HomeMy WebLinkAbout5/14/2019 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 14, 2019 RESOLUTION 051419-1 OF CONGRATULATIONS TO NORTHSIDE HIGH SCHOOL BOYS BASKETBALL TEAM FOR WINNING THE VIRGINIA HIGH SCHOOL LEAGUE (VHSL) CLASS 3 CHAMPIONSHIP WHEREAS, team sports are an important part of the curriculum at schools in Roanoke County, teaching cooperation, sportsmanship and athletic skill; and WHEREAS, the Northside High School boys basketball team are the first boys State champions in school history; and WHEREAS, the Northside Vikings finished their season with an outstanding overall record of 28 wins and 1 loss; and WHEREAS, the Northside Vikings earned their trip to a State championship game by winning the semifinal game by 73 to 54; and WHEREAS, the Northside Vikings won their first State title in school history by defeating Phoebus 60 to 58; and WHEREAS, the Vikings have been under the dedicated leadership of Head Coach Bill Pope for the last 33 years with Assistant Coaches Ed Culicerto and Coach Jim Wolfe assisting Coach Pope during his entire tenure with Northside; along with Assistant Coaches Jacob Paysour, Trey Smith, Omar Lewis; Managers Michael Summer and Quran Walker and Videographer John Palmeiri; and and WHEREAS, Coach Bill Pope was named VHSL State Coach of the Year; and WHEREAS, Julien Wooden was named VHSL and VHSCA Player of the year; Page 1 of 2 WHEREAS, Kasey Draper was named VHSL and VHSCA First Team All -State. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia does hereby extend its sincere congratulations to the members of the NORTHSIDE HIGH SCHOOL BASKETBALL TEAM: Ayrion Journiette, Julien Wooden, Jalen Jackson, Jordan Wooden, Quentin Slash, LA Gates, Kasey Draper, Cameron Upton, Avonte Grogan, Corey Brooks, Bryce Hall and Daniel Francis; and BE IT FURTHER RESOLVED, that the Board of Supervisors extends its best wishes to the members of the team, the coaches, and the school in their future endeavors. E-1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: May 14, 2019 AGENDA ITEM: Request to amend the scope of services for the Professional Engineering Services Contact with Draper Aden Associates for the Dixie Caverns Landfill Leachate Management Upgrade SUBMITTED BY: APPROVED BY: ISSUE: Tarek Moneir Acting Director of Development Services Daniel R. O'Donnell County Administrator To amend the Professional Engineering Services Contact with Draper Aden in excess of 125% of the original contract award amount. Under State Code, Board approval is required before the County may execute this amendment. BACKGROUND: Roanoke County has an on-going project, approved by the Board under its Capital Improvement Program, to upgrade the leachate management system at the Dixie Caverns landfill. The purpose of this upgrade is to increase the capacity of the existing leachate management system and enhance the ability to store excess leachate generated by significant rain events. The project would also replace aging equipment and system controls. DAA was selected through a qualifications based, competitive process to provide engineering services for this project. The identified services included initial investigations, concept and preliminary (65%) design, final design, bidding services, and construction phase services. Due to a number of unknowns in the scope of the project at its outset, only the concept and preliminary design phase services were initially authorized. After this initial work was completed the original plan was to add the additional scopes of work as the overall scope and design of the project was better understood based on an evaluation of the existing system and a Page 1 of 3 geotechnical investigation. The original contract was executed on August 31, 2015, for a lump sum of $51,233 for concept planning and preliminary design services. On January 1, 2016, based on the initial investigatory work, Amendment 1 was executed for additional geotechnical services to further investigate and identify sources of subsurface water. The cost of Amendment 1 was $12,825 which increased the total contract cost to $64,058. DAA has completed all of their contracted tasks included in the initially awarded work. On May 23, 2017, the Board amended the original contract following recommendation from the staff. This amendment increased the contract by $103,077 ($75,535 final design and bidding services and $27,542 for construction phase services) with an additional $12,000 project contingency which brought the total contract amount to $179,135. During this design process, it was determined that there may be other alternatives that would be more appropriate and result in long-term cost savings to the County. The requested authorization to amend this contract would allow DAA to perform required testing, analysis, and other support activities to evaluate alternatives. This additional study is needed to select the option that will provide the best value to the County and deliver it to construction. Once the preferred alternative is determined, staff will report back to the Board prior to proceeding with construction. As a result of the proposed contract amendment exceeding 125% of the original award amount, staff has considered the option of re - procuring these services in a second process. However, it is the opinion of staff that such an exercise would neither produce a substantively more qualified bidder nor reduce the expected project costs. Further, re -procuring these professional services will likely result in additional commitment of staff time to administer a second procurement process, potentially increase consultant costs, and delay project implementation. For these reasons, staff is recommending the Board authorize the recommended contract amendments. FISCAL IMPACT: Funding for this project is fully appropriated through the County's Capital Improvement Program. Approval of this item as requested will not result in additional fiscal impact to the County. STAFF RECOMMENDATION: Staff recommends that the Board of Supervisors authorize an increase in DAA's contract for professional services from $167,135.00 to an amount not to exceed $249,135.00. Caywood, Assistant County Administrator Tarek Moneir, Acting Director of Development Services Page 3 of 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MAY 14, 2019 ORDINANCE 051419-3 APPROVING A LEASE WITH ANBAJA ENTERPRISES, TO PROVIDE FOOD AND BEVERAGE SERVICES IN EXPLORE PARK AT BRUGH TAVERN WHEREAS, the County is the Lessee of a ninety-nine year lease for Explore Park, property owned by the Virginia Recreational Facilities Authority ("VRFA"), a political subdivision of the Commonwealth of Virginia; and WHEREAS, the purpose of the lease between the County and the VRFA is for the County to provide and promote a high quality recreational attraction in the western part of the Commonwealth; expand the historical knowledge of adults and children; promote tourism and economic development in the Commonwealth; set aside and conserve scenic and natural areas along the Roanoke River; preserve open -space land; and enhance and expand research and educational programs; and WHEREAS, the Roanoke County Department of Parks, Recreation and Tourism ("PRT") has devised a master plan ("Adventure Plan") for the land leased by the County in Explore Park to achieve the purpose of the County / VRFA Lease; and WHEREAS, the Adventure Plan calls for design and implementation of various outdoor recreation activities, including different types of food and beverage services; specifically a craft brewery and bistro; and WHEREAS, the County has solicited and negotiated contracts with various vendors for ground leases and event contracts to implement the Adventure Plan; and Page 1 of 3 WHEREAS, Anbaja Enterprises, was the responsive bidder for the County's Request for Proposal (RFP) for, among other things, food and beverage services for visitors to Explore Park at Brugh Tavern; and WHEREAS, the County has agreed to lease Brugh Tavern to Anbaja Enterprises, so that the company may provide food and beverage services to visitors of Explore Park; and WHEREAS, such a lease will provide tangible and intangible benefits to the County in the form of revenue and economic development. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows - 1 . ollows: 1. That pursuant to the provisions of Sections 2.01 and 2.03 of the Charter of Roanoke County, the County is authorized to acquire property, including the lease of real estate; and 2. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke County, the acquisition of any interest in real estate shall be accomplished by ordinance, the first reading of this ordinance was held on April 23, 2019, and the second reading of this ordinance was held on May 14, 2019. 3. That the execution of a Lease Agreement ("Agreement") with Anbaja Enterprises to lease Brugh Tavern in Explore Park is authorized. 4. That the lease term shall commence on May 20, 2019, and continue for a period of three years, with the option to renew for additional two successive 5 -year periods for a maximum of thirteen years, upon the same terms and conditions contained in the Agreement, unless terminated as provided in the Agreement. That the base rent shall be two percent of Anbaja Enterprises NET revenue derived from its services in Brugh Tavern at Explore Park for the first six months and then increase to four percent thereafter, annually, during the term of the Agreement. 6. That the County Administrator, or an Assistant County Administrator, is authorized to execute such documents and take such actions on behalf of the Board of Supervisors in this matter as are necessary to accomplish the lease of this property, all of which shall be approved as to form by the County Attorney. 8. That this ordinance shall be effective on and from the date of its adoption. The County and the Cave Spring Volunteer Rescue Squad have agreed to jointly fund the kitchen renovations, each contributing $4,000, pending approval of this ordinance. BACKGROUND: The kitchen facilities at the Cave Spring Rescue Station are not sufficient to support station operations, and the Cave Spring Volunteer Rescue Squad has requested support from the County to assist with renovations. The Cave Spring Volunteer Rescue Squad is donating $4,000 to assist with the kitchen renovations and has requested the County provide a match of $4,000 to complete project funding. FISCAL IMPACT: Funds in the amount of $4,000 received from the Cave Spring Volunteer Rescue Squad will be appropriated to the General Services Capital Maintenance Program (CMP) budget. General Services CMP funds previously appropriated will provide the remaining $4,000 for the kitchen renovation project.
