Good afternoon and welcome to our meeting for May 11, 2004. Regular meetings are
held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are
held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule
will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursdays at 7:00 p.m. and on Saturdays at 4:00 p.m. The meetings
are now closed-captioned. Individuals who require assistance or special arrangements

SUMMARY OF INFORMATION:
The Commonwealth of Virginia has declared the week of May 16 - 22, 2004 as Business
Appreciation Week. This week honors all business community leaders and partners for
their daily investment in our economic base, which contributes to the quality of life in
Roanoke County.
Doug Chittum, Director of Economic Development, will introduce representatives from the
Roanoke Regional Chamber of Commerce, Salem-Roanoke County Chamber of
Commerce and Vinton Chamber of Commerce who will accept the proclamation in
appreciation and recognition of the Roanoke County business community.

PROCLAMATION DECLARING THE WEEK OF MAY 16 - 22,2004 AS
BUSINESS APPRECIATION WEEK IN THE COUNTY OF ROANOKE
WHEREAS, the County of Roanoke is pleased to have a thriving base of business
and industry to support and strengthen the local economy; and
WHEREAS, these businesses provide essential employment opportunities for the
citizens of the County of Roanoke; and
WHEREAS, these businesses provide local revenues from which the entire local
citizenry benefit; and
WHEREAS, these businesses also make significant contributions in our
communities to promote educational opportunities for our children and promote a variety of
civic activities which increase the quality of life of the area; and
WHEREAS, the week of May 16 through 22, 2004 has been designated as
Business Appreciation Week; and
WHEREAS, Roanoke County participates in the activities of the Roanoke Regional
Chamber of Commerce, the Salem-Roanoke County Chamber of Commerce and the
Vinton Chamber of Commerce which represent a diverse and dynamic group of
businesses; and
WHEREAS, Roanoke County is proud that the current president of the Virginia

Ms. Allyson Fasnacht, a senior at Glenvar High School, and a member ofthe Glenvar High
School Girls Basketball Team, was named the Co-Player of the Year for the Group A team
by the Virginia High School Coaches Association for 2003-2004.
Ms. Fasnacht has had an outstanding high school basketball career and will be attending
Liberty University this fall. She will attend this meeting, accompanied by her parents, to
receive her certificate.
School Superintendent Dr. Linda Weber, Glenvar High School Principal Curtis Hicks, and
Coach Brian Harvey have been invited to attend.

SUMMARY OF INFORMATION:
The Code of Virginia requires a public hearing at any time that an appropriation of monies
exceeds $500,000. The Community Policy and Management Team (CPMT) is requesting
an additional appropriation of $1 ,820,000 to cover the required expenses for FY2003-04,
Following the public hearing, staff will be requesting the recognition of $1,000,000 new
revenue from the State and the appropriation of $820,000 from the unappropriated fund
balance of the general fund to cover the required expenses for this year. The new
amounts have been included in the budget requests for the upcoming fiscal year.
FISCAL IMPACT:
This fiscal year, the local share (match) for the program was budgeted at $1,153,000.
However, based on current cases, it is anticipated that the deficit for the year will be
$1,819,678. The share from the State will be $1,000,000 and $820,000 from local
sources.

1. Hold the public hearing in order to allow for the appropriation of $1,820,000 to the
CPMT for fiscal year 2003-2004.
2. Do not hold the public hearing.
STAFF RECOMMENDATION:
As this request covers mandated cases, staff recommends Alternative 1, hold the public
hearing in order to allow for the appropriation of $1 ,820,000 in new money to the CPMT for
FY 2003-04.

SUMMARY OF INFORMATION:
The Community Policy and Management Team (CPMT) is requesting an additional
appropriation of $1 ,820,000 to cover the required expenses for FY 2003-04, Following the
public hearing at today's meeting, staff respectfully requests the recognition of $1,000,000
new revenue from the State and an appropriation of $820,000 from the unappropriated
fund balance of the general fund to cover the required expenses for this year. The new
amounts have been included in the budget requests for the upcoming fiscal year.
In 1992, the State implemented the Comprehensive Services Act (CSA) to become the
funding source for youth with special needs and their families which had previously been
funded by the Schools, Juvenile Court, and Social Services. The plan uses a collaborative
effort to consider the identified needs of the child (Special Education for the Schools;
Foster Care for Social Services; youth with charges before the Juvenile Court) to reduce
the likelihood of duplicating or conflicting services and to seek cost effective means of
educating or treating the child,
There are many factors which must be considered in determining the status as a mandated
service (whereby for Roanoke County, the State pays 56% and the locality pays 44%) or a
non-mandated service where there is a shared match for the first $125,000 per year, and
then any service is paid 100% by the locality. There are also some specialized and grant
funds for certain qualified youth, but these also have limitations.

As children with needs are identified, they are assigned a case manager who serves as the
child's advocate and presents the needs to the Family Assessment and Planning Team
(FAPT), This collaborative team is comprised of senior workers from the Departments of
Health, Social Services, Schools, Court Services, a private provider of children services,
and parent advocates, They listen to the identified needs and help to formulate a
treatment plan based on their experience and knowledge of available programs. The
treatments are aimed at providing the least restrictive conditions first with the aim of
keeping the child in the home and community, Sometimes, the severity of need is greater
than services in the home can manage and residential treatment programs are required,
The goal is always to reunite the family and to provide the support services needed to allow
the education and stabilization of the child. Frequently, this requires a combination of
services which are decreased as the conditions improve. In cases where certain
treatments are not effective, alternatives are considered,
The CPMT is comprised of the directors of the core departments and other designated
disciplines and they collaborate to approve funding and authorize treatment. The team
also considers the utilization review to determine if the treatment goals are being
accomplished, In many cases, the treatment extends over several years. In other cases
such as foster care, the care may extend until the child is eighteen years old,
Over the past few years as many of the service providers have attempted to become
Medicaid providers, the overall cost of purchasing these services has increased
dramatically, thus driving up the cost of the program, Children are being identified earlier
and the presenting symptoms are more severe than in the past. Much of the increase for
service is attributed to substance abuse, mental health issues, family dysfunction and
domestic violence, As an example, over the last ten years the number offoster care cases
handled by Social Services has grown from 35 per year to over 105 today. In instances
where no other treatment monies are available to aid the child, the courts have placed the
child under the umbrella of Social Services to qualify them for services, Some of the cases
have minor costs for counseling, mentoring services, etc,; however, some of the severe
placements in residential treatment facilities may cost nearly $200,000 per year for a child.
In contrast, the family represented by one high dollar residential placement has moved out
of Roanoke County which resulted in a savings for the current year.
Attached is a listing of the cases for the current fiscal year and the projection of costs to be
incurred by the CPMT. You will note that one child and family who had been placed in a
residential treatment facility have moved from Roanoke County, The savings from this
action have been calculated in this program,

BACKGROUND:
The 2003 and 2004 sessions of the Virginia General Assembly amended the
procedure for granting tax exemptions. This legislation implements a
constitutional amendment that shifted the responsibility for granting real estate
tax exemptions from the General Assembly to the governing body of the locality
where the property of the group or organization seeking the exemption is located.
This legislation sets out the procedures for granting tax exemptions, In the past
the charitable organization requesting tax exempt status for its property by
designation would submit a request to the locality for a recommendation based
upon statutorily-required findings, Then that request and recommendation would
be sent to the General Assembly for approval.
As of January 1, 2003, this request must be addressed by the local governing
body. It no longer goes to the General Assembly,
Under this new legislation, if the local governing body agrees to grant a request
for an exemption, it must adopt an ordinance. If the ordinance to grant the
exemption is defeated, the property will remain taxable,
The ordinance shall state the specific use on which the exemption is based and
continuance of the exemption shall be contingent on the continued use of the

property in accordance with the purpose for which the organization is classified
or designated.
The ordinance exempting property shall be adopted after holding a public
hearing. The governing body shall publish notice of the public hearing once in a
newspaper of general circulation in the locality where the real property is located,
The notice shall include the assessed value of the real and tangible personal
property for which the exemption is requested as well as the property taxes
assessed against such property. The public hearing shall not be held until at
least five days has elapsed after the notice has been published. The local
governing body may collect the cost of publication from the organization
requesting the tax exemption.
Before adopting any such ordinance the governing body shall consider the
factors set out in Section 58.1-3651 B. which is attached to this report as Exhibit
1,
SUMMARY OF INFORMATION:
This petition by The Salvation Army seeks tax exempt status in accordance with
the Constitution of Virginia, The real estate consists of .66 acres located at 5511
Williamson Road. The assessed value of this real estate is $374,300 and the
real estate taxes would be $4,192. The Salvation Army will agree to execute an
agreement with the County for the payment of a 20% service fee in lieu of
taxation.
Attached to this Board report is a copy of the tax map showing the location of the
property owned by the Petitioner, This property was purchased by The Salvation
Army in 2003. A Thrift Store is operated out of this location. The Salvation Army
occupies the entire structure and does not lease it out to any other businesses or
operations.
The Salvation Army has submitted an application to the County for tax exempt
status, which is attached, It has also submitted to staff materials which provide a
more complete description of its services, which are attached to this report.
The Salvation Army is an "international religious and charitable movement
organized and operated on a quasi-military pattern and is a branch of the
Christian church," It provides food, shelter, clothing and counseling for those in
need, provides rent and utility assistance when funds are available, provides
worship services, and provides two Thrift Stores so that needy people in the
community may receive clothing at a discounted price,
The applicable provision of the State Code is Section 58.1-3650:

A. The real and personal property of an organization designated by
a section within this article and used by such organization
exclusively for a religious, charitable, patriotic, historical,
benevolent, cultural or public park and playground purpose as set
forth in Article X, Section 6 (a) (6) of the Constitution of Virginia, the
particular purpose for which such organization is classified being
specifically set forth within each section, shall be exempt from
taxation so long as such organization is operated not for profit and
the property so exempt is used in accordance with the purpose for
which the organization is classified, In addition, such exemption
may be revoked in accordance with the provisions of §§ 58.1-3605.
B, Exemptions of property from taxation under this article shall be
strictly construed in accordance with the provisions of Article X,
Section 6 (f) of the Constitution of Virginia.
FISCAL IMPACTS:
Tax exempt status will result in a loss of taxable revenue of the value of the land
and any structures ($4,192 per year). This will be offset in part by the 20%
service fee.
ALTERNATIVES:
After the public hearing the Board may decide to grant this exemption by the
approval of the attached ordinance; or it may decide to refuse to grant this
exemption.
STAFF RECOMMENDATION:
This matter is submitted to the Board for its consideration.

ORDINANCE GRANTING TAX EXEMPTION OF PROPERTY OWNED BY
THE SALVATION ARMY AND USED FOR ITS CHARITABLE,
EDUCATIONAL, AND RECREATIONAL PURPOSES ON A NON-PROFIT
BASIS
WHEREAS, The Salvation Army ("Petitioner") has petitioned this Board for tax
exemption for certain of its property from taxation pursuant to Article X, Section 6(a)(6) of
the Constitution of Virginia; and
WHEREAS, that the first reading of this ordinance was held on May 11, 2004; and
the second reading and public hearing at which all citizens had an opportunity to be heard
with respect to Petitioner's request was held by the Board on May 25, 2004; and
WHEREAS, the provisions of subsection B of Section 58.1-3651 of the 1950 Code
of Virginia, as amended, have been examined and considered by the Board; and
WHEREAS, Petitioner agrees that the property to be exempt from taxation is the
property of The Salvation Army.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1.
That, in accordance with Section 58,1-3651 of the 1950 Code of Virginia, as
amended, the Board grants an exemption from taxation under Article X, Section 6 (a)(6) of
the Constitution of Virginia of property owned and used by The Salvation Army for its
charitable, educational, and benevolent purposes, This ordinance is adopted by the Board
after holding a public hearing with respect hereto as to which public notice was given and
at which citizens had an opportunity to be heard. In adopting this ordinance, the Board has
examined and considered the provisions of subsection B of Section 58.1-3651 of the 1950
Code of Virginia, as amended. The assessed value of the property owned and used by
The Salvation Army is $374,300 and the property tax is $4,192. The Tax Parcel No. of the
property owned by The Salvation Army is 38,10-7-28 and said parcel is located at 5511
Williamson Road, Roanoke County, Virginia.
2.
That pursuant to Section 58,1-3605, The Salvation Army shall file triennially
an application with the County's assessing officer as a requirement for retention of the
exempt status of the property. Such application shall show the ownership and usage of
such property and shall be filed within the next sixty days preceding the tax year for which
such exemption, or the retention thereof, is sought.
3.
That The Salvation Army has agreed to enter into a Service Agreement with
Roanoke County providing for the payment of an annual service fee in the amount of 20%
of the County's real estate tax levies, were The Salvation Army not exempt from local
taxation, for so long as Petitioner is exempted from State and local taxation. This service
fee shall commence January 1, 2004, and shall continue for succeeding years so long as
Petitioner is exempted from State and local taxation.
4.
That the County Administrator or Assistant County Administrator is hereby
authorized to execute the necessary documents to accomplish the purposes of this
ordinance.
5.
That the Clerk is directed to forward an attested copy of this ordinance to the
Commissioner of the Revenue and the Treasurer for Roanoke County, and to The
Salvation Army.

tax exemptions,

Be it enacted by the General Assembly of Virginia:
1. That §§ ~¡Ll:3'lQi) and~JU:l6~_1 of the Code of Virginia are amended and reenacted as follows:
§ ~_:iLlOO. Service charge on certain real property.
Notwithstanding the provisions of Chapter 36 (§ 58.1:3QQQ et seq.) of this title relating to the exemption
of property trom taxation, the governing body of any county, city or town is authorized to impose and
collect a service charge upon the owners of all real estate situated within its jurisdiction which is
exempted trom property taxation under subdivision A 1, except property owned by the Commonwealth,
and subdivisions A 3, A 4 and A 7 of § 58.1-3606, subdivisions A 2 through A 7 of § 58.1-3607 and all
sections in Articles 3 (§ 58.1-3609 et seq.) ft, 4 (§ 58.1-3650 et seq.), and 4,1 (§ 58,1-365]) of Chapter
36 of this title.
The service charge may be imposed only if the commissioner of revenue or other assessing officer for
such locality, prior to imposing the service charge, publishes and lists all exempt real estate in the land
books of such locality, in the same manner as is taxable real estate.
§ 58,J:3.6~l, Property exempt from taxation by classification or designation by ordinance adopted by
local governing body on or after January 1,2003.
A. Pursuant to subsection 6 (a) (6) of Article X of the Constitution of Virginia, on and after January 1,
2003, any county, city, or town may by designation or classification exempt tram real or personal
property taxes, or both, by ordinance adopted by the local governing body, the real or personal property,
or both, owned by a nonprofit organization that uses such property for religious, charitable, patriotic,
historical, benevolent, cultural, or public park and playground purposes. The ordinance shall state the
specific use on which the exemption is based, and continuance of the exemption shall be contingent on
the continued use of the property in accordance with the purpose for which the organization is classified
or designated. No exemption shall be provided to any organization that has any rule, regulation, policy,
or practice that unlawfully discriminates on the basis ofreligious conviction, race, color, sex, or national
origin,
B. ~Any ordinance exempting property by designation pursuant to subsection A shall be adopted only
after holding a public hearing with respect thereto, at which citizens shall have an opportunity to be
heard, The local governing body shall publish notice of the hearing once in a newspaper of general
circulation in the county, city, or town where the real property is located. The notice shall include the
assessed value of the real and tangible personal property for which an exemption is requested as well as
the property taxes assessed against such property. The public hearing shall not be held until at least five
days after the notice is published in the newspaper. The local governing body 'lttWf"shall collect the cost

1. Whether the organization is exempt from taxation pursuant to § 501 (c) of the Internal Revenue Code
of 1954;
2. Whether a current annual alcoholic beverage license for serving alcoholic beverages has been issued
by the Virginia Alcoholic Beverage Control Board to such organization, for use on such property;
3. Whether any director, officer, or employee ofthe organization is paid compensation in excess of a
reasonable allowance for salaries or other compensation for personal services which such director,
officer, or employee actually renders;
4. Whether any part of the net earnings of such organization inures to the benefit of any individual, and
whether any significant portion of the service provided by such organization is generated by funds
received from donations, contributions, or local, state or federal grants. As used in this subsection,
donations shall include the providing of personal services or the contribution of in-kind or other material
services;
5. Whether the organization provides services for the common good of the public;
6. Whether a substantial part of the activities of the organization involves carrying on propaganda, or
otherwise attempting to influence legislation and whether the organization participates in, or intervenes
in, any political campaign on behalf of any candidate for public office;
7. The revenue impact to the locality and its taxpayers of exempting the property; and
8. Any other criteria, facts and circwnstances that the governing body deems pertinent to the adoption of
such l~a6httilm ordinance.
C. Any ordinance exempting property by classification pursuant to subsection A shall be adopted only
after holding a public hearing with respect thereto, at which citizens shall have an opportunity to be
heard. The local governing body shall publish notice of the hearing once in a newspaper of general
circulation in the county, city, or town. The public hearing shall not be held until at least five days after
the notice is published in the newspaper,

receive clothing at a discounted price. Clothing is JIee to
those residing in the Shelters. The Salvation Army also
provides a Gym and recreation space where young people
may meet and fellowship.

THE SALVATION ARMY MISSION STATEMENT
The Salvation Anny, founded in 1865, is a.ti. international religious and charitable
movement organized and operated on a qu(1si-military pattern and is a branch of
the Christian church. Its membership includes officers (clergy), soldiers/adherents
(laity), members of varied activity groups and volunteers who serve as advisors,
associates and committed participants in its service functions.
The motivation of the organization is love of God and a practical concem for the
needs of humanity. This is expressed by a spiritual ministry, the purposes of
which are to preach the Gospel, disseminate Christian truths, supply basic human
necessities, provide personal counseling and undertalœ the spiritual and moral
regeneration and physical rehabilitation of all persons in need who come within its
sphere of influence regardless ofrace, color, creed, sex or age.

assets, functional èxpenses, and cash flows for the year then ended. These financial statements
are the responsibility of the management of The Salvation Anny - Roanoke. Our responsibility is
to express an opinion on these financial statements based on our audit.

We conducted our audit in accordance with auditing standards generally accepted in the United
States of America. Those standards require that we plan and perform the audit to obtain
reasonable assurance about whether the financial statements are ftee of IIiaterial misstatement.
An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in
the financial statements. An audit also includes assessing the accounting principles used and

Martin's name has been placed on the consent agenda for confirmation at today's
meeting,
2. Roanoke Valley Area Metropolitan Planning Organization Community Advisory
Committee (CAC)
The late Mr. Eddy served on this committee without a term limit. The County has three
representatives on this Committee and the Board is asked to appoint a citizen and/or
representative of the community, business, education, health care or civic interests
rather than staff members.
3. Total Action Against Poverty (TAP) Board of Directors
The two-year term of Ms. Elizabeth W. Stokes, who serves as the designee of
Supervisor Richard Flora, expired on May 5, 2004.

Greystokes Partnership, the developer of The Hills of Spring Grove, Section 1, requests
that the Board of Supervisors approve a resolution to the Virginia Department of
Transportation (VDOT) requesting that they accept the following roads:

0,04 mile of Meadow Springs Circle, from the intersection with Fountain Lane to its
cul-de-sac
0.08 mile of Spring Grove Drive, being and extension of the existing Spring Grove
Drive (Va. Sec. Rte, #673) from the current cul-de-sac through 0.04 mile of future
street extension property owned by the Board of Supervisors of Roanoke County
(Deed Book 1439, page 67) and the remaining being 0,04 mile extending to the
intersection with Fountain Lane
0.22 mile of Fountain Lane, from the intersection with Spring Grove Drive to the
intersection with Meadow Springs Circle

MEETING ON THE 11th DAY OF MAY, 2004, ADOPTED THE FOLLOWING:
RESOLUTION REQUESTING ACCEPTANCE OF MEADOW
SPRINGS CIRCLE, A PORTION OF SPRING GROVE DRIVE, AND A PORTION
OF FOUNTAIN LANE INTO THE VIRGINIA DEPARTMENT OF
TRANSPORTATION SECONDARY SYSTEM.
WHEREAS, the streets described on the attached Addition Form SR-5(A), fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the
Circuit Court of Roanoke County, and
WHEREAS, the Resident Engineer for the Virginia Department of Transportation
has advised this Board the streets meet the requirements established by the Subdivision
Street Requirements of the Virginia Department of Transportation,
WHEREAS, the County and the Virginia Department ofTransportation have entered
into an agreement on March 9, 1999 for comprehensive stormwater detention which
applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the streets described on the attached Additions Form
SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of
Virginia, and the Department's Subdivision Street Requirements. and
BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-
of-way, as described, and any necessary easements for cuts, fills and drainage, and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to
the resident Engineer for the Virginia Department of Transportation.

SUMMARY OF INFORMATION:
Wexford of Roanoke, Inc., developers of Wexford Phase III, requests that the Board of
Supervisors approve a resolution to the Virginia Department of Transportation (VDOT)
requesting that they accept 0.19 miles of Montague Way from its intersection with Route
690 (Roselawn Road) west to its cul-de-sac. Staff has inspected this road, along with
representatives from VDOT, and finds that the road is acceptable.
FISCAL IMPACT:
No County funding is required.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the resolution accepting Montague Way into the
VDOT Secondary System.

THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, IN REGULAR MEETING ON
THE 11TH DAY OF MAY, 2004, ADOPTED THE FOLLOWING:
RESOLUTION REQUESTING ACCEPTANCE OF MONTAGUE
WAY INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION
SECONDARY SYSTEM
WHEREAS, the street described on the attached Addition Form SR-5(A), fully
incorporated herein by reference are shown on plats recorded in the Clerk's Office of the
Circuit Court of Roanoke County, and
WHEREAS, the Resident Engineer for the Virginia Department of Transportation
has advised this Board the streets meet the requirements established by the Subdivision
Street Requirements of the Virginia Department of Transportation,
WHEREAS, the County and the Virginia Department ofTransportation have entered
into an agreement on March 9, 1999 for comprehensive stormwater detention which
applies to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the streets described on the attached Additions Form
SR-5(A) to the secondary system of state highways, pursuant to §33,1-229, Code of
Virginia, and the Department's Subdivision Street Requirements, and
BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-
of-way, as described, and any necessary easements for cuts, fills and drainage, and
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to
the resident Engineer for the Virginia Department of Transportation.

On April 27 the Board of Supervisors heard the rezoning petition of Slate Hill. The Board
voted to continue the petition to May 25 in order to allow more time to review and refine
proffers. The Board also asked for an interim report, at the May 11 work session, to
assess progress on these efforts.
Staff plans to review transportation issues at the work session. Representatives from
VDOT will attend. In addition, staff will provide graphic information on slopes and
elevations along with suggested proffered conditions,

Mr. Chairman & members ofthe Board, we thank you for taking time for this work session on
the proposed Slate Hill rezoning, The Board has not routinely held work sessions on zoning
issues in the past, as does the Planning Commission, but we may want to do so in the future on
the more complicated ones such as this.
The staff and I have met on-site with the Smiths as most of you have. These meetings have
helped us understand even more the necessity of handling this project correctly. That is a dual
responsibility of the developer and of Roanoke County, Slate Hill comes at the most opportune
time as we consider changes to our Comprehensive Plan and discuss the development of a new
"Slope Policy." The decisions that we make on this project will tell us clearly whether we are
paying lip service to growth management or whether we are ready to make this community an
even more desirable place to live. Mr, Smith will also show us whether he is truly interested in
making this a quality project or is simply interested in making money,
Quite honestly, the Slate Hill project is NOT ready for rezoning OR construction, There are too
many unanswered questions, too many long term impacts, and too many negatives to the plan as
proposed, This project should be delayed until all issues are well defined. Mr, Smith has said
that he will build what the current zoning allows if we do not act favorably on his request. That
is disappointing. We understand the time value of money and the need to move forward when
the construction season allows. . We understand even better the never-ending maintenance issues
and irreversible changes that the County will live with if we move too hastily. Probably even
more importantly, we understand the example this will set for others to follow. I want to remind
Mr, Smith that the issues will be the same for development under the current or proposed zoning
and the same for residential as for commercial.
Mr. Covey, his staff, and I have worked on this at length. Let me give you an overview of our
work session, outline the issues to be discussed, and then have Aaron Hofberg, Anthony Ford,
Janet Scheid, and Arnold Covey go into greater detail on the major issues, You may even want
to hear from the developer and from VDOT. I believe Aaron's virtual tour will explain many of
our concerns, First, let me say that this project can work but changes will have to be made for it
to succeed,

Major Issues
Transportation issues - Much has been said about the proposed entrances on Route 419 and on
Route 220 beside Lowes, It has been reported that VDOT granted access in 1995 for the
construction of a restaurant behind the Moss & Rocovich offices. As we have read the
documents and traffic studies, the staff and I have gotten different interpretations than the
developer has. For example, the 1995 letter does not grant access but rather says that access may
be obtained, As of this time, the developer does not have VDOT approval for this much larger
more expansive project. There is no clear plan for left hand turns onto 419 and there is very little
room for adding turn lanes, We must work more closely with VDOT than ever before, I am
pleased that Richard Caywood has agreed to be with us today. It signifies the importance ofthis
project to the state as well as the County,
Slope issues - One has but to look across Route 220 at the erosion near IHOP to see the need for
good sound planning for construction on slopes this steep. We are convinced that the usual
construction practices will not be sufficient for Slate Hill. We also suggest that the developer
establish a maintenance reserve account that will help repair retaining walls, erosion, and roads
in the years to come. Developers often sell parcels and maintenance is turned over to
associations, Who will provide maintenance for this project and will there be funds when the
bonds are released? We must know in advance which roads will be public and the ones that will
be private, How will we provide County services such as refuse service, respond to fire and
rescue calls, and route school busses if property is developed residentially, Has geotechnical
work been done? If not, how can the developer be sure where the roads and building sites will
go?
We will work it out - All too often, we have worked under the concepts of "road improvements
FOLLOW construction" and "that is VDOT's responsibility." We cherish a property owner's
right to "do what he will" with his land as the American way, In the past, our staff has done
much of the repair after-the-fact that should have gone into proper planning and development.
That is possible with small projects but steep slope projects such as this one will not be so easy
or inexpensive.
Recommendations
Based on the work the staff has done, I recommend that the Board defer action on the Slate Hill
project at the May 24th meeting until the developer addresses the issues. Property is zoned for its
"highest and best use." That does not mean, however, that owners and developers can ignore the
many rules and regulations that dictate how this will take place. Traffic is traffic whether for
residential or commercial development. Water runs downhill for both. Ifwe are not convinced
that this is a different project than we have seen before, we have but to try running to the top of
Slate Hill to gain a sense of slope, We can also try to run across Route 419 to Tanglewood Mall
to understand traffic. The staff and I stand ready to work with the developer to make this project
work. If this is not acceptable to the developer, then I recommend that you deny the request for
rezoning,

Our client's properties are served by an access road which is parallel to Route 419 and
which enters and exits to and from 419 at a traffic light in front of the Wendy's restaurant. There
is another entrance/exit further east adjacent to 419. Our client's access road is a private
easement which serves only its properties and that of Fashion Floors,
Our client is aware that access to the property which is the subject of the zoning request
has been of concern to the County. Thus our client wishes to make it clear that the above private
easement is not appurtenant to any property of the Petitioners and that the Petitioners have no
legal interest whatsoever in the road. Signs have been posted on the private easement so as to
notify motorists that the road is a private right ofway.
We understand that the Petitioners may have made the representation that they have the
use of our client's easement. However, this is not correct and we therefore believe it important to
make this a matter of record in order to avoid any future misunderstanding with regard to the use
ofthe road.
While our client has no general opposition to this rezoning we would not want any
inaccurate infonnation with regard to access to fonn the basis of an approval.

SLOPES
1, A geo-technical report from a certified Geo-technical Engineer shall be
required to verify slope stability and stabilization methods, and design
values for retaining structures.
2. A "slope maintenance bond" shall be required, for a 10-year term, to
insure the continued safety and maintenance of all slopes, retaining walls
and private roads.
BUILDINGS
1. Height: Building height shall not exceed 45 feet (as measured per the
Roanoke County Zoning Ordinance) unless a minimum of 50% of the
required parking for that building is underground. Then building height
shall not exceed 60 feet.
2. Size: Building footprint shall not exceed 15,000 square feet. In addition,
no building shall exceed the maximum size building used in the Traffic
Impact Study by more than 10%.
3. Materials: Acceptable building finishes include brick, wood, vinyl or
composite wood substitute, glass, stucco or exterior insulated finish
system (EIFS), split-face colored concrete block, stone or cast stone.
4. Roof: Articulated roofline on all sides of the building shall be required.
Acceptable roof materials include standing seam metal, copper, composite
slate tile or asphalt shingles.
5, Building Colors: Tan, brown, gray, beige, brick red
ROAD
1, Curb and gutter shall be required for the road throughout the entire site.
2, Plant mix asphalt shall be required.
3. Roadway typical section shall be a minimum 11-foot travel lanes, with
VDOT standard CG-6 curb and gutter, minimum 26-feet from curb to curb.
Maximum road grade shall be 15%. There shall be no on-street parking
allowed.
4. Minimum 5-foot wide sidewalks shall be installed on at least one side of all
Internal streets throughout the site providing access between buildings.
ACCESS
1. Access from petitioner's property to the private access road (tax map
#77,20) in front of the Wendy's restaurant shall be prohibited and blocked
with a physical andlor landscaping barrier.
2. The property zoned R-3 behind Lowe's shall not be connected to the
internal road system of the Slate Hill project. (Has not been included in the
Traffic Impact Study).
3, Petitioner shall make all necessary improvements to Electric Road (Route
419), Valley Avenue and Franklin Road (Route 220) as required by the
traffic impact study and by VDOT.
RIDGELINE
1. No building height shall extend beyond the 1384 elevation mark and all
building elevations shall be shown on the site plan.
UTILITIES
1. All utilities shall be underground.
2. Where possible, all utilities shall share a common trench.
RETAINING WALLS
1. Height: Maximum of 10 feet.
2. Distance in between walls: Minimum of 4 feet.
3. Color and Texture: Tan, brown, gray, beige. Walls shall be textured.
4. Landscaping: One medium size (5-10 feet @ maturity) shrub for every 10
feet of linear wall. Shrubs shall be a mix of deciduous and evergreen.
Shrubs may be grouped together.
5. A Professional Engineer shall design all retaining walls.
LANDSCAPING
1. A tree survey shall be required to delineate all remaining trees on the site.
2. No tree shall be removed until tree survey is approved and a site plan is
approved. For each tree removed henceforth, there shall be a one-for-one
replacement of trees. Minimum size of replacement trees is 2 1/2-inch
caliper.
3. Trees shall be planted along the private entrance road every 30 feet,
minimum 2%- inch caliper, 50% native species. Flowering species that
are street and urban conditions tolerant shall be utilized.

SITE LIGHTING
1. No freestanding light pole, including fixture, shall be more than 22 feet
above grade. All exterior lights, including security lighting, shall be down-
lit or shielded so as not to direct glare onto adjoining streets or properties.
The intensity at adjoining streets or properties shall not exceed 0.5-foot
candles.
2. All street lighting shall be a decorative type of pole and fixture.
SIGNAGE
1. No more than three (3) business signs shall be permitted for each
business.
2. Restricted signs: The following signs shall be prohibited: Off-premise
signs, portable signs, temporary signs, changeable copy signs, roof signs
and pole signs.
3. Signage shall complement the buildings' architectural style. Materials
such as exposed standard concrete block, metal or brightly colored siding
shall not be allowed. Colors shall be in the range acceptable for buildings.
4. All freestanding signs shall be monument type, shall not exceed 10 feet in
height or 12 feet in width and signs shall be channel lit, ground lit or top lit
with shielded lamps placed so as to not cast light onto the path of traffic or
adjoining properties.
5. All signs shall be complemented, accented and enhanced by landscaping.
PARKING
1, All parking in excess of Roanoke County standards shall be constructed of
pervious pavements. Gravel shall not be allowed.
STORMWATER MANAGEMENT
1. Only one outfall may discharge into the concrete culvert within the VDOT
right-of-way. The outfall shall be through a level spreader and have a 25
foot riparian buffer as a separation between the discharge point and the
concrete culvert.
2, All drainage ways shall be piped. No drainage ditches shall be permitted.
3. Detention Requirements: 10 year post development equal to or less than
2 year pre-development and 25 year post equal to or less than 2 year pre-
development.

SUMMARY OF INFORMATION:
As requested by the Board at their meeting on April 27, 2004, this time has been set aside
to discuss the naming of several Roanoke County facilities. At this time, the Board has no
written policy and each request is considered individually.
The Clerk's Office has researched this subject, and attached are the following items for
your information:
(1) Copy of memo dated January 15, 1992 to the Board members from Elmer Hodge
with results of staff research on a naming policy. Most of the localities contacted at
that time had no written policy. The suggestion was made to treat each item
individually.
(2) Memo dated January 16, 1992 from former Supervisor Eddy with suggestions for a
written policy on naming of County-owned facilities. This was discussed at the
January 18, 1992 Board Retreat but there was no consensus to move forward to
adopt a written policy.
(3) List of County facilities named by Board action since 1992
(4) Arlington County Policy for Naming and Renaming County Facilities and Parks, last
adopted on July 10,1999

Staff has now completed its research on a naming policy for
public facilities. In doing so, sta~f contacted between sixteen
and eighteen other Virginia localities to see if such policies had
been adopted. Responses were received from fourteen. Following
are some of the comments received:
No policy in writing. Recreation Advisory Board would name
according to area/identifying mark in area, i.e., Cave
Park or River Park ------
No longer-ñãme any parks or schools for individuals
Brainstorm from citizens/neighboring landowners; county
administrator to name new (only) parks
No policy; very touchy thing; leave that to the politicians
No policy; each handled on individual basis; city council,
sometimes staff, name parks

No policy, but it's been a real problem.
staff also contacted Dr. Bayes Wilson of the County school
system. He indicated that they have so few opportunities for
naming facilities, they prefer to treat each case individually as
they have in the past.
Of all the localities contacted, only one, Arlington county,
has such a policy and a copy of it is attached for your
information. Due to the infrequency of having to name facilities,
I suggest that we continue to treat each individually as we have in
the past.

Thank you for your memo of 1/15/92 on this subject and the attached
policy statement from Arlington County. I believe it is desirable
to have a written and consistent policy on naming public facilities
and would recommend the following as a starting point for
discussion:
1. No public facility will be named after a person until that
person has been deceased for at least one year.
2. Names for Parks and Recreation facilities will be approved by
the Board of Supervisors upon the recommendation of the Parks and
Recreation Commission.
3. Names for Library facilities will be approved by the Board of
Supervisors upon the recommendation of the Library Board.
4. Names for School facilities will be approved by the School
Board, with the concurrence of the Board of Supervisors.
5. Names for any other public facilities will be approved by the
Board of Supervisors upon the recommendation of the County
Administrator.
I request that this matter be placed on the agenda for discussion
at our 1/18/92 Board retreat or at a subsequent regular Board
meeting.

ARLINGTON COUNTY POLICY FOR NAMING AND RENAMING OF
COUNTY
FACILITIES AND PARKS
Adopted by the Arlington County Board July 10, 1999
Criteria for Naming County Facilities: County facilities, including buildings
and parks, shall generally be named according to the geographical,
historical, or ecological relationships in which the site is located.
Exceptions may be made in the following circumstances:
A) To Commemorate an Individual's Service: Facilities may be named
after an individual who made significant contributions to Arlington
County through participation in community, state, or national
service. A facility can be so named five years or more after the
individual is deceased.
B) To recognize a Significant Contribution to a Facility: In selected
instances, a county facility may be named after a
business/individual/organization that makes a unique and
extraordinary financial or other contribution to the development
and/or usage of the facility being named. The merits and value of
each such nanúng shall be evaluated on a case-by-case basis. It
should not be assumed that a financial contribution guarantees that a
facility is named after the business/individual/organization.
C) To help Identify the Facilities PurposelUsage: A name may be
assigned to a county facility if it helps to describe and identify the
usage or purpose of the facility.
D) To Identify the Facility with a Specific School: Facilities developed
on a school site may be named according to the name of the school.
II.
Renanúng County Facilities: Renanúng a county facility can occur if
A) The above-stated criteria are met;
B) A valid justification for renanúng the facility is provided;
C) Changing the name will not cause undue confusion within the
community; and
D) An appropriate level of community support exists.

A) The Park and Recreation COInnÚssion shall make recommendations
to the County Board concerning the naming or renaming of parks,
recreation, conservation, and public open space areas and related
facilities. The COInnÚssion will seek comment from the following
organizations when considering a facility naming or renaming
request: Historical Affairs and Landmark Review Board,
Neighborhood Conservation Advisory CoInnÚttee and the
appropriate neighborhood civic association(s).
The Park and Recreation CoInnÚssion will synthesize the comments
received and make a recommendation to the County Board. The
County Manager will also present a recommendation to the County
Board.
B) The Historical Affairs and Landmark Review Board shall make
recommendations to the County Board concerning the naming or
renaming of County buildings and facilities not mentioned in ULA.
A consultation and recommendation process similar to that described
in III.A. shall be followed in the naming or renaming of non-park or
recreation-related facilities.

The new Driver Training Center at Dixie Caverns will open on June 17, 2004, This is a joint
regional project between the Roanoke County and Roanoke City Police Departments,
At this time a name has not been selected for the project. Staff would like to suggest that
the center be named "The Laurel Mountain Police Driving Center." We suggest this
because of the abundance of Mountain Laurel at the Center and the natural beauty of the
area, We also have made every effort to make this project environmentally friendly by
replacing the trees cut with seedlings and planting natural mountain plants such as
rhododendrons and day lilies.
FISCAL IMPACT:
None
ALTERNATIVES:
Any name the Board of Supervisors might select.
STAFF RECOMMENDATION:
Staff recommends that the center be named the Laurel Mountain Police Driving Center.

SUMMARY OF INFORMATION:
The former Salem Office Supply Building is currently being renovated by the County for
use as office space for the Sheriff's Office and the Court Services Unit, a division of
Juvenile and Domestic Relations Court. During this process, the building has been
referred to as the Roanoke County Courthouse Annex,
The building is scheduled to be finished by October 1, and as the time for occupancy
nears, signs and a plaque will be ordered. Traditionally, plaques on public buildings
include the official name of the building, as designated by the Board of Supervisors, and
facilities are generally named after an appropriate individual or based on geographic
location. In the past, the County has not named facilities after individuals who are still
living. This policy was followed in naming Darrell Shell Park and the Clifford E. Craig Dam
at Spring Hollow Reservoir. Most County facilities are named after their physical location
or purpose, such as Green Hill Park and the Brambleton Center, which may help citizens in
locating them.
The Board will need to choose a name for this facility so that staff can proceed with
ordering the appropriate signage for the building in time for the scheduled opening.

The Roanoke Valley-Allegheny Regional Commission has requested that Roanoke County,
along with neighboring jurisdictions, contribute $100,000 to a loan fund designed to assist
local businesses with growth and expansion activities. This work session has been
scheduled for staff to present information to the Board about the regional Grow America
Fund.
FISCAL IMPACT:
Funding in the amount of $100,000 in addition to a yearly management fee estimated at
$25,000 will be required and has not been currently identified.
STAFF RECOMMENDATION:
Staff recommends that if this program is approved by the Board, it should be considered a
new priority for the County's' Economic Development Strategy, and not dilute funding from
current ongoing projects and programs.
