Good afternoon and welcome to our meeting for March 8, 2005. Regular meetings are
held on the second Tuesday and the fourth Tuesday at 3:00 p.m. Public hearings are
held at 7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule
will be announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. The meetings are

RESOLUTION EXPRESSING THE APPRECIATION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY UPON THE RETIREMENT OF C.
DENNIS FISHER, FIRE AND RESCUE DEPARTMENT, AFTER TWENTY-
SEVEN YEARS OF SERVICE
WHEREAS, C. Dennis Fisher was first employed by Roanoke County on May
4, 1977 as a firefighter, and advanced to the rank of Captain; and
WHEREAS, Captain Fisher retired from Roanoke County on February 1,
2005, after twenty-seven years and nine months of services; and
WHEREAS, Captain Fisher was instrumental in Roanoke County being a
lead agency for a state regional hazardous materials team when this program was
instituted in the 1980's and continued serving as a team leader the entire time the County
participated through 1991; and
WHEREAS, Captain Fisher completed the FEMA Emergency Management
Professional Development Series (PDS) Program, receiving a PDS certificate which is
accomplished through classes delivered through the Virginia Dept of Emergency
Management (VDEM) and independent study courses through the Federal Emergency
Management Institute (EMI); and
WHEREAS, Captain Fisher has performed a crucial role in protecting the life
and property of citizens in one of the most hazardous professions, and Roanoke County is
very fortunate to have benefited from his dedication and many years of experience; and
WHEREAS, Captain Fisher has served with professionalism and integrity and
has been instrumental in improving the quality of life for the citizens of Roanoke County.

NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia, expresses its deepest appreciation and the appreciation of the
citizens of Roanoke County to C. DENNIS FISHER for more than twenty-seven years of
capable, loyal and dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best wishes for a
happy and productive retirement.

PROCLAMATION DECLARING THE MONTH OF MARCH 2005 AS
PURCHASING MONTH IN ROANOKE COUNTY
WHEREAS, the purchasing and materials management professions play a
significant role in the efficiency and effectiveness of both government and business; and
WHEREAS, purchasing and materials management professionals, through their
combined purchasing power, spend billions of dollars every year and have a significant
influence upon economic conditions throughout the world; and
WHEREAS, the National Institute of Governmental Purchasing, Inc. (NIGP), the
Virginia Association of Governmental Purchasing (V AGP), and other professional
purchasing associations throughout the world engage in special efforts, during the month of
March, to inform the public about the importance of the role played by the purchasing
profession in business, industry and government.
NOW, THEREFORE WE, the Board of Supervisors of Roanoke County, Virginia, in
recognition of the achievements of purchasing and materials management professionals,
do hereby proclaim the month of March 2005 as PURCHASING MONTH, and call its
significance to the attention of all citizens; and
FURTHER, the Board expresses its appreciation to the Roanoke County Purchasing
Department for its dedication to promoting ethics in public purchasing and saving tax

SUMMARY OF INFORMATION:
The City of Roanoke has been sponsoring an annual Household Hazardous Waste Day in
the Roanoke Valley for the past several years. A private contractor accepts the hazardous
waste from citizens, and disposes of it appropriately, which prevents those items from
being placed in the Smith Gap Landfill. The other local governments have assisted with
this event, and citizens from Roanoke, Vinton, Roanoke County, Salem and Botetourt
County have participated.
Staff from the localities have now agreed to rotate the responsibility for planning the event
and to hold it at the Transfer Station of the Roanoke Valley Resource Authority.
Household Hazardous Waste Day will occur three times per year, and participants will be
required to preregister in order to control the traffic situation in that area. The event will
take place on a Sunday, so it will not interfere with regular operations at the Transfer
Station. For the past two years, Roanoke County has taken the lead in arranging for the
event.
In order to use the Resource Authority property, some changes need to be made to the
Members Use Agreement, which is the contract between the Resource Authority and the
participating localities. A copy of the proposed amendment is attached.

The change to the Members Use Agreement specifically allows the Authority to sponsor or
issue a permit to an entity to sponsor a Household Hazardous Waste Day at the Hollins
road facility. This will allow for the hazardous waste to be accepted, but not stored or
disposed of on the site by a contractor, and also allow for residents of Salem and Botetourt
to participate. Since those two localities are not members of RVRA, special permission is
needed to accept their waste at the site.
The City of Roanoke, the Town of Vinton, and the Resource Authority will also have to
agree to this change. The City has determined that the City's Operating Criteria for the
Transfer Station will allow for acceptance of the waste and the Sunday Hours.
FISCAL IMPACT:
This change to the Member Use Agreement has no fiscal impact. Roanoke County
currently pledges $27,057 towards the event. This is consistent with what has been
pledged in recent years.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the attached amendment to the Roanoke Valley
Resource Authority members Use Agreement.

RESOLUTION AUTHORIZING THE FOURTH AMENDMENT TO
ROANOKE VALLEY RESOURCE AUTHORITY MEMBERS USE
AGREEMENT
WHEREAS, the parties hereto entered into the Roanoke Valley Resource
Authority Members Use Agreement dated October 23, 1991 (the "Members Use
Agreement"), as amended by First Amendment to Roanoke Valley Resource Authority
Members Use Agreement, dated as of June 1, 1992, Second Amendment to Roanoke
Valley Resource Authority Members Use Agreement, dated December 2, 1996, and
Third Amendment to Roanoke Valley Resource Authority Members Use Agreement,
dated February 1, 1999, among the Authority, the County, the City, and the Town under
which the Authority agreed to acquire, construct and equip a regional waste disposal
system consisting of a landfill and transfer station and related structures and equipment,
and to provide financing therefor in order to dispose of all nonhazardous solid waste
delivered to the System by or on behalf of the County, the City and the Town
(collectively, the "Charter Members"); and,
WHEREAS, the parties desire to amend the Members Use Agreement to allow
the Authority to issue permits to entities to sponsor and conduct a Household
Hazardous Waste Collection Day event at the Hollins Road Transfer Station site up to 3
times per calendar year and otherwise in compliance with applicable law.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

1. Approval of Amendment. The Board of Supervisors hereby approves the
Fourth Amendment in substantially the form attached to this Resolution as Exhibit A.
The County Administrator and such officers and agents as he may designate are
authorized and directed to execute and deliver the Fourth Amendment and the Clerk to
the Board of Supervisors is authorized to seal and attest the Fourth Amendment with
such changes as such officers deem appropriate to carry out the purposes expressed
therein.
2. Effective Date. This Resolution shall take effect immediately.

FOURTH AMENDMENT TO
ROANOKE VALLEY RESOURCE AUTHORITY
MEMBERS USE AGREEMENT
This Fourth Amendment to Roanoke Valley Resource Authority Members Use
Agreement (the "Fourth Amendment") is made as of , by and among the
Roanoke Valley Resource Authority, as successor to the Roanoke County Resource Authority
(the "Authority"), the County of Roanoke, Virginia, the City of Roanoke, Virginia, and the Town
of Vinton, Virginia, each of which are political subdivisions of the Commonwealth of Virginia.
RECITALS
WHEREAS, the parties hereto entered into the Roanoke Valley Resource Authority
Members Use Agreement dated October 23, 1991 (the "Members Use Agreement"), as amended
by First Amendment to Roanoke Valley Resource Authority Members Use Agreement, dated as
of June 1, 1992, Second Amendment to Roanoke Valley Resource Authority Members Use
Agreement, dated December 2, 1996, and Third Amendment to Roanoke Valley Resource
Authority Members Use Agreement, dated February 1, 1999, among the Authority, the County,
the City, and the Town under which the Authority agreed to acquire, construct and equip a
regional waste disposal system consisting of a landfill and transfer station and related structures
and equipment, and to provide financing therefor in order to dispose of all nonhazardous solid
waste delivered to the System by or on behalf of the County, the City and the Town (collectively,

In consideration of the foregoing, the Authority and the Charter Members each agree as

ARTICLE I
Amendment
1. The Members Use Agreement is hereby amended to provide, that
notwithstanding any other term or provision to the contrary, and for as
long as the Series 1992, 1998, and 1999 Revenue Bonds are outstanding
under the Indenture of Trust, upon the affirmative vote of all City and
County representatives on the Authority, the Authority shall be authorized
to sponsor or to issue an appropriate permit to an entity to sponsor and
conduct a Household Hazardous Waste Collection Day event at the
Hollins Road Transfer Station site up to 3 times per calendar year and
otherwise in compliance with applicable law, and such permit may allow
for participation by properly authorized residents of jurisdictions other
than the Charter Member jurisdictions and to include such other terms and
conditions as deemed by the Authority to be in its best interests.

ARTICLE II
Miscellaneous
2.1 Severability of Invalid Provisions. If any clause, provision or section of
this Fourth Amendment is held to be illegal or invalid by any court, the
invalidity of the clause, provision, or section will not affect any of the
remaining clauses, provisions or sections, and this Fourth Amendment will
be construed and enforced as if the illegal or invalid clause, provision, or
section had not been contained in it.
2.2 Counterparts. This Fourth Amendment may be executed in any number of
counterparts, each of which, when so executed and delivered, will be an
original, and the counterparts taken together will constitute one and the
same instrument.
2.3 Governing Law. This Fourth Amendment shall be governed by the laws of
the Commonwealth of Virginia.
2.4 Amendments. This Fourth Amendment may be amended only In
accordance with the provisions of the Members Use Agreement.

SUMMARY OF INFORMATION:
In February 2005, the Board of Supervisors approved by consensus the development of an
automatic aid agreement between Roanoke County and Roanoke City to provide enhanced
services to citizens in both jurisdictions. Implementation of this agreement will require the
addition of eight (8) Paramedic/Firefighter positions and the upgrade of three (3) existing
positions at a cost of $450,000 for salaries, benefits. scheduled overtime, uniforms,
physicals, and pagers.
In addition, the coverage for the Cave Spring and Bent Mountain areas was discussed and
four additional paramedic/firefighter positions are needed to provide enhanced coverage
from the Back Creek Station to both areas. Implementation of these personnel will cost an
additional $225,000.00 for salaries, benefits, scheduled overtime, uniforms, physicals, and
pagers. The total staffing request to accomplish both of these goals is twelve (12)
positions and funding totaling $675,000.

In order to address this necessary funding, the staff is recommending that the Board of
Supervisors approve an adjustment to the ambulance transport fee schedule, bringing the
ambulance transport fee for the County in line with that of the City of Roanoke. The
additional revenue generated by this adjustment, along with additional collections from
increased call volume and efficiency efforts, is projected to be sufficient to cover the cost
for all twelve (12) personnel. No recipient of ambulance service who cannot afford to pay
the ambulance transport fees will be required to do so.
The proposed new rate schedule is as follows:
· Advanced Life Support (ALS) Transport $330.00
· Advanced Life Support (ALS) II Transport $475.00
· Basic Life Support (BLS) Transport $280.00
· Mileage $9.00 per mile with a maximum charge of $75.00
FISCAL IMPACT:
Increased rates for ambulance transport fees are projected to be sufficient to cover all
costs associated with the approval and employment of twelve (12) paramedic/firefighter
positions needed to implement the Automatic Aid Agreement with the City of Roanoke and
to provide enhanced coverage in the Back Creek, Bent Mountain and Cave Spring areas.
ALTERNATIVES:
Without the approval of the revised schedule for ambulance transport fees, we will be
unable to proceed with the automatic aid agreement with the City of Roanoke, and will be
unable to provide enhanced services to citizens in the Back Creek, Bent Mountain, and
Cave Spring areas.
STAFF RECOMMENDATION:
Staff recommends the approval of the attached resolution adopting a revised schedule of
ambulance transport fees to provide additional revenue for staffing and a consistent rate
structure between Roanoke County and Roanoke City.

RESOLUTION ADOPTING A REVISED SCHEDULE OF
AMBULANCE TRANSPORT FEES AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, the Board of Supervisors enacted a Fee for Services ordinance as
an addition to the Roanoke County Code on May 22, 2001, which established the legal
structure for providing emergency medical transport services and accompanying fees as
provided for by the Code of Virginia; and
WHEREAS, Section 2-131 of this ordinance, contained in Chapter 2
Administration of the Roanoke County Code, provides that the Board of Supervisors, by
resolution, may establish reasonable fees for the provision of emergency medical
services by all emergency medical service personnel, whether provided by volunteers or
public employees, upon the recommendation of the County Administrator and the Chief
of Fire and Rescue; and
WHEREAS, the Board of Supervisors adopted a resolution on August 14, 2001,
which resolution was revised on March 26, 2002 by Resolution 032602-2, and on March
25, 2003 by Resolution 032503-8, upon the joint recommendation of the County
Administrator and the Chief of Fire and Rescue for the establishment of reasonable fees
for the provision of various levels of emergency medical services, including mileage
fees for vehicles; and
WHEREAS, the U. S. Department of Health and Human Services has issued
regulations, effective April 1, 2002, which establish a fee schedule for the payment of
ambulance services under the Medicare program based upon specific codes or

categories of ambulance services which must be complied with to receive Medicare
reimbursements.
NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. The fees which shall be charged by the County of Roanoke for the
following described emergency medical services provided by Roanoke County owned,
operated, funded, housed or permitted emergency vehicles shall be as follows:
Advanced Life Support (ALS) 1 Emergency $330.00
Advance Life Support (ALS) 2 Emergency $475.00
Basic Life Support (BLS) Emergency $280.00
Mileage: $9.00 per mile with a maximum charge of $75.00.
2. No recipient of ambulance service who cannot afford to pay the
ambulance transport fees will be required to do so.
3. This resolution shall be in full force and effect on and after April 1 f 2005.

SUMMARY OF INFORMATION:
Currently, information regarding EMS calls is completed by a written method and couriered
to the fire administration office on a daily basis. Data entry is completed twice for each
form and then forwarded to the Virginia Office of EMS to meet reporting requirements
mandated by the State of Virginia. The same form is photocopied and the original form is
couriered to the third party billing agency to generate the appropriate insurance claims for
ambulance transport fees. Once this process is complete, the original form has to be
returned to its originating agency resulting in down time and costs associated with hand-
carrying these forms to many different locations.
Creating further complications, effective July 2004, the Federal government's Medicare
program instituted stringent requirements for submission of Medicare reimbursement
claims. Roanoke County has the potential to loose approximately $300,000 per year if we
are unable to electronically submit medical reports to Medicare. By implementing this
system, data could be entered by the responders and transmitted electronically from the
originating agency to the fire administration office for Medicare compliance, HIPM
compliance, and quality assurance issues.
This information can also be electronically transmitted to the third party billing agency
resulting in a more accurate billing to insurance companies for the citizens and the
electronic transfer of files to the Virginia State Office of EMS to meet their requirements.

FISCAL IMPACT:
The total amount of the system is projected to be $185,000. The Fire and Rescue
department will allocate $30,000 from their existing budget to apply to this purchase. An
additional $155,000 would need to be appropriated from the Minor Capital Fund to the Fire
and Rescue Department to purchase the hardware and software to implement an EMS
Data Reporting System.
ALTERNATIVES:
Without the approval of $155,000 in funding, the Fire and Rescue Department would be
unable to complete the purchase and implement the EMS Data Reporting System resulting
in non-compliance and loss of revenue.
STAFF RECOMMENDATION:
Staff recommends appropriating $155,000 from the Minor Capital Fund. This amount will
be combined with the department's existing budget allocation of $30,000 to purchase and
implement the EMS Data Reporting System which will result in efficiency, increased
collections, and compliance with Federal regulations.

§30-5 of the Roanoke County Zoning Ordinance provides that the County
Planner shall serve as the Zoning Administrator with all of the duties and
responsibilities for administration and enforcement of the Zoning Ordinance.
The zoning administrator shall have the following powers and duties:
1. Zoning permit. To issue or deny a zoning permit for the erection,
construction, reconstruction, moving, adding to, or alteration of any structure, or
the establishment of any land use. The administrator shall also have the authority
to revoke any zoning permit if violations of the provisions of this ordinance occur.
2. Certificate of zoning compliance. To issue or deny a certificate of
zoning compliance.
3. Collect fees. To collect any fees required or set forth in this
ordinance.

4. Making and keeping records. To make and keep all records
required by state law or necessary and appropriate. for the administration of this
ordinance.
5. Inspection of buildings or land. To inspect any building or land to
determine if violations of this chapter have been committed or exist.
6. Enforcement. To enforce this ordinance and take all necessary
steps to remedy any condition found in violation of the provisions of this
ordinance.
7. Request assistance. To request the assistance of other local and
state officials or agencies in the administration and enforcement of this
ordinance.
8. Interpretation. To interpret the official zoning map and provisions of
this ordinance, and offer written opinions on their meaning and applicability.
The position of "County Planner" had been abolished several years ago. An
ordinance amending §30-5 and deleting the reference to the "County Planner"
will be submitted to the Board.
On June 12, 2001, the Board authorized the appointment of David Holladay as
Interim Zoning Administrator. The Director of the Department of Community
Development has reorganized the Planning Division. A current planning/zoning
section and a long-range planning section have been created. Janet Scheid,
Chief Planner, supervises the Planning Division. John Murphy as Zoning
Administrator will supervise the current planning/zoning section and David
Holladay as Senior Planner will supervise the long-range planning section.
Staff is requesting that the Board of Supervisors appoint John Murphy as Zoning
Administrator for Roanoke County; that it rescind its previous appointment of
David Holladay as Zoning Administrator; and that it authorize the appointment of
such deputy zoning administrators as Mr. Murphy may deem appropriate.
STAFF RECOMMENDATION:
It is recommended that the Board favorably consider the adoption of the attached
resolution.

County under an agreement with the Virginia Department of Transportation. The
proposed easement will contain a concrete V-ditch, pipes, and other drainage structures
that will be maintained by VDOT.

WHEREAS, Roanoke County staff is coordinating the development of the Center for
Research and Technology; and,
WHEREAS, the Commonwealth of Virginia requires a drainage easement on the
County's property along Glenmary Drive as shown on a plat prepared by Lumsden
Associates, P.C. entitled "Plat Showing New Permanent Drainage Easement (9,917 sq.ft.)
to be granted to the Commonwealth of Virginia" dated November 1, 2002; and,
WHEREAS, the proposed drainage easement will serve the interests of the public
and is necessary for the public health, safety, and welfare of citizens of the County of
Roanoke.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the acquisition and disposition of real estate can be authorized only by ordinance.
A first reading of this ordinance was held on March 8, 2005, and a second reading was
held on March 22, 2005.
2. That pursuant to the provisions of Section 16.01 of the Charter of Roanoke
County, the interests in real estate to be conveyed are hereby declared to be surplus, and
are hereby made available for other public uses by conveyance of a drainage easement to

the Commonwealth of Virginia for the completion of reconstruction of Glenmary Drive in
connection with Roanoke County's development of the Center for Research and
Technology.
3. That donation to the Commonwealth of Virginia of a drainage easement on

"Plat Showing New Permanent Drainage Easement (9,917 sq. ft.) to be granted to the
Commonwealth of Virginia," prepared by Lumsden Associates, P .C., and dated November
1 , 2002, is hereby authorized and approved.
4. That the County Administrator, or any Assistant County Administrator, is
hereby authorized to execute such documents and take such further actions as may be
necessary to accomplish this conveyance, all of which shall be on form approved by the

SUMMARY OF INFORMATION:
U.S. Cellular currently owns an 80 foot tower located on Twelve O'clock Knob, and wishes
to sell it to the County. It is no longer useful to the company for cellular phone technology,
but is ideally located for the County's new paging system, and will also be useful for the
future digital radio system.
U.S. Cellular leases the .25 acre on which the tower is located, and will assign the lease to
the County if this purchase is approved. The lease is fully assignable, with an initial term
until 2016, and an extension until 2026. The rent is currently $722 per month, and
escalates based on the Consumer Price Index.
Staff and U.S. Cellular have negotiated a purchase price of $25,000, which is less than the
estimated $175,000 it would cost to purchase land and construct a suitable tower nearby.
U.s. Cellular has also requested that the County begin paying the lease as of March 1,
2005.

FISCAL IMPACT:
The purchase price is $25,000, plus the rent of $722 for March, 2005, which is available in
the account for the new paging system. The rent on the land is currently $8,664 annually,
and that funding is also available in the paging system account for the first year.
STAFF RECOMMENDATION:
Staff recommends that the Board approve the purchase of this tower, and agree to the
assignment of the lease currently held by U.S. Cellular for the property on which the tower
stands.

ORDINANCE APPROVING AN AGREEMENT FOR

WHEREAS, the implementation of a new paging system for Roanoke County
government departments will necessitate additional transmitter locations not currently
owned or under lease by the County, including 12 O'clock Knob; and
WHEREAS, Ohio State Cellular Phone Company, Inc., D/B/A United States
Cellular Wireless Communications ("U.S. Cellular"), currently has a ground lease
agreement permitting the construction and operation of a communications antenna
tower at the top of 12 O'Clock Knob in the County of Roanoke, Virginia, which lease
expires on December 31, 2016, and which lease also contains an option for renewal of
said lease for an additional ten (10) years; and
WHEREAS, U. S. Cellular has offered to sell its antenna tower and related
equipment and personal property on 12 O'Clock Knob and assign its leasehold interests
to Roanoke County for the sum of Twenty-Five Thousand Dollars; and
WHEREAS, the acquisition of this antenna tower and equipment and the existing
leasehold interest for this tower site will provide a necessary antenna site for the
County's new paging system and avoid additional costs and potential delays to be
anticipated from the acquisition of another tower site.
WHEREAS, the first reading of this ordinance was held on March 8, 2005, and
the second reading was held on March 22, 2005.

THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board hereby approves the purchase of a communications
antenna tower and related equipment located on 12 O'Clock Knob in
Roanoke County and the execution of an assignment of lease with Ohio
State Cellular Phone Company, doing business as United States Cellular
Wireless Communications, in substantially the form as attached to this
ordinance, and authorizes the County Administrator, or his designee, to
execute this Agreement on behalf of Roanoke County, upon a form as
approved by the County Attorney.
2. The County is authorized to assume all responsibilities under the existing
lease with the property owner, including payment so all rents, as of March
1 , 2005.
3. This ordinance shall be effective from and after the date of its adoption.

As part of the construction of Hidden Valley High School it was necessary to realign
Pleasant Hill Drive. For the purpose of location and construction or other improvements
to Pleasant Hill Drive, the County School Board of Roanoke County acquired certain
portions of land for right-of-way purposes.
At their meeting on January 26, 2005, the County School Board declared the above-
mentioned portions of land acquired for right-of-way purposes to be surplus property,
thus allowing the Board of Supervisors to obtain ownership of the property upon
approval of an ordinance and recordation of a deed.
Once the Board of Supervisors has ownership to this real estate, it must convey this
real estate to the Commonwealth of Virginia (VDOT) in order to accept this street into
the secondary system of state highways.

FISCAL IMPACT
The reconstruction of Pleasant Hill Drive to serve Hidden Valley High School was done
as a VDOT revenue sharing project. In July 2000, the Roanoke County School Board
submitted $200,000 to VDOT as the local share for a qualified project of $400,000.
Because of timing concerns, the work was actually done with a contract amendment to
the Counts & Dobyns contract and paid by the Schools. On May 22, 2001, the Board
adopted a resolution approving a County-State Agreement with VDOT to construct
these improvements. This current action needs to be taken in order to recover the
$400,000 from VDOT (less $47,533.80 of expenses incurred by VDOT). This money
will be returned to the School Capital Account, where is it currently budgeted as a
receivable from VDOT, since the funds have already been spent.
STAFF RECOMMENDATION:
It is recommended that the Board favorably consider the adoption of the attached
ordinance.

SUMMARY OF INFORMATION:
The Roanoke County Code regulates parking at the courthouse parking lot.
Although it grants authority to ticket vehicles parked in violation of the Code, it
does not provide specific authority to remove or tow vehicles that are parked in
violation. This ordinance grants specific authority to the Sheriff to remove
vehicles parked in violation of the Code.
The authority to remove vehicles is important not only for enforcement purposes
but also is critical to public safety and security for the courthouse and jail
buildings.
STAFF RECOMMENDATION:
Staff recommends the favorable consideration of the adoption of this ordinance.

ORDINANCE AMENDING DIVISION 3. COURTHOUSE PARKING LOT
OF ARTICLE III. PARKING OF CHAPTER 12. MOTOR VEHICLES AND
TRAFFIC OF THE ROANOKE COUNTY CODE TO PROVIDE FOR A
NEW SECTION 12-76. AUTHORIZATION TO REMOVE VEHICLES
WHEREAS, § 46.2-1221 of the Code of Virginia grants authority to counties by
ordinanc'e to regulate parking on county-owned or leased property; and
WHEREAS, the Roanoke County Code does not specifically authorize the
removal or towing of vehicles parked in violation of the County Code at the courthouse
parking lot; and
WHEREAS, the power to remove vehicles from the courthouse parking lot is
critical to public safety and the security of the courthouse parking lot; and
WHEREAS, the first reading of this ordinance was held on February 22, 2005;
and the second reading was held on March 8, 2005.
NOW, THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County as follows:
1. That Division 3. Courthouse Parking Lot of Article III. Parking of Chapter
12. Motor Vehicles and Traffic is hereby amended by the addition of a new section,
Section 12-76, authorization to remove vehicles as follows:
Section 12-76.
Any vehicle parking in violation of this chapter may be moved or caused to be
removed by the Sheriff, or any person deputized by the Roanoke County Sheriff to
enforce the provisions of this ordinance, from the present location of the vehicle to
another area of the courthouse parking lot or such other location as the Sheriff

designates. Any vehicle so moved or removed shall be released to the owner or
operator thereof upon proper identification by that person and payment of the costs of
removing the vehicle. Neither the County nor the Sheriff shall be liable for any damages
to the removed vehicle which might result from the act of removal unless such damages
resulted from the gross negligence of the County or the Sheriff in such removal.
2. That this ordinance shall take effect from and after the date of its adoption.

The refugee school impact grant is a federal grant that supports educational programs for
students enrolled in our division that we have identified as being refugees. This grant
allows the district to offer support to students and their families with the goals of assisting in
a smooth transition to our community and of becoming proficient in the reading, writing,
listening, and speaking of English.
Roanoke County Public Schools has been awarded $8,850.
FISCAL IMPACT:
The instruction budget will be increased by $8,850.

SUMMARY OF INFORMATION:
Roanoke County Schools currently collaborates with Family Service of Roanoke Valley to
implement both school-based and after school service learning opportunities for our
students. The service work of our students has made a positive impact in our community.
Roanoke County Schools, working together with Family Service, is piloting the concept of
helping the elderly live more safely. State Farm and Youth Service America support our
efforts by providing a $5,000 grant to fund this pilot project.
The program will not only benefit the elderly, it will also benefit academically at-risk
students. The project targets middle school students, the majority of whom are
economically disadvantaged and/or disabled high risk youth. By building on student's
strengths, our school system can reduce the likelihood of negative developmental
outcomes.
FISCAL IMPACT:
The amount of the grant award is $5,000. There is no in-kind match required and no
additional money is required to be expended.

SUMMARY OF INFORMATION:
The School Board entered into a contract with Pepsi to provide vending services to
Roanoke County Schools. As a part of that contract, Pepsi agreed to support several
programs include "Safe and Drug Free Schools".
The Transportation Department applied for a grant to put cameras on buses. Pepsi
approved $11 ,550 to install ten (10) cameras. The Guidance Department applied for a
grant to print charts and stickers utilizing a critical incident color code system. Pepsi
approved $1 ,105 to fund the purchase of charts and critical incident color code stickers.
The Transportation Department has used bus cameras for approximately ten years. The
cameras have proven to reduce student misconduct on the buses. The Roanoke County
Public Schools utilizes a critical incident color code system when an event occurs that
requires individuals in a school to seek safety. The color code is reproduced on charts and
a sticker that is placed on staff identification badges. This enables school employees with
easy accessibility to code directions in case a violent or safety incident occurs during
school hours.
FISCAL IMPACT:
Pepsi has approved $11 ,550 for bus cameras and $1 ,105 to fund the purchase of critical

AI M. Cooper Construction, Inc., the developer of Parker Estates, requests that the Board
of Supervisors approve a resolution to the Virginia Department of Transportation (VDOT)
requesting that they accept 0.07 mile of Gavin Circle, from the intersection with Texas
Hollow Road, Route 641, to its cul-de-sac.
The staff has inspected this road, along with representatives ofVDOT, and finds the road is
acceptable.
FISCAL IMPACT:
No County funding is required.
STAFF RECOMMENDATION:
The staff recommends that the Board approve a resolution to VDOT requesting that they
accept Gavin Circle into the secondary road system.

VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM
WHEREAS, the streets described on the attached Addition Form SR-5(A), fully
incorporated herein by reference, are shown on plats recorded in the Clerk's Office of the
Circuit Court of Roanoke County, and
WHEREAS, the Resident Engineer for the Virginia Department of Transportation has
advised this Board the streets meet the requirements established by the Subdivision Street
Reauirements of the Virginia Department of Transportation,
WHEREAS, the County and the Virginia Department of Transportation have entered
into an agreement on March 9, 1999 for comprehensive stormwater detention which applies
to this request for addition,
NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia
Department of Transportation to add the streets described on the attached Additions Form
SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of

SUMMARY OF INFORMATION:
The Roanoke County Fire and Rescue Department applied for grant funding through the
Virginia Department of Fire Programs. These grants are intended to provide local
jurisdictions with funding for various training needs. The Fire and Rescue Department was
awarded $4,500 to complete the purchase of three replacement computers for the Roanoke
Valley Regional Fire/EMS Training Center.
Updating these computers is essential to keep pace with the ever-changing and improving
technology. Failure to maintain these upgrades results in incompatibility with presentation
and training software necessary to conduct classes at this facility.
FISCAL IMPACT:
There was no fiscal impact; the cost of the computers is covered at 1000/0 up to $4,500 by
the Department of Fire Programs grant.

SUMMARY OF INFORMATION:
The Roanoke County Fire and Rescue Department applied for grant funding through the
Department of Homeland Security. These competitive grants are intended to provide local
jurisdictions with funding for equipment that provides interoperability with other jurisdictions.
The Fire and Rescue Department was awarded $30,000 toward the purchase of radio
equipment. This equipment will allow for interoperability with other Virginia jurisdictions in a
wide-spread natural or man-made disaster.
FISCAL IMPACT:
There will be no fiscal impact since the cost of the radio equipment is funded through the

SUMMARY OF INFORMATION:
The Roanoke County Fire and Rescue Department applied for grant funding through the
Virginia Department of Fire Programs. These grants are intended to provide local
jurisdictions with funding to repair/renovate existing burn buildings, a .training prop crucial
for realistic scenarios of firefighting techniques. The Fire and Rescue Department was
awarded up to $15,250 to complete these repairs.
Bids will need to be completed in accordance with County purchasing guidelines. Once
the bid is awarded and repairs are 50% complete, Fire and Rescue will request 50% of the
awarded amount. Upon 1 00% completion of the repairs, Fire and Rescue will request the
balance of the grant funding.
FISCAL IMPACT:
There was no fiscal impact; the cost of the repairs is covered at 100% up to $15,250 by the
Department of Fire Programs grant.

SUMMARY OF INFORMATION:
The County has received notification of a grant award from the Department of Criminal
Justice services (DCJS) in the amount of $190,865 to establish a Functional Family
Therapy program for Roanoke County families in need. The grant is the first year of a five-
year program that will provide intensive family counseling for families with juveniles who
may otherwise be facing expensive out of home placements.
The grant is renewable for up to five years. There is no local match for the first three
years. The fourth year has a 25% local match and the fifth year has a 50% local match
should the County wish to continue the program for those years. If the program proves not
to be successful, it can be cancelled after the third year. Blue Ridge Behavioral Healthcare
will be providing the counseling services and the County will serve as fiscal agent. The
intent of this program is to provide more intensive in-home therapy services for juveniles
who otherwise would be faced with out-of home placements at a far greater cost.
This program will be coordinated with the Community Policy Management Team (CPMT)
process.

FISCAL IMPACT:
As there is no direct match for the first three years of the program and the intent of the
program is to decrease the costs of out of home placements, there will be positive fiscal
impact for the County.
STAFF RECOMMENDATION:
Staff recommends that the Board of Supervisors accept the grant award from DCJS and
appropriate the funds.

COUNTY ADMINISTRATOR'S COMMENTS:
This is a public hearing to receive input regarding the budget for purposes of budget
planning and also to meet the schedule for getting tax bills prepared and mailed to citizens.
The budget review process will continue and will include meetings with departments, as
well as a number of work sessions which have been scheduled with the Board; therefore,
staff will work within the tax rates which are adopted by the Board.
At the public hearing, the tax rates will not be adopted in order to allow time for the citizens
input and recommendations that are received at this meeting to be taken into consideration.
The actual setting of the tax rates is scheduled to occur at the March 22, 2005 meeting.
SUMMARY OF INFORMATION:
As requested at an earlier work session, staff advertised the proposed Real Estate,
Personal Property, and Machinery and Tools Tax Rates for calendar year 2005 as follows:
Real Estate Tax at a rate of not more than $1.12 per one hundred dollars assessed
valuation.
Personal Property Tax at a rate of not more than $3.50 per one hundred dollars
assessed valuation.
Machinery and Tools Tax at a rate of not more than $3.00 per one hundred dollars
assessed valuation.

In addition, state code mandates that when reassessment of real property in a locality
results in a real estate revenue increase of 1 % over the previous year, the locality must
either reduce the tax rate, so that the revenues are no more than 101 % of the previous
year's or hold a public hearing indicating an "effective" real property tax increase.
Also, consistent with past practices, the Board has expressed a desire to hold a public
hearing to elicit "general" comment on the upcoming annual budget development process.
This hearing gives citizens the opportunity to express their priorities and concerns for the
Board to consider during formulation of the upcoming budget.
The public hearings scheduled for today are for receiving written and oral comment on
these three topics.
The public hearing on proposed Tax Rates was advertised on February 22 and March 1,
2005, the "Effective" Real Estate Tax Rate Increase was advertised on March 1,2005, and
the General Comment for the FY2005-2006 Budget was advertised on March 1, 2005,
thereby satisfying state code requirements for public notice.

budget. These hearings will allow citizens the opportunity to comment on various items
that impact development of the upcoming budget--assessments, tax rates, funding
priorities, increases in revenues, etc.

Tax Rates
· The tax rates were advertised at the County's current rates. The Board may not
adopt tax rates above these advertised rates, (without re-advertisement and another
public hearing), but could adopt tax rates less than the advertised rates. Adoption of
