ISSUE:
To adopt a resolution declaring the intent to reimburse expenditures from future bond
proceeds
BACKGROUND:
Renovations to the Glen Cove and W.E. Cundiff Elementary Schools and the
construction of a new CTE are projects in the Roanoke County School Board Capital
Improvement Plan. On June 15, 2023, the School Board approved receipt of an
unsolicited proposal and published notification to accept competing proposals. As
negotiations are finalized, any funds that are currently being spent can be reimbursed to
the School Board at a later date with bond proceeds, if the County declares its intention
to do so before the funds are spent.
DISCUSSION:
The School Board intends to fund these three (3) projects with a combination of cash
reserves and scheduled bond issuances as outlined in the memorandum of
understanding on joint capital projects dated April 11, 2023, and also as sho wn on
Attachment A. It is the intent to participate in the fiscal year 2024 Virginia Literary Loan

Program as well as an issuance in fiscal year 2025 through the Virginia Public School
Authority.
The attached resolution will allow the School Board to reimburse itself at a later
date. This resolution does not authorize the projects or appropriate any funds to the
projects at this time; it merely gives the flexibility to include current expenditures in
future bond issuances, if the School Board chooses to do so.
FISCAL IMPACT:
This resolution gives the School Board the option to include expenditures
currently being made associated with these projects.
STAFF RECOMMENDATION:
Staff recommends approving the attached reimbursement resolution for the
renovations to the Glen Cove and W.E. Cundiff Elementary Schools and the
construction of a new CTE .

RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY
OF ROANOKE, VIRGINIA, DECLARING ITS INTENTION TO
REIMBURSE ITSELF FROM THE PROCEEDS OF ONE OR MORE
FINANCINGS FOR CAPITAL PROJECTS FOR PUBLIC SCHOOL
PURPOSES
WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia (the
"County"), has determined that it may be necessary or desirable to advance money to
pay the costs of certain capital projects for public school purposes, consisting primarily of
costs associated with the design and construction to renovate W.E. Cundiff Elementary
and Glen Cove Elementary Schools and the design and construction of a new C areer and
Technical Education Center (CTE) described in the County's capital improvement
program, as it may be amended from time to time (the "Projects").
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF
THE COUNTY OF ROANOKE, VIRGINIA:
1. The Board of Supervisors adopts this Resolution as a declaration of official
intent under Treasury Regulations Section 1.150-2.
2. The Board of Supervisors reasonably expects to reimburse advances made
or to be made by the County or the Roanoke County School Board to pay the costs of the
Projects from the proceeds of its debt or other financings (collectively, the "Bonds"). The
maximum amount of debt or other financing expected to be issued in one or more series
for the Projects is $121,560,000.

3. On the date each advance is made, it will be a capital expenditure (or would
be with a proper election) under general federal income tax principles or will otherwise
comply with the requirements of Treasury Regulations Section 1.150-2(d)(3).
4. The County reasonably expects to reimburse the advances made prior to
the issuance of the Bonds to finance the Project from the proceeds of the Bonds and the
adoption of this Resolution is consistent with the budgetary and financial circumstances
of the County.
5. This resolution shall take effect immediately upon its adoption.

ISSUE:

and Public Transportation, to be used to offset the monthly cost of the CORTRAN
program, and appropriating $19,379 amount of County funds from the CORTRAN
budget for the required local match.
BACKGROUND:
The CORTRAN program was established in 1985 in order to help County residents
remain in their homes and independent with curb -to-curb transportation from their
homes to destinations within Roanoke County, the City of Roanoke, the City of Salem
and the Town of Vinton. The program is currently structured so that Roanoke Coun ty
residents are eligible to use the CORTRAN program if they are either 65 years of age or
better, or if they have a disability.
While Roanoke County funds the program annually, staff started applying for grant
funding through the Department of Rail and Public Transportation (DRPT) for fiscal year
2022 to offset the County's cost of the program. Previous awards include:

DISCUSSION:
Staff applied for FTA 5310 funding through DRPT on February 1, 2023.
The Commonwealth Transportation Board adopted the Six-Year Improvement Program
on June 21, 2023, which included an award of $484,470 fo r the CORTRAN program
($465,091, with a required local match of $19,379).
DRPT has indicated that funding is still available from the Bipartisan Infrastructure Law
providing additional funding to DRPT to be distributed to transit programs around the
Commonwealth. This is the second time Roanoke County has received funding for the
rural area of the county.
The FTA Section 5310 grant for rural and urban funding is limited to be reimbursed
monthly starting October 1, 2023, through September 30, 2024.
FISCAL IMPACT:
Roanoke County was awarded $163,727 in rural capital funding and $301,364 in urban
capital funding totaling $465,091 for the CORTRAN program, which represents 80
percent (80%) Federal funding, 16 percent (16%) State funding and requires a fo ur
percent (4%) local match of $19,379 for a total grant of $484,470.
The FTA Section 5310 grant funding will be used to offset the monthly cost of the
CORTRAN program. The local match funding is available in the CORTRAN fiscal year
2024 budget.
STAFF RECOMMENDATION:
Staff recommends approval of the first reading of the ordinance and requests
scheduling of the second reading for September 12, 2023.

WHEREAS, the first reading of this ordinance was held on August 22, 2023, and
the second reading was held on September 12, 2023.
NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

Public Transportation and appropriated to the Grant Fund for the purpose
of operating the CORTRAN program.
2. That the sum of $19,379, which funds were previously appropriated to the

the Grant Fund (as the required County contribution for receipt of the funds
from the Department of Rail and Public Transportation).

ISSUE:
Accept and appropriate funding to operate the expanded McAfee Knob Trailhead
Shuttle for half of fiscal year 2024 and all of fiscal year 2025.
BACKGROUND:
Shuttle service to the McAfee Knob trailhead parking lot from the Interstate 81 Exit 140
Park and Ride is again eligible as a New Service project for a Department of Rail and
Public Transportation (DRPT) Demonstration Project Assistance grant. Shuttle service
meets DRPT New Service goals by offering a creative approach in determining a new
travel market for public transportation, as well as by improving the utilization and
productivity of an existing public transportation service with a connection to the Smart
Way and Virginia Breeze bus routes at the I-81 Exit 140 Park and Ride. The proposed
expansion in 2024 will provide a connection to Valley Metro service in the City of Salem.
DRPT awarded a Demonstration Project Assistance Grant for the McAfee Knob
Trailhead Shuttle in the amount of $97,920 for fiscal year 2023 and part of fiscal year
2024. Service began on September 2, 2022, with 716 reservations and 488 passengers

over 37 days of service between Labor Day weekend and Thanksgiving weekend.
Shuttle service resumed on March 3, 2023, and will end on November 26, 2023.
Between March and the end of June, service included 453 reservations and 266 riders
over 51 days of service. Ridership is expected to increase to and through Peak Leaf
Season in October.
The Virginia Department of Transportation (VDOT) obtained funding in 2017 to design
and construct a pedestrian bridge to carry the Appalachian National Scenic Trail (AT)
over Route 311. Bridge construction is anticipated in early 2024 and will result in
complete closure of the existing McAfee Knob Trailhead parking lot for approximately
nine months.
DISCUSSION:
The Board of Supervisors approved a resolution on January 24, 2023, requesting that
the Commonwealth Transportation Board (CTB) fund another Demonstration Project
Assistance grant application for expanded shuttle service to the McAfe e Knob Trailhead
parking lot. The CTB approved the Six-Year Improvement Program on June 21, 2023,
which included $170,709 of state funds for this project for part of fiscal year 2024 and all
of fiscal year 2025.
The expanded shuttle route is necessary due to the closure of the McAfee Knob
Trailhead parking lot for construction of the pedestrian bridge. The following shuttle
stops are planned:
· Current Stop: Interstate 81 Exit 140 Park and Ride
· Current Stop: McAfee Knob Trailhead
· New Stop: City of Salem’s Longwood Park with a nearby Valley Metro bus stop
· New Stop: City of Salem’s Farmers’ Market with a nearby Valley Metro bus stop
· New Stop: VDOT Orange Market Park and Ride
· Potential New Stop: Dragon’s Tooth Trailhead in discussion with the U.S. Forest
Service
Shuttle service will follow the current model which is based upon McAfee Knob Trail
hiker counts:
· During construction in 2024: March 1 through December 1 with 1.5 vehicles
· After construction in 2025: March 7 through June 29 with one vehicle
· Fridays, Saturdays, Sundays and holiday Mondays
· 12 hours per day, adjusting hours for daylight and Daylight Savings Time
The shuttle fare will remain $5 per one-way trip, plus processing fees.

FISCAL IMPACT:
The net project cost is eligible for up to eighty percent (80%) reimbursement by grant
funds and the applicant must provide up to twenty percent (20%) match from non -State
or Federal funds. The estimated net operation costs are $300,901, which could
potentially generate a maximum of $240,721 in eighty percent (80%) state funds and
$60,180 in twenty percent (20%) local match.
In June 2023, the CTB awarded Roanoke County $170,709 in State Demonstration
Grant funds for the second half of fiscal year 2024 and all of fiscal year 2025, which is
approximately seventy one percent (71%) of the County's request.
As a result, the net project cost reimbursable by DRPT is $52,920 in fiscal year 2024
and $117,789 in fiscal year 2025.
The local match required is $13,230 in fiscal year 2024 and $29 ,447 in fiscal year 2025.
Required matching funds and additional shuttle operating funds are available in the
CORTRAN account.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the first reading of the
ordinance and schedule the second reading for September 12, 2023.

Department of Rail and Public Transportation’s Fiscal Years 2024-2029 Six-Year
Improvement Program. I am pleased to report that the Board included $170,709 of state

service from the Interstate 81 Exit 140 Park and Ride Lot to the McAfee Knob Trailhead
parking lot and incorporate expanded service with stops in the City of Salem, the VDOT

continue to positively impact connections for the citizens of the Commonwealth, and DRPT

WHEREAS, the National Park Service’s McAfee Knob Overlook is one of the most
highly visited and photographed locations along the Appalachian National Scenic Trail;
and
WHEREAS, the proposed shuttle service was studied by the National Park Service
as the baseline service scenario in the February 2021 Appalachian National Scenic Trail,
Triple Crown Area Transit Feasibility Study; and
WHEREAS, the expanded shuttle service is needed due to the 2024 closure of the
McAfee Knob Trailhead parking lot for pedestrian bridge construction; and
WHEREAS, the proposed shuttle service is included as part of Recommendation
1.Z. in the Roanoke Valley Transit Vision Plan, which was approved by the Roanoke
Valley Transportation Planning Organization on September 22, 2016; and
WHEREAS, the proposed expanded shuttle service to the National Park Service’s
McAfee Knob Trailhead Parking Lot meets the goals of the Department of Rail and Public
Transportation (DRPT) Demonstration Project Assistance Grant by offering a creative

approach in determining a new travel market for public transportation, as well as by
improving the utilization and productivity of existing public transportation service s with
connections to the Smart Way and Virginia Breeze bus routes at the I-81 Exit 140 Park
and Ride, and to Valley Metro service in the City of Salem; and
WHEREAS, Roanoke County received $52,920 in Demonstration Project
Assistance grant funding from DRPT for the second half of fiscal year 2024 and $117,789
in funding for fiscal year 2025; and
WHEREAS, Roanoke County agrees to provide $13,230 for fiscal year 2024 and

WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and
WHEREAS, the first reading of this ordinance was held on August 22, 2023, and

2. That the sum of $42,677 is re-appropriated from the County’s General Fund
(having previously been appropriated for operation of the CORTRAN

ISSUE:
After execution of the multi-jurisdictional Marcus Alert MOU among local governments,
Blue Ridge Behavioral Healthcare and Frontier Health, a concern arose over whether
the terms of the MOU should require the Sheriffs of the City of Roanoke and Roanoke
County to provide dedicated staff to carry out the Marcus Alert mandates.
BACKGROUND:
The General Assembly authorized the Marcus Alert statute in 2020 which requires,
among other things, a collaborative relationship between parties for a system of uniform
communications and operations of the MARCUS Alert Program while also ensuring that
individuals experiencing behavioral health crisis are served by the behavioral health
comprehensive crisis service system when feasible. The Marcus Alert legislation was
designed as a phased-in program, with the comprehensive response from law
enforcement and the local community services board no later than July 1, 2023.
DISCUSSION:
Removing the requirement for the City of Roanoke and Roanoke County Sheriffs to
dedicate staff to the implementation of Marcus Alert will not affect the ability to carry out
the mandates of the program. Roanoke County Police and City of Roanoke Police will
continue to dedicate staff and provide the requisite law enforcement response for

Marcus Alert. The other parties to the Marcus Alert MOU do not object to this
Amendment.
FISCAL IMPACT:
The amendment to Marcus Alert will not have any fiscal impact on the County.

This Memorandum of Understanding Governing the MARCUS Alert Program for the Roanoke Valley,
Virginia – City of Roanoke, City of Salem, County of Craig, County of Roanoke, County of Botetourt,
Town of Vinton, Virginia, which is the Service Area for Blue Ridge Behavioral Healthcare
(“Agreement”), is amended as noted herein, effective on the ____ day of ________________, 2023
(“Effective Date”), by and between Blue Ridge Behavioral Healthcare (“BRBH”), New River Valley
Community Services (“NRVCS”), Frontier Health (“FH”), Matthew T. Ward, in his official capacity as
Sheriff of Botetourt County (“BCSO”), Botetourt County (“Botetourt”), Roanoke County (“County”), J.
Eric Orange, in his official capacity as Sheriff of Roanoke County (“RCSO”), Roanoke City (“City”),

This First Amendment is made pursuant to Section 20 of the 1 July 2023 MARCUS Alert MOU among
the Parties, which requires that all amendments to the MOU be in writing and endorsed by the
Parties.
TO WIT, the MARCUS Alert MOU is modified as follows:
I. Amend Section 5 of the MOU by deleting Subsection 5.5.1 in its entirety and replacing
Subsection 5.5.1 with the following:
5.5.1. Among the Parties, only Roanoke County and the City of Roanoke shall be
required to dedicate staff specifically to the MARCUS Alert Program; however,
nothing herein shall prohibit the remaining Parties from dedicating staff
specifically to the MARCUS Alert Program.
II. Amend the MOU by adding a new Section 22 to follow Section 21 and to read and provide
as follows:
22. OTHER AGREEMENTS
The terms of this Agreement shall in no way nullify or otherwise affect the obligations of
the Parties with regard to other inter and intra-governmental agreements among the
Parties.

WHEREAS, effective 1 July 2023, the Town of Vinton, City of Salem, City of
Roanoke, Roanoke County, Craig County, Botetourt County, and the Sheriffs of Roanoke,
Craig, Botetourt Counties and the Sheriffs of City of Salem and City of Roanoke in the
Sheriffs’ respective official capacities, entered into a Memorandum of Understanding with
Blue Ridge Behavioral Healthcare and Frontier Health to outline the parties’
responsibilities with regard to the Marcus Alert statute codified in Title 9.1 of the Code of
Virginia, 1950, as amended; and
WHEREAS, the Marcus Alert system for these localities launched effective 1 July
2023, as required by the Code; and
WHEREAS, after the launch of the program, the parties recognized a need to
amend the staffing requirements as set forth in the original MOU to require only Roanoke
County and the City of Roanoke to dedicate staff specifically to carry out the duties set
forth in the Marcus Alert statute; and
WHEREAS, the amendment is memorialized in an Amended Memorandum of
Understanding signed by an authorized representative of all localities and agencies; and
WHEREAS, Section 15.2-1300 of the Code of Virginia, 1950, as amended,
requires that intergovernmental agreements involving joint exercise of powers, privileges
or authority be accomplished by ordinance; the first reading of this ordinance was held on
August 22, 2023, and the second reading was held on August 12, 2023.

NOW, THEREFORE, BE IT ORDAINED BY the Board of Supervisors of Roanoke
County, Virginia, that
1. The amendment to the Memorandum of Understanding among the Town of

the Sheriffs of City of Salem and City of Roanoke in the Sheriffs’ respective

2. That the County Administrator, Deputy County Administrator or an Assistant
County Administrator, is authorized to execute such documents and take such

ISSUE:
Acceptance of a donation of a flagpole and an American flag to the Department of
Development Services County to be erected at the Roanoke County Stormwater
Drainage Service Center at 1204 Kessler Mill Road, Salem, Virginia
BACKGROUND:
Roanoke County's stormwater drainage staff has been offered a donation of a flagpole
and an American flag from the Woodmen of the World to be placed at 1204 Kessler Mill
Rd. The value of this donation is estimated at $1,600. The Roanoke County
Department of Development Services intends to build a short retaining wall and erect
the flagpole adjacent to and in the front of the newly built Roanoke County Stormwater
Drainage Service Center.
A similar donation occurred on September 11, 2012. On that day, Roanoke Cou nty
hosted a ceremonial raising of the donated flag. The Woodmen of the World
organization anticipate a ceremonial raising of this donated flag similar to the event
which occurred in 2012.
DISCUSSION:
The Roanoke County Department of Development Services will invest in building a

stone retaining wall and utilize the skills of the Roanoke County drainage crew to erect
the flagpole.
FISCAL IMPACT:
The Department of Development Services will supply necessary materials, equipment
and labor necessary to have a successful project and successful ceremony. No
additional funding is requested.
STAFF RECOMMENDATION:
County staff recommends acceptance of this donation and scheduling a ceremony on
September 11, 2023, in honor and remembrance of the victims o f the September 11,
2001 terrorist attacks.

WHEREAS, County staff recommends approval of the resolution accepting this

2. This resolution shall take effect immediately upon its adoption.

ISSUE:
Roanoke County currently owns a small unimproved right -of-way located in a
southeasterly direction of the intersection of Britaney Road and Setter Road, and the
County has no plans to use such right-of-way in the future. Hollins Magisterial District
Supervisor North has requested that the right-of-way be vacated and disposed of by
law.
BACKGROUND:
Roanoke County owns a small piece of land (6,250 square feet) extending from
Britaney Road which is located just off of Challenger Avenue/Route 460 (the “County
Property”). The County Property was part of a piece of property that was subdivided in
1979 to create the Huntridge subdivision, and at the time of the subdivision, the small
6,250 square foot piece of land (the “Property”) was dedicated to the County to hold for
public use.
The County Property was never developed, and was never held out for the public as a
right-of-way. It is bordered by two residential properties; one is owned by Misty and
Lawrence Otey, and the other is owned by Yi-Jung Liu and Michael Wu. These
residential property owners were under the reasonable (but mistaken) impression that
the Property was conveyed to them in 1996, and have jointly maintained the Property
since that time. The Property is also bordered by a large undeveloped property owned

by Roanoke County Land Venture, Inc. The Roanoke County Land Venture Inc.
property is zoned for commercial use, with conditions.
This is not the first time the Board has considered a vacation of this p ublic right-of-way.
On March 22, 1996, Mr. Charles R. Simpson, President of Roanoke County Land
Venture, Inc. submitted a written request that Roanoke County vacate the same portion
of right-of-way which is the subject of this agenda item. In his letter requesting the
vacation in 1996, Mr. Simpson wrote as follows:
· "I have discussed this with the property owner of Lot 9 and the purchaser of Lot 1
and both approve this.”
· “Our request is that one-half of the property be added to each lot involved.”
Mrs. Otey was the property owner of Lot 9 referenced in Mr. Simpson’s 1996 letter. A
copy of the letter is attached to this Board Report and also as an exhibit to the proposed
ordinance.
As a result of the 1996 request from Roanoke County Land Venture, Inc . the Board
acted by ordinance in an attempt to vacate this portion of Britaney Road. County
records show that County staff received no objections to this previous vacation request.
On May 14, 1996, by Ordinance 052896 -19, the Board voted unanimously to ap prove
this vacation, but included the following requirement in the ordinance:
· The “unimproved section of right of way … referred to as Britany Road, being 50
feet in width and extending approximately 130 feet in length … be, and hereby
is, vacated … subject to the following conditions: … The vacated area of
land shall be added and combined, by deed or by plat, to the adjoining
properties as provided by law and petitioner shall comply with the Roanoke
County Subdivision Ordinance, the Roanoke County Zoning Ordinance, and
other applicable laws, regulations and requirements, including recordation of
the necessary documents, in connection with this vacation or subsequent
subdivision of the property.” (Emphasis added).
Roanoke County Land Venture Inc. never took the necessary steps to satisfy the
condition of Ordinance 052896-19 requiring Roanoke County Land Venture, Inc. to add
and combine the vacated area of land to the adjoining properties, and to record a deed
or plat amongst the Roanoke County Circuit Court land records as such. It is reasonable
to conclude, insofar as the vacation was requested by Roanoke County Land Venture,
Inc., that this failure to file the required deed or plat was an inadvertent oversight on
their part. It is also reasonable to co nclude that the neighboring property owners
reasonably relied upon the request by Roanoke County Land Venture, Inc. and the
1996 action by the Board in believing that they were the rightful owners of the subject
property that was to be vacated, and also leading them to believe they were rightfully

maintaining the subject property since that time.
Nonetheless, without the condition requiring Roanoke County Land Venture Inc.’s
recordation of the necessary documents to have the subject property combined with the
neighboring properties satisfied, Ordinance 052896-19 dated May 14, 1996 is null and
void. A copy of that previous ordinance is attached to this Board Report and also as an
exhibit to the proposed ordinance.
DISCUSSION:
Hollins Magisterial District Supervisor North has asked County staff to explore the
manner in which this Property could be vacated by the County, which would remove the
possibility that the Property would be developed as an extension of the public road in
the future. Adjacent landowner Mrs. Otey has reached out to Roanoke County and is in
support of this vacation. She is concerned with the prospect of a public road mere feet
from her kitchen window, and with the accompanying traffic, in the event the right -of-
way is ever developed. Adjacent landowner Roanoke County Land Venture, Inc.,
despite their prior 1996 request, is not in support of this vacation; they had apparently
forgotten of their prior request (and Board approval) that the County vacate this
property. Upon information and belief, they may wish to request that the County allow
this property to be used to access future development on their parcel.
Virginia law dictates that in cases where any lot has been sold (as is the present case),
part of a subdivision plat may be vaca ted by ordinance of the Board on motion of one of
its members (Virginia Code § 15.2-2272). The recordation of the ordinance shall
operate to destroy the force and effect of the recording of the part of the plat so vacated,
and to vest fee simple title to the centerline of any streets, alleys or easements for
public passage so vacated in the owners of abutting lots free and clear of any rights of
the public or other owners of lots shown on the plat, but subject to the rights of the
owners of any public utility installations which have been previously erected therein
(Virginia Code § 15.2-2274).
During the 1996 Board action, County records show that County staff received requests
from American Electric Power, Roanoke Gas Company, and the Roanoke County Utili ty
Department (which in 1996 was charged with providing water and sewer service to the
citizens of Roanoke County prior to the creation of the Western Virginia Water Authority)
to retain the right-of-way as a combined public utility easement and a water and sewer
easement.
The existing 50' unimproved public right-of-way contains a 2" water and gas line. This
requires that an easement be retained for future maintenance to include the right to cut,
trim, or otherwise control trees or other obstructions near utilities and the right to ingress
and egress for maintenance and new construction for any future upgrades. Therefore,

County staff recommends that a public utility easement for utilities be reserved. This can
be done by recordation of the attached proposed ordinance and the attached "Exhibit
A."
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
STAFF RECOMMENDATION:
Should the Board approve the first reading of this ordinance, County staff recommend it
be scheduled for a second reading and public hearing on September 12, 2023. Should
the Board approve the vacation after second reading and a public hearing, County staff
proposes that the ordinance provide that fee simple title to the said property vest "as
provided for by law."

WHEREAS, Roanoke County owns a small piece of land (6,250 square feet)

WHEREAS, the County Property was part of a piece of property that was
subdivided in 1979 to create the Huntridge subdivision, and at the time of the subdivision

the portion of the plat creating this right-of-way, but made the vacation subject to the
following condition: “[t]he vacated area of land shall be added and combined, by deed or

by plat, to the adjoining properties as provided by law and petitioner shall comply with the
Roanoke County Subdivision Ordinance, the Roanoke County Zoning Ordinance, and
other applicable laws, regulations and requirements, including recordation of the
necessary documents, in connection with this vacation or subsequent subdivision of the
property” (a copy of Ordinance 052896-19 is attached hereto as Exhibit C); and
WHEREAS, Roanoke County Land Venture Inc. never took the necessary steps
to satisfy the condition of Ordinance 052896-19 requiring Roanoke County Land Venture,
Inc. to add and combine the vacated area of land to the adjoining properties, and to record
a deed or plat amongst the Roanoke County Circuit Court land records as such; and
WHEREAS, it is reasonable to conclude, insofar as the vacation was requested by
Roanoke County Land Venture, Inc., that this failure to record the required deed or plat
was an inadvertent oversight on their part; and
WHEREAS, it is also reasonable to conclude that the neighboring property owners
reasonably relied upon the request by Roanoke County Land Venture, Inc. and the 1996
action by the Board in believing that they were the rightful owners of the subject property
that was to be vacated, and also leading them to believe they were rightfully maintaining
the subject property since that time; and
WHEREAS, without the condition requiring Roanoke County Land Venture Inc.’s
recordation of the necessary documents to have the subject property combined with the
neighboring properties satisfied, Ordinance 052896-19 dated May 14, 1996 is null and
void; and
WHEREAS, Hollins Magisterial District Supervisor Phil North has requested that
the Board dispose of the County Property and legally vacate and close the section of

unimproved right-of-way referred to as Britaney Road located southeasterly of the
intersection of Britaney Road (Route 1224) and Setter Road (Route 1221), measuring
fifty feet (50’) in width and approximately one hundred and thirty feet (130’) in length, lyin g
between Lot 1, Block 3, and Lot 9, Block 1, in Section No. 1, Huntridge; and
WHEREAS, the existing 50' unimproved, right-of-way contains a 2" water and gas
line, therefore retention of an easement is needed for future maintenance of these public
utilities and for any public utilities that may be needed in the future; and
WHEREAS, the County Property is bordered by three adjacent parcels, all of which
have access for ingress and egress from alternate and existing public rights-of-ways; and
WHEREAS, the County is not currently using the existing 50' excess public right -
of-way and has no plans to use such right -of-way in the future, the County’s continued
ownership of the County Property is not necessary or required for the best interests of the
County, and the County finds that no public inconvenience will result from vacating the
50’ excess public right-of-way; and
WHEREAS, Virginia Code § 15.2-2272 allows for this vacation to be accomplished
by the adoption of an ordinance by the governing body; and
WHEREAS, notice has been given as required by Virginia Code § 15.2-2204; and
WHEREAS, § 18.04 of the Roanoke County Charter directs that the acquisition
and disposition of real estate interests be accomplished by ordinance; the first reading of
this ordinance was held on August 22, 2023, and the secon d reading and public hearing
were held on September 12, 2023;
NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County
of Roanoke, Virginia as follows:

1. That pursuant to the provisions of Section 16.01 of the Roanoke County
Charter, an unimproved right-of-way referred to as Britaney Road located
southeasterly of the intersection of Britaney Road (Route 1224) and Setter
Road (Route 1221), measuring fifty feet (50’) in width and approximately
one hundred and thirty feet (130’) in length, lying between Lot 1, Block 3,
and Lot 9, Block 1, in Section No. 1, Huntridge , is hereby declared to be
surplus.
2. That the portion of the plat for Huntridge , Section 1, recorded in the land
records of the Roanoke County Circuit Court Clerk’s Office at Plat Book 9,
Page 200 setting forth an unimproved right-of-way referred to as Britaney
Road located southeasterly of the intersection of Britaney Road (Route
1224) and Setter Road (Route 1221), measuring fifty feet (50’) in width and
approximately one hundred and thirty feet (130’) in length, lying between
Lot 1, Block 3, and Lot 9, Block 1, in Section No. 1, Huntridge be, and hereby
is, vacated pursuant to Virginia Code § 15.2-2272 and as shown on the
attached plat labeled “Exhibit A” dated June 2, 2023. However, an
easement to locate, relocate, repair, replace, maintain, and perpetually
operate all public utilities currently located therein or needed by the County
of Roanoke in the future is hereby reserved unto the County of Roanoke
and the construction of a permanent structure over any utility line without
the prior written approval of the County of Roanoke is prohibited.
3. That the County of Roanoke relinquishes any interest it may have acquired
in the vacated right-of-way, other than the above-reserved utitlity easement,

for by law.
4. That the County Administrator, Deputy County Administrator, or Assistant
County Administrator, is hereby authorized to execute such documents and

5. That this ordinance shall be effective thirty days from its adoption, and a
certified copy of this ordinance shall be recorded in the Clerk’s Office of the
Circuit Court of Roanoke County, Virginia, in accordance with Virginia Code

ISSUE:
B2X has identified a method by which it can enhance the services to be offered to
Roanoke County citizens, therefore the 2022 Agreement needs to be amended to
reflect certain changes in the project.
BACKGROUND:
Virginia Telecommunications Initiative grant was awarded in the spring of 2022 to
provide high speed internet to citizens on Bent Mountain in the Windsor Hills District.
B2X is currently working to provide fiber broadband service to the Bent Mountain area.
DISCUSSION:
During this process, B2X has discovered a way to add redundancy and reliability to the
network they are installing on Bent and Poor Mountains. As part of the build process, a
few opportunities arose that gave B2X the ability to provide more coverage. This is d ue
to space becoming available on a site other than the two (2) sites that were originally
planned. After some engineering, B2X discovered they could create a redundant ring
that would not only increase the bandwidth but would also provide a fail -over system
which raises the level of the system performance for our citizens. This new site also has
the potential of adding 50 new homes to the overall project.

FISCAL IMPACT:
An additional $34,131 is needed to complete the work as outlined in the attached
amendment. These funds are available within the CommIT Admin/Operations Fund due
to personnel and operating savings.

ORDINANCE ADOPTING AN AMENDMENT TO THE CONTRACT WITH
ROANOKE COUNTY, ROANOKE COUNTY ECONOMIC
DEVELOPMENT AUTHORITY AND B2X ONLINE, LLC FOR
BROADBAND EXPANSION UNDER THE VIRGINIA
TELECOMMUNICATIONS INITIATIVE
Whereas, in September 2022, Roanoke County (“County”), the Roanoke County
Economic Development Authority (“EDA”) and B2X Online, LLC (“B2X”) entered into a
contract for purposes of administering funds for broadband expansion in the County
pursuant to the Virginia Telecommunications Initiative (“VATI”); and
Whereas, during the course of the B2X broadband expansion that is the subject of
the 2022 VATI award, B2X has identified an opportunity to provide service to an additional
fifty passings not originally identified in the 2021 VATI grant application and 2022 VATI
Award; and
Whereas, the County and the EDA recognize that broadband expansion to
underserved areas of the County is essential for economic growth in the County; and
Whereas, the changes in the location of equipment and the ability to se rve
additional customers has caused the overall price of the pending project to increase; and
Whereas, B2X has proposed sharing the excess cost of $56,131, with the County
to pay $34,131 of such total and B2X to bear the remaining cost of $22,000, and the
County and EDA have agreed to this cost-sharing and will execute a contract amendment
to reflect these terms; and
Whereas, sufficient funds have been appropriated for broadband expansion that
no additional funds will be appropriated under this Ordinance; and

Whereas, this Amendment shall not affect any other terms or conditions of the
September 22, 2022 VATI Agreement among the parties;
WHEREAS, Section 2.2-4309(A) of the Code of Virginia, 1950, as amended,
requires the approval of the governing body for this modification of the contract; the first
reading of this ordinance was held on August 22, 2023, and the second reading was held
on September 2023.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Amendment to the Agreement among the County, EDA, and B2X
with regard to broadband expansion under the 2022 VATI award , is hereby authorized
and approved.
2. That the County Administrator, Deputy County Administrator, or Assistant
County Administrator is authorized to execute the agreement and other related
documents on behalf of the County, and to take all such further action as any of them
may deem necessary or desirable in connection with this project. The form of the
agreement and any other such documents shall be approved as to form by the County
Attorney.
3. That this ordinance shall be effective from and after the date of its adoption.

AMENDMENT TO ECONOMIC DEVELOPMENT GRANT AGREEMENT
FIXED WIRELESS BROADBAND SERVICE – ROANOKE COUNTY / B2X
ONLINE, INC.
WHEREAS, ROANOKE COUNTY, VIRGINIA (the “County”), a political subdivision
of the Commonwealth of Virginia, the ECONOMIC DEVELOPMENT AUTHORITY OF
ROANOKE COUNTY, VIRGINIA (the “Authority”), a political subdivision of the
Commonwealth of Virginia, and B2X ONLINE, INC. (“B2X”), a Virginia stock corporation,
entered into an Agreement dated August 3, 2022, for the purpose of providing grant funding from
the Virginia Telecommunications Initiative (“VATI”) and the Virginia Department of
Housing and Community Development (“DHCD”) to B2X in an effort to expand and improve
broadband services to the citizens of Roanoke County, Virginia. Subsequent to that 2022
Agreement, B2X has identified a method by which it can enhance the services to be offered to
citizens, and the parties wish to amend the 2022 Agreement to reflect certain changes in the project.
Such changes are set forth below and shall memorialize the first Amendment to the August 3, 2022
VATI broadband expansion agreement among the parties; and
WHEREAS, during the course of the B2X broadband expansion that is the subject of the
2021 VATI application and subsequent 2022 VATI award, B2X has identified an opportunity to
provide service to an additional fifty (50) passings not originally identified. Such passings are in
the Bent Mountain area (Windsor Hills Magisterial District) and are not served by any other
internet service provider; and
WHEREAS, B2X identified different sites for location of towers and equipment than those
outlined in its original proposal, which is attached hereto as Exhibit 1; and
WHEREAS, the location of the equipment and additional passings is depicted on the
attached Exhibit 2, which shall be incorporated by reference herein; and

WHEREAS, the changes in the location of equipment and the ability to serve additional
customers has caused the overall price of the pending project to increase; and
WHEREAS, B2X has proposed sharing the excess cost of $56,131, with the County to pay
$34,131 of such total and B2X to bear the remaining cost of $22,000, and the County has agreed
to this cost-sharing; and
WHEREAS, Carl Caudill, Broadband Project Manager for DHCD, has reviewed the B2X
proposal to amend the August 3, 2022 Agreement and does not object to this Amendment.
This Amendment shall not affect any other terms or conditions of the August 3, 2022 VATI
Agreement among the parties.

WHEREAS, Ginger Wynn was employed by Roanoke County on February 2, 1998;
and
WHEREAS, Ms. Wynn retired effective August 1, 2023, after twenty-five (25 years
and six (6) months of devoted, faithful and expert service to Roanoke County; and
WHEREAS, Ms. Wynn served as Computer Operator, Technology Support
Technician, Technical Support Technician and Technical Analyst II during her employment
in the Communication and Information Technology Department; and
WHEREAS, Ms. Wynn, through her employment with Roanoke County, has been
instrumental in improving the quality of life and providing services to the citizens of
Roanoke County; and
WHEREAS, throughout Ms. Wynn’s tenure with Roanoke County, she has
performed crucial printing processes in the form of payrolls, Personal Property Tax and
Real Estate billings for the County, the Roanoke County Public Schools, the Town of
Vinton, and the Western Virginia Regional Jail. Ms. Wynn also managed the multi-million-
dollar County Computer Inventory program without any discrepancies. She was
instrumental in the development and refinement of the County Technical Contact program
that solicited departmental volunteers to assist with both minor computer issues and with
large program deployments. She was the department representative on the Employee
Advisory Council. Most notably; she assisted thousands of users and vendors with troubles

and access issues and has become known as “The Voice of the Information Technology
Department”.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County expresses its deepest appreciation and the appreciation of the citizens of Roanoke
County to GINGER WYNN for more than twenty-five (25) years of capable, loyal and
dedicated service to Roanoke County; and

BACKGROUND:
Mary Elizabeth Radford owns a 1.4 acre parcel located at 0 Garstview Circle in
Roanoke County. The property contains an existing asphalt path (Garst Mill Park
Greenway) and portions of Mud Lick Creek run through it. The County owns an existing
20’ sanitary sewer easement on the property. The County owns a Public Access Trail
and Greenway Easement, which includes a provision stating that the County “shall have
the right and duty to ensure maintenance of the greenway easement.” The greenway
easement encompasses the sanitary sewer easement.
DISCUSSION:
Mrs. Radford wishes to donate the property to the Board of Supervisors of Roanoke
County, Virginia for public use. Roanoke County staff engaged with ECS Mid -Atlantic,
LLC who conducted an environmental site assessment on the property. The
environmental site assessment revealed no evidence of recognized environmental
conditions, controlled recognized environmental conditions, or significant data gaps in

FISCAL IMPACT:
There is no funding necessary to accept this donation of real property.

REZONING REQUEST NARRATIVE:
Introduction:
The purpose of this request is to rezone land and to repeal proffered conditions to allow
the Roanoke County School Board to construct a new Career and Technical Education
(CTE) facility on the subject property. The overall project consists of five (5) tax parcels
along Peters Creek Road and has been previously identified by the School Board as the
preferred site for the new CTE facility. The property was purchased by the School Board
earlier this year and this project has been identified as one of the top priority projects for
Roanoke County.
As outlined on “EX-A, Rezoning Plan,” dated July 14, 2023, the property consists of Tax
Parcels 027.13-05-03.00 (4.053 ac.), 027.13-05-04.00 (7.000 ac.), 027.13-05-05.00
(5.000 ac.), 027.13-05-06.00 (6.691 ac.), and 027.13-05-37.00 (5.322 ac.). Tax Parcels
027.13-05-03.00 and 027.13-05-04.00 are zoned C-1, which allows for the proposed
Educational Facility. Tax Parcel 027.13-05-05.00 is zoned C-1 and has a proffered
condition that is proposed to be repealed as part of this request. Tax Parcels 027.13-05-
06.00 and 027.13-05-37.00 are currently zoned Medium Density Multi-Family
Residential District (R-3) and are proposed to be rezoned to Low Intensity Commercial
District (C-1) to allow for the proposed Educational Facility use and to match the zoning
of the rest of the property. It is anticipated that these five parcels will be combined into
one larger parcel as part of the development/site plan process.
Background:
The proposed facility will replace the existing Burton Center for Arts and Technology
(BCAT) that is located along Roanoke Boulevard in the City of Salem. BCAT has been
located at this site since it was initially started in 1962. The school has expanded over the
years and current course offerings include Auto Service Technology, Building Trades,
Computer Information Technology, Cosmetology, Criminal Justice, Culinary Arts,
Cybersecurity, Early Childhood Education, EMT, Game Design, Masonry, Mechatronics,
Motorsports, Nursing, and Welding.
Students from all of the County high schools have the opportunity to attend classes at
BCAT for targeted, hands-on technical and vocational training in the subjects listed
above. The location of the new site along the Peters Creek Road corridor will allow for
convenient and efficient access to the site for students, parents, and educators, and will
move this important facility into Roanoke County.
Design:
A concept plan showing how the site could be developed is included with this
application, titled “EX-B, Conceptual Masterplan” and dated July 14, 2023. The
proposed building and site improvements are concentrated on the western side of the
property in order to take advantage of the Peters Creek Road access across from Alpine

Road and to preserve the existing jurisdictional watercourse and appropriate buffers on
the eastern side of the site. It should be noted that the majority of the site improvements
are shown on property that is already zoned C-1.
Primary access for the site will be from the main entry point on Peters Creek Road. A
new traffic signal is anticipated at this intersection, subject to VDOT approval. A
secondary, emergency-only access point at the end of Burlington Road is shown on the
Concept Plan as well. The expectation is that this entrance will be gated.
The Concept Plan indicates many things that have been done to help mitigate impacts to
adjacent residential properties. There is significant horizontal separation provided
between the proposed building and any residential properties. In addition, landscape
buffers will be provided along these property boundaries in accordance with the Roanoke
County zoning ordinance. These buffers are anticipated to be achieved either by
preserving existing vegetation or through planting new Type ‘B’ landscape buffers as
required by the Ordinance.
The existing high point of the site will be cut down significantly to create the pad for the
development of the site, which will also help to reduce the scale of the building in
relation to the surrounding properties. The building will still be significantly elevated
above Peters Creek Road, creating great visibility for this one-of-a-kind County facility.
A new traffic signal is proposed at the intersection of Peters Creek Road, Alpine Road,
and the new Site Entrance, subject to VDOT approval. The proposed signal phasing
would provide controlled turning movements to and from Peters Creek Road, which will
increase safety at this access point while also preserving a high level of functionality for
the Peters Creek Road corridor. It should be noted that new traffic impacts from this
development will be much less than with a typical commercial development that could
otherwise be developed on this site. A traffic impact study has been submitted and is
currently under review by VDOT. A copy of this study is included with this request. As
shown in the study, the surrounding road network can support the proposed development
and the impact to traffic from the proposed development is insignificant.
The improvements shown on the Conceptual Masterplan are intentionally designed to
accommodate the constraints of the site while balancing the desired aesthetic appearance.
There are functional considerations that are necessary to the operation of this type of
facility, but they have been designed to be discreet in their location and screened from
view for privacy. The project will meet all zoning ordinance requirements including on-
site landscaping and dimensional standards.
Compatibility with Comprehensive Plan:
The four western parcels associated with this project are shown on the Future Land Use
Map as Transition and the easternmost parcel (T.M. #027.13-05-37.00) is shown as
Development.

The proposed use is compatible with the Roanoke County Comprehensive Plan and the
surrounding zoning districts and uses. The Comprehensive Plan defines Transition as “a
future land use area that encourages orderly development of highway frontage parcels.
Transition areas generally serve as developed buffers between highways and nearby or
adjacent lower intensity development. Intense retail and highway oriented commercial
uses are discouraged in transition areas, which are more suitable for office, institutional
and small-scale, coordinated retail uses.” Development is defined as “a future land use
area where most new neighborhood development will occur, including large-scale
planned developments which mix residential with retail and office uses. Innovation in
housing design and environmental sensitivity in site development is a key objective.
Clustered developments are encouraged as is the use of greenways and bike and
pedestrian trails.”
The proposed educational facility is located completely within the Transition area and
will provide a natural transition between the commercial corridor of Peters Creek Road
and the existing residential uses to the south, east, and west. The institutional use is
consistent with the objectives of a Transition property. There are also many C-2 zoned
properties located to the east of the property along Peters Creek Road and on the opposite
side of South Drive. The proposed rezoning to C-1 will provide a transition from these
properties to the more residential areas located to the south of the property.
This area has also been identified by Planning staff for multi-modal improvements. A
proposed sidewalk is shown on the Conceptual Masterplan along the frontage of Peters
Creek Road. This project will further this initiative by installing sidewalk in an area
where pedestrian improvements do not currently exist.
As indicated above, this project is consistent with the guiding themes outlined in
Roanoke County’s Comprehensive Plan and it will also relocate an existing County
facility that is currently located in the City of Salem. This project will be developed in
accordance with applicable regulations including the Roanoke County Zoning Ordinance.
This essential community facility will serve the County and its residents for years to
come. On behalf of the Roanoke County School Board, we request approval of this
rezoning application.
PROFFERED CONDITION TO BE REPEALED
This proffered condition currently affects Tax Parcel 027.13-05-05.00-0000:
1. If Burlington Road is used for access to the subject property, then Burlington Road shall be
improved to standards as specified by the Virginia Department of Transportation (VDOT) and the
Roanoke County Department of Engineering. All improvements shall be completed prior to the
issuance of a Certificate of Occupancy for the first phase of any development on the site.

1. Introduction
Roanoke County is proposing to develop approximately 28 acres of land located at 6305
Peters Creek Road in Roanoke County (see Appendix A for vicinity map). The proposed
development consists of a new Career and Technical Education (CTE) Facility.
The site is located along the south side of Peters Creek Road. The property is described as
Roanoke County Tax Parcels #027.13-05-03.00-0000, #027.13-05-04.00-0000, #027.13-05-
05.00-0000, #027.13-05-06.00-0000, and #027.13-05-37.00-0000. These tax parcels are
currently zoned C1, Low Intensity Commercial District, and R3, Medium Density Multi-Family
Residential District. The proposed rezoning would revise the entire property to the C1 zoning
district to allow for the proposed use.
There is currently an existing residence with a driveway and accessory structures located on
the property. The remainder of the site is undeveloped. The driveway is a right-in, right-out
access onto Peters Creek Road, which will be removed with the proposed development. A new
entrance is proposed on Peters Creek Road at the existing median cut at Alpine Drive. This new
intersection is proposed as a thru-cut design, which will prohibit through movements from the
site entrance and Alpine Road to reduce the number of phases for the intersection and
maximize green time for Peters Creek Road traffic.
As discussed with VDOT at the pre-scoping meeting, the following intersections will be
analyzed to determine how levels of service and queue lengths are impacted by this
development:
• Peters Creek Road and Airport Road and Archcrest Drive (Signalized)
• Peters Creek Road and Alpine Drive and Site Entrance (Proposed Signal)
• Peters Creek Road and Barrens Road and South Barrens Road (Signalized)
Peters Creek Road, Route 117, is a four-lane, divided roadway that provides access
between Brandon Avenue and Williamson Road in Roanoke City and Roanoke County. This
road is classified as a minor arterial and the posted speed is 45 mph in front of the site.
Three scenarios will be considered: Existing Condition, Background Condition, and Buildout
Condition to determine the effects of the proposed development on the levels of service at the
study intersections. The proposed development is anticipated to be constructed by the year
2026, which will be the Background and Buildout year for this study.

Level of service (LOS) for signalized intersections is evaluated based on control delay per
vehicle and the driver’s perception of those conditions. Control delay is the portion of the total
delay attributed to the control at the intersection. Table 1 depicts the LOS scale with
corresponding control delay per vehicle, with LOS “A” representing the best operating conditions
and LOS “F” representing the worst.

The Synchro 11 and SimTraffic 11 software was used for all modeling and analysis. This
study was undertaken by Balzer and Associates, Inc. to:
• determine the total number of vehicle trips generated by the potential
development to be added to the adjacent street network;
• determine the impacts to level of service and queue lengths at the existing
intersections as a result of the proposed development;
• and to determine what roadway and intersection improvements are warranted as
a result of the proposed development;

2. 2023 Existing Conditions
The site currently consists of a vacant residence and other various improvements, and the
site does not currently generate any traffic. The existing improvements will be removed as part
of the proposed development. The existing driveway access to Peters Creek Road opposite
Alpine Road will be removed as part of the site development. Available VDOT traffic count data
is summarized below.

In addition to the VDOT published traffic count data, manual traffic counts were performed at
the study intersections. The counts were performed on Thursday, April 13, 2023 from 7:00 AM –
7:00 PM. Based on this information, the AM peak hour for the corridor was determined to be
7:30 – 8:30 AM and the PM peak hour was determined to be 5:00 – 6:00 PM. It should be noted
that the PM peak hour for the intersection of Peters Creek Road and Barrens Road was 4:45 –
5:45 PM based on the counts and these volumes were utilized for the study to fully model the
busiest time of day for this intersection. This makes the analysis more conservative than utilizing
the 5:00 – 6:00 PM volumes for this particular intersection.

Based on the data obtained, and in cooperation with VDOT, it was determined that it would
not be necessary to define and analyze a mid-day peak hour. All turning and through
movements were counted to facilitate analysis of the intersections. The manual traffic count
data is provided in Appendix B. Figure 1 graphically depicts the existing peak hour traffic
volumes and Figure 2 shows the heavy vehicle percentages obtained from the counts.
Existing signal phasing and timing information was provided by VDOT for the existing traffic
signals on Peters Creek Road. All existing information was used to create a model of the study
intersections in the Synchro 11 and SimTraffic 11 software to analyze the network.
The Synchro 11 and SimTraffic 11 software was used to analyze delays, level of service,
and queue lengths for existing weekday AM and PM peak hours. The existing conditions levels
of service, delays, and queue lengths are shown in Table 3. The Synchro 11 and SimTraffic 11
results are included in Appendix F.

3. 2026 Future Conditions Without Development
It is anticipated that the proposed development will be constructed and in use by 2026,
which will be utilized as the analysis year for the Background and Buildout conditions. To
analyze the future conditions and obtain the projected background traffic volumes, an annual
growth factor was applied to the existing traffic volumes. Based on historical VDOT traffic data,
this section of Peters Creek Road has not shown any measurable growth in the last several
years and has shown a decrease from 2010 traffic data. However, in order to provide a
conservative analysis, a 1% growth factor was applied to the existing traffic counts to project
traffic from the current year 2023 to the analysis year 2026. Figure 3 graphically depicts the
projected background traffic in the year 2026 with the growth rate applied.
Peak hour factors were revised to 0.92 where appropriate, in accordance with the
procedures outlined in the TOSAM. The Synchro 11 and SimTraffic 11 software was used to
analyze delays, level of service, and queue lengths for Background weekday AM and PM peak
hours. The Background condition levels of service, delays, and queue lengths are shown in the
LOS and queuing summary tables. The Synchro 11 and SimTraffic 11 results are included in
Appendix F.

4. Trip Generation
Trip generation for new sites is generally completed utilizing the policies and procedures
found in the Institute of Transportation Engineers (ITE) Trip Generation Manual. However, the
proposed Career and Technical Education facility is not accurately represented by any of the
uses in the ITE Manual. It functions differently from a typical school with students coming and
going throughout the day. This facility is being built as a replacement to the existing Burton
Center for Arts and Technology. Therefore, 12-hour counts were performed at the existing
facility on Thursday, April 13, 2023 to determine typical daily traffic flow in and out of this facility.
This information is included in Appendix C. It should be noted that traffic counts were performed
on a ‘B-day’ which represents a higher volume of students at the school than on ‘A-days’. There
is a morning block of classes from 7:30 – 10:50 AM and an afternoon block of classes from
12:25 – 2:55 PM and this is consistent with the information obtained in the traffic counts.
The data that was gathered was analyzed and discussed with Roanoke County Schools
personnel to determine whether any adjustments are warranted to project traffic for the new
facility. It is anticipated that the new facility could see approximately a 10% increase in students
over the current enrollment at the existing Burton facility. There are no changes anticipated to
the daily schedule in the foreseeable future. Therefore, the volumes that were generated during
the counts were increased by 10% and utilized as the anticipated traffic volumes to be
generated by the site. The existing traffic count information is summarized and adjusted site-
generated traffic calculations are included in Appendix D.
The peak hours along Peters Creek Road were determined to be 7:30 – 8:30 AM and 5:00 –
6:00 PM. Based on the current schedule, it is anticipated that the peak hours for the CTE facility
will not overlap with the peak hours for the adjacent street network. However, there were
observed some peak times for the school that are relatively close to the peak hours on Peters
Creek Road. The peak hours for the school that most closely correlate with the peak hours on
the street network are 7:00 – 8:00 AM and 5:30 – 6:30 PM. Due to the possibility of the school
schedule being modified in the future and to provide a conservative analysis, these times were
utilized as the peak hour traffic for the development. The anticipated peak hour and weekday
site-generated traffic is summarized in Table 3 below.

movements at the proposed entrance. Projected traffic volumes were then distributed
throughout the study network for further analysis as described in the next section.

5. Site Traffic Distribution and Assignment
The distribution of potential site-generated traffic was completed by observing the directional
splits from the traffic data and by applying engineering judgement based on knowledge of the
proposed use, as well as the surrounding area and traffic patterns. The directional percentages
were then applied to the site-generated traffic to determine the projected turning movements at
each intersection.
All site-generated traffic is anticipated to utilize the proposed entrance at the intersection of
Peters Creek Road and Alpine Road. This intersection is proposed as a ‘thru-cut’ design. This
design limits signal phases by restricting through movements on the minor street approaches,
therefore allowing more green time to be allocated to Peters Creek Road and enhancing traffic
flow along this major movement. This design is consistent with current VDOT practices along
major corridors. The connection to Burlington Road is anticipated to be gated and utilized only
for emergency access. Therefore, this entrance was disregarded when applying site-generated
traffic to the surrounding road network.
For the purposes of this analysis, it was assumed that 65% of vehicles will access the site
from the west, making a right turn into the site and a left turn out of the site. The other 35% of
vehicles will access the site from the east, making a left turn into the site and a right turn out of
the site. These trips were then allocated to the nearby intersections utilizing engineering
judgement.
Projected vehicle trips were distributed at each intersection based on existing traffic patterns
and engineering judgement. Traffic assignment for the site-generated traffic is shown
graphically in Figure 4.

6. Analysis of Future Conditions With Development
The buildout traffic was calculated by adding the 2026 Background traffic (Figure 3) to the
site-generated traffic (Figure 4). The buildout traffic for each of the study intersections is shown
in Figure 5. The intersections were then modeled and evaluated using the Synchro 11 and
SimTraffic 11 software. Peak hour factors were revised to 0.92 where appropriate, in
accordance with the procedures outlined in the TOSAM.
The proposed thru-cut signalized intersection at the site entrance was included in this
analysis as a fully-actuated signal. Full right and left turn lanes are proposed at this intersection
and were included in the model. Protected-permissive left turn movements were utilized for the
Peters Creek Road approaches. Signal cycle length and The Synchro 11 and SimTraffic 11
output is included in Appendix F.

8. Conclusions
Based on the data collected, the assumptions made, and the potential site generated traffic,
the recommendations for the roadway network are summarized below:
• It is recommended that the new four-leg intersection created by the entrance across
from Alpine Drive be signalized to improve safety in this location and to help with peak
volumes in and out of the proposed school. The proposed signal is desired by Roanoke
County to increase safety at this school entrance location and will also enhance traffic
flow into and out of the site. This signal is recommended to be a reduced phase, thru-cut
design to allow for left and right turning movements to and from the site and Alpine
Road, while maximizing the efficiency of the corridor and minimizing delay for traffic on
Peters Creek Road.
• The proposed signalized intersection results in minimal delay for the Peters Creek Road
corridor.
• New full-length right and left turn lanes should be installed along Peters Creek Road to
facilitate movements into and out of the site. These turn lanes should be 200’ long with
200’ tapers due to the 45 mph speed limit along Peters Creek Road.

ISSUE:
The current 1998 Memorandum of Agreement (MOA) that is set to expire on March 31,
2024 will be extended from April 1, 2024 through June 2024 to be in line with each
locality fiscal year.
BACKGROUND:
In 1998, Roanoke County, the City of Roanoke, the Town of Vinton, and the City of
Salem entered into an MOA that set forth the rights and responsibilities of the parties
with regard to the construction and maintenance of the Roanoke Valley Regional Fire -
EMS Training Center. The Agreement was set to expire on March 31, 2024. In fiscal
year 2020, Roanoke County assumed direction and control of fire -EMS services for the
Town of Vinton.
DISCUSSION:
The three (3) localities from the original MOA anticipate making other sub stantive
changes to the MOA for the renewal term. In the meantime, the three (3) localities
desire to extend the term of the MOA through June 30, 2024 so that the agreement,
which has fiscal impacts on each locality, will match each locality's fiscal year and,
further, so that the parties have sufficient time to negotiate and update the terms of the
MOA to ensure the most efficient and safe provision of public safety services. With the

approval of this extension, all other terms and conditions of the MOA ar e incorporated
by reference herein and shall remain in full force and effect through June 30, 2024.
There have been no changes since the first reading of this ordinance on July 25, 2023.
FISCAL IMPACT:
There will be no fiscal impact in extending the current MOA through June 30, 2024.

WHEREAS, in 1988, Roanoke County, City of Roanoke and City of Salem entered
into a Memorandum of Agreement for construction, maintenance and operation of the
Roanoke Valley Regional Fire-EMS Training Center; and
WHEREAS, the Agreement will expire on 31 March 2024; and
WHEREAS, in 2019, Roanoke County assumed all Fire-EMS responsibilities for
the Town of Vinton; and
WHEREAS, the agencies anticipate making significant changes to the terms and
conditions of the 1988 Agreement; and
WHEREAS, an extension of the Agreement in effect from 1 April 2024 through 30
June 2024 will allow the parties additional time to negotiate the terms of a new Agreement
and further, will cause the new Agreement to align with the localities’ fiscal year; and
WHEREAS, Section 15.2-1300 of the Code of Virginia, 1950, as amended,
requires that inter-governmental agreements involving joint exercise of powers, privileges
or authority be accomplished by ordinance; the first reading of this ordinance was held on
July 25, 2023, and the second reading was held on August 22, 2023.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

Roanoke, and the City of Salem with regard to the Regional Fire Training Center, is
hereby authorized and approved.

may deem necessary or desirable in connection with this project. The form of the
agreement and any other such documents shall be approved as to form by the County
Attorney.

AMENDMENT TO 1998 MEMORANDUM OF AGREEMENT AMONG
ROANOKE COUNTY, THE CITY OF ROANOKE, and THE CITY OF SALEM
This day came ROANOKE COUNTY, a political subdivision of the Commonwealth of Virginia,
THE CITY OF ROANOKE a municipal corporation of the Commonwealth of Virginia, and THE
CITY OF SALEM, a municipal corporation of the Commonwealth of Virginia (collectively, “the
parties”), by counsel, to memorialize an agreed-upon amendment to the 1998 Memorandum of
Agreement (“MOA”) that set forth the rights and responsibilities of the parties with regard to the
construction and maintenance of the Regional Fire Training Center. This Amendment is executed
in accord with the provisions of Section 15.2-1301 of the Code of Virginia.
WHEREAS, the parties entered into a MOA on 31 March 1999 to set forth the terms and
conditions and shared obligations of the parties with respect to construction and maintenance of a
Regional Fire Training Center, located on a six-acre site at 1220 Kessler Mill Road, Salem, 24153;
and
WHEREAS, the MOA will expire on 31 March 2024; and
WHEREAS the parties anticipate making other substantive changes to this MOA for the
renewal term; and
WHEREAS, subsequent to the inception of the 1999 MOA, Roanoke County has assumed
direction and control of Fire-EMS services for the Town of Vinton; and
WHEREAS, the parties desire to extend the term of the MOA through 30 June 2024 so that
the agreement, which has fiscal impacts on each locality, will match each locality’s fiscal year and,
further, so that the parties have sufficient time to negotiate and update the terms of the MOA to
ensure the most efficient and safe provision of public safety services; and
WHEREAS, the provisions of Section 15.2-1300 of the Code of Virginia authorize the
parties to enter into this MOA and this Amendment.
NOW, THEREFORE, in consideration of the mutual covenants and agreements made
herein, the parties agree as follows:
1. The Term of this MOA shall be extended from 1 April 2024 through 30 June 2024.
2. All other terms and conditions of the MOA are incorporated by reference herein,
and shall remain in full force and effect through 30 June 2024.

Roanoke River Greenway. The proposed greenway will be approximately 1.5 mile long,
ten (10)-feet wide, paved and ADA accessible. The route will parallel the Roanoke River
through Explore Park from Rutrough Point to connect to the greenway segment nearing
construction across the Roanoke Valley Resource Authority Rutrough Road (closed)
landfill.
The Roanoke Valley Transportation Planning Organization (RVTPO) designated
$3,020,308 in Regional Surface Transportation Program (now Surface Transportation
Block Grant) funding for this project in March 2018.
Project milestones include:
· Project design has reached the 95% stage;
· Virginia Recreational Facilities Authority has granted easements for the
greenway; and

· Environmental permits and approvals have been obtained, and stream mitigation
credits are in the process of being purchased.
Construction advertisement is anticipated in Fall 2023 with construction anticipated to
begin in early 2024.
DISCUSSION:
Additional Surface Transportation Block Grant (STBG) funding in the amount of
$1,275,000 was requested in November 2022 due to supply chain issues, inflation and
labor shortages which have increased the project cost since the original 2017 estimate.
While the Roanoke Valley Transportation Planning Organization (RVTPO) approved the
additional STBG funding in March 2023, at that same meeting, RVTPO staff announced
the availability of new Carbon Reduction Program (CRP) funding. It was determined
that the additional funding requested for this project fit the requirements for CRP funding
well. At the April 27, 2023, RVTPO meeting, CRP funding was awarded to this project
and the same amount of STBG funding was removed.
There have been no changes since the first reading held on July 25, 2023.
FISCAL IMPACT:
The $1,275,000 in CRP funding is one hundred percent (100%) Federal and State with
no local match required. This project is locally administered, necessitating acceptance
and appropriation of this funding to the Grant Fund to facilitate project reimbursement
requests.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors approve the attached ordinance.

RESOLUTION
Approval of Available and Preliminary Allocations to the Carbon Reduction Program
WHEREAS, the Federal Carbon Reduction Program (CRP) was incorporated into federal law
through the 2021 Infrastructure Investment and Jobs Act; and
WHEREAS, the RVTPO Policy Board has the opportunity and responsibility to prioritize CRP funds
for essential transportation improvements within the Roanoke Valley TPO Study Area Boundary; and
WHEREAS, the Regional Commission staff coordinated with VDOT staff regarding the usage of
CRP funding for Fiscal Years 2022, 2023, 2024 to allocate current projects in need of immediate funding
and the following three projects fit the requirements for the funding program:
•Town of Vinton – Walnut Avenue Bicycle and Pedestrian Accommodations (5th St. to City/Town
Limit, $200,000;
•Roanoke County – Roanoke River Greenway through Explore Park, $1,275,000;
•Town of Vinton – Walnut Avenue Bicycle and Pedestrian Accommodations (W. Lee St. to 1st
St.), $200,000; and
WHEREAS, these three Surface Transportation Block Grant projects and the ~$1.6M will result in
an increase of available funds for that financial plan; and
WHEREAS, the RVTPO Policy Board approved the FY24-29 STBG Financial Plan on March 23,
2023; and, the additional costs that were approved to the three subject projects:
WHEREAS, the RVTPO Transportation Technical Committee has recommended the three projects
to be funded with the CRP for FY2022-2024 available funds.
NOW THEREFORE BE IT RESOLVED, that the Policy Board of the Roanoke Valley
Transportation Planning Organization does hereby approve the FY 2022-2024 Carbon Reduction
Program Financial Plan (shown in the attached table) and forwards this supporting resolution or
endorsement to the Virginia Commonwealth Transportation Board.

(RSTP) grant funds, now named the Surface Transportation Block Grant (STBG), in the
amount of $3,020,308 in 2018 for design and construction of the Roanoke River
Greenway through Explore Park; and
WHEREAS, the County was awarded Carbon Reduction Program (CRP) funding
in the amount of $1,275,000 in April 2023 to satisfy a project deficit; and
WHEREAS, the project is locally administered, and certain agreements between
the County of Roanoke and the Virginia Department of Transportation (VDOT) must be
executed for this cooperative work to be accomplished ; and
WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be
appropriated by ordinance; and
WHEREAS, the first reading of this ordinance wa s held on July 25, 2023, and the
second reading was held on August 22, 2023.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia as

BACKGROUND:
The Roanoke River Greenway is a proposed 30-mile regional bicycle and pedestrian
trail developing through the Roanoke Valley, linking the Cities of Roanoke and Salem,
the Town of Vinton, and Roanoke County. The 2018 Roanoke Valley Greenway Plan
identifies the Roanoke River Greenway as its number one priority in the region, as
shown on the attached map. The greenway will serve as the primary non-motorized
transportation facility providing a critical link between the urbanized areas in Virginia’s
Blue Ridge, the Blue Ridge Parkway, and Explore Park. The 2007 Roanoke County

Comprehensive Master Plan f or Parks and Facilities identified the development of
greenways and trails as a high priority desired by citizens in Roanoke County.
Extension of the Roanoke River Greenway is supported in the Explore Park Adventure
Plan and the Roanoke County Community Strategic Plan, adopted in 2016 by the
Roanoke County Board of Supervisors.
DISCUSSION:
Roanoke County is overseeing the design, right-of-way acquisition, and construction of
the East Roanoke River Greenway proposed through Explore Park in the Vinton
Magisterial District, identified as VDOT UPC No. 113567. This approximately 1.4 -mile
section of the greenway will be an 8-10 foot-wide, paved, shared use path proposed
south of the Roanoke River. The project is funded with $3,020,308 in Surface
Transportation Block Grant (STBG)/Regional Surface Transportation Program (RSTP)
funding and $1,275,000 in Carbon Reduction Program (CRP) funding. The greenway
project is a Locally Administered Project with oversight from the Virginia Department of
Transportation (VDOT). For federal-aid projects, VDOT is required by the U.S.
Department of Transportation - Federal Highway Administration (FHWA) to certify local
government compliance with the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 (Uniform Act), as amended, found in Title 42 Chapter
61 of the United States Code and the implementing regulations found in 49 CFR Part
24.
The greenway project has been designed by AECOM. Temporary construction and
permanent easements are needed for the greenway proposed across the properties
owned by the Virginia Recreational Facilities Authority. This ordinance authorizes the
acquisition of permanent and temporary easements at Explore Park on properties
owned by the Virginia Recreational Facilities Autho rity (Tax Map Numbers 080.00-05-
24.00-0000,080.00-05-26.00-0000,080.00-05-27.00-0000,080.00-05-29.00-
0000,080.00-05-30.00-0000, 080.00-05-31.00-0000, 080.00-05-32.00-0000) for
development of the Roanoke River Greenway in the Vinton Magisterial District.
On June 29, 2023, representatives from the Roanoke County Department of Parks,
Recreation and Tourism presented a request to the Virginia Recreational Facilities
Authority Board of Directors for donation of the permanent and temporary easements
needed for the greenway. The Board of Directors agreed unanimously to the donation
and conveyance of temporary construction easements in the amount of 4.590 acres
(199,950 square feet), a permanent greenway easement in the amount of 4.957 acres
(215,944 square feet), and a permanent drainage easement in the amount of 0.927
acres (40,363 square feet), as shown on a sealed plat prepared by H & B Surveying
and Mapping, LLC dated May 31, 2023.

are attached to the board report.

PERMANENT DRAINAGE EASEMENTS & A PERMANENT GREENWAY
EASEMENT ON THE PROPERTIES OF VIRGINIA RECREATIONAL
FACILITIES AUTHORITY COUNTY OF ROANOKE, VIRGINIA” prepared by
H & B Surveying and Mapping, LLC and dated May 31, 2023, which is attached
hereto as “Exhibit A” and recorded in the Roanoke County Circuit Court Clerk’s
Office along with this Deed of Easement.
Together with a TEMPORARY CONSTRUCTION EASEMENT containing 4.590
acres (199,950 square feet) collectively, more or less, upon, over, and across the
parcels of land belonging to the Grantor designated as Roanoke County Tax Map
Numbers 080.00-05-24.00-0000, 080.00-05-26.00-0000, 080.00-05-27.00-0000,
080.00-05-29.00-0000, 080.00-05-30.00-0000, 080.00-05-31.00-0000, 080.00-05-
32.00-0000. The location of the said temporary construction easement shall be
within those areas shown upon the plat titled “PLAT SHOWING TEMPORARY
CONSTRUCTION EASEMENTS, PERMANENT DRAINAGE EASEMENTS &
A PERMANENT GREENWAY EASEMENT ON THE PROPERTIES OF
VIRGINIA RECREATIONAL FACILITIES AUTHORITY COUNTY OF
ROANOKE, VIRGINIA” prepared by H & B Surveying and Mapping, LLC and
dated May 31, 2023, which is attached hereto as “Exhibit A” and recorded in the
Roanoke County Circuit Court Clerk’s Office along with this Deed of Easement.
The Temporary Construction Easement shall automatically expire upon completion
of construction or substantial completion of construction of the public access trail
on Grantor’s property referred to herein. The Grantor agrees that the Grantee will
not be expected to restore the property to the identical original condition, but rather
as near as is practicable to its condition at the time the easement was granted and
that the Grantor will cooperate with the Grantee in effectuating such restoration.
The said PERMANENT GREENWAY EASEMENT shall be subject to the terms and
conditions stated below:

1. The Grantor hereby grants to the Grantee and the general public free access to and
use of the public access trail within the Greenway Easement, subject to the laws
and ordinances of Roanoke County for the purposes including but not limited to:
walking, jogging, hiking, bicycle riding, horseback riding, and nature study. The
general public shall have no right to construct or improve any p ortion of the
Greenway Easement or public access trail.
2. Public access with any type of motor vehicle, including but not limited to
motorcycles, four-wheel drives, motor bikes, mopeds, ATVs, and snowmobiles,
shall be prohibited except for construction, inspection, responding to emergency
calls, maintenance, or reconstruction of the public access trail within the Greenway
Easement area by the Grantee or to the extent such vehicles are necessary for
accessibility under the Americans with Disabilities Act.
3. The Grantor shall be considered the owner of the Greenway Easement for purposes
of determining development density standards under applicable zoning and land
use regulations.
4. The Grantor shall retain the right to use the land subject to the Greenway Easement
acquired herein in any manner which shall not interfere with the use and enjoyment
of said rights for recreational access to the public access trail.
5. The Grantor shall not erect any building, fence, sign, guardrail, or other structure
over the easement so as to render the Greenway Easement inaccessible, except that
fences and gates may be erected and/or maintained with the mutual consent of the
Grantor and Grantee. In the event that this covenant is violated, the Grantee shall

not be obligated to repair, replace, or otherwise be responsible for such
improvements if damaged or removed.
6. There shall be no dumping of ashes, garbage, waste, brush or other unsightly,
offensive, or hazardous material on the Greenway Easement or public access trail
by the Grantor or Grantee, nor their agents, invitees, or licensees, unless necessary
for the active construction of the public access trail.
7. Any construction by the Grantor of roads or driveways within the Greenway
Easement or crossing the public access trail must be approved by the Grantee and
designed in coordination with the Grantee to facilitate a safe and convenient
crossing of the road by public access trail users.
8. The Grantee may erect within the Greenway Easement markers, kiosks, litter
receptacles, vehicle control barriers, benches, bridges, signage, fences, and gates
(“Trail-related Improvements”) as deemed necessary for preservation of the
Greenway Easement, use of the public access trail, and safety of the public access
trail users. No other building or above grade structure shall be constructed by the
Grantee or Grantor without written permission of the Grantor.
9. There shall be no removal, destruction, or cutting of trees within the Greenway
Easement, except as may be performed by the Grantee or its agents for construction
or maintenance of the public access trail, reduction of hazard, flood control, good
husbandry practice, or prevention or treatment of disease. Grantee shall not remove,
destroy, or cut trees located outside the Greenway Easement, except to the extent
that cutting is necessary to remove that portion of a tree that intrudes into the
Greenway Easement.

10. Grantee agrees to be responsible for all regulatory stormwater requirements which
result from the Trail-related Improvements and to design, construct, and maintain
adequate storm water structures and controls within the Greenway Easement.
11. The Grantee shall pay any stormwater management fee imposed by any local, state,
or federal agency for the area within the Greenway Easement.
12. The Grantee and its agents shall have the right to inspect the Greenway Easement
and to cut, clear, and remove all undergrowth, obstructions, or improvements lying
within the easement that endanger or interfere with the proper use of the same.
13. The Grantor shall have no maintenance responsibility of the public access trail, the
Trail-related Improvements, or real or personal property within the Greenway
Easement.
14. To the extent permitted by law, Grantee will be responsible for its agents’ and
employees’ acts and omissions within the scope of their duties which cause injury
to persons or property relating to any use of the public access trail, the Trail-related
Improvements, or any property within the Greenway Easement.
15. The Grantor shall not erect any building, fence, sign, guardrail, or other above-
grade structure within the Greenway Easement so as to render the Greenway
Easement inaccessible.
16. The Grantee agrees that the Greenway Easement shall not be open to the public
until such time as construction of the public access trail is completed.
17. The Greenway Easement herein conveyed shall be appurtenant to the Grantor’s
lands over which they run and shall convey to the Grantee the perpetual right to
install and maintain improvements, the right to go on, over and upon the said

Greenway Easement for the purposes of installing, maintaining, repairing and
replacing the improvements necessary for the public access trail.
18. The covenants agreed to and the terms, conditions, and restrictions imposed herein
shall be binding upon the Grantor and its agents, heirs, and assigns and shall
continue as a servitude running in perpetuity with the described land. The Grantor
agrees that the terms, conditions, and restrictions of this Greenway Easement will
be inserted by it in any subsequent deed or other legal instrument by which it divests
itself of either the fee simple title to, or of its possessory interest in, the subject
property.
19. Should the Grantee or its assigns or successors-in-interest cease to develop, operate,
or maintain the public access trail, the Grantor may request that the Greenway
Easement be vacated. Grantee or its assigns or successors-in-interest shall not
unreasonably withhold approval of such request.
20. This Greenway Easement is subject to all covenants, conditions, restrictions, and
other easements of record insofar as they may affect this Greenway Easement.
21. The Grantor acknowledges the right to receive just compensation and the right to
request an appraisal for the property herein conveyed, and hereby waives those
rights.

ISSUE:
MVP, LLC has offered to provide a public service donation to Roanoke County in the
amount of $10,538.59.
BACKGROUND:
On June 30, 2021, three (3) individuals locked themselves to an immobilized vehicle
filled with concrete and rebar, and purposefully blocked access to Honeysuc kle Road in
Roanoke County (a public right-of-way). The Roanoke County Police Department
responded to this event and carried out an extensive and lengthy extraction of the three
(3) individuals in order to remove the blockage of Honeysuckle Road.
DISCUSSION:
In an attempt to collect the monetary losses incurred by Roanoke County for this event,
the Roanoke County Attorney's Office initiated a civil suit on behalf of the County
against the three (3) individual protesters. Counsel for the three (3) individ ual protesters
has proposed a settlement of the civil suit with an agreement by the protesters to pay
for the cost of the tow service incurred on June 30, 2021 ($510). MVP, LLC has offered
to reimburse the County for any additional expenses possible (above the normal
salaries of law enforcement officers - which is disallowed by law), in order to relieve the
County of the additional financial burden incurred in responding to this event

FISCAL IMPACT:
There is no funding required to effectuate this agenda item.
There have been no changes since the first reading of this ordinance on July 25, 2023.

BE IT ORDAINED by the Board of Supervisors of the County of Roanoke, Virginia,
as follows:
1. That the sum of $10,538.59 from MVP, LLC is hereby accepted and
appropriated to the Roanoke County general fund.
2. That this ordinance shall take effect from and after the date of adoption.
