Good afternoon and welcome to our meeting for March 10, 2020. Regular meetings are
held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00
p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Board of
Supervisors meetings can also be viewed online through Roanoke County's website at
www.RoanokeCountvVA.gov. Our meetings are closed -captioned, so it is important for

Recognition of award for Urban Libraries Council Top Ten Innovators for 2019
BACKGROUND:
On October 17, 2019, Roanoke County Public Library was awarded the Urban Libraries
Council top ten Innovator award for 2019.
A panel of expert judges selected the Library from 260 submissions in ten (10)
categories that showcase out-of-the-box thinking and creative application of library
resources.
The Library won in the category of Workforce and Economic Development. Award
winners were recognized for their level of creativity, ability for other libraries to adapt
their work and the outcomes achieved.
Susan Benton, Chief Executive Officer of the Urban Libraries Council will be in
attendance to make the presentation.

Briefing for the Board of Supervisors regarding the County Administrator's Proposed
Fiscal Year 2020-2021 Operating Budget.
BACKGROUND:
As part of the annual budget process, the County Administrator presents a balanced
operating budget for consideration by the Board of Supervisors. This briefing provides
an overview of the County Administrator's Proposed Fiscal Year 2020-2021 Operating
Budget.
DISCUSSION:
This time has been scheduled to provide the Board of Supervisors with a briefing on the
County Administrator's Proposed Fiscal Year 2020-2021 Operating Budget. A Power
Point presentation providing an overview of the operating budget will be presented to
the Board. The proposed operating budget document will be distributed to the Board of
Supervisors at the March 10, 2020 meeting.
FISCAL IMPACT:
There is no fiscal impact associated with this briefing. The fiscal impact of the operating

STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors receive information regarding the

The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the third Tuesday and the second
regularly scheduled meeting of the month of December 2019. Audio and video
recordings of this meeting will be held on file for a minimum of five (5) years in the office
of the Clerk to the Board of Supervisors.
IN RE: OPENING CEREMONIES
Before the meeting was called to order an invocation was given by Pastor
Ken Nienke of Fellowship Community Church. The Pledge of Allegiance was recited by
all present.

Chairman North called the meeting to order at 3:03 p.m. The roll call was

Chairman North stated the petitioner on agenda item K. Bane International
Company, LLC to obtain a Special Use Permit in a AG -3, Agricultural/Rural Preserve,
District to operate a campground on approximately 48.06 acres, located at 2745 Loch

Haven Lake Drive, Catawba Magisterial District has been postponed at the request of
the petitioner. As a result, there is no need to have an evening session at 7:00 p.m. He

be considered after Reports and Inquiries from Board Members. There were no

1. Resolution implementing a pilot program to establish fees and
regulations to facilitate the operation of Bicycle and E -Scooter
Sharing Companies in the County (Peter Lubeck, Acting County
Attorney)
Mr. Lubeck outlined the request for resolution. There was no discussion.
RESOLUTION 121719-1 IMPLEMENTING A PILOT PROGRAM
TO ESTABLISH FEES AND REGULATIONS TO FACILITATE
THE OPERATION OF BICYCLE AND E -SCOOTER SHARING
COMPANIES IN THE COUNTY
WHEREAS, in 2019, the General Assembly of the Commonwealth of Virginia
enacted Section 46.2-1315 of the Code of Virginia, in which it authorizes counties to
regulate (by ordinance, any governing body action, or administrative action) the
operation of motorized skateboards or scooters, bicycles, or electric power -assisted
bicycles (hereafter "shared mobility devices") for hire, provided that such regulation or
other governing body or administrative action exists prior to January 1, 2020; and
WHEREAS, although several businesses that offer shared mobility devices for
hire have located or expressed an intent to locate in neighboring localities, no such
business has hitherto requested to operate in the County; and

WHEREAS, the County desires to proactively assess the viability of shared
mobility devices in the County and to understand the parameters that will allow these
devices to operate effectively and to avoid any public nuisance under the authority of
Virginia Code § 15.2-2018.
NOW, THEREFORE, BE IT RESOLVED:
1) That the Board of Supervisors directs County staff to develop and implement
a pilot program to establish fees and regulations to license and facilitate the
operation of shared mobility device companies in the County.
2) The regulations in the pilot program shall be established and amended, as
needed, by administrative action.
3) Insofar as there is no present indication that any shared mobility device
company desires to operate in the County, the Board will not set an expiration
date on the pilot program. If and when County staff are able to develop further
recommendations for permanent regulations, based on a period of pilot
program implementation, the Board directs staff to bring such
recommendations before the Board for further consideration.
On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor
Hooker and carried by the following recorded vote:

2. Resolution of the Board of Supervisors of Roanoke County,
Virginia consenting to the amendment of special assessment
revenue note, series 2012, of the South Peak Community
Development Authority and Related Note Purchase Agreement
(Rebecca Owens, Assistant County Administrator; Richard
Caywood, Assistant County Administrator)
Mr. Caywood outlined the request for resolution. There was no

AMENDMENT OF SPECIAL ASSESSMENT REVENUE NOTE,
SERIES 2012, OF THE SOUTH PEAK COMMUNITY
DEVELOPMENT AUTHORITY AND THE RELATED NOTE
PURCHASE AGREEMENT
WHEREAS, the Board of Supervisors of Roanoke County, Virginia (the "Board of
Supervisors"), established the South Peak Community Development Authority (the

"Authority") for the purpose of assisting in the development of certain infrastructure
improvements (the "Improvements") described in Exhibit B to the Memorandum of
Understanding dated as of February 1, 2011 (the "Memorandum of Understanding"),
between Roanoke County, Virginia (the "County") and Slate Hill I LLC; and
WHEREAS, Section 1 of the Memorandum of Understanding provides that the
Authority may not issue revenue bonds without first receiving the consent of the Board
of Supervisors to do so; and
WHEREAS, on December 21, 2012, pursuant to the Memorandum of
Understanding and with the prior consent of the Board of Supervisors, the Authority
issued its Special Assessment Revenue Note, Series 2012 (the "2012 Note"), and sold
the 2012 Note to Carter Bank & Trust (the "Bank"), pursuant to a Note Purchase
Agreement dated as of December 1, 2012 (the "Note Purchase Agreement"), between
the Authority and the Bank; and
WHEREAS, the Bank has offered to reduce the interest rate on the 2012 Note
from 6.5% to 6% and counsel to the Authority has advised that the reduction will result
in a "reissuance" of the 2012 Note for federal tax purposes; and
WHEREAS, on November 26, 2019, the Board of the Authority adopted a
resolution (the "Authority Resolution") authorizing the amendment of the 2012 Note and
the Note Purchase Agreement to reflect the lower interest rate and requesting that the
Board of Supervisors consent to such amendments pursuant to the Memorandum of
Understanding; and
WHEREAS, a copy of the Authority Resolution has been attached hereto as
Exhibit A.
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA:
1. The Board of Supervisors hereby consents to and approves the
amendment of the 2012 Note and the Note Purchase Agreement to reflect the reduction
in the interest rate from 6.50% to 6% as provided in the Authority Resolution.
2. The approval of the amendment of the 2012 Note does not constitute an
endorsement of the 2012 Note. The 2012 Note shall continue to be payable solely from
revenues received by the Authority. The 2012 Note, as amended, shall not be deemed
to constitute a debt, liability, or obligation of the County and shall not impact upon the
debt capacity of the County.
3. All acts and doings of the officers of the County and members of the
Board of Supervisors that are in conformity with the purposes and intent of this
resolution shall be, and the same hereby are, in all respects approved and confirmed.
4. This resolution shall take effect immediately upon its adoption.

RESOLUTION OF THE SOUTH PEAK COMMUNITY DEVELOPMENT
AUTHORITY AUTHORIZING AND APPROVING THE AMENDMENT OF THE
SPECIAL ASSESSMENT REVENUE NOTE, SERIES 2012, AND THE
RELATED NOTE PURCHASE AGREEMENT AND REQUESTING THE
CONSENT OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY,
VIRGINIA, TO SUCH AMENDMENTS
WHEREAS, on December 21, 2012, the South Peak Community Development
Authority (the "Authority") issued its $7,000,000 Special Assessment Revenue Note,
Series 2012 (the "2012 Note"), for the purpose of assisting in the development of certain
infrastructure improvements described in Exhibit B to the Memorandum of
Understanding dated as of February 1, 2011 (the "Memorandum of Understanding"),
between Roanoke County, Virginia (the "County"), and Slate Hill I LLC; and
WHEREAS, the Authority sold the 2012 Note to Carter Bank & Trust (the "Bank")
on the terms set forth in the Note Purchase Agreement dated December 1, 2012 (the
"Note Purchase Agreement"), between the Authority and the Bank; and
WHEREAS, the Bank has offered to reduce the interest rate on the 2012 Note
from 6.5% to 6%; and
WHEREAS, both the Authority's administrator, MuniCap, Inc., and the finance
staff of the County, have reviewed the Bank's proposal and have recommended it to the
Authority; and
WHEREAS, counsel to the Authority has advised that the interest rate reduction
will constitute a "reissuance" of the 2012 Note for federal tax purposes and pursuant to
Section 1 of the Memorandum of Understanding the Board of Supervisors of the County
(the "County Board") must consent to the issuance of bonds by the Authority.
BE IT RESOLVED BY THE BOARD OF THE SOUTH PEAK COMMUNITY
DEVELOPMENT AUTHORITY:
1. The Authority hereby approves the reduction of the interest rate on the
2012 Note from 6.5% to 6%. The reduction will be reflected in amendments to the 2012
Note and the Note Purchase Agreement as set forth in an allonge to the 2012 Note (the
"Allonge") and a document amending the Note Purchase Agreement (the
"Amendment"), forms of which have been presented to this meeting.
The Chairman and Vice Chairman of the Authority (the "Authorized Officers"),
either of whom may act, are hereby authorized to execute and deliver the Allonge and
the Amendment, and the Secretary and the Assistant Secretary of the Authority, either
of whom may act, are authorized to have the seal of the Authority affixed or printed
thereon and to attest such seal. The Allonge and the Amendment shall be in
substantially the forms

2. Presented to this meeting, with such completions, omissions, insertions
and changes as an Authorized Officer may approve, whose approval will be evidenced
conclusively by the execution and delivery of the Allonge and the Amendment.
Notwithstanding the foregoing, the Authorized Officers may not deliver the Allonge and
the Agreement until the County Board has provided its consent thereto.
3. The Authorized Officers, the Secretary and Assistant Secretary and such
other officers of the Authority as the Authorized Officers may direct are hereby
authorized to execute, deliver and record, as necessary, on the Authority's behalf any
amendments to any other documents associated with the issuance and sale of the 2012
Note to reflect the amendments made by the Allonge and the Amendment and all other
agreements, contracts, documents, certificates and instruments approved by either
Authorized Officer relating to such amendments, and to take all such further action as
any of them may deem necessary or desirable in connection therewith, including without
limitation the execution and delivery of a certificate setting forth the expected use of the
property financed by the 2012 Note to show that such expected use will not violate the
applicable provisions of the Internal Revenue Code of 1986, as amended (the "Code"),
and the regulations thereunder, and Form 8038-G to be filed with the Internal Revenue
Service.
4. Any authorization made hereby to the officers of the Authority to execute
documents shall include authorization to the Secretary or Assistant Secretary to affix the
seal of the Authority to such document and attest such seal and authorization to any
officer to provide for the recording of such document where appropriate and deliver it to
the other parties thereto.
5. The Authorized Officers are hereby authorized to provide for the
presentation of a certified copy of this resolution to the County Board and to request on
the Authority's behalf that the County Board consent to the Allonge and the
Amendment. All other acts of the officers of the Authority that are in conformity with the
purposes and intent of this resolution and in furtherance of the issuance and sale of the
Series 2012 Note are hereby authorized, ratified and approved.
This resolution shall take effect immediately upon its adoption

IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS
William Skaff of 4815 Farmington Place Court stated May I say, before I
begin my statement proper, that it may seem that I am simply critical of the Board. Thus,
I would like to respectfully commend the Board on its approval of the Second
December 17, 2019 291
Amendment Sanctuary Resolution. It was uplifting to see so many residents speak
knowledgeably and passionately about the Constitution, natural rights, and God.
Delegate Joe McNamara commented: "We want the Virginia that we have, and we want
to keep it." I feel the same way about Roanoke County. Now to the matter at hand.
Roanoke County officials are characterizing the Carilion Clinic pediatric center at
Tanglewood Mall as the result of the Reimagine 419 Plan, consistent with its goal of
town center density development and the elimination of the natural environment. For
instance, the Economic Development Department says of the Carilion move that the
Plan will create density and density drives retail. Yet, here, exactly the opposite
happened. The Reimagine 419 Plan had, in fact, nothing to do with Carilion's decision
to locate at the Mall. News reports indicate that Blackwater Resources had contacted
Carilion to locate at the Mall immediately after the purchase several years ago—before
there ever was a Plan. Blackwater anticipated reviving the Mall through mixed-use
occupancy and complementary retail, not through residential density in the parking lot.
For Carilion, the choice was a business decision based on market dynamics. Carilion
recognized that there was no pediatric center in this part of the state west of
Charlottesville. As Carilion stated in its news release and elsewhere, the Mall's location
and ample available parking primarily drove its decision. Thus, if the Reimagine 419
Plan were already implemented and the Mall parking lot filled with a city, we can be
fairly certain that Carilion would not have decided to move there. Then 419's economic
future would depend on town center bars rather than healthcare. Moreover, density of
the Reimagine 419 variety will not be driving retail at Tanglewood, but, as Blackwater
explains, the traditional market incentive of synergistic business occupancy. The
pediatric center is not the beginning of the fulfillment of the density -obsessed Reimage
419 Plan, but rather a demonstration of the need for a plan that accommodates market
forces rather than trying to dictate them. Customer traffic drives retail, not building
density. In a mobile society, where people can drive wherever they want, density in itself
is no guarantee of customer traffic. But a good anchor with complementary businesses
is. As Virginia Tech Carilion impacts the 419 corridor, it will be important not to
continually make the same planning mistake—following a density ideology. Residential
density will physically crowd out business growth along 419. The Reimagine 419 Plan
was a product of socialist -style command -and -control central planning by the Planning
Department—devising a plan for private properties and then coercing them to follow it.
The pediatric center is a triumph of the free enterprise system. The project grew
naturally out of economics, not government mandate. Complementary businesses will
gradually join the Mall and its vicinity, driven by prospective customer needs.

Supervisor Peters inquired if there were any requirement that states you
have to have accumulated funds or anticipated funds. Rebecca Owens, Assistant
County Administrator responded stating it is not spelled out but in order to issue the
purchase order, all the funds must be available. They cannot appropriate without the
funds or the borrowing.
Supervisor North stated for the sake of clarity, the $2.2 million from school
sources, it should be clear in 2020 it will be $2.6 going forward.
The Board was in consensus that all the changes were correct.
Mr. O'Donnell then provided a spreadsheet with his initiatives and thought
process. A copy of which is on file in the office to the Clerk to the Board
Ms. Thompson continued the PowerPoint presentation.
Supervisor Peters inquired about which truck was deferred with Chief
Simon advising an engine.

Supervisor Radford asked about an item that was not included, the
stormwater backlog projects and asked for an explanation from Mr. O'Donnell. Mr.
O'Donnell advised that Mr. Caywood and Mr. Monier are the experts, but his
understanding is the problem with the backlog is staff related than capital dollars. There
are two crews that due the work, which is probably more than peer counties due. The
backlog of projects is the availability of the two crews. Adding dollars does not correct
the problem. Mr. Caywood can explain whether it makes sense to contract out. It is
more an operating budget item than a one-time dollar fix.
Supervisor Radford stated he is looking for a solution to tell his
constituents. They are calling him. Mr. Caywood advised it is probably one of their
more frequent areas of calls, drainage issues, particularly related to erosion issues and
with all the wet weather we had last year, accelerated the problem. Currently, we have
twenty-five (25) or so projects that have been identified that are available for staff to
work on today. We spend in the ballpark about $1.35 million a year. The
recommendation is to revisit the item when we look at the operating budget and staff
can present options to the Board if you would like to expand the program. This program
has been significantly expanded over the years as the demand increases. They tend to
be difficult to contract out.
Supervisor North recommended a possible work session on January 14,
2020.

Supervisor Radford stated this was the last meeting for Mr. Assaid and
just wanted to thank him for sponsoring Taco Tuesday tonight, he is looking forward to
that. He appreciates the year we worked together, especially during campaigning. It
was a great help. He also congratulated Supervisor North on being the Chairman for
2019; rounding up everybody and keeping us in the right direction. Thank you to both of
you.
Supervisor Peters stated he echoes the same comments for Mr. Assaid,
He has enjoyed the last four years; it has been fun. He did want to say that he is
welcomed back anytime at three (3) minutes at a time. He echoes the same comments
Supervisor Radford made regarding Mr. North's leadership this year. We appreciate it.
He encouraged everyone to attend Illuminights. He understands it is a beautiful event.
Again, he would like to thank Doug Blount and his staff and Center in the Square for
that partnership. He is planning on taking his family this weekend. Lastly, the
backbone of Roanoke County, the Board can sit up here and make decisions all day
long, but coming out of Thanksgiving and going into Christmas, we can make decisions
all day long, but it is our employees that carry it out. Mr. North alluded to it earlier. He
thanked the employees for all they do for Roanoke County, our Administrator for having
to listen to the Board and pass it down the pipe to the employees, but appreciate
everything that everyone does and wished everyone a Merry Christmas.
Supervisor Assaid stated as usual he does not have a lot to say, but the
best present he would leave is Mr. Mahoney.
Supervisor Hooker stated last week she had the honor and privilege of
going to the Community Christmas store at its opening and ribbon cutting and was
touched by the compassion and dignity they offer the citizens they serve. She was very
impressed with that operation. Any chance you get to support the organization, she
highly recommends it. Illuminights is awesome and appreciates everything Doug
Blount and his staff has done. What a great partnership with Center in the Square. It
took an amazing amount of work, but for her husband and herself, they left the event
incredibly impressed and have talked about it often to our friends and co-workers and
plan on going back. Thank you for all your good work on that. She thanked
Supervisor North for a great year; we appreciate your work, we appreciate you taking

this on with such fervor and doing a lot of good things. A lot of good things have
happened this year. We are going to miss you, George; your knowledge, your study

BACKGROUND:
Hollins College has requested a waiver from the County's noise ordinance under
Section 13-23 of the Roanoke County Code to allow for a formal dance to be held on
Saturday, April 11, 2020 and an outdoor concert to be held Friday, May 1, 2020. Both
events will not end until after 10:00 p.m.
The attached resolution grants waivers to the noise ordinance for both events.
DISCUSSION:
The Board of Supervisors has annually approved a noise ordinance waiver for Hollins
University since 2010 to permit similar events.
FISCAL IMPACT:
There is no fiscal impact associated with this request.

WHEREAS, Hollins University, a private university located in north Roanoke
County, will be holding a spring Cotillion on Saturday, April 11, 2020, ending at
midnight; and
WHEREAS, Hollins will also be holding an outdoor concert for the campus
community on Friday, May 1, 2020, ending at 11:00 P.M. on the grounds of the
University; and
WHEREAS, in order to accommodate these events and to mitigate economic
hardship (by enhancing students' sense of connectedness with Hollins and the Roanoke
Valley through social interaction, which supports recruiting and retaining students, which
in turn affects the economic vitality of the University and Roanoke County), Hollins
University is requesting a waiver of the County noise ordinance for two (2) hours on
Saturday, April 11, 2020, and (1) hour from 10:00 P.M. until 11:00 P.M., on Friday, May
1,2020 -land
WHEREAS, Section 13-23 of the Roanoke County Code establishes certain
standards for the Board of Supervisors to grant waivers from the provisions of the
Roanoke County Noise Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

1. The Board FINDS that the noise that will be produced by the above-described
events will not endanger the public health safety or welfare, and that compliance
with the provisions of the County noise ordinance would produce an economic
hardship without producing substantial benefit to the public.
2. That the provisions of Section 13-21 (5) and (6) are WAIVED for a period of two
(2) hours until midnight on Saturday, April 11, 2020 and for a period of one (1)
hour until 11:00 P.M. on Friday, May 1, 2020.
3. That this Waiver is granted specifically to Hollins University for the events
scheduled at the University on Saturday, April 11, 2020 and Friday May 1, 2020.

I am writing to you on behalf of the Hollins Activity Board (HAB) at Hollins University. We have
contracted to have our annual spring Cotillion formal dance on the Hollins University Campus on the
evening of Saturday, April 11, 2020 as well as a concert on campus on the evening of Friday, May 1,
2020.
After a successful dance at the Hotel Roanoke this fall, we wanted to move back to campus to make
accessing the space a little easier for our students. At this time, our dance is set to begin at 8 p.m. and
would end at 12:00 a.m. In regards to the provisions of the County's Noise Ordinance, Article 11,
Chapter 13, we are hoping to be granted a variance of the noise ordinance that would allow us
amplified music from a DJ performer until 12:00 a.m.
Additionally Hollapalloza is an end of the year campus concert, scheduled this year for Friday, May
1 St. While we have held it indoors the past few years, we are hoping to go outside (weather
permitting). We are asking for a variance that would allow us amplified music from live musicians
until 11 p.m. for this event.
The Spring Cotillion and Concert are two of our larger attended events at Hollins University and both
contribute significantly to the extracurricular enjoyment for our students and create memories and
experiences for the students to treasurer.
We appreciate your understanding in this matter and do hope to be present at your meeting in March
to discuss these exemptions. Please feel free to contact me with any questions or concerns.

BACKGROUND:
Roanoke Valley Television, RVTV-3, serves Roanoke County, Roanoke City, the Town
of Vinton, and their respective school systems. RVTV-3 was created in 1993 as an
agreement between the three localities to form a Government & Educational Access
Station. The station is located at the Jefferson Center, and is staffed by five full time
staff members. RVTV-3 produces original video productions, monthly television shows,
and covers live government meetings. Programming is cablecast on Cox
Communications, Channel 3, and Comcast, Channel 3, in the West County area.
RVTV-3 is governed by the Roanoke Valley Regional Cable Television Committee,
which includes representatives from the County, the City, and the Town. Mr. Jason
Peters represents the Board of Supervisors, Ms. Amy Whittaker represents Roanoke
County Administration, and Mr. David Jones is the Member at Large. The operational
budget for RVTV is provided by the three local governments, and is funded through the
Virginia Communications Sales and Use Tax paid by Cox Communications. The budget
amount paid by each locality is based on the proportion of Cox customers located in
each jurisdiction. Roanoke County's share of the cable budget is 46%. RVTV-3 staff
are included in the County's payroll and benefit system.

DISCUSSION:
Last year, Roanoke Valley Television produced a total of 164 video productions for the
three localities and their school systems. RVTV produced the following for the County:
(37) Television Shows, (38) Stand Alone Video Productions, and (22) Live Board
Meetings. RVTV also provides the Live Board Meeting signal for Web Streaming. RVTV
television shows include: "Roanoke County Today," "Accent Excellence," "Roanoke
County Business Partners," & "Recreation Television." An entire list of video
productions is included in the Budget Packet.
RVTV-3 programming is uploaded to the RVTV website and social media sources.
Additionally, RVTV-3 programming is posted to the websites and social media sources
for Roanoke County, Roanoke City, Town of Vinton and their School Systems.
On May 10, 2019, the RVTV Digital Upgrade was completed, and all video is now
recorded in HD.
The fiscal year 2020-2021 total Operating Budget is $481,538.
Roanoke County's share is based on the proportion of Cox customers located in each
jurisdiction. Roanoke County's share of the cable budget is 46%.
FISCAL IMPACT:
Roanoke County's share of the cable budget for 2020-2021 is $221,507, which is a
$17,605 increase over the contribution in the adopted 2019-2020 budget. Roanoke
County's share as presented is included in the proposed fiscal year 2020-2021
operating budget within the non -departmental section of the document.
STAFF RECOMMENDATION:
The Roanoke Valley Regional Cable Television Committee recommends approval of the
fiscal year 2020-2021 RVTV Operating Budget.

FISCAL IMPACT:
The proposed FY2020/2021 Operating Budget request is $481,538. Roanoke County is the fiscal agent for
Roanoke Valley Television, and RVTV Team Members are included in the County's payroll and benefits
system. The proposed budget includes a 4% salary increase if approved by the Board of Supervisors. For
budgeting purposes, a 10% increase for Group Health Insurance is included. The budget includes closed
captioning services for Roanoke City Council & Roanoke County Board of Supervisors meetings.
On January 1, 2007, the Virginia Communications Sales and Use Tax Act of 2006 (Va. Code 58.1-645 et seq.)
required Cox Communications, as well as other cable television providers, to pay a five percent (5%) sales or
use tax to the Commonwealth of Virginia in place of paying franchise fees to the localities, including the City of
Roanoke, County of Roanoke, and Town of Vinton. Under the Act, the Commonwealth pays the amount of
revenues it receives from cable television providers, like Cox, to the localities.
The operational budget for RVTV is provided by the three local governments, and it is funded through the
Virginia Communications Sales and Use Tax Revenue paid by Cox Communications. The RVTV budget
amount paid by each locality is based on the percentage of Cox Customers located in each jurisdiction.

The included resolution will allow the County Administrator or his Designee to sign all
VDOT agreements, subject to appropriation requests, eliminating the need to request
signatory authority for each individual transportation project or updated agreement.
BACKGROUND:
VDOT requires authorization of signatory authority for all agreements. At times, this
requirement has slowed down processing of project agreements with VDOT and has
stalled project initiation and progress.
DISCUSSION:
Adoption of this resolution will help streamline the process to execute project
agreements with VDOT.
Any change in project funding will continue to be approved and appropriated by the
Board of Supervisors.

RESOLUTION AUTHORIZING THE COUNTY ADMINISTRATOR OR HIS
DESIGNEE TO EXECUTE AGREEMENTS WITH THE VIRGINIA
DEPARTMENT OF TRANSPORTATION (VDOT) AND
ACKNOWLEDGMENTS OF LOCAL FUNDING COMMITMENT AS
REQUIRED IN VDOT FUNDING AGREEMENTS
WHEREAS, the County of Roanoke desires to have and maintain a safe and
efficient road system; and
WHEREAS, from time to time the County of Roanoke and the Virginia Department
of Transportation (VDOT) work together to enhance the transportation system; and
WHEREAS, certain agreements between the County of Roanoke and VDOT must
be executed for this cooperative work to be accomplished.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the County Administrator, or his designee, is authorized to execute
agreements, and any modifications to such agreements, with VDOT as needed to
advance transportation projects; and,
2. That the local share of preliminary engineering, right of way, and
construction (as applicable) of the project(s) under agreement with the Virginia
Department of Transportation is hereby committed to be funded in accordance with the
project agreement(s) financial documents, subject to appropriation; and
3. That this resolution shall be effective upon its adoption.

To facilitate the Roanoke River Greenway through Explore Park project, the following
Board actions are requested:
1. Accept and appropriate $3,020,308 in Regional Surface Transportation Program
(RSTP) / Surface Transportation Block Grant (STBG) funds; and
2. Grant signatory authority to the County Administrator, or his designee, to execute
VDOT project documents.
BACKGROUND:
The Explore Park greenway segment is proposed to complete the eastern end of the
Roanoke River Greenway. The proposed greenway will be approximately 1.5 mile long,
ten (10) -feet wide, paved and ADA accessible. The route will parallel the Roanoke River
through Explore Park from Rutrough Point to connect to the greenway segment in
design for the Roanoke Valley Resource Authority Rutrough Road (closed) landfill.
The Roanoke River Greenway is a regional, 31 -mile bicycle and pedestrian trail
proposed through the Roanoke Valley, linking the Cities of Roanoke and Salem, the

Town of Vinton and Roanoke County. The Roanoke River Greenway is identified as the
number one priority in the adopted 2018 Roanoke Valley Greenway Plan Update.
Greenways were strongly supported by citizens during development of the Roanoke
County Parks, Recreation and Tourism Comprehensive Master Plan for Parks
completed in 2007. The residents of Roanoke County identified greenways as a "high
priority need" for facilities and amenities desired in our community.
The Roanoke County Community Strategic Plan, adopted by the Board of Supervisors
in 2016, reaffirmed citizen desires for increased access to outdoor recreational
amenities. Additionally, the proposed section of the Roanoke River Greenway is an
implementation strategy supported by citizens in the Explore Park Adventure Plan,
adopted by the Roanoke County Board of Supervisors in 2016, that provides the
primary alternative transportation link between Explore Park, the Blue Ridge Parkway
and Virginia's Blue Ridge.
DISCUSSION:
The Roanoke Valley Transportation Planning Organization (RVTPO) designated
$3,020,308 in Regional Surface Transportation Program (RSTP) funding for this project
on March 22, 2018, in the Fiscal Years 2019-2024 RSTP Six -Year Financial Plan.
Funding for this project was identified in fiscal years 2020, 2021 and 2022.
VDOT has prepared agreements for this project which require commitment of funds by
the locality and authorization of signatory authority. Once executed by Roanoke County
and by VDOT, the project can proceed.
FISCAL IMPACT:
The $3,020,308 RSTP / STBG funding is one hundred

THIS AGREEMENT, made and executed in triplicate this day of
, 20, by and between the County of Roanoke, Virginia, hereinafter
referred to as the LOCALITY and the Commonwealth of Virginia, Department of
Transportation, hereinafter referred to as the DEPARTMENT.
WHEREAS, the LOCALITY has expressed its desire to administer the work
described in Appendix A, and such work for each improvement shown is hereinafter
referred to as the Project; and
WHEREAS, the funds shown in Appendix A have been allocated to finance each
Project; and
WHEREAS, the LOCALITY is committed to the development and delivery of
each Project described in Appendix A in an expeditious manner; and;
WHEREAS, both parties have concurred in the LOCALITY's administration of
the phase(s) of work for the respective Project(s) listed in Appendix A in accordance with
applicable federal, state, and local law and regulations.
NOW THEREFORE, in consideration of the mutual premises contained herein,
the parties hereto agree as follows:
1. The LOCALITY shall:
a. Be responsible for all activities necessary to complete the noted phase(s) of each
Project shown in Appendix A, except for activities, decisions, and approvals
which are the responsibility of the DEPARTMENT, as required by federal or
state laws and regulations or as otherwise agreed to, in writing, between the
parties. Each Project will be designed and constructed to meet or exceed current
American Association of State Highway and Transportation Officials standards
or supplementary standards approved by the DEPARTMENT
b. Meet all funding obligation and expenditure timeline requirements in
accordance with all applicable federal and state laws and regulations, and
Commonwealth Transportation Board and DEPARTMENT policies and as
identified in Appendix A to this Agreement. Noncompliance with this
requirement can result in deallocation of the funding, rescinding of state
funding match, termination of this Agreement, or DEPARTMENT denial of
future requests to administer projects by the LOCALITY.

c. Receive prior written authorization from the DEPARTMENT to proceed with
preliminary engineering, right-of-way acquisition and utility relocation, and
construction phases of each Project.
d. Administer the project(s) in accordance with guidelines applicable to Locally
Administered Projects as published by the DEPARTMENT.
e. Maintain accurate and complete records of each Project's development and
documentation of all expenditures and make such information available for
inspection or auditing by the DEPARTMENT. Records and documentation for
items for which reimbursement will be requested shall be maintained for no less
than three (3) years following acceptance of the final voucher on each Project.
f. No more frequently than monthly, submit invoices with supporting
documentation to the DEPARTMENT in the form prescribed by the
DEPARTMENT. The supporting documentation shall include copies of related
vendor invoices paid by the LOCALITY and an up-to-date project summary
and schedule tracking payment requests and adjustments. A request for
reimbursement shall be made within 90 days after any eligible project expenses
are incurred by the Locality. For federally funded projects and pursuant to 2
CFR 200.338, Remedies for Noncompliance, violations of the provision may
result in the imposition of sanctions including but not limited to possible denial
or delay of payment of all or a part of the costs associated with the activity or
action not in compliance.
g. Reimburse the DEPARTMENT all Project expenses incurred by the
DEPARTMENT if, due to action or inaction solely by the LOCALITY,
federally funded Project expenditures incurred are not reimbursed by the
Federal Highway Administration (FHWA), or reimbursements are required to
be returned to the FHWA, or in the event the reimbursement provisions of
Section 33.2-214 or Section 33.2-331 of the Code of Virginia, 1950, as
amended, or other applicable provisions of federal, state, or local law or
regulations require such reimbursement.
h. On Projects that the LOCALITY is providing the required match to state or
federal funds, pay the DEPARTMENT the LOCALITY's match for eligible
Project expenses incurred by the DEPARTMENT in the performance of
activities set forth in paragraph 2.a.
i. Administer the Project in accordance with all applicable federal, state, or local
laws and regulations. Failure to fulfill legal obligations associated with the
project may result in forfeiture of federal or state -aid reimbursements
j. Provide certification by a LOCALITY official that all LOCALITY
administered Project activities have been performed in accordance with all
federal, state, and local laws and regulations. If the locality expends over
$750,000 annually in federal funding, such certification shall include a copy of

the LOCALITY's single program audit in accordance with 2 CFR 200.501,
Audit Requirements.
k. If legal services other than that provided by staff counsel are required in
connection with condemnation proceedings associated with the acquisition of
Right -of -Way, the LOCALITY will consult the DEPARTMENT to obtain an
attorney from the list of outside counsel approved by the Office of the Attorney
General. Costs associated with outside counsel services shall be reimbursable
expenses of the project.
1. For Projects on facilities not maintained by the DEPARTMENT, provide, or
have others provide, maintenance of the Project upon completion, unless
otherwise agreed to by the DEPARTMENT.
m. Ensure compliance with the provisions of Title VI of the Civil Rights Act of
1964, regulations of the United States Department of Transportation (USDOT),
Presidential Executive Orders and the Code of Virginia relative to
nondiscrimination and as a sub -recipient of federal funds, adopt and operate
under the DEPARTMENT's FHWA-approved Disadvantaged Business
Enterprise (DBE) Program Plan in accordance with 49 CFR Part 26.
2. The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals which are the
responsibility of the DEPARTMENT, as required by federal and state laws and
regulations or as otherwise agreed to, in writing, between the parties and
provide necessary coordination with the FHWA as determined to be necessary
by the DEPARTMENT.
b. Upon receipt of the LOCALITY's invoices pursuant to paragraph I.£,
reimburse the LOCALITY the cost of eligible Project expenses, as described in
Appendix A. Such reimbursements shall be payable by the DEPARTMENT
within 30 days of an acceptable submission by the LOCALITY.
c. If appropriate, submit invoices to the LOCALITY for the LOCALITY's share
of eligible project expenses incurred by the DEPARTMENT in the performance
of activities pursuant to paragraph 2.a.
d. Audit the LOCALITY's Project records and documentation as maybe required
to verify LOCALITY compliance with federal and state laws and regulations.
e. Make available to the LOCALITY guidelines to assist the parties in carrying
out responsibilities under this Agreement.
3. Appendix A identifies the funding sources for the project, phases of work to be
administered by the LOCALITY, and additional project -specific requirements

agreed to by the parties. There may be additional elements that, once identified,
shall be addressed by the parties hereto in writing, which may require an
amendment to this Agreement.
4. If designated by the DEPARTMENT, the LOCALITY is authorized to act as the
DEPARTMENT's agent for the purpose of conducting survey work pursuant to
Section 33.2-1011 of the Code of Virginia, 1950, as amended.
5. Nothing in this Agreement shall obligate the parties hereto to expend or provide
any funds in excess of funds agreed upon in this Agreement or as shall have been
included in an annual or other lawful appropriation. In the event the cost of a
Project is anticipated to exceed the allocation shown for such respective Project on
Appendix A, both parties agree to cooperate in providing additional funding for the
Project or to terminate the Project before its costs exceed the allocated amount,
however the DEPARTMENT and the LOCALITY shall not be obligated to provide
additional funds beyond those appropriated pursuant to an annual or other lawful
appropriation.
6. Nothing in this Agreement shall be construed as a waiver of the LOCALITY's or
the Commonwealth of Virginia's sovereign immunity.
7. The Parties mutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their
official authority and the Parties agree that neither Party will bring a suit or assert
a claim against any official, officer, or employee of either party, in their
individual or personal capacity for a breach or violation of the terms of this
Agreement or to otherwise enforce the terms and conditions of this
Agreement The foregoing notwithstanding, nothing in this subparagraph shall
prevent the enforcement of the terms and conditions of this Agreement by or
against either Party in a competent court of law.
8. The Parties mutually agree that no provision of this Agreement shall create in the
public, or in any person or entity other than the Parties, rights as a third party
beneficiary hereunder, or authorize any person or entity, not a party hereto, to
maintain any action for, without limitation, personal injury, property damage,
breach of contract, or return of money, or property, deposit(s), cancellation or
forfeiture of bonds, financial instruments, pursuant to the terms of this Agreement
or otherwise. Notwithstanding any other provision of this Agreement to the
contrary, unless otherwise provided, the Parties agree that the LOCALITY or the
DEPARTMENT shall not be bound by any agreements between either party and
other persons or entities concerning any matter which is the subject of this
Agreement, unless and until the LOCALITY or the DEPARTMENT has, in
writing, received a true copy of such agreement(s) and has affirmatively agreed,
in writing, to be bound by such Agreement.
9 This Agreement may be terminated by either party upon 30 days advance written
notice. Eligible Project expenses incurred through the date of termination shall be

reimbursed in accordance with paragraphs Lf, l.g., and 2.b, subject to the
limitations established in this Agreement and Appendix A. Upon termination, the
DEPARTMENT shall retain ownership of plans, specifications, and right of way,
unless all state and federal funds provided for the Project have been reimbursed to
the DEPARTMENT by the LOCALITY, in which case the LOCALITY will have
ownership of the plans, specifications, and right of way, unless otherwise mutually
agreed upon in writing.
10. Prior to any action pursuant to paragraphs Lb or Lg of this Agreement, the
DEPARTMENT shall provide notice to the LOCALITY with a specific description
of the breach of agreement provisions. Upon receipt of a notice of breach, the
LOCALITY will be provided the opportunity to cure such breach or to provide a
plan to cure to the satisfaction to the DEPARTMENT. If, within sixty (60) days
after receipt of the written notice of breach, the LOCALITY has neither cured the
breach, nor is diligently pursuing a cure of the breach to the satisfaction of the
DEPARTMENT, then upon receipt by the LOCALITY of a written notice from the
DEPARTMENT stating that the breach has neither been cured, nor is the
LOCALITY diligently pursuing a cure, the DEPARTMENT may exercise any
remedies it may have under this Agreement.
THE LOCALITY and DEPARTMENT acknowledge and agree that this
Agreement has been prepared jointly by the parties and shall be construed simply and in
accordance with its fair meaning and not strictly for or against any party.
THIS AGREEMENT, when properly executed, shall be binding upon both parties,
their successors, and assigns.
THIS AGREEMENT may be modified in writing by mutual agreement of both
parties.

ORDINANCE ACCEPTING AND APPROPRIATING FUNDS IN THE
AMOUNT OF $3,020,308 AND GRANTING SIGNATORY AUTHORITY
TO THE COUNTY ADMINISTRATOR OR HIS DESIGNEE TO EXECUTE
A PROJECT ADMINISTRATION AGREEMENT WITH THE VIRGINIA
DEPARTMENT OF TRANSPORTATION FOR THE ROANOKE RIVER
GREENWAY THROUGH EXPLORE PARK
WHEREAS, it is a priority to construct the Roanoke River Greenway through
Roanoke County; and
WHEREAS, the County was awarded Regional Surface Transportation Program
(RSTP) grant funds, now named the Surface Transportation Block Grant (STBG), in the
amount of $3,020,308 for design and construction of the Roanoke River Greenway
through Explore Park; and
WHEREAS, the project is locally administered, and certain agreements between
the County of Roanoke and the Virginia Department of Transportation (VDOT) must be
executed for this cooperative work to be accomplished; and
WHEREAS, VDOT requires the local governing body to grant signatory authority
to execute such agreements; and
WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and
WHEREAS, the first reading of this ordinance was held on March 10, 2020, and
the second reading was held on March 24, 2020.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia as
follows..

1. That the sum of $3,020,308 is accepted and appropriated from RSTP/STBG
for the purpose of completing the Roanoke River Greenway through Explore
Park.
2. That the Board of Supervisors does hereby grant signatory authority to the
County Administrator or his designee to execute project administration
agreements with VDOT for the Roanoke River Greenway through Explore
Park.
3. That this ordinance shall take effect upon its adoption.

RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY TO JOHN F. MURPHY, ZONING
ADMINISTRATOR, UPON HIS RETIREMENT AFTER MORE THAN
THIRTY-FOUR (34) YEARS OF SERVICE
WHEREAS, John F. Murphy was employed by Roanoke County on January 6,
1986; and
WHEREAS, Mr. Murphy retired on February 29, 2020, after thirty-four (34) years
and two (2) months of devoted, faithful and expert service to Roanoke County; and
WHEREAS, throughout Mr. Murphy's tenure with Roanoke County, he has served
as Assistant Animal Control Officer, Police Community Services Officer, Planning
Technician, Associate Planner, Planner I, and Zoning Administrator; and
WHEREAS, Mr. Murphy, through his employment with Roanoke County, has been
instrumental in improving the quality of life and providing services to the citizens of
Roanoke County; and
WHEREAS, Mr. Murphy was appointed Subdivision Agent by the Board of
Supervisors in 2001, and has reviewed and approved numerous concept plans, site
development plans, and subdivision plats in Roanoke County; and
WHEREAS, Mr. Murphy served as the Secretary to the Board of Zoning Appeals
from 2005 till 2020, and was a Certified Zoning Administrator (CZA) through the Virginia
Association of Zoning Officials since 2006; and
WHEREAS, Mr. Murphy processed and reviewed various rezoning, special use
permit, variance and administrative appeal applications; and
WHEREAS, Mr. Murphy developed and processed numerous amendments to the

Roanoke County Zoning Ordinance on various topics including, but not limited to, special
use permits, board of zoning appeals, permitted uses in commercial and zoning districts,
Clearbrook Village Overlay District, Explore Park District, floodplain regulations,
agritourism, home occupations, wind energy systems, special events facility, sign
regulations, parking standards, enforcement, religious assembly, and screening and
landscaping standards; and
WHEREAS, Mr. Murphy supervised, developed and mentored many planning and
zoning staff members over the years;
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to JOHN F. MURPHY for more than thirty-four (34) years of capable, loyal and
dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a happy and
productive retirement.

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER ON TUESDAY, MARCH 10, 2020
RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby certifies that, to the best of each member's knowledge:
1. Only public business matters lawfully exempted from open meeting
requirements by Virginia law were discussed in the closed meeting which this certification
resolution applies; and
2. Only such public business matters as were identified in the motion convening
the closed meeting were heard, discussed or considered by the Board of Supervisors of
Roanoke County, Virginia.
