Problem. Recent U.S. Court of Appeals for the Fourth Circuit caselaw 1 has rendered portions of this Chapter unconstitutional, and the General Assembly has implemented a comprehensive statutory scheme2 governing solicitations by charitable and civic organizations which severely limits the county 's ability to legislate in this area. 2. Proposed solution. a. Panhandling: We propose deleting the unconstitutional portions of Chapter 19 regarding panhandling (personal solicitations). b. Charitable Solicitation: As noted above , the state has implemented a comprehensive statutory scheme governing charitable 3 and civic4 organizations. The statute allows the county to pass an ordinance that is not inconsistent with the state code, and severely restricts the type of organizations which the county can regulate . Those limitations boil down to only allowing the county to require local civic organizations to apply for a permit prior to soliciting funds. Further, before any such ordinance can take effect, it must be submitted to and approved by the Commissioner of Agriculture and Consumer Services. We propose deleting "Article II Permit for Charitable Solicitations" (County Code 19-21 through 28) and taking advantage of Virginia Code§ 57-63(D). That state code section states that charitable organizations , which are required to register with the state, are exempt from complying with local ordinances except that they must tell the local governm ent entity it 5 n;:im P, th r rrnmri;: nr 1 S ee, e.g., Reynolds v. Middleton , 779 F.3d 222 (4th Cir. 2015) (Henrico County 's ordinance, which prohibited solicitation within county roadways , was ruled unconstitutional.) 2 Virginia Code §§ 57-48 through 69 . 3 A "charitable organization" is defined as "any person that is or bolds itself out to be organiLe<l ur uptrnit <l fur aHy charitable purpose, or any person that solicits or obtains contributions solicited from th e public . 'Charitable organization ' does not include (i) any church or convention or association of churches, primarily operated for nonsecular purposes and no part of the net income of which inures to the direct benefit of any individual ; (ii) any political party as defined in § 24 .2-101 or any political campaign committee or politi cal action i:-0n1mittee or 0ther political committee required by state or federal law to file a report or statement of contributions and expenditures ; or (iii) any authorized individual who solicits, by authority of such organization , solely on behalf of a registered or exempt charitable organization or on behalf of an organization excluded from the definition of charitable organization." Virg inia Code§ 57-48 . 4 A "civic organization" is defined as "any local service club , vete rans post, fraternal society or assoc iation , vo lunlter fire or rescue group , or local civic league or association of 10 or more persons not organized for profit but operated exclusively for educational or charitable purposes as defined in this section , including the promotion of community welfare , and the net earnings of which are devoted exclusively to charitable , educational , recreational , or social welfare purposes ." Virginia Code § 57-48. its solicitors and the dates and time that they will be soliciting in the locality (see proposed amended County Code 19-21 ). If the Board decides to delete the charitable solicitations ordinance , the county will still have a remedy against problematic fundraisers. For example, if the police become aware of an organization soliciting funds while committing misrepresentation or fraud , they can enforce County Code 19-8( c) (prohibiting misrepresentation and fraud). In addition , the County Attorney is specifically authorized by Virginia Code § 57-59(D) to bring an action, in the name of the Commonwealth, to enjoin the violation of any of the applicable state code provisions. c. Commercial Solicitation: We propose keeping the current regulations in place regarding commercial solicitations, except adding that the commercial solicitors may begin their planned activities as soon as they have submitted the required information and fee.5 d. " • Applicable to the states by the Fourteenth Amendment • "No State shall make or enforce any law which shall abridge the privileges or immunities of the citizens of the United States" • In practice, the First Amendment could read: • "Governments shall make no law abridging the freedom of speech, unless the government proves that it meets one of several continuously evolving, judicially created tests." . ~ROANOKE 3 Office of the County Attorney ··-COUNTY VA First Amendment -Basic Overview Levels of Scrutiny (Judicial Review) • Rational basis test • The normal standard of review applied when considering constitutional questions. No fundamental rights or suspect classifications are at issue • The law must have a legitimate governmental interest, and there must be a rational connection between the law's means and goals • Intermediate scrutiny test • Triggered by "quasi-suspect classification" • The law must further an important governmental interest and must do so by means that are substantially related to that interest • Strict scrutiny test • Triggered by a law that infringes upon a fundamental right or involves a suspect classification (race, religion, etc.) • The law furthers a compelling governmental interest and must be narrowly tailored to achieve that interest . ~ROANOKE 4 Office of the County Attorney ··-COUNTY VA Key Rulings re Charitable Solicitation as Protected Speech • Solicitation of charitable contributions (professional fund-raisers and charities) is protected speech, subject to strict scrutiny. Fees, disclosures, license required were unconstitutional • Riley v. Nat'/ Fed'n of the Blind of N.C., 487 U.S. 781 {1988) • "Begging" (downtown mall area) is communicative activity within the protection of the First Amendment, subject to strict scrutiny • Clatterbuck v. IN GENERAL Sec. 19-1. Definition. &_For the purpose of this chapter, the term "commercial solicitation" shall mean and include any one or more of the following activities : (1) Seeking to obtain orders for the purchase of goods, wares, merchandise, foodstuffs or services of any kind, character or description. The applicant may begin soliciting as soon as the required information and payment is tendered. It shall be unlawful for any person to engage in solicitation upon any premises or residence located thereon, if such premises or residence is posted against solicitation by means of a notice prominently displayed, upon which is printed the legend "NO SOLICITORS ." (b) No person who engages in commercial solicitation shall misrepresent the right of a buyer of goods or services to rescind or cancel a sale under the provisions of law .
