Page 1 of 2 AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON JULY 12, 2022 RESOLUTION RECOGNIZING CMDR. RICHARD M. POINDEXTER FOR HIS EXEMPLARY SERVICE TO ROANOKE COUNTY WHEREAS, In July, 1994, Richard M. Poindexter was hired as a police officer for the Roanoke County Police Department, where he has served in an exemplary manner; and WHEREAS, Cmdr. Poindexter was promoted to sergeant in December 2003 and Commander in December 2014 and has supervised a variety of units within the Police Department since that time; and WHEREAS, Cmdr. Poindexter was assigned as the A Platoon Commander in October 2017 when he was also designated as the Deputy Incident Commander for the Police Department response to the Mountain Valley Pipeline project. During this assignment, he helped plan the County’s response to the pipeline, working with County Administration and other government officials both within and outside of Roanoke County. WHEREAS, Cmdr. Poindexter was assigned as commander of the Professional Standards Unit in October 2018, where he has been responsible for recruiting and selection of employees, policy development, accreditation compliance and internal affairs investigations, amongst other duties; WHEREAS, Cmdr. Poindexter led the revision of the Police Department’s use of force policies and transition to the 6th Edition standards of the Commission on Accreditation for Law Enforcement Agencies; and WHEREAS, Cmdr. Poindexter led an employee group charged with developing Page 2 of 2 guidelines for the implementation of the Police Department’s pay step plan in 2021 and subsequently implemented those guidelines; and WHEREAS, Cmdr. Poindexter has been assigned to investigate a number of significant and complex employee issues and disciplinary matters, which were d one in a thorough, professional and efficient manner earning recognition and praise from County Administration, Human Resources Department and County Attorney’s Office; and WHEREAS, Cmdr. Poindexter was appointed as Acting Assistant Chief of Police for Administration in April 2022 where he has successfully and effectively supervised the Professional Standards Unit, Roanoke County Criminal Justice Academy, Services Division and Crime Prevention Coordinator; and WHEREAS, Cmdr. Poindexter’s 28 years of service to the Roanoke County Police Department have contributed greatly to the safety of our citizens and effectiveness of the Police Department. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Cmdr. Richard M. Caywood County Administrator ISSUE: First reading of an ordinance to appropriate funds in the amount of $2,528,236 (pursuant to the amended 2022-2023 budget, which will be effectuated by resolution on July 26, 2022), and to amend the Classification Plan BACKGROUND: The County Administrator proposed the fiscal year 2023 operating budget on March 8, 2022. As discussed with the Board of Supervisors during the briefing held at the March 8, 2022 Board meeting, Commonwealth budget changes unde r consideration by the General Assembly could have impacts on the Roanoke County budget. These included the collection of sales tax on groceries, changes considered for compensation for Constitutional Officers from the Compensation Board and funding for P olice through HB 599 funding. DISCUSSION: County staff shared with the Board of Supervisors that ongoing discussions in the General Assembly were not resolved until June 21, 2022, which delayed the adoption of the State budget. As a result of the action taken by the General Assembly and based Page 2 of 2 on the final biannual state budget, staff recommends the revenue budget should be increased by $2,528,236 (it is proposed that the budget be amended by resolution on July 26, 2022). Of this amount, $2,400,000 is in our shared revenues with the schools. As part of the proposed budget amendment, the percentage of 41.0720% will be applied to the increase in shared revenues, and $985,728 will be transferred to the Schools based on the revenue-sharing formula. The remaining $1,542,508 will increase the General Government fund budget for expenditures to include increases for the starting salary in the Public Safety and ECC step plans in the amount of $853,720, increase the percentage in non-public-safety salaries from five percent (5%) to six (6%), in the amount of $425,000 and increase the registrar budget by $263,788, as formally approved at the May 24, 2022 Board meeting. See attached PowerPoint and other attachments for more details. FISCAL IMPACT: The proposed budget amendment will increase the General Government revenues budget by $2,528,236, increase expenditures for the transfer to Schools by $985,728 and increase the General Government expenditures by $1,542,508. STAFF RECOMMENDATION: Staff recommends approval of the first reading of the ordinance and scheduling the second reading for July 26, 2022. Resulting from this work, separate pay structures for public safety and non-public safety employees were created. Attachment A – Public Safety Step Structures In order to recruit and retain employees in critical public safety positions for Police, Fire & Rescue, Sheriff and Emergency Communications, certain positions have been removed from the Classification Plan format which combined all jobs. Each of these departments will have a step pay structure that identifies the employee pay based on rank and step. The Public Safety pay structures are anchored to the starting rate shown at the lowest level and progress with time in job and promotion in rank. The Public Safety pay structures are being implemented over a period of 3 years. The implementation period began in July 2021 and employees should be in their appropriate step as of July 2023, subject to appropriation by the Board of Supervisors. Attachment B – Classification Plan The Classification Plan provides a summary of all Roanoke County jobs, the pay range and number of employees assigned to each job. The County has moved to a Decision Band Method (DBM) based classification for non-public safety employees. The grading hierarchy of the Decision Band Method is illustrated by an alpha-numeric nomenclature and is determined by the level of decision making required for the job. Attachment C – Pay Bands The Pay Bands attachment shows the minimum and maximum pay rates assigned to the pay band. Further, the Board approved the Classification Plan for fiscal year 2022-2023, by Ordinance 051022-4, on May 10, 2022; and WHEREAS, ongoing discussions in the General Assembly were not resolved until June 21, 2022, and therefore delayed the adoption of the State budget; and WHEREAS, as a result of the provisions of the now-adopted biannual State budget, it is proposed that the County’s 2022-2023 budget be amended and increased by $2,528,236. It is proposed that such amendment be effectuated by resolution on July 26, 2022; and WHEREAS, it is further proposed that $2,528,236 be appropriated to the general fund, which will subsequently include a transfer to the Roanoke County Public Schools in the amount of $985,728; and WHEREAS, it is proposed that the Classification Plan also be amended to 1) include two new positions for the registrar, 2) update the new public safety step-plan Page 2 of 2 anchor salaries and 3) increase the pay bands from five percent (5%) to six percent (6%); and WHEREAS, the first reading of this ordinance was held on July 12, 2022, and the second reading was held on July 26, 2022. NOW THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. BACKGROUND: Roanoke County has leased certain real property located in the City of Salem, Virginia, bounded by East Main Street, Craig Avenue, Clay Street, and Thompson Memorial Drive for parking purposes for Roanoke County Courthouse guests and Roanoke County employees since May 1, 1992. The current lease is with the current landowner, Oaklands Properties, LLC. The lease is set to expire on July 31, 2022. DISCUSSION: In preparation for the upcoming lease expiration date, County staff has negotiated with Oaklands Properties, LLC for a new lease of the real property for continued parking purposes for Roanoke County Courthouse guests and Roanoke County employees. The proposed lease agreement (attached) includes rent in the amount of $4,573 per month, with rent increasing six percent (6%) annually on August 1st of each year. The proposed lease is for an initial term of five (5) years, with an optional renewal for an additional five-year term. The proposed lease also includes a right of first refusal on any Page 2 of 2 proposed sale of the leased premises. FISCAL IMPACT: Funding will include the rental amounts for the term of the lease. Page 1 of 5 This LEASE AGREEMENT, made and entered into this ________ day of _________________, 2022, by and between OAKLANDS PROPERTIES, LLC, a Virginia limited liability company, Grantor, hereinafter referred to as “Landlord,” and the BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, a political subdivision of the Commonwealth of Virginia, its successors or assigns, Grantee, hereinafter referred to as “Tenant.” W I T N E S S E T H That for and in consideration of the Premises and the mutual covenants contained herein, the parties agree as follows: 1. The total leased Premises is approximately 42,191 square feet. 2. Term of Lease – The term of this Lease shall be for a period of five (5) years, said term to commence on August 1, 2022 and continue until July 31, 2027. Tenant shall have the option to renew this Lease for an additional successive five (5) year term, commencing August 1, 2027 and continuing until July 31, 2032, upon the same terms and conditions contained in this agreement; said Lease may be renewed by providing written notice to Landlord on or before the 31st day of March, 2027. Either party may terminate this Lease by providing six (6) months’ written notice as provided in Section 13. Notices. 3. Rental – Tenant shall pay as rent the sum of Four Thousand Five Hundred and Seventy-Three Dollars ($4,573.00) per month, payable each month in advance by Tenant to Landlord at 2730 Wycliffe Avenue, Roanoke, VA 24014 without demand therefor. The rent shall increase six (6) percent annually, beginning on August 1st of each year. Tenant’s obligation to pay is subject to annual appropriations being made for such purpose by the governing body of the County of Roanoke. 4. Taxes – During the term of this Lease, Landlord shall remain responsible for the payment of all taxes and assessments imposed on the Premises; provided, however, that Tenant Page 2 of 5 agrees to pay the amount of any real estate tax increase which is directly attributable to improvements made to the Premises by Tenant. 5. Use and Possession – It is understood and agreed by the parties that the Premises are to be used, during the term of this lease, for the purpose of parking or storing motor vehicles, and may include the construction of certain improvements by Tenant for any related purposes. Any structures or other improvements placed upon the Premises by Tenant shall remain the property of Tenant and may be removed at any time prior to the expiration of this Agreement, but such removal shall not be deemed an abandonment or waiver of Tenant’s rights under this Agreement. Tenant agrees not to install underground storage facilities for petroleum products on the Premises. 6. Condition – Tenant has examined and knows the condition of the Premises and accepts same in its current condition. Tenant acknowledges that no representation as to the condition or repair of the Premises thereof has been made by Landlord, except as provided for herein. The Premises shall be returned to Landlord at the expiration of this Lease in its current condition and state of repair, with allowance for ordinary wear and tear. Tenant shall be allowed to perform general maintenance on the Premises in order to keep the Premises in safe and working order for the purpose of parking or storing motor vehicles. However, Tenant shall have no maintenance responsibilities as to the Premises. Landlord is responsible for all maintenance of the Premises. 7. Liabilities – During the term of this Lease, Tenant will provide and pay for all utilities which may be necessary to Tenant for the reasonable and proper use and enjoyment of the demised Premises by Tenant. Landlord agrees to grant such approvals to the utility companies as may be necessary for the installation of utility services. 8. Insurance - Tenant agrees that it shall, during the term of this lease, keep in full force and effect a policy of public liability insurance or such comparable self-insurance as may be authorized by the laws of the Commonwealth of Virginia with limits of at least $1,000,000 .00 for personal injury to or death of any one person and $2,000,000.00 for injury to or death of more than one person in any one occurrence and $100,000.00 for property damage. 9. Landlord Covenants – Landlord covenants and represents that it has the full and complete ownership of the leased Premises; that it and the undersigned signatory have the full power and right to execute this Lease and to perform the obligations hereunder; that no private restrictions exist with respect to the said Premises or the use thereof; that no one, exclusive of Landlord and Tenant and their respective successors in interest, has any interest in or claim against the leased Premises; and that the proposed use of the leased Premises by Tenant is lawful and permissible under all applicable laws and regulations. Page 3 of 5 10. Right of First Refusal – Landlord hereby grants to Tenant the right of first refusal on any sale of the leased Premises. Any proposed sale of the leased Premises will be submitted to Tenant, and Tenant shall have the right to purchase the leased Premises on the same terms and conditions as the proposed purchaser. In the event that Landlord’s proposed sale includes all or any portion of the Premises and the adjoining parcel of land containing 0.789 acres, more or less, located on Thompson Memorial Drive between East Main Street and Clay Street as shown on the attached Exhibit A, Landlord hereby grants to Tenant the right of first refusal on any such proposed sale; provided, however, that Tenant may not elect to purchase only the Premises portion of the proposed sale. All such proposals of any kind shall be presented to Tenant by written notice, and Tenant shall have thirty (30) days upon which to enter into a contract with Landlord to purchase said Premises, by itself or in combination with all or a portion of the adjoining parcel, as applicable, upon the same terms and conditions as the proposed purchaser. 11. Sale of Premises – In the event that Landlord sells the Lease Premises to any party other than Tenant, the sale and conveyance thereof will be made subject to all provisions of this lease. 12. Miscellaneous – Landlord and Tenant hereby agree, in the event any portion of the Premises is hereinafter acquired by the City of Salem or the Virginia Department of Transportation for street widening, that Tenant shall be entitled to proportionately reduce the monthly rent, i.e. the monthly rent to be reduced by the percentage that the square footage of the Premises taken related to the square footage of the entire Premises. 13. Caywood County Administrator ISSUE: The Board of Supervisors owns a landlocked parcel in Valley Tech Park, which is used for stormwater management purposes. Access to the County’s parcel is over an adjacent parcel, currently owned by Technology DR I LLC. Technology DR I LLC has requested an amendment to a previous access easement granted to the Board of Supervisors to establish a specific location of the easement in order to facilitate their development plans of the property. A map showing the location of both parcels is attached for review, as well as a plat showing the location of the proposed location of the new easement. BACKGROUND: Technology DR I LLC owns an 8.459 acre parcel, located in Valley Tech Park. Technology DR I LLC wishes to build a distribution facility on the 8.459 acre parcel, and has received approval of a site plan from the Department of Development Services showing the location of the proposed distribution facility. The Board of Supervisors owns a parcel immediately adjacent to Technology DR I LLC’s property. The County’s parcel is 5.81 acres in size, and houses a stormwater management facility. The County’s adjacent parcel is landlocked; the only access to the County’s parcel is over Technology DR I LLC’s parcel. Page 2 of 2 By deed dated January 21, 2000, the prior owner of the parcel now owned by Technology DR I LLC (the Roanoke County Economic Development Authority) sold that property and reserved for itself and the Board of Su pervisors of Roanoke County, Virginia, a perpetual general easement across the parcel for the purpose of ingress and egress to the County’s adjacent parcel. Then, 20 years later, by an instrument dated October 26, 2020, the subsequent owner of the parcel now owned by Technology DR I LLC requested an amendment to the easement to establish a specific location of the easement in order to facilitate that prior owner’s development plans of the property. The Board of Supervisors was not a party to the 2020 easement amendment. DISCUSSION: Technology DR I LLC has requested to vacate the general easement granted to the Board of Supervisors established in 2000, and to grant a new specific easement to the Board of Supervisors for stormwater management and access purposes. The proposed deed which is attached accomplishes those purposes. There have been no changes since the first reading of this ordinance on June 28, 2022. FISCAL IMPACT: There is no fiscal impact associated with the granting of the proposed ordinance. WITNESSETH: WHEREAS, Technology DR I LLC owns an 8.459 acre parcel, located in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.00-0000 (hereinafter referred to as the “subject property”); and WHEREAS, the Board of Supervisors of Roanoke County, Virginia owns a 5.81 acre parcel, located in the County of Roanoke, Virginia, identified as Roanoke County Tax Map No: 064.02-02-50.06-0000, which is immediately adjacent to the subject property, and which is landlocked (hereinafter referred to as the “County’s adjacent property”); and WHEREAS, by deed dated January 21, 2000, recorded amongst the land records in the Roanoke County Circuit Court Clerk’s Office at Deed Book 1648, Page 0662, the Economic Development Authority of Roanoke County, Virginia (referenced by that deed as the Industrial 2 of 7 Development Authority of Roanoke County, Virginia) reserved for itself, its successors and assigns, including the Board of Supervisors of Roanoke County, Virginia, a perpetual easement across the subject property for the purpose of ingress and egress to a stormwater management facility located on the County’s adjacent parcel (hereinafter referred to as the “2000 Easement”); and WHEREAS, by instrument dated October 26, 2020, recorded amongst the land records in the Roanoke County Circuit Court Clerk’s Office as Instrument #202100510, the Economic Development Authority of Roanoke County, Virginia and the prior owner of the subject property (VALLEY TECHPARK PARTNERS, LLC) executed an amendment to the easement across the subject property by establishing a specific location of the easement in order to facilitate the prior owner’s development plans of the subject property (hereinafter referred to as the “2020 Easement Amendment”); and WHEREAS, the Board of Supervisors of Roanoke County, Virginia was not a party to the 2020 Easement Amendment; and WHEREAS, Technology DR I LLC desires to vacate the easement granted to the Economic Development Authority of Roanoke County, Virginia established originally by the 2000 Easement and amended by the 2020 Easement Amendment, and to grant a new easement for stormwater management and access purposes to the Economic Development Authority of Roanoke County, Virginia; and WHEREAS, Technology DR I LLC also desires to vacate the easement granted to the Board of Supervisors of Roanoke County, Virginia established by the 2000 Easement, and to grant a new easement for stormwater management and access purposes to the Board of Supervisors of Roanoke County, Virginia; 3 of 7 NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, including the incorporation of the recitals above, the Grantor hereby GRANTS and CONVEYS with General Warranty and Modern English Covenants of Title unto the Grantees, their successors and assigns, the following described easement, in the County of Roanoke, Virginia to wit: A 20 (twenty) foot wide private stormwater management and access easement upon, over, through, and across the parcel of land belonging to the Grantor, which is designated on the Roanoke County Land Records as Tax Map Number 064.02- 02-50.00-0000. The location of said easement shall be within the area as shown upon the plat dated April 21, 2021, prepared by Parker Design Group, titled “EASEMENT PLAT FROM RECORDS FOR TECHNOLOGY DR I LLC SHOWING AN EXISTING STORMWATER MANAGEMENT AND ACCESS EASEMENT TO BE VACATED AND A NEW 20’ WIDE STORMWATER MANAGEMENT AND ACCESS EASEMENT TO BE CREATED LOCATED ON LOT 4A (8.459 ACRES) RESUBDIVISION OF LOT 4 OF VALLEY TECKPARK RECORDED IN PLAT BOOK 22, PG.193 CATAWBA MAGISTERIAL DISTRICT, ROANOKE COUNTY, VIRGINIA,” said plat being attached as Exhibit A and to be recorded in the Roanoke County Clerk’s Office with this deed. AND NOW, THEREFORE, the said EASEMENT shall be subject to the following terms and conditions: 1. The Grantor shall retain the right to use the subject property including the easement conveyed herein in any manner which shall not interfere with the Grantees’ rights to the easement area. 2. The Grantor shall not erect any structure or place any material within the easement area so as to render the easement inaccessible. 3. The easement herein conveyed shall be appurtenant to the Grantor’s lands over which it runs and shall convey to the Grantees, Grantees’ successors and assigns, the perpetual right to go on, over and upon the Grantor’s land for purposes of 4 of 7 ingress and egress to the County’s adjacent property identified as Roanoke County Tax Map No: 064.02-02-50.06-0000. 4. The covenants agreed to and the terms, conditions, and restrictions imposed herein shall be binding upon the Grantor and Grantor’s agents, heirs, and assigns and shall continue as a servitude running in perpetuity with the subject property. The Grantor agrees that the terms, conditions, and restrictions of this easement will be inserted by it in any subsequent deed or other legal instrument by which it divests itself of either the fee simple title to, or of its possessory interest in, the subject property. 5. This easement is subject to all covenants, conditions, restrictions, and other easements of record insofar as they may affect this easement. 6. The recitations in the introductory clauses to this Deed of Easement introduced by the word “whereas” are incorporated herein as substantive provisions of this Deed of Easement and will be binding on the parties. McPhail Jr. was employed by Roanoke County on August 15, 1994; and WHEREAS, Detective McPhail retired on June 1, 2021, after twenty-six (26) years and ten (10) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Detective McPhail, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Detective McPhail’s tenure with Roanoke County, he achieved the rank of Police Officer II and the rank of Detective; and, WHEREAS, as he advanced through the ranks, Mr. McPhail protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol as a Field Training Officer and member of the Special Weapons and Tactics team (SWAT) and the Criminal Investigations Division. Mr. McPhail investigated incidents that involved fraud, internet crimes, property crimes and crimes against persons (homicides, sexual assaults, and assaults). Mr. McPhail served as a Polygraph Operator during his tenure in the Criminal Investigations Division. Mr. McPhail completed his service to the citizens of Roanoke County as a member of the Federal Bureau of Investigations Violent Crimes Task Force. SMITH, POLICE OFFICER-COMMANDER-ACADEMY DIRECTOR, UPON HIS RETIREMENT AFTER MORE THAN TWENTY-FIVE (25) YEARS OF SERVICE WHEREAS, Keith B. Smith was employed by Roanoke County on August 14, 1995; and WHEREAS, Commander Smith retired on January 1, 2021, after twenty-five (25) years and five (5) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Commander Smith, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Commander Smith’s tenure with Roanoke County, he advanced through the ranks of Police Officer, Police Officer II, Sergeant, Lieutenan t and finally to Commander; and WHEREAS, as he advanced through the ranks, Mr. Smith protected the citizens of the County and the Roanoke Valley with professionalism and dedication, while serving in the Uniform Patrol, the Services Division and serving as the Roanoke County Criminal Justice Academy Director. Mr. Smith completed his service to the citizens of Roanoke County as the Director of the Roanoke County Criminal Justice Academy. WHEREAS, Mr. Smith also served on the Special Weapons and Tactics team (SWAT) for a number of years. During those years Mr. Smith initially started as a member of the team and progressed to become the Tactical Operations Commander. He contributed his skills to the development and training of SWAT team members and to the growth of new recruits attending the Roanoke County Criminal Justice Academy. BACKGROUND: The Bulletproof Vest Partnership (BVP), created by the Bulletproof Vest Partnership Grant Act of 1988 is a unique Department of Justice Initiative designed to provide a critical resource to state and local law enforcement. DISCUSSION: The Bulletproof Vest Partnership (BVP) has awarded the Roanoke County Sheriff’s Office matching grants to assist in the purchase of protective vests. FISCAL IMPACT: The total amount of the grant awarde d is $9,555, which includes a fifty percent (50%) match. U.S. Department of Justice grant funds total $4,777.50 and the County match of $4,777.50 was appropriated by the Board of Supervisors in the fiscal year 2022 -2023 Sheriff’s office budget. No additional appropriation of County funds is required.
