Good afternoon and welcome to our meeting for February 25, 2020. Regular meetings
are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at
7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Board of
Supervisors meetings can also be viewed online through Roanoke County's website at
www.RoanokeCountvVA.gov. Our meetings are closed -captioned, so it is important for
everyone to speak directly into the microphones at the podium. Individuals who require

Acceptance and allocation of $2,500 from the 2019 Mud Run and recognize Roanoke
Valley Detachment 426 of the Marine Corp League for its donation to Camp Roanoke
BACKGROUND:
In its twenty-fourth year, the Marine Corp Mud Run continues to be one of the Roanoke
Valley's signature running and fundraising events. This event draws the interest of many
individuals and its team competition has been popular with school groups, athletic
teams, friends, neighbors and companies.
The event represents a long standing partnership among Roanoke Valley Detachment
426 of the Marine Corp League, Roanoke County Parks, Recreation and Tourism and
many local corporate sponsors. The beneficiaries of this event are the nationally
recognized Marine Toys for Tots program and Camp Roanoke. The Mud Run is held
annually at Green Hill Park.
DISCUSSION:
The funds will be used to replace the roof on the cafeteria building at Camp Roanoke.
This year's $2,500 donation brings the total amount contributed for the twenty-four year
period to over $165,000.

FISCAL IMPACT:
The donation in the amount of $2,500 will be used to replace the roof on the cafeteria
building at Camp Roanoke.
STAFF RECOMMENDATION:
Staff recommends acceptance and allocation of the $2,500 donation to Camp Roanoke
from Roanoke Valley Detachment 426 of the Marine Corps League.

Transportation (VDOT) permit the erection of public service
signage in the right-of-way for panhandling prevention

VDOT requires a resolution from the Board of Supervisors for installation of permanent
signs in VDOT right-of-way. The resolution requests VDOT allow the County to erect
permanent, public -message signage addressing panhandling.
BACKGROUND:
Panhandling activities are increasing in the Roanoke Valley, and particularly, in
Roanoke County. These activities taking place in the VDOT right-of-way, present a
serious safety concern for both panhandlers and drivers. To attempt to reduce such
activities, over the past few years the City of Salem and City of Roanoke have installed
signs at key intersections to discourage panhandling and to provide information to
panhandlers about available resources.
DISCUSSION:
County staff propose to install signs with similar messaging at the following eight (8)
intersections identified by the Police Department:
Electric Road/Route 419 and Brambleton Avenue/Route 221
Electric Road/Route 419 and Ogden Road
Brambleton Avenue/Route 221 and Garst Mill Road

Challenger Avenue/Route 460 and Cloverdale Road/Alternate Route 220
Challenger Avenue/Route 460 and Valley Gateway Boulevard
Challenger Avenue/Route 460 and the Walmart/Lowe's entrance
Williamson Road/Route 11 and Peters Creek Road/Route 117
Williamson Road/Route 11 and Plantation Road/Route 115
A total of 21 signs can be installed within existing medians at these intersections. Other
locations could be added in the future if a need to do so is identified.
FISCAL IMPACT:
Approximately $1,260 will fund signs and installation, which is available in the Planning
Department Budget.
STAFF RECOMMENDATION:
Staff recommends approval of the resolution requesting VDOT permit permanent
signage to be installed in the right-of-way to address panhandling.

RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF
TRANSPORTATION (VDOT) PERMIT THE ERECTION OF PUBLIC
SERVICE SIGNAGE IN THE RIGHT-OF-WAY FOR PANHANDLING
PREVENTION
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified
the prevention of panhandling as an important safety concern, as panhandling is an
increasing problem in Roanoke County; and
and
WHEREAS, panhandling has an adverse effect upon the safety of our roadways;
WHEREAS, the Board finds that increased public service and informational
advertisements to promote public education about panhandling will achieve the goal of
increasing safety in the County; and
WHEREAS, the installation of panhandling prevention signs is a valid public
purpose.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Virginia Department of Transportation is hereby requested to
permit Roanoke County to erect permanent, public-service informational advertisements
in and along the public right-of-way of State maintained roads in Roanoke County.
2. That these public service informational advertisements shall inform and
educate the public about other ways to help those in need, and to provide contact
information for those who need assistance.

distance, post design and existing signage.
4. That this resolution shall be effective upon its adoption.

Resolution appointing Acting Zoning Administrator for
Roanoke County

Agenda item requesting the Board of Supervisors to appoint an Acting Zoning
Administrator.
BACKGROUND:
On March 8, 2005, the Board of Supervisors appointed John Murphy as the
Zoning Administrator for Roanoke County.
With John Murphy's retirement effective February 29, 2020, there is a need to
appoint an acting zoning administrator until his position is filled.
DISCUSSION:
Section 15.2-2286(A)4 of the Code of Virginia provides for the appointment or
designation of a zoning administrator to administer and enforce the localities zoning
ordinance. Section 30-5 of the Roanoke County Zoning Ordinance lists the powers,
duties and responsibilities of the zoning administrator which include the following:
1. Zoning permit. To issue or deny a zoning permit for the erection,
construction, reconstruction, moving, adding to, or alteration of any
structure, or the establishment of any land use. The administrator shall
also have the authority to revoke any zoning permit if violations of the
provisions of this ordinance occur.

2. Certificate of zoning compliance. To issue or deny a certificate of zoning
compliance.
3. Collect fees. To collect any fees required or set forth in this ordinance.
4. Making and keeping records. To make and keep all records required by
state law or necessary and appropriate for the administration of this
ordinance.
5. Inspection of buildings or land. To inspect any building or land to
determine if violations of this chapter have been committed or exist.
6. Enforcement. To enforce this ordinance and take all necessary steps to
remedy any condition found in violation of the provisions of this ordinance.
7. Request assistance. To request the assistance of other local and State
officials or agencies in the administration and enforcement of this
ordinance.
8. Interpretation. To interpret the official zoning map and provisions of this
ordinance, and offer written opinions on their meaning and applicability.
FISCAL IMPACT:
Any increase in acting status pay would be accounted for in personnel savings from the
vacant Zoning Administrator position.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors appoint Rebecca James as Acting
Zoning Administrator effective March 1, 2020.

Agenda item requesting the Board of Supervisors appoint a Subdivision Agent and an
Alternate Subdivision Agent.
BACKGROUND:
On January 23, 2001, the Board of Supervisors appointed John Murphy as
Subdivision Agent for Roanoke County, and Denise Sowder as an Alternate
Subdivision Agent.
With John Murphy's retirement effective February 29, 2020, there is a need to
appoint a Subdivision Agent and an Alternate Subdivision Agent.
DISCUSSION:
Section 15.2-2255 of the Code of Virginia specifies that a local governing body shall be
vested with the responsibility to administer and enforce the subdivision regulations of
the jurisdiction. The local governing body also has the right to delegate this authority to
the Planning Commission or other individual or entity. Historically, the Board has
delegated this responsibility to an administrative subdivision agent.
Denise Sowder, Development Review Coordinator, and Rebecca James, Planner II, are
closely involved in the day-to-day review of subdivision plats and other aspects of
administering the subdivision ordinance. It is appropriate that these two individuals

have the responsibility to ensure compliance with the subdivision ordinance and the
authority to approve submitted plats that comply with the ordinance.
FISCAL IMPACT:
There is no fiscal impact on this agenda item.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors appoint Denise Sowder as Subdivision
Agent for Roanoke County and Rebecca James as an Alternate Subdivision Agent for
Roanoke County, effective March 1, 2020.

ISSUE:
Fellowship Community Church requests that the County grant an easement for ingress
and egress over and across a fifty -foot public right of way adjacent to Church Property
to be acquired by Fellowship Community Church Holdings, LLC.
BACKGROUND:
Fellowship Community Church has entered into a contract to purchase a 3.5 acre parcel
of land in the Cave Spring Magisterial District. The parcel of land is adjacent to
Merriman Road, and is part of the parcel identified by Tax Map number 097.01-02-
12.00-0000. The County owns a fifty -foot right-of-way adjacent to the parcel being
purchased by the Church. The Church has requested an easement so that it may use
the public right of way as a second means of ingress and egress from the Church
Property.
DISCUSSION:
The Church will be constructing a church on the parcel of property and would like to use
the fifty -foot, public right-of-way as a second entrance/exit from the property.

The first reading of this ordinance was held on February 11, 2020. Since the first
reading, the following changes have been made. The revised easement now provides
that: 1) the Church will not use the public right of way for any construction access and
all contractors will use Merriman Road entrance for ingress and egress; 2) the Church
will maintain a liability policy of insurance with limits of no less than $1,000,000 and
name the County as an additional insured on the policy; and 3) the Church will pay
$2,500 to the County annually for as long as it maintains this easement as a
contribution toward road maintenance costs.
FISCAL IMPACT:
This easement will not have any fiscal impact on the County.

Staff recommends approval of the attached ordinance.

ORDINANCE AUTHORIZING THE GRANTING OF AN EASEMENT TO

AND EGRESS TO CHURCH PROPERTY ON A 3.5 ACRE PARCEL
OWNED BY THE CHURCH ON MERRIMAN AND STARKEY ROADS
(PARCEL TAX MAP NO 097.01-02-12.00-0000), CAVE SPRING
MAGISTERIAL DISTRICT
WHEREAS, Fellowship Community Church Holdings, LLC, has a contract to
purchase a 3.5 acre parcel of land on Merriman Road (Tax Map No. 097.01-02-12.00-
0000) to construct a church and has requested that the County grant an easement to a
fifty -foot right-of-way owned by the County for purposes of ingress and egress to the
parcel of land; and
WHEREAS, such easement will not have an adverse impact on the County's public
right of way; and
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition and conveyance of real estate interests be accomplished by ordinance; the
first reading of this ordinance was held on February 11, 2020, and the second reading
and public hearing was held on February 25, 2020.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the County shall grant an easement to Fellowship Community Church
Holdings, LLC to a fifty -foot right-of-way owned by the County that is adjacent to a 3.5
acre of property being acquired by the Church, which parcel is more specifically identified
on Tax Map No. 097.01-02-12.00-0000, and the right-of-way and the parcel are shown

on the attached subdivision plat prepared by Lumsden Associates, and such conveyance
is hereby authorized and approved.
2. That the County Administrator, or any Assistant County Administrators,
either of whom may act, are authorized to execute, deliver and record the deeds, and any
other documents on behalf of the County and to take all such further action as any of
them may deem necessary or desirable in connection with this project. The form of the
deed is hereby approved with such completions, omissions, insertions and changes as
the County Administrator may approve, whose approval shall be evidenced conclusively
by the execution and delivery thereof, all of which shall be approved as to form by the
County Attorney.
3. That this ordinance shall be effective from and after the date of its adoption.

THIS DEED OF EASEMENT, is entered into this day of February 2020 by the
BOARD OF SUPERVISORS OF ROANOKE COUNTY (the "County"), a political subdivision
of the Commonwealth of Virginia hereinafter referred to as the "Grantor," and FELLOWSHIP
COMMUNITY CHURCH HOLDINGS, LLC, (the "Church"), a Virginia limited liability
company hereinafter called "Grantee," with an address of 1226 Red Lane Extension, Salem, VA
24153.
WITNESSETH:
WHEREAS, the Church has entered into a contract to purchase a 3.5 acre portion (the
"Church Property") of Roanoke County Tax Map No. 097.01-02-12.00-0000 from Starkey
Properties, LLC; and
WHEREAS, the Church and Starkey Properties, LLC have submitted a subdivision plat to
the County for its review and approval, a copy of which plat is attached hereto as Exhibit A; and
WHEREAS, the Church Property fronts on both Merriman Road and a 50 ft. dedicated
public right-of-way owned by the County ("Public Right -of -Way"); and
WHEREAS, the Church's development of the Church Property would provide vehicular
access to both Merriman Road and the Public Right -of -Way; and
WHEREAS, the Church has accordingly requested authorization to use the Public
Right -of -Way

WHEREAS, the County has agreed to authorize such access in accordance with the
covenants and conditions in this agreement.
NOW THEREFORE, FOR AND IN CONSIDERATION of the sum of ONE DOLLAR
($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged,
the Grantor hereby GRANTS and CONVEYS unto the Grantee, its successor and assigns, the
following easement, in the Cave Spring Magisterial District, County of Roanoke, Virginia, to wit:
A PERMANENT EASEMENT for ingress and egress over and across a fifty -foot public
right of way adjacent to the Church Property to be acquired by Fellowship Community
Church Holdings, LLC. The 3.5 acre parcel is a portion of Tax Map number 097.01-02-
12.00-0000. The Public Right -of -Way is more particularly identified on the subdivision
plat attached hereto as Exhibit A.
The Grantee agrees to restore and repair any actual damage to Grantor's property that may
be directly caused by the construction, reconstruction, or maintenance of said Church Property
except as hereinafter provided. The Grantor agrees that the Grantee will not be expected to restore
the property to the identical original condition, but rather as near thereto as is practicable, and that

Agenda item for public hearing and second reading of ordinances to remove proffered
conditions from commercial property.
BACKGROUND:
In 2008, Michele Meinhart rezoned the property to amend the proffers from a 2001
rezoning with the intent of expanding the existing business that was operating on the
property. This expansion was never completed.
The current proffers limit uses of the property and the square footage of certain
uses, requires conformance with the site plan, building elevations and landscaping
plan, limit signage, and restrict light pole height.
This request is to remove the proffered conditions to allow future development to any
of the by -right C-1 uses.
The process to remove proffered conditions is through a rezoning.
Most of the site is designated a floodway and floodplain.
DISCUSSION:
The Planning Commission held a public hearing on this request on February 4, 2020.
No citizens spoke on this request during the public hearing. The Planning Commission

discussed the history of the property, the floodplain restrictions, C-1 by -right uses, the
proffered conditions and zoning regulations, lighting, signage, future land use
designation (Core), adjacent development since 2008, and any potential traffic issues.
The Commission recommends approval of the request to remove the proffered
conditions.
FISCAL IMPACT:
There is no fiscal impact on this agenda item.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the second reading of the ordinance to
remove the proffered conditions from the property.

4. The proposed landscaping shall be constructed in substantial conformance with
the Landscape Plan prepared by Craighead and Associates, dated September 29,
2008.
5. If a new freestanding sign is proposed, it shall be monument in style, and
constructed with materials to compliment the proposed building elevation. The
monument sign shall not exceed ten (10) feet in height, and contain no more
than fifty (50) total square feet.
6. All exterior lighting poles shall not exceed fifteen (15) feet in total height
inclusive of the base.
7. The proposed uses on-site shall be limited to General Office, Medical Office,
Business or trade schools, and Guidance Services.
EXECUTIVE SUMMARY:
Michelle Meinhart is requesting to remove proffered conditions from a 2008 rezoning. The property is located at
5681 Starkey Road and is 1.24 acres in size. The purpose of the request is to allow for the future development of all
the permitted uses in the C-1 zoned district.
The purpose of the C-1 Low Intensity Commercial district, per Section 30-53-1 of the Roanoke County Zoning
Ordinance is to provide for the development of attractive and efficient office and commercial uses in the urban
service area which serve both community and county -wide needs. The C-1 district allows for varying intensities of
office and commercial development as part of either a planned office complex or, to a limited degree, small scale
office and commercial uses. The C-1 districts are most appropriately found along or near major arterial streets
where existing commercial development has occurred and/or where commercial zoning has been established, or
near existing residential development where it would serve as a logical buffer strip between conflicting land use
types. Land uses permitted in the C-1 district are generally consistent with the recommendations set forth in the
transition and core land use categories of the comprehensive plan. Site development standards are intended to
ensure compatibility with adjacent land uses.
The following proffers, from the 2008 rezoning, are being requested to be removed:
1. The property shall be developed in substantial conformance with the Site Plan prepared by Craighead and
Associates, dated September 29, 2008

The Future Land Use Designation for this property is Core. Core is a future land use area where high intensity
urban development is encouraged. The proposed request does conform to the Core future land use designation.
1. APPLICABLE REGULATIONS
The property will be regulated by Section 30-53, C-1, Low Intensity Commercial District. (C-1 Low Intensity
Commercial District Regulations attached).
Permitted uses in the C-1 zoned district include, but are not limited to the following: Clubs, Day Care
Centers, Guidance Services, Financial Institutions, General Office, Medical Office, Antique Shops, Bed and
Breakfast, Business Support Services, Business or Trade Schools, Consumer Repair Services, Personal
Improvement Services, Personal Services, Studio, Fine Arts and Veterinary Hospital/Clinic. Additional use
and design standards may apply to the uses above.
Roanoke County comprehensive site plan review will be required if this request is approved. This includes
any improvements required by the Office of Building Safety.
2. ANALYSIS OF EXISTING CONDITIONS
Background — The property was initially developed in the mid -1940s with the completion of the primary
structure in 1945. The property would remain residential through the1989 rezoning for a commercial use.
The conditions imposed at that time included a provision preventing any future expansion of the structure. In
2
2001, a petition was filed to amend the condition preventing its expansion which allowed for a small
expansion to the rear of the structure. The majority of the 1989 conditions were retained as part of the 2001
rezoning. In 2008, Michele Meinhart rezoned the property to amend the proffers from the 2001 rezoning.
The intent was to expand the existing business that was operating on the property. However, the expansion
was never completed. Currently the property is vacant, however the previous use was a medical office.
TopographyNegetation — The site is generally level with the exception of the slight, downward slope from its
Starkey Road frontage. The southern property line rests along a small creek. Most of the site is designated
as a floodway and floodplain (100 -year and 500 -year). The western property line consists of a dense
vegetated tree buffer. In addition, there is a mixture of trees and shrubs located around the existing primary
building and parking area.
If this request is approved, the landscape buffer as shown on the proffered Landscape Plan, will no longer
be required. At the time of the 2008 rezoning, the property to the west was zoned R-1. That property is now
zoned C-2CS as a result of the approved rezoning in 2016 by Valley Management Company, Inc.
Surrounding Neighborhood — To the north and northwest and west are vacant properties, zoned C-2CS
(High Intensity Commercial district). To the south is an existing office in a former single family residence
zoned C-1 C (Low Intensity Commercial with Conditions). Immediately located across Starkey Road are
single-family residential properties, both zoned R-3 (Medium Density Multi -Family Residential).
3. ANALYSIS OF PROPOSED DEVELOPMENT
Site Layout/Architecture — Currently there are two buildings on the property. The primary building is 1,327
square feet in size. In addition, there is a detached garage located at the rear of the property. There are 6
existing parking spaces on the site. Any change of use from the existing medical office use type would be
required to meet the parking calculations per the Roanoke County Zoning Ordinance. No site development
changes are being proposed with this request.
Currently, there is an existing proffered condition that limits signage to a 50 square foot monument style
sign that is 10 feet tall. If removed, 228 square feet of signage would be allowed for this property based on
its road frontage. Sign height and setback regulations allow for a 7 -foot tall sign with a 5 -foot setback or a
15 -foot tall sign with a 10 -foot setback or a 25 -foot sign with a 15 -foot setback.
There is also an existing proffered condition that limits light pole height to 15 feet. If removed, there is no
standard in the County's zoning ordinance that limits the height of light poles. However, any additional
exterior lighting will be regulated by Section 30-94 of the Roanoke County Zoning Ordinance that states that
"all exterior lighting fixtures shall be designed, located and arranged so as not to direct glare on adjoining
streets or residential property. The intensity at adjoining streets or residential properties shall not exceed 0.5
foot candles." A photometric plan would be required as part of any site development process.
Access/Traffic Circulation — The site is currently accessed directly off Starkey Road, utilizing the existing
driveway. The Virginia Department of Transportation (VDOT) did indicate a Land Use Permit will be required
if a new entrance is needed from the VDOT right-of-way or for the change in use of an existing entrance. In
addition, a minor traffic impact analysis may be required for possible impacts along Starkey Road resulting
from development.
Fire & Rescue/Utilities — Brian Simmons, Roanoke County Fire Marshal, has the following comment: "Fire
and Rescue does not object to this proposal and it would not greatly affect the services we provide.
However, depending on the building use established by the Office of Building Safety, a change of use may
need to occur. If so, fire flow and access requirements would need to be addressed by our office."
Office of Building Safety — Morgan Yates, Roanoke County Building Commissioner, has the following
comment: "A Building Code Change of Use may be required for the proposed use. Please contact the Office
of Building Safety once the new use is determined to verify."
Economic Development — No objections to the request. As further stated, "The C-1 zoning uses are
consistent with neighboring development, and the existing proffers limits the development capability of the
property. Further, the property is located within a desirable commercial corridor, that typically generates
demand from diverse small business enterprises."
Stormwater Operations/Floodplain: Butch Workman, Stormwater Operations Manager has stated, "the
structure/property is located in Flood Zone AE, as shown on the Flood Insurance Rate Map, Panel No.
51161 CO253G dated September 28, 2007. As such, any improvements to the building or property will
require floodplain approval."
4. CONFORMANCE WITH ROANOKE COUNTY COMMUNITY PLAN
The 2005 Comprehensive Plan indicates that the Future Land Use Designation of this property as Core.
The Core is a future land use area where high intensity urban development is encouraged. Land uses within
core areas may parallel the central business districts of Roanoke, Salem and Vinton. Core areas may also
be appropriate for larger -scale highway -oriented retail uses and regionally -based shopping facilities. Due to
limited availability, areas designated as Core are not appropriate for tax-exempt facilities. The proposed
request does conform to the Core future land use designation.
5. STAFF CONCLUSIONS
Michelle Meinhart is requesting to remove proffered conditions from a 2008 rezoning. The property is
located at 5681 Starkey Road, located in the Cave Spring Magisterial District. The purpose of the request is
to allow for the future development of the site. Not only do the proffers limit the use types, but also restrict
the development by proffering the concept plan, building renderings and specific landscape requirements.
If this request is approved, any redevelopment would be severely limited due to majority of the property
being located in the floodplain. In addition, any change of use from the existing medical office use type
would require improvements as required by the Office of Building Safety and the Roanoke County Zoning
Ordinance. Finally, the approval of this request would be consistent with other land use actions on adjacent
properties since 2008. The impact to the properties located to the north and northwest, now zoned C-2CS
would be very minimal. In 2008 those parcels were both residential use types. The proposed petition is
consistent with the County's Comprehensive Plan Core future land use designation.

A concept plan of the proposed project must be submitted with the application. The concept plan shall graphically depict the
land use change, development or variance that is to be considered. Further, the plan shall address any potential land use or
design issues arising from the request. In such cases involving rezonings, the applicant may proffer conditions to limit the
future use and development of the property and by so doing, correct any deficiencies that may not be manageable by County
permitting regulations.
The concept plan should not be confused with the site plan or plot plan that is required prior to the issuance of a building
permit, Site plan and building permit procedures ensure compliance with State and County development regulations and may
require changes to the initial concept plan. Unless limiting conditions are proffered and accepted in a rezoning or imposed
on a special use permit or variance, the concept plan may be altered to the extent permitted by the zoning district and other
regulations.
A concept plan is required with all rezoning, special use permit, waiver, community plan (15.2-2232) review and variance
applications. The plan should be prepared by a professional site planner. The level of detail may vary, depending on the
nature of the request. The County Planning Division staff may exempt some of the items or suggest the addition of extra
items, but the following are considered minimum:

To extend learning opportunities to local schools including public and private day care,
elementary, secondary, and colleges. These schools may participate either in the instructional mode or

learning environment.

WHEREAS, the first reading of this ordinance was held on August 26, 2008, and the
second reading and public hearing were held October 28, 2008; and,
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on September 2, 2008 and October, 7, 2008; and
WHEREAS, legal notice and advertisement has been provided as required by law.
BE IT ORDAINED by the Board of Supervisors of Roainoke County, Virginia, as
follows:
That the proffered conditions in a C-1 C, Office District with Conditions, on a
certain tract of real estate containing 1.241 acres, as described herein, and located at 5681
Starkey Road (Tax Map Number 87.18-1-40) in the Cave Spring Magisterial District, are
hereby amended as set out below.
2. That this action is taken upon the application of Starkey Medical, PC.
3. That the owner of the property has voluntarily proffered in writing the following
amended conditions which the Board of Supervisors of Roanoke County, Virginia, hereby
accepts:
(1 ) The property shall be developed in substantial conformance with the site plan
prepared by Craighead and Associates, dated September 29, 2008.
(2) No more than 6,600 square feet of medical office shall be constructed, and
no more than 2,464 square feet of general office shall be constructed Including the existing
structure.
(3) The proposed building shall be constructed in substantial conformance with
the Starkey Road Elevation (East) prepared by Craighead and Associates, dated August
10, 2008.
(4) The proposed landscaping shall be constructed in substantial conformance
with the Landscape Plan prepared by Craighead and Associates, dated September 29,
(5) If a new freestanding sign is proposed, it shall be monument in style, and
constructed with materials to compliment the proposed building *elevation. The monument
sign shall not exceed ten (10) feet in height and contain no more than fifty (60) total square
feet.
(6) All exterior lighting poles shall not exceed fifteen (15) feet in total height
inclusive of the base
(7) The proposed uses on-site shall be limited to General Office, Medical Office,
Business or trade schools and Guidance Services.
4. That said real estate is more fully described as follows,

See. 30-53-1. Purpose.
(A) The purpose of the C-1 low intensity commercial district is to provide for the
development of attractive and efficient office and commercial uses in the urban service
area which serve both community and county -wide needs. The C-1 district allows for
varying intensities of office and commercial development as part of either a planned
office complex or, to a limited degree, small scale office and commercial uses. The C-1
districts are most appropriately found along or near major arterial streets where existing
commercial development has occurred and/or where commercial zoning has been
established, or near existing residential development where it would serve as a logical
buffer strip between conflicting land use types. Land uses permitted in the C-1 district are
generally consistent with the recommendations set forth in the transition and core land

(A) Minimum lot requirements.

(B) Minimum setback requirements.
1. Front yard:
a. Principal structures: 30 feet, or 20 feet when all parking is located behind
the front building line.
b. Accessory structures: Behind front building line.
2. Side yard: None.
3. Rear yard:
a. Principal structures: 15 feet.
b. Accessory structures: 3 feet.
4. Where a lot fronts on more than one (1) street, front yard setbacks shall apply to
all streets.
(C) Maximum height of structures.

Height limitations:
a. Principal structures: When adjoining property zoned R-1 or R-2, forty-five
(45) feet, including rooftop mechanical equipment. The maximum height
may be increased, provided each required side and rear yard adjoining the
R-1 or R-2 district is increased two (2) feet for each foot in height over
forty-five (45) feet. In all other locations the height is unlimited unless
otherwise restricted by this ordinance.
b. Accessory structures: 15 feet.
(D) Maximum coverage.
Building coverage: 50 percent of the total lot area.
2. Lot coverage: 80 percent of the total lot area.

WHEREAS, the first reading of this ordinance was held on August 26, 2008, and the
second reading and public hearing were held October 28, 2008; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on September 2, 20018 and October, 7, 2008, and
WHEREAS, legal notice and advertisement has been provided as required by law.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
fo}lows.
That the proffered conditions in a C-1 C, Office District with Conditions, on a
certain tract of real estate containing 1.241 acres„ as described herein, and located at 5681
Starkey Road (Tax Map Number 8718-1-40) in the Cave Spring Magisterial District, are
hereby amended as set out below.
2. That this action is taken upon the application of Starkey Medical, PC,
3. That the owner of the property has voluntarily proffered in writing the following
amended conditions which the Board of Supervisors of Roanoke County, Virginia, hereby
accepts:
(1) The property shall be developed in substantial conformance with the site plan
prepared by Craighead and Associates, dated September 29, 2008.
(2) No more than 5,600 square feet of medical office shall be constructed, and
no more than 2,464 square feet of general office shall be constructed including the existing
structure..
(3) The proposed building shall be constructed in substantial conformance with
the Starkey Road Elevation (East) prepared by Craighead and Associates, dated August
10, 2008.
(4) The proposed landscaping shall be constructed in substantial conformance
with the Landscape Plan prepared by Craighead and Associates, dated September 29,
(5) If a new freestanding sign is proposed, it shall be monument in style, and
constructed with materials to compliment the proposed building elevation. The monument
sign shall not exceed ten (10) feet in height and contain no more than fifty (50) total square
feet,
(6) All exterior lighting poles shall not exceed fifteen (15) feet in total (height
inclusive of the base.
(7) The proposed uses on-site shall be limited to General Office, Medical Office,
Business or trade schools and Guidance Services,

Beginning at a point on the westerlyside of Starkey Road, Virginia Secondary Route
904 at the southeasterly corner of the property now or formerly known as the Baptist
Parsonage; thence with the westerly side of Starkey Road South 24" 16' West 154
feet to a point in the center of a dry branch; thence leaving Starkey Road North 73'
30' West 310,6 feet to a point; thence North 210 37' East 191.75 feet to a point;
thence South 66' 33' East 316.6 feet to the point of beginning.

5. That this ordinance shall be in full force and effect thirty (30) days after its
finai passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed to

this ordinance.

the estate of Sidney Louis Hyatt to the Roanoke County Library.
The gift is given in memory of Sidney Louis Hyatt, known as
Sidney Louis. If you find a way to memorialize him, it would be
greatly appreciated and should be in the name of Sidney Louis.
The gift comes as a result of the help Ms. Kelly Whitescarver
gave to Mr. Hyatt on his weekly visits to the Library. It is
hoped that Ms. Whitescarver will have a hand in the selection of
books, CDs, etc, for the Library.
Many recipients have requested biographical data on Mr.
Hyatt and his brother, Babe. While I don't have complete
biographical sketches on them, enclosed is a copy of information
outlining some of what my wife and I knew about them. We hope it
will be helpful.

Estate of Sidney Louis Hyatt
Enclosures
Following is a glimpse into the lives of Babe and Sidney Louis as
remembered by Sidney's neighbors and friends, Max and Diane
Leach;
The brothers Babe and Sidney Louis Hyatt, known as Babe and
Sidney Louis, were totally devoted to each other. At the time of
Babe's death in 1974, they owned a thriving cattle and lamb
brokerage in Bonsack, near Roanoke, Virginia. Sid, as his
friends called him, was responsible for the cattle, and Babe was
responsible for the lambs. Sid kept a hood ornament of a bull on
his cadillac; Babe had a lamb on his. Sid wore an embroidered
bull on all his jackets. Their tombstone in Beth Israel Cemetery
has a bull and lamb etched on it. When Babe died, Sid had the
following New Testament scripture inscribed on the tombstone they
both now share:
"We fought a good fight, we finished the course, we kept the
faith."
After Babe's, death, Sid mourned deeply for two years. It was
during this time that we started our wonderful friendship with
Sid. He eventually came to have dinner with us nearly every
Saturday night. He loved talking over dinner about his Jewish
heritage and traditions and enjoyed hearing about our religion.
He respected persons of all denominations who believed and
practiced their faith and kept family traditions. He enjoyed
having Christmas dinner with our family.

The brothers believed and practiced the conservative Jewish
religion. Sid was often critical of his family for not
"properly" observing all Jewish holidays. He believed Jewish
children should be taught the old. Jewish traditions, including
how to prepare the traditional foods.
In their business, they went by the last name Louis instead
of Hyatt out of fear of antisemitic discrimination.
Sid, many years ago, learned that bulls sold for a higher
price than cows, but it was common knowledge that bulls would
fight if raised together. Sid, possessing a keen business sense,
developed a method of raising bulls so that they wouldn't fight.
Agricultural extension agents visited the farm and wrote a paper
on Sid's methods.
The brothers were born in Washington, D.C., of Russian
Jewish parents. Neither brother ever married. Babe, the more
vocal and outgoing one, earned a law degree from George
Washington University. Sid did not graduate from high school but
had a head full of knowledge. Sid was an avid reader, averaging
three books a week. Babe's hobby was raising racing pigeons.

The brothers tried unsuccessfully to start a brokerage
business during the 1930s. After failing, they returned to their
home and borrowed money from their father. The second time, it
worked, and they bought several farms in Virginia and traded at
various stock markets around Virginia and neighboring states.
They often supported colleges and churches of all denominations
in the communities in which they did business.
Sidney Louis Hyatt died September 7, 19891 of cancer. He
was 70 years old. We lost a dear friend, but we're glad he'll be
remembered by the charities who receive portions of his estate.
If his money can help one child get an education or better
prepare for life, he would be most pleased.

Acceptance and allocation of funds in the amount of $1,922.97 to the Clerk of the Circuit
Court from the Commonwealth of Virginia
BACKGROUND:
Technology Trust Funds represent fees collected by the Roanoke County Circuit Court
Clerk's Office, have been received from the State in the amount of $1,922.97. In
accordance with State of Virginia Code Section 17.1-279 stated the Circuit Court Clerk's
Office shall assess a $5.00 fee called Technology Trust Fund Fee. Each month, the
Clerk's Office can request the fees that were assessed the previous month. The code
section further states that four of every five dollar fee shall be allocated by the
Compensation Board from the trust fund for the purposes of obtaining and updating
office automation and information technology equipment including software and
conversion services; preserving, maintaining and enhancing court records, including but
not limited to the costs of repairs, maintaining and enhancing court records, consulting
services, service contracts, redaction of social security numbers from land records and
system replacement or upgrades and improving public access to court records.
DISCUSSION:
The funds received from the Commonwealth of Virginia have been earmarked for

maintenance needs for the Clerk of circuit Court, specifically towards the twice yearly
maintenance bill from the Supreme Court for maintaining their records, equipment, etc.
FISCAL IMPACT:
All funds are provided by the Commonwealth of Virginia. No County matching funds are
required.
STAFF RECOMMENDATION:
Staff recommends accepting and allocating $1,922.97 to the Clerk of Circuit Court from
the Commonwealth of Virginia.

WHEREAS, Ms. Merlin has proved herself to be an invaluable employee,

her personal beliefs into her daily work ethics and professional interactions with citizens
and coworkers; and
WHEREAS, Ms. Merlin, was an integral and reliable employee for the County of
Roanoke demonstrating the personal empathy and caring for all of our citizens and
employee's.

RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY TO MICHAEL WILLIAMS,
POLICE OFFICER -COMMANDER SERV. CID DIRECTOR, UPON HIS
RETIREMENT AFTER MORE THAN TWENTY-SIX (26) YEARS OF
SERVICE
WHEREAS, Michael Williams was employed by Roanoke County on August 14,
1993; and
WHEREAS, Mr. Williams retired on January 1, 2020, after twenty-six (26) years and
five (5) months of devoted, faithful and expert service to Roanoke County; and
WHEREAS, during Mr. Williams' tenure with the Police Department, he advanced
through the ranks of Police Officer, Sergeant, Lieutenant and Commander; and
WHEREAS, as he advanced through the ranks, Mr. Williams protected the citizens
of the County and the Roanoke Valley with professionalism and dedication, while serving in
the Uniform Patrol, Criminal Investigations, Vice and Services Divisions as both an officer
and supervisor. Mr. Williams, at the rank of Commander, served as the Roanoke County
Criminal Justice Academy Director and he completed his service to the citizens of Roanoke
County as the Commander in the Services Division and
WHEREAS, Mr. Williams served the Department and the citizens of Roanoke
County in an exemplary manner. During his tenure, Mr. Williams was instrumental in
developing and maintaining the firearms range and driving center. Mr. Williams was the
Department's project lead on the construction of the Roanoke County Criminal Justice
Academy and formed the first combined basic law enforcement class with the City of
Roanoke. During his tenure as the Academy Director, Mr. Williams directly managed and

graduated 25 basic classes with 198 new police, jail and communications officers entering
the profession of public safety. As the Services Division Commander, Mr. Williams was
instrumental in the selection of an e -citation solution and migrating the Department to an
encrypted radio system.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County expresses its deepest appreciation and the appreciation of the citizens of
Roanoke County to MICHAEL WILLIAMS for more than twenty-six (26) years of capable,
loyal and dedicated service to Roanoke County; and

Resolution requesting the Virginia Department of Transportation (VDOT) accept
Mystique Court Wedgewood Section 4 in the Hollins Magisterial District into the Virginia
Department of Transportation System.
BACKGROUND:
Staff is requesting that the Board of Supervisors approve a resolution that the Virginia
Department of Transportation (VDOT) accept, as described by the AM -4.3, (See
Attachment "A") 0.06 mile of Mystique Court from the intersection with Golden Ivy Road
(VA SEC. Route # 1456) to its cul-de-sac. This road is located within Wedgewood
Section 4 in the Hollins Magisterial District. See attached Exhibit "A" for exact location.
DISCUSSION:
Staff has inspected this road along with representatives of the Virginia Department of
Transportation. The road has been deemed acceptable for inclusion in the VDOT
system (See attachment B).

WHEREAS, the plat for the above named Subdivision is recorded in the above named Locality of Virginia, within
which Developer constructed the streets listed on the attached report titled 'Surety Addendum,' which is fully
incorporated herein by reference; and
WHEREAS, the Developer is required to provide Surety against any defects in workmanship and/or materials
used in the construction of the streets in the above subdivision and included on the 'Surety Addendum' for a
period of one (1) year following the date of the Locality's Resolution date and expiring, as shown above; and
WHEREAS, for the term of this Escrow Agreement, the Commonwealth has agreed that the Developer may
deposit the above indicated Amount of Surety in escrow to cover costs incurred by the Virginia Department of
Transportation to correct defects due to faults in workmanship or materials used in the construction of the streets
described in the attached Surety Addendum.
NOW, THEREFORE, for and in consideration of the foregoing premises and the following terms and conditions,
the parties hereto agree as follows:
1 Developer has deposited with Trustee, and Trustee by the execution hereof acknowledges that he holds the
above listed Amount of Surety under the terms of this agreement.
2 Trustee shall immediately place and maintain the above listed Amount of Surety with the Financial Institution
named above in an interest bearing account conditioned to allow withdrawal of all or part of the funds by the
Trustee at any time without penalty, until the expiration date cited above.
3 In the event the Commonwealth, in its sole discretion, deems it necessary to perform any work, including
labor, use of equipment, or materials to correct defects in workmanship and/or materials used by the Developer
in the construction of said streets during the period this Escrow Agreement is in force, either by its own forces or
by contract, Trustee shall disburse to the Commonwealth within five (5) days of receipt of written demand such
sum or sums for such work from the Amount of Surety stated above.
4 The Trustee shall pay any Sum remaining in said account to the Developer not sooner than one (1) day after
the Surety Expiration Date cited above, at which time this Escrow Agreement shall terminate.

RESOLUTION REQUESTING ACCEPTANCE OF MYSTIQUE COURT INTO
THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY
SYSTEM
WHEREAS, the streets described on the attached VDOT Form AM -4.3, fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the
Circuit Court of Roanoke County; and
WHEREAS, the representative for the Virginia Department of Transportation has
advised this Board that the street(s) meet the requirements established by the Virginia
Department of Transportation's Subdivision Street Requirements; and
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation add the street(s) described on the attached Additions Form
AM -4.3 to the secondary system of State highways, pursuant to §33.2-705 of the Code of
Virginia, and the Department's Subdivision Street Requirements, after receiving a copy of
this resolution and all outstanding fees and documents required of the developer,
whichever occurs last in time; and
BE IT FURTHER RESOLVED, this Board guarantees a clearand unrestricted right-
of-way, as described, and any necessary easements for cuts, fills and drainage; and
BE IT FURTHER, that a certified copy of this Resolution be forwarded to the
Residency Administrator for the Virginia Department of Transportation.

Resignation of Roanoke County appointment.
BACKGROUND:
In December 2019 Roanoke County appointee, Virginia Vann, resigned from the Blue
Ridge Behavioral Healthcare Board of Directors. Her term will not expire until
December 31, 2020.
DISCUSSION:
Staff from Blue Ridge Behavioral Healthcare have recommended the appointment of
Carol Whitt to fill the vacancy of Ms. Vann's membership on the Board.
It is the consensus of the Board of Supervisors to appoint Ms. Whitt to fill this vacancy.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
STAFF RECOMMENDATION:
Staff recommends confirmation of Carol Whitt to fill the unexpired term on the Blue

DECLARING MARCH AS MULTIPLE SCLEROSIS EDUCATION
AND AWARENESS MONTH IN THE COUNTY OF ROANOKE
WHEREAS, Multiple Sclerosis (MS) is a chronic, often disabling disease of the
central nervous system that affects approximately 400,000 people
in the United States; and
WHEREAS, it typically strikes young adults in the prime of life — in their 20's to
40's. Women are more likely to have Multiple Sclerosis by about
3:1. Symptoms can begin as simply as tingling and progress to
near paralysis; and
WHEREAS, March of 2020 is Multiple Sclerosis Education and Awareness
Month. It is important for better education and awareness of
Multiple Sclerosis so that it's victims can lead more productive and
satisfying lives — to benefit themselves, their caregivers and
families and the overall community; and
WHEREAS, Multiple Sclerosis is a disease that not only affects the person with
the condition, but also greatly impacts family, friends and the
community; and
WHEREAS, the exact cause of Multiple Sclerosis is still unknown, and there is
no known cure; and
WHEREAS, the symptoms of Multiple Sclerosis may be, mild such as numbness
in the limbs, or severe, such as paralysis or loss of vision; and
WHEREAS, every hour of every day, someone is newly diagnosed with Multiple
Sclerosis; and
WHEREAS, the Multiple Sclerosis Alliance of Virginia (MSAV) provides
programs and services for anyone in Virginia whose life has been
affected by MS.
NOW, THEREFORE, 1, David F. Radford, Chairman of the Board of Supervisors, of
Roanoke County, Virginia, do hereby recognize the month of March
2020, as Multiple Sclerosis Education and Awareness Month in the
County of Roanoke and call this observance to the attention of all
our citizens.

and Capital Project Status Update with the Board of Supervisors.
BACKGROUND:
As part of the annual budget development process, County staff conducts a series of
work sessions with the Board of Supervisors after the County Administrator proposes
the capital and operating budgets. This work session will provide information on the
proposed fiscal year 2021 - 2030 Capital Improvement Program (CIP) initially presented
to the Board of Supervisors on January 28, 2020. The presentation will also provide
information on active capital projects.
DISCUSSION:
This work session will provide information to the Board of Supervisors regarding the
proposed fiscal year 2021 - 2030 CIP. The attached Power Point presentation will be
shown.
Per Section 5-4 of the County of Roanoke's Comprehensive Financial Policy, County
staff will provide a summary status of active capital projects on a bi-annual basis. This
presentation provides an overview of the status and financial information of capital

FISCAL IMPACT:
There is no fiscal impact associated with the receipt of the attached presentation.
STAFF RECOMMENDATION:
Staff recommends the Board of Supervisors receive information regarding the fiscal
year 2021 - 2030 Capital Improvement Program (CIP) and information on active capital
projects.
