HomeMy WebLinkAbout10/10/2000 - Special October 10,2000 6JlJ Roanoke County Administration Center 5204 Bernard Drive Roanoke, Virginia 24018 October 10, 2000 The Board of Supervisors of Roanoke County, Virginia, met this day at the Montgomery County Courthouse, Christiansburg, Virginia, this being an adjourned meeting from the regular meeting on the second Tuesday of the month and a joint meeting with the Montgomery County Board of Supervisors who were already meeting in open session. IN RE: CALL TO ORDER Vice Chairman Minnix called the Board of Supervisors to order at 7:15 p.m. The roll call was taken. MEMBERS PRESENT: Vice Chairman H. Odell "Fuzzy" Minnix, Supervisors Joseph B. "Butch" Church, Bob L. Johnson, Harry C. Nickens MEMBERS ABSENT: Chairman Joseph McNamara STAFF PRESENT: Elmer C. Hodge, County Administrator; Paul M. Mahoney, County Attorney; Dan O'Donnell, Assistant County Administrator MONTGOMERY COUNTY BOARD OF SUPERVISORS: Chair Mary W. Biggs, Vice Chair Larry N. Rush, Supervisors John A. Muffo, Annette S. Stewart 602 October 10,2000 MEMBERS ABSENT: None MONTGOMERY COUNTY STAFF PRESENT: Jeffrey Johnson, County Administrator; Carol Edmonds, Assistant County Administrator; Martin McMahon, County Attorney INRE: CLOSED MEETING At 7:27 p.m., Supervisor McNamara moved to go into Closed Meeting pursuant to Code of Virginia Section 2.1-344 A (7) discussion with legal counsel and briefing by staff concerning probable litigation, Virginia Gas Pipeline. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Minnix, Church, Nickens NAYS: None ABSENT: Supervisor McNamara IN RE: OPEN MEETING AND ADOPTION OF CERTIFICATION RESOLUTION R·101000·3 At8:10 p.m., Supervisor Johnson moved to return to open meeting and adopt the Certification Resolution. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Minnix, Church, Nickens NAYS: None ABSENT: Supervisor McNamara RESOLUTION 101000·3 CERTIFYING THE CLOSED MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA October 10, 2000 603 - WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such closed meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting which this certification resolution applies, and 2. Only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Board of Supervisors of Roanoke County, Virginia. On motion of Supervisor Johnson to adopt the Certification Resolution; and carried by the following recorded vote: AYES: Supervisors Johnson, Minnix, Church, Nickens NAYS: None ABSENT: Supervisor McNamara INRE: ACTION TO FILE A MOTION WITH THE STATE CORPORATION COMMISSION CONCERNING THE PROPOSED VIRGINIA GAS PIPELINE Supervisor Church offered the following motion: BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby authorizes the County Attorney to file a Motion with the State Corporation Commission supporting and urging the State Corporation Commission to grant the Motion requesting the State Corporation Commission to reconsider and reopen the certification process for the Virginia Gas Pipeline (Case No. PUE 990167) proposed to go through Montgomery and Roanoke Counties that was filed by certain citizens residing in the Counties of Montgomery and Roanoke for the following reasons: 604 October 10, 2000 1. Virginia Gas failed to comply with the statutory notice provisions of the Code of Virginia, which resulted in a lack of notice to the citizens of Montgomery and Roanoke County affected by the pipeline. 2. Misrepresentation on the part of Virginia Gas concerning the scope and extent of the proposed gas pipeline easement that has been offered to citizens of Montgomery and Roanoke County affected by the pipeline. 3. Request the State Corporation Commission to reconsider and reopen the certification process in order to address the environmental impacts that were previously identified by the Department of Environmental Quality. 4. Request the State Corporation Commission to reconsider and reopen the process in order to address the possibility of Virginia Gas Pipeline co-locating within the existing gas easements of Duke Energy when appropriate. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Minnix, Church, Nickens NAYS: None ABSENT: Supervisor McNamara IN RE: ADJOURNMENT At 8:14 p.m. Vice Chairman Minnix adjourned the meeting.
