INRE: CALL TO ORDER Chairman Church called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Joseph B. INRE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF 360 June 11, 2002 AGENDA ITEMS Mr. Hodge added three items to the Closed Meeting pursuant to Section 2.2-3711 A (5) discussion concerning a prospective business or industry where no previous announcement has been made; and (7) consultation with legal counsel and briefings by staff members pertaining to probable litigation, namely (1) Whitlow and Roberts and (2) McNeil Storage Yard, Item M-5 on the agenda. Roanoke County's First Librarian. and in aDDreciation for more than 35 years of service. R-0611 02-1 Chairman Church presented the resolution to Diana Rosapepe, Library Director, on behalf of Mrs. Pedneau's family. She will deliver the resolution to Mrs. - Pedneau's nephew who was unable to attend the meeting. Supervisor McNamara moyed to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix June 11, 2002 361 RESOLUTION 061102-1 IN MEMORY OF BLANCHE PEDNEAU, ROANOKE COUNTY'S FIRST LIBRARIAN, THAN 35 YEARS OF SERVICE TO THE COUNTY BREWSTER FOR MORE WHEREAS, Mrs. Blanche Brewster Pedneau organized the first Roanoke County Public Library in 1932 from a donation of 350 books made by the Roanoke County Junior Woman's Club; and WHEREAS, she nurtured the library through difficult financial periods, even paying for staff and materials from her own funds, until it was firmly established; and WHEREAS, Mrs. Pedneau became the first director of the Roanoke County Library when it was chartered by the state of Virginia in 1945; and WHEREAS, through dedication and unfailing perseverance, Mrs. Pedneau was instrumental in the growth of the Roanoke County library system, establishing regular bookmobile services to reach all areas of the County and creative story hour programs to encourage children to love books and reading; and, WHEREAS, during Mrs. Pedneau's tenure, the library's collection grew from 350 books to approximately 100,000 volumes; and, WHEREAS, Mrs. Pedneau was an effective and consistent advocate for the approval of a 1967 bond referendum which laid the groundwork for the construction of the current system's Headquarters Library and branches; and WHEREAS, Mrs. Pedneau retired in 1967 after 35 years of dedicated serVice; and WHEREAS, Mrs. Pedneau passed away on Thursday, May 30, 2002, at the age of 99; and WHEREAS, she left an enduring legacy, the Roanoke County Public Library System, which has grown to include six libraries that together have become the most heavily-used system west of Richmond, with a combined collection of over 369,000 volumes and circulation exceeding 888,000 items annually. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, expresses its deepest appreciation and the appreciation of the citizens of Roanoke County for the life and contributions of Mrs. Blanche Brewster Pedneau. Resolution of Aooreciation to Paul B. Matthews. former Roanoke County's Executiye Officer. for more than 35 years of service. R-061102-2 Chairman Church presented the resolution to Mr. Hodge on behalf of Mr. Matthews who was unable to attend the meeting. Supervisor Flora and Mr. Hodge will deliver the resolution to Mr. Matthews. Supervisor Flora moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix RESOLUTION 061102-2 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO PAUL B. MATTHEWS, FORMER ROANOKE COUNTY EXECUTIVE OFFICER, FOR MORE THAN 35 YEARS OF SERVICE TO THE COUNTY WHEREAS, Paul B. Matthews' history of service to the Roanoke Valley began when he was first employed by Roanoke County as an Engineering Draftsman in 1939; and WHEREAS, Mr. Matthews began serving as Executive Officer of the County of Roanoke in 1943; and WHEREAS, Mr. Matthews was also active in the Civil Defense of Roanoke County, serving as a Plotting Officer in the Civil Defense Control Room during World War II and coordinating Roanoke County's Civil Defense program during the Korean War; and June 11, 2002 363 WHEREAS, Mr. Matthews presided over the administration of Roanoke County during a period of transition and growth in which the population doubled and the nural character of the County became increasingly suburban; and WHEREAS, Mr. Matthews was a member of the planning committee of the Roanoke Civic Center, helping to attract quality entertainment and fine arts performances to the Roanoke Valley; and WHEREAS, Mr. Matthews retired from the position of Executive Officer of Roanoke County in 1973 after 31 years of public service; and WHEREAS, Mr. Matthews was appointed to the Board of Supervisors in 1980 following a vacancy in the Hollins District; and WHEREAS, the Board of Supervisors of Roanoke County wishes to recognize the many contributions that Mr. Matthews has made to the County of Roanoke. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Paul B. Matthews for his capable, loyal and dedicated service to Roanoke County for more than thirty-five years. FURTHER, the Board of Supervisors does express its best wishes to Mr. Matthews. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix RESOLUTION 061102-3 OF CONGRATULATIONS TO RR DONNELLEY FOR ACHIEVING STAR WORKSITE STATUS IN THE VIRGINIA OCCUPATIONAL SAFETY AND HEALTH VOLUNTARY PROTECTION PROGRAM WHEREAS, RR Donnelley, a Fortune 500 Company, is the most technologically advanced, four color, book printing facility in the industry and one of the premier book printing facilities in the world; and WHEREAS, The Roanoke Manufacturing Division of RR Donnelley employs 235 employees in a 278,000 square foot facility located in Roanoke County; and WHEREAS, RR Donnelley was notified in November 2001, of the achievement of STAR worksite status in the Virginia Occupational Safety and Health Voluntary Protection Program (VPP), the highest designation in the VPP which recognizes its members as leaders in their respective industry in health and safety performance on injury and illness rates, management commitment, employee involvement and written procedures; and WHEREAS, The Roanoke Manufacturing Division holds the only STAR certification for all book printers in Region 3 which covers the states of Virginia, West Virginia, Delaware, and Maryland and will be the 16th site in Virginia to receive this award out of approximately 160,000 possible sites; and WHEREAS, RR Donnelley has a strong management commitment to safety culture and employee involvement, two of the key elements in achieving this status. NOW, THEREFORE BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, offers its congratulations to the Roanoke Manufacturing June 11, 2002 365 Division of RR Donnelley for achieving STAR worksite status in the Virginia Occupational Safety and Health Voluntary Protection Program; and FURTHER, the Board of Supervisors, in recognition of this outstanding achievement, declares June 24, 2002 as RR Donnelley Day in Roanoke County, the date that the Roanoke Manufacturing Division will celebrate its STAR worksite status designation. Windsor Hills Maaisterial District. (Arnold Coyey. Director of Community Develooment\ R-0611 02-4 Mr. Covey advised that in August 1999, Boone, Boone and Loeb, Inc., as part of the development of Fairway Forest Villas, extended Fairway Estates Drive by building a new road with a cul-de-sac. As a part of the VDOT requirements to move forward with the acceptance of this new extension of Fairway Forest Estates Driye, staff is asking that the Board (1) pass a resolution to accept the road for state maintenance 366 June 11, 2002 and (2) abandon and release VDOT from the maintenance of that portion of the cul-de- sac which is not needed. The developer has already proceeded with demolition of the cul-de-sac. The property has been restabilized and reseeded and if the next item on the agenda is approyed, it will be deeded over to the adjacent property owner. Staff is asking that the Board approve the resolution. There was no discussion. Supervisor McNamara moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix RESOLUTION 061102-4 TO REQUEST THAT THE VIRGINIA DEPARTMENT OF TRANSPORTATION ADD INTO THE SECONDARY SYSTEM OF STATE HIGHWAYS A NEW PORTION OF ROUTE 1388 (FAIRWAY ESTATES DRIVE) AND ABANDON THAT PORTION OF CUL-DE-SAC FOR ROUTE 1388 (FAIRWAY ESTATES DRIVE) WHICH NO LONGER SERVES THE PUBLIC NEED WHEREAS, Route 1388 (Fairway Estates Drive) has been altered by removal of the cul-de-sac and extension of the road, and WHEREAS, Roanoke County has provided a sketch dated June 4, 2002, depicting the addition and abandonment required in the secondary system of state highways as a result of this project, which sketch is attached hereto and hereby incorporated herein by reference, and WHEREAS, the new road serves the same citizens as that portion of old road identified by the project sketch to be abandoned and the segment of old road no longer serves a public need, and NOW, THEREFORE, BE IT RESOLVED, that this Board requests the Virginia Department of Transportation to add to the secondary system of state highways the extension of Route 1388 (Fairway Estates Drive). shown shaded on the attached sketch, pursuant to §33.1-229 of the Code of Virginia; and June 11, 2002 367 BE IT FURTHER RESOLVED, that this Board abandons as part of the secondary system of state highways that portion of cul-de-sac for Route 1388 (Fairway Estates Drive), identified by the sketch to be abandoned, pursuant to §33.1-155, Code of Virginia; and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Resident Engineer for the Virginia Department of Transportation. On motion of Supervisor McNamara to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix IN RE: FIRST READING OF ORDINANCES 1., First reading of ordinance yacatina and closina as oubUc riaht- of-way a oortion of cul-de-sac for Fairway Estates Driye adiacent to Lot 7. Block 2. Section 1. Fairway Forest Estates Subdiyision. and yacatina a 15 foot oubUc utility easement across said orooerty. located in the Windsor Hills Maaisterial District. (Arnold Coyey. Director of Community DeyeloDment. Mr. Covey advised that this is the second part of the resolution which was adopted earlier. He explained that in order to abandon or vacate any portion of a public right-of-way, the Board has to adopt an ordinance. Staff is asking for the Board to vacate that portion of the cul-de-sac that is not needed and also to vacate the public utility easement. He asked that the Board approve the first reading of this ordinance. In response to Supervisor McNamara's inquiry, Mr. Covey advised that the developer pays 368 June 11, 2002 fees to the County to proceed with the Board reports and for staff time. The developer also pays for the legal adyertisements and takes care of the plat preparation. There was no discussion. Supervisor McNamara moved to approve the first reading and set the second reading and public hearing for June 25, 2002. First readina of ordinance yacatina and closina an unimDrOyed and unused oortion of riaht-of-way known as Southern Pines Driye. Section 5. Southern Pines Subdivision. formerly Woodland Driye. located in the Caye Sorina Maaisterial District. (Arnold Coyey. Director of Community Deyelocment ) Mr. Covey advised that this is a subdivision that was platted in Plat Book 2 which dates back many years ago. Southern Pines Drive, north of South Mountain Drive, has never been developed and is currently heavily wooded. There is no plan to further develop Southern Pines Drive by extending it north of South Mountain Drive. Staff is recommending that the Board approve the vacation, subject to the reservation of June 11,2002 369 a 50-foot sewer, water, drainage, greenway, and public utility easement. He requested that the Board approve the first reading. In response to Supervisor McNamara's inquiry about actions like these creating land-locked parcels, Mr. Covey advised that staff determines that this will not be the case before they proceed with the abandonment or vacation. There are no land- locked parcels in this case. He also advised Supervisor McNamara that the beneficiaries of this action are the adjoining property owners. By state law if their lots were created as a part of the plat that created the right-of-way, the property would be divided 50-50 between them. Supervisor Church moved to approve the first reading and set the second reading and public hearing for June 25, 2002. Hewitt and Brittan R. Troutt. located in the Catawba 370 June 11, 2002 Maaisterial District. (Arnold Coyey. Director of Community DeYelooment) Mr. Covey advised that this is a request by the property owners to remove some of the encumbrances on their property. Staff has inspected the area and determined that the 15 foot drainage easement crossing the property is no longer necessary for proper storm water drainage of the area because there is no discharge of water from a public street onto the property and no drainage ditch exists. Staff has also contacted local utility companies and found that there were no objections to the closing of the 12 foot public utility easement on the property. He recommended that the Board approve and adopt the first reading of this ordinance. There was no discussion. Supervisor Church moved to approve the first reading and set the second reading and public hearing for June 25, 2002. First readina of ordinance authorizina and approYing assianment and acceotance of assianment of a lease aareement between East Main Street Prooerties. L.L.C.. and June 11, 2002 371 Blue Ridae Community Services for 381 sauare feet (Suite 207) of office soace in the Salem Bank & Trust Building at 220 East Main Street in Salem. (John Chambliss. Assistant Administrator) Mr. Chambliss advised that in May, 2001, the Board acquired the office building known as Salem Bank and Trust Building from East Main Street Properties, LLC. The building was received subject to numerous leases for office space, one of which was with Blue Ridge Community Services for space to house the coordinator for the Community and Policy Management Team which is part of the Comprehensive Services Act. On July 1, 2001, the Department of Social Services assumed responsibility for the coordinator but the County did not change the assignment of the lease at that time. The original lease was established in November 1998 and had five one-year extensions. Staff is recommending that the assignment be made from Blue Ridge Community Services to the County's Department of Social Services for the duration of the lease so that payments and reimbursements can be obtained from the state. There was no discussion. Supervisor Nickens moved to approve the first reading and set the second reading for June 25, 2002. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None 372 June 11, 2002 ABSENT: Supervisor Minnix IN RE: SECOND READING AND PUBLIC HEARING OF ORDINANCE 1., Second readinQ of ordinance to increase the salaries of the members of the Board of Suoervisors oursuant to Section 3.07 of the Roanoke County Charter and Section 15.2-1414.3 of the Code of Virainia. (Paul Mahoney. County Attorney) 0-061102·5 Mr. Mahoney advised that there has been no change since the first reading of the ordinance, and that the legal requirements for a public hearing have been satisfied. In response to Supervisor Church's inquiry, Mr. Mahoney clarified that the raise is $329 per year. Supervisor Flora commented that in 1972 when he was on the Board, the salary was $3,000 per year and that the pay has not kept up with rate of inflation. However, he advised that when you look at a 2.5% increase, it gives you an understanding of how citizens feel who are in the lower salary ranges. There were no citizens present to speak on this item. Supervisor Church moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None June 11, 2002 373 ABSENT: Supervisor Minnix ORDINANCE 061102-5 TO INCREASE THE SALARIES OF THE MEMBERS OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY PURSUANT TO SECTION 3.07 OF THE ROANOKE COUNTY CHARTER AND SECTION 14.1-46.01:1 OF THE CODE OF VIRGINIA WHEREAS, Section 3.07 of the Charter of the County of Roanoke provides for the compensation of members of the Board of Supervisors and the procedure for increasing their salaries; and WHEREAS, Section 15.2-1414.3 of the 1950 Code of Virginia, as amended, establishes the annual salaries of members of boards of supervisors within certain population brackets; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has heretofore established the annual salaries of Board members at $13,165.36 by Ordinance 061201-6 and further has established the additional annual compensation for the chairman for the Board to be $1,800 and for the vice-chairman of the Board to be $1,200; and WHEREAS, this section provides that the maximum annual salaries therein provided may be adjusted in any year by an inflation factor not to exceed five (5%) percent; and WHEREAS, the first reading on this ordinance was held on May 28, 2002; the second reading and public hearing was held on June 11, 2002. NOW, THEREFORE, it is hereby ORDAINED by the Board of Supervisors of Roanoke County, Virginia, that the annual salaries of members of the Board of Supervisors of Roanoke County, Virginia. are hereby increased by an inflation factor of 2.5% pursuant to the provisions of Section 3.07 of the Roanoke County Charter and Section 14.1-46.01: 1 of the 1950 Code of Virginia, as amended. The new annual salaries shall be $13,494.50 for members of the Board. In addition, the chairman of the Board will receive an additional annual sum of $1,800 and the vice-chairman of the Board will receive an additional sum of $1,200. This ordinance shall take effect on July 1, 2002. On motion of Supervisor Church to adopt the ordinance, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Nickens 374 June 11, 2002 IN RE: APPOINTMENTS 1., Board of Zonina Aooeals Supervisor Flora asked that Mr. Carlton Wright be contacted to determine if he wishes to serve another term. If he does want to serve another term, Supervisor Flora asked that the Deputy Clerk place his nomination on the agenda for approval at the next meeting. 2. Court-Community Corrections Alcohol Safety Action Proaram (ASAP) Policy Board Supervisor Nickens nominated Chief of Police Ray Lavinder to serve another two-year term which will expire July 1, 2004. 3. Grieyance Panel Supervisor McNamara asked that the Human Resources Department and the County Administrator provide the Board with names of several citizens for consideration to be nominated. 5. Virainia Western Community Colleae Board Supervisor Nickens advised that he has contacted the President of Virginia Western for suggested names and that he will have a citizen to nominate at the next meeting. That the certain section of the agenda of the Board of Supervisors for June 11,. 2002, designated as Item I - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 2, inclusive, as follows: 1. Request from Schools for appropriation of $5,883,778 for the 2002- 2003 Roanoke Valley Regional Special Education Board Budget. 2. Resolution of Congratulations to City of Salem in recognition of their 200'h Anniversary. That the Clerk to the Board is hereby authorized and directed where required by law to set forth upon any of said items the separate vote tabulation for any such item pursuant to this resolution. On motion of Supervisor Nickens to adopt the Consent Resolution, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix RESOLUTION 061102-6.b OF CONGRATULATIONS TO THE CITY OF SALEM IN RECOGNITION OF THEIR 200TH ANNIVERSARY 376 June 11, 2002 WHEREAS, the birth of Salem is dated to June 4, 1802, when James Simpson sold Susanna Cole a lot on Main Street at Cherry Alley for twenty dollars, marking the town's first real estate transaction; and WHEREAS, from the plots carved on land originally sold to Simpson by the son of Andrew Lewis, the town of Salem grew to become a popular outpost on the Great Road heading west; and WHEREAS, Salem became a formally incorporated town by an act of the General Assembly on March 21, 1836; and WHEREAS, Salem was named the county seat of the newly formed Roanoke County on March 30,1838, and remains so to this day; and WHEREAS, the City of Salem was formed on December 31, 1967, with a population of 22,500; and WHEREAS, Salem is today a thriving city of over 24,000 residents, rich in history and heritage; and WHEREAS, June 4, 2002, marked the 200th anniversary of the birth of the City of Salem; and WHEREAS, the City of Salem is a leader in tourism and sports marketing, boasting world class facilities and entertainment; and WHEREAS, the City of Salem is to be commended for the quality of life sustained by its residents and for its many contributions to the development and well being of the Roanoke Valley. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia does hereby extend our sincere congratulations to the City of Salem, Virginia, and its citizens, in honor and recognition of their 200th anniversary; and FURTHER, we extend our best wishes to the City of Salem and its citizens for continued success in their future endeavors. On motion of Supervisor Church to adopt the Certification Resolution, and carried by the following recorded vote: AYES: Supervisors Flora, McNamara, Nickens, Church NAYS: None ABSENT: Supervisor Minnix INRE: SENIOR CITIZENS HALL OF FAME AWARDS AND RECEPTION (4:00 P.M.) 380 June 11, 2002 Chairman Church advised that he would induct two Roanoke County residents age 60 and over who, through volunteer efforts, have improved the quality of life in their community into the Senior Citizens' Hall of Fame. He also advised that he would also induct into the Hall of Fame an organization that provides a service to senior citizens or provides services for the betterment of the community. The first award was presented to Del Kirschner, who is a full time volunteer with several programs: Appalachian Regional Blood Service Program, Volunteer Services Committee of the Roanoke Valley Chapter of the American Red Cross; League of Older Americans Tax Aide program; Senior Safety Program; Retired Senior Volunteer Program Advisory Council; and the Computer Club. The second award was presented to Rose Allen, who is a volunteer for the Girl Scouts of Virginia Skyline Council. She has held the following positions: Trefoil Registrar; Cookie Chairman for the Roanoke area; and manager of enrollment for the Dark Hollow Day Camp for Girl Scouts in the Roanoke Valley The third award was presented to the Master Gardener Association for the Horticultural Therapy Program and accepted by Shelby Snider. This is a new service that was developed within the past year.
