The Board of Supervisors of Roanoke County, Virginia met this day at the
Roanoke County Administration Center, this being the fourth Tuesday and the second
regularly scheduled meeting of the month of May, 2002.
IN RE:
CALL TO ORDER
Chairman Church called the meeting to order at 3:02 p.m. The roll call
was taken.

Supervisor Church introduced Diane Childers who will be serving as
Acting Deputy Clerk this evening. He also conveyed sympathy to the family of Mary
Allen, Clerk to the Board, who passed away recently.

The invocation was given by the Reverend Charles C. Calloway, Maple
Street Baptist Church, Roanoke, Virginia. The Pledge of Allegiance was recited by all
present.

REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF
AGENDA ITEMS
Mr. Mahoney added a closed meeting pursuant to Section 2.2-3711 A (7)
discussion of probable litigation.
Mr. Hodge requested that the request to lift the moratorium on the Colonial
Avenue project be moved to the evening session so that members of the Colonial
Avenue Alliance could be present.
IN RE: NEW BUSINESS
.1 Request for approval of ª-!! aQreement between the County of
Roanoke and the Vin:linia Department of Transportation for
reconstruction of Glenmarv Driye. (Georae Simpson, Community

Mr. Chittum updated the Board on the infrastructure improvements at the
Center for Research and Technology (CRT). The Board allocated $1,000,000 last year

for this project, and improvements to date include (1) Completion of public water and
sewer. (2) Extension of natural gas to all sites. (3) Installation of a power transfer line
to the site, with all lines inside the park being underground. (4) Road construction is
currently underway, with asphalt scheduled to be put down in June. Total improvement
expenditures to date are $875,000.
Mr. Simpson reported that in July, 2001, the Board of Supervisors
conducted a work session to look at options for upgrading access to the Roanoke
County Center for Research and Technology. Options considered were (a) the
reconstruction of existing Glenmary Drive and (b) the extension of Dow Hollow Road
and construction of a new access road. It was decided at that meeting to reconstruct the
existing Glenmary Drive due to the lower cost, the existing right-of-way, and the ability
to construct the road sooner than Dow Hollow.
Plans and specifications have been prepared for the project, and the
estimated construction cost of $872,000 is funded in the current CRT budget. The
plans allow for a 12' lane width with 6' shoulders. The Board is being asked to approve
an agreement with the Virginia Department Of Transportation (VDOT) to allow the
County to advertise, bid, award, and administer the construction contract. The
anticipated schedule is: (1) Advertise - June 15, 2002. (2) Bid award - July 30, 2002.
(3) Projected completion date - November 30, 2002.

Supervisor McNamara raised the possibility that if these costs are
reimbursable, the County could create a loan out of the General Fund balance in order
to more quickly develop our infrastructure needs. Mr. Hodge indicated that he would
discuss this possibility with staff.

RESOLUTION 052802-1 FOR APPROVAL OF COUNTY-STATE
AGREEMENT WITH THE VIRGINIA DEPARTMENT OF
TRANSPORTATION TO CONSTRUCT IMPROVEMENTS TO
GLENMARY DRIVE
WHEREAS, Title 33.1 of the Code of Virginia provides for the availability of funds
for implementing approved improvements to public streets to enhance and promote
economic and industrial development and continued public safety along public streets;
and
WHEREAS, Roanoke County is desirous of developing the Roanoke County
Center for Research and Technology for the purpose of job creation for the citizens of
the Roanoke Valley; and
WHEREAS, the Commonwealth Transportation Board has approved this project;
and
WHEREAS, the Virginia Department of Transportation (V DOT) has estimated the
cost of this road construction to be $872,000; and
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board of
Supervisors hereby authorizes the County Administrator or his designee to enter into a
County-State agreement allowing the County to advertise, bid, award, and administer
the construction contract for certain road improvements to Glenmary Drive (Project #
0778-080-315,501) to upgrade the access to the Roanoke County Center for Research
and Technology.

FIRST READING OF ORDINANCES
.1 First readina of ordinance to increase the salaries of the members
of the Board of Supervisors pursuant to Section 3.07 of the
Roanoke County Charter and Section 15.2-1414.3 of the Code of

Mr. Mahoney advised that Section 15.2-1414.3 of the 1950 Code of
Virginia and Section 3.07 of the County Charter require that any increase in
Supervisors' salaries be accomplished by ordinance after a public hearing between May
1 and June 30. Any increase is limited to an annual five (5%) percent inflation factor.
The first reading of this proposed ordinance was held on May 28, 2002, and the second
reading and public hearing is scheduled for June 11, 2002 at the 3:00 p.m. session. Mr.
Mahoney reported that the current salary for Board members is $13,165.36. There is
an additional annual compensation for the Chairman of the Board at $1,800 and for the
Vice-Chairman at $1,200. This ordinance increases salaries by 2.5%, which would cost
$1,645.70 annually. The new salary for each Board member would be $13,494.50.
Supervisor Church asked Mr. Mahoney to clarify the annual rate of increase for each
Board member. Mr. Mahoney indicated that the annual increase would total $329.14
per Board member.
Supervisor McNamara moved to approve the first reading and set the
second reading and public hearing for June 11, 2002. The motion carried by the

WORK SESSION (4TH FLOOR CONFERENCE ROOM)

b. Dumas Center for Artistic Development
The work session was presented by Tom McKeon, Roanoke Higher
Education Center; Ted Edlich, William Penn and Bill Skein, Dumas Center for Artistic
Development, and held from 4:40 p.m. to 5:30 p.m.
Mr. McKeon reported that the Higher Education Center is comprised of 16
member institutions that provide opportunities for workforce training and higher
education. The center receives 60% of their funding from leases by member institutions
and 40% from the Commonwealth of Virginia. Due to cuts in state funding, the Higher
Education Center is requesting the support of local governments. Mr. McKeon
requested that the County consider an annual partnership with the Higher Education
Center, with a funding request of $109,071.26 based on population data.

Mr. Edlich stated that the Dumas Center, the last historical structure on
Henry Street, is an artistic development center which targets young people. The
proposed plans for renovation include a recording studio and two performance halls.
Mr. Penn discussed the various programs offered at the Dumas Center
including the Dumas Drama Guild, Downtown Music Lab, Yo-Yo program and Dumas
on the Yard.
Mr. Skein reported that the total project costs for renovation of the Dumas
Center, including operating endowment, are $4,098,184. He indicated that the Dumas
Center would launch a capital campaign in November 2002, and are planning for a
ground breaking ceremony in September 2003. The Dumas Center requested that the
County consider a one time capital contribution of $200,000 which could be spread over
three to four years.
2. Work session with Parks & Recreation Advisorv Commission to
review Public Use Manual for Sports OrQanizations and
Community Users. (Pete Haislip. Director of Parks. Recreation &
Tourism}
The work session was presented by Pete Haislip, Director of Parks,
Recreation and Tourism, and members of the Parks and Recreation Advisory
Commission, and held from 4:00 p.m. to 4:38 p.m.
Mr. Griffith indicated that the Advisory Commission had reviewed the
community use manual in accordance with the Board's previous request. A public

meeting was held on March 21, 2002 which was attended by three groups: a non-
sanctioned youth baseball group and two groups interested in securing an aero park in
Roanoke County. Mr. Griffith indicated that the Commission had been able to address
some of the concerns of all these groups.
Mr. Haislip stated that the project review has been inclusive and involved
both the community and recreation club presidents. Mr. Haislip reviewed significant
changes to the manual and discussion of several items followed. Mr. Haislip indicated
that the Advisory Commission will meet on June 20, 2002, and the Commission will
bring a revised Community Use Manual back to the Board on July 9, 2002.

WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened
a ciosed meeting on this date pursuant to an affirmative recorded vote and in
accordance with the provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by

Mr. Hodge advised that the Colonial Avenue project is a part of the
County's six-year secondary road plan which the Board approved in December 2001,
but withheld one portion that included the section of Route 419 to Route 221.
Discussions have been held with VDOT and the Colonial Avenue Alliance regarding the
design of the road system. Improvements have been made to the plan, but the project
is not ready for construction or funding. The action requested this evening is to lift the
moratorium and allow the project to move forward and be placed back on the six-year
plan.
Members of the Colonial Avenue Alliance were present at the meeting and
indicated they were pleased with the progress and did not wish to speak at the meeting.
Supervisor Minnix moved to approve lifting the moratorium on the Colonial
Avenue Project. The motion carried by the following recorded vote:

RESOLUTION 052802-5 OF CONGRATULATIONS TO WILLIAM BYRD
HIGH SCHOOL CHEERLEADING COMPETITION TEAM FOR WINNING
THE GROUP AA STATE CHEERLEADING CHAMPIONSHIP
WHEREAS, team sports are an important part of the curriculum at schools in
Roanoke County teaching cooperation, sportsmanship and athletic skill; and
WHEREAS, the William Byrd High School Cheerleading Competition Team is
comprised of members of both the Junior Varsity and Varsity squads who are judged
and selected for membership on the competition team; and
WHEREAS, the competition team won the Group AA state cheerleading
championship this year at Virginia Commonwealth University in Richmond, defeating 15
other schools to become the first school in the Roanoke Valley to win a state
cheerleading competition; and,
WHEREAS, the team won the Region III Championship for the third consecutive
year and also won the Blue Ridge District Competition; and
WHEREAS, the team is coached by Barbara Shutt and Assistant Coaches
Shawna Hastings, Belinda West, Ruth Oyerfelt and Corie Goin; and,
WHEREAS, teamwork is essential in the sport of cheerleading with each member
contributing to the success of the team; and
WHEREAS, individual members of the team were recognized for the following
accomplishments:

SECOND READING AND ADOPTION OF PROPOSED BUDGET

Supervisor Church advised that the Board would consider the adoption of
the budget and appropriation of funds, and asked if there were any citizens who wished

to speak on this matter. Mr. Paul Bell, 2705 Hillbrook Drive, S.W., spoke concerning an
article which appeared in the May 13 issue of the Roanoke Times. He stated concerns
over the $3 million increase in this year's budget. He encouraged the Board to re-
evaluate the funding to Explore Park in light of the $1 million revenue shortfall the
County experienced this year.
Supervisor Nickens stated that the Capital Improvements Plan should be
more of a priority with more dollars allocated to this purpose. He commended staff for
their work on the budget process, and for maintaining quarterly reports and reviews
which were very informative and prevented the County from being caught short this
budget year.
Supervisor Minnix advised that staff had worked hard to bring forth a fair
budget with the services citizens demand. He indicated that difficult decisions have to
be made and that staff and Mr. Hodge had worked hard and did a good job in preparing
the budget.
Supervisor Church commended County staff and employees who go out
of their way to get the job done. He indicated that the Board is available to hear any
citizen concerns.
Following public discussion and comments, Mr. Robertson advised that
the resolution approving the fiscal year 2002-03 budget is detailed by fund and includes

unappropriated balances for the General Government, Capital, Water and Sewer
Funds. The School's budget is included in the overall County budget.
Mr. Robertson stated that the Fiscal Year 2003-2007 Capital
Improvements Program (CIP) is included as part of the resolution. On May 14, 2002
there was a public hearing to secure citizen comments on the County's Fiscal Year
2003-2007 CIP.
Supervisor Nickens moved to adopt the resolution. The motion carried by

RESOLUTION 052802-6 APPROVING THE FISCAL YEAR
2002-2003 BUDGET FOR ROANOKE COUNTY, VIRGINIA
WHEREAS, Section 15.2-2503 of the 1950 Code of Virginia, as amended,
provides that the governing body of the County shall prepare and approve an annual
budget; and
WHEREAS, said budget shall be prepared and approved for informative and
fiscal planning purposes only; and
WHEREAS, this budget contains a complete itemized and classified plan of all
contemplated expenditures and all estimated revenues and borrowings for the ensuing
fiscal year; and
WHEREAS, a brief synopsis of said budget was published as required by the
provisions of Section 15.2-2506 of the State Code, and the public hearing as required
thereon was held on May 14, 2002.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia:

ORDINANCE 052802-7 APPROPRIATING FUNDS FOR THE 2002-03
FISCAL YEAR BUDGET FOR ROANOKE COUNTY, VIRGINIA
WHEREAS, upon notice duly published in the newspaper, a public hearing was
held on May 14, 2002 concerning the adoption of the annual budget for Roanoke
County for fiscal year 2002-03; and
WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved
said budget on May 28, 2002, pursuant to the provisions of Section 13.02 of the
Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as
amended; and
WHEREAS, the first reading of this appropriation ordinance was held on May 14,
2002, and the second reading of this ordinance was held on May 28, 2002, pursuant to
the provisions of Section 18.04 of the Roanoke County Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as

2. That the County Administrator may authorize or delegate the
authorization of the transfer of any unencumbered balance or portion thereof
from one department to another within a fund.
3. That all funded outstanding encumbrances, both operating and capital,
at June 30, 2002, are re-appropriated to the 2002-03 fiscal year to the same
department and account for which they are encumbered in the previous year.
4. That appropriations designated for capital projects will not lapse at the
end of the fiscal year but shall remain appropriated until the completion of the
project or until the Board of Supervisors, by appropriate action, changes or
eliminates the appropriation. Upon completion of a capital project, staff is
authorized to close out the project and transfer to the funding source any
remaining balances. This section applies to appropriations for Capital Projects at
June 30, 2002, and appropriations in the 2002-03 budget.
5. That all school fund appropriations remaining at the end of the 2001-
02 fiscal year not lapse but shall be appropriated to the School Capital
Improvements Fund in fiscal year 2002-03.
6. That all General Fund appropriations remaining unexpended at the
end of the 2001-02 fiscal year not lapse but shall be re-appropriated as follows:
a) 40% of these unexpended appropriations shall be transferred to the
unappropriated Capital Fund Balance;
b) 60% of these unexpended appropriations shall be re-appropriated to the
same department for expenditure in fiscal year 2000-01 as provided by
Resolution 042396-5.
7. This ordinance shall take effect July 1, 2002.

BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the zoning classification of a certain tract of real estate
containing 3.33 acres, as described herein, and located at 2205 Washington
Avenue (Tax Map Number61.15-2-10.1) in the Vinton Magisterial District, is
hereby changed from the zoning classification of C-2, General Commercial
District with conditions, to the zoning classification of C-2, General Commercial
District, without conditions, REMOVING the following conditions imposed in
1986:
(1) Northern 2.66 acres +/. to remain as B-2 zoning in keeping
with comprehensive plan for transition property.
(2) Eastern 0.9 acres +/- between R-1 property to remain as
natural buffer zone.
(3) Construction will be in accordance with the concept plan
submitted with petition, specifically in accordance with
planting and paving as shown.
(4) Mini-warehouses will be the only use permitted in the M-1,
Industrial District.
(5) The color and architectural design of the mini-warehouses
will be in accordance with the photographs submitted with
petitions.
2. That this action is taken upon the application of Winter Properties
Partnership, LLP.
3. That the Board finds that the granting of a special use permit to
Winter Properties Partnership, LLC and E. B. Knighton to expand mini-
warehouses to be located at 2205 Washington Avenue (Tax Map Nos. 61.15-2-
10.1 and 61.15-2-10) in the Vinton Magisterial District is substantially in accord
with the adopted 2000 Community Plan pursuant to the provisions of § 15.2-2232
of the 1950 Code of Virginia, as amended, and said Special Use Permit is hereby
approved with the following conditions:
(1) Eastern .9 acres of the original mini-warehouse development

buffer yard shall be installed between expansion area and

WHEREAS, the first reading of this ordinance was held on April 23, 2002
and the second reading and public hearing were held May 28, 2002; and
WHEREAS, the Roanoke County Planning Commission held a public
hearing on this matter on May 7,2002;
WHEREAS, legal notice and advertisement has been provided as required
by law.
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the zoning classification of approximately 7,883 square feet,
as described herein, of a certain tract of real estate located at the south side of
U.S. 11 at North Brook Drive (a portion of Tax Map No. 028.05-01-13) in the
Holiins Magisterial District, is hereby changed from the zoning classification of C-
2, General Commercial District, to the zoning classification of R-3C, Medium
Density Multi-Family Residential District, with conditions, for the construction of
townhouses.
2. That this action is taken upon the application of Barrens
Development Corporation.
3. That in 1983 the Owner of the property did petition to the Board of
Supervisors to amend the site plan and conditions (from a 1981 rezoning) for a
25.67-acre tract of land located in the Hollins Magisterial District in order to
include an additional 0.53 acres to the development; and
4. That the Owner of the property voluntarily proffered in writing the
following conditions which the Board of Supervisors of Roanoke County,
Virginia, hereby accepts:
a) The maximum number of dwelling units to be constructed on the
26.2 acre tract (original 25.67 acre tract plus an additional 0.53 acre

tract) shall be 146 units.
b) No dwelling unit shall have less than 1,100 square feet of gross
space.
c) No structure shall be higher than two stories. Dwelling units
shall be physically located on the 26.2 acres as shown and
specified on the plan submitted by the applicant for the April 1982
Planning Commission meeting.
d) No bridge or bridges will be constructed across Tinker Creek
from North Ardmore or Shadwell Drive.
e) No private sewer system or above ground sewage treatment
system shall be constructed on the 25.76 acres.
f) All units on the 25.76 acres shall be finished to grade.
g) The lighting for the pool and tennis courts will be directed and
screened to minimize its penetration into the residential
subdivisions known as North Ardmore and Waterfall Lake.
h) All structures to be constructed on the 25.76 acres where Tinker
Creek separates the 25.76 acres from the residential dwellings on
Biscayne Road will be set back at least 100 feet from the center of
Tinker Creek.
i) Along the perimeter of the 25.76 acres adjacent to Biscayne
Road and adjacent to the recreation areas along Shadwell Drive
will be landscaped in an appropriate manner to provide reasonable
screening of the 25.76 acres from the adjoining residential
subdivisions.
5. That said real estate is more fully described as follows:
BEGINNING at Point No. 28 on the east side of
Northbrook Drive, said point being corner to parcels 5 and
6 of the J. D. Fralin subdivision; thence with the line
between Parcels 5 & 6 of said subdivision, No. 64° 27 ' 06"
E. 260.65 feet to Point No. 16 on the property of LCP
Summerview, Inc. and being a corner to Lot 5 and 6 of
said subdivision; thence with the line between Parcel 5 and

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Nickens: He questioned whether traffic signal
upgrades at the Wal-Mart site on 220 and 604 would be completed prior to the
anticipated opening in August or September. Mr. Hodge indicated that the
upgrades would be in place prior to the opening,
Supervisor Church: (1) He advised that the Automated External
Defibrillators (AEDs) were in place at Tanglewood Mall and training for the use of
these was held on May 23. (2) He questioned the availability of a drop box at
the Administration Center for use by disabled citizens in making payments. Mr.
Hodge indicated that there was a box outside the Administration Center. (3) He
advised that he had received an e-mail from the Floyd County Board of
Supervisors indicating that they had passed the prayer resolution.

RESOLUTION 052802-10 CERTIFYING THE CLOSED MEETING
WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County, Virginia has
convened a closed meeting on this date pursuant to an affirmative recorded vote
and in accordance with the provisions of The Virginia Freedom of Information
Act; and
WHEREAS, Section 2.2-3712 of the Code of Virginia requires a
certification by the Board of Supervisors of Roanoke County, Virginia, that such
closed meeting was conducted in conformity with Virginia law.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Roanoke County, Virginia, hereby certifies that, to the best of each member's
knowledge:
1. Only public business matters lawfully exempted from open meeting

certification resolution applies, and
2. Only such public business matters as were identified in the motion
convening the closed meeting were heard, discussed or considered by the Board
of Supervisors of Roanoke County, Virginia.
