IN RE: CALL TO ORDER Chairman Johnson called the meeting to order at 3:03 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Bob L. Johnson, Vice Chairman Harry C. Nickens, Supervisors Fenton F. Economic Develooment Director) R.081 099.1 Mr. Gubala reported that Staff has participated as a member of Virginia's First Regional Industrial Facility Authority since July 1998 with 15 local governments to develop a regional industrial park. The New River Valley Commerce Park will be the first regional industrial park in Virginia, encompassing 1,065 acres adjacent to the New River Valley Airport. The Authority has prepared a preliminary plan and cost estimates for the Initial Phase of the Park which will include the construction of a 1 mile industrial access road, the acquisition of 326 acres, the acquisition of easements for access, water and sewer services, the option of 739 acres, and site grading for a 40 acre building pad. This Initial Phase is estimated to cost $6,908,500 and will be funded by grants and loans. The estimated total development costs of the New River Valley Commerce Park are over $43 million. Mr. Gubala advised that the Authority has prepared a Local Participation Agreement that sets forth the scope of the project, the investment and the revenue sharing for the project participants. Each of the 15 member governments is requested to approve the Local Participation Agreement. Localities are offered a 1/15th share of the project or 10,000 shares of a 150,000 share pool, at the current price per share of $2.75. The annual payments for the shares will be used to retire the debt on the Rural Development Loans. August 10, 1QQQ 497 Mr. Gubala explained that since there is not yet a prospect locating in the project, there is no tax revenue at this time. The Authority has indicated that there might not be a payback on the localities' investment until after 2010. Each locality is asked to respond to the initial share offer and indicate their election of the number of shares they wish to purchase. As of July 21, 1999, six local governments have indicated they will purchase 44,541 shares and three have declined any purchase. The cities of Salem and Roanoke have not taken any action yet, and Mr. Hodge has recommended that the County purchase 1,000 shares. He also advised that the shares will be offered again, even to the private sector. Mr. Gubala requested that the Board of Supervisors adopt the resolution and authorize the County Administrator to execute the agreement. In response to questions, Assistant County Attorney Joseph Obenshain advised that the agreement locks in the current machinery and tools tax rate, and that if the General Assembly eliminates this tax, the host locality must pay the members the equivalent funding. Mr. Gubala also responded that if Roanoke County decides at a later date to withdraw, we would lose our shares but would still have the liability. Following additional questions, Supervisor Nickens moved to adopt the resolution and purchase 10,000 shares. The motion carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None RESOLUTION 081099.1 AUTHORIZING A LOCAL PARTICIPATION AGREEMENT WITH VIRGINIA'S FIRST REGIONAL INDUSTRIAL FACILITY AUTHORITY AND AN ACCEPTANCE OF ALLOTTED SHARES 498 August 10, 1999 FOR THE FINANCING OF THE DEVELOPMENT OF THE NEW RIVER VALLEY COMMERCE PARK PROJECT . INITIAL PHASE WHEREAS, Virginia's First Regional Industrial Facility Authority (the "Authority") has been organized and created by fifteen political subdivision in Southwest Virginia, including the County of Roanoke, pursuant to Chapter 64 of Title 15.2 ofthe Code of Virginia, 1950, as amended, to promote economic development in this region through the creation of a regional industrial park; and WHEREAS, the Authority and individual political subdivisions in this region have identified the development of the New River Valley Commerce Park, to be located in Pulaski County, Virginia, adjacent to the New River Valley Airport, as an important economic development project for the region to promote the purposes for which the Authority was created; and WHEREAS, the scope and preliminary plan of the Initial Phase of the New River Commerce Park (the "Project") has been developed including the acquisition of 326 acres of land, options upon approximately 740 additional acres for a five year period, construction of one mile of industrial access road, site grading of approximately 40 acres, acquisition of easements for access, water supply and waste water disposal and engineering plans for up to 6 million gallons of water supply and waste water disposal per day with an estimated cost of $6,908,500 and preparation of estimated revenue sources including grants and loans; and, WHEREAS, the County of Roanoke, Virginia, desires to participate in this project by purchasing shares in this project in order to contribute to the initial costs and expenses of the Project by underwriting the financing cost of loans at the rate of $2.75 per share per annum for an initial ten (10) year period in return for a proportionate share of revenues generated by this Project from machinery and tools taxes of any business or industry located in the Project. NOW THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia hereby expresses its intent to join as a participating jurisdiction in the Initial Phase of the New River Valley Commerce Park and authorizes the following: 1. That the County Administrator is authorized to execute on behalf of the Board of Supervisors the Local Participation Agreement - Initial Phase all upon such form as shall be approved by the County Attorney; and That the County of Roanoke, Virginia is authorized to purchase 10 000 shares of ownership interest in the Project at the price of$2.75 per share per annum. On motion of Supervisor Nickens to adopt the resolution and purchase 10,000 shares, and carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None 2. ~ Reauest to oroceed with additional work for road desian for the - AIJQm:t 10, 1QQQ 499 new South County Hiah School. (Deanna Gordon. School SuoerintendentJ A.081 099.2 Dr. Gordon reported that there will be an increase of $67,520 for the design of the access road into the property. The design will widen Pleasant Hill Drive and Arthur Thurman Road. She requested that the Board approve the design work. Chairman Johnson suggested that the School Board and Board of Supervisors meet to discuss the Glenvar Middle School and South County High School projects. Dr. Gordon advised that both projects are on hold because there are no funds to cover the design fees. Finance Director Diane Hyatt further advised that the School Board had to make this funding increase request because the architecture and engineering funds for the project are totally committed. SUpervisor Johnson pointed out that there was a $5 million increase in the scope of the project. Supervisors Johnson and Nickens expressed concern that the projects have been stopped, and suggested a joint work session on August 24. Supervisor McNamara moved to approve proceeding with the road design at $67,520 and to authorize Dr. Gordon to contact the architect to move forward with the auditorium. The motion carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Johnson NAYS: Supervisor Nickens It was the consensus of the Board to schedule a joint work session with the School Board on August 24, 1999. That the certain section of the agenda of the Board of Supervisors for August 10, 1999, designated as Item J - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 6, inclusive, as follows: 1. Approval of Minutes - July 13, 1999 2. Confirmation of committee appointments to the Highway and Transportation Safety Commission and Parks and Recreation Advisory Commission. 3. Request for acceptance of Springmill Road into the Virginia Department of Transportation Secondary System. 4. Request for acceptance of Carolina Trail and Stone House Lane into the Virginia Department of Transportation August 10, 1999 501 Secondary System. 5. On motion of Supervisor Johnson to adopt the Consent Resolution with correction to name in Item 2, and carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None RESOLUTION 081 099-3.b REQUESTING ACCEPTANCE OF SPRINGMILL ROAD INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM WHEREAS, the street described on the attached Additions Form SR-5(a), fully incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the Circuit Court of Roanoke County, and WHEREAS, the Resident Engineer for the Virginia Department of Transportation has advised this Board that the street meet the requirements established by the Subdivision Street Requirements of the Virginia Department ofTransportation, and WHEREAS, the County and the Virginia Department of Transportation have entered into an agreement on March 9, 1999, for comprehensive stormwater detention which applies to this request for addition, NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the street described on the attached Additions Form SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of Virginia, and the Department's Subdivision Street Requirements.. and BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Resident Engineer for the Virginia Department of Transportation. (2) He thanked and commended the County employees who have been working outside during the heat wave and drought. Suoervisor Johnson: He asked for a report on the greenway trail at Hanging Rock. Tim Gubala reported that the contract ends on August 17. He updated the Board on the recent activities and advised that there will be a ribbon cutting ceremony in the fall. INRE: CLOSED MEETING At 4:00 p.m., Supervisor Johnson moved to go into Closed Meeting after the work session pursuant to Code of Virginia Section 2.1-344 A (7) consultation with legal counsel regarding specific legal matter requiring the provision of legal EKivice: contract negotiations concerning (a) water contract with the City of Roanoke, and (b) economic development prospect; 2.1-344A(3) discussion ofthe acquisition of real property for public purposes, water line. The motion carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None 504 August 10,1999 INRE: WORK SESSIONS ~ Annual Meetina with the Honorable Bob Goodlatte. United States Conaress The work session was held from 4:10 to 5:10 p.m. Also attending was Pete Larkin from Congressman Goodlatte's office. The following reports were presented: (1) Blue Ridge Interpretative Center (Assistant Economic Development Director Joyce Waugh); (2) Update on federal flood mitigation grant funding and request for assistance in obtaining additional grants (Assistant Community Development Director George Simpson); (3) Report on drought conditions in Roanoke County ( Assistant County Administrator Don Myers); and (4) A request from the Board for assistance in addressing traffic problems on Interstate 81 and Routes 11-460. Congressman Goodlatte updated the Board on legislation that affects local governments. There was discussion on safety issues and road improvements to Interstate 81. Congressman Goodlatte announced that a meeting had been scheduled to discuss Interstate 81 on Thursday, August 12. Other discussion issues included the potential impact to County citizens from the Interstate 73; and funding for improvements to the Roanoke Regional Airport. Supervisor Johnson announced that the Federal Aviation Agency has agreed to remove the old FAA towers on Read Mountain, and advised that if it was not moved, he would contact Congressman Goodlatte for assistance. In response to a question from Supervisor Minnix concerning federal school construction funds, Congressman Goodlatte advised that the funds would be spent on localities that did not take care of their school facilities. Congressman Goodlatte also commended the Board of Supervisors for constructing the Spring Hollow Reservoir. =::¡ August 10,1999 505 IN RE: CERTIFICATION RESOLUTION R-081 099-4 At 6:00 p.m., Supervisor Johnson moved to return to open session; announced that the Closed Meeting was held from 5:15 p.m. until 6:00 p.m., and adopt the Certification Resolution. The motion carried by the following recorded vote: AYES: Supervisors McNamara, Minnix, Harrison, Nickens, Johnson NAYS: None RESOLUTION 081099-4 CERTIFYING THE CLOSED MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting which this certification resolution applies, and 2.
