WHEREAS,the Board of Supervisors of Roanoke County, Virginia has convened a
closed meeting on this date pursuant to an affirmative recorded vote and in accordance
with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the
Board of Supervisors of Roanoke County, Virginia, that such closed meeting was
conducted in conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke
County, Virginia, hereby certifies that, to the best of each member's knowledge:

Ordinance approving a Partial Lease Termination Agreement formally removing Gearhart
Park and the Charles R. Hill Community Center from a 1982 lease with the Town of Vinton

Issue:
The 1982 lease must be amended to formally terminate Roanoke County's control over
Gearhart Park and the Charles R. Hill Community Center, returning full operational
authority to the Town of.Vinton.
Background:
Under a Memorandum of Understanding executed on September 15, 1981, Roanoke
County agreed to provide parks and recreation services to the Town of Vinton. To
support this agreement, the Town leased three properties to the County on May 3, 1982:
1. Gearhart Park (Highland Road): Ballfield, picnic shelter, building, tennis courts, and
basketball courts.
2. Gladetown Park (Craig Avenue): Basketball court and playground equipment (now
known as M.A. Banks Park).
3. Vinton Recreation Center (814 East Washington Avenue): Recreation center, picnic
shelter, ballfield, basketball court, and tennis courts (now known as the Charles R. Hill
Community Center).
Operational control of the Charles R. Hill Community Center was previously returned to
the Town of Vinton, which has since fabulously maintained and expertly operated the
facility. However, staff found no formal amendment to the 1982 lease reflecting this
transfer.
The Town of Vinton now intends to repurpose Gearhart Park for law enforcement
operations. Both the Town of Vinton and Roanoke County mutually agree to return
operational control of Gearhart Park to the Town of Vinton and formally amend the 1982
lease to reflect the return of both Gearhart Park and the Charles R. Hill Community
Center.
Discussion:
Gearhart Park sits on a 6.731-acre parcel behind the former Roanoke County Career
Center at 350 Highland Avenue (Tax Map #060.15-01-22.00-0000). The facility currently
features a section of the Glade Creek Greenway, ballfield, parking lot, and a small
abandoned maintenance shop.
Under the 1982 lease, Roanoke County leased the three properties for$0 annual rent,
taking responsibility for routine building maintenance, groundskeeping, lighting,
insurance, and utilities.
An administrative audit conducted by Allen Hayes, Roanoke County's Director of Parks,
Recreation, and Tourism, revealed that the current use of the Gearhart Park ballfield
could be accommodated at nearby facilities. Working with the Vinton Youth Boosters,
the Parks, Recreation, and Tourism Department successfully shifted sport play in 2025
and 2026 to nearby facilities without issue or concern. This demonstrated ability
resulted in the Vinton Youth Boosters supporting the decommissioning of Gearhart Park
as a recreational facility for other public needs.
Fiscal Impact:
This ordinance has no adverse fiscal impacts and is expected to generate
approximately $3,750 in annual savings through the elimination of park maintenance
responsibilities.
Staff Recommendation:
Staff recommends that the Board of Supervisors approve the first reading of this
ordinance and schedule this for a second reading on October 13, 2026. Staff
recommends that the Board approve the attached Partial Lease Termination Agreement.
This action formally removes Gearhart Park and the Charles R. Hill Community Center
from the 1982 lease while keeping the terms for M.A. Banks Park (formerly Gladetown
Park) fully intact.
Vote:
Supervisor North moved to approve the first reading of this ordinance and scheduling the
second reading for October 13, 2026. Supervisor Shepherd seconded the motion.

PARTIAL LEASE TERMINATION AGREEMENT
THIS PARTIAL LEASE TERMINATION AGREEMENT (this "Agreement") is made
and entered into this day of ,2026,by and between the TOWN OF
VINTON,VIRGINIA, a municipal corporation of the Commonwealth of Virginia("Town"),party
of the first part, and the COUNTY OF ROANOKE, VIRGINIA, a political subdivision of the
Commonwealth of Virginia("County"), party of the second part.
WITNESSETH:
WHEREAS, the Town and the County entered into a certain Lease Agreement dated May
3, 1982 (the "Lease Agreement"), pursuant to which the Town leased to the County certain
recreational properties situated in the Town of Vinton, Virginia, as identified on Exhibit "A"
attached thereto; and
WHEREAS, the properties encumbered by the Lease Agreement initially included the
following:
(1) Gearhart Park, Highland Road, Vinton, Virginia, including a picnic shelter and
building, ballfield, tennis courts, and basketball courts;
(2) Gladetown Park, Craig Avenue, Vinton, Virginia, including a basketball court and
playground equipment(the Gladetown Park is now known as M.A. Banks Park);
(3) Vinton Recreation Center, 814 East Washington Avenue,Vinton,Virginia,including a
recreational center, picnic shelter, ballfield, basketball court, and tennis courts (the
Vinton Recreation Center is now known as the Charles R. Hill Community Center);
and
WHEREAS, operational control of the Vinton Recreation Center (hereinafter referred to
as the"Charles R. Hill Community Center")was previously surrendered and returned to the Town;
and
WHEREAS, the County and the Town now mutually desire for operational control of
Gearhart Park to be returned to the Town; and
WHEREAS, the County and the Town mutually desire to terminate the Lease Agreement
strictly with respect to the Charles R. Hill Community Center and Gearhart Park, and to surrender
full maintenance, operation, possession and control of the Chares R. Hill Community Center and
Gearhart Park back to the Town; and
WHEREAS,the County and the Town mutually desire to retain the existing lease terms as
to the remaining property, specifically Gladetown Park(now known as M.A. Banks Park).
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein
and other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the Town and the County agree as follows:
TERMS AND CONDITIONS
1. Effective as of the day of , 2026 (the "Effective
Date"), the Lease Agreement dated May 3, 1982, is hereby terminated solely as it pertains to the
Charles R. Hill Community Center, located at 814 East Washington Avenue, Vinton, Virginia
(including a recreational center, picnic shelter, ballfield, basketball court, and tennis courts) and
Gearhart Park, located on Highland Road,Vinton, Virginia(including the picnic shelter, building,
ballfield, tennis courts, and basketball courts). As of the Effective Date, the County surrenders all
its leasehold interest,possession,and rights to the Charles R. Hill Community Center and Gearhart
Park to the Town.
2. As of 11:59 PM on the day immediately preceding the Effective Date, the County's
obligation to maintain, repair, insure, or pay utilities (including water, sewer, electric, and field
lighting) for the Charles R. Hill Community Center and Gearhart Park pursuant to Sections 3, 4,
and 5 of the original Lease Agreement shall fully cease.The Town shall assume sole responsibility
for all operations, maintenance, capital improvements, insurance, security, and utility accounts
associated with the Charles R.Hill Community Center and Gearhart Park on and after the Effective
Date.
3. Pursuant to Section 3 of the Lease Agreement, any personal property owned by the
County located at the Charles R. Hill Community Center or Gearhart Park prior to the Effective
Date may be removed by the County on or before the Effective Date. Any property remaining on
the premises after the Effective Date shall be deemed to be surrendered and shall become the
property of the Town without further consideration.
4. The County shall remain responsible for and indemnifies the Town against any
third-party claims, liabilities, or causes of action arising out of the County's use or occupancy of
the Charles R. Hill Community Center and Gearhart Park prior to the Effective Date, as provided
under Section 6 of the original Lease Agreement. From and after the Effective Date, the Town
releases and discharges the County from any and all ongoing covenants, maintenance obligations,
or liability arising from the occupancy, operation, or use of the Charles R. Hill Community Center
and Gearhart Park occurring on or after the Effective Date.
5. Except as expressly modified by this Agreement, all remaining terms, provisions,
and covenants of the May 3, 1982 Lease Agreement shall remain unchanged and in full force and
effect. Exhibit "A" of the original Lease Agreement is hereby amended to delete the Charles R.
Hill Community Center and Gearhart Park therefrom.
6. This Agreement shall be governed by, construed, and enforced in accordance with
the laws of the Commonwealth of Virginia. If any provision of this Agreement is held invalid or
unenforceable, the remaining provisions shall continue in full force and effect.
IN WITNESS WHEREOF, the Town of Vinton, Virginia, and the County of Roanoke,
Virginia, have caused this Partial Lease Termination Agreement to be executed by their duly
authorized representatives as of the date first written above.

Magisterial District. (Second Reading and Public Hearing)

Issue:
Agenda item for second reading and public hearing of an ordinance to rezone property
from industrial to agricultural for a family subdivision.
Background:
The Roanoke County Zoning Ordinance defines a manufactured homes as "a structure
subject to federal regulation, which is transportable in one (1) or more sections: is eight
(8) body feet or more in width and forty (40) body feet or more in length in the traveling
mode, or is three hundred twenty (320) or more square feet when erected on site; is
built on a permanent chassis; is designed to be used as a single-family dwelling, with or
without a permanent foundation, when connected to the required utilities; and includes
the plumbing, heating, air conditioning, and electrical systems contained in the
structure. For floodplain management purposes also included are park trailers, travel
trailers, and other similar vehicles placed on a site for greater than one hundred eighty
(180) consecutive days."
A manufactured home is not allowed in the 1-2 zoning district but is a permitted use in
the AG-1 zoning district.
Discussion:
The Planning Commission held a public hearing on this petition on September 1, 2026.
No citizens spoke during the public hearing. The Planning Commission discussed the
proposed family subdivision and easement, the zoning history of the property, other
industrial uses in the area, when the last industrial use (Kent's Insulating and Tru Team)
was constructed in 2004, surrounding zoning, and the future land use designation.
The Planning Commission voted to recommend approval of the rezoning request from I-
2 to AR.
Fiscal Impact:
There is no fiscal impact associated with this agenda item.
Staff Recommendation:
Staff recommends that the Board of Supervisors approve the second reading of an
ordinance to rezone approximately 6.544 acres from 1-2, High Intensity Industrial

rezone approximately 6.544 acres of land from 1-2 (High Intensity Industrial) District to

this matter on September 1, 2026; and
WHEREAS, the Planning Commission recommends approval of the petition as
requested; and
WHEREAS, legal notice and advertisement has been provided as required by law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The petition of Kent A. Wheeler and K&K Corporation of Roanoke to rezone
approximately 6.544 acres of land from 1-2 (High Intensity Industrial) District
to AG-1 (Agricultural/Rural Low Density) District located at 5454 Aerospace

2. The Board finds that the proposed rezoning request is consistent with the
purpose and intent of the Roanoke County Comprehensive Plan.
3. The Board further finds that approval of the request is good zoning
practice, and will not result in substantial detriment to the community.
4. This ordinance shall be in full force and effect thirty (30) days after its final
passage. The Zoning Administrator is directed to amend the zoning district
map to reflect the change in zoning classification authorized by this
ordinance.

Issue:
Second reading of an ordinance and public hearing for a special use permit to operate a
construction yard in an industrial district.
Background:
The Roanoke County Zoning Ordinance defines `construction yards' as: establishments
housing facilities of businesses primarily engaged in construction activities, including
outside storage of materials and equipment. Typical uses are building contractor's
yards. Construction yards are only permitted in the I-1, Low Intensity Industrial District,
through approval of a special use permit.
The existing building at this location was constructed in 1997 for warehousing and
distribution purposes and was previously occupied as the Frito-Lay distribution facility.
The property was sold in September 2024 to Star City Realty, LLC. Comfort Systems
USA Shoffner intends to lease the property from Star City Realty, LLC, and renovate the
building to serve as its central office and warehouse location for service to the Roanoke
area.
Discussion:
The Planning Commission held a public hearing on this petition on September 1, 2026.
No citizens spoke during the public hearing. The Planning Commission discussed the
proposed use, the purpose of the construction yard is to store equipment orders until it
is transported to the job site, the re-use of an existing industrial building, great to see an
area business that is growing, surrounding zoning, and the future land use designation.
The Planning Commission voted to recommend approval of the special use permit
request for a construction yard with the following condition:
• The site shall be developed in substantial conformance with the concept plan
entitled "Comfort Systems USA Zoning Exhibit" dated July 10, 2026, prepared by
Westwood Professional Services, Inc., subject to any revisions required during
the comprehensive site plan review process.
Fiscal Impact:
There is no fiscal impact associated with this agenda item.
Staff Recommendation:
Staff recommends that the Board of Supervisors approve the second reading of an
ordinance to approve a special use permit for a construction yard in an I-1, Low
Intensity Industrial District, with the following condition:
• The site shall be developed in substantial conformance with the concept plan
entitled "Comfort Systems USA Zoning Exhibit" dated July 10, 2026, prepared by
Westwood Professional Services, Inc., subject to any revisions required during
the comprehensive site plan review process.
VOTE:
Supervisor Hooker found that the proposed special use permit request:
1. Meets the requirements of Section 30-19-1 of the Roanoke County Code and
that the proposed special use conforms with the standards set forth in article
IV, use and design standards of the Roanoke County Zoning Ordinance;
2. Is in conformance with the Roanoke County Comprehensive Plan; and
3. Will have a minimum adverse impact on the surrounding neighborhood and
community.
Therefore, moved that the Board approve the petition for a special use permit with the
following conditions:
1. The site shall be developed in substantial conformance with the concept plan
entitled "Comfort Systems USA Zoning Exhibit" dated July 10, 2026, prepared
by Westwood Professional Services, Inc., subject to any revisions required
during the comprehensive site plan review process.

WHEREAS, Comfort Systems USA Shoffner has petitioned to obtain a special use
permit to operate a construction yard on approximately 6.6 acres zoned I-1 (Low Intensity
Industrial) District at 3941 West Main Street, Catawba Magisterial District (Roanoke
County Tax Parcel #055.13-01-04.00-0000); and
WHEREAS, the first reading of this ordinance was held on August 18, 2026, and
the second reading and public hearing were held on September 22, 2026; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on September 1, 2026; and
WHEREAS, the Roanoke County Planning Commission recommends approval of
the petition, with one (1) condition; and
WHEREAS, legal notice and advertisement have been provided as required by
law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The Board finds that the special use permit meets the requirements of
Section 30-19-1 of the Roanoke County Code and that the proposed special
use conforms with the standards set forth in article IV, use and design
standards of the Roanoke County Zoning Ordinance;

Issue:
Ordinance to amend the fiscal year 2026-2027 Roanoke County Public Schools (RCPS)
overall Budget Categories.
Background:
The state biennium budget was signed by the Governor on June 29, 2026. Included in
the budget was the subsequent release of the Virginia Department of Education's final
funding estimates.
Discussion:
During a work session held on August 6, 2026, with the Roanoke County School Board,
school staff presented the final revision to their FY2026-2027 Annual Budget. The
revision incorporates final state funding estimates, updated local and federal revenue
projections, and related expenditure adjustments to reflect the division's final anticipated
revenues for the 2026-2027 fiscal year.
The attached RCPS 2026-2027 Revised Annual Budget was approved at the Roanoke
County Public School Board meeting held on August 20, 2026.
There have been no changes since the first reading held September 8, 2026.
Fiscal Impact:
Approval of this ordinance will reduce the overall budget categories by $1,140,662 and
appropriate additional funds to the individual categories as outlined in the attached
email from Susan Peterson, Chief Financial Officer for the Roanoke County Public
Schools.
Staff Recommendation:
Staff recommends approving the ordinance.

WHEREAS, the state biennium budget was signed by the Governor on June 29,

WHEREAS, during the Roanoke County Public Schools (RCPS) August 6, 2026
budget work session, school staff presented the final revision to their FY2026-2027
annual budget which incorporates final state funding estimates, updated local and federal
revenue projections, and related expenditure adjustments to reflect the division's final
anticipated revenues for the 2026-2027 fiscal year; and
WHEREAS, pursuant to Section 22.1-115 of the Code of Virginia, the Board of
Supervisors approves the School Board's budget by categories; and
WHEREAS, the first reading of this ordinance was held on September 8, 2026,
and the second reading was held on September 22, 2026.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board approves the overall reduction of the budget categories by
$1,140,662.
2. The Board appropriates funds to the individual budget categories as follows:

Issue:
There is a need for a new lease agreement with Virginia Regional Transit for the lease of
two (2) parking spaces at Kessler Mill for the shuttle parking. If Roanoke County continues
to provide shuttle services to and from the McAfee Knob Trailhead beyond November 26,
2027, there will be a need for future leases of the two (2) parking spaces at Kessler Mill
for the shuttle parking.
Background:
Ride Source is Roanoke County's current vendor for the McAfee Knob Trailhead
Shuttle. Roanoke County has a current contract with Ride Source for this service. The
original contract was entered into on August 12, 2022, and it was most recently renewed
effective August 2, 2026. The contract terminates on November 26, 2027.
Ride Source has notified Roanoke County that Virginia Regional Transit will be
acquiring Ride Source. The current contract with Ride Source allows for assignment by
the vendor (Ride Source), and Roanoke County has agreed to the assignment to
Virginia Regional Transit. Upon acquisition of Ride Source by Virginia Regional Transit,
the contract will continue as assigned with Virginia Regional Transit being the new
vendor.
Roanoke County also has a lease agreement with Ride Source for the lease of two (2)
parking spaces at Kessler Mill for the shuttle parking. This lease agreement was not
renewed and thus expired on August 1, 2026.
There have been no changes since the first reading held September 8, 2026.
Discussion:
The Roanoke County Attorney's Office has drafted a new lease agreement to be
entered into with Virginia Regional Transit for the lease of two (2) parking spaces at
Kessler Mill for the shuttle parking.
Fiscal Impact:
Roanoke County will receive $50 per month in rental payments pursuant to the terms of
the lease with Virginia Regional Transit. If further leases are entered into after
November 26, 2027, then Roanoke County would also receive rental payments under
those future leases.
Staff Recommendation:
Staff recommends that the Board of Supervisors approve the execution of the lease
agreement with Virginia Regional Transit. Staff further recommends that the Board of
Supervisors adopt the attached ordinance delegating authority to the County
Administrator, or his designee, to negotiate and execute future lease agreements for up
to a 10-year period with vendors requiring parking spaces at 1204 Kessler Mill Road for
the McAfee Knob Trailhead shuttle service. The attached ordinance clarifies that the
County Administrator holds discretion over all lease terms and rental rates, provided
future rental payments meet or exceed fifty dollars ($50.00) per month.

Management Services prepares a budget development calendar for approval by the
Board of Supervisors.
Discussion:
The attached calendar provides the Board of Supervisors and County staff with a clear
timeline to meet all legal obligations associated with both the operating and capital
budgets. The budget calendar also adheres to requirements set forth within the
Comprehensive Financial Policy.

Background:
The first reading of this ordinance is accomplished by adoption of this ordinance in the

procedural requirements of the County Charter and schedules the required public
hearing and second reading of these ordinances. The second reading and public

Issue:
Request to accept and allocate an Emergency Management Performance Grant
(EMPG) award of $21,282 from the Virginia Department of Emergency Management
(VDEM), with a required local match of $21,282, for a total grant project amount of
$42,564.
Background:
The Emergency Management Performance Grant (EMPG) is an annual grant provided
to local governments by the Virginia Department of Emergency Management (VDEM) to
support emergency preparedness and response capabilities. Grant funds may be used
to purchase equipment and resources that enhance Emergency Operations Center
(EOC) capabilities and support EOC operations. Funds may also be used for items that
support field operations, logistics, and other emergency management preparedness
activities.
Discussion:
Fire & Rescue will use the grant funds to purchase iPads equipped with required
emergency management reporting and tracking software, as well as other essential
software applications to support emergency operations and incident management in the
field. Additionally, grant funds will support the continued use of emergency
management software and services, including flood monitoring and hazardous materials
tracking, which provide critical information and situational awareness during emergency
incidents.
Fiscal Impact:
The grant award provides $21,282 in funding from the Virginia Department of
Emergency Management (VDEM) and requires a 50% local match of $21,282, for a
total project amount of$42,564. A portion of the Emergency Manager's salary will serve
as the required 50% local match and will satisfy the local match requirement without
requiring additional appropriated cash funds.
Staff Recommendation:
Staff recommends that the Board of Supervisors approve the acceptance and allocation
of $21,282 in Emergency Management Performance Grant (EMPG) funds from the
Virginia Department of Emergency Management (VDEM), with the required local match
of $21,282, for a total project amount of $42,564, to the Fire and Rescue Department.

Issue:
DMV offers annual grants within the federal fiscal year (October-September). Roanoke
County Police was awarded two grants this year that enhance public safety through
additional enforcement efforts, community outreach, and new equipment.
Background:
Roanoke County Police have received at least two DMV grants every year for over ten
years. These grants are provided by NHTSA and managed by DMV. They offer
compensation for officers to work overtime shifts with the exclusive purpose of enforcing
traffic laws. The grant also offers opportunities to purchase additional radars and
preliminary breath tests.
Discussion:
The Roanoke County Police Department will use the funds to purchase four handheld
radars, five in-car radars, and five preliminary breath tests to be used as tools for
enforcing speed laws and DUls. The funds will further allow for officers to voluntarily work
in their off-duty time, with the specific objective of conducting traffic stops during days of
the week and times that our current statistics show when violations of speeding, impaired
driving, and unrestrained occupants are occurring. These statistics have been gathered
over the previous three years based on violations warned and cited as well as crash
reports. By reducing speeding and impaired driving through enforcement efforts, the
roads of Roanoke County have been made safer and reduced crashes related to these
violations.
Fiscal Impact:
The grants require a match as outlined above and will be accomplished through fuel
and vehicle maintenance expenditures already appropriated in the Police department's
Fiscal Year 2027 operating budget.
Staff Recommendation:
Staff recommends acceptance and allocation to the grant fund on behalf of the Roanoke
County Police Department in the amount of $90,810.00 for the Police Traffic Services
Grant with a local match of $45,405 and $90.685.00 for the Alcohol Grant with a local
match of$45,343.
Vote:
Supervisor Mahoney moved to accept and allocate the grant funds. Supervisor North

RESOLUTION 092226-12 APPOINTING AN ACTING COUNTY ATTORNEY
WHEREAS, Chapter 7 of the Roanoke County Charter provides that the Board
shall appoint a County Attorney who shall serve at the pleasure of the Board of
Supervisors, and whose compensation shall be fixed by the Board of Supervisors; and
WHEREAS, Section 15.2-1542 of the Code of Virginia establishes the various
statutory duties and responsibilities of the County Attorney; and
WHEREAS, due to a temporary absence, the Board of Supervisors wishes to
appoint a qualified individual to serve as Acting County Attorney.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia as follows:
1. That Rachel W. Lower is hereby appointed as Acting County Attorney for
Roanoke County, effective immediately.
2. That Rachel W. Lower shall exercise all the powers and fulfill all the duties and
obligations of the County Attorney as provided in the Roanoke County Charter,
the Code of Virginia, the established position description, the policies and
regulations adopted by the Board of Supervisors, and the legal directives of the

Issue:
Agenda item for second reading of an ordinance and public hearing to rezone property
from residential to commercial.
Background:
The proposed rezoning is to provide a secondary access for a by-right development on
an adjacent property. The proposed use on the neighboring property is a convenience
store and a commercial building to house either a retail use or an office use. Because
this property would be used for access to commercial development, it must be rezoned
to support those commercial uses which are allowed by-right in the C-2, High Intensity
Commercial, District.
Discussion:
The Planning Commission held a public hearing on this petition on September 1, 2026.
No citizens spoke during the public hearing. The Planning Commission discussed the
traffic study, access, that no turn lane was needed on Friendship Lane based on the
traffic study, the rezoning is for secondary access to Friendship Lane for a by-right
development on adjacent property, and the current zoning (R-2) is not consistent with
the Core future land use designation or surrounding zoning.
The Planning Commission recommends approval of the rezoning request from R-2 to C-
2.

Staff recommends that the Board of Supervisors approve the second reading of an

Issue:
Agenda item for second reading of an ordinance and public hearing to rezone property
from Agricultural to Industrial and obtain two (2) special use permits, one for automobile
dealership and one for a construction yard.
Background:
RYT, LLC is petitioning to rezone approximately 19.456 acres from AR,
Agricultural/Residential District (15.456 acres) and ARS, Agricultural Residential District
with a Special Use Permit (4 acres), to I-1, Low-Intensity Industrial District and to obtain
a special use permit for automobile dealership and to obtain a special use permit for
construction yard to operate a business that encompasses general office, automobile
repair services, major, automobile dealership, and construction yard. The proposal
includes five (5) parcels, 1924, 1928, 0, 0, and 0 Loch Haven Drive.
Discussion:
The Planning Commission held a public hearing on this petition on September 1, 2026.
No citizens spoke during the public hearing. The Planning Commission discussed the
construction yard location, screening of the construction yard, sales of tow trucks and
rollbacks would be in front of the building within the existing parking lot, traffic issues on
Barrens Road raised by citizen email, most of the traffic to the site would be from Route
419/North Electric Road, natural buffers on site, great opportunity for an existing local
business to continue to grow, special use permit conditions, surrounding zoning, and the
future land use designations.
The Planning Commission recommends approval of the rezoning of 19.456 acres from
AR, Agricultural/Residential District, and ARS, Agricultural/Residential District with
Special Use Permit, to I-1, Low Intensity Industrial District.
The Planning Commission also recommends approval of the special use permit for an
automobile dealership with the following conditions:
1. The site shall be developed in substantial conformance with the application
concept plan dated July 9, 2026, prepared by Parker Design Group, subject to
any changes required during the site plan review process.
2. The automobile dealership shall be limited to tow truck/wrecker sales.
The Planning Commission also recommends approval of the special use permit for a
construction yard with the following conditions:
1. The site shall be developed in substantial conformance with the application
concept plan dated July 9, 2026, prepared by Parker Design Group, subject to
any changes required during the site plan review process.
2. The construction yard (Possible Equipment Storage on concept plan) shall be
fenced and fully screened from surrounding views in accordance with Section 30-
92 and shall be set back at least 100 feet from adjoining property lines (not part

Supervisor Hooker also found that the first proposed special use permit (auto dealership):
1. Meets the requirements of Section 30-19-1 of the Roanoke County Code and
that the proposed special use conforms with the standards set forth in article
IV, use and design standards of the Roanoke County Zoning Ordinance,
2. Is not in conformance with the Roanoke County Comprehensive Plan's future
land use designation,
3. Will have a minimum adverse impact on the surrounding neighborhood and
community.
Therefore, also moved that the Board approve the petition to obtain a special use permit
to operate an auto dealership, with the following conditions:
1. The site shall be developed in substantial conformance with the application
concept plan dated July 9, 2026, prepared by Parker Design Group, subject to
any changes required during the site plan review process.
2. The automobile dealership shall be limited to tow truck/wrecker sales.
Supervisor Hooker also found that the second proposed special use permit (construction
yard):
1. Meets the requirements of Section 30-19-1 of the Roanoke County Code and
that the proposed special use conforms with the standards set forth in article
IV, use and design standards of the Roanoke County Zoning Ordinance,
2. Is not in conformance with the Roanoke County Comprehensive Plan's future

ORDINANCE 092226-14 (I) REZONING APPROXIMATELY 19.456 ACRES FROM AR
(AGRICULTURAURESIDENTIAL) DISTRICT (15.456 ACRES) AND ARS
(AGRICULTURAURESIDENTIAL) DISTRICT WITH A SPECIAL USE PERMIT (4
ACRES) TO I-1 (LOW INTENSITY INDUSTRIAL) DISTRICT, (II) GRANTING A
SPECIAL USE PERMIT FOR AUTOMOBILE DEALERSHIP, AND (III) GRANTING A
SPECIAL USE PERMIT FOR A CONSTRUCTION YARD TO OPERATE A BUSINESS
THAT ALSO ENCOMPASSES GENERAL OFFICE AND AUTOMOBILE REPAIR
SERVICES, MAJOR, LOCATED AT 1924 LOCH HAVEN DRIVE (ROANOKE COUNTY
TAX PARCEL #036.07-01-04.00-0000), 1928 LOCH HAVEN DRIVE (ROANOKE
COUNTY TAX PARCEL #036.07-01-04.01-0000), 0 LOCH HAVEN DRIVE (ROANOKE
COUNTY TAX PARCEL #036.07-01-05.00-0000), 0 LOCH HAVEN DRIVE (ROANOKE
COUNTY TAX PARCEL #036.07-01-14.00-0000), AND 0 LOCH HAVEN DRIVE
(ROANOKE COUNTY TAX PARCEL #036.07-01-15.00-0000), IN THE CATAWBA
MAGISTERIAL DISTRICT
WHEREAS, RYT, LLC is requesting (i) to rezone approximately 19.456 acres from
AR (Agricultural/Residential) District (15.456 acres) and ARS (Agricultural/Residential)
District with a Special Use Permit (4 acres) to I-1 (Low Intensity Industrial) District, (ii) to
obtain a special use permit for automobile dealership, and (iii) to obtain a special use
permit for a construction yard to operate a business that also encompasses general office
and automobile repair services, major at 1924 Loch Haven Drive (Roanoke County Tax
Parcel #036.07-01-04.00-0000), 1928 Loch Haven Drive (Roanoke County Tax Parcel
#036.07-01-04.01-0000), 0 Loch Haven Drive (Roanoke County Tax Parcel #036.07-01-
05.00-0000), 0 Loch Haven Drive (Roanoke County Tax Parcel #036.07-01-14.00-0000),
and 0 Loch Haven Drive (Roanoke County Tax Parcel #036.07-01-15.00-0000), in the
Catawba Magisterial District; and

WHEREAS, the first reading of this ordinance was held on August 18, 2026, and
the second reading and public hearing were held on September 22, 2026; and
WHEREAS, the Roanoke County Planning Commission held a public hearing on
this matter on September 1, 2026; and
WHEREAS, the Planning Commission recommends approval of the rezoning
petition as requested, recommends approval of the special use permit for an automobile
dealership with two (2) conditions, and recommends approval of the special use permit
for a construction yard with two (2) conditions; and
WHEREAS, legal notice and advertisement has been provided as required by law.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The petition of RYT, LLC to rezone approximately 19.456 acres from AR
(Agricultural/Residential) District (15.456 acres) and ARS
(Agricultural/Residential) District with a Special Use Permit (4 acres) to I-1
(Low Intensity Industrial) District located at 1924 Loch Haven Drive
(Roanoke County Tax Parcel #036.07-01-04.00-0000), 1928 Loch Haven
Drive (Roanoke County Tax Parcel #036.07-01-04.01-0000), 0 Loch Haven
Drive (Roanoke County Tax Parcel #036.07-01-05.00-0000), 0 Loch Haven
Drive (Roanoke County Tax Parcel #036.07-01-14.00-0000), and 0 Loch
Haven Drive (Roanoke County Tax Parcel #036.07-01-15.00-0000), in the
Catawba Magisterial District is hereby approved.
2. The Board finds that the proposed rezoning request is partially consistent
with the Roanoke County Comprehensive Plan's future land use
designation and partially inconsistent, and also finds that approval of the

rezoning request is good zoning practice and will not result in substantial
detriment to the community.
3. The petition of RYT, LLC to obtain a special use permit for automobile
dealership at 1924 Loch Haven Drive (Roanoke County Tax Parcel
#036.07-01-04.00-0000), 1928 Loch Haven Drive (Roanoke County Tax
Parcel #036.07-01-04.01-0000), 0 Loch Haven Drive (Roanoke County Tax
Parcel #036.07-01-05.00-0000), 0 Loch Haven Drive (Roanoke County Tax
Parcel #036.07-01-14.00-0000), and 0 Loch Haven Drive (Roanoke County
Tax Parcel #036.07-01-15.00-0000), in the Catawba Magisterial District is
hereby approved with the following two conditions:
a. The site shall be developed in substantial conformance with the
application concept plan dated July 9, 2026, prepared by Parker
Design Group, subject to any changes required during the site plan
review process.
b. The automobile dealership shall be limited to tow truck/wrecker
sales.
4. The petition of RYT, LLC to obtain a special use permit for a construction
yard at 1924 Loch Haven Drive (Roanoke County Tax Parcel #036.07-01-
04.00-0000), 1928 Loch Haven Drive (Roanoke County Tax Parcel
#036.07-01-04.01-0000), 0 Loch Haven Drive (Roanoke County Tax Parcel
#036.07-01-05.00-0000), 0 Loch Haven Drive (Roanoke County Tax Parcel
#036.07-01-14.00-0000), and 0 Loch Haven Drive (Roanoke County Tax
Parcel #036.07-01-15.00-0000), in the Catawba Magisterial District is
hereby approved with the following two conditions:

a. The site shall be developed in substantial conformance with the
application concept plan dated July 9, 2026, prepared by Parker
Design Group, subject to any changes required during the site plan
review process.
b. The construction yard (which is labeled "POSSIBLE EQUIPMENT
STORAGE" on the concept plan dated July 9, 2026) shall be fenced
and fully screened from surrounding views in accordance with
Section 30-92 of the Roanoke County Code and shall be set back at
least 100 feet from adjoining property lines (not part of this
application).
5. The Board finds that the proposed special use permits meet the
requirements of Section 30-19-1 of the Roanoke County Code and that the
proposed special use conforms with the standards set forth in article IV, use
and design standards of the Roanoke County Zoning Ordinance. The Board
further finds that the proposed special use permits are not in conformance
with the Roanoke County Comprehensive Plan's future land use
designation, but that they will have a minimum adverse impact on the
surrounding neighborhood and community.
6. This ordinance shall be in full force and effect thirty (30) days after its final
passage. The Zoning Administrator is directed to amend the zoning district
map to reflect the change in zoning classification authorized by this
ordinance.
On motion of Supervisor Hooker to approve the ordinance; seconded by
Supervisor Shepherd and carried by the following roll call and recorded vote:
