Roanoke, Virginia 24018 January 2, 1997 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the organizational meeting and the 2nd day of January, 1997. IN RE: CALL TO ORDER Chairman Johnson called the meeting to order at 9:01 a.m. The roll call was taken. MEMBERS PRESENT: Chairman Bob L. Johnson, Vice Chairman Harry C. Nickens Supervisors Lee B. Eddy, Fenton F. "Spike" Harrison, H. Odell "Fuzzy" Minnix MEMBERS ABSENT: None STAFF PRESENT: Elmer C. Hodge, County Administrator; Paul M. Mahoney, County Attorney; Mary H. Allen, Clerk to the Board; John M. Chambliss, Assistant County Administrator, Don C. Myers, Assistant County Administrator IN RE: OPENING CEREMONIES The invocation was given by Supervisor Harry C. Nickens. The Pledge of Allegiance was recited by all present. IN RE: ORGANIZATION OF COUNTY BOARD 2 January 2, 1997 Election of Officers a. Chairman and Vice chairman Supervisor Harrison moved to elect Supervisor Johnson to serve as Chairman. There were no other nominations and the motion was carried by the following recorded vote: 1. AYES: NAYS: Supervisors Eddy, Minnix, Harrison, Nickens, Minnix. None Chairman Johnson thanked the Board for their confidence In him and expressed pride at the diversity and excellence of the Board of Supervisors. He advised that he looked forward to a prod uctive 1997. Supervisor Harrison moved to elect Supervisor Nickens to serve as Vice Chairman. There were no other nominations and the motion was carried by the following recorded vote: AYES: NAYS: Supervisors Eddy, Minnix, Harrison, Nickens, Johnson. None 2. Lenath of Term for Chairman and Vice Chairman Supervisor Johnson moved that terms of the chairman and vice chairman shall run from January 2, 1997, to the organizational meeting on January 5, 1998. The motion carried by the following recorded vote: AYES: Supervisors Minnix, Harrison, Eddy, Nickens, Johnson. NAYS: None 3. Resolution establishina Bvlaws. Rules of Order and Schedule for January 2, 1997 3 Board Meetinas in 1997 . R-01 0297-1 Supervisor Johnson moved to adopt the prepared resolution. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Minnix, Harrison, Nickens, Johnson. NAYS: None RESOLUTION 010297-1 ESTABLISHING A MEETING SCHEDULE FOR THE BOARD OF SUPERWSORSOFROANOKECOUNTYFOR CALENDAR YEAR 1997 AND ADOPTING RULES OF PROCEDURE FOR SUCH MEETING BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That for calendar year 1997, the regular meetings of the Board of Supervisors of Roanoke County, Virginia, are set forth below with public hearings scheduled for 7:00 o'clock p.m. unless otherwise advertised. That the organizational meeting for 1997 shall be held on Monday, January 5, 1998. 3. That the rules of parliamentary procedure for the conduct of all Board meetings shall be Robert's Rules of Order; provided, however, these rules are amended as follows: a. that no second to motions shall be required in order to consider that motion; and b. that the chairperson may make motions, participate in debate and vote on all matters considered by the Board. c. That no amendment or addition to the printed agenda be permitted unless approved by unanimous vote of all Board members present, unless requested by the County Administrator or the County Attorney as a matter requiring immediate attention. This provision applies to Main Motions and shall not apply to Privileged Motions, Subsidiary Motions, Incidental Motions, or Motions That Bring a Question Again Before the Board. On motion of Supervisor Minnix to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Eddy, Minnix, Harrison, Nickens, Johnson NAYS: None IN RE: RECESS Chairman Johnson declared a recess at 9: 15 a.m. January 2, 1997 5 IN RE: RECONVENEMENT: Chairman Johnson reconvened the meeting at 9:20 a.m. MEETING WITH ROANOKE VALLEY LEGISLATORS TO DISCUSS 1997 LEGISLATIVE PROGRAM. Legislators who were present for this meeting were Delegates A. Victor Thomas, C. Richard Cranwell and State Senator John Edwards. County Attorney Paul Mahoney presented the list of legislative requests adopted in Resolution 120396-2 on December 3, 1996. It was recommended that several of the items should be emphasized. They included: (1) Increase funding for public education and more particularly, assist localities in capital construction and renovation projects; (2) Support legislation appropriating additional funds and directing the State Compensation Board to modify staffing standards for local jails and court services positions for sheriff's offices; (3) Support legislation to restore the balance to the rebuttal process for heart/lung/cancer presumption in Workers' Compensation; (4) Support additional new construction and maintenance funding for VDOT secondary and primary roads; and (5) Oppose any efforts to eliminate or restrict local powers of taxation for personal property tax IN RE: and BPOL. Delegate Cranwell explained that he did not think the House Finance Committee would adopt any legislation to eliminate the BPOL or personal property tax. In response to a question from Senator Edwards, Supervisor Eddy explained that the request 6 January 2, 1997 for additional funds for VDOT was to improve secondary roads. In response to a question from Supervisor Minnix regarding funding for renovations to schools, Senator Edwards advised that possibilities include increasing funding in the Literary Loan Fund, and that VPSA funding could be enhanced. Supervisor Eddy requested that several other items be added to the legislative requests. They included granting of franchising authority to counties similar to the powers granted to cities to take advantage of the provisions of the federal Telecommunications Act and opposition to the New Century Council's request to be designated as a regional planning agency. Delegates Cranwell and Thomas responded that they understood that the New Century Council's request was misconstrued, and that they were only interested in getting authority for signs for the Interstate. Supervisor Eddy also requested support for increased funding for the Regional Competitiveness Act. IN RE: EXECUTIVE SESSION At 9; 15 a.m., Supervisor Johnson moved to go into Executive Session following the discussion with the Roanoke Valley legislators at 10:05 a.m. pursuant to the Code of Virginia Section 2.1-344 A (3) acquisition of real estate for public purposes. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Minnix, Harrison, Nickens, Johnson NAYS: None IN RE: CERTIFICATION OF EXECUTIVE SESSION January 2, 1997 7 R-01 0297-2 At 10:40 a.m., Supervisor Johnson moved to return to open session and adopt the Certification Resolution. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Minnix, Harrison, Nickens, Johnson NAYS: None RESOLUTION 010297-2 CERTIFYING EXECUTIVE MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened an executive meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such executive meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2. Only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Board of Supervisors of Roanoke County, Virginia.
