HomeMy WebLinkAbout07/12/2022 - Adopted Board RecordsAT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON JULY 12, 2022 RESOLUTION 071222-1 RECOGNIZING CMDR. RICHARD M. POINDEXTER FOR HIS EXEMPLARY SERVICE TO ROANOKE COUNTY WHEREAS, In July, 1994, Richard M. Poindexter was hired as a police officer for the Roanoke County Police Department, where he has served in an exemplary manner; MT WHEREAS, Cmdr. Poindexter was promoted to sergeant in December 2003 and Commander in December 2014 and has supervised a variety of units within the Police Department since that time; and WHEREAS, Cmdr. Poindexter was assigned as the A Platoon Commander in October 2017 when he was also designated as the Deputy Incident Commander for the Police Department response to the Mountain Valley Pipeline project. During this assignment, he helped plan the County's response to the pipeline, working with County Administration and other government officials both within and outside of Roanoke County. WHEREAS, Cmdr. Poindexter was assigned as commander of the Professional Standards Unit in October 2018, where he has been responsible for recruiting and selection of employees, policy development, accreditation compliance and internal affairs investigations, amongst other duties; WHEREAS, Cmdr. Poindexter led the revision of the Police Department's use of force policies and transition to the 6t" Edition standards of the Commission on Accreditation for Law Enforcement Agencies; and WHEREAS, Cmdr. Poindexter led an employee group charged with developing Page 1 of 3 guidelines for the implementation of the Police Department's pay step plan in 2021 and subsequently implemented those guidelines; and WHEREAS, Cmdr. Poindexter has been assigned to investigate a number of significant and complex employee issues and disciplinary matters, which were done in a thorough, professional and efficient manner earning recognition and praise from County Administration, Human Resources Department and County Attorney's Office; and WHEREAS, Cmdr. Poindexter was appointed as Acting Assistant Chief of Police for Administration in April 2022 where he has successfully and effectively supervised the Professional Standards Unit, Roanoke County Criminal Justice Academy, Services Division and Crime Prevention Coordinator; and WHEREAS, Cmdr. Poindexter's 28 years of service to the Roanoke County Police Department have contributed greatly to the safety of our citizens and effectiveness of the Police Department. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Cmdr. Richard M. Poindexter for his dedicated and exemplary service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for continued success in the future. Jacks Chief Deputy Cle k tp4he Board of Supervisors Page 3 of 3 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, JULY 12, 2022 ORDINANCE 071222-2 AUTHORIZING THE ACQUISITION OF AN EASEMENT ACROSS PROPERTY OWNED BY TECHNOLOGY DR I LLC (TAX MAP NO: 064.02-02-50.00-0000) FOR PURPOSES OF INGRESS AND EGRESS TO AN ADJACENT PARCEL OWED BY THE ROANOKE COUNTY BOARD OF SUPERVISORS (TAX MAP NO: 064.02-02-50.06- 0000), IN THE CATAWBA MAGISTERIAL DISTRICT WHEREAS, Technology DR I LLC owns an 8.459 acre parcel, located at 6410 Technology Drive in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.00-0000 (hereinafter referred to as the "subject property"); and WHEREAS, the Board of Supervisors of Roanoke County, Virginia owns a 5.81 acre parcel, located at 0 Technology Drive in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.06-0000, which is immediately adjacent to the subject property, and which is landlocked (hereinafter referred to as the "County's adjacent property"); and WHEREAS, by deed dated January 21, 2000, the Economic Development Authority of Roanoke County, Virginia (referenced by that deed as the Industrial Development Authority of Roanoke County, Virginia) reserved for itself, its successors and assigns, including the Board of Supervisors of Roanoke County, Virginia, a perpetual easement across the subject property for the purpose of ingress and egress to a stormwater management facility located on the County's adjacent parcel (hereinafter referred to as the "2000 Easement"); and WHEREAS, by instrument dated October 26, 2020, the Economic Development Authority of Roanoke County, Virginia and the prior owner of the subject property (VALLEY TECHPARK PARTNERS, LLC) executed an amendment to the easement Page 1 of 3 across the subject property by establishing a specific location of the easement in order to facilitate the prior owner's development plans of the subject property (hereinafter referred to as the "2020 Easement Amendment"); and WHEREAS, the Board of Supervisors of Roanoke County, Virginia was not a party to the 2020 Easement Amendment; and WHEREAS, in order to facilitate their development purposes, Technology DR I LLC desires to vacate the easement granted to the Board of Supervisors of Roanoke County, Virginia established by the 2000 Easement and to grant a new easement for stormwater management and access purposes to the Board of Supervisors of Roanoke County, Virginia; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; and WHEREAS, the first reading of this ordinance was held on June 28, 2022, and the second reading was held on July 12, 2022. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the vacation of a previous general easement to the Board of Supervisors on property located at 6410 Technology Drive (Tax Map No: 064.02-02-50.00- 0000) and the acquisition of a new twenty (20) foot wide easement as shown on the attached plat dated April 21, 2021, prepared by Parker Design Group, titled "EASEMENT PLAT FROM RECORDS FOR TECHNOLOGY DR I LLC SHOWING AN EXISTING STORMWATER MANAGEMENT AND ACCESS EASEMENT TO BE VACATED AND A NEW 20' WIDE STORMWATER Page 2 of 3 MANAGEMENT AND ACCESS EASEMENT TO BE CREATED LOCATED ON LOT 4A (8.459 ACRES) RESUBDIVISION OF LOT 4 OF VALLEY TECKPARK RECORDED IN PLAT BOOK 22, PG.193 CATAWBA MAGISTERIAL DISTRICT, ROANOKE COUNTY, VIRGINIA," is hereby authorized and approved. 2. That the County Administrator or the Deputy County Administrator are hereby authorized to execute a deed and any other incidental documents required for the approved vacation and acquisition and to take such actions on behalf of the County of Roanoke in this matter as are necessary or desirable to accomplish the approved vacation and acquisition, all of which shall be approved as to form by the County Attorney. 3. That this ordinance is to be in full force and effect upon its passage. Ms. Griffin was primarily assigned to the Public Safety Building, where she became a member of the departments there, but she was always willing to be flexible and help in other locations as needed. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to SHARON GRIFFIN for more than twenty-five (25) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. McPhail Jr. was employed by Roanoke County on August 15, 1994; and WHEREAS, Detective McPhail retired on June 1, 2021, after twenty-six (26) years and ten (10) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Detective McPhail, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Detective McPhail's tenure with Roanoke County, he achieved the rank of Police Officer II and the rank of Detective; and, WHEREAS, as he advanced through the ranks, Mr. McPhail protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol as a Field Training Officer and member of the Special Weapons and Tactics team (SWAT) and the Criminal Investigations Division. Mr. McPhail investigated incidents that involved fraud, internet crimes, property crimes and crimes against persons (homicides, sexual assaults, and assaults). Mr. McPhail served as a Polygraph Operator during his tenure in the Criminal Investigations Division. Mr. McPhail completed his service to the citizens of Roanoke County as a member of the Federal Bureau of Investigations Violent Crimes Task Force. He also assisted County volunteers and other jurisdictions with training and development. WHEREAS, Captain Parcell served on numerous capital improvement projects within the fire stations; and WHEREAS, Captain Parcell was instrumental in serving on fire truck and ambulance specification committees to improve technology and new designs to improve the functionality of equipment and apparatus being used to better serve the community. Smith was employed by Roanoke County on August 14,1995; WHEREAS, Commander Smith retired on January 1, 2021, after twenty-five (25) years and five (5) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, CommanderSmith, through his employmentwith Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Commander Smith's tenure with Roanoke County, he advanced through the ranks of Police Officer, Police Officer II, Sergeant, Lieutenant and finally to Commander; and WHEREAS, as he advanced through the ranks, Mr. Smith protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol, the Services Division and serving as the Roanoke County Criminal Justice Academy Director. Mr. Smith completed his service to the citizens of Roanoke County as the Director of the Roanoke County Criminal Justice Academy. WHEREAS, Mr. Smith also served on the Special Weapons and Tactics team (SWAT) for a number of years. During those years Mr. Smith initially started as a member of the team and progressed to become the Tactical Operations Commander. Within each Page 1 of 2 of these roles, Mr. Smith performed in an exemplary manner. He contributed his skills to the development and training of SWAT team members and to the growth of new recruits attending the Roanoke County Criminal Justice Academy. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to KEITH B. SMITH for more than twenty-five (25) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Caywood County Administrator Acceptance and allocation of $9,555 for the Bulletproof Vest Partnership Grant. BACKGROUND: The Bulletproof Vest Partnership (BVP), created by the Bulletproof Vest Partnership Grant Act of 1988 is a unique Department of Justice Initiative designed to provide a critical resource to state and local law enforcement. DISCUSSION: The Bulletproof Vest Partnership (BVP) has awarded the Roanoke County Sheriff's Office matching grants to assist in the purchase of protective vests. FISCAL IMPACT: The total amount of the grant awarded is $9,555, which includes a fifty percent (50%) match. U.S. Department of Justice grant funds total $4,777.50 and the County match of $4,777.50 was appropriated by the Board of Supervisors in the fiscal year 2022-2023 Sheriff's office budget. No additional appropriation of County funds is required. Page 1 of 2 STAFF RECOMMENDATION: Staff recommends acceptance and allocation of grant funds in the amount of $9,555 to the Sheriff's office from the U.S. Department of Justice's Bulletproof Vest Partnership. Caywood County Administrator Confirmation of appointment of alternates BACKGROUND: Effective July 1, 2022, the charter for the Roanoke Valley -Alleghany Regional Commission was amended to change the number of members on this Commission. Roanoke County is limited to two elected officials and one citizen representative. The Board of Supervisors, by consensus, has recommended the appointment of alternates: F. Kevin Hutchins to a three-year term to expire June 30, 2025 as the elected alternate Richard L. Caywood to a three-year term to expire June 30, 2025 as the citizen alternate. STAFF RECOMMENDATION: Staff recommends confirmation of both alternates. Page 1 of 2 VOTE: Supervisor Peters moved to approve the appropriation. Supervisor North seconded the motion. Motion approved.
