O'Donnell County Administrator Establish the percentage for personal property tax relief in Roanoke County for the 2020 tax year BACKGROUND: The Personal Property Tax Relief Act (PPTRA or the Act) of 1998 established a State- wide program to provide relief to owners of personal use motor vehicles. The Act provides State funds to localities to reduce local government taxation of personal property. In 2004 and 2005, additional legislation was passed to amend the original Act. This legislation capped PPTRA at $950 million for all Virginia localities for tax years 2006 and beyond. PPTRA funds are allocated to individual localities based on each government's pro rata share of tax year 2004 payments from the Commonwealth. The County's share of the $950 million is $12,229,857. DISCUSSION: The amount the County receives from the State has stayed constant since 2006. However, the personal property tax base has continued to grow, which has caused less of the personal property tax bill to be offset by PPTRA Funds. Page 1 of 2 The County uses The PPTRA Allocation Model developed by the State to calculate the effective reimbursement rate. This model uses historical trends and a five (5) -year rolling average to calculate the effective reimbursement rate. This same methodology for calculating the rate is used by many of our neighboring localities. For 2020, County staff has computed the effective reimbursement rate based upon the PPTRA allocation model. The rate for the County is 52.60%. The Board is required by the State to annually adopt a resolution setting the percentage reduction in personal property for that year. The attached resolution establishes the percentage reduction at 52.60% for the 2020 tax year. FISCAL IMPACT: The percentage reduction is calculated to distribute the $12,229,857 block grant allocation from the State in the manner described above. There will be some timing delays in the receipt of the State funds since they are received in the following fiscal year (2020-2021). However, we are allowed to accrue these funds back to the 2019- 2020 year for accounting purposes, therefore our budget will be balanced. STAFF RECOMMENDATION: Staff recommends approval of the attached resolution, which establishes the percentage reduction for personal property tax relief at 52.60% for Roanoke County for the 2020 tax year. Page 2 of 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, APRIL 14, 2020 RESOLUTION SETTING THE ALLOCATION PERCENTAGE FOR PERSONAL PROPERTY TAX RELIEF IN ROANOKE COUNTY FOR THE 2020 TAX YEAR WHEREAS, in accordance with the requirements set forth in Section 58.1-3524 (C) (2) and Section 58.1-3912 (E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly and as set forth in item 503.E (Personal Property Tax Relief Program or "PPTRA") of Chapter 951 of the 2005 Acts of Assembly, a qualifying vehicle with a taxable situs within the County commencing January 1, 2020, shall receive personal property tax relief; and, WHEREAS, this Resolution is adopted pursuant to Ordinance 122005-10 adopted by the Board of Supervisors on December 20, 2005. NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: 1. That tax relief shall be allocated so as to eliminate personal property taxation for qualifying personal use vehicles valued at $1,000 or less. 2. That qualifying personal use vehicles valued at $1,001-$20,000 will be eligible for 52.60% tax relief. 3. That qualifying personal use vehicles valued at $20,001 or more shall only receive 52.60% tax relief on the first $20,000 of value; and 4. That all other vehicles which do not meet the definition of qualifying (for example, including but not limited to, business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. 5. That the percentages applied to the categories of qualifying personal use vehicles are estimated fully to use all available PPTRA funds allocated to Roanoke County by the Commonwealth of Virginia. 6. That this Resolution shall be effective from and after the date of its adoption. D.1 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER MEETING DATE: AGENDA ITEM: SUBMITTED BY: April 14, 2020 Public Hearing and First reading of an Emergency Ordinance temporarily suspending imposition of penalty and interest on tax year 2020 delinquent personal property tax until August 1, 2020 Peter S. O'Donnell County Administrator ISSUE: Whether to provide taxpayer relief by temporarily suspending penalty and interest on tax year 2020 delinquent personal property tax. BACKGROUND: Local Law regarding Payment of Tangible Personal Property Taxes. Section 21-17(d) of the Roanoke County Code states that County taxes on tangible personal property shall be due and payable on or before May 31 during the year for which the same are assessed. This year, because the due date falls on a weekend, it is extended to June 1St (pursuant to the Code of Virginia). Section 21-18 of the Roanoke County Code imposes a penalty on delinquent payments of tangible personal property taxes (in the amount of 10% of the amount of such unpaid tax); accordingly, such a penalty is imposed on delinquent tax payments on the day after such payments are due. Accordingly, this year, the penalty would be imposed on June 2nd. Section 21-18 further states that interest (at the rate of 10% per annum) is assessed, commencing on July 1 of the year for which such tax was assessed. In summary: Tangible personal property taxes are due on or before June 1 st Page 1 of 3 A 10% penalty for delinquent taxes is imposed on June 2nd Interest (at a rate of 10%) begins to accrue on July 1 st The typical process for amending the County Code requires that such amendments are made by ordinance (two readings and a public hearing). The Board's Continuity of Government Ordinance. On March 31, 2020, the Board adopted ordinance No. 033120-1, which allows the Board to provide for continuity of government during the present COVID-19 pandemic. The ordinance further provides that "notwithstanding any provision of law, regulation or policy to the contrary, any deadlines requiring action by a Public Entity, its officers (including Constitutional Officers) and employees of its organization shall be suspended during this emergency and disaster .... This paragraph does not automatically extend any deadlines for the payment of taxes or filing of tax returns." Proposed Taxpayer Relief. It has been proposed, pursuant to the authority claimed in ordinance No. 033120-1, that the Board, by emergency ordinance, temporarily suspend the imposition of penalties and interest on delinquent 2020 tangible personal property taxes. DISCUSSION: It is proposed, for the purpose of providing relief to taxpayers whose financial circumstances have been affected by the COVID-19 pandemic, that the Board temporarily suspend the imposition of both penalty and interest on delinquent 2020 personal property taxes as follows: Tangible personal property taxes for tax year 2020 would remain due on or before June 1, 2020. A 10% penalty for delinquent taxes would be imposed on August 1St, 2020 (instead of June 2nd) Interest (at a rate of 10%) would begin to accrue on August 1, 2020 (instead of July 1 st) Additionally, the temporary suspension dates for penalty and interest will not negatively impact revenue accruals since this time period is within the County of Roanoke's time period of revenue availability. The County of Roanoke will be able to pick up these collections and accrue back to fiscal year 2020. STAFF RECOMMENDATION: Staff recommends that if the Board desires to offer such relief to taxpayers, that this action be effectuated by emergency ordinance, pursuant to the authority claimed in Page 2 of 3 Ordinance 033120-1. Page 3 of 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, APRIL 14, 2020 EMERGENCY ORDINANCE TEMPORARILY SUSPENDING IMPOSITION OF PENALTY AND INTEREST ON TAX YEAR 2020 DELINQUENT PERSONAL PROPERTY TAX UNTIL AUGUST 1, 2020 WHEREAS, pursuant to Section 21-17(d) of the Roanoke County Code and Section 58.1-8 of the Code of Virginia, year 2020 County taxes on tangible personal property shall be due and payable on or before June 1, 2020; and WHEREAS, Section 21-18 of the Roanoke County Code imposes a penalty on delinquent payments of tangible personal property tax (in the amount of 10% of such unpaid tax). In 2020; such a penalty would be imposed on June 2, 2020; and WHEREAS, Section 21-18 further states that interest (at a rate of 10% per annum) is assessed, commencing on the first day of the month after the due date or July 1 st of the year for which such tax was assessed, whichever is later. Accordingly, in 2020, interest on delinquent payments would be imposed on July 1, 2020; and WHEREAS, because of the hardships imposed on all citizens by the COVID-19 pandemic, the Board of Supervisors desires to provide relief to taxpayers by suspending the imposition of both penalty and interest on tax year 2020 delinquent personal property tax until August 1, 2020; and WHEREAS, pursuant to Ordinance 033121-1, adopted by the Board on March 31, 2020, which authorizes the suspension of deadlines established by the County Code, the Board desires to provide such relief, and to effectuate such an action by emergency ordinance, dispensing with notice typically required by Section 15.2-1427 of the Code of Virginia; and Page 1 of 2 WHEREAS, the first reading of this ordinance was held on April 14, 2020; and the second reading has been dispensed with, upon an affirmative vote of 4/5ths of the members of the Board, this being deemed to be an emergency measure pursuant to Section 18.04 of the Roanoke County Charter. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County of Roanoke, Virginia: 1. The provisions of Section 21-18 of the Roanoke County Code are temporarily suspended as follows: a. The imposition of any penalty, for delinquency of 2020 personal property tax pursuant to Section 21-18(a) of the Roanoke County Code, shall be suspended from June 2, 2020 to August 1, 2020. b. The commencement of assessment of any interest, for delinquency of 2020 personal property tax pursuant to Section 21-18(b) of the Roanoke County Code, shall be suspended from July 1, 2020 to August 1, 2020. 2. All other provisions of Section 21-18 are unaffected and shall remain in full force and effect. 3. The assessment of penalties and interest for any other tax year (other than tax year 2020) and any other category of tax (other than tangible personal property tax) remains unaffected by this ordinance. 4. An emergency is deemed to exist, and this ordinance shall be effective upon its adoption. Page 2 of 2 ACTION NO. ITEM NO. O'Donnell County Administrator Conduct a public hearing to receive citizen comment on the Calendar Year 2020 Real Estate, Personal Property and Machinery and Tools Tax rates. BACKGROUND: State Code requires a public hearing in advance of the adoption of tax rates. This public hearing satisfies that requirement. DISCUSSION: The public hearing scheduled for April 14, 2020, is to receive written and oral comments on setting the tax rates for calendar year 2020 to support the fiscal year 2020-2021 operating budget. The public hearing was advertised on March 31 and April 7, 2020, thereby satisfying State code requirements for public notice. The adoption of these tax rates was preceded by a public hearing on March 24, 2020, to receive written and oral comments on setting the maximum tax rates for calendar year 2020. Page 1 of 2 FISCAL IMPACT: There is no fiscal impact associated with this public hearing. STAFF RECOMMENDATION: Staff recommends conducting the public hearing to satisfy State code requirements and receive citizen comment on the Calendar Year 2020 Real Estate, Personal Property and Machinery and Tools Tax rates. BACKGROUND: As part of the annual budget development process, the Board of Supervisors is required to adopt tax rates to support the operating budget. The adoption of calendar year 2020 tax rates will support the fiscal year 2020-2021 operating budget. DISCUSSION: Proposed tax rates for the twelve month period beginning January 1, 2020 and ending December 31, 2020, were advertised on March 31 and April 7, 2020 as follows: a. Real Estate Tax at a rate of not more than $1.09 per one hundred dollars assessed valuation b. Personal Property Tax at a rate of not more than $3.50 per one hundred dollars assessed valuation Page 1 of 2 c. Machinery and Tools Tax at a rate of not more than $2.85 per one hundred dollars assessed valuation. A public hearing for citizen comment on the tax rates was held on April 14, 2020. A public hearing for citizen comment on the proposed fiscal year 2020-2021 operating budget and proposed fiscal year 2021-2030 Capital Improvement Program will be held on May 26, 2020, pending approval of the amended fiscal year 2020-2021 budget development calendar. The adoption of these tax rates was preceded by a public hearing on March 24, 2020, to receive written and oral comments on setting the maximum tax rates for calendar year 2020. FISCAL IMPACT: Fiscal impact will be determined if the Board of Supervisors adopts tax rates that differ from Calendar Year 2019 tax rates. STAFF RECOMMENDATION: Staff recommends the Board of Supervisors adopt calendar year 2020 tax rates. The donations are: $1,500 from OmniSource, LLC $1,500 from Steel Dynamics Roanoke Bar Division $1,500 from New Millennium Building Systems Totaling $4,500 BACKGROUND: The Police Department needs to purchase a new canine to replace a retiring canine. The canine will be trained as a dual purpose dog for patrol work and narcotics detection. DISCUSSION: The Police Department has gratefully received three donations that total $4,500 to help fund the purchase of a new police canine to replace a retiring canine. The new canine will be trained as a dual purpose dog in patrol work and narcotics detection. The value of the new canine is $8,500. Page 1 of 2 FISCAL IMPACT: The Police Department will cover the remaining cost of the canine ($4,000) from the current 2019-2020 budget. No additional funding is requested for this purchase. O'Donnell County Administrator On September 10, 2019, Roanoke County Board of Supervisors approved the budget development calendar for fiscal year 2020-2021. The Board amended the budget development calendar by consent on February 11, 2020 to amend the budget adoption date. Following a work session on March 24, 2020, staff are presenting Attachment A, which details the amended budget development calendar, including a revised fiscal year 2020- 2021 budget proposal and delaying adoption of operating and capital budgets until June 23, 2020. BACKGROUND: As part of the annual budget development process, the Department of Finance and Management Services prepares a budget development calendar for approval by the Board of Supervisors. On September 10, 2019, Roanoke County Board of Supervisors approved the budget development calendar for fiscal year 2020-2021. The Board amended the budget development calendar by consent on February 11, 2020 to amend the budget adoption date. At the March 24, 2020 work session on the fiscal year 2020-2021 budget, the Board received information on impacts from COVID-19 on the current and upcoming fiscal year budgets. Staff recommended presenting a revised operating and capital proposal based on new revenue estimates. Additionally, staff recommended delaying adoption of Page 1 of 2 the operating and capital budgets to June 23, 2020 to allow staff to evaluate economic trends that may impact revenues in the upcoming year. Attachment A is the amended budget development calendar detailing required Board of Supervisors actions, public hearings, budget work sessions and briefings associated with both the operating and capital budgets revised through the remainder of fiscal year 2019-2020. FISCAL IMPACT: There is no fiscal impact associated with the approval of the amended fiscal year 2020- 2021 budget development calendar. O'Donnell County Administrator ISSUE: Request to accept and allocate funds in the amount of $4,607.40 to the Clerk of the Circuit Court from the Commonwealth of Virginia BACKGROUND: Technology Trust Funds representing fees collected by the Roanoke County Circuit Court Clerk's Office, have been received from the State in the amount of $4,607.40. In accordance with State of Virginia Code Section 17.1-279, the Circuit Court Clerks Office shall assess a $5.00 fee called Technology Trust Fund Fee. Each month, the Clerk's Office can request the fees that were assessed the previous month. The code section further states that four of every five dollar fee shall be allocated by the Compensation Board from the trust fund for the purposes of obtaining and updating office automation and information technology equipment including software and conversion services; preserving, maintaining and enhancing court records, including but not limited to the costs of repairs, maintenance, land records, consulting services, service contracts, redaction of social security numbers from land records and system replacement or upgrades and improving public access to court records. DISCUSSION: The funds received from the Commonwealth of Virginia have been earmarked for maintenance needs for the Clerk of Circuit Court, specifically towards the twice yearly Page 1 of 2 maintenance bill from the Supreme Court for maintaining their records, equipment, etc. and funds to offset the cost of postage. FISCAL IMPACT: All funds are provided by the Commonwealth of Virginia. No County matching funds are required. BELZ, POLICE OFFICER IV, UPON HIS RETIREMENT AFTER MORE THAN FIVE (5) YEARS OF SERVICE WHEREAS, Donn L. Belz was employed by Roanoke County on January 3,2015-1 WHEREAS, Mr. Belz retired on February 1, 2020, after five (5) years and one (1) month of devoted, faithful and expert service to Roanoke County; and WHEREAS, Mr. Belz, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Mr. Belz' tenure with Roanoke County, he served in several Divisions in the Police Department, beginning in Patrol. Due to his previous extensive experience in major crimes investigations with another law enforcement agency, Mr. Belz was quickly moved to serve in the Criminal Investigations Division, then to Vice/Narcotics where he was assigned to the federal Drug Enforcement Administration's Task Force in Roanoke where he participated in the investigation of large-scale Drug Trafficking Organizations before his retirement from the County of Roanoke. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to DONN L.
