IN RE: CALL TO ORDER Chairman McNamara called the meeting to order at 3:02 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Joseph McNamara, Supervisors Joseph B. "Butch" Church, Bob L. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Mr. Hodge added a work session on the Rising Star Sports Camp (Item 4 h44 November 14,2000 under Public Hearings). Mr. Mahoney added two items to the Closed Meeting pursuant to Section 2.1-344 A (3) disposition of real estate; and 2.1-344 A (7) legal consultation concerning insurance coverage and volunteers in the county. Supervisor Johnson added an item to the Closed Meeting pursuant to Section 2.1-344 A (7) consultation with legal counsel - update on water contract with Botetourt County. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS L Proclamation declaring the week of November 12 - 18. 2000 as American Education Week. Chairman McNamara presented the proclamation to Maggie Angell, representing the Roanoke County Education Association. Supervisor Church moved to adopt the proclamation. November 14, 2000 h45 IN RE: NEW BUSINESS L Reauest to approve a resolution adoptina a Leaislative Proaram for the 2001 General Assemblv session. Mahonev. Countv Attornev) (Paul R-111400.1 Mr. Mahoney advised that this resolution is based upon previous legislative programs adopted by the Board but has been modified as follow: (1) adding provisions to address recent problems with the location of the proposed gas pipeline by requiring written notice to affected property owners, and expanding the authority of the State Corporation Commission to require joint use of existing easements; (2) supporting the distribution of state income tax collections to localities for their unrestricted use; and (3) deletion of several public safety items and other items previously adopted by the General Assembly. Mr. Mahoney reported that the General Assembly will be limiting the number of bills each delegate can introduce unless the bill has been prefiled. This was not supported by VACO but by members of the General Assembly. He announced that all but one delegate will attend the meeting scheduled for December 5. Supervisor Nickens advised that December 18 is the last date that a delegate can prefile a bill. Supervisor McNamara moved to adopt the resolution. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Church, Nickens, McNamara None ABSENT: Supervisor Minnix RESOLUTION 111400-1 ADOPTING A LEGISLATIVE PROGRAM FOR h46 November 14,2000 THE 2001 SESSION OF THE VIRGINIA GENERAL ASSEMBLY, AND PETITIONING THE GENERAL ASSEMBLY TO FAVORABLY CONSIDER THE TOPICS AND ISSUES ADDRESSED HEREIN WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has identified major legislative issues of state-wide concern to be considered by the 2001 session of the Virginia General Assembly; and WHEREAS, the Board adopts this resolution as its Legislative Program for the 2001 session of the Virginia General Assembly. NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Roanoke County, Virginia, that the following legislative initiatives are submitted for its legislative program for the 2001 session of the Virginia General Assembly for its favorable consideration and adoption. I. A. Education. Realizing that public education is the foundation of American democracy and the cornerstone of our future economic well being, the County urges the General Assembly to consider favorably the following actions. 1) The Constitution of the Commonwealth of Virginia should be amended to provide that elected school boards may be granted the authority and responsibility for taxation to support public education. 2) The General Assembly should enhance funding for public education, including increasing the funds available to the Literary Fund for local school capital construction or renovation projects. The General Assembly should increase funding for capital construction and renovation projects based upon the locality's local effort in support of these capital projects. 3) Local school divisions should be authorized to establish opening dates for school. 4) Disparity funding should be based not only upon the number of students eligible for free or reduced fee lunches, but also upon the locality's local tax effort in support of education. Disparity funding should be based upon the composite index (which measures a locality's relative fiscal ability to provide its share of the cost of a local school system that meets the standards of quality) and the locality's local effort in support of that school system. B. Public Service Corporations. 1) Roanoke County supports legislation to provide citizens better notice of proposed construction of public service corporation facilities. "Interested parties" requiring written notice should include property owners directly affected by the proposed location of new facilities. 2) Roanoke County supports legislation to provide the State Corporation Commission with expanded authority to require joint use of existing easements for the installation of new facilities of public service corporations. Further the grant of all certificates of public convenience and necessity and the right to exercise the power of eminent domain to acquire any lands or estates or interests therein shall be conditioned upon the future joint use of existing easements or rights-of-way. C. Environment. 1) Roanoke County supports amending Chapter 6.1, "Virginia Tire Tax" of Title 58.1, "Taxation" (a) to increase the tire tax from $.50 to $1.25, and (b) November 14, 2000 h47 to direct and authorize the Department of Waste Management to utilize the increased Waste Tire Trust Fund to remediate illegal or abandoned waste tire dumps. 2) Roanoke County supports allowing the disposal of land clearing vegetative debris (including tree stumps) in less expensive facilities in a manner not detrimental to the environment. D. Local Taxation and Funding. 1) County vigorously opposes any attempt to restrict or eliminate local sources of taxation, including personal property taxation and business and professional occupational licensing, unless local governments are guaranteed the opportunity to replace lost sources of local revenue with comparable, equivalent, independent sources of revenue to allow localities to fulfill their public service obligations. 2) Roanoke County supports restructuring the distribution of tax revenues in the Commonwealth, by returning a portion of the state income tax collections to localities for their unrestricted use. 3) Roanoke County supports continued and increased funding for the Comprehensive Services Act, the Virginia Community Juvenile Crime Control Act, the Family Preservation Act, local police departments (HB 599 funding), and the Regional Competitiveness Act. 4) Roanoke County requests funding for the Virginia Recreational Facilities Authority (Explore Park), Blue Ridge Parkway Interpretive Center, and capital construction funding for the Explore Park Education Center. 5) Roanoke County supports authority to impose an additional one-half percent (Y:.%) local option sales tax. 6) Roanoke County supports increased capital construction funding for regional juvenile detention facilities, and that such facilities receive at least 50% of their operating costs from the Commonwealth. 7) Roanoke County supports legislation amending Section 14.1-46.0:1 to increase the salary supplement for the Chairman of the Board of Supervisors from $1,800 to $2,500 per year. II. That the Clerk to the Board of Supervisors is directed to send a certified copy of this resolution to Senator John S. Edwards, Senator Malfourd W. "Bo" Trumbo, Delegate H. Morgan Griffith, Delegate Clifton "Chip" Woodrum, Delegate C. Richard Cranwell, Delegate A. Victor Thomas; Mary F. Parker, Roanoke City Clerk; Members of the Roanoke City Council; Forest Jones, Clerk for Salem City Council; Members of the Salem City Council; Clerk for the Town of Vinton; Members of the Vinton Town Council and the Fifth Planning District Commission, and the Virginia Association of Counties. On motion of Supervisor McNamara to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, Church, Nickens, McNamara NAYS: None ABSENT: Supervisor Minnix ~ Reauest to approve a construction contract and advance 6,48 November 14, 2000 ~ funds for the renovations at Glenvar Middle School. (Dr. Linda Weber. School Superintendent and Diane Hvatt. Chief Financial Officer) R-111400-2 Ms. Hyatt and Richard Flora, Roanoke County Schools, presented the report. Mr. Flora reported that the Schools received eight bids and on November 10, the School Construction Committee and School Board reviewed the bids and awarded the contract to Branch and Associates for $6,125,000. The contract is within the construction budget for Glenvar Middle School, and maintains the overall budget of $8,499,934 without two additional classrooms, estimated at $120,000. Proceeds from the state literary loan program and the Virginia Public School Authority wi/I be used to finance the project. Ms. Hyatt requested that the Board approve the resolution which requests an advance of $4,000,000 from the County for renovations to Glenvar Middle School and approval of the construction contract of $6,125,000. Supervisors Johnson and Church expressed pleasure at the bids. Supervisor Church suggested getting an exact cost figure for the two additional classrooms to determine whether to include them. Mr. Fiora advised that the $120,000 for the two classrooms is not a firm figure. Supervisor Church moved to adopt the resolution. November 14, 2000 64J) RESOLUTION 111400-2 TO ADVANCE FUNDS FOR CERTAIN EXPENDITURES MADE AND/OR TO BE MADE IN CONNECTION WITH THE ACQUISITION, RENOVATION, CONSTRUCTION AND EQUIPPING OF CERTAIN CAPITAL IMPROVEMENTS FOR SCHOOL PROJECTS WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia (the "County Board") adopted a resolution on August 19, 1997 declaring its intention to reimburse itself from the proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in connection with the acquisition, renovation, construction and equipping of certain capital improvements for school projects, and WHEREAS, the School Board (the "School Board") of the County of Roanoke, Virginia (the "County") adopted a resolution on August 28, 1997 declaring its intention to reimburse itself from the proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in connection with the acquisition, renovation, construction and equipping of certain capital improvements for school projects, and WHEREAS, the School Board requested an advance to award contracts of $318,000 for site development, $129,300 for architecture and engineering costs, value engineering, and surveying/testing, and $226,651 for project management for Glenvar Middle School, for a total advance of $673,951, on June 13, 2000, and WHEREAS, the School Board requested an advance to award contracts of $592,100 for site development, $500,000 for road construction, and $757,992 for project management for the new south county high school, for a total advance of $1,850,092, on June 13, 2000, and WHEREAS, the County Board approved an advance of $1 ,850,092 for the new south county high school and an advance of $673,951 for Glenvar Middle School on June 13,200~and WHEREAS, the School Board requested an advance of $9,500,000 to award the construction contract for the new south county high school for $19,094,000 on October 9,2000, and WHEREAS, the County Board authorized the School Board to enter into a construction contract for $19,094,000 and approved an advance of $9,500,000 for the new south county high school on October 10, 2000, and WHEREAS, the School Board now desire to award the construction contract for the renovations of Glenvar Middle School, and WHEREAS, the Schools Board requested an advance of $4,000,000 to award the construction contract for renovations at Glenvar Middle School for $6,125,000 on November 10, 2000, NOW THEREFORE BE IT RESOLVED, that the County Board approves the total budget for the Glenvar Middle School project of $7,819,767, authorizes the School Board to enter into a construction contract for $6,125,000, and advances the sum of $4,000,000, for renovations to Glenvar Middle School. Exit 132. FIRST READING OF ORDINANCES November 14, 2000 651 L First readina of ordinance to establish a utility service area in Clearbrook for water and sewer extensions. (Garv Robertson, Utilitv Director) Mr. Robertson reported that during the past year, there has been much interest for economic development projects within the Stable Road area. In order for this area to develop as a planned growth area, public water and sewer facilities will be critical in achieving the goal. Mr. Robertson explained that staff is proposing that these utilities be provided by Roanoke County with individual property owners paying their share at the time of development. This process would be very similar to recent petition projects in that a special service area would be established with separate fees. The differences are that the project is not the result of a direct petition by property owners and would not have 50% of the property owners participating at this time. The cost estimate for the project is $126,000 for water and $300,000 for sewer resulting in a total cost of $426,000. The special connection fee will be $7,700 for water extension and $11,800 for sewer line extension. These fees would be in addition to the normal off-site facility fees that would be charged by Roanoke County. Mr. Robertson requested that the Board approve construction of the water and sewer facilities to the area, establish a special service area, with special connection fees, and provide funding as a loan in the amount of $426,0006 for the project. The loan will be paid back to the general fund from the special connection fees as properties develop. Supervisor Nickens noted there will be a work session on the year-end surplus and suggested funding from that source rather than the general fund. 652 November 14.2000 Supervisor Johnson pointed out this was a loan and suggested that the amount be placed "below the line" in the general fund report until it is paid back. Ms. Hyatt responded that the loan will be repaid to the general fund and it could be included on the Fund Balance Sheet. Supervisor McNamara moved to approve the first reading and set the second reading and public hearing for December 5, 2000. Gladden was first employed by Roanoke County on December 1, 1980 as a Clerk Typist in the Social Services Department; and WHEREAS, Ms. Gladden retired from Roanoke County on October 1, 2000 as a Social Services Aide I in the Social Services Department after more than nineteen years of service; and WHEREAS, Ms. Gladden, through her employment with Roanoke County, has been instrumental in improving the quality of life for its citizens, by always displaying a genuinely positive attitude towards not only her job responsibilities but to the ever-changing Social Services environment; investing in the team concept; and consistently demonstrating a willingness to help others in her department and community. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to MARTHA A. SWORTZEL, POLICE DEPARTMENT 656 November 14, 2000 WHEREAS, Jeffrey M. Swortzel was first employed by Roanoke County on September 16, 1981 as a Deputy Sheriff in the Sheriffs Office; and has served as Deputy Sheriff Corporal; and Deputy Sheriff Sergeant, before transferring to the Police Department as a Police Officer; and WHEREAS, Sgt. Swortzel retired from Roanoke County on October 1, 2000 as a Police Officer Sergeant after more than nineteen years of service; and WHEREAS, Sgt. Swortzel was assigned to the first accreditation team for the Police Department and was instrumental in receiving the first accreditation in 1992; and WHEREAS, Sgt. Swortzel has been assigned to the School Services Unit for the past five years; was responsible for implementing many of the successful School-Police programs in place today; and worked very hard with the students to make the programs effective; and WHEREAS, Sgt. Swortzel, through his employment with Roanoke County, has been instrumental in improving the quality of life for its citizens. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to JEFFREY M. The work session was held from 4:55 p.m. until 5:30 p.m. An overview was presented by Lorraine Lange, chair of the steering committee, and members of the steering committee were present to respond to questions. There was discussion on various aspects of the six year improvement plan with emphasis on instruction. There was general consensus that any budgetary implications in the plan should be prioritized, including facilities and operations, by the next budget process. ~ Work Session to review the VDOT Secondarv Svstem Six-Year (\~ November 14, 2000 Construction Plan and revenue sharing projects. The work session was held from 5:35 p.m. until 5:50 p.m. and presented by Arnold Covey, George Simpson, Jeff Echols, VDOT. The following information was provided by County and VDOT staff: Roanoke County received approximately $3.6 million last year. Roanoke County's budget for FY 2001-2002 is estimated to be approximately $3.56 million. In Countywide Items, this category includes traffic signs, entrance culverts and rural addition roads. Because Roanoke County's rural addition list is very long, $180,000 was allocated, which is the maximum allowed by state law. Two projects from last year's list, Autumn Drive and Bluebird Lane, have been submitted to VDOT for construction and therefore removed from the list. Staff recommended that the following projects be added to this year's priority list; Leffler Lane, Dow Hollow Road, Uphill Drive and Grey Fox Lane. Staff will again be requesting the maximum allocation of $500,000 for the Revenue Sharing Program from the Commonwealth of Virginia. The majority of this year's priority list, FY 2001-2002, are projects that were not funded last year. Roads that have been completed or have received sufficient funds to be completed and are no longer on the six-year plan are Patterson Drive (Route 669) and the railroad crossing, flashing lights and gates on Layman Road (Route 606). Priority projects scheduled to receive funding this year are Hardy Road, Hollins Road, McVitty Road, Old Cave Spring Road, Colonial Avenue, Buck Mountain Road, Cotton Hill Road, Mountain View Road, Boones Chapel Road, Catawba Creek Road, Florist Road, Dry Hollow Road, Merriman Road, King Brothers Road and Rocky Road. Projects added to the plan are: November 14, 2000 665 . Buck Mountain Road - this project involves reconstruction of 0.14 miles of road and the intersection with Route 220. Staff is requesting that this project be added to the six-year plan because of the increased commercial activity in the area and the safety concerns. . Staff is requesting that this project be added because of increased traffic due to commercial development in the Hollins area and deteriorating condition of the bridge. . Starkey Road - reconstruct 1.05 miles of road. With the continued commercial and high density residential development along this corridor and the proposed opening of the South County Park Complex this spring, staff is recommending adding this project to the six-year plan. County Attorney) h7g November 14, 2000 : Mr. Mahoney advised that the State Code establishes the procedural requirements for organizations seeking tax exempt status. DePaul has submitted an application and materials to the County for tax exempt status. DePaul is a private non- profit child placing agency licensed by the State Department of Social Services and associated with Catholic Charities, USA. It provides specialized foster care for children and adolescents, day programs for mental retardation, and clinical services programs. DePaul will agree to execute an agreement with the County for the payment of a 20% service fee in lieu of taxation. Herb Beskar was present on behalf of DePaul Family Services. He reported that they contract with other jurisdictions to place children, and they have one building located in North Roanoke County. They have a staff of 100 employees, 200 children under their care and a statewide budget of $9 million. Supervisor Nickens advised he was not supporting the request because of the large operating budget which could cover the real estate taxes. Supervisor McNamara advised he did support the request because of the services they provide to the Roanoke Valley. Supervisor Johnson felt he did not have enough information to make a decision and suggested delaying action until the December 5 meeting. Supervisor Nickens asked for information on the compensation of DePaul employees. Supervisor Johnson moved to delay action until the December 5, 2000 meeting so that staff can check out the operation, look at the compensation of employees and provide a site map. County Planner) 0-111400-7 Mr. Harrington reported that in September, several housing developers and design engineers raised questions about the maximum building coverage regulations in the R1 zoning district with respect to zero lot line subdivisions. They pointed out that while the zero lot line options allows up to a 20% reduction in lot area for individual lots, the maximum allowable building coverage was not adjusted accordingly which resulted in less allowable building footprint than if they chose a standard building design. In October, the Planning Commission approved an amendment to the use and design standards for Zero Lot Liine, and Single Family Attached development that would offer a greater maximum building coverage for lots less than 7,200 square feet. Since then, 672 November 14, 2000 staff was asked to reconsider the threshold of 7,200 below which maximum building coverage would be increased to 40%. The increase to 40% is not being disputed but the 7,200 square foot threshold created inconsistencies. At their November 7 Public Hearing the Planning Commission concurred to delete the threshold of 7,2000 square feet lot area. Supervisor McNamara moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Minnix, Church, Nickens, McNamara None ORDINANCE 111400-7 AMENDING AND REENACTING THE ZONING ORDINANCE OF THE COUNTY OF ROANOKE VIRGINIA BY THE MODIFICATION OF STANDARDS FOR ZERO LOT LINE AND SINGLE FAMILY ATTACHED SUBDIVISION DEVELOPMENT IN RESIDENTIAL ZONING DISTRICTS WHEREAS, in 1992, the Roanoke County Board of Supervisors adopted a new zoning ordinance for Roanoke County, including standards for zero lot line and single family attached housing developments within the county; and, WHEREAS, The Roanoke County Planning Commission has considered increasing allowable building coverage in zero lot line and single family attached housing developments; and, WHEREAS, public necessity, convenience, general welfare, and good zoning practice support an amendment to the Zoning Ordinance of the County of Roanoke to allow increased building coverage in zero lot line and single family attached housing developments; and, WHEREAS, the Planning Commission held a public hearing on this amendment on November 7,2000; and, WHEREAS, the Roanoke County Board of Supervisors held first reading of this ordinance on October 24, 2000, and second reading and public hearing on November 14,2000; and, WHEREAS, public notice and advertisement of this amendment has been provided as required by Section 15.2-2204 of the Code of Virginia, and the Roanoke County Code. Countv Planner) 0-111400-8 Mr. Harrington advised that at the Planning Commission hearing, eight citizens spoke on behalf of the request stating that they have children at Rising Star and that the facilities and programs offer a unique experience for children. Mr. Mike Wray, speaking on behalf of the citizen committee, reported that the citizens generally support the conditions jointly negotiated by Mr. Pollack and them. Ms. Deb Smith explained that the neighborhood is not "anti-children" but that the issue has always been one of zoning compliance. The Planning Commission recommended approval with changes to the conditions pertaining to the required trees and fence. Ed Natt, attorney for the petitioners, complimented the residents and Mr. Pollack for their work in reaching agreement. Supervisor Johnson asked if approval of the Special Use Permit would squash Judge Strickland's ruling, and Mr. Natt responded affirmatively. The following citizens spoke on the proposed Special Use Permit: .L Ms. Deb Smith. 5512 Yellow Mountain Road. who lives adjacent to the sports camp was reluctant to allow the Roanoke Steam to practice there but willing to wait and see the impact. 2., Mike Wrav. 5650 Yellow Mountain Road, described the negotiations between the sports camp and the residents. Since negotiations were completed, another issue is the use of the sports camp by the Roanoke Steam. Following a meeting on November 12, the citizens are willing to support this use with six additional conditions November 14, 2000 675 added to the ordinance. ;i. The camps will operate 6:00pm to 9:00pm Monday thru Friday. The gate will close at 9:30 pm, except during indoor soccer season, (November 15 - February 15) when operating hours will be to 10:00pm and the gate shall close at 10:30pm. Saturday hours shall be from 9:00am to 9:00pm. (Gate shall close at 9:30pm). Sunday hours shall be 1 :OOpm to 6:00pm except during indoor soccer season (November 15 - February 15) when operating hours shall be until 9:00pm (Gate shall close at 9:30pm). All camps shall be run by Rising Star staff. All camp enrollments shall be individual. All instruction shall be given by Rising Star staff. Sinale Function Clinics A. Single function clinics of up to a maximum of four (4) hours would be permitted during operating hours. Weekend Tournaments A. No more than 8 outdoor (3 Fall, 3 Spring, 2 Summer) and 16 indoor tournaments shall be held during any calendar year. All tournaments (except Commonwealth Games) shall be sponsored and operated by Rising Star. No more than 20 teams shall participate in any indoor tournament. No more than 10 teams shall participate in any outdoor tournament. Pre-registration, with Rising Star, shall be required for all tournament teams. Rising Star shall not allow or encourage the parking of any vehicle associated with Rising Star on Yellow Mountain Road. This parking prohibition shall be publicized in Rising Star publications and newsletters. No alcoholic beverages shall be allowed on the property. No outside vendors shall be allowed on Rising Star property. No professional or semi-professional sports teams shall be allowed to play or practice at Rising Star except Roanoke Steam, subject to the following conditions: 1. No other professional sports team would be allowed to practice at Rising Star other than the Roanoke Steam due to its uniqueness. There would be no alcohol or profanity allowed. No loud speakers permitted. No buses would be allowed for transportation of the Roanoke Steam. Use of the Rising Star facility would be within the operating hours of 9:00 a.m. to 10:00 p.m. 6. This would be one season limit for year 2001 only. Holiday Closinqs A. Rising Star shall be closed on the following holidays: New Year's Day, Easter, Memorial Day, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day. Activity Supervision A. Rising Star's personnel shall be present in a supervisory role at the site at all times. Phvsical Development A. The site shall be developed generally in accord with a concept plan entitled" Concept Plan, Pollock Soccer Camp, Yellow Mountain Road, Prepared by Lang Engineering, and dated June 19, 1997. A 4-foot high chain link fence shall be installed on the property line along the entire length of the two athletic fields, where these fields adjoin Roanoke County Tax Parcel 98.04-1-23, said parcel currently owned by Donald Dean. The fence will be installed by August 2001. A maximum of 12, 6-foot tall pine trees shall be planted and maintained, and evenly spaced along the mutual property line of Darlene Overstreet (98.04-1-21.1), where said property line abuts (6) B. Planner) 0-111400-~ Mr. Beard reported that in 1999 the Board of Supervisors requested a comprehensive study of the Colonial Avenue Corridor. Staff developed a range of special corridor design guidelines under a mixed use concept of existing residential and well-designed, carefully located commercial projects. The guidelines recommended preservation of the overall residential character of the corridor through appropriate site layout, architectural treatment, landscaping, lighting and signage. The design guidelines were approved by the Planning Commission on July 5, 2000 and the Commission also approved proposed revisions to the future land use map. The citizen- based Colonial Avenue Alliance reviewed and voiced support for the proposed revisions to the future land use map and the proposed design guidelines at meetings held on November 14,2000 679 September 21, 2000 and October 4, 2000. .L Mark Harrell. 3716 Colonial Avenue. advised his only concern was that eight properties were cut in half with four designated as Neighborhood Conservation and four designated Transition, and this could cause problems in the future. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Minnix, Church, Nickens, McNamara None ORDINANCE 111400-11 AUTHORIZING THE VACATION OF A PORTION OF AN EXISTING 20-FOOT WATER LINE EASEMENT AND A PORTION OF AN EXISTING 20' SANITARY SEWER EASEMENT AND ACCEPTANCE OF THE RELOCATED PORTIONS OF SAID 20' EASEMENTS ACROSS PARCEL 1B-1-A OF PETERS CREEK COMMERCIAL PARK (PLAT BOOK 22, PAGE 137; TAX MAP NO. 37.08-1-6.3) WHEREAS, by subdivision plat entitled 'PLAT SHOWING NEW PARCELS "1B-1-A" & "TRACT 2" BEING A RESUBDIVISION OF PARCEL "1B-1" (P.B. 21 PG.92) PETERS CREEK COMMERCIAL PARK,' dated November 1, 1999, and recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in Plat Book 22, page 137, a "NEW 20' WATERLINE EASEMENT" and a "NEW 20' SANITARY SEWER EASEMENT" were dedicated and shown across Parcel "1 B-1-A", said parcel being designated upon the Roanoke County Land Records as Tax Map No. 37.08-1-6.3; and, WHEREAS, the Petitioner, The Branch Family, LLC, is the owner of Parcel "1B-1-A", Peters Creek Commercial Park; and, WHEREAS, due to the location of a concrete pad with fuel tanks within the area of the above-described original easements, the water and sewer lines for Peters Creek Commercial Park were relocated by the Petitioner; and, WHEREAS, the Petitioner has requested that, pursuant to §15.2-2272.2 of November 14, 2000 683 - the Code of Virginia (1950, as amended), the Board of Supervisors of Roanoke County, Virginia, vacate the affected portions of the existing 20' water line easement and 20' sanitary sewer easement, and accept in exchange a new 20' public water line easement and a new 20' sanitary sewer easement across Parcel "1 B-1-A", Peters Creek Commercial Park; and, WHEREAS, this vacation will not involve any cost to the County and the affected County departments have raised no objection; and, WHEREAS, notice has been given as required by § 15.2-2204 of the Code of Virginia (1950, as amended), and the first reading of this ordinance was held on October 24, 2000; the public hearing and second reading of this ordinance was held on November 14, 2000. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That portions of the existing 20' water line easement and 20' sanitary sewer easement on Parcel "1B-1-A", Peters Creek Commercial Park (Tax Map No. 37.08-1-6.3), dedicated by 'PLAT SHOWING NEW PARCELS "1B-1-A" & "TRACT 2" BEING A RESUBDIVISION OF PARCEL "1 B-1 " (P.B. 21 PG. 92) PETERS CREEK COMMERCIAL PARK,' dated November 1, 1999, and recorded in the aforesaid Clerk's Office in Plat Book 22, page 137, and being shown cross-hatched and designated as "EXIST. PUBLIC WATER LINE ESMT. TO BE VACATED" and "EXIST. PUBLIC SAN. SEWER ESMT. TO BE VACATED" on 'Plat Showing New 20' Waterline Easement & New 20' Sanitary Sewer Easement', dated July 11, 2000, attached hereto as Exhibit A, be, and hereby is, vacated pursuant to § 15.2-2272 of the Code of Virginia (1950, as amended), subject to the conditions contained herein. 2. That, in exchange, acquisition and acceptance of a new 20' water line easement and a new 20' sanitary sewer easement across Parcel "1B-1-A", Peters Creek Commercial Park (Tax Map No. 37.08-1-6.3), being designated and shown as "CL NEW 20' PUBLIC WATERLINE ESMT." AND "CL NEW SAN. SEWER ESMT. TO BE DEDICATED" on Exhibit A attached hereto, be and hereby is, authorized and approved; and, 3. That all costs and expenses associated herewith, including but not limited to publication, survey and recordation costs, shall be the responsibility of the Petitioner. 4. That the County Administrator, or an Assistant County Administrator, is hereby authorized to execute such documents and take such actions as may be necessary to accomplish the provisions of this ordinance, all of which shall be on form approved by the County Attorney. 5. That this ordinance shall be effective on and from the date of its adoption, and a certified copy of this ordinance shall be recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia, in accordance with §15.2-2272.2 of the Code of Virginia (1950, as amended). On motion of Supervisor Johnson to adopt the ordinance, and carried by the following recorded vote: AYES: Supervisors Johnson, Minnix, Church, Nickens, McNamara NAYS: None 684 November 14,2000 .- IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Johnson: (1) He asked Director of Parks, Recreation and Tourism Pete Haislip about the improvements to Brookside Park. Mr. Haislip updated the Board on the improvements. (2) He asked Mr. Haislip to check on the poor condition of flags at the Brambleton Center and possibly other County buildings. (3) He advised that he was unimpressed with the new County signs at various County boundary lines and liked the old ones better. Supervisor Minnix: (1) He advised that he has received a number of calls from citizens who have requested an acceptable required time when trash receptacles are removed from the road after trash collections. (2) He advised that he has received correspondence from people supporting the appropriation of matching funds for Greenway grants. Supervisor Church: (1) He expressed appreciation with the funding of renovations to Glenvar Middle School and the recognition of golf champ Alan May from Glenvar High School. He also announced that the Glenvar High School girls basketball team, the Glenvar High School football team, the Northside High School football team and the Northside High School girls basketball teams all had outstanding seasons. Supervisor Nickens: (1) He advised that in the future the Virginia Association of Counties and the National Association of Counties dues will be assessed together resulting in reduced dues for Roanoke County. (2) He announced that the VACo Insurance Program will be purchasing a building in downtown Roanoke to locate permanently. (3) He thanked the Board members for their endorsement of him to serve as a VACO regional director. Supervisor McNamara: (1) He announced that following the budget work November 14, 2000 685 = sessions, the Board will return to Open Session to take action on two items. (2) He advised that the County has a surplus because they used conservative revenue projections, and that they will consider funding items with the surplus that are tied to investment return. Based upon the policy for rollover of year end savings, the departments were able to request up to 60% of the savings within their own departments which totaled $233,235, leaving a net savings of $224,701. After funding $723,267 as part of the original 2000- 2001 budget appropriation, a balance of $2,639,382 will be added to the general fund unappropriated balance. Mr. Robertson advised that the County can expect revenues in excess of budget for 2000-01 of $2,820,284 with the largest surplus in personal property taxes. 686 November 14, 2000 '== There was discussion on the rollover requests from the departments. It was the consensus of the Board to approve all the departmental rollover requests except for upgrade of video equipment in the Board of Supervisors meeting room and funding for election precinct workers. These dollars were to remain in the departments' rollover but not spent for these uses. There was discussion on funding for Roanoke River Greenway funding. There was no consensus and a work session was scheduled for December 19, 2000. IN RE: RETURN TO OPEN SESSION AT 10:05 P.M. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Minnix, Church, Nickens, McNamara None RESOLUTION 111400-12 APPROPRIATING AND DONATING PUBLIC FUNDS TO THE ROANOKE COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY TO PAY INTEREST EXPENSE FOR THE VALLEY GATEWAY SHELL BUILDING WHEREAS, the Board of Supervisors of Roanoke County, Virginia, ("the County") and the Industrial Development Authority of Roanoke County ("the Authority") November 14, 2000 687 = desire to promote and encourage the economic development of Roanoke County, Virginia, and the Roanoke Valley by the recruitment of new industry for the Roanoke Valley, in order to provide for increased employment and corporate investment in the County; and WHEREAS, this increased employment and investment constitutes a valid public purpose for the expenditure of public funds; and WHEREAS, the County desires to support these economic development efforts of the Authority by donating public funds to the Authority in accordance with the provisions of § 15.2-1205 of the Code of Virginia. WHEREAS, by an agreement between the Authority, the County, F&W Properties II, Inc., and the Greater Roanoke Valley Development Foundation ("the Foundation") a shell building was constructed at Valley Gateway. This agreement provides that the Authority will begin making the interest payments on the construction ioan held by the Foundation beginning two years after the completion of construction (November 11, 2000) and continuing until either (a) the building is sold, or (b) the Foundation's five year note to the Authority has become due (May 15, 2002). NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $45,000 is hereby appropriated and donated to the Authority. That this appropriation of public funds is made from funds available and previously appropriated in the County's Public Private Partnership account. 2. That this appropriation and donation to the Authority is made for the following economic development purposes: to pay the interest payments on the construction loan held by the Foundation on the shell building in Valley Gateway from November 11, 2000 through June 30, 2001. 3. That the appropriate officers or agents of the County are hereby authorized and directed to take such actions as may be necessary to accomplish the purposes of this resolution, and all actions taken by such officers and agents in connection with this transaction are hereby ratified and confirmed. 4. That this resolution shall take effect immediately.
