ISSUE:
Resolution adopting the fiscal year 2024-2025 County operating budget, the fiscal year
2024-2025 capital budget and the fiscal year 2025-2034 Capital Improvement Program
for the County of Roanoke, Virginia.
BACKGROUND:
Attached is a resolution approving the fiscal year 2024-2025 operating budget for
Roanoke County, Virginia. This resolution is detailed by fund and includes all transfers
between funds. The fiscal year 2024-2025 Roanoke County Public School's categories
will be adopted at a later date due to delays in adopting the state budget.
Also included in the resolution for approval and prepared in conjunction with the fiscal
year 2024-2025 operating budget are the fiscal year 2024-2025 capital budget and
fiscal years 2025-2034 Capital Improvement Program for the County. A summary of
sources of funds and projects included as part of the County capital budget and the
County Capital Improvement Program are attached as Schedule 3.
Adoption of these documents does not represent an appropriation of funds. The
commitment of funds will not occur until the second reading and approval of the fiscal

year 2024-2025 budget appropriation ordinance, which is later in the agenda.
In regards to the County Capital Improvement Program, only the fiscal year 2024-2025
capital budget will be appropriated as part of the budget appropriation ordinance.
Adoption of the ten (10)-year plan does not represent an appropriation of funds for all
years of the plan. Years two (2) through ten (10) of the Capital Improvement Plan are
presented for informational and planning purposes only.
DISCUSSION:
The adoption of the budget is being requested to fulfill the County's legal requirements
of adopting, and then having a first and second reading of the budget appropriation
ordinance before July 1, 2024, and to allow adequate time for County staff to prepare
and disburse employment contracts, institute pay changes and other administrative
tasks necessary for final budget implementation.
FISCAL IMPACT:
Approval of the resolution provides County funding effective July 1, 2024.
STAFF RECOMMENDATION:
Staff recommends approval of the resolution.

Supervisor Mahoney moved to approve the proposed resolution adopting 1) the fiscal
year 2024-2025 Operating and Capital Budget Revenues and Expenditures for the

RESOLUTION 052824-1 ADOPTING
1) THE FISCAL YEAR 2024-2025 OPERATING AND CAPITAL BUDGET
REVENUES, EXPENDITURES FOR THE COUNTY OF ROANOKE,
VIRGINIA,
2) THE FISCAL YEARS 2025-2034 CAPITAL IMPROVEMENT
PROGRAM FOR ROANOKE COUNTY, VIRGINIA, AND
3) THE FISCAL YEAR 2024-2025 FEE COMPENDIUM
WHEREAS, Section 15.2-2503 of the 1950 Code of Virginia, as amended,
provides that the governing body of the County shall prepare and approve an annual
budget; and
WHEREAS, said budget shall be prepared and approved for informative and fiscal
planning purposes only; and
WHEREAS, this budget contains a complete itemized and classified plan of all
contemplated expenditures and all estimated revenues and borrowings for the ensuing
fiscal year; and
WHEREAS, a brief synopsis of said budget was published as required by the
provisions of Section 15.2-2506 of the State Code, and the public hearings as required
thereon were held on April 23, 2024 and May 14, 2024; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia:
1. That there is hereby approved the annual operating and capital budget
revenues and expenditures for fiscal year 2024-2025 for Roanoke County,
Virginia as shown on the attached Schedules'1 and 2.

2. That there is hereby approved the Capital Improvement Program for fiscal
years 2025-2034 for Roanoke County, Virginia as shown on the attached
Schedule 3.
3. That the preparation and approval of these budgets is for informative and
fiscal planning purposes only.
4. That there is hereby approved a Fee Compendium which lists all fees and
charges imposed by the County for providing specialized programs and
services. The Fee Compendium provides details on the type of fee,
authority to levy the fee, current fees, and proposed changes to the current
fees.
Supervisor Mahoney moved to approve the proposed resolution adopting 1) the
fiscal year 2024-2025 Operating and Capital Budget Revenues and Expenditures for the
County of Roanoke, Virginia, and 2) the fiscal years 2025-2034 Capital Improvement
Program for the County of Roanoke, Virginia and 3) the fiscal year 2024-2025 Fee
Compendium. Supervisor Hooker seconded the motion. Motion Approved.

AGENDA ITEM: Ordinance approving an intergovernmental agreement for
operation of the Roanoke Regional Fire Training Center

ISSUE:
The current intergovernmental agreement with the City of Roanoke and the City of
Salem for operation of the Roanoke Regional Fire Training Center is set to expire on
June 30, 2024, and a new agreement needs to be executed.
BACKGROUND:
Since 1999, Roanoke County, the City of Roanoke, and the City of Salem have
operated a multi jurisdictional training center for fire and emergency services personnel
in order to maximize training opportunities, combine resources, and efficiently utilize
time of training staff. The three jurisdictions entered into an agreement on March 31,
1999 to set forth the terms, conditions, and shared obligations of the parties with
respect to construction, maintenance, and operation of the training center.
The Town of Vinton was an original participant to the 1999 agreement, but subsequently
it was decided that Roanoke County would assume direction and control of fire and
emergency medical services for the Town of Vinton.
The 1999 agreement was set to expire on April 1, 2024, but was extended by
agreement of the parties and will now expire on June 30, 2024:

DISCUSSION:
The attached "Roanoke Regional Training Center Agreement" was drafted by the
Roanoke County Attorney's Office, and has been reviewed and approved by the
participating localities: Roanoke County, Roanoke City, and the City of Salem. The
proposed agreement outlines:
An effective date of July 1, 2024, with an initial term of three (3) years and an
option to extend for an additional two (2) years;
• Roanoke County's continued ownership of the land and improvements on
Kessler Mill Road which house the training center;
• A cost sharing allocation for operating costs to be as follows: Roanoke County
-48%, Roanoke City -44%, and City of Salem - 8%;
• The total annual operating costs of the center to be $120,000, to be shared by
the participating localities pursuant to the cost sharing allocation, or more
specifically as follows: Roanoke County - $57,600, Roanoke City - $52,800,
City of Salem - $9,600;
• Roanoke County's obligation to serve as the fiscal agent for the training
center;
• Roanoke County's obligation to maintain general liability insurance on the
training center;
• Other general budget and fiscal matters;
Membership and rules of the Training Center Committee, which is made up of
members from each locality; and
• Provisions for the withdrawal of a party, including a provision stating that "any
party withdrawing from [the] Agreement shall not be entitled to and shall not
receive any financial or other compensation, adjustment, or credit of any type
for the value of equipment, assets, grant, or other funds .. or items that may
be used or held for the benefit of the Training Center or owned by the
Committee."
FISCAL IMPACT:
Roanoke County's share of the operating cost of the training center shall be $57,600
annually, and Roanoke County's share of additional costs of managing the training
center (i.e. utilities, maintenance, snow removal, costs to replace equipment) shall be
48% of such cost. Roanoke County is also obligated to carry general liability insurance
for the training center.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of the ordinance to approve the
intergovernmental agreement for the operation of the Roanoke Regional Fire Training

Center and scheduling the second reading for June 11, 2024.

Supervisor Radford moved to approve the first reading of this ordinance and scheduling
the second reading for June 11, 2024. Supervisor Mahoney seconded the motion.

ISSUE:
Conduct second reading of two ordinances to appropriate funds for fiscal year 2024-
2025 County of Roanoke operating and capital budgets and approve the County of
Roanoke Classification and Pay Plan for fiscal year 2024-2025.
BACKGROUND:
The fiscal year 2024-2025 operating budget and the fiscal year 2025-2034 Capital
Improvement Program (CIP) were presented to the Board of Supervisors on March 26,
2024 and reflect the tax rates adopted at the Board meeting held on April 9, 2024. The
budget was advertised in the Roanoke times on April 14, 2024, and May 5, 2024 and is
reflected in the attached ordinance.
Public hearings on the budget were held on April 23, 2024, and May 14, 2024, to
receive written and oral comment from the public concerning the proposed fiscal year
2024-2025 operating budget and the proposed fiscal year 2025-2034 Capital
Improvement Program.
Attached for your approval are two budget appropriation ordinances for fiscal year 2024-
2025 and the Classification and Pay Plan for fiscal year 2024-2025. County staff has
divided the appropriation into two ordinances. Each ordinance will be voted on

separately.
DISCUSSION:
The County General Government Fund totals $260.48 million and is appropriated as
part of the County's operations ordinance. The budget is recommended to be
appropriated in two separate budget ordinances. Because of delays in the adoption of
the state budget, the ordinance to adopt the school categories will be presented at a
later date.
(a) The first budget ordinance provides funding in the amount of$335,582,253 in fiscal
year 2024-2025 for the County's operations budget. The ordinance also approves
the County's Classification and Pay Plan for fiscal year 2024-2025.
(b) The second budget ordinance provides funding in the amount of $17,257,357 in
fiscal year 2024-2025 for the County's capital budget including the first year of the
ten-year Capital Improvement Program.
There have been no changes since the first reading held on May 14, 2024.
FISCAL IMPACT:
Approval of the fiscal year 2024-2025 budget appropriation ordinances provides funding
for County operations, transfers and capital budgets effective July 1, 2024.
STAFF RECOMMENDATION:
Staff recommends approval of the second reading of the two fiscal year 2024-2025
budget appropriation ordinances. Staff also recommends approval of the attached
Classification and Pay Plan for fiscal year 2024-2025.

WHEREAS, upon notice duly published in the newspaper, public hearings were
held on April 23, 2024 and May 14, 2024 concerning the adoption of the annual budget
for Roanoke County for fiscal year 2024-2025; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved said
budget on May 28, 2024, pursuant to the provisions of Section 13.02 of the Roanoke
County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as amended;
and
WHEREAS, the first reading of this appropriation ordinance was held on May 14,
2024, and the second reading of this ordinance was held on May 28, 2024, pursuant to
the provisions of Section 18.04 of the Roanoke County Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:

2. That the County Administrator may authorize or delegate the authorization of
the transfer of any unencumbered balance or portion thereof from one
department to another.
3. That all funded outstanding operating encumbrances at June 30, 2024, are re-
appropriated to the 2024-2025 fiscal year to the same department and account
for which they are encumbered in the previous year.
4. That all General Government Fund unexpended appropriations and all General
Government revenues collected in excess of appropriated revenues at the end
of any fiscal year not lapse but shall be re-appropriated and presented to the
Board of Supervisors for allocation based on guidance provided in Section 10-
1 through 5 of the County of Roanoke Comprehensive Financial Policy as
approved by the Board of Supervisors.
5. Account balances remaining in the Fee Class Fund collected by the Parks,
Recreation and Tourism Department will be allocated to accounts as defined
by the Fee Class Accounts Procedure.
6. Account balances remaining in Children's Services Act (C111), Police
Confiscated Property (C120), Police Special Programs (C121), Forfeited Asset
Sharing (C122), Sheriff Confiscated Property (C123), Sheriff Jail Fees (C124),

to the Grants Fund for the various functions and purposes as provided therein,
and said appropriation shall be acknowledged and allocated to the appropriate
fund upon approval by the Board of Supervisors on the Consent Agenda.
8. That the Board of Supervisors approves the County of Roanoke Classification
and Pay Plan. The Classification and Pay Plan included as part of this
ordinance is effective July 1, 2024. The County Administrator shall implement
the County Classification and Pay Plan pursuant to Board of Supervisors
Resolution 082515-1.
9. This ordinance shall take effect July 1, 2024.
On motion of Supervisor Hooker to approve the proposed ordinance appropriating
funds for the fiscal year 2024-2025 operations budget and approval of the classification
and pay plan for fiscal year 2024-2025; seconded by Supervisor Radford and carried by
the following roll call and recorded vote:

2. That the County Administrator may authorize or delegate the authorization of the
transfer of any unencumbered balance or portion thereof from one project to
another so as to provide for the completion of a capital project.
3. That all funded outstanding capital encumbrances at June 30, 2024, are re-
appropriated to the 2024-2025 fiscal year to the same account for which they are
encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the end of the
fiscal year but shall remain appropriated until the completion of the project or until
the Board of Supervisors, by appropriate action, changes or eliminates the
appropriation. Upon completion of a capital project, staff is authorized to close out
the project and transfer to the funding source any remaining balances. This
section applies to appropriations for capital projects at June 30, 2024, and
appropriations in the 2024-2025 fiscal year budget.
5. That the Board of Supervisors anticipates receiving various grants, donations, and
other miscellaneous revenues. These anticipated funds are appropriated to the
Grants Fund for the various functions and purposes as provided therein, and said
appropriation shall be acknowledged and allocated to the appropriate fund upon
approval by the Board of Supervisors on the Consent Agenda.
6. This ordinance shall take effect July 1, 2024.

ISSUE:
Amendment to Section 7-71 of the Roanoke County Code.
BACKGROUND:
Section 7-71 of the Roanoke County Code, last amended in September 2004,
establishes the fee schedule for building and demolition permits by incorporating, by
reference, the fee schedule attached to ordinance No. 092804-7 (adopted by the Board
of Supervisors on September 28, 2004).
DISCUSSION:
It is proposed that, after 20 years with no increase, the Board approve fee increases for
building permit fees. Insofar as the County code references the fee schedule adopted in
2004, the code must be amended to reference a newly adopted fee schedule.
It is proposed that under the new fee schedule, building fees would be as follows:
1) for structures valued from $1,000 to $100,000, a "base fee" of$40 shall be imposed,
along with a "multiplier" of$6 per each $1,000 of value, beginning at $6,000 of value;
2) for structures valued from $101,000 to $500,000, a "base fee" of $610 shall be
imposed, along with a "multiplier" of$2.50 per $1,000 of value;
3) for structures valued from $501,000 to $1,000,000, a "base fee" of $1,610 shall be

imposed, along with a "multiplier" of$1.50 per $1,000 of value; and
4) for structures valued over $1,000,000, a "base fee" of$2,360 shall be imposed, along
with a "multiplier" of$0.50 per$1,000 in value.
Attached to this report are two charts:
A) a comparison chart, showing the current fees charged, compared to the proposed
fees, along with applicable state and technology fees for building projects, and
B) a chart showing the new proposed fee schedule, as it will be attached and
incorporated by reference to the proposed ordinance amending the County Code
FISCAL IMPACT:
Based on the average fees collected in prior years, we anticipate an increase in the
range of$160,000 +/- of building fees collection for fiscal year 2024/25.
STAFF RECOMMENDATION:
Staff recommends that the Board conduct the required public hearing on this matter and
subsequently approve ordinance as proposed.

WHEREAS, Section 7-71 of the Roanoke County Code, last amended in

WHEREAS, after 20 years with no increase, and upon recommendation of the
Director of Development Services and the Building Commissioner, it is proposed that the
Board adopt an updated fee schedule for building fees as set forth on the attached fee
schedule; and
WHEREAS, the County Code references the fee schedule adopted in 2004, the
Code must be amended to reference the newly adopted fee schedule; and
WHEREAS, the first reading of this ordinance was held on May 14, 2024, and the
second reading and public hearing were held on May 28, 2024.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, that
the Roanoke County Code is hereby amended to read and provide as follows:
Sec. 7-71. -Building permit fees.
Permit fees are determined by calculating a value of construction. In order to derive this
valuation, the square footage of the structure is multiplied by the building construction value
base rates as adjusted annually by the county real estate valuation office.
An estimated cost of construction is obtained from the applicant and is used to determine the
permit fees for applications that do not correspond to the square footage construction value

base rates as described above. This includes, but is not limited to, interior and exterior
alterations, roofing and siding construction, and demolitions.
There is hereby established the following schedule for fees for building and demolition permits

ISSUE:
Board of Supervisors action is needed to accept and appropriate $500,000 in Surface
Transportation Block Grant (STBG) funds for the Roanoke River Greenway through
Explore Park Project (VDOT UPC 113567) and to authorize an amendment to the
contract with AECOM Technical Services, Inc. for professional services needed to
complete the project.
BACKGROUND:
The Explore Park greenway segment is proposed to complete the eastern end of the
Roanoke River Greenway. The proposed greenway will be approximately 1.5 miles
long, ten (10)-feet wide, paved and ADA accessible. The route will parallel the Roanoke
River through Explore Park from Rutrough Point to connect to the greenway segment
under construction across the Roanoke Valley Resource Authority Rutrough Road
(closed) landfill.
The Roanoke Valley Transportation Planning Organization (RVTPO) designated

$3,020,308 in Regional Surface Transportation Program (now Surface Transportation
Block Grant) funding for this project in March 2018. This funding was accepted and
appropriated on March 24, 2020.
Roanoke County requested additional project funding in November 2022 due to supply
chain issues, inflation and labor shortages which had increased the project cost since
the original 2017 estimate. The RVTPO awarded $1,275,000 in Carbon Reduction
Program (CRP) funding for the project on April 27, 2023, which was accepted and
appropriated on August 22, 2023.
The original contract with AECOM for engineering consulting services for design,
permitting, and construction administration and inspection was for $629,658. Notice to
proceed was issued to AECOM on November 9, 2020.
Since that time there have been six (6) contract amendments that have been
considered and approved administratively that have increased the contract amount to
$713,434 (113% of the original contract amount) for additional survey work, cultural and
environmental work, revisions to the trail alignment in response to Virginia Recreational
Facilities Authority (VRFA) Board member comments and to coordinate the terminus
with the end of the adjacent greenway project.
DISCUSSION:
Additional Surface Transportation Block Grant (STBG) funding in the amount of
$500,000 was requested in November 2023 to provide contingency funding because the
Engineer's Estimate matched the available project funds. At the March 28, 2024,
RVTPO meeting, $500,000 in STBG funding was awarded to the project.
AECOM has requested a seventh (7th) contract amendment in the amount of$91,280 to
cover costs associated with additional effort to update bidding documents due to a
bidding delay; increases in construction administration/inspection services cost due to
inflation escalation and due to the estimated construction period increasing from seven
(7) months to ten (10) months. This change in the length of the time of construction is
due to regulatory time of year restrictions for tree clearing to protect the Tricolored Bat.
Staff also requests a $25,000 contingency to respond to minor contract changes
through the end of the project. The requested additional funding increases the AECOM
contract to $828,714, which is one-hundred thirty-two percent (132%) of the original
contract amount. According to Roanoke County procurement regulations and the
Procurement Code of Virginia, changes exceeding one-hundred twenty-five percent
(125%) must be approved by the Board of Supervisors.
Roanoke County has received construction bids for the Roanoke River Greenway
through Explore Park and is in the process of obtaining VDOT approval to award the
construction contract to Allegheny Construction Company, Inc. Construction is

anticipated to start mid-November 2024.
There have been no changes since the first reading held on May 14, 2024.
FISCAL IMPACT:
The $500,000 in STBG funding and all other project funding is one hundred percent
(100%) Federal and State with no local match required. This project is locally
administered, necessitating acceptance and appropriation of this funding to the Grant
Fund to facilitate project reimbursement requests.
Funding is available in the project budget to accommodate the AECOM contract
amendment.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the ordinance.

amount of $3,020,308 in 2018 for design and construction of the Roanoke River
Greenway through Explore Park; and
WHEREAS, the County was awarded Carbon Reduction Program (CRP) funding
in the amount of$1,275,000 in April 2023 to satisfy a project deficit; and
WHEREAS, the County was awarded STBG funding in the amount of $500,000
in March 2024 to provide a project contingency; and
WHEREAS, the project is locally administered, and certain agreements between
the County of Roanoke and the Virginia Department of Transportation (VDOT) must be
executed for this cooperative work to be accomplished; and
WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and

ISSUE:
Accept and appropriate $30,000 of grant funding from the Department of Rail and Public
Transportation (DRPT) through the Transit Ridership Incentive Program (TRIP), for the
installation of a bus shelter and amenities at the existing Valley Metro Route 52 bus
stop on Route 419 at Copper Croft Apartments.
BACKGROUND:
In 2015, Roanoke County applied for HB 2 funding through the Virginia Department of
Transportation (VDOT) for improvements to the Route 419 corridor between Ogden
Road and Route 220.The funding was to widen Southbound Route 419 and add safety
and multimodal improvements. Part of the project was to consolidate three existing
Valley Metro bus stops into one bus stop and create a concrete pad for future
installation of a bus shelter for the existing bus stop on the Valley Metro route.
The existing 16-foot-wide and 16-foot-deep concrete pad is located in front of Copper
Croft Apartments on Route 419 across from Tanglewood Mall.
DISCUSSION:
Roanoke County desires to provide an enhanced experience for bus riders with shelter
from the weather, a place to rest, and a safely lighted bus shelter.

Passenger amenities and facilities greatly improve the transit rider experience and
increase the accessibility of the system. TRIP supports the addition and improvement of
passenger related infrastructure and allows for improvements to existing bus stops.
DRPT offered a mid-cycle grant opportunity in October 2023 through TRIP to allow for
improvements to existing bus stops. Planning staff applied for TRIP funding in October
2023 for the installation of a bus shelter and amenities at the Route 419 bus stop. TRIP
funding was approved on December 4, 2023, by the Commonwealth Transportation
Board.
Acceptance and appropriation of the grant funding will enable staff to work with a
vendor to fabricate a design associated with the 419 Town Center Plan that was
adopted by the Board of Supervisors in July 2019. Along with the installation of an ADA
accessible
14-foot-wide bus shelter with tinted roof, amenities will include a bench and trash
receptacle. The bus shelter will have a 12-volt, 60-watt Polycrystalline Solar Panel and
Lexan top.
There have been no changes since the first reading held on May 14, 2024.
FISCAL IMPACT:
Roanoke County was awarded $30,000 in TRIP funding from DRPT to be reimbursed
by March 3, 2025. The funding includes $20,400 of state funds, which is sixty-eight
percent (68%) of the total project cost and will be deposited in the Grant Fund. A $9,600
required local match, thirty-two percent (32%) will be allocated from the Roanoke

APPROPRIATING SUCH FUNDS, ALONG WITH A $9,600 LOCAL
MATCH, FOR THE INSTALLATION OF A BUS SHELTER AND
AMENITIES AT THE EXISTING VALLEY METRO ROUTE 52 BUS STOP
WHEREAS, in 2015, Roanoke County received funding through the Virginia
Department of Transportation for improvements to the Route 419 corridor between Ogden
Road and Route 220, including consolidation of three existing Valley Metro bus stops into
one bus stop and creating a concrete pad for future installation of a bus shelter for the
existing bus stop on the Valley Metro route; and
WHEREAS, the existing 16-foot-wide and 16-foot-deep concrete pad is located in
front of Copper Croft Apartments on Route 419 across from Tanglewood Mall; and
WHEREAS, Roanoke County desires to provide an enhanced experience for bus
riders with shelter from the weather, a place to rest, and a safely lighted bus shelter to
greatly improve the transit rider experience and increase system accessibility; and
WHEREAS, this bus shelter project has been selected by the Commonwealth
Transportation Board, funded through the Virginia Department of Rail and Public
Transportation's ("DRPT") Transit Ridership Incentive Program ("TRIP"), for a grant in the
amount of$20,400, with a local match of$9,600, for a total grant amount of$30,000 for
the installation of a bus shelter and amenities; and
WHEREAS, the estimated total project cost is $30,000 to include fabrication of the
bus shelter design and installation; and
WHEREAS, the required $9,600 local match will be allocated from the Roanoke
County Department of Planning General Fund; and
WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and
WHEREAS, the first reading of this ordinance was held on May 14, 2024, and the
second reading was held on May 28, 2024.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the sum of $20,400 in TRIP funding from DRPT is hereby accepted
and appropriated to the Grant Fund.
2. That the County's matching sum of $9,600 be allocated from the Planning
General Fund to the Grant Fund.
3. That this ordinance shall take effect from and after the date of adoption.

ISSUE:
To accept and appropriate funds from Roanoke City and Franklin County in the
combined total of $202,805.84 for the 911 Genesis-Aided Dispatch Interface capital
project (Capital Project).
BACKGROUND:
The Capital Project was approved and funded for $220,000 with the County being the
only funding source as part of the FY2024 Capital Improvement Program. Our partners,
Roanoke City and Franklin County, have recently requested to join us on this project.
DISCUSSION:
Allowing Roanoke City and Franklin County to participate with us will increase the total
cost of the project to $304,208.74 from the $220,000 currently budgeted.
Roanoke City and Franklin County have each agreed to pay Roanoke County
$101,402.92 for a total amount of$202,805.84.
Staff is requesting the approval of the increase in cost of the project and the acceptance
of funds from Roanoke City and Franklin County to offset the increased cost.

There have been no changes since the first reading held on May 14, 2024.
FISCAL IMPACT:
The total project cost will increase to $304,208.74 from $220,000 for a net change of
$84,208.74. This increase will be offset by the $202,805.84 that will be received by
Roanoke City and Franklin County, which reduces the County costs from $220,000 to
$101,402.92. This results in a savings to the County in the amount of$118,597.08.
The additional funding from the other localities will be deposited in the Capital Fund
within the already established project. Once the project is closed the remaining savings
will be closed out and returned to capital reserves.
STAFF RECOMMENDATION:
Staff recommends approval of the increase in cost and the acceptance of funds from
Roanoke City and Franklin County to offset the increased cost.

ISSUE:
Agenda item for public hearing and second reading of ordinance to rezone a portion of
property from residential to commercial, obtain a special use permit for mini-warehouse,
and amend the proffered conditions.
BACKGROUND:
• In September 2022, the Board of Supervisors approved a rezoning of
approximately 3.46 acres from R-1 (Low Density Residential) to C-2 (High
Intensity Commercial), to construct a four-story hotel, and approximately 28.86
acres from R-1 to R-3 (Medium Density Multi-Family Residential) to construct 80
townhomes.
• The Roanoke County Zoning Ordinance defines a mini-warehouse as "a building

designed to provide rental storage space in cubicles where each cubicle has a
maximum floor area of four hundred (400) square feet. Each cubicle shall be
enclosed by walls and ceiling and have a separate entrance for the loading and
unloading of stored goods." Mini-warehouse requires a special use permit in a C-
2 (High Intensity Commercial) district.
• The County Zoning Ordinance defines townhouses as "a grouping of three (3) or
more attached single-family dwellings in a row in which each unit has its own
front and rear access to the outside, no unit is located over another unit, and
each unit is separated from any other unit by one (1) or more common walls."
Townhouses are permitted in the R-3, Medium Density Multi-Family Residential
District.
DISCUSSION:
The Planning Commission held a public hearing on this application on May 7, 2024.
Two (2) citizens spoke at the public hearing. One citizen had concerns about buffers
and the noise generated by Interstate 81. The other citizen spoke in opposition to the
project. Prior to the public hearing, two (2) citizens emailed comments to staff. The first
mentioned the green space located on the subject parcel which is indicated not to be
disturbed, and the second questioned if the proffered conditions would remain on the
property if the property was sold.
The Planning Commission discussed the project history, mini-warehouse use, buffers,
noise, community outreach, proffered conditions, surrounding zoning and land uses,
and the future land use. The Planning Commission recommends approval of the
application with the following proffered conditions:
1. The townhomes and 2-story storage building shall be developed in substantial
conformance with the Edgebrook Park Overall Development Plan (Exhibit B) dated
March 22, 2024, prepared by Balzer and Associates, Inc. No grading or
development shall take place in the areas designated as existing vegetation to
remain as buffer, stream buffer or area to remain undisturbed as shown on the
Edgebrook Park Overall Development Plan dated March 22, 2024, prepared by
Balzer and Associates, Inc. Development of the remaining vacant areas of
Commercial Area A and Commercial B shall be done in accordance with the
applicable Roanoke County development regulations at the time of development and
restricted to the uses stated in Proffer#3.
2. The maximum building height for any structure shall be 45 feet.
3. The Property shall be limited to the following uses:
Commercial Area A- Mini-warehouse (Self-Storage) Only
Commercial Area B - Office Uses - General Office; Medical Office; Laboratory;
Commercial Uses - Personal Services; Restaurant, General (No Drive Through);

STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the second reading of an
ordinance to approve the application with the following proffered conditions:
1. The townhomes and 2-story storage building shall be developed in substantial
conformance with the Edgebrook Park Overall Development Plan (Exhibit B) dated
March 22, 2024, prepared by Balzer and Associates, Inc. No grading or
development shall take place in the areas designated as existing vegetation to
remain as buffer, stream buffer or area to remain undisturbed as shown on the
Edgebrook Park Overall Development Plan dated March 22, 2024, prepared by
Balzer and Associates, Inc. Development of the remaining vacant areas of
Commercial Area A and Commercial B shall be done in accordance with the
applicable Roanoke County development regulations at the time of development and
restricted to the uses stated in Proffer#3.

3. The Property shall be limited to the following uses:

VOTE:
Supervisor Hooker found that the proposed special use permit:
1. Meets the requirements of Section 30-19-1 of the Roanoke County Code and
that the proposed special use conforms with the standards set forth in article IV,
use and design standards of the Roanoke County Zoning Ordinance;
2. Is partly in conformance with the Roanoke County Comprehensive Plan, and
partly inconsistent with the Roanoke County Comprehensive Plan; and
3. Will have a minimum adverse impact on the surrounding neighborhood and
community.
Therefore, moved that the Board approve the petition to obtain a special use permit.
AND Supervisor Hooker also found that the proposed rezoning requests to A) rezone
approximately 16.27 acres of land from R-3C to C-2C, and B) Amend the proffered
conditions on 32.323 acres of land zoned C-2C and R-3C:

1. Are partly consistent with the Roanoke County Comprehensive Plan, and partly
inconsistent with the Roanoke County Comprehensive Plan,
2. Are good zoning practice, and
3. Will not result in substantial detriment to the community.
Accordingly, Supervisor Hooker moved that the Board approve the rezoning requests as
they have been requested, with the following amended proffered conditions to replace
the previous proffered conditions from September 2022 on the entire 32.323 acres
subject to this petition:
1. The townhomes and 2-story storage building shall be developed in substantial
conformance with the Edgebrook Park Overall Development Plan (Exhibit B)
dated March 22, 2024, prepared by Balzer and Associates, Inc. No grading or
development shall take place in the areas designated as existing vegetation to
remain as buffer, stream buffer or area to remain undisturbed as shown on the
Edgebrook Park Overall Development Plan dated March 22, 2024, prepared by
Balzer and Associates, Inc. Development of the remaining vacant areas of
Commercial Area A and Commercial B shall be done in accordance with the

WHEREAS, ABoone Real Estate, Inc. is requesting (1) to rezone approximately
16.27 acres of land from R-3C (Medium Density Multi-Family Residential District with
conditions) to C-2C (High Intensity Commercial District with conditions), (2) to obtain a
special use permit for mini-warehouse on approximately 19.73 acres zoned C-2C (High
Intensity Commercial District with conditions), and (3) to amend the proffered conditions
on 32.323 acres of land zoned C-2C (High Intensity Commercial District with conditions)
and R-3C (Medium Density Multi-Family Residential District with conditions) in order to
construct mini-warehouses, townhomes, and other commercial/office uses in the 1300
and 1400 blocks of Edgebrook Road, Catawba Magisterial District (Tax Map No: 035.04-
02-33.00-0000); and
WHEREAS, the first reading of this ordinance was held on April 23, 2024, and the
second reading and public hearing were held on May 28, 2024; and

WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on May 7, 2024; and
WHEREAS, the Planning Commission recommends approval of the petition as
requested; and
WHEREAS, legal notice and advertisement have been provided for as required by
law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The petition of ABoone Real Estate, Inc. to rezone approximately 16.27
acres of land from R-3C (Medium Density Multi-Family Residential District
with conditions)to C-2C (High Intensity Commercial District with conditions)
is approved.
2. The petition of ABoone Real Estate, Inc. to obtain a special use permit for
mini-warehouse on approximately 19.73 acres zoned C-2C (High Intensity
Commercial District with conditions) is approved.
3. The petition of ABoone Real Estate, Inc. to amend the proffered conditions
on 32.323 acres of land zoned C-2C (High Intensity Commercial District
with conditions)and R-3C (Medium Density Multi-Family Residential District
with conditions) is approved. The following three (3) proffered conditions
shall replace the previous proffered conditions from September 2022 on the
entire 32.323 acres subject to this petition:
a. The townhomes and 2-story storage building shall be developed in
substantial conformance with the Edgebrook Park Overall Development
Plan (Exhibit B) dated March 22, 2024, prepared by Balzer and

5. The Board further finds that the proposed special use permit meets the
requirements of Section 30-19-1 of the Roanoke County Code and that the
proposed special use conforms with the standards set forth in article IV, use
and design standards of the Roanoke County Zoning Ordinance. The Board
further finds that the special use permit is partly in conformance with the

6. This ordinance shall be in full force and effect thirty (30) days after its final

ISSUE:
Agenda item for public hearing and second reading of ordinance for a special use
permit for short-term rental in a residential district.
BACKGROUND:
• The Roanoke County Zoning Ordinance defines a short-term rental as "the
provision of a room or space that is suitable or intended for occupancy for
dwelling, sleeping, or lodging purposes, for a period of fewer than 30 consecutive
days, in exchange for a charge for the occupancy. This use does not include
existing uses defined in this ordinance including bed and breakfast, bed and
breakfast inn, boarding house, country inn, and hotel/motel/motor lodge."
A short-term rental has several use and design standards. In the R-1 and R-2
zoning districts, a special use permit is required for a short-term rental on lots
less than five (5) acres in size.
DISCUSSION:
The Planning Commission held a public hearing on this application on May 7, 2024.
Two (2) citizens spoke during the public hearing. One citizen had questions regarding

impact to real estate values, insurance rates, the vetting process for renters, safety, and
the extent of the special use permit. The other citizen supported the special use permit
request.
The Planning Commission discussed the property owner's vetting process for renters,
the number of overnight guests, that no complaints have been received from neighbors,
the property owner lives on the upper floor of the house with his family, special use
permit conditions, surrounding zoning, and future land use.
The Planning Commission recommends approval of the special use permit for a short-
term rental with the following conditions:
1. The short-term rental shall be limited to the lower level of the existing residential
dwelling (approximately 1,800 square feet).
2. The number of overnight guests shall not exceed six (6) people.
3. One (1) off-street parking space shall be provided for each guestroom in addition
to parking spaces required for the principal dwelling. All parking shall be
provided on-site and shall be located in driveways and other designated
approved parking areas.
4. The property owner shall provide and maintain in good working order every
smoke detector, carbon monoxide detector, and fire extinguisher required by law.
Exits required by law shall not be obstructed.
5. The property must maintain a residential appearance. No signage shall be
allowed with the short-term rental use.
6. No events such as parties, banquets, weddings, receptions, meetings, or similar
events shall be allowed with the short-term rental use.
7. A business license shall be obtained from the Commissioner of Revenue for the
short-term rental use.

ORDINANCE 052824-10 GRANTING A SPECIAL USE PERMIT TO
RAMSEYS AND JESICA SANDOVAL TO OPERATE A SHORT-TERM
RENTAL ON APPROXIMATELY 0.3794 ACRE OF LAND ZONED R-1
(LOW DENSITY RESIDENTIAL DISTRICT), LOCATED AT 5207 NORTH
SPRING DRIVE, CATAWBA MAGISTERIAL DISTRICT
WHEREAS, Ramseys and Jesica Sandoval have filed a petition for a special use
permit to operate a short-term rental on approximately 0.3794 acres of land zoned R-1
(Low Density Residential District), located at 5207 North Spring Drive (Roanoke County
Tax Map #037.09-01-41.00-0000), in the Catawba Magisterial District; and
WHEREAS, the first reading of this ordinance was held on April 23, 2024, and
the second reading and public hearing were held on May 28, 2024; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on May 7, 2024; and
WHEREAS, the Roanoke County Planning Commission recommends approval of
the petition to obtain a special use permit, with seven (7) conditions; and
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the
County of Roanoke, Virginia, as follows:
1. The Board finds that the proposed special use meets the requirements of
Section 30-19-1 of the Roanoke County Code and that the proposed special use
conforms with the standards set forth in article IV, use and design standards of the
Roanoke County Zoning Ordinance.

2. The Board further finds that the proposed special use is in conformance
with the Roanoke County Comprehensive Plan and will have a minimum adverse
impact on the surrounding neighborhood and community.
3. The special use permit is hereby approved, with the following conditions:
a. The short-term rental shall be limited to the lower level of the
existing residential dwelling (approximately 1,800 square feet).
b. The number of overnight guests shall not exceed six (6) people.
c. One (1) off-street parking space shall be provided for each
guestroom in addition to parking spaces required for the principal
dwelling. All parking shall be provided on-site and shall be located
in driveways and other designated approved parking areas.
d. The property owner shall provide and maintain in good working
order every smoke detector, carbon monoxide detector, and fire
extinguisher required by law. Exits required by law shall not be
obstructed.
e. The property must maintain a residential appearance. No signage
shall be allowed with the short-term rental use.
f. No events such as parties, banquets, weddings, receptions,
meetings, or similar events shall be allowed with the short-term
rental use.
g. A business license shall be obtained from the Commissioner of
Revenue for the short-term rental use.
4. This ordinance shall be in full force and effect thirty (30) days after its final
passage.
On motion of Supervisor Hooker to adopt the ordinance; seconded by Supervisor
Radford and carried by the following roll call and recorded vote:
