Good afternoon and welcome to our meeting for July 27, 2004. Regular meetings are
held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are
held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule
will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursdays at 7:00 p.m. and on Saturdays at 4:00 p.m. The meetings
are now closed-captioned. Individuals who require assistance or special arrangements
to participate in or attend Board of Supervisors meetings should contact the Clerk to the.

Commission Public hearing to receive public comments on a proposal to
adopt a revised Community (Comprehensive) Plan for Roanoke County,
Virginia. The proposed Community Plan is comprised of both text and maps.
Once recommended by the Planning Commission and adopted by the Board
of Supervisors, the plan will serve as a general guide for long-range use and
development of all land within Roanoke County. The proposed plan has been
prepared in accordance with guidelines contained in Sections 15.2-2223 and
2224 of the Code of Virginia, and Section 30-8-1 of the Roanoke County
Zoning Ordinance.
3. Second reading of an ordinance to rezone a 1.3 acre and a 97 acre tract of

SUMMARY OF INFORMATION:
This time has been set aside to recognize the Department of Economic Development for
being designated as an Accredited Economic Development Organization (AEDO) by the
International Economic Development Council (IEDC). There are currently only 25 other
organizations with AEDO status. In addition, Roanoke County's Department of Economic
Development joins the City of Roanoke's Department of Economic Development and the
Roanoke Valley Economic Development Partnership who have also achieved AEDO status
leading to the creation of the first fully-accredited region in the nation.
The International Economic Development Council's Accredited Economic Development
Organization Program recognizes the professional excellence of economic development
organizations throughout North America through a process of critical evaluation and peer
mentoring by certified professionals regarding internal and external operations.
The initial accreditation period is for three years, after which it will be necessary for the
Department to seek re-accreditation. Re-accreditation will also be for a period of three
years, as will successive periods of re-accreditation.
The accreditation evaluation process consisted of two phases after which a written report
of findings was filed and the determination made. The two phases were:
Þ- Documentation Review. This part of the process helped determine eligibility for
accreditation and consisted of documentation relevant to the mission, goals and activities

of the Department. This documentation was assembled in three binders and sent to the
IEDC.
~ Site Visit. This phase of the process was designed to assess the Department in action.
The site visit team was comprised of economic development professionals who had at least
ten years experience in the economic development profession or were Certified Economic
Developers. The criteria evaluated included internal environment, leadership, external
environment, and financial resources. A community tour was also taken.

SUMMARY OF INFORMATION:
This memorandum of understanding sets up the framework for the transfer of
approximately ten acres of land adjacent to the School Board administrative offices to the
County Board of Supervisors for the location of the new Public Safety
Building/Communications Center. This memorandum does not actually transfer land as the
exact parcel will have to be platted and subdivided based on the final development plans of
the selected development proposal prior to a formal land transfer.
At their meeting on July 15, 2004, the School Board authorized the execution of this
memorandum of understanding.
FISCAL IMPACT:
There is no cash transfer in the proposed agreement. The County will be responsible for
the provision of replacement warehouses and will agree to work with the School Board to
find funding in future budgets to renovate the existing Public Safety Building back into a
facility for use by the School Board.

Staff recommends approval of the memorandum of understanding.
Memorandum of Understanding
The purpose of this Memorandum of Understanding between the Roanoke COWlty Board
of Supervisors (Board of Supervisors) and the Roanoke COWlty School Board (School
Board) is to signify the intent of the School Board to cooperate in the provision of a site
for a Public Safety Building in exchange for the current Roanoke COWlty Public Safety
Building and the construction of a new warehouse adjacent to the School Board
Administrative Offices on Cove Road. This memorandum is intended to establtslí the
framework of future legal agreements to be executed between Board of Supervisors and
the School Board.
The parties agree to proceed with the following;
1) The School Board agrees to transfer the ownership of no more than ten (10) acres of
property at the site of the current School Board Administrative Offices, 5937 Cove Road,
to the Roanoke County Board of Supervisors for the purposes of construction of a Public
Safety Building of approximately 80,000 square feet. The exact metes and bounds of the
acreage will be detennined by future surveys and site plans and will be the subject of a
future agreement and fonnalland transfer.
2) As soon as practical following the occupancy of the new Public Safety Building at the
Cove Road location by the County, the Board of Supervisors agrees to transfer ownership
of the current Public Safety Building and site located at 5368 Peters Creek Road to the
School Board. The Board of Supervisors furthennore agrees to pursue funds in future
budgets for renovation of the current Public Safety Building back to a school building.
3) The Roanoke COWlty Board of Supervisors agrees to grade an earthen pad on the
School Board's property on Cove Road for the School Board to use for the replacement
of the warehouses that will be demolished as part of the site preparation for the proposed
Public Safety Building and to construct replacement warehouses. The exact location and
design of the replacement warehouses will be detennined mutually by the Board of
Supervisors and the School Board.
4) The School Board agrees to transfer ownership of the current Roanoke County Career
Center, located at 100 Highland Road, Vinton, to the Board of Supervisors if and when
the facility is no longer needed by the School Board.

SUMMARY OF INFORMATION:
The first reading on these ordinances is accomplished by adoption of these ordinances in
the man ner of consent agenda items. The adoption of these items does not imply approval
of the substantive content of the requested zoning actions; rather, approval satisfies the
procedural requirements of the County Charter and schedules the required public hearing
and second reading of these ordinances. The second reading and public hearing on these
ordinances is scheduled for Auqust 24. 2004.

The Planning Commission will study rezoning and special use permit requests to determine the need and
justification for the change in terms of public health, safety, and general welfare. Please answer the
following questions as thoroughly as possible. Use additional space if necessary.
Please explain how the request furthers the purposes of the Zoning Ordinance (Section 30-3) as
well as the purpose found at the beginning of the applicable zoning district classification in the
Zoning Ordinance.
The purpose of the C-2 District is to provide for a variety of commercial and service-related activities
within the urban service area serving the community. The car wash facility, at this location, would provide
a service to the residents in the area. The C-2 District provides for general commercial uses.

The Planning Commission will study rezoning and special use permit requests to determine the need and
justification for the change in terms of public health, safety, and general welfare. Please answer the
following questions as thoroughly as possible. Use additional space if necessary.
Please explain how the request furthers the purposes of the Zoning Ordinance (Section 30-3) as
well as the purpose found at the beginning of the applicable zoning district classification in the
Zoning Ordinance. .
The property is presently zoned R-1 (036.19-01-12.01) and C2C (036.19-01-40). The proposed rezoning
to R-4, with proffers, would allow for the development of twenty-one (21) townhouses on the parcel of
land. The R-4 District is to provide for high-density development within the urban service area with
between twelve (12) and twenty-four (24) units per acre. The proposal for twenty-one (21) townhouses
within this parcel of land will fall within that criterion. As stated in the purposes of the R-4, the proposal
would serve as a buffer between less intensive (single-family residential) and more intensive (commercial)
uses. The proposal will provide for the development of twenty-one (21) units within five (5) clusters,
ranging in size from two (2) to five (5) units.
Please explain how the project conforms to the general guidelines and policies contained in the
Roanoke County Community Plan.
The property, as designated in the Community Plan, falls along the border of transition and neighborhood
conservation. Neighborhood conservation allows for attached housing at reasonable density that is not
significantly higher than the existing neighborhood. This. coupled with the buffer provisions, makes this a
reasonable use. A significant portion of the property remains undisturbed. Transition district provides for
single-family attached residential with not more than six (6) units per acre. The proposal falls within that.
criterion and, thus. is an appropriate use.
Please describe the irnpact(s) of the request on the property itself, the adjoining properties, and
the surrounding area, as well as the impacts on public services and facilities, including
waterlsewer, roads, schools, parks/recreation and fire and rescue.
Public utilities are available within the immediate area and no significant burden will be placed upon the

The provisions of the R-1 District allow for major utility service facilities. The stormwater facility proposed
for this property has been determined to be a major utility facility by the County. The stormwater
detention pond will replace the existing stormwater detention pond on the adjoining tract of Pinkerton
Properties, LL.C. The relocation of the pond will decrease the rate of flow and volume of water traveling
across certain properties within Montclair Estates and, therefore, will be a benefit to the residential
development. Additionally, the stormwater detention will be re-routed away from the existing discharge
point and will benefit a number of residential lots. Such does not constitute diversion, as the run-off will
reach the same out fall point for the overall drainage area.
Please explain how the project conforms to the general guidelines and policies contained in the
Roanoke County Community Plan.
The proposed use will be in furtherance of the Community Plan in that it will provide for improved
stormwater run-off for residential as well as commercial properties, consolidating stormwater
management for an area into one pond. The Applicant will be responsible for continued maintenance of
the stormwater detention pond in conjunction with its ownership of the properties along Route 419. The
development will be an improvement to the overall stormwater management system within the area and
will provide the opportunity for better utilization of the commercial properties along Route 419.
Please describe the impact(s) of the request on the property itself, the adjoining properties, and
the surrounding area, as well as the impacts on public services and facilities, including
water/sewer, roads, schools, parks/recreation and fire and rescue.

The CODcept plan should not be confused with the site plan or plot plan that is required prior to the issuance f a building

RE: Special Use Pennit application - RN322 Peters Creek telecommunications facility
Dear Mr. Holladay:
Please accept the attached application for special use permit by Virginia PCS Alliance,
LC. (dba "NTELOS") for a new telecommunications facility located at the Hollins
Rescue Station #5, 7401 Barrens Road, Roanoke (tax parcel 27.13-04-01.00-000) on
property owned by the Board of SupeI:Visors of the County of Roanoke, Virginia. The
parcel contains 2.51 acres and is zoned C2. NTELOS is requesting approval to construct
a 199 foot monopole and a telecommunications facility compound. Currently, there is an
existing 100 foot monopole located on the property and used by Roanoke County. If
approved, NTELOS will remove the existing monopole and relocate the Roanoke County
communications equipment ITom the existing monopole and from the building to the new
monopole and within the compound. T Mobile has also committed to NTELOS to
collocate on the new monopole and within the compound.
Below are explanations addressing the provisions outlined in the Roanoke County Zoning
Ordinance as well as the Pre-Application Checklist.
The following are Application Standards set forth in Section 30-87 -2 (C)2 of the Zoning
Ordinance:
A & B) The search ring objective for NTELOS is to provide fill-in coverage
along Rt. 117 (peters Creek Rd.), south of the intersection of Rt. 11 (Williamson
Rd.) and Peters Creek Rd. The sites considered and rejected by NTELOS
included collocating on the existing Hollins Rescue Station monopole which was
not structurally capable of the additional loading and did not meet height
requirements. Other sites rejected included a new monopole at the First Team
Auto Mall property, the Gary L. Johns property (027.10-07-04.00-0000) which is
a small vacant lot behind the old Pizza Den, and the industrial area along Hitech
Rd. All these sites would meet our coverage objectives at the proposed height of
199 feet; however, NTELOS took into consideration the County's goal of

reducing the number of tower sites and decided to work with Roanoke County at
the Hollins Rescue Station to replace the existing 100 foot monopole with a new
monopole. Thereby benefiting the County's communications network, as well as
allowing the collocation possibility to other interested carriers. NTELOS also
contacted the Roanoke Regional Airport regarding the possibility of collocating
antennas on its new radio control tower, but they were not interested in working
with telecommunications carriers.
C) Attached are photo simulations of the proposed monopole. Photos were taken
from Oakley's Funeral Home property and across from First Team Auto Mall.
The proposed monopole site location will not require any new or modified road,
access or utility coITidor from BaITens Rd. The monopole will be accessed by the
existing parking lot used by the Rescue Station.
D) Attached is a computerized terrain analysis showing the visibility of the
proposed tower at the requested height and location. No additional road, access
or utility conidors are proposed.
E) The proposed site will provide coverage along Rt. 117 (Peters Creek Rd.)
from the intersection ofRt. 117 and Rt. 11 (Williamson Rd.) south to Interstate
581 and to the Roanoke Regional Airport. This site is sandwiched between the
NTELOS site at Tinker Mountain to the north, its AEP collocation site on
Interstate 81 to the south and the Friendship Manor Retirement Home rooftop
collocation to the southeast. NTELOS currently has ninety-seven (97) sites
within its Roanoke Market (from Wytheville to Lexington) including twenty-nine
(29) sites in Roanoke County and Roanoke City.
F) NTELOS and T Mobile will conduct on-site balloon tests prior to the planning
commission and board of supervisor hearings on the special use pennit on dates
provided by Roanoke County Zoning.
G) Attached is the FAA detennination in which the proposed site received a
determination of "No Hazard to Air Navigation" and will not require marking or
lighting.
The following are General Standards requirements set forth in Section 30-87-2 (D) of
the Zoning Ordinance:
1. The maximum heiwt of the proposed monopole and antenna shall not exceed
199 ft. in height. Propagation maps showing coverage intervals of 25 ft are
included for NTELOS and T Mobile. The 195 ft. antenna rad center for NTELOS
and 185 ft. antenna rad center for T Mobile clearly show the needed height to
provide adequate coverage. Roanoke County will be moving their
communications equipment from the existing monopole to the 165-175 ft and
145-155 ft levels on the new monopole thus increasing their height. The County
requires the proposed monopole must accommodate an additional 3

carriers/vendors besides the applicant. Additional carrier/vendor collocation
opportunities at the proposed site will be available.
2. & 3. The monopole site compound meets the fifty (50) foot front yard setback
along Barrens Rd. and the twenty five (25) foot setback along all other property
lines. The proposed monopole is more than the 40% (79.6 ft.) of the height of the
monopole away from the nearest residence on the adjoining lot to the NW of the
rescue station property.
4. The existing monopole on the property is to be dismantled and removed per
the County's request.
5. A determination of "No Hazard to- Air Navigation" was received £rom the
FAA and is attached. No marking or lighting is required.
6. The detennination received £rom the FAA has been routed through local
regional offices of the FAA prior to issuing the "No Hazard" determination.
7. The proposed site does not lie within the airport overlay or emergency
communications overlay districts.
8. The monopole will be designed to accommodate at least three (3) other
carriers/vendors in addition to the applicant. Attached is a Letter of Intent from T
Mobile to collocate at the 185 ft. level and Roanoke County will be located on
this tower at the 145-155 ft. and 165-175 ft. levels. Additional lease/collocation
opportunities are available.
9. The proposed site will be a monopole design.
10. A Phase I Environmental Site Assessment and NEPA Checklist has been
completed on the proposed site. A copy of the reports may be submitted,if
needed.
11. In the event ofterminationlabandonment of the proposed site, NTELOS
agrees to remove the monopole and facilities from the property. However, in the
event ofterminationlabandonment by NTELOS, the proposed lease between
Roanoke County and NTELOS allows for the purchase of the monopole site by
the County. NTELOS requests that if the Special Use Permit is approved, the
permit be transferable.
12. The proposed monopole shall be flat matte finished galvanized steel. The
compound will be fenced and landscaped.
13. No business signs will be located on the property except those required by
the FCC to properly identify the tower owner and those signs to identify
individual carrier equipment.

In conclusion, NTELOS feels the approval of a special use permit for a new monopole
telecommunications facility at this location not only demonstrates the willingness of
cairiers to work together on collocation opportunities, but also allows for improvement to
the Roanoke County communication system by increasing their opportunities for future
growth by moving its equipment from the existing monopole and building roof to the new
monopole location. The County will also receive revenue from the proposed site.
Although a new monopole is proposed, NTELOS will remove the existing monopole
from the property allowing for an even exchange for the number of tower sites in the
vicinity, while creating collocation opportunities for other carriers. NTELOS has proven
that it makes its best effort to find collocation opportunities. Of the twenty-nine (29)
NTELOS telecommunications sites in Roanoke County and Roanoke City, only one (1)
tower is owned by NTELOS. We have demonstrated a history of choosing collocation
sites over building new sites if available - 5 rooftops, 8 transmission tower collocations,
1 billboard, 3 water tanks and 11 collocations on other carrier/vendors towers. The site
will be served by the existing parking lot of the rescue station and will be served by
utilities at Barrens Road. There were no other available structures within the vicinity of
suitable height, design and location to provide NTELDS or T Mobile needed service in
this area. The Peters Creek Road corridor has been developed largely by commercial
activity keeping the proposed site consistent with the commercial and service related
development already occurring in this area.

Dear David,
On behalf of Star City Comics and Games Inc., please accept our attached application for a
Special Use Permit (SUP). Per our previous conversations and your subsequent
determination, we are requesting a SUP for a commercial indoor amusement land use at
5728 Williamson Road.. Four tax. parcels are a part of this request. All are zoned C-2
Commercial.
Our letter to you dated June 16, 2004 provided detailed information on the nature and scale
of our current and proposed business. I have attached a copy of this letter to our application
for the review of the Planning Commission and Board of Supervisors. As requested on the
application, I have also provided detailed information on the relationship of our proposed
land use to the county zoning ordinance, community plan, and surrounding land uses. This
information is presented below.
1. Please explain how the request {ùrthers the purposes of the Zoning Ordinance
(Section 30-3) as well as the purpose found at the beginning of the applicable zoning
district classification in the Zoning Ordinance.
The proposed use will be located in a C-2 zoning district in an existing building now
being used as a retail furniture store and warehouse. This portion of Williamson Road is
developed with a wide variety of retail and business activities. Our request furthers the
purposes contained in Section 30-3 of the zoning ordinance in the following ways:
. Our proposed location is on a primary highway, and generates very little
weekday traffic. The traffic associated with our business will not occur
during weekday AM and PM peak hours. Truck traffic associated with
our business will also be considerably less than that generated by the
furniture store.

- Weare currently located on Williamson Road, and wish to remain in the
county. Our reuse of an existing building in a commercial area preserves
vacant and undeveloped land within the county, and will not require the
expansion of existing public services. Services currently available to us at
our CUlTent location and available to the furniture store (police,
fire/rescue, utilities etc,) will be used by us at our new location.
. The employment we now provide, and the taxes we currently contribute,
will continue to benefit the county's economic development base.
The purpose of the C-2 district, as stated in Section 30-54.1 of the zoning ordinance is to
pennit a wide variety of retail and service related activities. Our use of a parcel
cun-ently zoned C-2 is consistent with this purpose.
2. please explain how the lJroiect conforms to the general guidelines and policies
contained in the Roanoke County Community Plan.
The future land use map contained in the 1998 Community Plan designates this portion
of Williamson Road for "Core" development. High intensity urban development is
encouraged in Core areas, as are highway oriented commercial uses. Our proposed use
is consistent with recommended land use types and detenninants for Core areas.
3. Please describe the imvact(s) of the request on the property itself. the ad;oining
properties. and the surroundinf! area. as well as the impacts on public services and
facilities. including water/sewer. roads. schools. varlcs/recreation and fire and rescue.
Our intent is to reuse the existing building and the twenty-one space parking area on the
site. We do not envision any building expansions at this time. The interior of the
building will be upgraded to meet our business needs and to comply with any applicable
building code requiIements. Tax parcel 38.10- 6- 20 is cun-ently undeveloped, but could
be developed for additional parking if requITed to meet the future demands of our
customers. We will not have any outdoor storage of materials or products.
Our proposed use of this property will not have a negative land use impact on
Williamson Road or the surrounding area. Land uses along Williamson Road are
cUlTently a mixture of high intensity retail, commercial service and office uses. Specific
uses in the area include a used car lot, a bowling alley, convenience stores, fast food
restaurants and a large flea market. Our site is adjacent to a small strip commercial
shopping and office center (to the south), and a truck accessory business (to the north).
Parcels across Williamson Road are zoned C-2 and are currently vacant. The rear of our
proposed site is adjacent to an unimproved right-of-way (alley) and R-l zoned
properties within the Boxley Hills Subdivision. A privacy fence and dense vegetation
currently screen the site from these R-I areas.
Finally, our proposed use will have no impact on public services such as schools and
parks and recreation. The site is currently served by public water and sewer, and is

located within existing police and fire and rescue service areas. Our proposed use will
not place unusually or heavy demands on these utility) or public safety services.
I hope this information has help to further clarify the nature of our request and its
conformance with comprehensive plan guidelines and zoning ordinance requirements.

What is the Star City Game Center?
The Star City Game Center is owned and operated by Star City Comics & Games, Inc., a
Roanoke, Virginia based corporation. Star City Comics & Games, Inc. is considered to be
a world leader in sales of Collectable Card Games (CCGs). Some examples of CCGs

Each of the aforementioned manufacturers has created multi-million dollar organized play
(OP) programs in order to drive sales of their games at the retail level.
What do we do?
The Star City Game Center generates approximately 90% of its income through mail order
sales of the aforementioned games. The remaining 10% is generated through retail sales
and manufacturer-sanctioned tournaments (as an accessory to those retail sales) at its
physical location. An example of one such tournament is the JSS (Junior Super Series)
qualifier; an event which we host 2-4 times per year. These qualifier tournaments are only
open to children under the age of fifteen years old and award a $1,000 college scholarship
(provided by the game manufacturer) to the winner. The winner also qualifies for the JSS
Championship; an annual tournament which awards $100,000 in college scholarships
amongst its top finishers.
Why do we need more space?
Despite the fact that 90% of our revenue is derived fÌom mail order sales, in-store
tournaments generally have to accommodate dozens to hundreds of players. This requires
plenty of seating, along with ample space for players to safely move about. Below, I have
provided a more detailed explanation.
Our current 5.500 sq. ft. location at 5623 Williamson Rd N.W.
3,100 sq. ft. (upstairs) - retail sales and manufacturer-sanctioned tournaments
2,400 sq. ft. (downstairs) - mail order sales
Our new 24.000 sq. ft. location at 5728 Williamson Rd. N.W.
9,000 sq. ft. - retail sales and manufacturer-sanctioned tournaments
As we discussed, our current space is too small to accommodate many of the larger
events/tournaments that we have the opportunity to run. Although we still run many
smaller local events/tournaments at our existing location, we are often forced to host the
larger events/tournaments in cities such as Greensboro, NC or Richmond, VA. This costs
us money, since many participants often purchase other merchandise while visiting our
Game Center. It also costs other local businesses money, particularly the numerous fast
food restaurants, pizza delivery businesses and "7-11" type convenient stores scattered
along Williamson Road.
Since the majority of our Collectable Card Game business is done on the weekends, having
this additional space will also allow us to set aside weeknights to accommodate bingo

activities, something we have been licensed to do for years. On these nights, we will
simply be leasing a portion of our space to local organizations/charities so that they have a
site from which to run their fundraisers. The fundraisers themselves will be run entirely by
the licensed organizations/charities and our only income will be generated from renting
them a portion of our space in which to do so.
5,000 sq. ft. - mail order sales
As you saw, we have become quite cramped in our current warehouse/office and need the
increased space in order to accommodate our continued growth in this segment of our
business
10,000 sq. ft. - warehouse space for rent
This is an attached, but basically independent, warehouse at the back end of the building.
We plan on renting this space, preferably to a company that compliments our existing
business. Current prospects include authorized distributors (those who supply businesses
like ours with the games that we stock, but don't sell direct to the public) and smaller game
manufacturers. Nothing has yet been confirmed.

following street location for a "Watch for Children" sign,

SUMMARY OF INFORMATION:
Residents along Starmount Avenue, specifically the section between Barrens Road and
Alpine Road, have submitted a petition to the County staff requesting that a "Watch for
Children" sign be installed at each end of their street (see attached photo). The road does
meet criteria set forth in the County's "Watch for Children" sign policy, such as: this section
of Starmount Avenue is classified as Urban Local, the road length is approximately 1,200-ft,
and the traffic count is approximately 250 vehicles per day; all qualifying facts.
There are 21 homes along this section of Starmount Avenue and under the County's policy,
the submitted petition must include 75% of the property owners along said street. The
residents submitted 14 signatures, or 67% of the property owners. While the number of
submitted signatures is 2 short of the County's policy, the residents have made a concerted
effort to obtain signatures and determine if there were any objections to the sign
installation. To this date, the main point of contact, Ms. Dru Chocklett, has not received
any notification of opposition or disapproval of the sign installation. Of importance is the
fact that the submitted petition does include the signatures of those property owners
adjacent to the proposed sign location.

FISCAL IMPACT:
There is no fiscal impact to the County. The residents along said street have agreed to pay
100% of the necessary amount for purchase and installation of the sign.
ALTERNATIVES:
1. Approve the request and forward the resolution to the Virginia Department of

sign; final determination and installation of the signs based on Virginia Department of
Transportation's approval.
2. Do not approve the request.

THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, IN REGULAR MEETING
ON THE 27th DAY OF JULY 2004, ADOPTED THE FOLLOWING:
RESOLUTION TO THE TRANSPORTATION COMMISSIONER
WHEREAS, the General Assembly enacted an amendment to the Code of Virginia,
adding Section 33.1-210.2 regarding the installation and maintenance of signs alerting
motorists that children may be at play nearby, and
WHEREAS, the Board of Supervisors along with the Virginia Department of
Transportation staff institute a local policy, and
WHEREAS, a petition has been received that meets both Roanoke County and the
Virginia Department of Transportation guidelines, and
WHEREAS, the property owners along Starmount Avenue (between Barrens Road
and Alpine Road) have agreed to fund the installation of the sign, and
NOW, THEREFORE, BE IT RESOLVED, this Board requests the following street
location to be reviewed for a "Watch for Children"sign, pursuant to Section 33.1-210.2,
Code of Virginia:
Sign location: Intersection of Starmount Avenue and Barrens Road and the
intersection of Starmount Avenue and Alpine Road.

SUMMARY OF INFORMATION:
The Roanoke County Department of Social Services receives, throughout the year,
additional appropriations for public assistance and services delivery. The state has made
available $27,177 in federal funds for the Child Day Care Quality Initiative Grant. The
Department of Social Services cannot access these funds until the County has
appropriated the same.
The Board of Supervisors is requested to appropriate $27,177 to the 2004-2005 Social
Services budget, line 60-51000, and to appropriate the same revenues from the state.
This is the seventh year the department has received this grant.
FISCAL IMPACT:
There is no fiscal impact; 100% federal and state reimbursement funds
ALTERNATIVES:
1. Approve the acceptance of $27,177 for the Child Day Care Quality Initiative Grant

SUMMARY OF INFORMATION:
On June 22, 2004, the Board of Supervisors authorized the County to participate in the
Virginia Juvenile Community Crime Control Act (VJCCCA) program for FY 2004-05,
appropriated funding in the amount of $276,170, and authorized staffing of the grant
program for the fiscal year.
The City of Salem has requested to participate in the Life Skills Mentoring Program, which
is the major program operated by the Court Services Unit of the Juvenile Court utilizing
V JCCCA grant and related monies, and has approved their resolution to the Department of
Juvenile Justice requesting that their VJCCCA monies be used in that manner. This work
load can be assumed by the staff of the Life Skills Mentoring Program, and the additional
case load will be funded through Salem's grant funds.
The Department of Juvenile Justice has requested that a revised resolution be adopted
recognizing that the City of Salem's grant monies will be used to support the Life Skills
Mentoring Program. As operator of this program, the County of Roanoke will oversee the
fiscal responsibilities of the grant.

FISCAL IMPACT:
There is no fiscal impact. The Board of Supervisors has already appropriated County
monies for the grant.
STAFF RECOMMENDATION:
Staff recommends approval of the attached resolution which will allow the Life Skills
Mentoring Program to be administered by the County's Court Service Unit, utilizing the
VJCCCA funds from both the City of Salem and County of Roanoke, to serve the youth
from both jurisdictions.

WHEREAS, the County of Roanoke has participated in the Virginia Juvenile
Community Crime Control Act (VJCCCA) program in the past allowing the Court Service
Unit to provide direct services, treatment programs, substance abuse services and
probation activities associated with the Juvenile Court, and
WHEREAS, through the Life Skills Mentoring Program of our Court Services
Unit, the grant funds have been administered to assist the court by providing counseling
services, drug screens, intensive supervision, community service, restitution and other
needed services, and
WHEREAS, the Court Services Unit of the Juvenile Court serves the youth of
both the County of Roanoke and the City of Salem, and
WHEREAS, the Court Services Unit desires to provide services through the Life
Skills Mentoring Program to serve the youth of both the County of Roanoke and the City
of Salem utilizing the funding from the VJCCCA grant and other appropriate funds.
Now, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County will participate in the Virginia Juvenile Community Crime Control Act
for Fiscal Year 2004-05 and will accept said funds, appropriating them for the purpose
set forth in this Act until it notifies the Department of Juvenile Justice, in writing, that it
no longer wishes to participate in the program.

Be it further resolved that the County Administrator or the Assistant County
Administrator is hereby authorized to execute a local plan on behalf of the County of
Roanoke and City of Salem, and
Be it further resolved that the County of Roanoke will combine services and grant
resources with the City of Salem, and the County, as operator of the Life Skills
Mentoring Program, will serve as fiscal agent for these localities.

DECLARING SEPTEMBER 27, 2004, AS
FAMILY DAY - A DAY TO EAT DINNER WITH YOUR CHILDREN
IN THE COUNTY OF ROANOKE
WHEREAS, the use of illegal drugs and the abuse of alcohol and nicotine
constitute the greatest threats to the well-being of America's
children; and
WHEREAS, surveys have found that children and teenagers who routinely eat
dinner with their families are less likely to use illegal drugs, alcohol
and cigarettes; and
WHEREAS, these surveys found that teenagers who rarely eat dinner with their
families are 72 percent more likely than the average teenager to use
illegal drugs, alcohol and cigarettes; and
WHEREAS, teenagers who almost always eat dinner with their families are 31
percent less likely than the average teenager to use illegal drugs,
alcohol and cigarettes; and
WHEREAS, the correlation between family dinners and reduced risk for teen
substance abuse are well documented, and parental. influence is
known as one of the most crucial factors in determining the
likelihood of substance abuse by teenagers; and
WHEREAS, Family Day, which was established in 2001 by the National Center on
Addiction and Substance Abuse at Columbia University and is
celebrated on the fourth Monday of September, emphasizes the
importance of regular family activities in parent-child communication
and encourages Americans to make family dinners a regular feature
of their lives.
NOW THEREFORE, I, Richard C. Flora, Chairman of the Board of Supervisors of
Roanoke County, Virginia, do hereby proclaim and recognize
September 27,2004, as FAMILY DAY - A DAY TO EAT DINNER WITH
YOUR CHILDREN in the County of Roanoke; and
FURTHER urge all citizens to observe Family Day by making family dinners a
regular part of their children's lives.

SUMMARY OF INFORMATION:
This time has been set aside to recognize senior citizens for their contributions to the
community. This is the 19th year of the Hall of Fame awards, and the eighth time that the
awards have been presented at a Board of Supervisors meeting. The Board members
have been given information about the presentation and recipients. The many contributions
of these volunteers are always impressive, and we are grateful for their work in Roanoke
County.
The Hall of Fame was established to give recognition to Roanoke County residents, who
are 60 years of age or older, for their volunteer efforts that have improved the quality of life
in our community. A Special Award Category was also established to recognize one
community-minded business, agency or organization that operates for profit, non-profit or
on a volunteer basis. This nominee must provide a service to the senior citizen population
or have as a statement of purpose, the inclusion of community betterment in some form.
The ceremony is coordinated by the Parks, Recreation & Tourism Department, under the
direction of Myra Sellers. Following the awards ceremony, there will be a reception on the
fourth floor of the Administration Center honoring this year's award recipients.

Senior Citizens Hall of Fame Awards
The 18th annual Roanoke County Senior Citizens Hall of Fame will be held on
July 27, 2004 following the Board of Supervisors meeting. There will be three
awards presented in the individual category, two of which are for groups that
have done significant work at Camp Roanoke. There were no nominations for
the special category.
There will be a reception on the 4th floor of the Administration Center after the
awards presentations to recognize the following individuals:
Judith Ashcraft
Judith has devoted her life in service to others. As an educator, she was named
"A Child Advocate of Virginia" by Governor Charles Robb for her tireless work on
behalf of children with learning disabilities. In 1978, Ms. Ashcraft was named
"Mother of the Year Professional".
She has dedicated the same energy in her work to benefit the low-income,
uninsured population. As a volunteer for the Bradley Free Clinic, Ms. Ashcraft
has contributed many hours creating awareness of and raising funds to support
the Clinic. Each week, she volunteers at the Clinic in a staff support role more
than any other administrative volunteer.
Recently, a Free Clinic diabetic patient was diagnosed with advanced Charcot
joint disease in the left foot and early Charcot disease in the right foot which
rendered him unable to walk without severe pain. A doctor at the Clinic ordered
orthopedic diabetic shoes and custom made orthodics which the patient could
not afford. Upon learning of this patient's circumstances, Ms. Ashcraft made
arrangements to have the patient fitted and donated the cost for the equipment.
Nearly 40 % of the uninsured have no regular source of health care, and,
coupled with the fear of high medical bills, many may delay or forego needed
care. These decisions can lead to more serious illness and avoidable health
problems. The Bradley Free Clinic provides free access to free healthcare
services for low-income, uninsured families in the Roanoke Valley to give
patients better health outcomes and avoid medical bad debt.
The Bradley Free Clinic provides $3.2 million annually in value of services and
relies heavily on individual donations as they receive no federal funding. Without
volunteers like Judith, the Clinic would be hard pressed to do as much as they do
to make Roanoke Valley a healthier community and help maintain a healthy
workforce.

Phillip Boqqs
Phillip retired from the JC Penney Company just as the Rescue Mission began
planning its new Thrift Store. Phil spent countless hours meeting with the
Mission staff and volunteers to draw and layout the new store. Phil begged and
borrowed (the Mission had to draw the line at stealing) in order to put together a
thrift store that could compete with retail stores in the local malls. Due to his
connections, vision, marketing ability and experience, he was able to recycle
racks, dump tables, cash registers, etc. to get the store ready for opening day.
He accomplished this task working with a volunteer crew as they worked in and
around the construction crew who were also trying to finish on time.
After the building was completed, Phil recruited and led a dynamite crew of
volunteers to set up the new store in a department store style, taking the Thrift
Store to a new level in our community. As the Thrift Store continues to grow and
expand, Phil has been there on a daily basis to help set up systems for
distribution, loading, pick-up and deliveries. He has been involved in helping to
market the store to potential donors. He has developed systems to recruit and
maintain volunteers as well as make the best use of staff time. He is inspired with
new ideas almost daily to make this operation trim and fit and profitable without
losing its charitable character and mission.
Phil's spirit of volunteerism is contagious. This is evident in the loyal band of
volunteers he leads at the Thrift Store. The Rescue Mission is blessed to have
someone of Phil's caliber in this key leadership volunteer position.
In addition to the Rescue Mission Thrift Store, Phil was the key man for two other
charitable projects: The Discovery Store for the American Cancer Society, and
the Art on a Mission Store at Tanglewood Mall, a store handling art on
consignment from more than 300 local artists to benefit the free clinic at the
Rescue Mission.
During the past year Phil has faced a number of health challenges, but he
continues to think and plan and mentor the staff of the Thrift Store. The staff at
the Rescue Mission is thankful to know and work with this man and his lovely
wife Geneva, who probably deserves an award too. With each project Phil takes
on, Geneva works with him and does so with a smile and a cheerful word for
everyone.
James J. Grimes
James has lived in Roanoke County for 43 years. He was a Scoutmaster of
Troop 236 and District Scout Commissioner. He served twice as a Big Brother
and also served on the Board of Directors of Big Brothers/Big Sisters. He
secured a $24,000 grant from the GE Foundation to provide the first computer
lab in the County for Glen Cove Elementary School.

He initiated the project "Computers for School" in 1993, and has been Project
Leader since its inception. This project procures unwanted PCs from local
businesses, cleans them up, and repairs them as necessary, before placing them
in school systems. Most County schools have been recipients and several
networked labs have also been installed.
From 1993 to 2004 a total of over 5000 computers have been placed in seven
school districts, as well as in most non-profit organizations in the valley.
Under his leadership, the GE Elfun Volunteers provided 120 computers for 10
local schools in 2002. In 2003, 140 computers were provided for 22 non-profit
organizations, 7 of which are devoted to education. Local recipients are: Apple
Ridge Farms, Act /I Friendship House, Veterans Facility, LOA, Turning Point, and
the Rescue Mission. Thirty computers were placed with a laboratory at Oak Hill
Academy in North Carolina.
Mr. Grimes has also served as Project Administrator for the Regional Chamber of
Commerce's "Project 2000 Technology Upgrade Program", which had similar
goals to those of the "Computers for Schools" project.
Since he retired from GE nine years ago, he has also been an Instructor and Site
Chief with TaxAid for the elderly, which helps older Americans with their Income
Tax Forms.
The importance of participation in TaxAid, Boy Scouts, and Big Brothers is well-
known, but Mr. Grimes' initiatives are of particular significance in his efforts to
provide individual computers and to establish computer labs. He and his fellow
GE retirees recognized that the changes in technology in recent years made it
imperative to educate our children in computer technology. They have spared no
effort to make the necessary equipment available to them.
As a result of Mr. Grimes' efforts, literally thousands of children, and adults as
well, have received a better education and have been better equipped to meet
not only the demands of the work force but also those of higher education.
Roanoke Valley Community Band: (Wilbur Grant, Conductor)
The Community Band is a 50 piece Orchestra style band that performs for
retirement and nursing homes and other groups at no charge. They present very
professional performances and have a lot of fun doing so.
It is great to have this level of professional entertainment for the residents of
retirement and nursing homes. Good music can be enjoyed by everyone, no
matter what your physical condition.

The Community Band usually has a patriotic program they perform in the
summer and a Holiday Program they present in December. Professional
performances do not come without practice and this group devotes a lot of time
to practice. The performing comes from the heart and each member takes joy
from giving pleasure to their audiences. It is obvious to the residents of the
homes that the band enjoys what they do.
Sue Hodqe
Sue has given much of her time as a volunteer Director of choirs and choral
groups in the area. She directs the Caroloa Choir and the Simplicity Singers
from the local Mormon Church. They perform all around the Roanoke Valley for
free.
The various choirs she directs perform for many nursing homes, retirement
homes, and other groups. Both choirs are very professional and brighten the
lives of so many people.
Sue is upbeat, vivacious and creative. She helps the performers provide very
entertaining and professional quality shows. The choirs benefit from her
knowledge and her positive attitude. The folks who come to the programs
thoroughly enjoy them and their day is made a little more special. Brandon Oaks
is one of the homes that the Caroloa Choir and the Simplicity Singers visit
several times each year. The residents love and appreciate them very much.
Sue also volunteers at Explore Park doing any number of jobs, for several days a
week.
James (Jim) Deaton
Jim Deaton is always ready to lend a helping hand to Habitat and does so in
many ways. This past year he was the house leader on 3 houses. He helped
build a Habitat Float which was entered in two Christmas parades. He helped
retrofit a new trailer which will be used at work sites to store supplies and tools.
He helped build the base for a Plexiglas house which is situated outside Sears at
Valley View Mall. The house is a donation point for the community to assist
Habitat in sponsoring another house.
Habitat for Humanity in the Roanoke Valley works to improve the lives of God's
families in need by providing affordable quality homes in partnership with
homeowners and volunteers for the enhancement of our community. Habitat
helps rid our community of substandard housing by building decent homes and
communities for those who might not otherwise be able to qualify for a loan to
buy a house.

Through all Jim's volunteer projects, he works closely with the homeowners and
volunteers, including TAP youth, to build a quality home and teach construction
skills they can use in the future. He also makes sure all are conscious of
Habitat's Christian mission in whatever they are doing. Jim not only helps
change the lives of the homeowners but also the lives of the volunteers.
Mike Harvey
On an almost daily basis, Mike Harvey gives time, effort and attention to friends,
family, the elderly and those shut-in or sick. When he hears of those in need of a
visit or help with a task, Mike is there. He will frequently bring flowers in a small
vase and simply leave them on a kitchen or family room table. If Mike learns that
someone is sick in the hospital or at home, he will stop by for a visit and words of
comfort and sometimes will leave a small treat, cookie or snack. When flowers
are left from an event at Raleigh Court Presbyterian Church, Mike arranges them
for the elderly, shut-ins, and friends and has even taken his creations to the
Carillon Breast Care Center and Cancer Center.
Mike also has a passion and talent for flower gardening and has planted literally
hundreds of flowers for elderly friends who otherwise would not have a garden.
He also waters and nurtures each garden throughout the season.
There is a story about a man on a beach littered with many starfish. The man is
picking up the starfish and throwing them back into the ocean before they die. A
young boy sees him and asks him what he is doing. The man replies that he is
trying to save the starfish before the sun comes up and kills them. The boy says
that there are so many that are going to die that what he is doing won't make a
difference. The man replies "It made a difference to that one".

This time has been set aside to present a resolution of appreciation to Donald L. Davis for
his 15 years of public service in the Town of Vinton. Former Mayor Davis was first elected
to the Vinton Town Council in 1986; serving two terms from July 1, 1986, through June 30,
1994. He was then appointed to fill the unexpired term of a deceased Council Member in
1997. Mr. Davis was elected as Mayor of Vinton in 2000 and retired from that office on
June 30, 2004.
Former Mayor Davis was a proponent of regional cooperation and worked with Roanoke
County on various joint projects including the Gain Sharing Agreement, development of the
Vinton Business Center, and viewshed protection for the Blue Ridge Parkway. He also
served on various regional committees as well as taking an active role in the Vinton
Chamber of Commerce, the Vinton Lions Club, and the Vinton Dogwood Festival
Committee.
Former Mayor Davis is expected to be present to receive his resolution.

Public Hearing to receive public comments on a proposal to adopt a revised
Community (Comprehensive) Plan for Roanoke County, Virginia. The proposed
Community Plan is comprised of both text and maps. Once recommended by the
Planning Commission and adopted by the Board of Supervisors, the plan will serve as
a general guide for a long range use and development of all land within Roanoke
County. The proposed plan has been prepared in accordance with guidelines
contained in Sections 15.2-2223 and 2224 of the Code of Virginia, and Section 30-8-1
of the Roanoke County Zoning Ordinance.

CITIZEN COMMENTS
Eight citizens spoke. Concerns were expressed regarding the following: 1) rural
densities should be increased; 2) Section 2232 review should not be required; 3) need
more residential development; 4) need more specific information and more time to
review it; 5) need more citizen participation; 6) transportation section needs to be
more closely linked to growth management section; 7) rural areas need to be
preserved.
In addition, Mr. Bob Flynn spoke representing the Roanoke Regional Home Builders
Association. He expressed concern that the areas projected for growth will not be
areas where land is available for sale or that the land may not be developable. His
organization is concerned with any form of an urban service boundary.

Mr. Chris Lowe presented the petition and explained that each planning commissioner
visited the site. Mr. Lowe explained that the area does not fall under the Blue Ridge
Parkway View shed. Mr. Lowe said he along with Ms. Scheid visited the parkway
overlooks and felt that the homes proposed would not be seen from the parkway
during summer conditions (full foliage) and that he could not say if they would be
visible during the winter. Mr. Lowe explained what Mr. Hardy could do by right with
the current zoning and explained that this is an actual downzoning that would be
reducing the amount of homes that would typically be allowed on this property.

This is a rezoning request from AR & AG-3 to PRD for 97.543 acres, at Whistler Creek Circle &
Applegrove. The majority of the property, approximately 96 acres is zoned AR, Agriculture
Residential and the remaining acreage (approximately 1-1 Yz) is zoned AG-3. The property is
designated as Rural Preserve in the 1998 Roanoke County Community Plan. The petitioner
requests to rezone the entire tract.

Topo~aphvN egetation - The property consists of 90% timbered woodland. The tract was cut
approximately 5 years ago. The topography is generally steep and rolling. Because of the size of
the tract it has a few ridgelines as well as varying degrees of slopes. A stream runs through
approximately 36 acres of the property which is being designated as open space. A floodplain
study may be required during site plan review.
Surrounding Neighborhood - Approximately 50% of the adjoining properties are vacant
woodlands. AG-3 zoned properties adjoin to the west~ south~ and east~ and AR zoned properties
adjoin to the north.

ANALYSIS OF PROPOSED DEVELOPMENT
Background - Current conceptual plans show a subdivision of 12 lots with 1;ìingle family
residences, approximately 36 acres of open space, and 3 out parcels. Anticipated use is single-
. family homes utilizing the natural terrain and specific site criteria for design. The petitioner
proposes that site plans for each individual lot will be required and must be developed by a
certified landscape architect, and will be subject to the developer's approval. The petitioner also
proposes that natural exterior materials and colors are to blend in with the natural woodland
setting, houses will not be built on steep slopes and houses will have a minimum of 1600 square
feet and be limited in height of 45 feet and shall be sensitive to the surrounding view sheds.
Site Layout/Architecture - No building site is visible to any of the existing adjoining homes. No
houses will be closer than 150 feet to one another within the development. The conceptual plan
shows a private road which serves the 12 single family lots.
Access/Traffic Circulation - V DOT states that the development of this single-family residential
subdivision will increase the traffic from this site. A minimum sight distance of 390 feet on
Route 937 will be required in either direction and will be addressed during site plan review.
Roanoke County Traffic Engineer - Mr. Ford does not feel that the increase of traffic
(approximately 120 trips per day) is significant enough to cause a point of concern. Mr. Ford
does recommend that the proposed 16-ft- private road be increased to 18-ft to allow for easier
passage ofvehic1es that may meet on this private road. Mr. Ford also recommends that the
applicant meet all county standards set forth in the "Public Street and Parking Design Standards
and Specifications". These specifications require an 18-ft paved road with 2' shoulders and a
maximum grade of 16%.
Fire & RescuelUtilities -Fire and rescue services will continue, as they currently exist and should
not adversely impact Fire and Rescue call volume at this time. Fire and Rescue does have
concerns with the plans only showing one means of entry and exit into this subdivision because
of it's location in a wildland/interface area and is heavily wooded. Fire and Rescue recommends
building materials for roofbe asphalt or "Fire Retardant" wood shake shingles because of the
possibility of a wildland fIre in this area. Fire and Rescue also recommend brick or stucco
exterior walls for the same reasons. Fire and Rescue also recommend driveways that would be
wide enough for a Fire and Rescue Apparatus to get up and down without difficulty.
Public water and sanitary sewer is not currently available. This petition does not affect the
existing public water and sanitary sewer systems.
4.
CONFORMANCE WITH ROANOKE COUNTY COMMUNITY PLAN
The site is designated as Rural Preserve in the 1998 Community Plan. Rural Preserve designated
land use areas are where preservation options and certain design strategies can be followed which
would allow future development but leave land available for productive agricultural acivities and
open space, and preserve rural views and vistas.
This petition is consistent with the Rural Preserve designation of the' Roanoke County
Community Plan. '"

STAFF CONCLUSIONS
This is a request to obtain a rezoning from AR & AG-3 to PRD for the construction of 12 single
family homes and 3 outparce1s. The request involves a 97.543 acre tract off of Whistler Creek

JUSTIFICATION FOR THE REZONING REQUEST
The subject tract of this PRD consists of97 acres oftimbered woodland. The timber
on about 90% of this trac.1 was cut about 5 years ago. Already, the site is showing positive
signs ofœtural regeneration of the forest. Over 50% of the adjoining boundary is vacant
woodland. A large portion of the proposed 36 acre open space was not timbered and has a
pristine mountain stream floWing thru. It is the intent to keep this area in an untouched
state for all in the development to enjoy. The highlight of the development is the
spectular views of the valley and the surrounding mountains and the extensive walking
trails thru the 36 acre open space. By limiting the number of home sites we feel this is
the highest and best use of the land.

This request furthers the purpose of the Roanok~ County AR zoning ordinance by
offering very low density of single family residences utilizing the natural terrain in a
gentle way. The site is outside the urban service area ( only 6.5 miles to Cave Spring
Corners) but convenient to major retail, office space, restaurants, and major medical
facilities, Agriculture will not be encouraged because of the wooded nature ofthis tract.

The developer will oversee the development by requiring an individual site plan on
each lot. The site plan will be developed by an approved landscape architect and will be
subject to the developers approval fonowing specific site criteria. That is, houses will
be required to use natural exterior materials and colors to blend in with the natural

woodland setting. Houses are not to be built on steep slopes. Hous~s will have a
minimum of 1600 square feet and be limited in height of 45 feet and to be sensitive to the
surrounding view sheds. All of the building sites are not visible to any of the
adjoining existing homes. Furthermore, no houses will be closer than 150 feet to another
house within the development. Yard space will be limited to allow the forest to
regenera.te which will assure privacy between the home sites. No temporary structures
shall be used as a residence at any time.

There will be no impact on the adjoining properties because the home sites are not
in close proximity or visible to them. The home sites will have private well and septic,
underground electric, telephone and cable thus not requiring any public infrastructure.
The streets will be private and maintained by the homeowners association .Because of the
low density and targeted market of retirees there will be minimal impact on the schools.
Fire and rescue will not be strained because of the low density .Parks and recreation will
be provided within the de,:elopment by the walking trails.

ORDINANCE TO CHANGE THE ZONING CLASSIFICATION OF A 1.3-
ACRE AND A 97-ACRE TRACT OF REAL ESTATE LOCATED SOUTH
OF WHISTLER DRIVE AND CREEK CIRCLE AND EAST OF APPLE
GROVE LANE (TAX MAP NOS. 95.03-2-19, 19.2, AND 33) IN THE
WINDSOR HILLS MAGISTERIAL DISTRICT FROM THE ZONING
CLASSIFICATION OF AG3 AND AR, RESPECTIVELY, TO THE
ZONING CLASSIFICATION OF PRD WITH CONDITIONS UPON THE
APPLICATION OF SAM L. AND MERCEDES P. HARDY
WHEREAS, the first reading of this ordinance was held on May 25, 2004, and the
second reading and public hearing were held June 22, 2004 and continued to July 27,
2004; and,
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on July 6, 2004; and
WHEREAS, legal notice and advertisement has been provided as required by
law.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1.
That the zoning classification of a certain tract of real estate containing 1.3
acres and 97 acres, as described herein, and located south of Whistler Drive and Creek
Circle and east of Apple Grove Lane (Tax Map Numbers 95.03-2-19, 19.1, and 33) in
the Windsor Hills Magisterial District, is hereby changed from the zoning classification of
AG3, Agriculture/Rural Preserve District and AR, Agriculture/Residential District, to the
zoning classification of PRD, Planned Residential District.
2.
That this action is taken upon the application of Sam L. and Mercedes P.
Hardy.

That the owner of the property has voluntarily proffered in writing the
following conditions which the Board of Supervisors of Roanoke County, Virginia,
hereby accepts:
Minimum of 18' paved width with 2' shoulders for private road.
(1 )
(2)
Maximum 16% grade for private road.
(3)
Development must be developed in substantial conformity with the
concept plan dated, 4/21/2004.
4.
That said real estate is more fully described as follows:
1.237 acres being a portion of Tax Map No. 95.03-2-33 - AG3 to PRD
Tract A containing 45.277 acres and being Tax Map No. 95.03-2-33 - AR to PRD
Tract B containing 26.877 acres and being Tax Map No. 95.03-2-19 - AR to PRD
Tract C containing 25.389 acres and being Tax Map No. 95.03-2-19.1 - AR to
PRD

That this ordinance shall be in full force and effect thirty (30) days after its
final passage. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed. The Zoning Administrator is directed
to amend the zoning district map to reflect the change in zoning classification authorized
by this ordinance.
