Good afternoon and welcome to our meeting for December 12, 2023. Regular meetings
are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at
7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Sunday from 10:00 a.m. until 5 p.m.
Board of Supervisors meetings can also be viewed online through Roanoke County's
website at www.RoanokeCountyVA.gov. Our meetings are closed -captioned, so it is
important for everyone to speak directly into the microphones at the podium. Individuals
who require assistance or special arrangements to participate in or attend Board of
Supervisors meetings should contact the Clerk to the Board at (540) 772-2005 at least
48 hours in advance. Please turn all cell phones off or place on silent.

The Economic Development Department is requesting the Board of Supervisors
recognize Lionberger Construction's 100th anniversary doing business in Roanoke
County.
BACKGROUND:
Lionberger Construction has been operating in Roanoke County since 1923.
DISCUSSION:
Lionberger Construction, a cornerstone of the construction industry based in Southwest
Roanoke County, is celebrating a century of unwavering commitment, dedication, and
excellence.
The history of Lionberger Construction, rooted in the principles laid out by S. Lewis
Lionberger, reflects a tradition of quality, craftsmanship, and a commitment to exceeding
clients' expectations.
From its humble beginnings in 1923 as John C. Center Construction to its current
incarnation as Lionberger Construction, the company has been a driving force in the
construction landscape, leaving an indelible mark on the Roanoke Valley.
Lionberger Construction has contributed significantly to the growth and development of

RESOLUTION RECOGNIZING MARIA WARD, ASSISTANT DIRECTOR
OF INFORMATION TECHNOLOGY, FOR HER EXEMPLARY SERVICE
TO ROANOKE COUNTY
WHEREAS, in April 2003, Maria Ward was hired by Roanoke County as the
Application Services Manager, and during her tenure was promoted to Assistant Director
of Information Technology in March 2019; and
WHEREAS, Maria has been responsible for leading all aspects of IT Operations,
including Infrastructure, Application, Enterprise, and GIS Services teams; and
WHEREAS, she has been responsible for strategic technology planning and
policies, project oversight, and training plans; and
WHEREAS, Maria has served in a leadership role for multiple projects including
Public Safety Systems - E911/CAD/Police/Fire records and mobile modules, Revenue
Systems - HP Migration to Windows SQL for replacement of Permitting, Enterprise GIS,
Revenue/Tax Billing, Cashiering, Real Estate Appraisal, School Personnel Budgeting and
Jury systems, Tyler Content Management, and Citizen Self Service bill
presentation/online credit card payments, and significant role in adoption of initial major
County vendor cloud -hosted applications, Lawson HR and Payroll and Parks, Recreation
and Tourism Max Galaxy; and
WHEREAS, she has researched and prepared security planning guidelines and
requests, in preparation for increasing cybersecurity challenges and funding
opportunities; and
WHEREAS, Maria worked tirelessly to lead a successful M365 rollout for 1,350
users across the organization, using phased module deployment approach which

includes coordinating vendor selection and management, project teams and
organizational communication for the multi -year project; and
WHEREAS, Maria's positive attitude and commitment to her work makes a
difference every day in many of Roanoke County's employees and citizens' lives.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of
Roanoke County to Maria Ward for her dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for continued
success in the future.

RESOLUTION OF APPRECIATION TO P. JASON PETERS FOR HIS
SERVICE AS A MEMBER OF THE BOARD OF SUPERVISORS FROM
2014 THROUGH 2023
WHEREAS, P. Jason Peters was first elected to represent the Vinton Magisterial
District on the Board of Supervisors of Roanoke County on January 1, 2014 and has
served through December 31, 2023; and
WHEREAS, during his tenure as a member of the Board, Supervisor Peters served
with exemplary professionalism and dedication, working on behalf of the people of his
district and all citizens of Roanoke County; and
WHEREAS, his leadership skills were recognized by his fellow Board members
when he was chosen to serve as Chairman of the Board of Supervisors in the years 2015,
2016 and most recently in 2021; and
WHEREAS, Supervisor Peters consistently focused on the best interests of not
just his district, but of the County as a whole, demonstrating a keen understanding of the
scope and complexity of issues facing local governments and a willingness to work
cooperatively toward viable, long-term solutions; and
WHEREAS, Supervisor Peters expressed unwavering advocacy for public safety,
911 operations and all County employees, which has been instrumental in enhancing the
well-being of our community. His commitment to ensuring a secure and resilient
environment is truly commendable; and
WHEREAS, Supervisor Peters recognized the importance of ensuring our
children's success and meeting the needs of the business community and was a strong

advocate of the Memorandum of Understanding with Roanoke County Public Schools to
fund $130 million for school capital projects, which includes a new Career and Technical
Education Center and renovations for two elementary schools; and
WHEREAS, Supervisor Peters supported economic development initiatives,
including, but not limited to:
• Redevelopment of Roland E. Cook School into 21 loft apartments by Old School
Partners, LLC
• Redevelopment of William Byrd High School into 80 market -rate apartments by
Waukeshaw Development, Inc.
• Sale of the former Vinton Library for a full -service Macado's restaurant
• Acquisition of the 110-acre Wood Haven Road properties through the Western
Virginia Industrial Facilities Authority
• Completion of the Reimagine 419 Town Center Study and community visioning
process.
• Revitalization of Tanglewood Mall and the Route 419 area
• Completion of Roanoke County's first -ever Community Strategic Plan
• Completion of the Explore Park Master Plan and multiple infrastructure
improvements.
• Multiple business locations and expansions including Wells Fargo, Carilion
Children's, Carilion Mental Health, AEP, VFP, PFG, Metis Plaza, Vistar Eye
Center; Cardinal Glass, and Mack Trucks
• New Bonsack Fire Station
• New Vinton restaurants — 107 South Pollard, Pok-E Joe's
WHEREAS, Supervisor Peters represented Roanoke County on numerous civic
and governmental committees, including the Audit Committee; Chief Local Elected
Officials Consortium, Roanoke Valley Regional Cable Television Committee and
Virginia's First Regional Industrial Facility Authority.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia, expresses its deepest appreciation and the appreciation of the citizens
of Roanoke County to P. JASON PETERS for his commitment to public service and the
many significant contributions he made as a member of the Board of Supervisors; and
FURTHER, the Board of Supervisors congratulates Supervisor Peters at the

AGENDA ITEM: Presentation of year-end financial results for June 30, 2023,
acceptance of audit report and allocation of year-end funds

ISSUE:
Accept audited financial results for the County of Roanoke and allocate year-end funds
for the fiscal year ended June 30, 2023.
BACKGROUND:
Brown Edwards and Company completed the audit of the financial operations of the
County of Roanoke for the year ended June 30, 2023. The County Audit Committee
met on December 12, 2023, to review the results of the year's operations. The County
received a clean and unmodified opinion. Staff from Brown Edwards and Company will
present the audit information to the Board at the meeting.
DISCUSSION:
On September 26, 2023, staff reviewed preliminary unaudited financial results for June
30, 2023, and there have been no changes since that work session.
Below is the information for the County regarding the General Government results of
operations for the fiscal year ended June 30, 2023.
Revenue collections were above the amended budget as a result of:
- Real Estate Taxes were $818,109 above budget due to new housing

developments, offset by a limited supply of existing housing options, which led
to increased sales prices and values. These increased revenues were offset by
a 3-cent decrease in the real estate tax rate.
- Personal Property Taxes were $286,896 above budget which was due to
increases in assessed values, offset by a 10-cent reduction in the personal
property tax rate, a 5-cent reduction in the machinery and tools tax rate, and a
one-time allocation of $3 million for additional personal property tax relief.
- Sales Tax was $190,182 above budget as consumer spending remained high
and showed consistent growth when compared to prior years. Sales prices
were also affected by increased inflation which further led to increased
revenues.
- Business License tax was $1.09 million above budget due to increased
consumer spending which led to continued high gross receipts. Business
License tax was also impacted by higher inflation.
- Meals Tax was $561,799 above budget due to several new restaurants, most
notably in the Tanglewood area, combined with inflationary impacts on higher
meal prices.
- Hotel/Motel Tax was $505,901 million above budget due to the increased return
of business travel and regional events.
- Other Revenues were $1.24 million above budget primarily as a result of an
increase in permits, fees and licenses and various miscellaneous revenues.
Expenditures savings were recognized as a result of:
- Personnel savings were under budget by $441,716 due to savings from attrition
and vacancies, offset by increased costs for public safety overtime and salary
compression adjustments which included the second year for the implementation
of the step plans for Fire & Rescue, Police, and Sheriff.
- Operating expenses were under budget by $170,159, but the County again saw
increased costs for fuel and higher costs for contractual services such as fleet
repairs.
- Transfers and other expenditures were below budget by $3.19 million which
included funds carried over from the prior fiscal year for contingencies due to the
continued economic uncertainty and high inflation seen during fiscal year 2023.

FISCAL IMPACT:
Budget Ordinance 051022-4 for the fiscal year 2022-2023 fiscal year Operations Budget
provides that all unexpended general government expenditures and revenues collected
in excess of budget shall not lapse but be re -appropriated and presented to the Board
for recommendations of allocations and designations based on the Comprehensive
Financial Policy.
General Government surplus revenue and expenditure savings are shown on
Attachment I and reflects the recommendations reviewed at the September 26, 2023
work session for the recommended allocation for fiscal year end June 30, 2023
available funds.
STAFF RECOMMENDATION:
Staff recommends accepting the audited financial results for the fiscal year ended June
30, 2023, allocating $382,042 for encumbrances from year-end savings and allocating
the available funds as presented in Attachment I.

Significant Audit Matters
Qualitative Aspects of Accounting Practices
Management is responsible for the selection and use of appropriate accounting policies. The significant
accounting policies used by the County are described in Note 1 to the financial statements. As described
in Note 1 to the financial statements, the County adopted a new accounting standard for 2023: GASB
Statement No. 96, Subscription -Based Information Technology Arrangements. The cumulative effect of
the accounting change as of the beginning of the year had an immaterial impact on net position. We
noted no transactions entered into by the County during the year for which there is a lack of
authoritative guidance or consensus. All significant transactions have been recognized in the financial
statements in the proper period.
Accounting estimates are an integral part of the financial statements prepared by management and are
based on management's knowledge and experience about past and current events and assumptions about
future events. Certain accounting estimates are particularly sensitive because of their significance to the
financial statements and because of the possibility that future events affecting them may differ
significantly from those expected. The most sensitive estimates affecting the financial statements were:
• The useful lives of capital assets and the allowance for uncollectible accounts are based on
management's knowledge and judgment, which is based on history.
• The other postemployment benefits liability is based on an actuarial study provided by the
County's external actuarial firm.
• The net pension liability and the net OPEB liability for state administered plans are based on
actuarial studies provided by actuaries engaged by the Virginia Retirement System.
• The self-insurance liability is based on information from an external third -party consultant and
subsequent claims information provided by the third -party administrator.

We evaluated the methods, assumptions, and data used to develop these estimates in determining that
the estimates are reasonable in relation to the financial statements taken as a whole.
Certain financial statement disclosures are particularly sensitive because of their significance to
financial statement users. The most sensitive disclosures affecting the financial statements are those
related to capital assets, long-term debt, commitments and contingencies, other postemployment
liabilities, and pension disclosures.
The financial statement disclosures are neutral, consistent, and clear.
Difficulties Encountered in Performing the Audit
We encountered no significant difficulties in dealing with management in performing and completing
our audit.
Corrected and Uncorrected Misstatements
Professional standards require us to accumulate all known and likely misstatements identified during the
audit, other than those that are clearly trivial, and communicate them to the appropriate level of
management. There were no corrected or uncorrected misstatements.
Disagreements with Management
For purposes of this letter, a disagreement with management is a financial accounting, reporting, or
auditing matter, whether or not resolved to our satisfaction, that could be significant to the financial
statements or the auditor's report. We are pleased to report that no such disagreements arose during the
course of our audit.
Management Representations
We have requested certain representations from management that are included in the management
representation letter dated November 27, 2023, a copy of which is attached.
Management Consultations with Other Independent Accountants
In some cases, management may decide to consult with other accountants about auditing and accounting
matters, similar to obtaining a "second opinion" on certain situations. If a consultation involves
application of an accounting principle to the governmental unit's financial statements or a determination
of the type of auditor's opinion that may be expressed on those statements, our professional standards
require the consulting accountant to check with us to determine that the consultant has all the relevant
facts. To our knowledge, there were no such consultations with other accountants.
Other Audit Findings or Issues
We generally discuss a variety of matters, including the application of accounting principles and
auditing standards, with management each year prior to retention as the County's auditors. However,
these discussions occurred in the normal course of our professional relationship and our responses were
not a condition to our retention.
Other Matters
We applied certain limited procedures to the management's discussion and analysis, the General Fund
budget to actual schedules, and the required pension and OPEB schedules which are required
supplementary information (RSI) that supplements the basic financial statements. Our procedures
consisted of inquiries of management regarding the methods of preparing the information and
comparing the information for consistency with management's responses to our inquiries, the basic
financial statements, and other knowledge we obtained during our audit of the basic financial statements.
We did not audit the RSI and do not express an opinion or provide any assurance on the RSI.
We were engaged to report on the additional budget to actual statements, the combining statements of
the internal service and custodial fund financial statements, the financial statements of the discretely
presented component units, and the schedule of expenditure of federal awards, which accompany the
financial statements but are not RSI. With respect to this supplementary information, we made certain
inquiries of management and evaluated the form, content, and methods of preparing the information to
determine that the information complies with accounting principles generally accepted in the United
States of America, the method of preparing it has not changed from the prior period, and the information
is appropriate and complete in relation to our audit of the financial statements. We compared and
reconciled the supplementary information to the underlying accounting records used to prepare the
financial statements or to the financial statements themselves.
We were not engaged to report on the introductory or statistical sections, which accompany the financial
statements but are not RSI. Such information has not been subjected to the auditing procedures applied
in the audit of the basic financial statements, and accordingly, we do not express an opinion or provide
any assurance on it.

SESSION OF THE VIRGINIA GENERAL ASSEMBLY AND PETITIONING
THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER THE
PRIORITIES ADDRESSED HEREIN
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified
legislative priorities of local and statewide concern to be considered during the 2023
session of the Virginia General Assembly; and
WHEREAS, the Board adopts this resolution setting forth its legislative priorities,
and respectfully petitions the General Assembly to favorably consider such.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, that the following five priorities are submitted for the General Assembly's
consideration during its 2024 session:
1. Education K-12 Funding
a. The County supports making additional state resources and grant funding
available to localities to support school capital needs, including rehabilitation
and upgrades to existing facilities as well as construction of new facilities.
b. The County urges the General Assembly to simplify the eligibility requirements
of the existing School Construction Assistance Program by basing grant
eligibility on the school divisions' local composite index value, the locality's level
of fiscal stress, and site readiness.
c. The County urges the General Assembly to provide economic development
workforce grants that could be used to fund career and technical education
capital projects.

2. Mental Health and Public Hospital Needs
a. The County urges the General Assembly to use available funds to continue the
operation and expansion of Catawba Hospital.
3. Airport Expansion
a. The County urges the General Assembly to provide funding for the Roanoke -
Blacksburg Regional Airport to support a needed runway extension and other
airport improvements to foster regional economic development.
4. Broadband Expansion
a. The County urges the General Assembly to use available state and federal
funding to improve access to and affordability of broadband, to promote the
goal of statewide coverage.
5. Children's Services Act
a. The County supports enhancing the ability of local school divisions to serve
children with disabilities, to include flexibility in use of state pool funds to serve
children with high-level needs in local or regional programs tailored to meet
those needs at a local option.
b. The County supports exploration of enhancements to the Students with
Intensive Support Needs Application (SISNA) or a similar funding mechanism
within the Department of Education to enable more children to be supported
within the public -school environment.
c. The County supports continued investment of state resources to assist in the
local administration of CSA programs.

ISSUE:
To facilitate the extension of water service to Wood Haven Technology Park, the
following Board actions are requested:
1. Accept and appropriate $820,000 for an Economic Development Initiative -
Community Project to the Grant Fund; and
2. Grant signatory authority to the County Administrator or his designee to execute
a grant agreement with HUD.
BACKGROUND:
Roanoke County and the Western Virginia Regional Industrial Facility Authority
(WVRIFA) are currently developing the Wood Haven Technology Park (hereinafter
referred to as "the Park") and are seeking to attract large-scale business operations to
the Park to create jobs which will benefit the entire Roanoke region. While the Park is
well -situated geographically and in relation to transportation infrastructure, the
boundaries of Interstates 81 and 5-81 limit access to water infrastructure. The Western
Virginia Water Authority (WVWA) currently provides water to the Park from a 12-inch
diameter water main located along Wood Haven Road, which may or may not be
adequate for future development.

In April of 2022, Roanoke County partnered with the WVRIFA and the WVWA to submit
a fiscal year 2023 Economic Development Initiative - Community Project Funding (CPF)
Appropriations Request to Virginia's 9th District Congressman Morgan Griffith in the
amount of $820,000 through the Consolidated Appropriations Act. The purpose of this
request was to help fund the construction of a waterline extension underneath Interstate
81, which will provide connectivity between an existing 16-inch diameter water main
located along Loch Haven Road and Wood Haven Technology Park and provide a
redundant connection and a larger quantity of available water supply. The proposed
project seeks to increase the water supply to the 110-acre Park, making the site
significantly more attractive to water -intensive business operations that may be
interested in establishing a facility in the Park. This project will make the region more
competitive for business investment and increase employment opportunities. It will
provide greater utility capacity to the Tier 4 Virginia Economic Development Partnership
Business Ready Site, enhancing the marketability of the property for one or more future
users.
DISCUSSION:
In March 2023, Roanoke County was awarded $820,000 in Community Project Funding
(CPF) for construction of the waterline extension underneath Interstate 81 to provide
connectivity between an existing water transmission line along Loch Haven Road and
Wood Haven Technology Park. The addition of a 400 linear foot 24-inch water main
crossing under Interstate 81 and a 40 linear foot 24-inch water main connection point
will provide the Park with a direct connection to the North Loop Transmission Main and
maximize available capacity. This additional connection will allow for the looping of the
water distribution system, which will provide for greater available fire flow for future
development, which is critical for safety. The CPF grant provides investments in a wide
variety of projects such as housing, public facilities, parks, and other critical
infrastructure.
The U.S. Department of Housing and Urban Development (HUD)'s Office of Community
Planning and Development, Congressional Grants Division is responsible for the
administration of congressionally -directed spending under the CPF. Roanoke County is
partnering with the Western Virginia Water Authority (WVWA) for delivery of the
waterline extension project. A Development Agreement is being negotiated outlining the
roles and responsibilities of the two entities for delivery of the waterline extension
project. The grant award of $820,000 will be appropriated by Roanoke County and
specifically used for construction of the waterline extension. The WVWA will administer
the design, engineering, permitting, right-of-way acquisition, and construction. Roanoke
County will serve as the responsible entity and grantee, and the WVWA will serve as a
grant subrecipient. The WVWA will own and maintain the waterline extension as an
addition to its water distribution system. Roanoke County will oversee the environmental
review process and provide funding for the environmental services through an existing

annual contract that has been procured for projects with federal funding and will not
seek reimbursement through the federal grant funds.
The WVWA has executed a contract with Whitman, Requardt, and Associates, LLP
(WRA) for engineering services for the Wood Haven Technology Park waterline
extension. Surveying and utilities investigation has begun. Construction of the waterline
underneath Interstate 81 is anticipated to begin in August 2024 and end in August 2025.
The grant agreement period of performance has an end date of August 31, 2031.
FISCAL IMPACT:
The $820,000 CPF grant is one -hundred percent (100%) federal funding with no local
match requirement. This project will be locally administered by Roanoke County,
necessitating acceptance and appropriation of this funding to facilitate project
reimbursement requests. The grant award of $820,000 will need to be appropriated by
Roanoke County and specifically used for construction of the waterline extension.
Roanoke County will serve as the responsible entity and grantee, and the WVWA will
serve as a grant subrecipient.
The total anticipated projects costs are $1,490,000 for planning, engineering, and
construction of the waterline extension. The anticipated costs of construction of the
waterline are $1,240,000. The WVWA will request reimbursement from Roanoke County
for construction expenses not to exceed $820,000. Roanoke County will process
payments to the WVWA and then submit reimbursement requests to HUD. The WVWA
will contribute $670,000 for the balance of the project costs as a match without seeking
reimbursement through federal grant funds. The Roanoke County Department of
Economic Development has also budgeted $21,915.24 for the project from funds
allocated for environmental services.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of an ordinance to:
1. Accept and appropriate $820,000 for an Economic Development Initiative -
Community Project to the Grant Fund; and
2. Grant signatory authority to the County Administrator, or his designee, to execute
the grant agreement with HUD.
Staff recommends that the second reading be scheduled for January 9, 2024.

This Grant Agreement between the Department of Housing and Urban Development (HUD) and
Roanoke County (the Grantee) is made pursuant to the authority of the Consolidated Appropriations
Act, 2023 (Public Law 117-328) and the Explanatory Statement for Division L of that Act, which was
printed in the Senate section of the Congressional Record on December 20, 2022 (Explanatory
Statement).
In reliance upon and in consideration of the mutual representations and obligations under this
Grant Agreement, HUD and the Grantee agree as follows:
ARTICLE I. Definitions
The definitions at 2 CFR 200.1 apply to this Grant Agreement, except where this Grant
Agreement specifically states otherwise.
Budget period is defined in 2 CFR 200.1 and begins and ends on the dates specified
above for the Period of Performance/Budget Period Start Date and Period of
Performance/Budget Period End Date.
Period of Performance is defined in 2 CFR 200.1 and begins and ends on the dates specified

ARTICLE II. Total Grant Amount
Subject to the provisions of the Grant Agreement, HUD will make grant funds in the amount
of $820,000 available to the Grantee.
ARTICLE III. Award -Specific Requirements
A. Federal Award Description. The Grantee must use the Federal funds provided
under this Grant Agreement (Grant Funds) to carry out the Grantee's "Project." Unless
changed in accordance with Article III, section C of this Grant Agreement, the Grantee's
Project shall be as described in the Project Narrative that is approved by HUD as of the
date that HUD signs this Grant Agreement. For reference, HUD will attach this approved
Project Narrative as Appendix 1 to the Grant Agreement on the date that HUD signs this
Grant Agreement.

B. Approved Budget. The Grantee must use the Grant Funds as provided by the
Approved Budget. Unless changed in accordance with Article III, section C of this Grant
Agreement, the Approved Budget shall be the line -item budget that is approved by HUD as of
the date that HUD signs this Grant Agreement. For reference, HUD will attach this approved
line -item budget as Appendix 2 to this Grant Agreement on the date that HUD signs this Grant
Agreement.
C. Project and Budget Changes. All changes to the Grantee's Project or Approved Budget
must be made in accordance with 2 CFR 200.308 and this Grant Agreement. To request HUD's
approval for a change in the Project or Approved Budget, the Grantee must submit a formal letter
to the Director of HUD's Office of Economic Development - Congressional Grants Division
through the assigned Grant Officer. The letter must be submitted by email to the assigned Grant
Officer and must provide justification for the change. The email submitting the letter must also
include a revised project narrative or revised line -item budget, as applicable, that includes the
requested change. The Grantee is prohibited from making project or budget changes that would
conflict with the Applicable Appropriations Act Conditions described in Articl e III, section D of
this Grant Agreement. The assigned Grant Officer for this grant is provided in the Award Letter
for this grant and found on HUD's website. The HUD Office of Economic Development —
Congressional Grants Division will notify the Grantee in writing, by email, whether HUD
approves or disapproves the change. Before the Grantee expends Grant Funds in accordance
with any change approved by HUD or otherwise allowed by 2 CFR 200.308, the Grantee must
update its grant information in Disaster Recovery Grant Reporting (DRGR) to reflect that
change.
D. Applicable Appropriations Act Conditions. The conditions that apply to the Grant
Funds as provided by the Consolidated Appropriations Act, 2023 and the Explanatory Statement
are hereby incorporated and made part of this Grant Agreement. In the event of a conflict
between those conditions, the conditions provided by the Act will govern. The Grant Funds are
not subject to the Community Development Block Grants regulations at 24 CFR part 570 or Title
I of the Housing and Community Development Act of 1974.
E. In accordance with 2 CFR 200.307(b), costs incidental to the generation of program
income may be deducted from gross income to determine program income, provided these costs
have not been charged to the grant. As authorized under 2 CFR 200.307(e)(2), program income
may be treated as an addition to the Federal award, provided that the Grantee uses that income
for allowable costs under this Grant Agreement. In accordance with 2 CFR 200.307(b), costs
incidental to the generation of program income may be deducted from gross income to determine
program income, provided these costs have not been charged to the grant. Any program income
that cannot be expended on allowable costs under this Grant Agreement must be paid to HUD
before closeout of the grant, unless otherwise specified by an applicable Federal statute.

F. The Grantee must use the Grant Funds only for costs (including indirect costs) that
meet the applicable requirements in 2 CFR part 200 (including appendices). The Grantee's
indirect cost rate information is as provided in Appendix 3 to this Grant Agreement. Unless
the Grantee is an Institution of Higher Education, the Grantee must immediately notify HUD
upon any change in the Grantee's indirect cost rate during the Period of Performance, so that
HUD can amend the Grant Agreement to reflect the change if necessary. Consistent with 2
CFR Part 200, Appendix III (C.7), if the Grantee is an Institution of Higher Education and
has a negotiated rate in effect on the date this Grant Agreement is signed by HUD, the
Grantee may use only that rate for its indirect costs during the Period of Performance.
G. The Grantee must comply with any specific award conditions that HUD may
attach to this Grant Agreement as provided by 2 CFR 200.208. If applicable, these conditions
will be listed or added as Appendix 5 to this Grant Agreement.
H. The Grantee is responsible for managing the Project and ensuring the proper use of
the Grant Funds. The Grantee is also responsible for ensuring the completion of the Project,
the grant closeout, and compliance with all applicable federal requirements. The Grantee may
subaward all or a portion of its funds to one or more subrecipients, as identified in the Project
Narrative (Appendix 1) or as may be approved by HUD in accordance with 2 CFR 200.308.
All subawards made with funding under this Grant Agreement are subject to the subaward
requirements under 2 CFR Part 200, including 2 CFR 200.332, and other requirements
provided by this Grant Agreement. The Grantee is responsible for ensuring each subrecipient
complies with all requirements under this Grant Agreement, including the general federal
requirements in Article IV. A subaward may be made to a for -profit entity only if HUD
expressly approves that subaward and the for -profit entity is made subject to the same
Federal requirements that apply to all other subrecipients, including the requirements 2 CFR
part 200 provides for a "non -Federal entity" that receives a subaward.
ARTICLE IV. General Federal Requirements
A. If the Grantee is a unit of general local government, a State, an Indian Tribe, or an
Alaskan Native Village, the Grantee is the Responsible Entity (as defined in 24 CFR part 58)
and agrees to assume all of the responsibilities for environmental review and decision -
making and action, as specified and required in regulations issued by the Secretary pursuant
to section 305(c) of the Multifamily Housing Property Disposition Reform Act of 1994 and
published in 24 CFR Part 58.
B. If the Grantee is a housing authority, redevelopment agency, academic institution,
hospital or other non-profit organization, the Grantee shall request the unit of general local
government, Indian Tribe or Alaskan Native Village, within which the Project is located and
which exercises land use responsibility, to act as Responsible Entity and assume all of the
responsibilities for environmental review and decision -making and action as specified in
paragraph A above, and the Grantee shall carry out all of the responsibilities of a grantee
under 24 CFR Part 58.

C. After December 29, 2022, neither the Grantee nor any of its contractors,
subrecipients and other funding and development partners may undertake, or commit or
expend Grant Funds or local funds for, project activities (other than for planning,
management, development and administration activities), unless a contract requiring
those activities was already executed on or before December 29, 2022, until one of the
following occurs: (i) the Responsible Entity has completed the environmental review
procedures required by 24 CFR part 58, and HUD has approved the environmental
certification and given a release of funds; (ii) the Responsible Entity has determined and
documented in its environmental review record that the activities are exempt under 24
CFR 58.34 or are categorically excluded and not subject to compliance with
environmental laws under 24 CFR 58.35(b); or (iii) HUD has performed an
environmental review under 24 CFR part 50 and has notified Grantee in writing of
environmental approval of the activities.
D. Following completion of the environmental review process, the Grantee
(recipient) shall exercise oversight, monitoring, and enforcement as necessary to assure
that decisions and mitigation measures adopted through the environmental review process
are carried out during project development and implementation.
E. The Grantee must comply with the generally applicable HUD and CPD
requirements in 24 CFR Part 5, subpart A, including all applicable fair housing, and civil
rights requirements. If the Grantee is a Tribe or a Tribally Designated Housing Entity
(TDHE) as established under 24 CFR 1000.206, the Grantee must comply with the
nondiscrimination requirements in 24 CFR 1000.12 in lieu of the nondiscrimination
requirements in 24 CFR 5.105(a). The Grantee must report data on the race, color,
religion, sex, national origin, age, disability, and family characteristics of persons and
households who are applicants for, participants in, or beneficiaries or potential
beneficiaries of the Grantee's Project, consistent with the instructions and forms provided
by HUD in order to carry out its responsibilities under the Fair Housing Act, Executive
Order 11063, Title VI of the Civil Rights Act of 1964, and Section 562 of the Housing
and Community Development Act of 1987 (e.g. HUD-27061).
F. The Grantee must comply with the Uniform Administrative Requirements,
Cost Principles, and Audit Requirements in 2 CFR part 200, as may be amended from
time to time. If 2 CFR part 200 is amended to replace or renumber sections of part 200
that are cited specifically in this Grant Agreement, the part 200 requirements as
renumbered or replaced by the amendments will govern the obligations of HUD and the
Grantee after those amendments become effective.
G. The Grantee must comply with the Award Term in Appendix A to 2 CFR Part
25 ("System for Award Management and Universal Identifier Requirements") and the
Award Term in Appendix A to 2 CFR Part 170 ("Reporting Subawards and Executive
Compensation"), which are hereby incorporated into and made part of this Grant
Agreement.
H. If the Total Grant Amount, as provided in Article II of this Grant Agreement,
is greater than $500,000, the Grantee must comply with the Award Term and Condition
for Grantee Integrity and Performance Matters in Appendix 4 to this Grant Agreement.

I. Unless the Grantee is exempt from the Byrd Amendment as explained below, the
Grantee must comply with the provisions of Section 319 of Public Law 101-121, 31 U.S.C.
1352, (the Byrd Amendment) and 24 CFR Part 87, which prohibit recipients of Federal contracts,
grants, or loans from using appropriated funds for lobbying the executive or legislative branches
of the Federal Government in connection with a specific contract, grant, loan, or cooperative
agreement. The Grantee must include in its award documents for all sub -awards at all tiers
(including subcontracts, subgrants, and contracts under grants, loans, and cooperative
agreements), the requirements for the certification required by Appendix A to 24 CFR Part 87
and for disclosure using Standard Form- LLL (SF-LLL), "Disclosure of Lobbying Activities."
In addition, the Grantee must obtain the executed certification required by Appendix A and an
SF-LLL from all covered persons. "Person" is as defined by 24 CFR Part 87. Federally
recognized Indian tribes and TDHEs established by Federally recognized Indian tribes as a result
of the exercise of the tribe's sovereign power are excluded from coverage of the Byrd
Amendment. State -recognized Indian tribes and TDHEs established only under state law must
comply with this requirement.
J. The Grantee must comply with drug -free workplace requirements in Subpart B of 2
CFR Part 2429, which adopts the governmentwide implementation (2 CFR Part 182) of sections
5152-5158 of the Drug -Free Workplace Act of 1988, Pub. L. 100-690, Title V, Subtitle D (41
U.S.C. 701-707).
K. The Grantee must comply with the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 (URA) as implemented by regulations at 49 CFR Part 24. The
URA applies to acquisitions of real property and relocation occurring as a direct result of the
acquisition, rehabilitation, or demolition of real property for Federal or Federally funded
programs or projects. Real property acquisition that receives Federal financial assistance for a
program or project, as defined in 49 CFR 24.2, must comply with the acquisition requirements
contained in 49 CFR part 24, subpart B. Unless otherwise specified in law, the relocation
requirements of the URA and its implementing regulations at 49 CFR part 24, cover any
displaced person who moves from real property or moves personal property from real property as
a direct result of acquisition, rehabilitation, or demolition for a program or project receiving
HUD financial assistance
L. If Grant Funds are used for purchase, lease, support services, operation, or work that
may disturb painted surfaces, of pre-1978 housing, you must comply with the lead -based paint
evaluation and hazard reduction requirements of HUD's lead- based paint rules (Lead Disclosure;
and Lead Safe Housing (24 CFR part 35)), and EPA's lead- based paint rules (e.g., Repair,
Renovation and Painting; Pre -Renovation Education; and Lead Training and Certification (40
CFR part 745)).
M. The Grantee must comply with Section 3 of the Housing and Urban Development
Act of 1968 (Section 3), 12 U.S.C. 1701u, and HUD's regulations at 24 CFR part 75, as
applicable, including the reporting requirements in 24 CFR 75.25. Grants made to Tribes and
TDHEs are subject to Indian Preference requirements in Section 7(b) of the Indian Self -
Determination and Education Assistance Act (25 U.S.C. 5307(b)). As stated in 24 CFR 75.3(c),
grants to Tribes and TDHEs are subject to Indian Preference requirements in lieu of Section 3.
Grantees that are not exempt from Section 3 must submit annual reports of Section 3

accomplishment Performance Measures in DRGR in January of the calendar year.
This report reflects Section 3 accomplishments for the previous calendar year.
N. The Grantee must not use any Grant Funds to support any Federal, state, or
local project that seeks to use the power of eminent domain, unless eminent domain is
employed only for a public use. Public use includes use of funds for mass transit,
railroad, airport, seaport, or highway projects, and utility projects which benefit or serve
the general public (including energy -related, communication -related, water -related, and
waste water -related infrastructure), other structures designated for use by the general
public or with other common -carrier or public -utility functions that serve the general
public and are subject to regulation and oversight by the government, and projects for the
removal of an immediate threat to public health and safety or brownfields, as defined in
the Small Business Liability Relief and Brownfields Revitalization Act (Pub. L. 107-
118). Public use does not include economic development that primarily benefits private
entities.
O. The Grantee must not use any Grant Funds to maintain or establish a computer
network that does not block the viewing, downloading, and exchanging of pornography.
This requirement does not limit the use of funds necessary for any Federal, State, tribal,
or local law enforcement agency or any other entity carrying out criminal investigations,
prosecution, or adjudication activities.
P. The Grantee must administer its Grant Funds in accordance with the Conflict
of Interest requirements set forth in Appendix 6 of this Grant Agreement.
Q. The Grantee must comply with the governmentwide debarment and suspension
requirements in 2 CFR part 180 as incorporated and supplemented by HUD's regulations
at 2 CFR part 2424.
R. The Grantee must comply with the award term and condition regarding
trafficking in persons in Appendix 7 of this Grant Agreement.
S. The assurances and certifications the Grantee has made and submitted to HUD
are incorporated by this reference and made part of this Grant Agreement.
ARTICLE V. Drawdown Requirements
A. The Grantee may not draw down Grant Funds until HUD has received and
approved any certifications and disclosures required by 24 CFR 87.100 concerning
lobbying, if applicable.
B. The Grantee must use HUD's Disaster Recovery Grant Reporting (DRGR)
system to draw down Grant Funds and report to HUD on activities.
C. The Grantee must enter activity and budget information in DRGR that is
consistent with the Grantee's Project and Approved Budget as described in Article III,
sections A and B of this Grant Agreement and complies with HUD's instructions for
entering information in DRGR found in the document titled "Grant Award Instructions"
that accompanies the Grant Agreement.

D. The Grantee must only enter activities in DRGR that are described in the
Approved Budget.
E. The Grantee must expend all Grant Funds in accordance with the activity and
budget information in DRGR.
F. Each drawdown of Grant Funds constitutes a representation by the Grantee
that the funds will be used in accordance with this Grant Agreement.
G. The Grantee must use DRGR to track the use of program income and must
report the receipt and use of program income in the reports the Grantee submits to HUD
under Article VI of this Grant Agreement. The Grantee must expend program income
before drawing down Grant Funds through DRGR.
H. Notwithstanding any other provision of this grant agreement, HUD will not be
responsible for payment of any Grant Funds after the date Treasury closes the account in
accordance with 31 U.S.C. § 1552. Because Treasury may close the account up to one
week before the September 30 date specified by 31 U.S.C. § 1552, the Grantee is advised
to make its final request for payment under the grant no later than September 15, 2031.
ARTICLE VI. Program -Specific Reporting Requirements
In addition to the general reporting requirements that apply under other provisions
of this Agreement, the following program -specific reporting requirements apply to the
Grantee:
A. The Grantee must submit a performance report in DRGR on a semi-annual
basis and must include a completed Federal financial report as an attachment to each
performance report in DRGR. Performance reports shall consist of a narrative of work
accomplished during the reporting period. During the Period of Performance, the Grantee
must submit these reports in DRGR no later than 30 calendar days after the end of the 6-
month reporting period. The first of these reporting periods begins on the first of January
or June (whichever occurs first) after the date this Grant Agreement is signed by HUD.
B. The performance report must contain the information required for reporting
program performance under 2 CFR 200.329(c)(2) and (d), including a comparison of
actual accomplishments to the objectives of the Project as described in Article III, section
A of this Grant Agreement, the reasons why established goals were not met, if
appropriate, and additional pertinent information including, when appropriate, analysis
and explanation of cost overruns or high unit costs.
C. Financial reports must be submitted using DRGR or such future collections
HUD may require and as approved by OMB and listed on the Grants.gov website

D. The performance and financial reports will undergo review and approval by
HUD. If a report submission is insufficient, HUD will reject the report in DRGR and
identify the corrections the Grantee must make.
E. No drawdown of funds will be allowed through DRGR while the Grantee has
an overdue performance or financial report.
F. The Grantee must report and account for all property acquired or improved
with Grant Funds as provided by 2 CFR part 200 using the applicable common forms
approved by OMB and provided on the Grants.gov website
(https://www.grants.gov/web/grants/forms/post-award-reporting-fonns.html). This
reporting obligation includes submitting status reports on real property at least annually
as provided by 2 CFR 200.330, accounting for real and personal property acquired or
improved with Grant Funds as part of Project Closeout, and promptly submitting requests
for disposition instructions as provided by 2 CFR 200.311(c), 200.313(e), and
200.3 14(a).
ARTICLE VII. Project Closeout
A. The grant will be closed out in accordance with 2 CFR part 200, as may be
amended from time to time, except as otherwise specified in this Grant Agreement.
B. The Grantee must submit to HUD a written request to closeout the grant no
later than 30 calendar days after the Grantee has drawn down all Grant Funds and
completed the Project as described in Article III, section A of this Grant Agreement.
HUD will then send the Closeout Agreement and Closeout Certification to the Grantee.
C. At HUD's option, the Grantee may delay initiation of project closeout until the
resolution of any findings as a result of the review of semi-annual activity reports in
DRGR. If HUD exercises this option, the Grantee must promptly resolve the findings.
D. The Grantee recognizes that the closeout process may entail a review by HUD
to determine compliance with the Grant Agreement by the Grantee and all participating
parties. The Grantee agrees to cooperate with any HUD review, including reasonable
requests for on -site inspection of property acquired or improved with Grant Funds.
E. No later than 120 calendar days after the Period of Performance, Grantees
shall provide to HUD the following documentation:
1. A Certification of Project Completion.
2. A Grant Closeout Agreement.
3. A final financial report giving the amount and types of project costs
charged to the grant (that meet the allowability and allocability

requirements of 2 CFR part 200, subpart E); a certification of
the costs; and the amounts and sources of other project funds.
4. A final performance report providing a comparison of actual
accomplishments with the objectives of the Project, the reasons for slippage
if established objectives were not met and additional pertinent
information including explanation of significant cost overruns.
5. A final property report, if specifically requested by HUD at the time of closeout.
ARTICLE VIII. Default
A default under this Grant Agreement shall consist of any use of Grant Funds for a purpose other
than as authorized by this Grant Agreement, any noncompliance with statutory, regulatory, or
other requirements applicable to the Grant Funds, any other material breach of this Grant
Agreement, or any material misrepresentation in the Grantee's submissions to HUD in
anticipation of this award. If the Grantee fails to comply with the terms and conditions of the
Grant Agreement, HUD may adjust specific conditions of this Grant Agreement as described in 2
CFR part 200, as may be amended from time to time. If HUD determines that noncompliance
cannot be remedied by imposing additional conditions, HUD may take one or more of the
remedies for noncompliance described in 2 CFR part 200, as may be amended from time to time.
HUD may also terminate all or a part of this award as provided by 2 CFR 200.340 and other
applicable provisions of 2 CFR part 200, as may be amended from time to time. Nothing in this
Grant Agreement shall be construed as creating or justifying any claim against the Federal
government or the Grantee by any third party.

Award Term and Condition for Grantee Integrity and Performance Matters
Reporting of Matters Related to Grantee Integrity and Performance
1. General Reporting Requirement
If the total value of the Grantee's currently active grants, cooperative agreements, and
procurement contracts from all Federal awarding agencies exceeds $10,000,000 for any period of
time during the period of performance of this Federal award, then during that period of time the
Grantee must maintain the currency of information reported to the System for Award
Management (SAM) that is made available in the designated integrity and performance system
(currently the Federal Awardee Performance and Integrity Information System (FAPIIS)) about
civil, criminal, or administrative proceedings described in paragraph 2 of this award term and
condition. This is a statutory requirement under section 872 of Public Law 110-417, as amended
(41 U.S.C. 2313). As required by section 3010 of Public Law 111-212, all information posted in
the designated integrity and performance system on or after April 15, 2011, except past
performance reviews required for Federal procurement contracts, will be publicly available.
2. Proceedings About Which Grantee Must Report
During any period of time when the Grantee is subject to the requirement in paragraph 1 of this
award term and condition, the Grantee must submit the information required about each
proceeding that:
a. Is in connection with the award or performance of a grant, cooperative agreement, or
procurement contract from the Federal Government;
b. Reached its final disposition during the most recent five-year period; and
c. Is one of the following:
(1) A criminal proceeding that resulted in a conviction, as defined in paragraph 5 of this
award term and condition;
(2) A civil proceeding that resulted in a finding of fault and liability and payment of a
monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more;
(3) An administrative proceeding, as defined in paragraph 5. of this award term and
condition, that resulted in a finding of fault and liability and the Grantee's payment of
either a monetary fine or penalty of $5,000 or more or reimbursement, restitution, or
damages in excess of $100,000; or
(4) Any other criminal, civil, or administrative proceeding if:
(i) It could have led to an outcome described in paragraph 2.c.(1), (2), or (3) of
this award term and condition;

(ii) It had a different disposition arrived at by consent or compromise with an
acknowledgment of fault on the Grantee's part; and

3. Reporting Procedures
During any period of time when the Grantee is subject to the requirement in paragraph 1 of this
award term and condition, the Grantee must enter in the SAM Entity Management area the
information that SAM requires about each proceeding described in paragraph 2 of this award
term and condition. The Grantee does not need to submit the information a second time under
assistance awards that the Grantee received if the Grantee already provided the information
through SAM because the Grantee was required to do so under Federal procurement contracts
that the Grantee was awarded.
4. Reporting Frequency
During any period of time when the Grantee is subject to the requirement in paragraph 1 of this
award term and condition, the Grantee must report proceedings information through SAM for the
most recent five-year period, either to report new information about any proceeding(s) that the
Grantee has not reported previously or affirm that there is no new information to report. If the
Grantee has Federal contract, grant, and cooperative agreement awards with a cumulative total
value greater than $10,000,000, the Grantee must disclose semiannually any information about
the criminal, civil, and administrative proceedings.
5. Definitions
For purposes of this award term and condition:
a. Administrative proceeding means a non judicial process that is adjudicatory in nature in order
to make a determination of fault or liability (e.g., Securities and Exchange Commission
Administrative proceedings, Civilian Board of Contract Appeals proceedings, and Armed
Services Board of Contract Appeals proceedings). This includes proceedings at the Federal and
State level but only in connection with performance of a Federal contract or grant. It does not
include audits, site visits, corrective plans, or inspection of deliverables.
b. Conviction, for purposes of this award term and condition, means a judgment or conviction of
a criminal offense by any court of competent jurisdiction, whether entered upon a verdict or a
plea, and includes a conviction entered upon a plea of nolo contendere.
c. Total value of currently active grants, cooperative agreements, and procurement contracts
includes—
(1) Only the Federal share of the funding under any Federal award with a cost share or
match requirement; and
(2) The value of all expected funding increments under a Federal award and options, even
if not yet exercised.

APPENDIX 6 — Conflict of Interest Requirements
1. Conflicts Subject to Procurement Regulations. When procuring property or services, the
grantee and its subrecipients shall comply with the applicable conflict -of -interest rules in 2 CFR
200.317 and 2 CFR 200.318(c). In all cases not governed by 2 CFR 200.317 and 2 CFR
200.318(c), the Grantee and its subrecipients must follow the requirements contained in
paragraphs 2-5 below.
2. General prohibition. No person who is an employee, agent, consultant, officer, or elected or
appointed official of the Grantee or subrecipient and who exercises or has exercised any
functions or responsibilities with respect to assisted activities, or who is in a position to
participate in a decision making process or gain inside information with regard to such activities,
may obtain a financial interest or benefit from the activity, or have a financial interest in any
contract, subcontract, or agreement with respect thereto, or the proceeds thereunder, either for
himself or herself or for those with whom he or she has immediate family or business ties, during
his or her tenure or for one year thereafter. Immediate family ties include (whether by blood,
marriage or adoption) the spouse, parent (including a stepparent), child (including a stepchild),
sibling (including a stepsibling), grandparent, grandchild, and in-laws of a covered person.
3. Exceptions. HUD may grant an exception to the general prohibition in paragraph (ii) upon the
Grantee's written request and satisfaction of the threshold requirements in paragraph (iv), if
HUD determines the exception will further the Federal purpose of the award and the effective
and efficient administration of the Grantee's Project, taking into account the cumulative effects
of the factors in paragraph (v).
4. Threshold requirements for exceptions. HUD will consider an exception only after the Grantee
has provided the following documentation:
a. A disclosure of the nature of the conflict, accompanied by an assurance that there has
been public disclosure of the conflict and a description of how that disclosure was made;
and
b. An opinion of the Grantee's attorney that the interest for which the exception is sought
would not violate state or local law.
5. Factors to be considered for exceptions. In determining whether to grant a requested exception
after the Grantee has satisfactorily met the threshold requirements in paragraph (iii), HUD will
consider the cumulative effect of the following factors, where applicable:
a. Whether the exception would provide a significant cost benefit or an essential degree
of expertise to the program or project that would otherwise not be available;
b. Whether an opportunity was provided for open competitive bidding or negotiation;
c. Whether the person affected is a member of a group or class of low- or moderate -
income persons intended to be the beneficiaries of the assisted activity, and the exception

described in paragraph (ii);
f Whether undue hardship will result either to the Grantee or the person affected when
weighed against the public interest served by avoiding the prohibited conflict; and
g. Any other relevant considerations.

Project Name:
Wood Haven Technology Park Water Service Extension, Roanoke County, Virginia
Project Purpose: Provide a brief one sentence summary.
The proposed project seeks to increase the water supply to the 110-acre Wood Haven Technology Park,
making the site significantly more attractive to water -intensive business operations that may be
interested in establishing a facility in the Park.
Project Scope:
The project scope includes construction of approximately 400 linear feet of 24-inch diameter water main
underneath Interstate 81 that will connect to an existing 16-inch diameter water transmission line on
Loch Haven Road and provide 40 linear feet of on -site 24-inch water main to the Wood Haven
Technology Park. The water main will be installed underground using trenchless construction methods
beneath Interstate 1-81.
What will the CPF grant be used for?
The CPF grant award will be used to help fund construction of the waterline extension underneath 1-81
to provide connectivity between an existing water transmission line along Loch Haven Road and Wood
Haven Technology Park to provide a redundant connection and a larger quantity of available water
supply.
Restate the project purpose, identify general activity categories, and specify what the grant award will
be used for.
Roanoke County and the Western Virginia Regional Industrial Facility Authority (WVRIFA) are currently
developing the Wood Haven Technology Park, seeking to attract large scale business operations to the
site to create jobs benefiting the entire Roanoke region. While the Park is well -situated geographically
and in relation to transportation infrastructure, the boundaries of Interstates 81 and 5-81 create a
limiting situation for access to water infrastructure. Water is currently available to the Park from one 12-
inch main, which may or may not be adequate for future development. The addition of a water line
crossing under Interstate 81 will provide the Park with a direct connection to the North Loop
Transmission Main and maximize available capacity. This additional connection will allow for looping of
the water distribution system which will provide for greater available fire flow for future development
which is critical for safety.
Roanoke County is partnering with the Western Virginia Water Authority (WVWA) for delivery of the
waterline extension project. Roanoke County will appropriate the grant funding and serve as the
responsible entity and grantee. The Western Virginia Water Authority will administer the
design/engineering, permitting, right-of-way acquisition, and construction of the proposed project and
serve as subrecipient of the FY 2023 Community Project Funding. The WVWA will contribute $670,000
for the balance of the project costs without seeking reimbursement through the federal grant funds. The
WVWA will own and maintain the waterline extension as an addition to its water distribution system.

Roanoke County will oversee the environmental review process and is providing funding for the
environmental services through an existing annual contract that has been procured for projects with
federal funding and will not seek reimbursement through the federal grant funds.
The grant award of $820,000 will be appropriated by Roanoke County and specifically used for
construction of the waterline extension underneath 1-81. The Western Virginia Water Authority will
request reimbursement from Roanoke County for construction expenses not to exceed $820,000 in total.
Roanoke County will process payments to the WVWA and then submit reimbursement requests to HUD.
This project will make the region more competitive for business investment and increase employment
opportunities. It will provide greater utility capacity to the Tier 4 Virginia Economic Development
Partnership Business Ready Site, enhancing the marketability of the property for one or more future
users.
Is the CPF funded project part of a larger project?
Yes, the waterline extension project supports development of the Wood Haven Technology Park, a
regionally supported 110-acre economic development site located near the intersection of Interstates 81

The Wood Haven Technology Park is primarily for high technology manufacturing uses with supporting
uses such as office, commercial establishments, and residential areas. The property is owned by the
Western Virginia Regional Industrial Facility Authority (WVRIFA), formed in 2014 by Botetourt County,
Franklin County, Roanoke County, the City of Roanoke, the City of Salem, and the Town of Vinton through
the Virginia Industrial Facilities Act. Roanoke County and the Cities of Salem and Roanoke are the local
governments involved in the Wood Haven Road project due to the site's proximity to those localities.
The Wood Haven Technology Park is located at the intersection of Interstates 81 and 5-81 and close to
the Roanoke -Blacksburg Regional Airport. This 110-acre site area is being developed into a park -like
setting that complements surrounding land uses though appropriate siting of buildings, controlled access
points, and landscape buffering. The property has been rezoned to the Planned Technology District
(PTD), and site development plans have been produced for a development area in conjunction with a
community engagement process. The Technology Park has 88-acres available for development and
currently offers a 20-acre graded pad (of a designed and permitted 53-acre pad) with an existing
entrance road that is publicly owned with utilities in place (i.e., electric, gas, 12-inch water line, 8-inch
sewer line, and broadband). The proposed waterline extension project will provide a 24-inch diameter
water main underneath 1-81 to increase the water supply to the Technology Park.

Has the project started? If so, please provide a brief overview of the status of the project.
The Western Virginia Water Authority (WVWA) has executed a contract with a consultant firm for design,
surveying, and engineering services for the waterline extension underneath 1-81. Topographic surveying
and utilities investigation of the project area has started. The grant award will not cover expenses related
to the engineering services. Construction of the waterline underneath 1-81 is anticipated to begin in
August 2024 and end in August 2025.
If the project has been started, did you initiate an HUD-NEPA environmental review?
Roanoke County has coordinated with HUD-NEPA Regional Environmental Officers on the project
environmental review. A scope of services has been prepared by a consultant for environmental services
for the waterline extension. Roanoke County intends to execute a contract with the consultant firm for
the environmental services for NEPA compliance, using an existing annual contract that has been
procured for projects with federal funding.

DEVELOPMENT AGREEMENT
WOOD HAVEN TECHNOLOGY PARK WATER INFRASTRUCTURE IMPROVEMENTS
This DEVELOPMENT AGREEMENT ("Agreement") made as of Month 00, 0000 by the
WESTERN VIRGINIA WATER AUTHORITY (the "Authority"), a public service authority formed
and existing in accordance with the provisions of Chapter 51 of Title 15.2 of the Code of Virginia,
1950, as amended, the Virginia Water and Waste Authorities Act §§ 15.2-5100-15.2-5158 (the
"Act"); and ROANOKE COUNTY, VIRGINIA, ("the Developer") a political subdivision of the
Commonwealth of Virginia.
WITNESSETH:
WHEREAS, the Developer has a desire to improve water infrastructure in the vicinity of
Tax Parcel 026.17-01-01.00-0000, Wood Haven Technology Park ("the Development") situated
in Roanoke County, Virginia; and,
WHEREAS, the Developer's improvements will require certain improvements to the
Authority's water system, approximately 400 linear feet of 24-inch diameter water main connecting
the existing 16-inch diameter water main on Loch Haven Road and providing 40 LF of on -site 24"
water main providing a connection point for future Park facilities service to the Wood Haven
Technology Park, and associated appurtenances ("Infrastructure Improvements"); and,
WHEREAS, the total estimated cost of these Infrastructure Improvements is estimated to
be $1,490,000; and,
WHEREAS, the Developer has secured a grant in the amount of $820,000 for the purpose
of constructing these Infrastructure Improvements; and,
WHEREAS, the Authority has budgeted $670,000 for the purpose of constructing these
infrastructure improvements; and,
WHEREAS, the Authority owns and operates an existing water distribution system in the
vicinity of the Development; and,
WHEREAS, the Developer and Authority agree that it will be mutually beneficial for the
Authority to execute construction of desired Infrastructure Improvements and the Developer has
agreed to fund a portion of the Authority's construction; and,
WHEREAS, the Developer and Authority understand that time is important and both
parties will use any reasonable means necessary to start and complete the project in a timely
manner.
NOW THEREFORE, in consideration of the mutual benefits accruing to each party, the
parties do hereby agree and covenant as follows:
DEVELOPER'S RESPONSIBILITIES:
1. Reimbursement shall be made by check payable to Western Virginia Water Authority within
30 days of receipt of properly submitted. Invoices shall be submitted no more frequently than
monthly and shall not exceed $820,000 in total.

2. The Developer, as Grantee of FY2023 Community Project Funding, will manage the
conditions of the grant program.
AUTHORITY'S RESPONSIBILITIES:
1. The Authority shall submit invoice(s) to the Developer up to the value of $820,000.
2. The Authority shall provide for design, permitting, and construction of the Infrastructure
Improvements.
3. The Authority shall be solely responsible for all costs and expenses to design and construct
the Infrastructure Improvements.
4. The Authority will provide construction inspection services for the Infrastructure Improvements
at no additional cost to Developer.
5. All Infrastructure Improvements shall be designed and constructed in accordance with the
Western Virginia Regional Design and Construction Standards, latest edition.
6. Final Acceptance by the Authority shall not be unreasonably withheld, conditioned or delayed,
and the Authority shall work and cooperate with Developer in good faith in all aspects of the
work contemplated herein, including, without limitation, granting such easements and
approvals as may be reasonably required in connection with the project. Upon such Final
Acceptance, the Authority, at the Authority's cost, shall assume the maintenance, repair,
replacement and operation of the Infrastructure Improvements to keep the same in good
working condition. The Authority assumes responsibility for any warranty issues during
customary warranty period.
7. The Authority will, as subrecipient of FY 2023 Community Project Funding, provide information
and assistance to the Developer upon request as necessary to comply with its grant
agreement.
All notices or other communications required or desired to be given with respect to this Agreement
shall be in writing and shall be addressed as provided below.

ORDINANCE ACCEPTING AND APPROPRIATING FUNDS IN THE AMOUNT OF
$820,000.00 AND GRANTING SIGNATORY AUTHORITY TO THE COUNTY
ADMINISTRATOR OR HIS DESIGNEE TO EXECUTE A GRANT AGREEMENT WITH
THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) FOR
THE WOOD HAVEN TECHNOLOGY PARK WATER SERVICE EXTENSION PROJECT
WHEREAS, Roanoke County and the Western Virginia Regional Industrial Facility
Authority (WVRIFA) are currently developing the Wood Haven Technology Park
(hereinafter referred to as "the Park") and are seeking to attract large-scale business
operations to the Park to create jobs which will benefit the entire Roanoke region; and
WHEREAS, the Park is well -situated geographically and in relation to
transportation infrastructure, but the Park's boundaries of Interstates 81 and 5-81 limit
access to water infrastructure; and
WHEREAS, the Western Virginia Water Authority (WVWA) currently provides
water to the Park from a 12-inch diameter water main located along Wood Haven Road,
which may or may not be adequate for future development; and
WHEREAS, in April of 2022, Roanoke County partnered with the WVRIFA and the
WVWA to submit a fiscal year 2023 Economic Development Initiative - Community Project
Funding (CPF) Appropriations Request to Virginia's 9th District Congressman Morgan
Griffith in the amount of $820,000.00 through the Consolidated Appropriations Act; and
WHEREAS, the purpose of the joint request was to help fund the construction of a
waterline extension underneath Interstate 81 to provide connectivity between an existing
water main located along Loch Haven Road and Wood Haven Technology Park; and
WHEREAS, the proposed extension would increase the water supply to the 110-
acre Park, making the site significantly more attractive to water -intensive business
operations that may be interested in establishing a facility in the Park; and
WHEREAS, in March of 2023 Roanoke County was notified that it was awarded
$820,000.00 as a result of the CPF Appropriations Request for construction of the
waterline extension underneath Interstate 81 to provide connectivity between an existing
water transmission line along Loch Haven Road and Wood Haven Technology Park; and
WHEREAS, the grant award of $820,000 needs to be accepted and appropriated
by Roanoke County in order to be used for construction of the waterline extension; and
WHEREAS, the first reading of this ordinance was held on December 12, 2023,
and the second reading was held on January 9, 2024.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, that
1) Funds in the amount of $820,000.00 received by the U.S. Department of Housing
and Urban Development as part of a Community Project Funding grant are hereby
accepted and appropriated to the grant fund.
2) The County Administrator, or his designee, is hereby granted authority to execute
a grant agreement with the U.S. Department of Housing and Urban Development
for purposes of the Wood Haven Technology Park water service extension project.
3) This ordinance shall be effective upon its adoption.

ISSUE:
A resolution is needed to request that the Virginia Department of Transportation (VDOT)
abandon a portion of State Route 1901/Robertson Lane right-of-way to facilitate
redevelopment of four adjacent parcels.
BACKGROUND:
Staff have been working with a prospective business interested in locating at the corner
of Plantation Road and Williamson Road since November 2022. The proposed
redevelopment involves four parcels with three property owners and changes to State
Route 1901, Robertson Lane, to facilitate construction of and access to the proposed
development.
As part of the Plantation Road widening and relocation project in the early 1980s, VDOT
purchased right-of-way at the end of Robertson Lane to terminate the roadway with a
cul-de-sac turnaround. Because the right-of-way was purchased by VDOT for the
secondary roadway, it must be abandoned before it can be sold. The subject right-of-
way measures approximately 0.17 acre, is located 0.09 mile from Plantation Road,
extends a distance of 0.03 mile or 136.63 feet to the center of the cul-de-sac located at
0.12 mile.

DISCUSSION:
Pursuant to §33.2-909 Code of Virginia, "a county governing body or an interested
landowner can initiate the §33.2-909 abandonment of a secondary road or segment that
is deemed to no longer be necessary for the uses of the highway system."
In the absence of Roanoke County having an application to request roadway
abandonment, RYT, LLC and JSBONE, LLC, owners of two adjacent parcels, submitted
an application to Roanoke County on July 14, 2023, to vacate the subject Robertson
Lane right-of-way. While Roanoke County can vacate a plat dedicating a public right-of-
way, VDOT must abandon right-of-way VDOT owns with Roanoke County concurrence.
To show that the subject Robertson Lane right-of-way is no longer necessary for the
uses of the highway system and that no public necessity exists for the continuance of
the secondary road, the following modifications are included in the site plan approved
on September 28, 2023:
1. A new branch -style turnaround is proposed to replace the cul-de-sac turnaround;
and
2. Existing overhead and underground utilities are proposed to be relocated out of
the right-of-way.
Immediately after the site plan was approved, Roanoke County followed the process
outlined in §33.2-909:
1. Notice of Intent to Abandon (NOIA) process was initiated on September 29,
2023, and concluded on November 4, 2023 with one property owner response;
and
2. Public Hearing Notification Process was initiated on November 9, 2023, and
concludes with the public hearing on December 12, 2023, with one additional
property owner response.
Property owner comments include:
1. Abandonment of the cul-de-sac will keep Mr. Dunbar's clients driving semi -trucks
and trailers up to 56 feet in length from being able to turn around, impacting his
business; and
2. Mr. Dunbar believes that a 1946 private easement provides access from his
property to Williamson Road across the properties to be developed.
Staff has requested additional information from Mr. Dunbar regarding the types and
lengths of vehicles that need to access his business to determine if the proposed
branch turnaround will enable these vehicles to turn around within the proposed VDOT
right-of-way.
Within four months of the public hearing the Board of Supervisors must either:
1. Approve a resolution abandoning the section of highway; or

2. Dismiss the proposed abandonment and provide VDOT a resolution indicating
that the locality does not support the abandonment and requests that the mileage
remain in the VDOT inventory.
FISCAL IMPACT:
There is no fiscal impact associated with this resolution.
STAFF RECOMMENDATION:
If the prospective business can address property owner comments raised during the
NOIA and public hearing process, then staff recommends approving a resolution
abandoning a portion of Robertson Lane.

Roanoke County has received a request from JSBONE, LLC, and RYT, LLC, to vacate approximately 0.17
acre of Robertson Lane (Route 1901) right-of-way to facilitate redevelopment of four parcels located at
and near the intersection of Williamson Road (Route 11) and Plantation Road (Route 115). The
requested vacation is proposed to remove a distance of 0.03 mile or 136.63 feet at the end of Robertson
Lane from public right-of-way, between 0.09 mile and 0.12 mile at the center of the cul-de-sac.
In accordance with Virginia Code §33.2-909, the Virginia Department of Transportation (VDOT) has been
notified of Roanoke County's intent to abandon this portion of Robertson Lane. To continue to provide
an appropriate turnaround, the VDOT Salem Residency has approved plans for a new branch turnaround
to be dedicated to VDOT to be located across from the southern end of 7575 Robertson Lane, as
indicated on the enclosed exhibit.
The Notice of Intent to Abandon (NOIA) process must be at least 30 days long. Roanoke County is
beginning the NOIA process on October 4, 2023, and concluding it on November 4, 2023. The process
includes:
1) Two legal advertisements in The Roanoke Times;
2) Posting Robertson Lane in at least three locations; and
3) Notification of adjacent and nearby property owners and tenants with this letter.
Following the NOIA, Roanoke County will hold a public hearing with at least 30 days notice. You are
welcome to attend and speak at the public hearing. The public hearing notification process will include:
1) Two new legal advertisements in The Roanoke Times;
2) Posting Robertson Lane again in at least three locations; and
3) Notification of adjacent and nearby property owners and tenants with a new letter including
public hearing details.
After the public hearing, the Board of Supervisors will consider an ordinance to abandon the subject
portion of Robertson Lane.

Dear Ms. Cronise,
I am writing on behalf of Greg Dunbar, the owner of Dunbar Welding & Repairs, Inc.,
regarding the proposed development of the corner of Plantation and Williamson Road
by JSBONE and RYT LLC. My understanding, from your letter dated September 29,
2023, is that the county is considering abandoning a portion of Robertson Lane.
Pursuant to your letter and the rules of notices of intent to abandon, please consider this
a formal objection to the abandonment of portions of Robertson Lane and particularly
the small cul-de-sac that terminates Robertson Lane.
Mr. Dunbar has operated Dunbar Welding & Repair at 7531 Robertson Lane for the last
23 years. In this business he fabricates, welds, and repairs large machinery which is often
moved to the premises by semi -trucks and trailers up to 56' in length. The current cul-
de-sac, is small with only a 30' radius. Despite the cul-de-sac's small size, it is sufficient
to safely access Mr. Dunbar's shop, safely maneuver semi -trucks around, and safely get
them back to Plantation Road.
If the cul-de-sac is abandoned and removed for the above referenced development, Mr.
Dunbar will no longer be able to turn clients around and back to Plantation Road.
Instead, he will have to back the semi -trucks and trailers over a football field in length
down Robertson Lane and into Plantation Road. As you can imagine, this is no easy feat.
This feat is only compounded in difficulty and danger because he routinely receives heavy
equipment at night.
Mr. Dunbar has dealt with this problem in the past. From 2011-2014, his neighbor to
the South at 7527 Robertson Lane purposefully blocked the cul-de-sac in an effort to
negatively affect Mr. Dunbar's business. Fortunately, that issue was resolved when no -
parking signs were placed around the cul-de-sac. However, during that time Mr. Dunbar
lost a significant amount of business; he has kept the receipts and records to show the
damage to his business' income. Without an alternative means of turning trucks around,
the abandonment of the cul-de-sac will result in a similar slowdown of business.

The current proposal to help alleviate this problem is ineffective. The current plans show a 31.74' turn
around being placed across Robertson Lane, West of Mr. Dunbar's shop. There is simply no way that the
proposed turn around is deep enough to safely turn large trucks and trailers around. Furthermore, it
appears that a deeper turn around will not be possible because of a planned private entrance and drive.
The only option may be for the development to create a similarly sized cul-de-sac closer to Mr. Dunbar's
shop.
On a separate but important note, Mr. Dunbar believes that his lot is the beneficiary of an easement
recorded in 1946 in the Roanoke County Circuit Court. I have attached a copy of that easement for your
review. The easement crosses the proposed development and provides access to Williamson Road. If this
easement is to his benefit, Mr. Dunbar would like to continue to utilize it to access Williamson Road.
I appreciate your time and I look forward to working with you. When the Board of Supervisors meet to
discuss this particular development, we will attend and advocate for a resolution to Mr. Dunbar's
predicament

county on its own motion or upon petition of any interested landowner may cause any
section of the secondary state highway system ... deemed by it to be no longer necessary
for the uses of the secondary state highway system to be abandoned altogether as a
public highway"; and
WHEREAS, on July 14, 2023 Roanoke County received a request to abandon a
0.03 portion of State Route 1901 (Robertson Lane) from RYT, LLC and JSBONE, LLC,
who own property adjacent to State Route 1901 (Robertson Lane); and
WHEREAS, the request to abandon the 0.03 portion of State Route 1901
(Robertson Lane) from RYT, LLC and JSBONE, LLC is to facilitate redevelopment of four
parcels adjacent to State Route 1901 (Robertson Lane), which will require changes to
State Route 1901 (Robertson Lane) in order to facilitate construction of and access to the
proposed development; and
WHEREAS, public notice of the proposed abandonment was posted as
prescribed by Virginia Code § 33.2-909 announcing the Board's intention to abandon
the segment of road described below from the Virginia Department of Transportation's
Secondary System of State Highways, and
WHEREAS, after considering all evidence available, the Board is satisfied that
no public necessity exists for the continuance of the portion of State Route 1901
(Robertson Lane) which has been proposed to be abandoned, and which is fully shown
as "ROW VACATION = 0.166 ACRES TOTAL" on a plat titled "PLAT SHOWING
COMBINATION OF THE PROPERTIES OF RYT LLC. & JS BONE LLC., MARTHA
ANN RAKES, AND DONALD & DONNA JEAN ANGER SHOWING NEW PARCEL A,
HOLLINS DISTRICT, ROANOKE COUNTY, VIRGINIA" by Armstrong Civil and dated

WHEREAS, the Comm ssioner of the Virgin a Department of Transportation was
provided the prescribed notice of this Board s intent to abandon the subject segment of
road, and
WHEREAS, the said portion of State Route 1901 (Robertson Lane) is no longer
needed as part of the Virgin a Department of Transportation's Secondary System of State
Highways.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, as follows:
1. The Board of Supervisors authorizes the abandonment of the above -
described portion of State Route 1901 (Robertson Lane) and requests that

budget, the County must publish notice of a meeting and public hearing. The notice
must state the County's intent to amend the budget and include a brief synopsis of the
proposed budget amendment(s). This notice was published on December 5, 2023.
FISCAL IMPACT:
There is no fiscal impact as a result of the public hearing. Requests for the
appropriation will occur later on in this agenda.
STAFF RECOMMENDATION:
It is recommended that the Board hold the required public hearing. Board action
appropriating funds, as provided in this notice, will occur later during this meeting.
Conducting the public hearing does not guarantee the requested appropriation will be

ISSUE:
Ordinance authorizing the acquisition of new public drainage easements to the Board of
Supervisors of Roanoke County for multiple properties (Tax Map #s. 077.14-06-27.00-
0000; 077.11-06-26.00-0000; and, 077.14-06-38.00-0000) for the purpose of drainage
improvements, in the Cave Spring Magisterial District.
BACKGROUND:
Margaret A. Ferris; Richard A. Juneau; and Derrick S. and April H. Minnix, who own
properties located between Richards Blvd and Pilot Blvd, are granting drainage
easements to the Roanoke County Board of Supervisors located as shown on the
attached plats. These easements are of the purpose of correcting long-standing
drainage problems.

DISCUSSION:
The subject parcels were developed in the early 1950s as part of Castle Hills
development. There is a failing 15" corrugated metal drainage pipe connected to a non-
standard drainage inlet in the right-of-way in front of 3475 Richards Blvd. that is
inaccessible for inspection or cleaning without heavy equipment. The pipe leaves this
non-standard structure, crosses under a masonry retaining wall, and continues down
the south side of the 3475 Richards Blvd property to a retaining wall near the rear
property line. This pipe is causing a sinkhole to develop near the house.
If the pipe fails, the retaining wall could suffer damage, complicating repair of the pipe,
and incurring significant cost. Also, 3475 Richards Blvd. has a basement, which could
suffer water damage if the drainage system collapses, and storm drainage backs up in
the system. The property owners at 3475 and 3481 Richards Blvd have agreed to
donate drainage easements to allow the drainage system to be repaired in this area and
have signed the easement deeds.
The pipe from 3475 Richards Blvd passes through a retaining wall and spills onto a
grate inlet in the backyard of 3480 Pilot Blvd. This structure needs to be cleaned out
and inspected. The residents at 3480 Pilot Blvd have agreed to donate a drainage
easement along their property line to allow drainage maintenance and repair.
The owners of the impacted parcels (see "Attachment A") have agreed to donate public
drainage easements to Roanoke County for construction and maintenance of storm
drainage improvements. The new easements will be public drainage easements to allow
for construction and maintenance of the proposed improvements. Properties
considered for this ordinance include:

Richard A. Juneau - Tax Map # 077.14-06-26.00-0000
Derrick S. and April H. Minnix - Tax Map # 077.14-06-38.00-0000
Maps indicating the location of each proposed easement are attached to this report.
The easements are necessary for the installation and maintenance of a new drainage
system. The new drainage system shall provide adequate to prevent flooding or
creation of any sinkholes in the future.
It is important to note that the scope of this drainage project improvement was scaled
down due to some challenges of obtaining additional easements. In the future, if the
condition changes, the staff will return to the board for further action if needed.

FISCAL IMPACT:
There is no cost to Roanoke County for preparation of the easements, as the deeds and
plats have been prepared by Roanoke County staff. Roanoke County will be
responsible for the construction and maintenance of the storm drain. It is anticipated
that the County will order the materials and have an on -call contractor construct the
storm drain. The estimated cost of $300,000 for this project is covered by the American
Rescue Plan Act known as ARPA funding available for the Department of Development
Services and approved by the Board of Supervisors. Future maintenance for this said
easement will be covered by routine maintenance of efforts by Department of
Development Services.
STAFF RECOMMENDATION:
Staff recommends approval of this ordinance and scheduling the second reading for
January 9th, 2024.

The drainage easement being for the installation and maintenance of a drainage system,

in any way endanger or interfere with the proper use of the same. The Grantors agree that no

such location as to render said easement inaccessible. In the event that this covenant is violated,
the Grantee shall not be obligated to repair, replace, or otherwise be responsible for such
improvements if damaged or removed.
The Grantors acknowledge that the plans for the aforesaid project as they affect Grantors'
property have been fully explained to Grantors. The fixtures, facilities, lines, utilities, and any
other improvements placed upon, under, or across the easement by the Grantee shall remain the
property of the Grantee. The easement herein granted is in addition to, and not in lieu of, any
easement or right-of-way now in existence or which may be acquired in the future.

to restore the property to the identical original condition, but rather as near thereto as is
practicable, and that the Grantors will cooperate with the Grantee in effectuating such
restoration.
It is expressly agreed between the parties hereto that the Grantee and its agents have the
right to inspect the easement herein granted and to cut, clear, and remove all trees, shrubbery,
undergrowth, obstructions, or improvements lying within, upon, or adjacent to said easement that

owned solely by Margaret A. Ferris, and Margaret A. Ferris has full authority to execute this

VA TAX PARCEL 077.14-06-27.00-0000" prepared by the Roanoke County
Department of Development Services, said parcel being designated on the
Roanoke County Land Records as Tax Map #077.14-06-27.00-0000. The location
of said easement is more particularly described on the plat attached hereto as
"Exhibit A" and by reference incorporated herein.
The drainage easement being for the installation and maintenance of a drainage system,
and to allow for necessary grading and storage during any phase of construction, reconstruction,
repair or replacements of the improvements to the drainage system, the location of which is set
forth on the plat. The Grantee agrees to restore and repair any actual damage to Grantor's
property that may be directly caused by the construction, reconstruction, or maintenance of said
project except as hereinafter provided. The Grantor agrees that the Grantee will not be expected
to restore the property to the identical original condition, but rather as near thereto as is
practicable, and that the Grantor will cooperate with the Grantee in effectuating such restoration.

ISSUES:
1) Accepting a staffing recognition grant in the amount of $102,500 from the Virginia 9-
1-1 Services Board, and appropriating such funds to the grant account, and
2) Authorizing the payment of bonuses to eligible County's eligible E-9-1-1 employees.
BACKGROUND:
Most, if not all, Virginia Public Safety Answering Points (PSAPs) are experiencing a
staffing recruitment and retention crisis. The 9-1-1 Services Board wanted to
demonstrate its support for the 9-1-1 community and help alleviate the staffing crisis by
providing one-time funding to PSAPs to help them recognize and retain their
telecommunicators. They want to assist Virginia PSAPs to improve retention of 9-1-1
staff by allocating funding on an equity basis to PSAPs to recognize all that "wear the
headset."
DISCUSSION:
The funds will be used to recognize our Communications Officers and all they do. Full
time Communications Officers will receive a one-time payment of $2,500 and part time
Communications Officers will receive a one-time payment of $1,250. We are hopeful

this will assist our department with the retention and recognition of our 9-1-1 staff.
There have been no changes since the first reading of this ordinance on November 15,
2023.
FISCAL IMPACT:
Awarded grant funds total up to $102,500. There is no local match associated with this
grant. However once approved by the Board, these payments will be processed on the
next available pay period and processed for those employees who are in these
positions as of that date, but not at a cost of more than $102,500, which will be
deposited in the grant fund.
STAFF RECOMMENDATION:
Staff recommends approval of this ordinance.

ISSUE:
Appropriate an additional $4,966,171 to the fiscal year 2023-2024 Roanoke County
Public Schools Budget which includes new funds from the State and the reclassification
of current year budget between categories.
BACKGROUND:
Ordinance 052323-4 appropriated 2023-2024 funds for Roanoke County Public Schools
by categories. Any new funds, reclassification of budget, or use of funds between
categories must be approved by the Board of Supervisors.
DISCUSSION:
The Special Session Final Budget for the 2022-2024 biennium was adopted on
September 14, 2023 which provided additional funding in the amount of $4,716,171.
The final budget includes $653,780 in additional funding for the General Fund,
$4,063,973 in additional funding for the Grant Fund for the ALL in VA Plan, and $1,582
in reduced funding for the Grant Fund for the Mentor Teacher Grant.
In addition, an amount of $250,000 will be appropriated to cover grant overage's and to
add a buffer for the remaining fiscal year. In the original 2023-2024 budget, $421,274
was set aside in the Grant Fund special projects revenue and expenditures to absorb

these differences. During the current year, several grants were awarded at balances
significantly higher than budgeted which used the entire special projects balance.
Lastly, the School division has two separate needs to reclassify funds at this time. First,
the nutrition will fund a mechanic who should be reported in the operations and
maintenance category. This will shift $67,277 between categories. Second, as of
October 31 budgets need to be reclassified between categories as follows:

Administration, attendance, and health (10,416.00)
Pupil transportation (1,500.00)
Operation and maintenance (9,224.61)
School food services and other
non -instructional operations (270.00)

ORDINANCE APPROPRIATING AN ADDITIONAL $4,966,171 TO THE
FISCAL YEAR 2023-2024 ROANOKE COUNTY PUBLIC SCHOOLS'
BUDGET
WHEREAS, on May 23, 2023, the Board of Supervisors approved ordinance
052323-4 appropriating funds for the fiscal year 2023-2024 Roanoke County Public
Schools' Categories; and
WHEREAS, subsequently on September 14, 2023, the Governor signed the
2023 Special Session 1 Chapter 1 Final Budget for the biennium, which provided
$653,780 in additional funding for the General Fund, $4,063,973 in additional funding
for the Grant Fund for the ALL in VA Plan, and $(1,582) in reduced funding for the Grant
Fund for the Mentor Teacher Grant, and the School Board appropriated $4,716,171 for
these changes and appropriated an additional $250,000 to cover overages and add a
buffer for the rest of the year;
WHEREAS, grant balances are estimated when developing the original budget,
and after the year begins, actual awards vary from estimates; additionally, unexpected
grants may be received each year; and in the original 2023-2024 budget, $421,274 was
set aside in the Grant Fund special projects revenue and expenditures to absorb these
differences; and
WHEREAS, during the current year, the IDEA Title Vlb and ESEA Title I grants
were awarded at balances significantly higher than budgeted, which used the entire
special projects balance; and
WHEREAS, Ordinance 052323-4 appropriated 2023-2024 funds for Roanoke

County Public Schools by categories, and any reclassification of budget or use of funds
between categories must be approved by the Board of Supervisors; and the school
division has two separate needs to reclassify funds at this time: First, the nutrition fund
will fund a mechanic who should be reported in the operations and maintenance
category, which will shift $67,277 between categories, and second, as of October 31,
budgets have been reclassified between categories as follows:

ISSUE:
Appropriate $48,113,501.44 available year-end funds from Roanoke County Public
Schools' fiscal year ended June 30, 2023, to the fiscal year 2023-2024 Roanoke County
Public Schools' Budget.
BACKGROUND:
In accordance with the Code of Virginia Section 22.1-100, at the end of each fiscal year,
all Roanoke County Public Schools' unexpended funds (derived from the Board of
Supervisors) reverts to the Board of Supervisors. The Board of Supervisors may then
re -appropriate such funds back to the Schools' budget for use in the next year.
The County Board of Supervisors' Comprehensive Financial Policy sets forth
expenditures for which such funds may be re -appropriated.
DISCUSSION:
The Roanoke County School Board proposed the following uses of such year-end funds
at their November 8, 2023 meeting, and requests that the Board of Supervisors
reappropriate the funds for such purposes as outlined in Attachment A.
This proposal follows the County Board of Supervisors' Comprehensive Financial

Policy, dated July 11, 2023. (See Section 10 - Reserves, item 6 (Roanoke County
Public Schools Reserves and Year End Allocation)).
There have been no changes since the first reading of this ordinance on November 15,
2023.
FISCAL IMPACT:
The appropriation of the funds to Roanoke County Public Schools will increase their
total funds by $48,113,501.44; the funds will then be transferred out as outlined in
Attachment A to the appropriate areas.
STAFF RECOMMENDATION:
Staff recommends the approval of the attached ordinance.

ISSUE:
Acceptance and allocation of funds in the amount of $19,725 to the Clerk of the Circuit
Court from the Commonwealth of Virginia
BACKGROUND:
Technology Trust Funds represent fees collected by the Roanoke County Circuit Court
Clerk's Office, and have been received from the State in the amount of $19,725. In
accordance with State of Virginia Code Section 17.1-279, the Circuit Court Clerks
Office shall assess a $5.00 fee called Technology Trust Fund Fee. Each month, the
Clerk's Office can request the fees that were assessed the previous month. The code
section further states that four of every five dollar of the fee shall be allocated by the
Compensation Board from the trust fund for the purposes of obtaining and updating
office automation and information technology equipment including software and
conversion services; preserving, maintaining and enhancing court records, including but
not limited to the costs of repairs, maintenance, land records, consulting services,
service contracts, redaction of social security numbers from land records and system
replacement or upgrades and improving public access to court records.
DISCUSSION:
The funds received from the Commonwealth of Virginia have been earmarked for
maintenance needs for the Clerk of Circuit Court, specifically towards the twice -yearly

maintenance bill from the Supreme Court for maintaining their records, offset the cost of
postage, equipment, etc.
FISCAL IMPACT:
All funds are provided by the Commonwealth of Virginia. No County matching funds
are required.
STAFF RECOMMENDATION:
Staff recommends accepting and allocating $19,725 to the Clerk of Circuit Court from
the Commonwealth of Virginia.

ISSUE:
To establish a Board of Supervisor's meeting schedule for calendar year 2024.
BACKGROUND:
The Board of Supervisors of Roanoke County annually establishes a schedule for its
meetings. It has been the custom of the Board to schedule its meetings on the second
and fourth Tuesdays of each month. The months of August, November and December
only have one meeting due to summer and holiday schedules.
Finally, the Board must schedule an organization meeting for January 2025. Staff
recommends the Board schedule its organization meeting for Tuesday, January 14,
2025.

ISSUE:
The owner of Tax Map Number 036.10-01-10.00-0000 located at 1900 Timberview
Road, Mason Creek, LLC, wishes to donate a 0.0331 acre portion of the property to the
Board of Supervisors of Roanoke County, Virginia to be held for public use.
BACKGROUND:
Mason Creek, LLC owns a parcel of real estate in Roanoke County, Virginia containing
0.858 acre, identified as Roanoke County Tax Map Number 036.10-01-10.00-0000,
which was granted to Mason Creek, LLC by deed dated April 15, 2021 and recorded in
the Clerk's Office of the Roanoke County Circuit Court on May 10, 2021 as Instrument
#202106559. The property is adjacent to the intersection of Dutch Oven Road (State
Route 863) and Timberview Road (State Route 1404). Additionally, the subject property
is adjacent to a crosswalk serving the Hinchee Trail and the trailhead parking lot that
serves the Hanging Rock Battlefield and Hinchee Trails located on Tax Map Number
036.10-01-09.00-0000.
DISCUSSION:
Mason Creek, LLC wishes to donate the property to the Board of Supervisors of
Roanoke County, Virginia for public use. County staff desire to acquire the 0.0331 acre

of the above referenced property for public use and combine it with property owned by
the Board of Supervisors of Roanoke County, Virginia identified as Roanoke County
Tax Map Number 036.10-01-09.00-0000, for development of the Hinchee Trail.
Roanoke County staff have prepared a deed of gift and plat of resubdivision showing
the combination of a portion of Tax Map Number 036.10-01-10.00-0000 (0.0331 ac.)
being added to Tax Map Number 036.10-01-09.00-0000.
There have been no changes since the first reading of this ordinance held on November
15, 2023.
FISCAL IMPACT:
There is no funding necessary to accept this donation of real property.
Subject to available funding, the Grantee agrees to develop a public access trail with
wooden fencing on the property that will span from the Hanging Rock Battlefield Trail
parking lot to the crosswalk for the Hinchee Trail on New Lot 1A on or before April 1,
2024. Additionally, the Grantee agrees to place signage on the property directing the
public to the area on the property that shall be held out for public access on or before
April 1, 2024. Funding for construction of the trail and appurtenances will be covered by
annual capital maintenance program funds.
STAFF RECOMMENDATION:
Staff has advised the property owner has requested a postponement of this item.

ISSUE:
Acceptance and allocation of $7,357.28 from the U.S. Department of Justice's
Bulletproof Vest Partnership along with a $7,327.27 local match from the fiscal year
2023-2024 Roanoke County Sheriff's Office operating budget
BACKGROUND:
The Bulletproof Vest Partnership (BVP), created by the Bulletproof Vest Partnership
Grant Act of 1988 is a unique Department of Justice Initiative designed to provide a
critical resource to state and local law enforcement.
DISCUSSION:
The Bulletproof Vest Partnership (BVP) has awarded the Roanoke County Sheriff's
Office matching grants to assist in the purchase of protective vests.
FISCAL IMPACT:
The total amount of the grant awarded is $14,714.55, which includes a fifty percent
(50%) match. The U.S. Department of Justice grant funds total $7,357.28 and the
County match of $7,357.27 was appropriated by the Board of Supervisors in the fiscal

year 2023-2024 Sheriff's office budget. No additional appropriation of County funds is
required.
STAFF RECOMMENDATION:
Staff recommends the acceptance and allocation of grant funds in the amount of
$7,357.28 from the U.S. Department of Justice's Bulletproof Vest Partnership along with
allocating $7,357.27 from the Sheriff's Office operating budget to the Grant Fund.
