Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order, a moment of silence was observed. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Mahoney called the meeting to order at 3:01 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Paul M. Mahoney; Supervisors Martha B. Hooker, Phil C. North, P. Jason Peters and David F. Radford MEMBERS ABSENT: None STAFF PRESENT: Richard L. Lubeck, County Attorney; Amy Whittaker, Public Information Officer and Deborah C. Jacks, Chief Deputy Clerk to the Board IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Resolution recognizing Cmdr. Richard M. Poindexter for his exemplary service to Roanoke County (Richard L. Caywood, County Administrator) Mr. Caywood and Chief Hall gave brief introduction and overview. The resolution was read by the Clerk. RESOLUTION 071222-1 RECOGNIZING CMDR. RICHARD M. POINDEXTER FOR HIS EXEMPLARY SERVICE TO ROANOKE COUNTY 708 July 12, 2022 WHEREAS, In July, 1994, Richard M. Poindexter was hired as a police officer for the Roanoke County Police Department, where he has served in an exemplary manner; and WHEREAS, Cmdr. Poindexter was promoted to sergeant in December 2003 and Commander in December 2014 and has supervised a variety of units within the Police Department since that time; and WHEREAS, Cmdr. Poindexter was assigned as the A Platoon Commander in October 2017 when he was also designated as the Deputy Incident Commander for the Police Department response to the Mountain Valley Pipeline project. During this assignment, he helped plan the County's response to the pipeline, working with County Administration and other government officials both within and outside of Roanoke County. WHEREAS, Cmdr. Poindexter was assigned as commander of the Professional Standards Unit in October 2018, where he has been responsible for recruiting and selection of employees, policy development, accreditation compliance and internal affairs investigations, amongst other duties; WHEREAS, Cmdr. Poindexter led the revision of the Police Department's use of force policies and transition to the 6th Edition standards of the Commission on Accreditation for Law Enforcement Agencies; and WHEREAS, Cmdr. Poindexter led an employee group charged with developing guidelines for the implementation of the Police Department's pay step plan in 2021 and subsequently implemented those guidelines; and WHEREAS, Cmdr. Poindexter has been assigned to investigate a number of significant and complex employee issues and disciplinary matters, which were done in a thorough, professional and efficient manner earning recognition and praise from County Administration, Human Resources Department and County Attorney's Office; and WHEREAS, Cmdr. Poindexter was appointed as Acting Assistant Chief of Police for Administration in April 2022 where he has successfully and effectively supervised the Professional Standards Unit, Roanoke County Criminal Justice Academy, Services Division and Crime Prevention Coordinator; and WHEREAS, Cmdr. Poindexter's 28 years of service to the Roanoke County Police Department have contributed greatly to the safety of our citizens and effectiveness of the Police Department. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Cmdr. Richard M. Poindexter for his dedicated and exemplary service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for continued success in the future. On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor Hooker and carried by the following recorded vote: July 12, 2022 709 AYES: Supervisors Peters, Hooker, North, Radford, Mahoney NAYS: None IN RE: BRIEFINGS 1. Briefing to update the Board of Supervisors on the grant application regarding School Resource Officers (SRO's) (Richard Caywood, County Administrator; Howard B. Hall, Chief of Police) Mr. Caywood provided overview; PowerPoint presentation is on file in the office of the Clerk to the Board of Supervisors. Supervisor Mahoney asked about the grant for the Town of Vinton. Supervisor Peters explained they are unable to apply for the grant. Supervisor Peters commented he has a problem with part-time. He prefers to see full-time officers. He is glad they have the same training. His concern not having full-time officers. Chief Hall advised he would prefer to hire full time, but they are not in a position to hire full time positions. SRO Officer have to be law enforcement certified. Supervisor North applauded staff for working on this so quickly. Supervisor Peters also thanked everyone involved. This may help bring folks to our area. As we are going through this process, are our Sheriff Deputies trained. Chief Hall explained a SRO has to be law enforcement certified. Supervisor Hooker stated she wanted to make sure that the pay is equalized. There should not be a difference for the same work, just a different uniform. Mr. Caywood advised they have met with the Sheriffs office. Supervisor Radford commented this is a great start, a lot of effort. So, you have picked eight (8) schools, what is the long term on the other seven (7) schools. The grant is for eight (8), however there are two deputies working for the Sheriffs Department to try and spend some time across all sixteen (16) elementary schools. As we hire, we will add in. Supervisor Radford then stated it appears to be very fluid, get the grant and then find people to hire. We don't know if we will have this by fall or not. Chief Hall stated they are aware of three (3) people who are interested, two (2) of them are retired from Roanoke County and thinks that would allow us to process them faster. Supervisor Mahoney asked with regard to the grant, he is assuming it is a specific sum as stated by the General Assembly. So, is this going to be a race that all the various localities are going to submit their applications and then they look and see they have more applications than funds appropriated. So, you may not get what we are asking for. Supervisor Mahoney asked if had a sense of where we will end up with Chief Hall responding he is having a little bit of a hard time figuring out the DCS Grants and which one this is. 710 July 12, 2022 Interestingly, about two or three days before this solicitation was published, he was in a meeting with the Secretary of Public Safety with some other police chiefs and one of the questions he asked was if there was a timeline for getting the applications out there. He advised they had not established a timeline yet. When the solicitation came out, it was worded oddly and references a second solicitation and he is not sure if this is left over money from the last fiscal year. Supervisor North confirmed the amount was around $46 million for the biennium. He thinks a lot of municipalities may not know about these or might miss the date because it is an aggressive date. So, the early bird might get the applications approved quicker. IN RE: FIRST READING OF ORDINANCES 1. Ordinance appropriating funds in the amount of$2,528,236 for the fiscal year 2022-2023 Operations Budget and approval of an amended Classification Plan for fiscal year 2022-2023 for Roanoke County, Virginia (Laurie Gearheart, Director of Finance and Management Services) Supervisor Mahoney inquired if the starting salary for Sheriffs Department was equal to Jailors. Ms. Owens responded a little higher than regional jail. Supervisor Peters stated as we are looking at the needs of the department, he inquired of Chief Hall if this is sufficient to where we need to be. Chief Hall responded this will put us ahead of the other agencies in the immediate area. He is not completely sure, if anything, any of them have done. The applicant pool is a trickle, but does not know what the magic number is. Supervisor Peters advised he just wanted to make sure we are in the ballpark. Supervisor Peters' motion to approve the first reading and set the second reading for July 26, 2022, was seconded by Supervisor Hooker and approved by the following vote: AYES: Supervisors Peters, Hooker, North, Radford, Mahoney NAYS: None 2. Ordinance approving a lease agreement with Oaklands Properties, LLC for parking purposes at Thompson Memorial Drive and East Main Street in the City of Salem, Virginia (Rachel Lower, Senior Assistant County Attorney) Ms. Lower outlined the request for ordinance. There was no discussion. July 12, 2022 711 Supervisor Hooker's motion to approve the first reading and set the second reading for July 26, 2022, was seconded by Supervisor Radford and approved by the following vote: AYES: Supervisors Peters, Hooker, North, Radford, Mahoney NAYS: None IN RE: SECOND READING OF ORDINANCES 1. Ordinance authorizing the acquisition of an easement across property owned by Technology DR I LLC (Tax Map No: 064.02-02- 50.00-0000) for purposes of ingress and egress to an adjacent parcel owned by the Roanoke County Board of Supervisors (Tax Map No: 064.02-02-50.06-0000) (Rachel Lower, Senior Assistant County Attorney) Ms. Lower advised there were no changes to the first reading. There was no discussion. ORDINANCE 071222-2 AUTHORIZING THE ACQUISITION OF AN EASEMENT. ACROSS PROPERTY OWNED BY TECHNOLOGY DR I LLC (TAX MAP NO: 064.02-02-50.00-0000) FOR PURPOSES OF INGRESS AND EGRESS TO AN ADJACENT PARCEL OWED BY THE ROANOKE COUNTY BOARD OF SUPERVISORS. (TAX MAP NO: 064.02-02-50.06- (1000), IN THE CATAWBA MAGISTERIAL DISTRICT WHEREAS, Technology DR I LLC owns an 8.459 acre parcel, located at 6410 Technology Drive in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.00-0000 (hereinafter referred to as the "subject property"); and WHEREAS, the Board. of Supervisors of. Roanoke County, Virginia owns a 5.81 acre parcel, located at 0 Technology Drive in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.06-0000, which is immediately adjacent to the subject property, and which is landlocked (hereinafter referred to as the "County's adjacent property"); and WHEREAS, by deed dated January 21, 2000, the Economic Development Authority of Roanoke County, Virginia (referenced by that deed as the Industrial Development Authority of Roanoke County, Virginia) reserved for itself, its successors and assigns, including the Board of Supervisors of Roanoke County, Virginia, a perpetual easement across the subject property for the purpose of ingress and egress to a stormwater management facility located on the County's adjacent parcel (hereinafter referred to as the "2000 Easement"); and 712 July 12, 2022 WHEREAS, by instrument dated October 26, 2020, the Economic Development Authority of Roanoke County, Virginia and the prior owner of the subject property (VALLEY TECHPARK PARTNERS, LLC) executed an amendment to the easement across the subject property by establishing a specific location of the easement in order to facilitate the prior owner's development plans of the subject property (hereinafter referred to as the "2020 Easement Amendment"); and WHEREAS, the Board of Supervisors of Roanoke County, Virginia was not a party to the 2020 Easement Amendment; and WHEREAS, in order to facilitate their development purposes, Technology DR I LLC desires to vacate the easement granted to the Board of Supervisors of Roanoke County, Virginia established by the 2000 Easement and to grant a new easement for stormwater management and access purposes to the Board of Supervisors of Roanoke County, Virginia; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; and WHEREAS, the first reading of this ordinance was held on June 28, 2022, and the second reading was held on July 12, 2022. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the vacation of a previous general easement to the Board of Supervisors on property located at 6410 Technology Drive (Tax Map No: 064.02-02- 50.00-0000) and the acquisition of a new twenty (20) foot wide easement as shown on the attached plat dated April 21, 2021, prepared by Parker Design Group, titled "EASEMENT PLAT FROM RECORDS FOR TECHNOLOGY DR I LLC SHOWING AN EXISTING STORMWATER MANAGEMENT AND ACCESS EASEMENT TO BE VACATED AND A NEW 20' WIDE STORMWATER MANAGEMENT AND ACCESS EASEMENT TO BE CREATED LOCATED ON LOT 4A (8.459 ACRES) RESUBDIVISION OF LOT 4 OF VALLEY TECKPARK RECORDED IN PLAT BOOK 22, PG.193 CATAWBA MAGISTERIAL DISTRICT, ROANOKE COUNTY, VIRGINIA," is hereby authorized and approved. 2. That this ordinance is to be in full force and effect upon its passage. Confirmation of appointment of alternates to the Roanoke Valley-Alleghany Regional Commission (At-Large) On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor North and carried by the following recorded vote: AYES: Supervisors Peters, Hooker, North, Radford, Mahoney NAYS: None A-071222-3.a 714 July 12, 2022 RESOLUTION 072122-3.b EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO SHARON GRIFFIN, CUSTODIAN, UPON HER RETIREMENT AFTER MORE THAN TWENTY-FIVE (25)YEARS OF SERVICE WHEREAS, Sharon Griffin was employed by Roanoke County on October 23, 1995; and WHEREAS, Ms. Griffin retired on August 1, 2021, after twenty-five (25) years and nine (9) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Ms. Griffin, through her employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Ms. Griffin's tenure with Roanoke County, she worked diligently to keep County facilities clean and safe for both employees and citizens. Ms. Griffin was primarily assigned to the Public Safety Building, where she became a member of the departments there, but she was always willing to be flexible and help in other locations as needed. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to SHARON GRIFFIN for more than twenty-five (25) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. MCPHAIL JR., POLICE OFFICER IV, UPON HIS RETIREMENT AFTER MORE THAN TWENTY-SIX (26) YEARS OF SERVICE WHEREAS, John L. McPhail Jr. was employed by Roanoke County on August 15, 1994; and WHEREAS, Detective McPhail retired on June 1, 2021, after twenty-six (26) years and ten (10) months of devoted, faithful and expert service to Roanoke County; and July 12, 2022 715 WHEREAS, Detective McPhail, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Detective McPhail's tenure with Roanoke County, he achieved the rank of Police Officer II and the rank of Detective; and, WHEREAS, as he advanced through the ranks, Mr. McPhail protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol as a Field Training Officer and member of the Special Weapons and Tactics team (SWAT) and the Criminal Investigations Division. Mr. McPhail investigated incidents that involved fraud, internet crimes, property crimes and crimes against persons (homicides, sexual assaults, and assaults). Mr. McPhail served as a Polygraph Operator during his tenure in the Criminal Investigations Division. Mr. McPhail completed his service to the citizens of Roanoke County as a member of the Federal Bureau of Investigations Violent Crimes Task Force. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JOHN L. MCPHAIL JR. for more than twenty-six (26) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Parcell was employed by Roanoke County on May 1, 1997; and WHEREAS, Captain Parcell retired on January 1, 2021, after twenty-three (23) years and eight (8) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Captain Parcell, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, Captain Parcell started his career with Roanoke County as a Paramedic/ Firefighter and promoted up through the ranks to the final rank of Captain. 716 July 12, 2022 WHEREAS, throughout Captain Parcell's tenure with Roanoke County, he was a respected and valued incident commander within the fire and rescue operational team. He also assisted County _ volunteers and other jurisdictions with training and development. WHEREAS, Captain Parcel) served on numerous capital improvement projects within the fire stations; and WHEREAS, Captain Parcel) was instrumental in serving on fire truck and ambulance specification committees to improve technology and new designs to improve the functionality of equipment and apparatus being used to better serve the community. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JERRY W. PARCELL for more than twenty-three (23) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. SMITH, POLICE OFFICER-COMMANDER- ACADEMY DIRECTOR, UPON HIS RETIREMENT AFTER MORE THAN TWENTY-FIVE (25)YEARS OF SERVICE WHEREAS, Keith B. Smith was employed by Roanoke County on August 14, 1995; and WHEREAS, Commander Smith retired on January .1, 2021, after twenty-five (25) years and five (5) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Commander Smith, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of.Roanoke County; and WHEREAS, throughout Commander Smith's tenure with Roanoke County, he advanced through the ranks of Police Officer, Police Officer II, Sergeant, Lieutenant and finally to Commander; and WHEREAS, as he advanced through the ranks, Mr. Smith protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol, the Services Division and serving as the Roanoke County July 12, 2022 717 Criminal Justice Academy Director. Mr. Smith completed his service to the citizens of Roanoke County as the Director of the Roanoke County Criminal Justice Academy. WHEREAS, Mr. Smith also served on the Special Weapons and Tactics team (SWAT) for a number of years. During those years Mr. Smith initially started as a member of the team and progressed to become the Tactical Operations Commander. Within each of these roles, Mr. Smith performed in an exemplary manner. He contributed his skills to the development and training of SWAT team members and to the growth of new recruits attending the Roanoke County Criminal Justice Academy. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to KEITH B. SMITH for more than twenty-five (25) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Davis for his service as a Director of the Authority IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS 718 July 12, 2022 Supervisor Radford thanked Jim Woltz for reupping for another four-years. He replaced him on the Planning Commission and here he is coming around as a Supervisor and reappointing him. Jim has been a great asset to our Planning Commission; he has a wealth of real estate knowledge and thinks he will continue to do well in that position. Supervisor Peters stated he is an advocate for Amtrak; as of yesterday they started with their second train in the evening and encourage anyone to get on there and have a great trip. He has said this throughout the years, he really appreciates the employees of Roanoke County. We can sit up here and legislate, but you are the ones that keep Roanoke County moving forward. He thinks that this Board has "put their money where their mouths are"with raises and step plans and everything we have done for our employees. He thanked all the employees. On the morning of July the 2nd in the Town of Vinton, we had a major fire that took out one of our historic buildings downtown and the rumor is they are not sure whether the second structure is going to stand or whether they will need to take it down. He commended the fire and rescue personnel from Vinton, Station #1, and Cave Spring sent the ladder truck. That building was something that as a fire and rescue member, we have trained on that building for 30 years. We have had all the tabletop exercise because those buildings downtown share common basements. So, that fire could have easily taken out half the block in downtown Vinton. They did a heck of job, used a million gallons of water, but they really a great job; long day. It was a hot day on Saturday, but they did a great job. Thanks to all those fire and rescue folks. Supervisor Hooker stated lately she has heard from several citizens in her district regarding Rt. 11/460 West. It's a corridor that has been improved; it is now four (4) lanes, it has sidewalks and soon on both sides and she would like to see what kind of help we could offer that corridor to help meet its economic potential. While there has been some progress, we need more and she knows that they are not alone; there are other corridors that may need similar attention and similar help. She requested a work session at some point in the future to discuss some possibilities on how can we incentivize and help some of these corridors to help their storefronts, business fronts or whatever we can to help these small businesses grow and bring in more. Supervisor Mahoney noted it was a good suggestion and wonder if we could partner with our Economic Development Authority. Maybe staff can come up with some plans. In the past, there is a grant program for signage, frontage, etc. Supervisor Peters stated several years ago we had a joint work session with the EDA and that may be something we want to revisit again so they can hear what we are looking for as well and brainstorm on ideas. Supervisor Mahoney asked staff to find some dates. Supervisor North stated he was there along with staff yesterday at the arrival of the second Amtrak train at 1:00 p.m. It was well attended with local dignitaries, State Senators, Delegates, City Council, Botetourt and Roanoke County July 12, 2022 719 were represented. The train returned at 4:30 p.m. and one of the highlights of the day was seeing an old college friend as his dad also worked for the railroad many years ago. In addition, last Thursday, he was placed on the 181 Advisory Council, which had its first meeting to elect officers, first meeting in about 15 months, and the Secretary of Transportation, Shep Miller, was there and he got to meet with him and also at that meeting we elected a chair and vice chairman. Dr. Smoot was there and nominated Terry Austin of the 181 Committee. Terry is also the Chairman of the Transportation Committee and Vice Chairman of the Appropriations Committee. So, the second person nominated for Vice Chairman was delegate Tony Wilt of Rockingham County and a well-attended meeting for the first time; represented by all six planning districts on the corridor was represented. Supervisor North then shared several slides that show some impacts locally along the 181 Corridor. These slides are on file in the office of the Clerk to the Board of Supervisors and come from the 181 Corridor Improvement Plan. Supervisor Mahoney stated the Board may recall that we had a group of citizens expressing their concerns from White Pelican, a street in Cave Spring about a drug treatment facility. He knows our County Attorney, Mr. Lubeck was looking into that and Mr. Lubeck is out this week. He would encourage the County Attorney's office to assist Mr. Lubeck in the analysis. We owe the citizens on White Pelican a response. He knows we are trying to get some more information from Pinnacle as to the scope and extent of the activities there. His understanding is some of the patients have moved into the house on White Pelican. It is an issue that is concerning a lot of citizens on that street. He hopes we can accelerate our response to the citizens so they get an answer. Chairman Mahoney recessed to the third floor for work session at 4:21 p.m. IN RE: WORK SESSIONS 1. Joint work session with the Roanoke County Board of Supervisors; Roanoke County School Board and the Roanoke County Career and Technical Advisory (CTE) Committee (Paul M. Mahoney, Chairman of the Board) Chairman Mahoney welcomed everyone and the School Board and CTE called their Boards to order. Chairman Altizer of the CTE Committee Altizer started the PowerPoint and then turned over to Craig Balzer and finally to Mr. Spangler of the CTE Committee. Gene Rose commented he has still not received the square footage numbers so they can compare with what is needed and does not agree with the Arts square footage. 720 July 12, 2022 Max Beyer stated he did not vote in agreement for what has been purposed. He felt there should have been a financial analysis done. He asked that be done and the Committee refused. The square footage was exactly what the schools asked for; no changes were made. The philosophy is "Build it and they will come." Wayne Bower thanked the two Boards for allowing the Committee. He just wants to make sure we get it right. School Board Chairman Linden announced the site selected a 23-acre site on Peters Creek Road that they hope will be the new CTE facility. Mr. Altizer announced the committee would do their research on solar. Next, Todd Kagles, Director of Facilities and Operations for Roanoke County Schools provided a presentation on the site selected. Dr. Nicely thanked the committee for the work that has been done. He is excited with the announcement on the new location. Discussion ensued regarding putting the performing arts in one of the schools versus CTE. Chairman Altizer asked who would contact the business community; Supervisor Mahoney stated as long as they know that both boards are supportive then CTE can move forward. Supervisor Peters suggested a Town Hall meeting at South County Library and invite the businesses so they can come and tell us what their needs are. School Board member Tim Greenway inquired if we need another joint meeting to discuss funding. It was the consensus staff from the schools and County staff would work on and advise.
