Good afternoon and welcome to our meeting for November 4, 2020. Regular meetings
are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at
7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced.
Because of the present state of emergency, and until further notice, members of
the public are urged not to attend Board of Supervisor meetings in person. All
are encouraged to view and participate in meetings through electronic means.
Meetings may be viewed live on RVTV, Channel 3, or on the County’s website
https://roanokecountyva.gov(and accessed by clicking on the “Watch Board
Meetings Online” button). Prior to and during meetings, citizens may share
comments by email (to djacks@roanokecountyva.gov) or by phone (540-776-
7278). When submitting comments, please include your name and address.
Comments submitted by email and by phone will be read aloud during meetings,
subject to reasonable time limitations.
For those individuals who desire to attend meetings in person, please be advised
that seating modifications and limits have been established in order to facilitate
social distancing; attendees who are not of the same household must sit six feet
apart; and attendance at meetings will be limited to 25 individuals.

counsel and receive briefings from staff members pertaining to possible litigation,
where such consultation or briefing in an open meeting would adversely affect
the negotiating or litigating posture of the public body. Specifically the Board will
consider participation in class action litigation or settlement with manufacturers of
polychlorinated biphenyls.
2.Section 2.2-3711(A) (7) and A (29) of the Code of Virginia in order to consult
with legal counsel and receive briefings from staff members pertaining to 1)
possible litigation, where such consultation or briefing in open meeting would
adversely affect the negotiating or litigating posture of the public body, and 2) the
award of a new public contract for goods or services, and discussion of the terms
or scope of such contract, where discussion in open session would adversely
affect the bargaining position or negotiating strategy of the public body.
Specifically, the Board will discuss litigation options for proceeding against a
vendor of goods or services for breach of contract, and the award of a new public
contract for such goods or services.

A proclamation commending Luigi's Italian Gourmet Restaurant on the occasion of its
50th anniversary
BACKGROUND:
0 and has
been under the ownership of the Marques family for 50 years. Luigi's is one of the
longest operating restaurants in Roanoke County and is well known for its exquisite
Italian cuisine. Luigi's success is well known throughout the community as they have
been voted Roanoke's Best Italian restaurant for 17 years running.
Owner Maristane Rocha and representatives from the Marques family will be present to
accept the Proclamation.

This item has no fiscal impact.

AGENDA ITEM: Ordinance accepting and appropriating funds in the amount

Fast Track Broadband Program
BACKGROUND:
Governor Northam allocated $30 million in funding from the Federal Coronavirus Aid,
Recovery, and Economic Security (CARES) Act to improve broadband access that will
address the need to increase broadband connectivity for distance learning and telework
as a result of the public health emergency.
This program is unrelated to other broadband support programs offered by the
Commonwealth. Localities are encouraged to creatively partner with other public and
private partners to respond to this need during the public health emergency digital -
whether residents lack access to broadband connectivity as a result of inadequate
- and
submit projects that can be completed in the provided timeline.

DISCUSSION:
Rural areas of Roanoke County have been in need of broadband connectivity for
several years. Approximately 23% of the County of Roanoke currently has either no
access or are underserved for high speed Internet access. With County Schools utilizing
distance learning many children will be potentially left behind on assigned school work
and school teleconference requirements. Additionally, families must use the Internet for
employment and telemedicine if they are to stay employed or seek services from
healthcare professionals.
Broadband Program from our application submitted October 9, 2020. This will provide
funding for several County Broadband projects in the Catawba, Vinton, Cave Spring and
completed by December 25, 2020.
FISCAL IMPACT:
No County funds are required. Funds are 100% Federal funds passed through the
State. $976,380 will be appropriated to the Grant Fund.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading and waiver of the second reading of an
ordinance to accept and appropriate $976,380 to the grant fund for the allocation of the
Governor's Fast Track Broadband Program upon a 4/5ths vote of the Board of
Supervisors.

As stated in the program guidelines, these funds must be expended and service must be available by
December 25, 2020. Similar to previous CARES Act allocationsto localities, this award amount will be
transmittedtoRoanoke Countyby the Department of Accounts. Once the project is complete, the
Team and the Department of Accounts will follow up regarding project outcomes
and compliance. I want to reiterate that it is incumbent on Roanoke Countyto ensure project expenses are
documented and verified in case of audit.

ORDINANCE ACCEPTING AND APPROPRIATING FUNDS IN THE
AMOUNT OF $976,380 FROM THE COMMONWEALTH OF VIRGINIA,
PURSUANT TO THE CORONAVIRUS AID, RELIEF, AND ECONOMIC
SECURITY (CARES) ACT OF 2020 FOR BROADBAND PROJECTS IN
CATAWBA, VINTON, CAVE SPRING AND WINDSOR HILLS
MAGISTERIAL DISTRICTS
WHEREAS, the Governor of the Commonwealth has created a Fast Track
Broadband Program funded by federal Coronavirus Aid, Recovery, and Economic
Security (CARES Act) allocations to the Commonwealth; and
WHEREAS,
expansion and improvement of broadband in under-served areas; and
WHEREAS, the County applied for funds from the Track
Broadband Program to continue broadband construction and installation projects in the
Catawba, Vinton, Cave Spring, and Windsor Hills Magisterial Districts; and
WHEREAS, the County was awarded $976,380 in funds for its broadband projects
on the condition that such funds be expended and work completed no later than
December 25, 2020; and
WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and
WHEREAS, first reading of this ordinance was held on November 4, 2020, and
because time is of the essence for this broadband project, the second reading has been
waived, upon an affirmative vote of 4/5ths of the members of the Board, this being

deemed to be an emergency measure pursuant to Section 18.04 of the Roanoke County
Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the sum of $976,380 is accepted and appropriated from the
Fast Track Broadband Program for the purpose of improving broadband
access in under-served areas in Catawba, Vinton, Cave Spring, and
Windsor Hills Magisterial Districts.
2. That this ordinance shall take effect upon its adoption.

least every 60 days in order to remain in effect.
BACKGROUND:
On March 31, 2020, the Board adopted Ordinance No. 033120-1, which effectuates
temporary changes in certain deadlines and modifies public meeting and public hearing
practices and procedures, to address continuity of operations associated with the
COVID-19 pandemic disaster. The Board readopted the ordinance on May 26, 2020,
July 14, 2020, and again September 8, 2020.
DISCUSSION:
Pursuant to Section 15.2-1427, emergency ordinances must be readopted in order to
remain in effect for more than 60 days.

WHEREAS, pursuant to Section 15.2-1427 of the Code of Virginia, emergency
ordinances shall not be enforced for more than sixty (60) days unless readopted; and
WHEREAS, the Board readopted the ordinance on May 26, 2020, July 14, 2020;
September 8, 2020; and
WHEREAS, due to the ongoing nature of the COVID -19 pandemic, it is again
proposed that the Board readopt Ordinance 033120-1; and
WHEREAS, the first reading of this ordinance was held on November 4, 2020; and
the second reading has been dispensed with, upon an affirmative vote of 4/5ths of the
members of the Board, this being deemed to be an emergency measure pursuant to
Section 18.04 of the Roanoke County Charter.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County

ASSOCIATED WITH PANDEMIC DISASTER
WHEREAS, on March 12, 2020, Governor Ralph S. Northamissued Executive
Order Fifty-One declaring a state of emergency for the Commonwealth of Virginia arising
from the novel Coronavirus (COVID-19) pandemic; and
WHEREAS, Executive Order Fifty-One acknowledged the existence of apublic
health emergency which constitutes adisaster as defined by Virginia Code §44-146.16
arising from the public health threat presented by a communicable disease anticipated to
spread; and
WHEREAS, Executive Order Fifty-One ordered implementation of the
Commonwealth of Virginia Emergency Operations Plan, activation of the Virginia
Emergency Operations Center to provide assistance to local governments, and
authorization for executive branch agencies to waive “any state requirement or regulation”
as appropriate; and
WHEREAS, on March 13, 2020, the President of the United States declared a
national emergency, beginning March 1, 2020, in response to the spread of COVID-19;
and
WHEREAS, on March 11, 2020, the World Health Organization declared the
COVID-19 outbreak a pandemic; and

WHEREAS, on March 17, 2020, the Board of Supervisorsconfirmed the
declaration of local emergencymade by the County’s local director of emergency
management on March 16, 2020;and
WHEREAS, the Boardfinds that COVID-19 constitutes a real and substantial
threat to public health and safety and constitutes a “disaster” as defined by Virginia Code
§44-146.16,being a “communicable disease of public health threat;” and
WHEREAS, Virginia Code§15.2-1413 provides that, notwithstanding any contrary
provision of law,a locality may, by ordinance, provide a method to assure continuity of
government in the event of a disaster for a period not to exceed six monthsafter the
disaster; and
WHEREAS, Virginia Code§44-146.21(C) further provides that a local director of
emergency management,or any member of a governing body in his absence,may,upon
the declaration of a local emergency “proceed without regard to time-consuming
procedures and formalities prescribedby law (except mandatory constitutional
requirements) pertaining to performance of public work;” and
WHEREAS, Virginia Code §2.2-3708.2(A)(3) allows, under certain procedural
requirements including public notice and access, that members of the Board of
Supervisorsmay convene solely by electronic means “to address the emergency;” and
WHEREAS, the open public meeting requirements of the Virginia Freedom of
Information Act (“FOIA”) are limited only by a properly claimed exemption provided under
that Act or “any other statute;” and

WHEREAS,the Governor and Health Commissioner of the Commonwealth of
Virginia and the President of the United Stateshave recommended suspension of public
gatherings of more than ten attendees; and
WHEREAS, The Attorney General of Virginia issued an opinion dated March 20,
2020 opiningthat localities have the authority during disasters to adopt ordinances to
ensure the continuity of governmentin accord with the provisionsofSection 15.2-1413 of
the Code of Virginia; and
WHEREAS, this emergency ordinance in response to the disaster caused by the
COVID-19 pandemic promotes public health, safety and welfare and is consistent with
the law of the Commonwealth of Virginia, the Constitution of Virginia and the Constitution
of the United States of America; and
WHEREAS, the first reading of this ordinance was held on March 31, 2020; and
the second reading has been dispensed with, upon an affirmative vote of 4/5ths of the
members of the Board, this being deemed to be an emergency measure pursuant to
Section 18.04 of the Roanoke County Charter.
NOW, THEREFORE, BE IT ORDAINEDby theBoard of Supervisors of the County
of Roanoke, Virginia:
1.Thatthe COVID-19pandemicmakes it unsafe to assemble in one locationa quorum
for public bodies includingtheBoard of Supervisors, the School Board,the Planning
Commission, Board of Zoning Appeals, Board of Equalization,and all local and
regional boards, commissions, committees and authoritiescreated by the Board of
Supervisorsor to which the Board of Supervisorsappoints all or a portion of its
members(collectively,“Public Entities”and individually “Public Entity”),or for such

Public Entities to conduct meetings in accordance with customarypractices and
procedures.
2.That in accordance with Virginia Code § 15.2-1413, and notwithstanding any contrary
provision of law, general or special, the following emergency procedures are adopted
to ensure the continuity of government during this emergency and disaster:
a.Any meetingsor activities which require the physical presence of members of the
Public Entitiesmay be held through real time electronic means (including audio,
telephonic, video or other practical electronic medium) without a quorum physically
present in one location; and
b.The chairmanof each Public Entity shall have authority to decide whether to hold
any such electronic meeting. If the chairmanis unavailable, the vice-chair shall
decide. If the vice-chair is unavailable, such authority shall lie with representatives
from the County’s respective magisterial districts, in the following order of
availability:Vinton, Catawba, Hollins, Windsor Hills, and Cave Spring. If the Public
Entity is not comprised of representatives solely according to magisterial district,
each Public Entity mayenact a Resolution that sets forth authority to make such
decisionin the absence of the chairman or vice-chair.
c.Prior to holding any such electronic meeting, the Public Entity shall provide public
notice of such at least 3days in advance of the electronic meeting,identifying how
the public may participate or otherwise offer comment; and
d.Any such electronic meeting of Public Entities shall state on its agenda and at the
beginning of such meeting that it is being held pursuant to and in compliance with
this Ordinance; identify Public Entity members physically and/or electronically

present;identify the persons responsible for receiving public comment;andidentify
notice of the opportunities for the public to access and participate in such electronic
meeting; and
e.Any such electronic meeting of the Public Entities shall be open to electronic
participation by the publicwhich may include,inter alia, recess periods during such
meetings to receive electronic comments from citizens,and shall be closed to in-
person participation by the public; and
f.For any mattersrequiring a public hearing,public comment maybe solicited by
electronic means in advance and shall also be solicited through telephonic or other
electronic or audiovisual meansduring the course of the electronic meeting. All
such public comments will be provided to members of the Public Entity duringor
before the electronic meeting and made part of the record for such meeting; and
g.The minutes of all electronic meetingsshall conform to the customary
requirements of law, identify how the meeting was conducted, members
participating, and specify what actions were taken at the meeting. The Public

IT IS FURTHER ORDAINEDthat,notwithstandingany provision of law, regulation
or policy to the contrary, any deadlines requiring action by a Public Entity, its officers
(including Constitutional Officers) and employees of its organization shall be suspended
during this emergency and disaster, however, the Public Entities, officersand employees
thereof are encouraged to take such action as is practical and appropriateto meet those
deadlines. Failure to meet any such deadlines shall not constitute a default, violation,
approval, recommendation or otherwise. This paragraph does not automatically extend
any deadlines for the paymentof taxes or filing of tax returns.
IT IS FURTHER ORDAINED that non-emergency public hearings and action items
of Public Entities maybe postponed to a date certain,provided that public notice is given
so that the public are aware of how and when to present their views.
IT IS FURTHER ORDAINED that the provisions of this Emergency Ordinance shall
remain in full force and effect for a period of 60 days, unless amended, rescinded,or
readopted by the Boardin conformity with the notice provisions set forth in Virginia Code
§15.2-1427 but in no event shall such ordinance be effective for more than 6monthsafter
the disaster.Uponrescission by the Boardor automatic expiration as described herein,
this emergency ordinance shall terminate and normal practices and procedures of
government shall resume.
Nothing in this Emergency Ordinance shall prohibit Public Entities from holdingin-
personpublic meetingsprovided that public health and safetymeasures as well as social
distancingare taken into consideration.

ISSUE:
Request to purchase 304 acres of land located off Old Mountain Road adjacent to Read
Mountain Preserve from the Andrews, Bradshaw, and Holland families identified as Tax
Map Numbers 028.00-01-08.00-0000 and 028.00-01-09.00-0000.
BACKGROUND:
Read Mountain is an iconic feature with significant influence on the scenic viewsheds
and historical attributes of the Roanoke Valley. As early as 2002, the Virginia Outdoors
Plan designated Read Mountain as a critical viewshed that is visible from surrounding
localities, the Blue Ridge Parkway, the Appalachian Trail, and Interstate 81. The Great
Wagon Road ran down Old Mountain Road, and the area still has many historic sites,
such as Monterey and Bellvue. A prominent Roanoke family - the Andrews - owned the
property. Tom Andrews ran an apple orchard, an off-shoot of the family business
supplying produce to southwest Virginia. Read Mountain was the backdrop to this
historic area and was always a large, forested mountain.
Read Mountain Preserve became a Roanoke County Park in 2008. This 243-acre
Preserve is generally located on the eastern side of the mountain and has two
conservation easements - one with the Blue Ridge Land Conservancy and one with
Virginia Outdoors Foundation (VOF). These easements restrict timbering, construction,

recreation areas with a five (5)-mile natural surface trail system that features Buzzards
Rock, which provides a remarkable view of the Roanoke Valley and is located on the
property proposed for acquisition.
This project, Read Mountain Preserve North, is the proposed acquisition of 304 acres of
forested land adjacent to Read Mountain Preserve. The property proposed for
acquisition is generally on the northwestern side of the ridge and would double the
Preserve size, as well as protect the scenic ridgeline. The parcels are completely
forested, except for trails and a 0.81-mile long woods road, which once accessed a FAA
section of the Roanoke Valley, and is varyingly mapped as being in the Ridge and
Valley Physiographic Region or in the Blue Ridge Mountains region. The land is steep,
with many rock outcrops, but also with perennial streams and large cove hardwoods.
The land has been in the Andrews, Bradshaw and Holland families for generations and
has been protected for almost a century as mountain forests.
On October 7, 2019, the Virginia Outdoors Foundation notified the Roanoke County
Department of Parks, Recreation and Tourism that $620,054 from the Forest CORE
Fund grant program had been awarded for the acquisition and protection of the 304
acres on Read Mountain that is owned by the Andrews, Bradshaw and Holland families.
There is no local match required for this grant. Read Mountain Alliance has also
pledged $30,000 towards the project cost, and their fiscal agent is the Blue Ridge Land
Conservancy.
On February 11, 2020, the Board of Supervisors accepted and appropriated $620,054
from the VOF Forest CORE Fund grant program and $30,000 from the Read Mountain
Alliance for the purchase of land, easements, and acquisition costs.
A grant agreement with VOF was executed on February 28, 2020, for acquisition of the
two (2) parcels, which will be owned and maintained by Roanoke County for outdoor
recreation, open-space and forestry protection in perpetuity for year-round public
access. Roanoke County plans to use the two (2) parcels in the same manner as Read
Mountain Preserve. The park will have passive recreation facilities such as hiking trails,
picnic facilities, kiosks and wayfinding signs. Roanoke County Parks, Recreation and
Tourism will partner with the Roanoke Valley Greenway Commission to develop a
master plan for expansion of the trail system. Additionally, Roanoke County will
coordinate with VOF to have a Forestry Management Plan and/or Natural Resources
Inventory completed for the two (2) parcels.

DISCUSSION:
Roanoke County is requesting approval to move forward with the purchase of 304 acres
of land from the Andrews, Bradshaw and Holland families through the VOF Forest
CORE Fund grant program. The landowners have agreed to sell the two (2) parcels for
the appraisal value of $610,000. They have agreed to sell the smaller parcel for the
purchase price of $55,530, and the larger parcel for the purchase price of $554,470.
Roanoke County has complied with the following VOF Forest CORE Fund grant
requirements for acquisition of the land:
· A Phase 1 Environmental Assessment was completed by ECS Mid-Atlantic, LLC.
· A survey of the parcels to ALTA/ASTM standards was prepared by Caldwell
White Associates, a Virginia licensed surveyor or professional engineer,
depicting the metes and bounds of the property. A preliminary plat is attached to
this report.
· An appraisal of the Property has been prepared within six months of closing by
Miller Long & Associates, LLC, a Virginia licensed appraiser who meets Uniform
Standards of Professional Appraisal Practice (USPAP) standards. Excerpts of
the appraisal are attached to this report.
· A Title Exam has been prepared by Land Records Research, LLC showing title
vested in the seller of the properties and that upon closing, Roanoke County will
hold an unencumbered fee simple interest in the property, subject to easements
and encumbrances of record.
· A Preliminary Title Commitment from Fidelity National Title Insurance Company.
In accordance with the VOF Forest CORE Fund grant requirements, should the Board
of Supervisors act favorably upon consideration of the land acquisition, Roanoke
County will need to convey an open-space easement on the 304 acres designating the
property in perpetuity as open-space land in accordance with the Open-Space Land Act
(Virginia Code § 10.1-1700 et seq.) including Section 10.1-1701 of the Code of Virginia
(1950), as amended. In addition, restrictions will be imposed in perpetuity set forth in a
deed of easement to be granted to VOF providing permanent forest protection. At the
time the Board Report is being submitted, VOF has not provided County staff with the
proposed deed of easements. However, the terms will be those terms outlined in the
attached Grant Agreement, and in summary as follows: (a) permanent protection of the
forest areas and (b) further permanent protection of the property.
FISCAL IMPACT:
The total anticipated project cost is approximately $650,054. The property owners have

agreed to sell the land for $610,000 and there is approximately $40,000 in land
acquisition expenses such as a boundary survey, appraisal, title exam, environmental
assessments, closing expenses, forestry management plan and a natural resource
inventory.
The Board of Supervisors accepted and appropriated $620,054 from the VOF Forest
CORE Fund grant program (no local match requirement) and $30,000 from the Read
Mountain Alliance for the purchase of land, easements and acquisition costs on
February 11, 2020.
The property will be used for passive recreation, specifically hiking trails. The trails will
be built by volunteers and maintenance of the trails will be shared between Roanoke
County staff and volunteers. The annual maintenance costs will be less than $2,000.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of the ordinance and scheduling the
second reading for November 17, 2020.

WHEREAS, Matilda Holland Bradshaw, Trustee of a Trust Agreement Dated
November 27, 1982, Matilda Holland Bradshaw, Ida Mae Holland Perkins, Andrews

acre parcel being $554,470.00; and
WHEREAS, the Virginia Outdoors Foundation has awarded Roanoke
County $620,054.00 from the Forest CORE Fund grant program for the acquisition and
protection of both parcels; and

WHEREAS, in accordance with the VOF Forest CORE Fund grant requirements,
Roanoke County ase of the parcels) shall convey an open-
space easement on the two parcels designating the property in perpetuity as open-
space land in accordance with the Open-Space Land Act (Virginia Code § 10.1-1700 et
seq.) including § 10.1-1701 of the Code of Virginia (1950), as amended; and
WHEREAS, in accordance with the VOF Forest CORE Fund grant requirements,
Roanoke County shall agree to certain
restrictions to be imposed in perpetuity set forth in a deed of easement to be granted to
the VOF providing permanent forest protection; and
WHEREAS, there is no local match required for the grant, and Read Mountain
Alliance has also pledged $30,000.00 towards the project cost, with their fiscal agent
being the Blue Ridge Land Conservancy; and
WHEREAS, on February 11, 2020, the Board of Supervisors appropriated
$620,054.00 from the VOF Forest CORE Fund grant program and $30,000.00 from the
Read Mountain Alliance for the purchase of the land, easements, and acquisition costs;
and
WHEREAS, the two parcels will be used in the same manner as the current
Read Mountain Preserve, and will be owned and maintained by Roanoke County for
outdoor recreation, open-space, and forestry protection in perpetuity for year-round
public access; and
WHEREAS, the County has facilitated and reviewed an environmental
assessment, an ALTA/ASTM survey, an appraisal, and a title exam on the property; and

WHEREAS, the Board of Supervisors of Roanoke County has determined that it
is in the public interest to acquire these properties; and
WHEREAS, § 18.04 of the Roanoke County Charter directs that the acquisition
and conveyance of real estate interests be accomplished by ordinance; the first reading
of this ordinance to be held on November 4, 2020, and the second reading to be held on
November 17, 2020;
NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the acquisition of approximately 27.6962 acres located in Roanoke
County, Virginia (Tax Map No. 028.00-01-08.00-0000) is hereby authorized
and approved at the purchase price of $55,530.00.
2. That the acquisition of approximately 276.5393 acres located in both
Roanoke County, Virginia (Roanoke County Tax Map No. 028.00-01-09.00-
0000) as well as Botetourt County, Virginia (unidentified on the land records
of Botetourt County) is hereby authorized and approved at the purchase price
of $554,470.00.

ISSUE:
Mr. Dallas J. Wright, through his attorney James T. Jordan, is requesting that Roanoke
County grant a 20 foot wide access easement over the property identified as Tax Map #
064.04-03-01.00-0000 (vacant), which is owned by the Roanoke County Board of
Supervisors for the purpose of an access road to Poor Mountain Road, for the benefit of
a parcel identified as Tax Map # 064.02-02-56.00-0000 with an address of 5057 Poor
Mountain Road in the Catawba Magisterial District.
BACKGROUND:
Mr. Dallas J. Wright, through his attorney James T Jordan, is requesting that Roanoke
County grant an easement for ingress and egress on behalf of Mr. Dallas Wright. Mr.
Wright was conveyed title to property located at 5057 Poor Mountain Road by deed in
2002. The property currently does not have legal access to Poor Mountain Road. Mr.
Wright has used an access road that crosses several surrounding parcels, including
property owned by the Roanoke County Board of Supervisors, throughout his 18-year
ownership of the property.
Mr. Wright is currently in the process of attempting to sell the property and is seeking a
right-of-way to provide access to and from Poor Mountain Road. Mr. Wright is

specifically requesting an easement for ingress and egress over the property identified
as Tax Map # 064.04-03-01.00-0000, a vacant parcel owned by Roanoke County.
Mr. Wright provided a professional land easement survey (see attached) to
Development Services. The provided survey identifies the proposed easement as
064.02-02-56.00-stern
corner of the Roanoke County property.
DISCUSSION:
Staff has discussed the request with Mr. Wright, has reviewed the survey provided, and
has determined that the proposed access easement will have a minimal amount of
impact on the County-owned property. Staff also discussed and agreed with Mr. Wright
to recommend approval of a non-exclusive perpetual right-of-way over, under and
across that tract or parcel of land owned by Roanoke County.
There have been no changes since the first reading held on October 22, 2020.
FISCAL IMPACT:
No funding from Roanoke County will be required for this request. Mr. Wright will be
responsible for recording the easement agreement.

WHEREAS, David Bergeron was employed by Roanoke County on November 24,
2012; and served as a Parks Maintenance Worker and Motor Equipment Operator I, and
WHEREAS, Mr. Bergeron retired on April 1, 2020, after thirteen (13) years and three
(3) months of devoted, faithful and expert service to Roanoke County; and
WHEREAS, Mr. Bergeron, through his employment with Roanoke County in the
Parks, Recreation and Tourism Department has been instrumental in providing expert
maintenance for Park grounds and amenities, greenways, and ballfields: and
WHEREAS, throughout Mr. Bergerons tenure with Roanoke County, provided
professional and qualified support for Parks response for snow removal and outdoor
emergencies at county facilities, and provided staunch support to Roanoke County Special
Events and Regional Sports Tournaments which has improved the quality of life to the
citizens of Roanoke County; and
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke

SUPERVISORS OF ROANOKE COUNTY TO JONATHAN CLIFTON,
DEPUTY SHERIFF-SERGEANT-COURT SERVICES, UPON HIS RETIRE-
MENT AFTER TWENTY-THREE (23) YEARS OF SERVICE
WHEREAS, Johnathan Clifton was employed by Roanoke County on January 20,
1997; and
WHEREAS, Mr. Clifton retired on February 1, 2020, after twenty-three (23) years of
devoted, faithful and expert service to Roanoke County; and
WHEREAS, Mr. Clifton, through his employment with Roanoke County, has been
instrumental in improving the quality of life and providing services to the citizens of
Roanoke County; and
WHEREAS, throughout tenure with Roanoke County, he has served as
a Deputy Sheriff-Care/Confinement, Deputy Sheriff-Sergeant, and Deputy Sheriff-Sergeant
(Court Services); and
so with exceptional dedication and determination to ensure that he provided the highest
level of service possible. Mr. Clifton served as a mentor to many new Deputy Sheriffs in
every facet of his job. His experience and knowledge provided a strong foundation for
these new employees to grow and excel in their careers. He served at length as the
and Departmental training, as well as
mentoring new recruits and veteran staff alike. Mr. Clifton is well known for his outstanding
work as the Sergeant of the Juvenile and Domestic Relations Court. During his tenure, he
was instrumental in helping develop the First Offenders Program. This program explains to

first time juvenile offenders just how incarceration in the local jails and state penitentiaries
is managed and is offered in an attempt to change the path that they are currently
experiencing. Mr. Clifton will be missed by his colleagues and leaves behind a magnificent
legacy of well-deserved respect and outstanding service; and
WHEREAS, Mr. Clifton plans on continuing his career in law enforcement, he has
secured a position as a police officer for Carillion Hospital in Roanoke. His vast experience
will serve him well in this new endeavor and his colleagues wish him the best in this new
position.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke

WHEREAS, Cyd Walters was employed by Roanoke County on May 1, 1974 and
WHEREAS, Ms. Walters retired on July 1, 2020, after thirty-three (33) years of
devoted, faithful and expert service to Roanoke County; and
WHEREAS, Ms. Walters, through her employment with Roanoke County served as
Library Page Part-time, Library Assistant, Library Assistant I, Library Assistant II, and
Senior Library Assistant and has been instrumental in improving the quality of life and
providing services to the citizens of Roanoke County; and
WHEREAS, througho tenure with Roanoke County, she displayed
effortless joy in serving all of our patrons. For many she was their go-to readers advisory
solution. She brought a lot of entertainment to the technology classes she taught or co-
taught. With passport services, she was exemplary in customer service and keeping our
facility organized and up to standards. For many years she organized the volunteers,
maintained the book donation process, and played a huge role in making library book sales
successful. During her time in the Materials Management unit, Cyd placed materials and
supply orders, helped track materials spending, worked efficiently and professionally with
vendors, and assisted with database projects and materials processing for the entire
Library system. Cyd was particularly helpful with telework and team building projects, and
our popular virtual trivia program during the early stages of the pandemic shut down.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke

or association of providers of children or family services, or its designee shall be
appointed by the Board of Supervisors for a three-year term.
DISCUSSION:
The Roanoke County Community Policy and Management Team (CPMT) has
recommended Renee Brown with DePaul Community Resources be approved for an
additional three-year term as the Directors Designee and Trista Thompson as Alternate.
These appointments would expire on June 30, 2023.

Cave Spring Volunteer Fire Department

ISSUE:
A request to donate a Roanoke County surplus vehicle to the Cave Spring Volunteer
Fire Department.
BACKGROUND:
From time to time, other local governmental/not for profit agencies have requested the
donation of surplus vehicles from Roanoke County, and the County has generally
honored these requests. Cave Spring Volunteer Fire Department uses the Roanoke
County Fleet Service Center to repair its vehicles.
DISCUSSION:
Cave Spring Volunteer Fire Department is requesting that the County donate a surplus
2007 Chevy Suburban with over 109,000 miles for its use. It is anticipated that the
vehicle will be used for emergency response.
The vehicle will be returned to Roanoke County for sale at surplus auction, with the
proceeds going to the County. There is no internal need for the vehicle.
FISCAL IMPACT:
While there is no direct cost to the County, the value of the vehicle at surplus is

estimated to be approximately $5,000.

Request to accept donation of a recycle trailer from Cox Communications
BACKGROUND:
In 2005, Roanoke County initiated a mobile drop-off recycling program through a
cooperative agreement with Hollins University. Since that time the program has
expanded to also include an additional trailer at Hollins, two trailers near the
Brambleton Center, two trailers at Cox Communications, one trailer at William Byrd
participation in the mobile drop off program has grown since its inception.
The expanded recycling program was due in part to the provision of a drop-off location
and donation of a trailer to the County by Cox Communications in 2008, as a part of
their Cox Conserves environmental program. This program prioritizes positive
environmental change both within their company and the communities they serve. Cox
Communications has corporately invested over one hundred million dollars in
sustainability and conservation projects, to include initiatives related to emissions, water
conservation and landfill impacts.

DISCUSSION:
The trailers originally purchased were gravity dump trailers and were segmented for the
various materials. In an effort to improve efficiency and to facilitate the change to single
stream recycling, Roanoke County is replacing trailers at the end of their useful life with
ones that are larger, dump hydraulically and have single compartments to handle all
materials. The hydraulic dump style trailers are safer, more efficient, and provide some
increased capacity for high demand locations. Cox Communications continues their
partnership and investment in recycling by providing use of their property on Fallowater
Lane as a drop-off location for all County citizens and purchasing another trailer for this
location to help with the increased utilization. The price of the new trailer is $13,819.
With the purchase of this trailer, there will be two Cox Conserves trailers at their
location, as well as one County owned trailer. This third trailer will help handle the
heavy flow of traffic at this site.
Solid Waste employees will continue to be responsible for hauling the recyclable
materials to the processor and maintenance of the trailer and site. The trailer matches
the specification requirements of the County.
FISCAL IMPACT:
Acceptance of the donated trailer reduces capital investment by the County for a trailer
that would be necessary in order to continue providing comparable recycling drop-off
opportunities.
STAFF RECOMMENDATION:
Staff recommends acceptance of the donated recycling trailer from Cox
Communications.

Review fiscal year 2020-2021 first quarter (through September 30, 2020) financial
information with the Board of Supervisors.
BACKGROUND:
The fiscal year 2020-2021 budget was developed based on economic uncertainties that
were expected to impact various revenue categories. The attached presentation
provides information on revenues and expenditures through the first quarter (September
30, 2020) of fiscal year 2020-2021.
DISCUSSION:
This time has been scheduled to discuss fiscal year 2020-2021 first quarter financial
information. While first quarter information provides a beginning estimate for trends in
the current year, the majority of some revenue sources have not yet been received as
they are collected only at certain intervals or are received a month to two months
delayed. The attached PowerPoint presentation will be shown.

The County of Roanoke received two allocations of $8,217,365 each from the
Commonwealth of Virginia as part of the Coronavirus Aid, Relief, and Economic
Security (CARES) Act of 2020.
DISCUSSION:
This work session will provide additional detailed information to the Board of
Supervisors on the budgets developed for the allocations of CARES Act funding.

There is no fiscal impact associated with the receipt of the attached presentation.
