The Roanoke County Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the organizational
meeting and the 5th day of January, 1998.

CALL TO ORDER
Chairman Johnson called the meeting to order at 9:01 a.m. The roll call was taken.

Supervisor Nickens moved to elect Supervisor Johnson to serve as
Chairman. There were no other nominations and the motion was carried by the following
recorded vote:

Supervisor Harrison moved to elect Supervisor Nickens to serve as Vice
Chairman. There were no other nominations and the motion was carried by the following
recorded vote:

2. Lenath of Term for Chairman and Vice Chairman
Supervisor Johnson moved that terms of the chairman and vice chairman
shall run from January 5, 1998, to the organizational meeting on January 4, 1999 at 4:00
p.m.. The motion carried by the following recorded vote:

RESOLUTION 010598-1 ESTABLISHING A MEETING
SCHEDULE FOR THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY FOR CALENDAR YEAR 1998 AND
ADOPTING RULES OF PROCEDURE FOR SUCH MEETING
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That for calendar year 1998, the regular meetings of the Board of
Supervisors of Roanoke County, Virginia, are set forth below with public hearings
scheduled for 7:00 o'clock p.m. unless otherwise advertised.

2. That the organizational meeting for 1999 shall be held on Monday,
January 4, 1999, at 4:00 p.m.
3. That the rules of parliamentary procedure for the conduct of all Board
meetings shall be Robert's Rules of Order; provided, however, these rules are amended
as follows:
a. that no second to motions shall be required in order to consider
that motion; and
b. that the chairperson may make motions, participate in debate
and vote on all matters considered by the Board.
c. that no amendment or addition to the printed agenda be
permitted unless approved by unanimous vote of all Board members present, unless
requested by the County Administrator or the County Attorney as a matter requiring
immediate attention. This provision applies to Main Motions and shall not apply to
Privileged Motions, Subsidiary Motions, Incidental Motions, or Motions That Bring a
Question Again Before the Board.
On motion of Supervisor Nickens to adopt the resolution with joint meetings
with Roanoke City Council removed and corrections to the resolution for April and
November 18, and carried by the following recorded vote:

1... Resolution adopting a leaislative program for the 1998 session
of the VirQinia General Assemblv. (Paul Mahoney) (CONTINUED
FROM DECEMBER 16.1997)
Mr. Mahoney advised that if the Board preferred, they could wait to adopt the

Supervisor Johnson asked that funding support for Destination Education
and the College of Health Sciences be added to the resolution.
There was Board consensus to wait to consider adoption of the resolution
until after the meeting with the legislators.
IN RE:
OTHER BUSINESS
Chairman Johnson announced that he had received a letter regarding
Housing and Urban Development's (HUD) denial of federal funding for Total Action Against
Poverty's Transitional Living Center and had sent a letter to HUD in support of the funding.

IN RE:
MEETING WITH ROANOKE VALLEY LEGISLATORS TO DISCUSS 1998
LEGISLATIVE PROGRAM.
Legislators who were present for this meeting were Delegates A. Victor
Thomas, C. Richard Cranwell, Clifton Woodrum, and State Senator Bo Trumbo.
County Attorney Paul Mahoney presented the list of legislative requests and

particularly, assist localities in capital construction and renovation projects; (2) Opposition
to the creation of charter schools; (3) Support for additional new construction and
maintenance funding for VDOT secondary and primary roads; (4) support for the
imposition of an additional one-half percent local option sales tax; and (5) Support to
authorize the establishment of a commission to fund and/or operate a joint juvenile
detention facility for the Counties of Roanoke and Franklin, and the Cities of Roanoke and
Salem. Other items discussed included additional State Compensation Board funding for
the Sheriffs Office positions, recycling mandates, debris landfills and tire dumps.
There was a discussion on the potential impact of the elimination of local
personal property taxes. Supervisor Johnson requested that if Charter Schools are
approved, the General Assembly should ensure that the public schools receive the same
level of support as the charter schools. Delegate Cranwell offered to introduce the bill
authorizing the establishment of the joint juvenile detention facility commission. Senator
Trumbo agreed to introduce the bill on the Senate side.
Following discussion on these items, Chairman Johnson continued approval
of the legislative program to the Board Planning Session on January 10, 1998 so that the
resolution could be amended prior to adoption.

EXECUTIVE SESSION
At 10:20 a.m., Supervisor Johnson moved to go into Executive Session
pursuant to the Code of Virginia 2.1-344 A (5) discussion concerning a prospective

interest in locating in Roanoke County; 2.1-344 A (7) consultation with legal counsel
concerning probable litigation: Gallagher condemnation; 2-1-344 A (3) disposition of
publicly held real estate: Lloyd property; 2.1-344 A (7) consultation with legal counsel,
gainsharing agreement with Town of Vinton; and 2.1-344 A (7) probable litigation, BPOL
tax.

CERTIFICATION RESOLUTION

Supervisor Johnson moved to return to open session at 11 :00 a.m. and adopt
the Certification Resolution. The motion carried by the following recorded vote:

RESOLUTION 010598-2 CERTIFYING EXECUTIVE
MEETING WAS HELD IN CONFORMITY WITH THE CODE
OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has
convened an executive meeting on this date pursuant to an affirmative recorded vote and
in accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification
by the Board of Supervisors of Roanoke County, Virginia, that such executive meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge:

FIRST READING OF AN ORDINANCE
1.. First readinQ of ordinance aDDrovina a purchase agreement with
Virginia Polytechnic Institute & State University and the
Commonwealth of Virainia for 377 acres of real estate known as
the Catawba Farm and authorizina the purchase of the property
for economic development purposes. «Melinda Cox. Economic
Development Specialist)
Ms. Cox advised that this property is on the Virginia National Historic
Registry list and has the potential to offset most of the purchase price as an economic
development project. The County will make the payment for this property over a ten year
period. At closing, $100,0000 will be paid. The balance will be paid at one year
increments of $1 00,000 each with no interest charged. Staff recommends that the Board
adopt first reading of the ordinance approving the purchase agreement with Virginia
Polytechnic Institute & State University/Commonwealth of Virginia to acquire the property
with ten equal payments of $100,000 without interest for a total purchase price of $1
million.

DISCUSSION
There was a discussion on changes to the trash collection because of the
recent holidays and inclement weather. Staff was asked to review the procedures for
handling trash during holidays and snow schedules.

At 11 :30 a.m., Chairman Johnson adjourned the meeting to 9:00 a.m.
Saturday, January 10, 1998 at the Smith Mountain 4-H Center for the purpose of a Board
Retreat.
