CENTER ON TUESDAY, JANUARY 14, 2020
RESOLUTION 011420-1 APPOINTING THE COUNTY ATTORNEY AND
APPROVAL OF AN EMPLOYMENT AGREEMENT
WHEREAS, Chapter 7 of the Roanoke County Charter provides for the
appointment of a County Attorney, his or her powers and duties, compensation and
tenure; and
WHEREAS, Section 15.2-1542 of the Code of Virginia establishes the various
duties and responsibilities of the County Attorney; and
WHEREAS, an employment agreement between the County Attorney and the
Board of Supervisors has been negotiated.
NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That Peter S. Lubeck, subject to acceptance of the terms and conditions
of employment as set forth in the employment agreement, is hereby appointed County
Attorney for Roanoke County, and that his tenure shall commence on or before January
14, 2020.
2. That Peter S. Lubeck shall exercise all of the powers and fulfill all of the
duties and obligations of County Attorney as provided in the Roanoke County Charter,
the position description, the policies and regulations adopted by the Board and the legal
directives of the Board.
3. That an employment agreement is hereby approved, and the Chairman of
the Board is hereby authorized to execute this agreement of behalf the Board.

Supervisor Mahoney asked that the approval of the minutes of the October 22, 2019
Board Meeting be pulled from the Consent Agenda as he was not on the Board in 2019.
There were no objections.

Request to accept and allocate a grant in the amount of
$5,000 from ADT, LLC

Accept and allocate a grant in the amount of $5,000 from ADT, LLC.
BACKGROUND:
ADT, LLC recognizes and rewards fire departments who help save their customers'
homes and lives with $5,000 grants through the Lifesaver program.
DISCUSSION:
ADT selected the Fire and Rescue Department for this grant after fire crews recently
responded to a house fire where 911 was notified by the ADT monitoring system. Fire
and Rescue was dispatched to the scene and was able to extinguish the flames
promptly because of the early detection from the ADT system. The funds will be used to
purchase equipment for Vinton Station #2, which was the station who responded to the
call.
FISCAL IMPACT:
Awarded grant funds total $5,000 and there is no required local match.

STAFF RECOMMENDATION:
Staff recommends the acceptance and allocation of funds in the amount of $5,000 to
the Fire and Rescue Department.
VOTE:
Supervisor Mahoney moved to approve to accept and allocate the funds. Supervisor
Hooker seconded the motion. Motion approved.

Confirmation of appointments
BACKGROUND:
Blue Ridge Behavioral Healthcare Board of Directors:
Debbie Bonniwell, Chief Executive Officer of Blue Ridge Behavioral Healthcare has
recommended the appointment of Patrick Kenney, Esq. to the At -Large position
previously held by Lisa Garst for a three-year term ending December 31, 2022. All At -
Large appointments must be ratified by each of the five local governing bodies in
accordance with their Bylaws.
Community Policy and Management Team (CPMT):
DePaul Community Services has recommended the appointment of Trista Thompson as
the alternate for the Private Community Resources appointment. Staff is in agreement.
The Police Department has recommended the appointment of Commander Chris
Kuyper and Sergeant Dan Walters to be appointed as the Roanoke County Law
Enforcement appointments.

Parks, Recreation and Tourism Commission (District):
Supervisor Paul M. Mahoney has recommended the reappointment of Fred Corbett to
an additional three-year term to expire June 30, 2022.
Planning Commission (District):
Supervisor Paul M. Mahoney has recommended the appointment of Kelly McMurray to
fill the unexpired Cave Spring Magisterial District seat. This appointment will expire
June 30, 2020.
South Peak Community Development Authority (CDA)(At-Large):
Staff has recommended the appointment of Linwood P. Windley to fill the unexpired
term on this CDA. This term will expire October 25, 2021.
STAFF RECOMMENDATION:
Staff recommends confirmation of all appointments outlined.
VOTE:
Supervisor Mahoney moved to confirm all appointments. Supervisor Hooker seconded
the motion. Motion approved.

RESOLUTION 011420-4 CERTIFYING THE CLOSED MEETING WAS
HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each member's knowledge:
1. Only public business matters lawfully exempted from open meeting requirements

ON TUESDAY, JANUARY 14, 2020
RESOLUTION 011420-3.b AMENDING AND RESTATING THE COUNTY
ADMINISTRATOR'S EMPLOYMENT AGREEMENT
WHEREAS, on December 4, 2018, the Roanoke County Board of Supervisors
approved the appointment of Daniel R. O'Donnell as County Administrator and executed
a contract on that same day by Resolution 120418-5; and
WHEREAS, the contract states that any amendment must be by written
agreement; and
WHEREAS, the Board and Mr. O'Donnell desire to amend the existing contract to
amend and clarify certain terms to reflect the current relationship.
NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The current Employment Agreement of the County Administrator, Daniel R.
O'Donnell, is hereby amended to clarify certain benefits and provide for a
2.75% salary increase.
2. The Chairman of the Board is hereby authorized to sign the attached
Amendment to reflect changes to the original Employment Agreement, which
Amendment is hereby made a part of this Resolution. (Attachment)
