways, Inc. (1/2 interest) are the following: 025.00-01-09.00-0000 025.00-01-10.00-0000 025.00-01-44.00-0000 025.00-01-45.00-0000 025.00-01-47.00-0000 025.00-01-49.00-0000 036.00-01-02.00-0000 The seven tracts total 218.64 acres. The seven tracts are identified on the map titled One additional tract of land is being donated by Pathfinders for Greenways, Inc. The following tract is: 036.00-01-05.00-0000 This tract is 34.217 acres and is solely owned by the Pathfinders for Greenways. The oposed this tract. The Hinchee mountain properties are wooded and undeveloped; there are remains of an old cabin, an old orchard, and two parking areas. The conservation values include open space, upland forest, headwaters of streams, recreation access, wildlife habitat, and scenic view sheds. The Hinchee Trail project will provide access to Carvins Cove lands that currently are relatively difficult to reach because they are ten miles from any access points. In addition to the mountain properties noted, the heirs of the two Trusts have agreed to sell the three tracts at the intersection of Timberview and Dutch Oven Roads for trailhead parking, picnic facilities, and trailhead amenities. Phase 1 and 2 environmental studies have been completed on the seven mountain tracts. Phase 1 environmental study has been completed on the sole tract owned by the Page 3 of 5 standard for land acceptance. Title exams on all parcels have been completed as well. There were no negative findings. There are several deed restrictions being placed on the land donations due to the grant terms of the Virginia Land Conservation Foundation, Preservation Trust Fund and wishes of the Hinchee family. The deed restrictions are: 1. The Property shall not be used for commercial logging. 2. In order to maintain the runoff and erosion prevention, nonpoint source pollution control, stream temperature and ecological values of the Property, indigenous vegetation shall be preserved to the maximum extent possible. Removal of vegetation on the Property shall be allowed only as set forth herein. 3. Dead, diseased, and dying trees may be removed. 4. Fallen trees that are blocking stream channels, or trees with undermined root systems in imminent danger of falling across streams or roads, may be removed where a potential problem outweighs any positive effects the fallen trees may have on the ecosystem. 5. Trees sprouting in ditches, roadways, parking areas and trails may be removed to maintain the function of these facilities. 6. No spraying of chemicals for insect or vegetation control will be allowed. 7. Pathways, greenways, trails, and driveways shall be constructed and maintained with minimal tree removal and using best management practices, so as to effectively control storm water and prevent erosion. 8. Campfires shall be burned only in designated, contained areas and shall be in compliance with Roanoke County burn laws. 9. No hunting shall be allowed on the Property. 10. The Property shall be used for the operation of a greenway and park. A parking lot, restroom facility, canoe launch, trails, bridges, and site furnishings, such as kiosks, signs, benches, and trash receptacles, may be constructed on the Property to provide access to the creek and support to the park and greenway/trail connections, subject to the terms of the Open-Space Easement 11. All of the aforesaid real estate shall be used in perpetuity only as open-space land for recreational purposes as set forth in the Open-Space Land Act, Virginia Page 4 of 5 Code § 10.1-1700 et seq. This declaration and dedication shall run with the aforesaid real property and shall be binding upon all parties and entities having any right, title, or interest in the aforesaid real estate or any part thereof, their heirs, successors, and assigns, and shall inure to the benefit of the Grantees, the Commonwealth of Virginia, and the Virginia Land Conservation Foundation pursuant to Virginia Code §§ 10.1-1017 through 10.1-1026. 12. The Property shall not be diverted from open-space use unless the requirements of Section 10.1-1704(A) of the Code of Virginia have been met. Should the Property be diverted or converted from the uses described in this deed or should the interest created by this deed be extinguished at any time after the date hereof, contrary to the provisions of Section 10.1-1704(A) of the Code of Virginia, Grantee agrees to reimburse the VLCF any monetary consideration received by the Grantee from VLCF in relation to acquisition of these parcels. Roanoke County would like to name the park and trail after the Hinchee family. Roanoke County will allow primitive camping on the park property starting in the summer of 2020. The tentative date to open the trail is on National Lands Day, September 28, 2019. Since the first reading of this ordinance on April 23, 2019, one change has been made to the deed at the request of VLCF: the County agrees that if the property is ever diverted away from open-space use, the County would reimburse VLCF any grant money received in relation to the acquisition of the parcels. FISCAL IMPACT: Annual repairs will be necessary for the maintenance of the trail and park property. The estimated annual maintenance cost is $10,000. Pathfinders for Greenways, Inc. will volunteer to assist with trail and park maintenance; additionally, Parks, Recreation and Tourism staff will assist with maintenance. Maintenance funding is available for trail and park repairs in Parks, Recreation and Tourism's Capital Maintenance Program to pay for repair materials. BACKGROUND: The kitchen facilities at the Cave Spring Rescue Station are not sufficient to support station operations, and the Cave Spring Volunteer Rescue Squad has requested support from the County to assist with renovations. The Cave Spring Volunteer Rescue Squad is donating $4,000 to assist with the kitchen renovations and has requested the County provide a match of $4,000 to complete project funding. FISCAL IMPACT: Funds in the amount of $4,000 received from the Cave Spring Volunteer Rescue Squad will be appropriated to the General Services Capital Maintenance Program (CMP) budget.
