Peter Lampman, President of Virginia Amateur Sports, Inc" has requested time on the
agenda to report on the economic impact of the 2004 Commonwealth Games of Virginia,
He would also like to present a plaque to the Board of Supervisors at that time,
The Commonwealth Games of Virginia were first held in July 1990 with more than 4,400
athletes competing in 29 sports. Roanoke County has been involved in the Commonwealth
Games since its inception, providing funding, fields and other assistance.

SUMMARY OF INFORMATION:
The Roanoke County Fire and Rescue Department applied for grant funding through the
Department of Justice Competitive Sub-Grant Equipment Program. The competitive sub-
grants are intended to provide local jurisdictions with funding to respond to incidents
involving terrorist events from weapons of mass destruction (WMD). The Fire and Rescue
Department was awarded approximately 13% of the available funding out of 80
applications. The funding allowed for the purchase of structural collapse equipment and
mass casualty supplies to support a WMD event. The grant funds in the amount of
$99,778.00 are from year 2002 competitive sub-grant cycle and were appropriated to the
department on August 12, 2003.
The Roanoke County Fire and Rescue Department would like to offer the Board of
Supervisors, County staff, and other attendees the opportunity to view the equipment and
trailers purchased with grant funds during the past fiscal year.
FISCAL IMPACT:
There was no fiscal impact; the cost of the equipment was covered at 100% by the
Department of Justice grant program.

SUMMARY OF INFORMATION:
The County of Roanoke currently operates the Salem-Roanoke County Jail which is located
behind the Roanoke County Courthouse in Salem. The facility is currently classified as a
regional jail and provides jail capacity for Craig County as well Salem and Roanoke County.
This jail was opened in 1980 and is rated as a 108 bed facility. Last year, we averaged 248
inmates throughout the year. During weekends, the number is often over 285 at a given
time.
Salem and Roanoke County have already been approved by the State with a waiver to the
moratorium for building new jail facilities. We have talked with Montgomery County and
Franklin County officials and the four jurisdictions are interested in pursuing a larger
regional jail to meet our overcrowding needs. Each jurisdiction, however, is interested in
maintaining their existing local jail to reduce the number of new beds to be constructed and
to reduce transportation time and cost. The local jails will be used primarily to house pre-
sentenced inmates and work program inmates. It is anticipated that sentenced inmates,
women inmates, medical cases, or other special needs inmates will be maintained at the
regional facility. A regional operating agreement is being discussed and will be presented
in the next few months.

There are two specialized studies which must be completed on behalf of the localities
desiring to build a jail facility. The Community-Based Corrections Plan serves as a needs
assessment to project the number of total beds that will be needed, the types of programs
and resources which are available which could modify that number, and the types of
programs which should be used in the overall corrections program. The second report is
the Program Plan which becomes the schematic drawing for the new facility and the budget
document for the proposed facility. This study is site specific and becomes the basis for
the amount of funding that the State will provide for the new facility. Both of these reports
and other supporting documentation must be filed with the State before March 1,2005 to
be eligible for inclusion in the Governor's capital budget plan as a part of the 2006 General
Assembly action. If we fail to meet the March 1, 2005 application date, it will be two years
later before the request can be considered.
The advantage of being classified as a regional facility is that the State share of the
construction capital cost will be up to 50% of the allowable costs. Should a locality be
approved to build a facility only for themselves, the State share would be a maximum of
25% of the allowable costs.
Administratively, the staff has contracted with Powell Consulting Services to prepare the
Community-Based Corrections Plan on behalf of the four jurisdictions named above at a
cost of $42,100. We are finalizing the negotiations for an AlE firm to prepare the Program
Plan at this time. The Administrative staff has agreed to share in the cost of these two
studies on the basis of the population of the participating localities with Roanoke County's
share being 35.485% or $57,522. Each locality is also having an AlE audit of the existing
jail facility to determine any structural or capital issues needed in order to allow our existing
rated bed capacity to be used in the proposal. Our cost for this study is $28,400,
There are numerous other costs which will be incurred in the immediate future to complete
these studies (funds for an option on an approved site; environmental studies of the site;
survey costs; Facility Condition Study of each existing jail facility to determine a budget and
time-line for the capital improvements needed to maintain the local jail; and fees for
professional services looking at the legal transactions and financial arrangements that will
be necessary to file with the State).
The staffs of the four localities have agreed to seek approval of a formal Letter of Intent
from the governing body of each jurisdiction to proceed with the required studies and to
move forward with the development of a regional contract for the construction and
operation of a regional jail facility. The attached Letter of Intent and request for
appropriations are being considered by the other localities at this time and all parties will
sign and approve funding during October, 2004. We hope to have the regional agreement
in basic form by Thanksgiving, 2004.

FISCAL IMPACT:
Roanoke County is serving as the lead agency in this project and the purchasing process is
being held by the County. The four jurisdictions have agreed to share in the cost of the two
studies on the basis of population and Roanoke County's share is $57,522 or 35.485% plus
the cost of the evaluation of our existing facility $28,400. It is requested that these funds be
appropriated from the Capital Unappropriated Balance. The contributions from the other
jurisdictions will be handled separately.
AL TERNA TIVES:
1.
Participate in the development of a regional jail facility for the four jurisdictions
and qualify for up to 50% of the allowable costs of the project.
2.
Develop a jail facility for Roanoke County and the City of Salem only, which
requires us to meet the same timelines, but with increased local costs.
STAFF RECOMMENDATION:
Staff recommends approval of Alternative 1, participating in the development of a regional
jail facility to meet the needs of Roanoke County, Montgomery County, Franklin County,
and the City of Salem; authorizing the County Administrator to execute the Letter of Intent
which allows the required studies to be completed; and appropriate the monies necessary
to fund Roanoke County's Share of the studies ($85,922). These funds should be eligible
for reimbursement in the bond funding.
Staff further recommends that a work session be held in November to discuss the regional
agreement and to answer more questions concerning the new facility.

LETTER OF INTENT
To Continue to Pursue the Feasibility of
THE REGIONAL JAIL CONCEPT
October -' 2004
WHEREAS, the City of Salem, Roanoke County, Franklin County and Montgomery
County ("Participating localities") are looking at alternatives to expanding their existing
capacity to house the inmates for their respective jurisdictions, and
WHEREAS, since the Commonwealth of Virginia shares in the capital construction of
jails in an amount of fifty percent of the allowable cost for regional facilities as compared
to twenty-five percent of the allowable cost for capital construction of individual
facilities, the Participating Localities want to continue to pursue the feasibility of a
regional jail approach, and
WHEREAS, the Participating Localities have deemed to be in their collective best
interest to continue to operate their local jails in their respective jurisdictions to the
degree practical and allowable by the State and also continue to pursue the feasibility of
participating in the construction of a regional jail facility; and
WHEREAS, the Participating Localities have agreed to share on the basis of population
of the Participating Localities (Salem 10.069%, Roanoke County 35.485%, Franklin
County 19.935% and Montgomery County 34.511 %) in the cost of the Community
Based Corrections Plan (estimated cost of $42,000) and the Planning Study (Estimated
Cost of $100,000), two studies which are required by the Commonwealth of Virginia's
Department of Corrections in detennining the need for the and the capacity of new jail
facilities; and
WHEREAS, the State Funding Application and all supporting documentation must be
filed with the State before March 1, 2005, in order to be included in the Governor's
capital budget, and
WHEREAS, it is understood that should the Participating Localities decide following
this study period to participate in a Regional Jail facility, a fonnal Regional Jail
Agreement (Agreement) must be adopted by the participating jurisdictions to detennine
the projected capacity of the new regional jail facility to be owned by each jurisdiction;
the means of governing the operation of the facility; the method of sharing the capital
construction costs; the method of sharing the operating costs on an equitable basis; and
the means of amending the Agreement or updating the criteria for the life of the
Agreement, and

WHEREAS, it is the intent of each of the Participating Localities to continue to study the
feasibility of the Regional Jail Approach and share in the costs of that study as agreed in
this Letter of Intent.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Salem,
the Board of Supervisors of Roanoke County, the Board of Supervisors of Franklin
County, and the Board of Supervisors of Montgomery County, do hereby authorize the
City Manager or the County Administrator of their respective jurisdiction to sign this
Letter of Intent to continue to study and develop the feasibility of a Regional jail
approach among the Participating Localities. The Participating Localities agree to
continue to study the feasibility of a Regional jail approach and share in the costs of this
study on the basis of population of each Participating Locality. If it is determined that
following this study period that the Participating Localities desire to participate in the
Regional Jail facility, those Participating Localities shall develop and approve a Regional
Jail Agreement subject to final approval by each participating governing body.
BE IT FURTHER RESOLVED, that the Participating Localities agree to seek
legislative authority from the General Assembly for Franklin County and Montgomery
County to participate in a regional jail facility with the City of Salem and Roanoke
County who already have authority to participate in such a facility, and
BE IT FURTHER RESOLVED, that each Participating Locality shall, consistent with
this Letter of Intent, cooperate and complete all studies, forms and adopt all necessary
agreements or documents to allow the submittal of the State Funding Application
package to the State prior to the March I, 2005 deadline.

SUMMARY OF INFORMATION:
Roanoke County has begun advertising various pieces of County property for lease by
cellular service providers for tower sites. Income received from these sites will then be
available for improvements to County facilities and equipment.
NTELOS, a cellular telephone company, has expressed interest in leasing space at the
Hollins Fire Station for a tower, and has already received a special use permit from the
Board for this project. Staff has been negotiating a lease with NTELOS, and a draft copy of
the lease is available in the Clerk's Office. The major provisions of the lease are as follows:
. NTELOS will construct the tower and three cabinets and/or buildings at the Hollins
Fire Station site at no cost to the County.
. NTELOS will provide space for the County's current communication equipment, and
additional space will be reserved for another County antenna.

. NTELOS will move all current County equipment and provide a cabinet at the base
of the tower for the County's use, at no cost to the County. NTELOS will also
remove and dispose of the current tower at the site.
. NTELOS will pay Roanoke County $6,000 annually for five years to lease the space
at the fire station. The lease may be extended at the option of NTELOS for four
additional five year periods, with an increase in rent of 20% for each extension.
. If NTELOS leases space on the tower to other entities, the County will receive 20%
of the rent from the third party. The County also has approval rights over any
subleases,
. NTELOS may not assign or sell the tower without the County's permission.
Additionally, the County has the right of first refusal to purchase the tower, at fair
market value at the time of the sale. Fair market value will be based on an appraisal
by a certified appraiser, and take into consideration depreciation and income
producing potential of the tower.
. At the end of the 25 year lease period, NTELOS will either remove the tower or give
it to the County, at the County's option.
FISCAL IMPACT:
There is no cost to the County. The County has a variety of other leases with cell tower
companies, but those have not involved construction of a tower. As an example, NTELOS
pays $18,000 annually in rent at the Salem Bank and Trust Building for antenna space. In
that case, the County building acts as the tower, and the County has the associated costs
of maintenance, insurance, etc. In this case, NTELOS will be constructing the tower, and
assuming all maintenance, repair and liability issues.
If space on the tower is leased to three other carriers as anticipated, the County's
consultant predicts revenue of over $20,000 per year.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the first reading of this ordinance and schedule
the second reading of the ordinance for October 26,2004.

ORDINANCE AUTHORIZING AND APPROVING EXECUTION OF AN
OPTION AND LEASE AGREEMENT WITH VIRGINIA PCS ALLIANCE,
LC., D/B/A NTELOS, FOR A 3,400 SQ. FT. TOWER SITE AT THE
HOLLINS FIRE STATION ON BARRENS ROAD IN THE HOLLINS
MAGISTERIAL DISTRICT, OWNED BY THE BOARD OF SUPERVISORS
OF ROANOKE COUNTY
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, is the owner of a
parcel of land, containing 2.51 acres, located at 7401 Barrens Road in the County of
Roanoke, Virginia. designated on the Roanoke County Land Records as Tax Map #27.13-
4-1, and commonly referred to as the Hollins Fire Station; and,
WHEREAS, staff has been approached by and has negotiated with NTELOS for
lease of a portion of the Hollins Fire Station Site to construct a new telecommunications
tower, with space available for the County's equipment and facilities; and,
WHEREAS, by Ordinance #082404-9 adopted on August 24, 2004, the Board
approved a Special Use Permit for this project at the County site; and,
WHEREAS, Section 18.04 of the Roanoke County Charter directs that the
acquisition or conveyance of an interest in real estate, including leases, shall be
accomplished by ordinance; the first reading of this ordinance was held on October 12,
2004; and the second reading and public hearing was held on October 26, 2004.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1.
That lease of approximately 3,400 square feet of land, together with rights of
access, ingress and egress, and utility easements, at the Hollins Fire Station, located at
7401 Barrens Road in the County of Roanoke, Virginia, to Virginia PCS Alliance, LC, d/b/a

NTELOS, for an initial period of five (5) years at an annual rental of $6,000.00, payable
annually in advance, plus installation and payment for its own utility services, and to include
the option to NTELOS to renew said lease for four (4) additional successive periods of five
(5) years at a twenty percent (20%) rental increase for each renewal period, is hereby
authorized and approved.
2.
That an Option to NTELOS to exercise the rights set forth in the Lease
Agreement and authorized in paragraph 1 hereof, for a period of one (1) year during which
NTELOS shall have the necessary rights of access for feasibility studies and tests, at an
Option Fee of $500.00, to be applied to the rent in the event that the option is exercised, is
hereby authorized and approved.
3.
That subleases of tower and equipment space to third party entities by
NTELOS, with 20% of the rental to be paid to the County, shall be subject to approval by
the Board through resolution.
4.
That the County Administrator or an Assistant County Administrator is hereby
authorized to execute an Option and Lease agreement on behalf of the Board of
Supervisors of the County of Roanoke and to execute such other documents and take such
further actions as are necessary to accomplish this transaction, all of which shall be upon
form and subject to the conditions approved by the County Attorney.
5.
That the revenue generated by this lease agreement, including future
subleases, shall be placed in the County Building Repair Account.
6.
That this ordinance shall be effective on and from the date of its adoption.

This is the second reading of an ordinance amending Section 21-73 of the
Roanoke County Code to increase the various asset threshold amount provisions
for the elderly and disabled persons real estate tax exemptions. The 2004
session of the Virginia General Assembly amended Section 58.1-3211 of the
State Code which establishes the various restrictions, limitations, and conditions
on the authority of local governments to adopt real estate exemptions for elderly
and handicapped persons,
The General Assembly has authorized the governing bodies of counties, cities,
and towns to adopt an ordinance to provide for the exemption from, deferral of, or
a combination program of exemptions from and deferrals of real estate taxation
for elderly or disabled property owners subject to certain conditions and in such
amounts as the ordinance may allow and the enabling legislation may authorize.
Roanoke County has adopted the exemption instead of deferral program for local
real estate taxes for eligible citizens.

The Board has budgeted $600,000 for this exemption program in the current
fiscal year. There are 1,386 persons in this program; and 1,463 parcels of real
estate.
This real estate property tax relief program is authorized by Article X, Section 6
(b) of the Constitution of Virginia. The exemption is intended to provide relief to
those elderly or disabled persons whose real estate property tax burden is
deemed to be excessive in comparison with their income and financial worth.
There are three conditions in calculating eligibility for this exemption:
1. Total combined income cannot exceed $50,000
2, Total combined net worth cannot exceed $100,000
3. The net worth amount shall not include the value of the sole dwelling
house and up to one acre of land.
Roanoke County excludes an amount up to $6,500 of income of each relative
who is not the spouse of an eligible owner living in the dwelling and who does not
qualify for the exemption,
The recent amendments by the General Assembly increased this amount
($6,500) to $10,000; it increased the net combined financial worth to $200,000;
and it allowed excluding the value of the sole dwelling and land not to exceed 10
acres from this calculation.
The draft ordinance recommends increasing from $6,500 to $10,000 of income of
each relative who is not the spouse of the owner living in the dwelling house and
who does not qualify for the exemption from the $50,000 total combined income
limitation.
The ordinance does not recommend increasing the total combined net worth
from $100,000 to $200,000.
The ordinance does not recommend increasing the value of acreage from one
acre to ten acres in calculating the total combined net worth of the owner and
spouse.
Finally the ordinance allows exempting the income of a relative or the relative's
spouse who moves in and provides care for an eligible person in order to avoid
going into a hospital, nursing home, convalescent home, or other similar facility.
The current total combined income and total combined net worth limitations
appear to be appropriate for Roanoke County based upon median family income
statistical data. The higher dollar limits are more appropriate for the more
expensive Northern Virginia and Tidewater areas of the Commonwealth.
Roanoke County's program provides real estate tax relief to elderly and

handicapped citizens of modest means while assisting them in alleviating an
undue real estate tax burden, By excluding the value of the sole dwelling house
and up to one acre of land from the total combined net worth calculation, the
County helps these qualifying citizens to retain the family home. At the same
time this exemption program does not shift an undue tax burden to young
families with children.
The ordinance grants a tax exemption to eligible persons based upon financial
need and ability to pay, while balancing the tax burden among the generations.
FISCAL IMPACT:
The County has budgeted $600,000 in this fiscal year for this real estate
exemption program. Staff believes that these amendments can be
accommodated within the existing approved budget.
STAFF RECOMMENDATION:
It is recommended that the Board favorably consider the adoption of the
proposed ordinance. The first reading and public hearing was held on
September 28, 2004; second reading is scheduled for October 12, 2004. If
adopted this ordinance would become effective for the tax year beginning
January 1, 2005.

WHEREAS, Section 21-73 of the Roanoke County Code establishes a restriction
upon the total combined income for the exemption from or deferral of real estate taxes for
certain elderly or permanently or totally disabled persons; and
WHEREAS, Ordinance 84-232 adopted on December 18, 1984, increased this
financial restriction from $15,000 to $18,000, and Ordinance 22388-9 adopted February 23,
1988, increased this financial restriction from $18,000 to $22,000, and Ordinance 82791-10
adopted August 27, 1991, increased this financial restriction from $22,000 to $30,000;
Ordinance 052201-14 adopted May 22, 2001, increased this financial restriction from
$30,000 to $50,000; and
WHEREAS, the 2004 General Assembly for the Commonwealth of Virginia amended
Section 58.1-3211 of the 1950 Code of Virginia by increasing various asset threshold
amounts; and
WHEREAS, the first reading and public hearing on this ordinance was held on
September 28, 2004; and the second reading was held on October 12, 2004.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1.
That Section 21-73, General prerequisites to qrant of Division 3. Exemption
for elderly and disabled persons of Chapter 21, Taxation be amended to read and provide

Exemptions provided for in this division shall be granted only if the following
conditions are met:
(1 )
That the total combined income, during the immediately preceding calendar
year, from all sources, of the owner of the dwelling and his relatives living therein did not
exceed fifty thousand dollars ($50,000); provided, however, that the first sixty five hundred
doll3rs ($6,500) ten thousand dollars

That the owner and his spouse did not have a total combined net worth,
including all equitable interests, exceeding one hundred thousand dollars ($100,000.00) as
of December 31 of the immediately preceding calendar year. The amount of net worth

acre of land,

Federal funds have recently become available to help school divisions implement the state
wide standards of learning assessment system. Roanoke County schools will receive a
total of $53,570.31. The federal funds will be used to purchase new scientific and graphing
calculators, repair non-functioning calculators, or to purchase calculator batteries.
FISCAL IMPACT:
An additional appropriation of $53,570.31 will be added to budget code 791900-3365, as
well as a corresponding increase in general fund revenues from state aid.

on a tuition basis. The tuition is $350 per full course and $175 per half-credit course, plus a

anticipated enrollment of approximately 20 students would generate $8,000 in revenues.

The Roanoke County Police Department has applied, and continues to apply, to the
Department of Criminal Justice Services for annual Edward Byrne Formula Grants to
provide law enforcement support. The grant provides local law enforcement agencies with
additional resources to improve capabilities for detecting, deterring, disrupting, and
preventing acts of terrorism. It also provides for the purchase of equipment, supplies, or
other equipment related to community policing, law enforcement, or crime prevention.
The grant will be used to provide funds toward the purchase of a chemical, biological,
radiological, nuclear, explosive (CBRNE) response vehicle to deploy bomb, hazmat and
special weapons personnel. The grant has been approved in the amount of $19,747. The
Edward Byrne Formula Grant is administered by the Department of Criminal Justice
Services, and the purpose of the program is to provide law enforcement units of local
government with funds to underwrite projects to reduce crime and improve public safety.
The Police Department applied for this one time grant due to funds made available to
Virginia from unspent funds in a previous fiscal year.

The final award amount is $19,747 in federal funds which are to be matched with $6,582 in
Roanoke County funds. The local match will be provided from existing Police Department

This document summarizes implemented changes in the secondary system of state highways that will be reported to the Commonwealth Transportation Board 011 September 16, 2004
.
WHEREAS, the use of illegal drugs and the abuse of alcohol and nicotine
constitute the greatest threats to the well-being of America's
children; and
WHEREAS,
WHEREAS,
surveys conducted by The National Center on Addiction and
Substance Abuse (CASA) at Columbia University have consistently
found that the more often children and teenagers eat dinner with
their families the less likely they are to. smoke, drink alcohol and
use illegal drugs; and
teenagers who virtually never eat dinner with their families are 72
percent more likely, and teenagers who almost always eat dinner
with their families are 31 percent less likely than the average
teenage to use illegal drugs, alcohol and cigarettes; and
WHEREAS, the correlation between family dinners and reduced risk for teen
substance abuse are well documented; and
WHEREAS, parental Í/1fluence is known to be one of the most crucial factors in
determining the likelihood of substance abuse by teenagers; and
WHEREAS, family dinners have long constituted a substantial pillar offamily
life in America.
NOw, THEREFORE, WE, the undersigned, do hereby proclaim Monday,
September 27, 2004, throughout the Roanoke Valley, as
FAMILYDAY-A DAY TO EAT DINNER WITH YOUR CHILDREN.

SUMMARY OF INFORMATION:
Staff has been participating in a work group sponsored by the State Department of Finance
to interpret the effect and the implementation of SB5005, which was enacted as legislation
during the 2004 General Assembly session, This legislation has major detrimental financial
implications for the localities in the State that bill personal property taxes in the spring of the
year.
This time has been set aside the update the Board on the status on these meetings and the
current direction of the implementation.

ON TUESDAY, OCTOBER 12, 2004
RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law,
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each members knowledge:
1. Only public business matters lawfully exempted from open meeting requirements
by Virginia law were discussed in the closed meeting which this certification resolution
applies, and
2. Only such public business matters as were identified in the motion convening the
closed meeting were heard, discussed or considered by the Board of Supervisors of
