IN RE: CALL TO ORDER Chairman Church called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Joseph B. "Butch" Church, Vice Chairman Joseph McNamara, Supervisors Richard C. Flora, H. Odell "Fuzzy" Minnix, Harry C. Nickens MEMBERS ABSENT: None STAFF PRESENT: Elmer C. O'Donnell, Assistant County Administrator IN RE: OPENING CEREMONIES The invocation was given by The Reverend Tommy London, First Baptist Church, Cloverdale, Virginia. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Supervisor McNamara asked to add two work sessions, (1) discussion of a Board Retreat, and (2) discussion of a potential aquatic complex. 26 January 22, 2002 Mr. Hodge added an item to closed meeting, pursuant to Section 2.2-3711 A (5) discussion of prospective business or industry in a regional industrial park. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND PRESENTATIONS 1. Recoanition ofthe Roanoke County Fire and Rescue Department and Induction into the Bullard Save-A-Life Club for use of the Bullard Thermal Imaaina camera. (Richard Burch. Fire and Rescue Chief) Battalion Chief Charlie King, Lt. Jeff Lawson, Firefighter Lynn Hudson, Volunteer Firefighter Todd Hanson were recognized by Tom Krahling of Bullard Thermal Imaging Company for savings lives with the use of their cameras. Chief Burch advised that the County has purchasing thermal imager cameras for the department for better evaluation of the structural integrity as firefighters work inside, and for quicker location of victims. He reported that Roanoke County Fire and Rescue personnel responded to a house fire on the evening of May 8, 2001. They arrived on the scene to find flames coming out of the rear of the house. Lt. Jeff Lawson, Medic/Firefighter Lynn Hudson and Volunteer Firefighter/EMT Todd Hanson entered the structure. Lt. Lawson was operating the Bullard Thermal Imager. Battalion Chief Charlie King, incident commander, was viewing the transmitted image from Lt. Lawson's camera. Chief King observed that the floor was slanting and the rafters appeared as though they were about to fall through the ceiling space. He called for an emergency evacuation. Within one minute, the hallway floor fell in where the firefighters had been previously fighting the fire. January 22, 2002 27 Chief King estimates that the effective use of thermal imaging saved these firefighters' lives. IN RE: BRIEFINGS 1. Briefina on annual reassessment process. (William Driver. Director of Real Estate Valuation> Mr. Driver announced that the purpose of the briefing was to provide for the public and Board of Supervisors information on: (1) Increase in Tax Base and Market Factors; (2) The assessment Process / Review and Equalization Schedule; and (3) Senior and Disabled Citizen Tax Relief - Increase in income level eligibility. Mr. Driver reported that the total increase in assessed values was 6.13%. Values of existing real estate increased 4.08% and new construction accounted for 2.05%. Two market factors that attributed to the increase were the low interest rates and the increase in the number of sales. Sales between 2000 and 2001 increased 13%. He advised that reassessment notices were mailed the first week of January, and our informal hearings will take place from January 16th to the 25th. Citizens may schedule an appointment with appraisers or may discuss concerns by phone. Appraisers will conduct office or field reviews of properties during the month of February, and notification to citizens should be completed by the end of February. Following notification citizens may continue their appeal to the Board of Equalization. Mr. Driver also emphasized that last year the Board of Supervisors increased the income levels for the Senior and Disabled Citizens Exemption from $30,000 to $50,000 in an effort to assist senior citizens and permanently disabled persons on fixed incomes. To apply for this program citizens need to contact the Commissioner of Revenue's Office 28 January 22, 2002 on or before March 31, 2002 to apply for this program. In response to questions from the Board members, Mr. Driver advised that assessments are at about 94% of actual market values of the property, and that the Board of Supervisors has never given the staff any direction on how to handle the assessments. INRE: 1. NEW BUSINESS Presentation from the U. S. Marine Corps Reserve Unit and the Marine Corps Leaaue and appropriation of $7.500 proceeds from the 6h Annual Marine Mud Run. (Pete Haislip, Parks. Recreation and Tourism Director) A-012202-1 Mr. Haislip advised that for the past five years the Marine Corps Reserve Unit, Company B, 4th Combat Engineer Battalion and the Marine Corps League, in cooperation with the Department of Parks, Recreation, and Tourism and other corporate sponsors has sponsored the Mud Run in Green Hill Park. The event is designed to raise funds for the Toys For Tots program and Camp Roanoke. This event continues to be one of the largest and most successful running events in the Valley and has received media support from around the state. This year there were 1,371 participants, and over 4,000 spectators. It is a family event, and includes runners from ages three years old to the 70's. Mr. Haislip expressed pride of the partnership with the Marines and looked forward to working with them in the future. This year's $7,500 contribution brings the total amount contributed to $19,000 and the funds will be added to the Camp Roanoke Fund and will be used to finish the canoe launch at the reservoir and purchase new canoes. January 22, 2002 29 Captain Winthrop, Marine Corp League Commandant Mike Sheperd and Race Director Jeff Baker were present to accept Certificates of Recognition from Roanoke County. They also presented a plaque to Eddie Ford, Parks, Recreation and Tourism and the County of Roanoke for their participation and support of the event. Supervisor McNamara moved to appropriate $7,500 to the Camp Roanoke Funds. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Minnix, Nickens, Church NAYS: None 2. Authorization to enter into an aareement with Roanoke Gas to extend ª natural aas line into the Center for Research and Technoloav. (Jill Loope. Assistant Director. Economic Development) A-012202-2 Ms. Loope reported that the 457-acre Center for Research and Technology (CRT) has been undergoing infrastructure improvements since 1998. To date, preliminary roads have been established, water and sewer lines extended, and a site has been preliminarily graded for development purposes. The extension of the gas line to the park is the next phase of improvement critical to the future development success of CRT, and is necessary for the Novozymes project. Ms. Loope advised that the proposal is that Roanoke County enter into an agreement with Roanoke Gas Company to construct a natural gas line into CRT. The proposed extension consists of 15,624 feet of line with a 6-inch minimum line from Rt. 460 30 January 22, 2002 to the entrance to the CRT, and a 4-inch minimum line within the park. The cost of the line extension is to be paid by Roanoke County initially, with the monies being reimbursed by Roanoke Gas as the County attracts new tenants to the park. The County will have six years to recruit enough users on the system to fulfill the terms of the agreement, which should pay for the cost ofthe construction. It is estimated that the entire cost of the line will be covered by the gas use projected by Novozymes, upon implementation of the first two phases of their development. Ms. Loope advised that $152,000 funds available in the CRT account will be reimbursed by Roanoke Gas, as the County secures new users on the line. Supervisor Nickens pointed out that Roanoke Gas is a sole source supplier and therefore not subject to a competitive bid process. Supervisor McNamara moved to authorize the agreement. That the certain section of the agenda of the Board of Supervisors for January 22, 2002 designated as Item J - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 5, inclusive, as follows: 1. Approval of Minutes - August 28, 2001, September 11, 2001. 2. On motion of Supervisor Nickens to adopt the Consent Resolution, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Minnix, Nickens, Church NAYS: None RESOLUTION 012202-4.d REQUESTING ACCEPTANCE OF THE REMAINING PORTION OF BUCKLAND MILL ROAD INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM WHEREAS, the streets described on the attached Additions Form SR-5(a), fully incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the Circuit Court of Roanoke County, and WHEREAS, the Resident Engineer for the Virginia Department of Transportation has advised this Board the streets meet the requirements established by the Subdivision Street Requirements of the Virginia Department of Transportation, and WHEREAS, the County and the Virginia Department ofTransportation have entered into an agreement on March 9, 1999, for comprehensive stormwater detention which applies to this request for addition, NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the streets described on the attached Additions Form SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of -' January 22, 2002 33 Virginia, and the Department's Subdivision Street Requirements, and BE IT FURTHER RESOLVED. this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Resident Engineer for the Virginia Department of Transportation. Bill Waddell. 5719 Oakland Boulevard asked why three homes with varying assessments were all increased exactly $4,000, which resulted in the most expensive home having the least percentage increase. Mr. Hodge responded that he would investigate and report back. 2. Ann Motlev. 5725 Oakland Blvd. noted that the real estate tax rate since 1990 has gone down from $1.15 to $1.12 as of last year and advised it was still difficult for seniors to pay the increased tax assessments 3. David Courev. 3419 Ashmeade Dr.. expressed concern about: (1) increased assessments and proposed that a renter's tax be introduced since the bulk ofthe taxes are on homeowners; (2) that a private firm be contracted to handle assessments which could save money; and (3) that the real estate tax rate be lowered. Church NAYS: None IN RE: ABSENCE Supervisor Minnix left the meeting at 4:40 p.m. January 22, 2002 35 IN RE: WORK SESSION (4TH FLOOR CONFERENCE ROOM) 1. Budaet work sessions (Brent Robertson. Budaet Director) a. Mid-vear revenues and sales tax b. Update on General Assemblv The work session was presented by Mr. Hodge and Mr. Robertson and held from 4:50 p.m. to 5:50 p.m. Mr. Hodge reported it will be several weeks before the County will know what state funding will be available. Mr. Robertson reported that staff is working on the personal property revenue and hope to have figures in several weeks. Currently the County is about $400,000 short in current revenues, but may end up by as much as $800,000 short in the current year's budget. In response to questions from the Board on how staff is handling the shortfall, Mr. Hodge advised that the staff is holding positions vacant, looking at travel and other expenses to make up some of the $800,000 shortfall. It was the consensus of the Board to balance the budget without using the General Fund Unappropriated Balance to make up the deficit. Supervisor Nickens asked for a budget work session on February 26, 2002, to discuss where the County stands at that time with local and state revenues. Supervisor Flora asked for information at the same work session on the seven months actual revenues and expenditures compared to the same time last year. 2. Discussion on Board Retreat The discussion was held from 5:05 p.m. to 5:10 p.m. Mr. Hodge and 36 January 22, 2002 Chairman Church described the plans for the retreat which will be held February 16, 2002, at Tanglewood Mall and will include a two hour segment with the School Board, a two hour segment with members of the business community, and discussion of other County issues with the Board and County staff. 3. Discussion on proposed Aauatic Center Supervisor McNamara advised that the Board received a letter from Phillip Anderson, 29 Franklin Road SW. describing what he felt was a need for a 50-meter pool large enough to host statewide swim meets. He suggested that the local governments jointly fund a 50-meter pool large enough for this purpose. Supervisor McNamara noted while he didn't necessarily support this request, he supported using last year's surplus to encourage tourism, and suggested that the County needs to. look at the development of some sports facilities to increase sports events in the Roanoke Valley. Director of Parks, Recreation & Tourism Pete Haislip noted that a 50 meter pool would be outdoors and only for high school swim teams. IN RE: CLOSED MEETING Chairman Church announced that Supervisor Minnix left the meeting at 4:40 p.m. because he had to go out of town and that the Closed Meeting lasted from 4:10 to 4:40 p.m. January 22, 2002 37 IN RE: R-012202-5 CERTIFICATION RESOLUTION At 7:00 p.m., Supervisor Church moved to return to open session and adopt the Certification resolution. Second readina of ordinance to obtain a SDecial Use Permit for 2.24 acres for an accessorv aDartment located at 2929 Elderwood 38 January 22,2002 Road. Catawba Maaisterial District. UDon the petition of Robert Finck. (Janet Scheid. Chief Planner) 0-012202-6 Ms. Scheid reported that Mr. and Mrs. Finck have three children one of whom is eight years old and has a special needs condition. The apartment would serve as live-in quarters for a nurse/caretaker for the child. The property is currently zoned R-1 and an accessary apartment is permitted with a special use permit and regulations as set out in the zoning ordinance. Ms. Scheid advised that at the Planning Commission meeting, staff was asked if the accessory apartment could be rented out. The staff responded that while this was not the intention, the zoning ordinance does not prohibit the rental of accessory apartments. The Planning Commission recommended approval. Supervisor Nickens pointed out that the Board has usually restricted these accessory apartments so that they could not be rented out and suggested that this condition be added to the permit to be consistent with other such requests. Supervisor McNamara concurred with the suggestion. Supervisor Church moved to adopt the ordinance with condition added by Supervisor Nickens that the accessory apartment will be limited to the use described in petition and will not be rented out. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix ORDINANCE 012202-6 GRANTING A SPECIAL USE PERMIT TO ROBERT FINCK FOR AN ACCESSORY APARTMENT TO BE LOCATED AT 2929 ELDERWOOD ROAD (TAX MAP NO. 44.03-5-8.1), CATAWBA MAGISTERIAL DISTRICT January 22, 2002 39 WHEREAS, Robert Finck has filed a petition for a special use permit for an accessory apartment to be located at 2929 Elderwood Road (Tax Map No. 44.03-5-8.1) in the Catawba Magisterial District; and WHEREAS, the Planning Commission held a public hearing on this matter on January 2, 2002; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, held a first reading on this matter on December 18, 2001; the second reading and public hearing on this matter was held on January 22, 2002; and NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board finds that the granting of a special use permit to Robert Finck for an accessory apartment to be located at 2929 Elderwood Road (Tax Map No. 77.03-5-8.1) in the Catawba Magisterial District is substantially in accord with the adopted 2000 Community Plan pursuant to the provisions of § 15.2-2232 of the 1950 Code of Virginia, as amended, and said Special Use Permit is hereby approved with the following condition: (1) The apartment shall only be used as a residence for members of the owner's family, or as a residence for a person providing care for a member of the owner's family and may not be rented to others. 2. Thatthis ordinance shall be in full force and effect thirty (30) days after its final passage. County Attornev) 0-012202-7 40 January 22, 2002 Mr. Mahoney advised that this ordinance divides the existing Glenvar Precinct #103 and creates a new precinct, Wildwood Precinct #108 in order to conform with the congressional redistricting. He reported there were no changes to the ordinance since the first reading. Supervisor Church moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix ORDINANCE 012202-7 AMENDING ORDINANCE 062601-13 BY THE CREATION OF A NEW PRECINCT (WILDWOOD PRECINCT #108), ALTERING THE BOUNDARIES OF GLENVAR PRECINCT #103, AND CHANGING THE POLLING PLACE FOR GLENV AR PRECINCT #1 03, AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE WHEREAS, Ordinance 062601-13 adopted by the Board of Supervisors of Roanoke County on June 26,2001, amended the election districts and precinct boundaries as a result of the population changes in the County as reported by the 2000 Federal census; and WHEREAS, this ordinance amends Ordinance 062601-13 in orderto conform with the Congressional redistricting found in Chapter 7, Acts of Assembly, 2001, Special Session.; and WHEREAS, legal notice of a public hearing concerning the adoption of this ordinance was provided as required by law; and WHEREAS, the first reading of this ordinance was held on January 8, 2002; and the second reading and public hearing was held on January 22, 2002. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Ordinance No. 062601-13 is hereby amended by the creation of a new precinct, - Wildwood Precinct #108 - described as follows: WILDWOOD PRECINCT -108 Beginning at a point where Butt Hollow Creek intersects Interstate 81 and the City of Salem corporate line; thence in a generally northeasterly direction with the said City of Salem corporate line to a point where Dry Branch forks into an easterly and westerly fork; thence with the easterly fork of the said Dry Branch as it meanders in generally a northwesterly direction to where this branch or hollow intersects with the AEP power line; thence following the January 22, 2002 41 AEP power line in an westerly direction to its intersection with Paint Bank Road; thence in a southeasterly direction with Paint Bank Road to its intersection with Texas Hollow Road; thence in a westerly and then southerly direction with Texas Hollow Road to its intersection with Alleghany Drive; thence in a southerly direction with Alleghany Drive to its intersection with Butt Hollow Creek; thence in a southerly direction with said Butt Hollow Creek to the point of beginning. Church 42 January 22, 2002 NAYS: None ABSENT: Supervisor Minnix IN RE: CITIZEN COMMENTS AND COMMUNICATIONS 1. Michael Roop. President of the Mt. Pleasant Civic League, noted that his Civic League was opposed to Interstate -73 and had made several requests to the Board that they adopt a resolution in opposition. He noted that he received a copy of a Community Impact Assessment Brochure and that the requirements include community meetings with various agencies such as civic leagues that would be impacted by major projects. He advised that VDOT has not met with the Mt. Pleasant Civic League to discuss the impact of 1-73 even though VDOT has been invited, and felt that the resolutions adopted by the Board of Supervisors supporting 1-73 were not in compliance with federal law and regulations. Chairman Church asked Mr. Mahoney to investigate and report back. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS SUDervisor Church: He advised that he felt that little by little and day by day the Board is trying to make Roanoke County a better place to live. He encouraged everyone to take an active part in their government.
