RESOLUTION 062326-1 RECOGNIZING DR. KEN NICELY FOR HIS
DISTINGUISHED SERVICE TO ROANOKE COUNTY PUBLIC SCHOOLS AND
THE ROANOKE COUNTY COMMUNITY
WHEREAS, Dr. Ken Nicely retired at the conclusion of the 2025-2026 school year,
marking an extraordinary 35-year career in education, including 33 years of dedicated
service to Roanoke County Public Schools; and
WHEREAS, Dr. Nicely's career reflects a remarkable journey of service and
leadership, beginning as a Spanish teacher at Cave Spring High School and culminating
as superintendent of one of Virginia's premier school divisions; and
WHEREAS, Dr. Nicely has worked to ensure that every student is prepared for
success by fostering a culture of innovation, academic excellence, and opportunity, while
advancing the vision of the Opportunity Ready Graduate; and
WHEREAS, he has remained committed to the belief that students learn best when
they feel safe, supported, and encouraged, strengthening student services, school safety,
and programs that help every child reach his or her full potential; and
WHEREAS, recognizing that exceptional schools are built by exceptional people,
Dr. Nicely has been a steadfast advocate for teachers and staff, promoting a culture of
teamwork, professional growth, and shared success; and
WHEREAS, under his leadership, Roanoke County Public Schools has
strengthened not only its educational programs but also its facilities and long-range
planning, creating learning environments that will benefit generations of students to come;
and

WHEREAS, Dr. Nicely provided thoughtful and steady leadership during periods
of significant challenge and change, always keeping the needs of students, families, and
the community at the forefront of his decisions; and
WHEREAS, his vision and dedication have brought state and national recognition
to Roanoke County Public Schools, while enhancing the reputation of Roanoke County
as a community committed to educational excellence; and
WHEREAS, the true measure of Dr. Nicely's legacy will not be found solely in the
programs he established or the buildings he improved, but in the countless students,
educators, and families whose lives have been enriched through his leadership and
service;
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board of
Supervisors hereby expresses its sincere appreciation and gratitude to Dr. Ken Nicely for
his unwavering commitment to public education and his many contributions to the
students, families, and citizens of Roanoke County.
BE IT FURTHER RESOLVED that the Board of Supervisors congratulates Dr.
Nicely on his well-earned retirement and extends its best wishes to him and his family for
continued happiness, health, and success in the years ahead.

Resolution supporting SMART SCALE applications by Roanoke County, the Roanoke
Valley Transportation Planning Organization and the Roanoke Valley-Alleghany Regional

Issue:
A resolution of support from the Board of Supervisors is required as part of the SMART
SCALE application process for transportation project funding.
Background:
The SMART SCALE program provides methods and procedures for scoring and funding
transportation projects in the Commonwealth of Virginia. According to the SMART
SCALE Technical Guide, "The purpose of SMART SCALE is to fund the right
transportation projects through a prioritization process that evaluates each project's
,merits using key factors including: improvements to safety, congestion reduction,
accessibility, land use, economic development and the environment. The evaluation
focuses on the degree to which a project addresses a problem or need relative to the
requested funding for the project."
The deadline for submitting SMART SCALE project applications is August 3, 2026.
Attached is a PowerPoint presentation with details for proposed SMART SCALE
projects included in the resolution of support.
Discussion:
SMART SCALE applications require a resolution of support from the governing body.
The proposed resolution of support includes not only projects to be submitted by
Roanoke County, but also includes projects to be submitted by the Roanoke Valley
Transportation Planning Organization (RVTPO) and a project in Botetourt County on
Route 11 at Shadwell Drive near the Roanoke County line that will be submitted by the
Roanoke Valley-Alleghany Regional Commission (RVARC).

Fiscal Impact:
The SMART SCALE program provides 100 percent funding for selected applications so
no fiscal impact is anticipated.
Staff Recommendation:
Staff recommends that the Board of Supervisors adopt a resolution of support for
SMART SCALE applications to be submitted by Roanoke County, the RVTPO and the
RVARC for Botetourt County.

WHEREAS, at a regular meeting on June 23, 2026, the Board of Supervisors
reviewed proposed SMART SCALE project applications; and
WHEREAS, the list of projects includes applications to be submitted by Roanoke
County, the Roanoke Valley Transportation Planning Organization and the Roanoke
Valley-Alleghany Regional Commission; and
WHEREAS, the Board of Supervisors desires to support both local and regional
projects to mitigate congestion, promote economic development, increase accessibility,
safety, and environmental quality, as well as develop projects consistent with local land
use policies.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board of Supervisors hereby supports the following SMART
SCALE projects for Roanoke County application:
a. Plantation Road Transit Access and Pedestrian Safety
Improvements (Hershberger Road to Hollins Road)

Resolution supporting the design and limited access control changes for the Interstate 81
Widening Project from Exit 128 to Exit 137, Catawba Magisterial District. (Megan Cronise,

Issue:
The Virginia Department of Transportation (VDOT) has requested that Roanoke County
adopt a resolution to support the design and limited access control changes for the
Interstate 81 (1-81) Widening Project from Exit 128 at Ironto to Exit 137 at Wildwood
Road.
Background:
In 2019, legislation was approved to fund 1-81 improvements. In the Roanoke Valley, the
first segment of 1-81 to be widened to six lanes with this funding is anticipated to be
complete in the next few months, between approximately Exit 137 (Wildwood Road) and
Exit 141 (Route 419/Electric Road). The second segment to be widened is located
between Exit 143 (Interstate 581) and Exit 150 (Troutville in Botetourt County). This
design-build project is currently under construction by Branch Civil Inc. with an
anticipated completion date of 2031. The third widening project is located between Exit
137 (Wildwood Road) and Exit 128 (Ironto).
Discussion:
As part of this project, VDOT has requested that Roanoke County, Montgomery County
and the City of Salem support proposed design and limited access changes to facilitate
construction. Limited access changes must be approved by the locality in which they
are proposed. Approximately seven miles of the project is located in Roanoke County.
VDOT held a Design Public Hearing on this project on November 6, 2025, at Glenvar
Elementary School.
Proposed right-of-way and limited access changes in Roanoke County are generally
minor with proposed property acquisition of portions of parcels. No homes or
• businesses in Roanoke County will be acquired as part of this project.
The proposed design as shown at the Design Public Hearing includes one additional

lane in the northbound and southbound directions with widening occurring in the median
of the roadway. The ramps at Exit 132, Dow Hollow Road, will be improved and a
temporary traffic signal will be installed at the Dow Hollow Road and West Main Street
intersection to help manage detour traffic. Interstate road crossings in Roanoke County
include Dow Hollow Road, Glenvar Heights Boulevard, Fort Lewis Church Road,
Daugherty Road, Alleghany Drive, Butt Hollow Road and.Texas Hollow Road. Several
interstate bridges over these roadways will be replaced as part of this project. New
stormwater management infrastructure is also included and locations are being
determined for potential sound walls.
The Commonwealth Transportation Board awarded Triton Construction, Inc. of Virginia
a design-build contract in April, 2026, to construct 3.2 miles between mile marker 133.8
and Exit 137 at Wildwood Road. Construction activities are anticipated to begin in
Spring 2027. The remaining project is broken into two phases between mile markers
131 and 133.8, and Exit 128 at Ironto and mile marker 131. Construction is anticipated
to begin on the two remaining phases between late 2027 and 2028.

RESOLUTION 062326-3 SUPPORTING THE DESIGN AND LIMITED
ACCESS CONTROL CHANGES FOR THE INTERSTATE 81
WIDENING PROJECT FROM EXIT 128 TO EXIT 137, CATAWBA
MAGISTERIAL DISTRICT
WHEREAS, the Interstate 81 (1-81) Widening Project, as depicted on the plans
for project 0081-080-861, P101, R201, C501 (UPC 116197), project 0081-060-902,
P101, R201, C501 (UPC 127445), and project 0081-080-988, P101, R201, C501 (UPC
127443) in Roanoke County, Montgomery County and the City of Salem is classified
as a "limited access highway" by the Virginia Department of Transportation (VDOT);
and
WHEREAS, in accordance with 24 VAC 30-401-20 limited access control
change procedures, it is necessary that a request by resolution or letter of support be
received from the locality within which the highway is located where the change in
limited access is proposed; and
WHEREAS, the limited access control lines along 1-81 Northbound and
Southbound from approximately Exit 128 to Exit 137 will be modified as depicted in the
Proposed Limited Access Adjustment Exhibits for project 0081-080-861, P101, R201,
C501 (UPC 116197), project 0081-060-902, P101, R201, C501 (UPC 127445), and
project 0081-080-988, P101, R201, C501 (UPC 127443); and
WHEREAS, the limited access control changes are necessary for the widening,
safety improvements, and maintenance of the interstate; and
WHEREAS, a Design Public Hearing was held on November 6, 2025, and the

comment period expired on November 16, 2025; and
WHEREAS, the design concept made available for the Public Hearing
represents the major design features along with limited access control changes; and
WHEREAS, VDOT has requested the Roanoke County Board of Supervisors
express its support of the limited access control changes made available at the Public
Hearing and refined in the Proposed Limited Access Adjustment Exhibits.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the Board of Supervisors hereby supports the VDOT Project, 1-81
CIP Exit 128 to Exit 137 Improvements, specifically the portion located
within Roanoke County, to include the major design features and the
proposed limited access control changes included in the Proposed
Limited Access Adjustment Exhibits.
2. That the Clerk to the Board forthwith send a certified copy of this
Resolution to VDOT.
3. That this resolution is effective immediately.

Issue:
Conduct the first reading to approve the Second Amended and Restated
Intergovernmental Agreement Regarding the Roanoke Valley Greenway.
Background:
The regional greenway partnership began in 1997 when the Cities of Roanoke and
Salem, the Town of Vinton, and Roanoke County entered into an Intergovernmental
Agreement to establish the Roanoke Valley Greenway Commission. This agreement was
revised in 2008 and further expanded on July 1, 2016, when Botetourt County joined as
a participating locality.
The 2016 agreement established the Greenway Commission as an independent,
regional, intergovernmental board operating as a joint exercise of powers pursuant to
Section 15.2-1300 of the Code of Virginia.
To increase administrative efficiency and cost-effectiveness, the participating localities
now desire to reorganize this structure. The proposed plan dissolves the independent
Commission and transitions its operations under the administrative umbrella of the
Roanoke Valley-Alleghany Regional Commission (RVARC), which is a political
subdivision created under the Regional Cooperation Act (Chapter 42 of Title 15.2 of the
Code of Virginia).
Discussion:
The Second Amended and Restated Intergovernmental Agreement Regarding the
Roanoke Valley Greenway, dated July 1, 2026, officially implements this structural
reorganization.
Under the terms of the new agreement:

1. Administrative Shift: RVARC assumes primary responsibility for planning,
supporting, coordinating, and engaging the community regarding the greenway
system.These duties will be incorporated directly into RVARC's annual Work Plan.
2. Committee Transition: The standalone Greenway Commission will cease to exist
as an independent board. It will be reconstituted as RVARC's Greenway
Committee, serving in an advisory role to assist RVARC with planning updates,
funding solicitations, and public-private partnerships.
3. Locality Ownership: Individual greenways will continue to be owned and
operated by the specific locality in which they are physically located.
4. Funding Structure: The participating localities will fund the RVARC greenway
budget using the same calculation model applied to the Roanoke Valley
Transportation Planning Organization (TPO).
The new contract explicitly replaces and repeals the 2016 agreement. While the original
commission operated under Section 15.2-1300, the new contract is an intergovernmental
agreement executed in accordance with the Regional Cooperation Act and is not intended
to be a joint exercise of powers.
Approval of the attached ordinance authorizes the first reading on June 23, 2026, with the
second reading and final adoption scheduled for July 14, 2026. The reorganization will
take effect on July 1, 2026.
Fiscal Impact:
There is no direct fiscal impact associated with the administrative reorganization or the
adoption of this ordinance. Long-term regional greenway planning costs will be
absorbed into the RVARC Work Plan as outlined in the underlying agreement.
Staff Recommendation:
Staff recommends approval of the first reading of the ordinance and setting the second
reading for July 14, 2026.

ORDINANCE APPROVING THE SECOND AMENDED AND RESTATED
INTERGOVERNMENTAL AGREEMENT REGARDING THE ROANOKE
VALLEY GREENWAY
WHEREAS, the Cities of Roanoke and Salem, the Counties of Roanoke and
Botetourt, and the Town of Vinton (the "Participating Localities") adopted that certain
Amended and Restated Intergovernmental Agreement Establishing the Roanoke Valley
Greenway Commission as of July 1, 2016 (the "Intergovernmental Agreement"); and
WHEREAS, the Participating Localities desire to reorganize the standalone
Greenway Commission into a committee operating under the administrative umbrella of
Roanoke Valley-Alleghany Regional Commission ("RVARC") and integrate greenway
planning directly into the RVARC's Work Plan; and
WHEREAS, RVARC is a political subdivision of the Commonwealth created
pursuant to the provisions of the Regional Cooperation Act, Chapter 42 of Title 15.2 of
the Code of Virginia to improve public services through regional cooperation and
coordination; and
WHEREAS, to accomplish this reorganization, the Participating Localities and
RVARC have prepared the Second Amended and Restated Intergovernmental
Agreement Regarding the Roanoke Valley Greenway, dated July 1, 2026; and
WHEREAS, this agreement is authorized pursuant to the provisions of Virginia's
Regional Cooperation Act (§15.2-4200 et. seq. of the Code of Virginia); and
WHEREAS, the first reading of this ordinance was held on June 23, 2026, and the
second reading was held on July 14, 2026.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Second Amended and Restated Intergovernmental Agreement
Regarding the Roanoke Valley Greenway is hereby approved.
2. The Board authorizes the County Administrator, Deputy County
Administrator, or Assistant County Administrator, any of whom may act, to
execute the agreement in such form as is approved by the County Attorney.
3. This ordinance shall take effect immediately upon its adoption.

Discussion:
To move forward with the regional reorganization, the Board must formally dissolve the
independent Commission via this repealing ordinance. This action is a companion
measure to a separate ordinance on the same agenda, which authorizes the Second
Amended and Restated Intergovernmental Agreement transitioning greenway
operations to RVARC.

Approval of the attached ordinance authorizes the first reading on June 23, 2026. The
second reading will be set for July 14, 2026, with the formal repeal taking effect on July
15, 2026.
Fiscal Impact:
There is no direct fiscal impact associated with the administrative reorganization or the

ORDINANCE REPEALING THE AMENDED AND RESTATED
INTERGOVERNMENTAL AGREEMENT ESTABLISHING THE
ROANOKE VALLEY GREENWAY COMMISSION
WHEREAS, the Cities of Roanoke and Salem, the Counties of Roanoke and
Botetourt, and the Town of Vinton (the "Participating Localities") adopted that certain
Amended and Restated Intergovernmental Agreement Establishing the Roanoke Valley
Greenway Commission as of July 1, 2016 (the "Intergovernmental Agreement") which
was adopted by uncodified ordinance as a joint exercise of powers pursuant to Section
15.2-1300 of the Code of Virginia of 1950, as amended; and
WHEREAS, the Participating Localities wish to restructure the arrangements set
forth in the Intergovernmental Agreement and enter into a new Agreement by separate
action, which is not subject to Section 15.2-1300 of the Code; and
WHEREAS, the Intergovernmental Agreement must be repealed by ordinance;
and
WHEREAS, the first reading of this ordinance was held on June 23, 2026, and the
second reading was held on July 14, 2026.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Intergovernmental Agreement is hereby repealed.
2. That this Ordinance shall take effect on July 15, 2026.

associated with NG911.
Background:
Since 2018 the Virginia 9-1-1 Services Board has been focused on the state-wide
implementation of NG9-1-1 in all 124 Public Safety Answering Points (PSAPs) across
the state. All funding efforts have been dialed into those directly affecting this
implementation. The 9-1-1 Services Board has refocused their grant funding program to
cover immediate operational gaps.
Discussion:
The original grant funds were for the amount of 340,857.02. The Virginia 9-1-1 Services
Board was able to increase the award by $34,446.46 this year.
Fiscal Impact:
Grant funds totaling $34,446.46 will provide one hundred percent (100%) funding. No
County funds are required.
Staff Recommendation:
Staff recommends the acceptance and allocation of additional grant funds in the amount
of$34,446.46 for eligible costs associated with NG911.

Issue:
Accept and allocate an additional $25,000 from the Department of Juvenile Justice for
the FY2026 Virginia Community Crime Control (VJCCCA) grant budget for the purpose

Background:
On July 9, 2024, the Board of Supervisors approved a resolution supporting
participation in the VJCCCA grant program for the 2024-2025 and 2025-2026 fiscal
years. The board report and approved resolution are attached.
Discussion:
The VJCCCA grant program funds four full-time Roanoke County positions. Due to
rising personnel costs, staff is projecting expenditures to exceed budget for FY2026. In
January 2026, staff applied for$60,000 of additional state funds from the Department of
Juvenile Justice.
In March 2026, the state awarded additional VJCCCA funds to the County in the amount
of$35,000 for the purpose of detention alternative programs. This was accepted and
allocated at the March 24, 2026, Board meeting.
On May 27, 2026, the state made an additional award of$25,000 for the purpose of
detention alternative programs.
The funds will need to be expended by the end of the fiscal year on June 30, 2026, and
reported in FY2026 state reporting.
Fiscal Impact:
The additional $25,000 grant award requires no additional local match.

Issue:
The current Antenna Site Use Agreement and Ground Sub-Lease between Roanoke
County and the New River Valley 911 Authority for use of property located at 8449
Honeysuckle Road terminates on July 31, 2026.
Background:
The Board of Supervisors of Roanoke County, Virginia owns property located at 8449
Honeysuckle Road. Roanoke County owns two telecommunications towers and
equipment shelters on the property.
Since at least August 1, 2020, the New River Valley 911 Authority has leased space
within the shelter and space upon each of the two towers pursuant to an Antenna Site
Use Agreement and Ground Sub-Lease between the two entities (the "agreement"). The
agreement is for the purpose of transmission and reception of radio communication
signals on various frequencies and for the installation, maintenance, and operation of
necessary facilities, including, but not limited to, transceivers and antennas.
Under the current agreement, the New River Valley 911 Authority was to pay $150.00
per month beginning on August 1, 2020. Based upon information gathered from
Roanoke County staff, the rate has not been increased since the initial term began on
August 1, 2020. The current agreement terminates on July 31, 2026.
Discussion:
Roanoke County staff recommend execution of a new agreement with the New River
Valley 911 Authority for continued lease of the property. Staff recommends no changes
to the terms of the agreement, with one exception. Staff recommends the rental amount
be increased by 8% for a new monthly amount of$162.00. Staff recommends a five
year term with a 5% increase in rental each year of the initial term, with one additional
five year renewal with up to 10% increase in rental each year of the renewal term.

Roanoke County will receive income from the New River Valley 911 Authority in the
amounts indicated above.
Staff Recommendation:
