Good afternoon and welcome to our meeting for June 23, 2026. Regular meetings are held on
the second and fourth Tuesday at 2:00 p.m. Public hearings are held at 6:00 p.m. on the fourth
Tuesday of each month. Deviations from this schedule will be announced. The meetings are
broadcast live on RVTV, Channel 3, and will be rebroadcast on Friday at 7:00 p.m. and on
Sunday from 10:00 a.m. until 5 p.m. Board of Supervisors meetings can also be viewed online

RESOLUTION RECOGNIZING DR. KEN NICELY FOR HIS DISTINGUISHED
SERVICE TO ROANOKE COUNTY PUBLIC SCHOOLS AND THE ROANOKE
COUNTY COMMUNITY

WHEREAS, Dr. Nicely provided thoughtful and steady leadership during periods
of significant challenge and change, always keeping the needs of students, families, and
the community at the forefront of his decisions; and
WHEREAS, his vision and dedication have brought state and national recognition
to Roanoke County Public Schools, while enhancing the reputation of Roanoke County
as a community committed to educational excellence; and
WHEREAS, the true measure of Dr. Nicely's legacy will not be found solely in the
programs he established or the buildings he improved, but in the countless students,
educators, and families whose lives have been enriched through his leadership and
service;
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board of
Supervisors hereby expresses its sincere appreciation and gratitude to Dr. Ken Nicely for
his unwavering commitment to public education and his many contributions to the
students, families, and citizens of Roanoke County.

RESOLUTION RECOGNIZING OR. KEN NICELY FOR HIS DISTINGUISHED SERVICE TO
ROANOKE COUNTY PUBLIC SCHOOLS AND THE ROANOKE COUNTY COMMUNITY
WHEREAS, Dr. Ken Nicely retired at the conclusion of the 2025-2026 school year, marking an
extraordinary 35-year career in education, including 33 years of dedicated service to
Roanoke County Public Schools; and
WHEREAS, Dr. Nicely's career reflects a remarkable journey of service and leadership, beginning
as a Spanish teacher at Cave Spring High School and culminating as superintendent
of one of Virginia's premier school divisions; and
WHEREAS, Dr. Nicely has worked to ensure that every student is prepared for success by
fostering a culture of innovation, academic excellence, and opportunity, while
advancing the vision of the Opportunity Ready Graduate; and
WHEREAS, he has remained committed to the belief that students learn best when they feel safe,
supported, and encouraged, strengthening student services, school safety, and
programs that help every child reach his or her full potential; and
WHEREAS, recognizing that exceptional schools are built by exceptional people, Dr. Nicely has
been a steadfast advocate for teachers and staff, promoting a culture of teamwork,
professional growth, and shared success; and
WHEREAS, under his leadership, Roanoke County Public Schools has strengthened not only its
educational programs but also its facilities and long-range planning, creating learning
environments that will benefit generations of students to come; and

Issue:
The Virginia Department of Transportation (VDOT) has requested that Roanoke County
adopt a resolution to support the design and limited access control changes for the
Interstate 81 (I-81) Widening Project from Exit 128 at Ironto to Exit 137 at Wildwood
Road.
Background:
In 2019, legislation was approved to fund I-81 improvements. In the Roanoke Valley, the
first segment of I-81 to be widened to six lanes with this funding is anticipated to be
complete in the next few months, between approximately Exit 137 (Wildwood Road) and
Exit 141 (Route 419/Electric Road). The second segment to be widened is located
between Exit 143 (Interstate 581) and Exit 150 (Troutville in Botetourt County). This
design-build project is currently under construction by Branch Civil Inc. with an
anticipated completion date of 2031. The third widening project is located between Exit
137 (Wildwood Road) and Exit 128 (Ironto).
Discussion:
As part of this project, VDOT has requested that Roanoke County, Montgomery County
and the City of Salem support proposed design and limited access changes to facilitate
construction. Limited access changes must be approved by the locality in which they
are proposed. Approximately seven miles of the project is located in Roanoke County.
VDOT held a Design Public Hearing on this project on November 6, 2025, at Glenvar
Elementary School.
Proposed right-of-way and limited access changes in Roanoke County are generally
minor with proposed property acquisition of portions of parcels. No homes or
businesses in Roanoke County will be acquired as part of this project.
The proposed design as shown at the Design Public Hearing includes one additional
lane in the northbound and southbound directions with widening occurring in the median
of the roadway. The ramps at Exit 132, Dow Hollow Road, will be improved and a
temporary traffic signal will be installed at the Dow Hollow Road and West Main Street
intersection to help manage detour traffic. Interstate road crossings in Roanoke County
include Dow Hollow Road, Glenvar Heights Boulevard, Fort Lewis Church Road,
Daugherty Road, Alleghany Drive, Butt Hollow Road and Texas Hollow Road. Several
interstate bridges over these roadways will be replaced as part of this project. New
stormwater management infrastructure is also included and locations are being
determined for potential sound walls.
The Commonwealth Transportation Board awarded Triton Construction, Inc. of Virginia
a design-build contract in April, 2026, to construct 3.2 miles between mile marker 133.8
and Exit 137 at Wildwood Road. Construction activities are anticipated to begin in
Spring 2027. The remaining project is broken into two phases between mile markers
131 and 133.8, and Exit 128 at Ironto and mile marker 131. Construction is anticipated
to begin on the two remaining phases between late 2027 and 2028.

WHEREAS, the design concept made available for the Public Hearing
represents the major design features along with limited access control changes; and
WHEREAS, VDOT has requested the Roanoke County Board of Supervisors
express its support of the limited access control changes made available at the Public
Hearing and refined in the Proposed Limited Access Adjustment Exhibits.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Board of Supervisors hereby supports the VDOT Project, I-81
CIP Exit 128 to Exit 137 Improvements, specifically the portion located
within Roanoke County, to include the major design features and the
proposed limited access control changes included in the Proposed
Limited Access Adjustment Exhibits.
2. That the Clerk to the Board forthwith send a certified copy of this
Resolution to VDOT.
3. That this resolution is effective immediately.

1.Administrative Shift: RVARC assumes primary responsibility for planning,
supporting, coordinating, and engaging the community regarding the greenway
system. These duties will be incorporated directly into RVARC’s annual Work Plan.
2.Committee Transition: The standalone Greenway Commission will cease to exist
as an independent board. It will be reconstituted as RVARC's Greenway
Committee, serving in an advisory role to assist RVARC with planning updates,
funding solicitations, and public-private partnerships.
3.Locality Ownership: Individual greenways will continue to be owned and
operated by the specific locality in which they are physically located.
4.Funding Structure: The participating localities will fund the RVARC greenway
budget using the same calculation model applied to the Roanoke Valley
Transportation Planning Organization (TPO).
The new contract explicitly replaces and repeals the 2016 agreement. While the original
commission operated under Section 15.2-1300, the new contract is an intergovernmental
agreement executed in accordance with the Regional Cooperation Act and is not intended
to be a joint exercise of powers.
Approval of the attached ordinance authorizes the first reading on June 23, 2026, with the
second reading and final adoption scheduled for July 14, 2026. The reorganization will
take effect on July 1, 2026.
Fiscal Impact:
There is no direct fiscal impact associated with the administrative reorganization or the
adoption of this ordinance. Long-term regional greenway planning costs will be
absorbed into the RVARC Work Plan as outlined in the underlying agreement.

ISSUE:
Approve resolution for VJCCCA grant participation.
BACKGROUND:
In 1995, the Virginia General Assembly passed the Virginia Juvenile Community Crime
Control Act (VJCCCA) to allow localities greater flexibility and autonomy to develop
programs to better meet the needs of at-risk youth in their communities. VJCCCA is
meant to be a community-based system of progressive sanctions and services that hold
youth accountable for their actions and decrease risky and criminal behavior in the
future.
The County of Roanoke has partnered for many years with the City of Salem to operate
the Juvenile Intervention Services Program, located in the Court Services Unit, to
provide direct services to youth and families. The VJCCCA grant funds four (4), full-
time positions for staff who provide intensive monitoring, supervision, and advocacy for
youth at risk.
DISCUSSION:
The Juvenile Intervention Services (JIS) Program serves youth ages 11-18, who are
involved in the juvenile justice system in Roanoke County and City of Salem. One of

the program’s primary objectives is to maintain youth safely in their home, school and
community by offering an alternative to detention. JIS operates two (2) programs to
achieve that goal, an Outreach Detention Program and a Home Electronic Monitoring
(GPS) Program. Staff engage with youth face-to-face multiple times a week to
determine their compliance, supervise their whereabouts and assess their needs in
multiple settings. The alternative detention programs have a high rate of successful
discharges, higher than the State average, and a recidivism rate lower than that
statewide.
For the upcoming grant cycle for fiscal year 2024-2025 and fiscal year 2025-2026, the
JIS Program will continue offering a relatively new program in response to changing
community needs. The new program focuses more resources on prevention services for
youth contacting the juvenile justice system for the first time. The new program
identifies youth at-risk and provides check-ins, monitoring, referrals and incentives to
help youth decrease risky behavior and isolation and increase pro social behavior and
practical skills. In addition, the JIS Program also provides other successful alternative
detention programs.
The City of Salem intends to continue its participation in the Juvenile Intervention
Services Program and will continue to dedicate their local and state VJCCCA funds to
the operation of the JIS Program. The grant requires the County to contribute $24,644
and the City of Salem to contribute $9,418 for fiscal year 2024-2025 and for fiscal year
2025-2026 as the local maintenance of effort.
The Department of Juvenile Justice requires that the attached resolution be adopted by
the County of Roanoke allowing participation in the grant program and recognizing that
the City of Salem’s grant monies will be used to support the Juvenile Intervention
Services Program.
FISCAL IMPACT:
The grant requires the County to contribute $24,644 for the upcoming two (2) fiscal
years as our maintenance of effort. Salem will contribute $9,418 each year. Those
local contributions will leverage $232,833 in State funds. There has been no increase in
the local maintenance of effort for several years. No appropriation is required as this
was included in the fiscal year 2025 approved budget and will be included in the fiscal
year 2026 budget.
STAFF RECOMMENDATION:
Staff recommends approval of the resolution to continue participation in the VJCCCA
grant for fiscal years 2024-2025 and 2025-2026.

PROJECT DESCRIPTION & BACKGROUND
This project involves the removal of proffered conditions from a commercial property in the
Glenvar Area. The property (TM#055.10-01-13.00-0000) was rezoned in June of 1987 from
B-1 Business to B-3 Business for the purpose of operating a used car dealership. As part of
the rezoning, six (6) proffered conditions offered by the property owner were accepted by
the Roanoke County Board of Supervisors. The proffered conditions are:
• Use of the property will be limited to the sale of used automobiles.
• No outside storage of inoperable vehicles or junk vehicles.
• Development will be in general accord with the submitted concept plan, 5-11-87,
including the landscaping.
• An additional point of access from Shawnee Drive will be constructed.
• No billboards will be constructed on the property.
• Only signage will be single letters on building frontage.
The property was developed in accordance with the proffered conditions and has been a
used car dealership for almost 40 years.
With only 4%-5% of Roanoke County being zoned for industrial or commercial
development, the removal of old and outdated proffered conditions is necessary to provide
for new development and redevelopment opportunities in the future. This strategy is
included in the Board of Supervisors Strategic Plan and the Roanoke County 200 Plan.
NEED & JUSTIFICATION QUESTIONS
Please explain how the request furthers the purposes of the Roanoke County Zoning
Ordinance as well as the purpose found at the beginning of the applicable zoning
district classification in the Zoning Ordinance.
The proposed request furthers the general purpose statement in the Roanoke County
Zoning Ordinance to “Encourage economic development activities that provide desirable
employment and enlarge the tax base. The proposed request also furthers the purpose of
the C-2 High Intensity Commercial district which is:
• “to provide locations for a variety of commercial and service related activities
within the urban service area serving a community of several neighborhoods or
large areas of the county.”
• “High intensity commercial districts are most appropriately found along major
arterial thoroughfares which serve large segments of the county's population.”
• “The C-2 district permits a wide variety of retail and service related uses.”

The Roanoke County 200 Plan includes the following Economic Development goal and
objectives:
Economic Development: Roanoke County recognizes that a strong economy
benefits from partnering with current and potential businesses, cultivating a skilled
workforce, and fostering connectivity to the world.
• Encourage the reuse, redevelopment and occupancy of existing, vacant
commercial and industrial space.
• Provide resources and support to help retain and expand existing businesses.
• Seek new business development and investment in the County.
The Glenvar Community Plan (2012), which is part of the Roanoke County 200 Plan, also
includes the following goals:
Provide a mix of environmentally-sensitive commercial and industrial uses at
appropriate locations in the Glenvar Community that meet the needs of current and
future residents.
Maintain a healthy, safe and sustainable community that ensures opportunities for a
multi-generational community to live, work, recreate and raise a family.
The Roanoke County 200 Plan also includes the following Land Use & Housing
recommendation:
• Remove outdated proffer conditions on certain properties to promote
redevelopment and expedite the development process.
Lastly, the future land use designation for this property in the Roanoke County Plan 200 is
Core. Core is a future land use area where high intensity urban commercial and high-
density residential developments are encouraged. Land uses within core areas may
parallel the central business districts in Roanoke, Salem and Vinton. Core areas may also
be appropriate for larger-scale highway-oriented retail uses and regionally based shopping
facilities. Appropriate land use types include general retail shops, restaurants, personal
services, offices, institutional uses, limited industrial uses, multi-family residential, and
mixed-use. The proposed rezoning to remove the proffered conditions from the property is
consistent with the Core future land use designation.
Please describe the impact(s) of the request on the property itself, the adjoining
properties, and the surrounding area, as well as the impacts on public services and
facilities, including water/sewer, roads, schools, parks/recreation and fire and rescue.

The request to remove the proffered conditions from the property at 3306 West Main Street
will have minimal impact on the property and surrounding properties. The property is
zoned C-2 High Intensity Commercial and is currently used for used automobile sales.
Removal of the proffered conditions would allow for future by-right commercial uses in C-2
which would be compatible with surrounding uses. Surrounding uses include industrial
uses and vacant industrial zoned property to the south of the property, commercial and
industrial uses to the west, vacant commercial zoned properties to the north across West
Main Street, and commercial use to the east across Shawnee Drive. West Main Street
contains a variety of commercial, industrial, and civic uses adjacent to it in the Glenvar
area.
The removal of the proffered conditions on this existing commercially developed site will
have no or minimal impact on public services (schools, parks and recreation, police and
fire and rescue). The property is currently adequately served by public water and public
sewer. The property is located at the corner of West Main Street (a four-lane divided
highway) and Shawnee Drive with one entrance on West Main Street and one entrance on
Shawnee Drive. Right- and left-turn lanes to turn onto Shawnee Drive exist on West Main
Street. Any new uses or redevelopment of the property would be adequately served by the
existing roadway infrastructure and VDOT would review entrance permits for any new uses
or redevelopment of the site.

SECOND ANTENNA SITE USE AGREEMENT AND GROUND LEASE
This Second Antenna Site Use Agreement and Ground Lease (“Agreement”) for County
property located at 8449 Honeysuckle Road, Tax Map No. 093.00-01-44.02-0000, is entered into
this ______ day of July, 2026, between the Board of Supervisors of Roanoke County, Virginia
(“the County”) and the New River Valley 911 Authority (“the Authority”). This Agreement is
entered into in the spirit of regional cooperation with regard to public safety matters.
For good and valuable consideration, the parties hereto agree as follows:
1.Premises. The County is the owner of two (2) telecommunications towers (the
“Towers”) and two (2) equipment shelters (“the Shelters”) located on a parcel of land as
described on Exhibit A attached hereto (the Towers, the Shelters, and the land are collectively
the “Property”). The Authority desires to use space within one (1) shelter and space upon the
Towers (collectively, the “Premises”) in such amounts and in such locations as described on
Exhibit B, subject to the terms and conditions of this Agreement.
2.Use. The Premises shall be used by the Authority solely for the transmission and
reception of radio communication signals on various frequencies and for the installation,
maintenance, and operation of necessary facilities, including, but not limited to, transceivers and
antennas. The County agrees to cooperate with the Authority in obtaining (at the Authority’s
expense) any licenses, permits, and other approvals required for the Authority’s use of the
Premises.
3.Term. The term of this Agreement shall be for a period of five (5) years (“Initial
Term”), said term to commence on August 1, 2026, and continue until July 31, 2031. This
Agreement shall be automatically renewed for one (1) additional successive five (5) year term
(“Renewal Term”), commencing August 1, 2031, and continuing until July 31, 2036, upon the
same terms and conditions contained herein (unless otherwise provided), unless either the
County or the Authority sends written notice of non-renewal to the other on or before April 30,
2031, such notice to be provided in accordance with Paragraph 13 of this Agreement.
4.Reimbursement.
(a) The Authority shall pay to the County One Hundred Sixty-Two Dollars ($162.00) per
month as reimbursement for utilities and maintenance costs associated with upkeep of the
Premises and equipment for the first year of the Initial Term. The reimbursement amount shall

increase five percent (5%) each year of the Initial Term. This Reimbursement shall be payable on
the first day of each month in advance at the address set forth in Paragraph 13 or, at the option of
the Authority, as a lump sum due on August 1 of each year of this Agreement.
Interference.
Improvements; Liability; Utilities; Access.

installation is inconsistent with industry standards and best practices. Title to the Authority’s
Facilities shall be in the Authority. The Authority has the right to remove all of the Authority’s
Facilities at its sole expense on or before the expiration or earlier termination of the term,
provided the Authority repairs any damage to the Premises caused by such removal.
Termination. This Agreement may be terminated without further liability on (30)
days prior notice as follows: (a) by either party upon a default of any covenant or term hereof by
the other party, which default is not cured with sixty (60) days of receipt of written notice of
default, provided that the grace period for any monetary default is ten (10) days from receipt of
notice; (b) by the Authority if it does not obtain or maintain any license, permit or other approval
necessary to the installation and operation of the Authority’s Facilities; (c) by the Authority if the
Authority determines that the Premises are not appropriate for its operations for economic or
technological reasons, including signal interference; or (d) the County may terminate this
Agreement for cause if the County determines that the Authority’s actions pose a risk in
violation of any federal or state law, regulation, or ordinance applicable to public health, safety
or welfare and issues written notice, or if the Authority’s actions result in the issuance of a legal
violation of any public health, safety or welfare law, regulation, or ordinance and the Authority is
unable to cure the conditions which resulted in such violation, then the County may immediately
terminate this Agreement by written notice to the Authority.
Taxes. If personal property taxes are assessed, the Authority shall pay any portion
directly attributable to the Authority’s Facilities.
Insurance.

(b) Neither party shall be liable to the other (or to the other’s successors or assigns) for
any loss or damage caused by fire or any of the risks enumerated in a standard fire insurance
policy with an extended coverage endorsement.
10.Destruction of Premises. If the Premises or Facilities are destroyed or damaged,
Authority may elect to terminate this Agreement as of the date of the damage or destruction by
notice given to the County no more than forty-five (45) days following the date of any such
damage or destruction. In such event, all rights and obligations of the parties shall cease as of the
date of the damage or destruction.
11.Condemnation.
(a) If a condemning authority takes all of the Property, or a portion sufficient to render
the Premises unsuitable for the Authority’s use, this Agreement shall terminate as of the date title
vests in the condemning authority. Sale of all or part of the Property to a purchaser with the
power of eminent domain in the face of the exercise of power shall be deemed a taking by
condemnation.
(b) The Authority may claim and recover from the condemning authority an award for
the Authority’s moving expenses, business dislocation damages, the Authority’s personal
property and fixtures, and the unamortized costs of any improvements paid for by the Authority.
12.Hold Harmless. The Authority agrees to hold the County harmless from any and all
claims arising from the installation, use, maintenance, repair or removal of the Authority’s
Facilities, except for claims arising from the negligence of the County, its employees, agents, or
independent contractors. This paragraph shall not be deemed a waiver of any sovereign
immunity or other immunity which either party to this Agreement may be entitled to claim.
13.Notices. All notices, requests, demands and other communications hereunder shall
be in writing and shall be deemed given if personally delivered or by an overnight courier
providing proof of service, or mailed, certified mail, return receipt requested, to the following

14.Title and Quiet Enjoyment. The County warrants that it has full right, power and
authority to execute this Agreement and has good and marketable title to the Property. The
County further warrants that the Authority shall, provided the Authority is not in material default
of this Agreement, have quiet enjoyment of the Premises.
15.Assignment. Either party may, upon notice to and consent of the other party, assign
or transfer its rights and obligations arising under this Agreement to any of its governmental
entities or affiliates, or to a successor by consolidation or merger. In all other instances, either
party may assign or transfer its rights and obligations only upon written consent of the other
party, which consent shall not be withheld or delayed unreasonably.
16.Successors and Assigns. The Authority shall have the right to submit this
Agreement for recordation to the appropriate governmental agency having jurisdiction over the
Property. This Agreement shall be binding upon and insure to the benefit of the parties, their
respective successors, and assigns.
17.Tower Marking and Lighting Requirements. The County acknowledges that it,
and not the Authority, shall be responsible for compliance with all tower or building marking and
lighting requirements of the Federal Aviation Administration (“FAA”) or the Federal
Communications Commission (“FCC”). Should the Authority be cited by either the FCC or
FAA because this site is not in compliance, and should the County fail to cure the conditions of
noncompliance within the time frame allowed by the citing agency, the Authority may either
terminate this Agreement immediately on notice to the County or proceed to cure the conditions
of noncompliance at the County’s expense.
18.Miscellaneous.
(a) This Agreement constitutes the entire agreement and understanding between the
parties and supersedes all offers, negotiations and other agreements. There are no representations
or understanding of any kind not set forth herein. Any amendments to this Agreement must be in
writing and executed by both parties.
(b) If any provision of this Agreement is invalid or unenforceable with respect to any
party, the remainder of this Agreement or the application of such provision to persons other than
those as to whom it is held invalid or unenforceable shall not be affected, and each provision of
this Agreement shall be valid and enforceable to the fullest extent permitted by law.
19.Governing Law. This Agreement shall be governed by the laws of the
Commonwealth of Virginia. Venue for any disputes shall be the Circuit Court of Roanoke
County, Virginia.

is in Roanoke County’s best interests to enter into a Second Antenna Site Use
Agreement and Ground Lease with the New River Valley 911 Authority for use of
property located at 8449 Honeysuckle Road.
2. The Second Antenna Site Use Agreement and Ground Lease with the
New River Valley 911 Authority for use of property located at 8449 Honeysuckle Road is
hereby approved with such completions, omissions, insertions, and changes as the
County Administrator or his designee may approve, whose approval shall be evidenced
conclusively by the execution and delivery thereof, all of which shall be approved as to
form by the County Attorney
3. The County Administrator or his designee is hereby authorized and
directed to execute such documents and take such actions on behalf of the Board of
Supervisors of Roanoke County, Virginia in this matter as are necessary to accomplish
this ordinance, including the Second Antenna Site Use Agreement and Ground Lease,
which shall be approved as to form by the County Attorney.

PROJECT DESCRIPTION & BACKGROUND
This project involves the removal of proffered conditions from a commercial property along
Route 220 (Franklin Road), south of Yellow Mountain Road, but north of Back Creek Road.
The property (TM#098.04-02-20.00-0000) was rezoned in September of 2004 from AVC,
Agricultural/Village Center District with conditions, to C-2C High Intensity Commercial
District with conditions, for limited retail sales. As part of the rezoning, three (3) proffered
conditions offered by the property owner were accepted by the Roanoke County Board of
Supervisors. The proffered conditions are:
• Use of the property will be restricted to the sale and storage of the following:
Oriental/Persian rugs, area rugs and flooring materials and antiques.
• Signage shall be limited to a maximum of 140 square feet.
• No off-premises signage shall be installed.
With only 4%-5% of Roanoke County being zoned for industrial or commercial
development, the removal of old and outdated proffered conditions is necessary to provide
for new development and redevelopment opportunities in the future. This strategy is
included in the Board of Supervisors Strategic Plan and the Roanoke County 200 Plan.
NEED & JUSTIFICATION QUESTIONS
Please explain how the request furthers the purposes of the Roanoke County Zoning
Ordinance as well as the purpose found at the beginning of the applicable zoning
district classification in the Zoning Ordinance.
The proposed request furthers the general purpose statement in the Roanoke County
Zoning Ordinance to “Encourage economic development activities that provide desirable
employment and enlarge the tax base. The proposed request also furthers the purpose of
the C-2 High Intensity Commercial district which is:
• “to provide locations for a variety of commercial and service related activities
within the urban service area serving a community of several neighborhoods or
large areas of the county.”
• “High intensity commercial districts are most appropriately found along major
arterial thoroughfares which serve large segments of the county's population.”
• “The C-2 district permits a wide variety of retail and service related uses.”
Please explain how the project conforms to the general guidelines and policies
contained in the Roanoke County Comprehensive Plan.
The proposed project complies with the following items in the County’s Comprehensive
Plan:

The Roanoke County 200 Plan includes the following Economic Development goal and
objectives:
Economic Development: Roanoke County recognizes that a strong economy
benefits from partnering with current and potential businesses, cultivating a skilled
workforce, and fostering connectivity to the world.
• Encourage the reuse, redevelopment and occupancy of existing, vacant
commercial and industrial space.
• Provide resources and support to help retain and expand existing businesses.
• Seek new business development and investment in the County.
The Roanoke County 200 Plan also includes the following Land Use & Housing
recommendation:
• Remove outdated proffer conditions on certain properties to promote
redevelopment and expedite the development process.
Lastly, the future land use designation for this property in the Roanoke County Plan 200 is
Core. Core is a future land use area where high intensity urban commercial and high-
density residential developments are encouraged. Land uses within core areas may
parallel the central business districts in Roanoke, Salem and Vinton. Core areas may also
be appropriate for larger-scale highway-oriented retail uses and regionally based shopping
facilities. Appropriate land use types include general retail shops, restaurants, personal
services, offices, institutional uses, limited industrial uses, multi-family residential, and
mixed-use. The removal of the proffered conditions is consistent with the Core future land
use designation.
Please describe the impact(s) of the request on the property itself, the adjoining
properties, and the surrounding area, as well as the impacts on public services and
facilities, including water/sewer, roads, schools, parks/recreation and fire and rescue.
The request to remove the proffered conditions from the property at 5999 Franklin Road will
have minimal impact on the property and surrounding properties. The property is zoned C-
2C High Intensity Commercial with conditions and is currently used for limited retail sales.
Removal of the proffered conditions would allow for future by-right commercial uses in C-

locating on the site. Cahas Valley Properties, LLC owns several vacant properties adjacent
to the proposed rezoning on the north, south, and west sides. A residence and a church are
located to the east across Route 220, a four-lane divided highway. Any impacts to these
properties would be minimal.
The removal of the proffered conditions on this existing commercially developed site will
have no or minimal impact on public services (schools, parks and recreation, police and
fire and rescue). The property is currently adequately served by public water and private
sewer. The property is located along Route 220 (a four-lane divided highway) with a median

break along Route 220 to provide access to the site for northbound traffic. Any new uses or
redevelopment of the property would be adequately served by the existing roadway
infrastructure and VDOT would review entrance permits for any new uses or redevelopment
of the site.

POTENTIAL OF NEED FOR TRAFFIC ANALYSIS AND/OR TRAFFIC IMPACT STUDY
The following is a list of potentially high traffic-generating land uses and road network situations
that could elicit a more detailed analysis of the existing and proposed traffic pertinent to your
rezoning, subdivision waiver, public street waiver, or special use permit request. If your request
involves one of the items on the ensuing list, we recommend that you meet with a County planner,
the County traffic engineer, and/or Virginia Department of Transportation staff to discuss the
potential additional traffic related information that may need to be submitted with the application
in order to expedite your application process.
(Note this list is not inclusive and the County staff and VDOT reserve the right to request a traffic
study at any time, as deemed necessary.)
High Traffic-Generating Land Uses:
Single-family residential subdivisions, Multi-family residential units, or Apartments with more
than 75 dwelling units
Restaurant (with or without drive-through windows)
Gas station/Convenience store/Car wash
Retail shop/Shopping center
Offices (including: financial institutions, general, medical, etc.)

Road Network Situations:
Development adjacent to/with access onto/within 500-ft of intersection of a roadway
classified as an arterial road (e.g., Rte 11, 24, 115, 117, 460, 11/460, 220, 221, 419, etc)
For new phases or changes to a development where a previously submitted traffic study is
more than two (2) years old and/or roadway conditions have changed significantly
When required to evaluate access issues
Development with ingress/egress on roads planned or scheduled for expansion, widening,
improvements, etc. (i.e. on Long Range Transportation Plan, Six-Yr Road Plan, etc.)
Development in an area where there is a known existing traffic and/or safety problem
Development would potentially negatively impact existing/planned traffic signal(s)
Substantial departure from the Community Plan
Any site that is expected to generate over one hundred (100) trips during the peak hour of
the traffic generator or the peak hour on the adjacent streets, or over seven hundred fifty
(750) trips in an average day

RESOLUTION CERTIFYING THE CLOSED MEETING WAS HELD IN
CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each member’s knowledge:
