Good afternoon and welcome to our meeting for May 25, 2021. Regular meetings are
held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at 7:00
p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced.
Because of the present state of emergency, and until further notice, members of
the public are urged not to attend Board of Supervisor meetings in person. All
are encouraged to view and participate in meetings through electronic means.

BACKGROUND:
The first reading of this ordinance is accomplished by adoption of this ordinance in the
manner of consent agenda items. The adoption of these items does not imply approval
of the substantive content of the requested zoning actions; rather, approval satisfies the
procedural requirements of the County Charter and schedules the required public
hearing and second reading of these ordinances. The second reading and public
hearing on this ordinance is scheduled for June 22, 2021.
The title of this ordinance is as follows:

ISSUE:
Ordinance approving a lease with Ft. Lewis Mountain Company, LLC for ingress and
egress on a private road to access communications and information technology
equipment
BACKGROUND:
The original lease was written on May 31, 1996, and provides access to the Roanoke
County radio system which provides coverage to the Roanoke Valley P25 radio system.
DISCUSSION:
The term of the lease shall be for a period of five (5) years and then automatically renew
at the expiration of the five (5)-year term for successive one (1)-year terms.
There have been no changes since the first reading of the ordinance on May 11, 2021.
FISCAL IMPACT:
Annual payments of seven thousand dollars ($7,000), to begin upon the execution of
this agreement and will be payable on each anniversary thereafter. Annual payment
shall be increased every five years by a percentage equal to the percentage increase in

the Roanoke County real estate taxes assessed against the parcel over which the road
runs is 10% higher than real estate taxes assessed against the parcel in 2021, then the
annual payment due hereunder would be increased by 10%, effective upon written
notice from Fort Lewis Mountain Company, LLC., to Roanoke County.

AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION
CENTER ON TUESDAY, MAY 25, 2021
ORDINANCE APPROVING A LEASE WITH FORT LEWIS MOUNTAIN
COMPANY, LLC FOR INGRESS AND EGRESS ON A PRIVATE ROAD
TO ACCESS COMMUNICATIONS AND INFORMATION TECHNOLOGY
EQUIPMENT
WHEREAS, the County provides public safety services to its citizens and needs
to place various communications equipment at non-County locations to facilitate
communications, particularly public safety communications, throughout the County; and
WHEREAS, given the topography of the County, such equipment is most
effective when placed on elevated locations, such as mountain peaks; and
WHEREAS, the County has identified Fort Lewis Mountain as a viable and
necessary spot for placement of COMM-IT equipment to support the public safety radio
system; and
WHEREAS, no public road or other viable means of access exists to reach the
COMM-IT equipment atop Fort Lewis Mountain other than the private road
owned by FLMC; and
WHEREAS, the County has re-negotiated a long-standing contract with FLMC, a
County landowner, for a non-exclusive easement on the FLMC private road to access
such equipment; and
WHEREAS, such a lease will provide tangible and intangible benefits to the
County as it provides public safety services to persons in the County;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of Sections 2.01 and 2.03 of the Charter of
Roanoke County, the County is authorized to acquire property, including the lease of
real estate; and,

2. That pursuant to the provisions of Section 18.04 of the Charter of
Roanoke County, the acquisition of any interest in real estate shall be accomplished by
ordinance, the first reading of this ordinance was held on May 11, 2021, and the second
reading of this ordinance was held on May 25, 2021.
3. That the execution of a Lease Agreement (with Fort Lewis
Mountain Company, LLC, to lease a certain parcel of land on Fort Lewis Mountain is
authorized.
4. That the lease term shall commence on June 1, 2021, and continue
through December 31, 2026, unless terminated as provided in the Agreement.
5. That the rent shall be $7,000 annually during the term of the Agreement.
6. That the County Administrator, or an Assistant County Administrator, is
authorized to execute such documents and take such actions on behalf of the Board of
Supervisors in this matter as are necessary to accomplish the lease of this property, all
of which shall be approved as to form by the County Attorney.
8. That this ordinance shall be effective on and from the date of its adoption.

September 26, 2024. Confirmation has been placed on the Consent Agenda.

expired effective June 30, 2019.

Court from the Commonwealth of Virginia.
BACKGROUND:
The postage allocation represents a request to the Compensation Board to help offset
postage costs.
DISCUSSION:
The funds received from the Commonwealth of Virginia have been earmarked for
postage needs.
FISCAL IMPACT:
All funds are provided by the Commonwealth of Virginia. No County matching funds are
required.
STAFF RECOMMENDATION:

ISSUE:
A request to donate a surplus Roanoke County vehicle to the Masons Cove Civic Club
BACKGROUND:
From time to time, other local governmental/not for profit agencies have requested the
donation of surplus vehicles from Roanoke County, and the County has generally
honored these requests. The Masons Cove Civic Club is requesting that the County
donate a surplus 1999 Dodge Ram 3500 truck with 12,589 miles to their organization.
The club would like to obtain this truck as historical memorabilia to preserve the history
of the Masons Cove Fire and Rescue Station for their community. This vehicle was
purchased, maintained and serviced by the volunteers at the station until it was recently
transferred to the County. Due to the condition and age of this vehicle, there is not a
need for it within the County and it also does not have a high resale value.
FISCAL IMPACT:
While there is no direct cost to the County, the value of the vehicle at surplus is
estimated to be $2,000 to $2,500.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors donate the 1999 Dodge Ram 3500 to

ISSUE:
This time has been set aside to review the CARES Act final expenditures and provide
an overview of the American Rescue Plan Act
BACKGROUND:
The County of Roanoke received $16,434,730 from the Commonwealth of Virginia as
part of the Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020.!
In addition, on March 11, 2021, the American Rescue Plan Act was signed into law
which provides the Coronavirus Local Fiscal Recovery Fund to provide significant
funding resources to local governments to aid in their response to the COVID-19 public
health emergency and its economic impacts.
DISCUSSION:
This work session will provide information on the final expenditures for the CARES Act
funding and an overview of the American Rescue Plan Act.
FISCAL IMPACT:
There is no fiscal impact associated with the receipt of the attached presentation.

RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, theBoard of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each member’s knowledge:
1. Only public business matters lawfully exempted from open meeting requirements
by Virginia law were discussed in the closed meeting which this certification resolution
applies;and
2. Only such public business matters as were identified in the motion convening the
closed meeting were heard, discussed or considered by the Board of Supervisors of
Roanoke County, Virginia.
