The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the fourth Tuesday and the second
regularly scheduled meeting of the month of May 2020. Audio and video recordings of
this meeting will be held on file for a minimum of five (5) years in the office of the Clerk
to the Board of Supervisors.
IN RE: OPENING CEREMONIES
Before the meeting was called to order a moment of silence was
observed. The Pledge of Allegiance was recited by all present.
IN RE: CALL TO ORDER
Chairman Radford called the meeting to order at 3:01 p.m. The roll call
was taken.

IN RE: NEW BUSINESS
1. Resolution approving the Roanoke County Public Schools (RCPS)
budget for fiscal year 2020-2021 upon certain terms and
conditions (Michael Wray, Vice-Chairman, Roanoke County Public
School Board; Dr. Kenneth Nicely, Roanoke County Public
Schools Superintendent; and Susan Peterson, Roanoke County
Public Schools Director of Finance)

Mr. Wray provided an overview; waiting on directions from the State.
Next, Dr. Nicely provided an additional overview. Ms. Peterson then through the
projected, revised budget.
Supervisor Hooker applauded Dr. Nicely and administration on this
unprecedented year with an early closure due to the pandemic and the way that it has
been handled. I know there has been a lot of feedback from parents and students, but it
has been a pleasure to watch how calming and thoughtful the decision-making process
was. Job well done.
Supervisor Radford stated he noticed in the budget the fact that the
nurses are now full time. He knows they were full time then took them back to part time
and now they are back to full time; he is sure COVIDI9 had a lot of impact on this. His
wife was a substitute nurse and the challenge is a lot of the schools' offices are really
small and staff will now need to figure out how to see the students and stay protective.
Supervisor North complimented Dr. Nicely and staff for the way graduation
was handled, which was outside the norm, to say the least. He does hope that
everyone gets a chance to "walk" and get their diploma in a different manner. They did
get them, even though it was raining. He thought that was very commendable and
rather than put on Facebook, he thought he would tell them in person. Thank you.
Supervisor Hooker noted as she has discussed in the past, she is an
employee with Roanoke County Public Schools and after consulting with the County
Attorney and Commonwealth Attorney, they have advised me that is no conflict in her
participation in this vote.
RESOLUTION 052620-1 APPROVING THE ROANOKE COUNTY
PUBLIC SCHOOLS BUDGET FOR FISCAL YEAR 2020-2021
UPON CERTAIN TERMS AND CONDITIONS
WHEREAS, State Code 22.1-93 requires the governing body of a County to
prepare and approve an annual budget for education purposes by May 15 or within
thirty (30) days of the receipt by the County of the estimates of State funds, whichever
shall later occur; and
WHEREAS, the Roanoke County School Board approved their fiscal year 2020-
2021 budget on May 14, 2020.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia that the fiscal year 2020-2021 Roanoke County Public Schools budget
as set forth by the School Board's adoption on May 14, 2020, a copy of which is
incorporated by reference herein, is hereby APPROVED, and the County Administrator
and the Clerk are authorized to execute and attest, respectively, on behalf of the
County, any documentation, in form approved by the County Attorney, necessary to
evidence said approval.
On motion of Supervisor North to adopt the resolution, seconded by Supervisor
Peters and carried by the following recorded vote:

2. Resolution authorizing the creation of a new Agreement with the
County of Botetourt for mutual fire and emergency medical
services (Stephen G. Simon, Chief of Fire and Rescue)
Chief Simon reviewed the request for resolution.
Supervisor Peters stated as he said in the work session, he wants to go
on record. While he is in favor of this agreement, we need to look at the corridor long-
term as the demand will continue to increase with the nursing home coming up in the
city, the demand in the Daleville Town Center. We know that area is going to continue
to have more and more pressure put on fire and rescue and he would hope that
Roanoke County will continue to look at other ways we can provide that service to make
sure our citizens are being protected.
Supervisor North stated he would like to echo the comments from
Supervisor Peters as well. The future is now. We came out of a 30 year agreement, we
have a five (5) year agreement with a year to year renewal. He thinks now is the time to
being looking towards the future at other sites just to have information gathering and
discussion, but he does think this agreement is much better than what we had before. It
gives us the first right of refusal. You never know, if you don't ask for it, you won't get it.
If you don't seek it, you won't find it and maybe we will be able to use that one day;
maybe not. It will still provide the same service to the citizens of that area that we have
today and that is of utmost importance to him as representative of one side of Rt. 460.
Thank you for those changes, Mr. Lubek and Mr. Simon.
RESOLUTION 052620-2 APPROVING THE CREATION OF A
NEW AGREEMENT WITH BOTETOURT COUNTY FOR MUTUAL
FIRE AND EMERGENCY MEDICAL SERVICES
WHEREAS, §§ 27-2, 27-4, and 27-23.9 of the Code of Virginia (1950), as
amended, authorize local governments to cooperate in the furnishing of fire and
emergency medical response and related issues; and
WHEREAS, the County of Botetourt and the County of Roanoke have
demonstrated a pattern of successful cooperation through the joint operation of the
Read Mountain Fire Station; and
WHEREAS, pursuant to an agreement dated May 10, 1990, the Roanoke County
Fire and Rescue Department and the Botetourt County Fire and Rescue Department
have been jointly operating the Read Mountain Fire Station, located at 43 Eastpark Dr.,
Roanoke, VA 24019 (the Fire Station Agreement); and

WHEREAS, the Fire Station Agreement, which was previously scheduled to
expire on May 11, 2020, has been continued in effect until June 30, 2020, in order to
allow the localities additional time to create a new mutual aid agreement; and
WHEREAS, upon the expiration of the Fire Station Agreement, Botetourt County
will assume sole ownership and management of the Read Mountain Fire Station; and
WHEREAS, it is proposed that a new mutual aid agreement between the parties
be created, wherein emergency services will continue to be provided to all areas of both
Botetourt and Roanoke Counties, as they are presently offered from the Read Mountain
Fire Station.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, that:
1. The continued joint exercise of powers, privileges and authority with the
County of Botetourt and the County of Roanoke, in the establishment and
maintenance of mutual aid for emergency fire and medical services, is hereby
approved.
2. The Board hereby authorizes the creation of a new mutual aid agreement with
Botetourt County (which may become effective on or after July 1, 2020), to
provide fire and emergency medical services in the Read Mountain area of
Roanoke County, and the Masons Cove and Catawba areas of Botetourt
County, in substantially the form as attached to this resolution, and authorizes
the County Administrator and Chief of Fire and Rescue, or their designees, to
execute this Agreement on behalf of Roanoke County, upon a form as
approved by the County Attorney.
3. The Board further authorizes the County Administrator, or any assistant
County Administrator, to execute an option for the purchase and sale of Read
Mountain Fire station, in substantially the form as attached to this resolution,
upon a form as approved by the County Attorney.
4. This resolution shall be effective from and after the date of its adoption.
On motion of Supervisor North to adopt the resolution, seconded by Supervisor

3. Resolution approving the donation of property to Botetourt
County (Stephen G. Simon, Chief of Fire and Rescue)
Chief Simon outlined the request for resolution. There was no discussion.
RESOLUTION 052620-3 APPROVING THE DONATION OF
PROPERTY TO BOTETOURT COUNTY

WHEREAS, pursuant to an agreement dated May 10, 1990, the Roanoke County
Fire and Rescue Department and the Botetourt County Fire and Rescue Department
have been jointly operating the Read Mountain Fire Station, located at 43 Eastpark Dr.,
Roanoke, VA 24019 (the Joint Fire Station Agreement); and
WHEREAS, the Joint Fire Station Agreement which was previously scheduled to
expire on May 11, 2020, has been continued in effect until June 30, 2020, in order to
allow the localities additional time to create a new mutual aid agreement; and
WHEREAS, in order to facilitate further cooperation and the rendering of mutual
aid between the two localities, it is proposed that Roanoke County transfer certain
vehicles (each of which shall be equipped with MSA self-contained breathing apparatus
equipment) to Botetourt County, including the following:
1. 2009 Pierce Engine 4P1 CU01 HX9A009891 (presently known as
"Wagon 12"),
2. 2012 Ford F350 4x4 1FDRF3B63CEB84443 ("Brush 12"),
3. 2008 Chevrolet 2500H 1GBHK23K18F179684 ("Utility 12"),
4. 2017 Ford/Braun 1 FDUF4HT1 HED80238 ("Ambulance 12-1"); and
WHEREAS, Roanoke County has a mutual aid agreement with Botetourt County
and is frequently called upon for assistance with patient care; and
WHEREAS, Botetourt County is in need of the above described property, and
would willingly accept the donation of such property from Roanoke County in "as is"
condition. Such property will better enable Botetourt County to provide fire and rescue
assistance to Roanoke County pursuant to the mutual aid agreement; and
WHEREAS, Section 15.2-953(C) of the Code of Virginia provides that a locality
may make gifts and donations of personal property to another governmental entity
within the Commonwealth.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, that:
5. The following items of personal property (each of which shall be equipped
with MSA self-contained breathing apparatus equipment) are declared to be
surplus:
a. 2009 Pierce Engine 4P1 CU01 HX9A009891 (Wagon 12),
b. 2012 Ford F350 4x4 1FDRF3B63CEB84443 (Brush 12),
c. 2008 Chevrolet 2500H 1GBHK23K18F179684 (Utility 12), and

6. The donation of such property to Botetourt County is hereby authorized, and
such donation shall occur on or after June 30, 2020.

to take such actions as are necessary to effectuate the donation.

IN RE: PUBLIC HEARING
1. Public hearing for citizen comments on the Proposed Fiscal Year
2020-2021 Operating Budget and the Proposed Fiscal Year 2021-
2030 Capital Improvement Program (Laurie Gearheart, Director of
Finance and Management Services)
Chairman Radford opened and closed the public hearing with no
comments.
IN RE: FIRST READING OF ORDINANCES
1. Ordinance authorizing the County Administrator to finalize and
execute a lease agreement to include an option to purchase
property and finalize and execute a subsequent purchase
agreement if the procurement option is exercised for property
located at 2741 Penn Forest Boulevard, Roanoke, Virginia; Cave
Spring Magisterial District (Rob Light, Director of General
Services)
Mr. Light outlined the request for the ordinance and the options outlined in
the lease agreement. There was no discussion.
Supervisor Mahoney's motion to approve the first reading and set the
second reading for May 26, 2020, was seconded by Supervisor Hooker and approved
by the following vote:

2. Ordinance of the Board of Supervisors of the County of Roanoke,
Virginia authorizing County support of refinancing by the Western
Virginia Regional Industrial Facility Authority (Rebecca Owens,
Assistant County Administrator)
Ms. Owens outlined the request for ordinance. There was no discussion.
Supervisor Hooker's motion to approve the first reading and set the p
second reading for June 9, 2016 was seconded by Supervisor North and approved by

3. Emergency ordinance readopting Ordinance 033120-1 to
effectuate temporary changes in certain deadline and to modify
public meeting and public hearing practices and procedures to
address continuity of operations associated with pandemic
disaster (Due to the Pandemic Disaster, it is requested, upon a
four-fifths vote of the Board, the second reading be waived and
the ordinance adopted as an emergency measure.) (Peter S.
Lubeck, County Attorney)
Mr. Lubeck outlined readopting the ordinance.
Supervisor Peters inquired when do we plan to reopen this building with
Mr. Lubeck advising the Emergency Operation Team is currently working on that. Mr.
O'Donnell, County Administrator, stated tentatively June 8, 2020, but is still being
finalized. Supervisor Peters inquired would this ordinance that we are renewing, would
it continue when we open this building. Mr. Lubeck responded in the affirmative for a
couple of different matters with regard to how the Board operates. For example, the
future of the COVID19 pandemic is unknown and there may be a resurgence and it may
it become necessary, we hope not, to close and Board meetings may be determined to
be necessary for the Board to meet remotely, we would like to have the ordinance in
place. Also, we have not used it for these reasons, there is a possibility that with
regards to Freedom of Information Act deadlines and other deadlines set by the Code of
Virginia, and this would give the County flexibility to operate, if needed, outside of those
time constraints.
Supervisor North inquired how long is this extension with Mr. Lubeck
responding 60 days. So, if staff recommends we rescind, would we have to vote to
rescind with Mr. Lubeck responding in the affirmative.
EMERGENCY ORDINANCE 052620-4 READOPTING
ORDINANCE 033120-1, TO EFFECTUATE TEMPORARY
CHANGES IN CERTAIN DEADLINES
AND
TO MODIFY PUBLIC MEETING AND PUBLIC HEARING
PRACTICES AND PROCEDURES TO ADDRESS CONTINUITY
OF OPERATIONS ASSOCIATED WITH PANDEMIC DISASTER
WHEREAS, on March 31, 2020, the Board adopted emergency Ordinance
033120-1, to effectuate temporary changes in certain deadlines and to modify public
meeting and public hearing practices and procedures to address continuity of
operations associated with the COVID-19 pandemic disaster; and

WHEREAS, pursuant to Section 15.2-1427 of the Code of Virginia, emergency
ordinances shall not be enforced for more than sixty (60) days unless readopted; and
WHEREAS, due to the ongoing nature of the COVID-19 pandemic, it is proposed
that the Board readopt Ordinance 033120-1; and
WHEREAS, the first reading of this ordinance was held on May 26, 2020; and the
second reading has been dispensed with, upon an affirmative vote of 4/5ths of the
members of the Board, this being deemed to be an emergency measure pursuant to
Section 18.04 of the Roanoke County Charter.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the
County of Roanoke, Virginia:
1. That Ordinance 033120-1 is hereby readopted.
2. An emergency is deemed to exist, and this ordinance shall be effective upon
its adoption.

adversely affect the bargaining position or negotiating strategy of the public body, in the

where such consultation or briefing in open meeting would adversely affect the

RESOLUTION 052620-6 CERTIFYING THE CLOSED MEETING
WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a closed meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by
the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.

IN RE: PUBLIC HEARINGS AND SECOND READINGS OF ORDINANCES
1. The petition of Western Virginia Regional Industrial Facility
Authority to rezone 2.02 acres from R-1, Low Density Residential,
District to PTD, Planned Technology Development, District for the
development of the Wood Haven Technology Park, and to amend
a portion (43.72 acres) of the Wood Haven Technology Park
Master Plan, located in the 7800 and 7900 blocks of Wood Haven
Road, including 7875 Wood Haven Road, Catawba Magisterial
District (Philip Thompson, Director of Planning)
Mr. Thompson provided a PowerPoint presentation; a copy of which is on
file in the office of the Clerk to the Board of Supervisors.

Supervisor Hooker stated her question regards buffering for that site,
specifically it is true that right there at the entrance there really isn't any natural buffering
going on there. To the left and right of the property, there is a tree line, on that border
and that will be protected, so we will have that entry way of the new additional property
that will have the designated buffer zone built to the standards that Mr. Thompson
described with Mr. Thompson responding in the affirmative. She just wanted to confirm
that.
Supervisor Radford stated he agreed, it is a much better flow with the
stormwater that he can see with the house on that property. At this point, does the
petitioner have the option of putting the stormwater on the surface or are they going to
put underground. Mr. Thompson stated it would be a pond that would be developed
and asked the applicant speak to that. There may be options, but until they understand
who the user will be and more intensive engineering done, all options are available.
Supervisor Radford then asked if we do an aboveground pond, will we have to put a
fence around it. Mr. Thompson stated he did not think so; it will be a Nue j pond.
Next, Mary Ellen Goodlatte, with the law firm of Glenn Feldman Darby and
Goodlatte represents the applicant, the Western Virginia Regional Industrial Facility
Authority provided introductions of those joining her representing the Authority - John
Hull, Executive Director and Shaun Home from Balzer and Associates to answer any
questions the Board may have. She provided a brief overview.
Chairman Radford opened and closed the public meeting with no citizen
comments.
Supervisor Hooker stated she had some Iprecursoryfrp2j comments. First,
she had a really good meeting with several neighbors weeks ago; good conversation,
good discussion. She advised that she believed that this additional parcel will enhance
the master plan and she really liked the way Mr. Thompson described it with a much
gentler slope. She thinks it will be much more appealing just from street level. She
added that she finds the proposed rezoning and amendment to the Wood Haven
Technology Park Master Plan are consistent with the purpose and intent of the County's
adopted comprehensive plan and good zoning practice, and will not result in substantial
detriment to the community.
ORDINANCE 052620-7 REZONING 2.02 ACRES FROM R-1
(LOW DENSITY RESIDENTIAL) DISTRICT TO PTD (PLANNED
TECHNOLOGY DEVELOPMENT) DISTRICT FOR THE
DEVELOPMENT OF THE WOOD HAVEN TECHNOLOGY PARK,
AND AMENDING A PORTION (43.72 ACRES) OF THE WOOD
HAVEN TECHNOLOGY PARK MASTER PLAN, LOCATED IN
THE 7800 AND 7900 BLOCKS OF WOOD HAVEN ROAD,
INCLUDING 7875 WOOD HAVEN ROAD, CATAWBA
MAGISTERIAL DISTRICT

WHEREAS, the Western Virginia Regional Industrial Facility Authority (WVRIFA)
was formed in 2014 by six regional governments to provide a mechanism for localities
to cooperate regionally on economic development projects; and
WHEREAS, after an analysis to identify suitable large acre tracts in the region,
the Wood Haven Road site was selected as the first priority for development; and
WHEREAS, in July 2018, the Board of Supervisors approved a rezoning of
approximately 113 acres from I-1 (low intensity industrial) district and R-1 (low density
residential) district to PTD (planned technology development) district, for the
development of the Wood Haven Technology Park; and
WHEREAS, as part of the 2018 rezoning process, a master plan was submitted
by WVRIFA which lists the permitted uses that will be allowed within the Wood Haven
Technology Park along with development standards for the proposed Wood Haven
Technology Park; and
WHEREAS, this request keeps the same permitted uses and development
standards as the 2018 rezoning, except for some minor revisions to the buffer areas
associated with the construction and maintenance of stormwater management facilities
within the buffer areas and the installation of a landscape buffer along Wood Haven
Road for a 2.02 acre parcel being incorporated into the Technology Park; and
WHEREAS, the first reading of this ordinance was held on April 28, 2020, and
the second reading and public hearing were held on May 26, 2020; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on May 5, 2020; and
WHEREAS, the Planning Commission recommends approval of the petition; and
WHEREAS, legal notice and advertisement has been provided as required by
law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The petition of the Western Virginia Industrial Facility Authority to rezone 2.02
acres from R-1 (low density residential) district to PTD (planned technology
development) district for the development of the Wood Haven Technology Park,
and to amend a portion (43.72 acres) of the Wood Haven Technology Park
Master Plan, located in the 7800 and 7900 blocks of Wood Haven Road,
including 7875 Wood Haven Road (in the Catawba Magisterial District) (Tax map
nos: 037.05-01-30.00-0000 and 026.17-01-03.00-0000), is approved.
2. The Board finds that the proposed rezoning request and amendment to the
Wood Haven Technology Park Master Plan is consistent with the purpose and
intent of the County's Comprehensive Plan and good zoning practice, and will not
be a substantial detriment to the community.
3. This ordinance shall be in full force and effect thirty (30) days after its final
passage. The Zoning Administrator is directed to amend the zoning district map
to reflect the change in zoning classification authorized by this ordinance.

On motion of Supervisor Hooker to adopt the ordinance, seconded by Supervisor
Peters and carried by the following recorded vote:

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Mahoney stated last week the Board received a report from
our Economic Development Department and there was some good news. Roanoke
County is going to be partnering with the Roanoke Regional Partnership for a $100,000
grant from GoVA for a Roanoke Regional recovery. He thinks that is a very positive
step for Roanoke County to try to work with our local business community and
partnering with the Regional Partnership for this new initiative. Again, it is consistent
with what our Board has been trying to do, particularly during these difficult times with
the Coronavirus. Hopefully, we can keep doing positive things like this for our business
community.
Supervisor Hooker recognized Memorial Day and hoped everyone had an
enjoyable Memorial Day weekend remembering those who gave the ultimate sacrifice
for our freedom and we should continue to remember the great sacrifice and honor our
fallen heroes because freedom is not free. Secondly, she offered a special
congratulations to our Roanoke County Schools graduating 2020 seniors. To say this
has been a difficult year is quite the understatement. The traditions of spring sports,
last games, proms, senior day, Baccalaureate, our traditional pomp and circumstance
for graduation just were not possible this year because of the once in a century,
worldwide pandemic, COVID19. She is proud of the way out community has stepped
up in meaningful ways to honor this class of students. It is reminder of life and how
difficult times can offer opportunities to demonstrate strength and creativity.
Perspective makes all the difference. Again, congratulations to the very special class of
2020.
Supervisor Peters stated on Thursday, May 28, at approximately 9:00
a.m., Roanoke County's Emergency Communications Center will test the RoCo Alert
emergency notification system. The RoCo alert works like a "reverse 911" and allows
the County call every household telephone number in the 9-1-1 Center database in the
event of an emergency. Each year, the County tests the system to insure procedures,
processes and staff training are up-to-date. To help eliminate any confusions that may
occur when the system is tested, the public is notified in advance about this upcoming
test. This Thursday, this test will take place and it will be notifying the citizens of East
Roanoke County and that will include Vinton and the Mt. Pleasant areas. Hopefully,
there won't be one following that about more flooding, but everybody be safe out there.
Supervisor Radford stated he also want to recognize Memorial Day that
we just had yesterday for the servicemen and women that gave the ultimate sacrifice for

our freedom. Supervisor Hooker is correct, freedom is not free. It is very special for the
Radford family. He lost an uncle that he never got to meet. He was 21 years old and
was killed on the island of Guam in a Japanese attack early in the morning. He learns
something about him every year. There was letter that was just passed from family
members and it finally made our way. It was a service person telling us how his uncle
Waverly fought that day and the injuries that he finally succumbed to. More importantly,
before he left his home in West Virginia at the time, he told my grandfather and
grandmother that no matter what happens, if he does not make it back, get the family
out of West Virginia. They were in the coal fields and the oldest brother did not want his
brothers and sisters to grow up in the coal fields of West Virginia. So, it was that more
remarkable foresight he had to tell our family to move and his grandmother and
grandfather honored that request and they moved to Roanoke, Virginia and of course
his dad met his mom and he is glad they met because here he is. So thankful for all the
people that have sacrificed. It was a special day and especially unusual because we
could not be in large crowds so we had to do our own thing, but still a special day.
Blessings to all those families that have family members that have been lost in wars.
