The Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the
second Tuesday, and the first regularly scheduled meeting of the month
of January, 1995.

Supervisor Eddy requested addition of a resolution
supporting the establishment of a small business incubator in the
Roanoke Valley.
Supervisor Johnson requested an amendment to the
legislative program opposing the charter schools bill.
Supervisor Eddy expressed opposition to adding the
amendment as proposed by Supervisor Johnson, and felt that it
should not be considered at this time.
Chairman Minnix ruled
that the issue could be heard at this meeting.

RESOLUTION 11095-1 OF APPRECIATION TO LEE B. EDDY
FOR HIS SERVICE AS 1994 CHAIRMAN
OF THE BOARD OF SUPERVISORS
WHEREAS, Lee B. Eddy served as Chairman of the Roanoke
County Board of Supervisors during 1994; and
WHEREAS, during Mr. Eddy's term as Chairman, the County
achieved a variety of accomplishments, including:
o Dedication of the Clifford D. Craig Memorial Dam
and the beginning of construction of the water
treatment plant at the Spring Hollow Reservoir;
o Completion of several important projects including
renovations to the Hollins Library, the opening of
Valley TechPark and Explore Park, and major road
improvements to Routes 220 and 11/460;
o Increased emphasis on regionalization efforts
resulting in quarterly meetings with other Roanoke
Valley governments, and the signing of a joint
sewage treatment plant contract; and
o Establishment of programs to protect the Valley's
natural resources for future generations by the
enactment of a Roanoke River Conservation overlay
District, involvement in protecting the mountain
ridgelines and Blue Ridge Parkway viewshed, and
development of a Community Visioning Process.
WHEREAS, Mr. Eddy also worked diligently during his
term to represent all the ci tizens of Roanoke County and to

promote regional projects which would benefit all the residents
of the Roanoke Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Supervisors of Roanoke County, Virginia, does hereby extend its
deepest appreciation to LEE B. EDDY for his service as Chairman
during 1994 and for his belief in democracy and participation by
citizens in local government.
On motion of Supervisor Kohinke to adopt the

RESOLUTION 11095-2 OF APPRECIATION TO CONGRESSMAN
BOUCHER FOR SECURING ECONOMIC DEVELOPMENT GRANT FOR
VALLEY TECHPARK

WHEREAS, Rick Boucher has served the Ninth District of
virginia in the united States Congress since 1982 and has
represented western Roanoke County since 1992, and
WHEREAS, Congressman Boucher has been involved in
economic development throughout the Ninth District, and has
established the Showcase Southwest Virginia program, wherein
potential employers are introduced to communities and their
industrial facilities, and
WHEREAS, this program was instrumental in the location
of two major employers within the Ninth District, and
WHEREAS, Roanoke county is in the process of
constructing the first phase of Valley TechPark, a publicly owned
industrial park strategically located to create jobs for the
residents of both the Roanoke and New River Valleys, as well as
to provide a link between Virginia Tech and the Roanoke Valley,
and
WHEREAS, Congressman Boucher has been involved in
securing funds for industrial park development throughout the
Ninth District, and recently was instrumental in obtaining
$150,000 from the Department of Housing and Urban Development for
the purpose of completing Phase I of the Valley TechPark
improvements.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
to CONGRESSMAN RICK BOUCHER for his efforts in securing these

funds as well as for his efforts to showcase Roanoke County to
potential
expanding
and
relocating
technologically
based
companies.

The Presentation was made by Beth Doughty, Executi ve
Director of the Roanoke Valley Economic Development Partnership,
and John Williamson, President.
Ms. Doughty reported that the
Roanoke Valley was leading Virginia in job creation.
Inquiries
were up in 1994 by 8 percent, and inquiries from advertising and
direct mail increased 173 percent.
She advised that three
prospects had located in Roanoke County during 1994:
Hanover
Direct Domestications and Apparel, John Deere Health Care and
ITT-Gallium Arsenide, and five new prospects located elsewhere in
the Roanoke Valley.

Ms. Hyatt advised that on June 28, 1994 the Board of
Supervisors adopted a resolution supporting the Roanoke Valley
Regionalization Group hiring a consultant to provide a study of
services provided by each local government, and develop a list to
be considered for regionalization. Towers Perrin was selected to
conduct the study at a cost of $30,000. Ms. Hyatt reported that
the business community agreed to split the cost on a fifty-fifty
matching basis with the participating localities paying their
share. Roanoke County's share amounts to $3,000.
Supervisor Nickens moved to approve the $3,000
appropriation. The motion carried by the following recorded

Mr. Chambliss reported that one of the bay doors at the
Clearbrook Fire and Rescue station had failed recently. It was
determined that the glass style bay doors should be replaced with
energy efficient panel doors. Four stations use the same style
doors and staff recommended that all of these be replaced. Mr.
Chambliss also advised that the heating/air conditioning system
for the living area was not working properly and needed
replacing. The costs for the bay doors at Catawba, HOllins,
Clear brook, and Fort Lewis are estimated to cost $71,000 and the
heating/air conditioning system at Clearbrook Public Safety
Building is estimated to cost $21,000.
Mr. Chambliss stated that a review of the stations
identified the need to upgrade the heating system in the
remainder of the public safety buildings estimated at $35,000,
and other improvements are recommended at the Public Service
Center ($161,000) and fire and rescue stations ($150,000).
Following discussion on the immediate need at
Clearbrook and the option of including the other improvements in

the budget process, Supervisor Nickens moved to approve only door
repairs and heating and air conditioning at Clearbrook with other
requests included in the budget process. There was no vote.
Supervisor Johnson offered a substitute motion to
appropriate $92,000 to replace the doors at several fire and
rescue buildings and replace the heat/air conditioning at
Clearbrook. The motion carried by the following recorded vote:

Supervisor Johnson moved to adopt the handbook.
Supervisor Nickens noted there were financial implications if the
benefit enhancements were included. Mr. Hodge responded that the
enhancements would be included in the 1995-96 budget process.
Supervisor Nickens requested that the Paid Time Off (PTO) policy
be studied again during the budget process. Supervisor Eddy and
Nickens advised that they would not support adoption of the
handbook in its present form because it included a mission
statement which was not approved by the Board of Supervisors, and
because of the need for a grammar and language review. Mr. Hodge
responded that the statement could be eliminated and the handbook
will be rechecked for grammar errors.

Supervisor Eddy advised that this issue was brought up
at the joint meeting with Roanoke City Council on January 9, and
he agreed to bring it before the Board of Supervisors.
Phil
Sparks, with Roanoke City's Economic Development Department, was
present with additional information on the small business
incubator program, and advised that the funds would be used to
renovate existing buildings.
Supervisor Minnix moved to adopt the resolution. The

RESOLUTION 11095-7 SUPPORTING ESTABLISHMENT OF SMALL
BUSINESS INCUBATOR PROGRAM IN ROANOKE VALLEY
WHEREAS,
the Fifth Planning District Commission has
adopted a resolution dated December 15, 1994, supporting the

establishment of a statewide Business Incubator Program; and
WHEREAS, the Council of the City of Roanoke has
requested state funds to help establish a local small business
incubator facility and program; and
WHEREAS, the Roanoke County Board of Supervisors
supports the concept of a small business incubator for the
Roanoke Valley region and supports the previous actions of the
Fifth Planning District commission and Roanoke City Council in
this regard, believing implementation will substantially enhance
economic development in the Roanoke area and across the
Commonwealth.
NOW, THEREFORE, BE IT RESOLVED that the Board of
supervisors of Roanoke County, Virginia, requests the Governor
and members of the General Assembly to act to establish a
business incubator program in the Commonwealth including one or
more facilities for the Roanoke area; and
BE IT FURTHER RESOLVED that the Clerk to the Board be
directed to send copies of this resolution to the Honorable
Governor of Virginia, area representatives in the General
Assembly, the Honorable Mayor and Clerk of the City of Roanoke,
the Executive Director of the Fifth Planning District commission,
and the Executive Director of the Roanoke Valley Economic
Development Partnership.

Supervisor Johnson advised that he had read the
proposed bill and the final authority for charter schools will
rest with the State Board of Education appointed by the Governor
and not with local school boards. He reported that the Roanoke
County School Board had expressed opposition and the Roanoke City
Council had opposed charter school legislation.
Supervisor
Nickens suggested going on record in support of the Roanoke
County School Board's posi tion rather than amending the
legislative program.
Supervisors Eddy and Minnix recommended
that more information be available before taking a strong
position.
Supervisor Johnson moved: (1) to convey to the School
Board the concerns that the Board of Supervisors have about the
charter school bill; (2) that the Board will support action that
the School Board takes, and (3) the Board reserves the option to
revisit the issue after more information is known. The motion

Mr. Robertson advised that motel/hotel establishments
have been assessed off-site facility fees based on the number of
proposed beds with each bed representing 1/2 equivalent resident
connection. FOllowing a study of water usage in Roanoke
County's motels, staff recommended that motel/hotel
establishments be assessed off-site facility fees on a per room
basis in lieu of per bed basis.
Supervisor Eddy suggested using the language "guest
room" instead of "room" in the ordinance. Supervisor Johnson
requested a report on comparison of utility fees in Virginia.

Mr. Robertson reported that property owners Gary and
Holly Greenlee are requesting that the Board vacate a portion of
the sanitary sewer easement and accept in exchange an additional
area for sanitary sewer easement on the southern side of the
existing easement.
He advised that $2,500 had been deposited
with the utility Department to cover the costs. Supervisor Eddy
suggested that the ordinance be modified regarding the $2,500 to
more accurately reflect that the petitioners paid this amount to
reimburse the County for relocation of the line.
Supervisor Eddy moved to approve the first reading with
his suggested changes and set the second reading for January 24,

Mr. Mahoney advised that the purpose of this ordinance

is to establish a fifty-foot radius around a well lot off
Woodbrook Drive in Brookwood in exchange for an agreement by the
Board to convey the remaining well lot property to Mar ie S.
Harrison upon abandonment of the well.
Ms. Harrison and Mr.
Michael H. Frank have each agreed to lease to the County the
required areas for the period of time needed for operation of the
well.
In exchange, the county will convey the remainder of the
well lot to Ms. Harrison when the well is abandoned. Mr.
Mahoney advised that one adjoining property owner, Scott W.
Bauman, has objected to this proposal. He further advised that
staff has been negotiating with the property owners for some time
and may have to go forward with condemnation proceedings.
Supervisor Nickens moved to proceed with condemnation
proceedings but withdrew his motion. It was the consensus of the
Board that the staff continue to negotiate with the adjacent
property owners.

Mr. Mahoney explained that in September 1994, the
County conveyed 89 acres to the u. S. Government National Park
Service for a spur road to Explore Park. The County now needs to
convey the entire property to the Roanoke Valley Resource
Authority. He recommended that the County, Roanoke City and Town
of Vinton convey the 89 acre portion immediately. He recommended
that the County not take action to rescind the September 1994
ordinance until the City of Roanoke and Town of Vinton take their
action.

Planner Janet Scheid described the three projects that
will be included in the ISTEA grant applications. She advised
that Roanoke County is submitting only one of the projects, the
Cresthill Drive/Garst Mill Park Pedestrian and Bicycle Access
Trail, and the $57,000 funding will come from bond monies and in-
kind contributions. There were no citizens to speak.

RESOLUTION 11095-8 APPROVING THE SUBMISSION OJ' THREE
ISTEA TRANSPORTATION ENHANCEMENT PROGRAM APPLICATIONS
BE IT RESOLVED, By the Board of Supervisors of Roanoke
County, Virginia:
WHEREAS, in accordance with Commonwealth Transportation
Board construction allocation procedures, it is necessary that a
request by resolution be received from the local government in
order that the Virginia Department of Transportation program an
enhancement project in the County of Roanoke, Virginia.
WHEREAS, the County of Roanoke is submitting one
project application and has reviewed two additional
transportation enhancement project applications.
NOW, THEREFORE, BE IT RESOLVED, that the County of
Roanoke, Virginia, requests the Commonwealth Transportation Board
to establish the following improvement projects:
Hanging Rock Rails-to-Trails Project
"Virginia's civil War Trails" - Hanging Rock site
Garst Mill Park & Trail Project
BE IT FURTHER RESOLVED, that the County of Roanoke,
Virginia hereby agrees to pay 20 percent of the total cost for
planning and design, right-of-way, and construction of these
proj ects, and that,
if the County of Roanoke, Virginia

subsequently elects to cancel any of these projects, the County
of Roanoke, Virginia hereby agrees to reimburse the Virginia
Department of Transportation for the total amount of the costs

IN CERTAIN ITEMS SET FORTH ON THE BOARD OJ'
SUPERVISORS AGENDA FOR THIS DATE DESIGNATED
AS ITEM L - CONSENT AGENDA
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. that the certain section of the agenda of the Board
of Supervisors for January 10, 1995, designated as Item L-
Consent Agenda be, and hereby is, approved and concurred in as to
each item separately set forth in said section designated Items 1
through 7, inclusive, as follows:
1. Approval of Minutes - December 13, 1994
2. Request from the School Board for Appropriation to
the 1994-95 Operating Budget of the Roanoke Valley
Regional Board for Low Incidence Population.
3. Acceptance and Appropriation of Grant from the
Trust Fund of the Comprehensive Services Act.
4. Request for Approval of a Raffle Permit from the
Virginia's Junior Miss Scholarship Program.
5. Acknowledgement of Acceptance of 0.16 Miles of
Mallard Lake Court into The Virginia Department of
Transportation Secondary System.
6. Donation of Sanitary Sewer Easement on Lot 25,
Block 2, Section 2, Fairway Forest Estates, from
David A. Kinsler and Cathy G. Kinsler.

On motion of Supervisor Johnson to adopt the Consent
Resolution, and carried by the following recorded vote:

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
SUDervisor Nickens: He asked that Mr. Hodge and Mr.
Chambliss prepare a summary of past reports showing county
ridership and costs for Valley Metro.
SUDervisor Johnson: He reminded the Board that they
decided it was less expensive to provide taxi service than to pay
a share for Valley Metro.
SUDervisor Kohinke: He announced that he had received
a wood crafted "tax shelter" from a constituent. (2) He
announced that he was attending Legislative Day in Richmond on
February 9, 1995. Supervisor Minnix, Mr. Hodge, and Mr. Mahoney
will also attend. Supervisor Kohinke will also attend the
Chairman's Institute on February 10th and 11th.
SUDervisor EddY: (1) He advised that he asked Mr.
Mahoney to check the state code as to why Salem does not qualify
as a partner in a regional jail. Mr. Mahoney responded that this

was a Department of Corrections determination, and another
locality has already challenged the action.
(2)
He announced
that he was pleased with the elimination of the reserved parking
spaces. (3) He reviewed the video of the December 13, 1994
meeting and thought it looked good. Supervisors Minnix and
Kohinke recommended checking on viewership of the show to see if
it will be a worthwhile project.
(4)
He advised that he had
read an editorial by Frank Longaker opposing elimination of the
BPOL tax in Roanoke Times & World-News and has written him
expressing his thanks and agreement.
SUDervisor Minnix:
He advised that his assessment
increased almost $10,000.
(2) He stated that all organizations
and individuals wishing to speak on the proposed 1995/96 budget
should come to one pUblic hearing.
IN RE:
CITIZENS' COMMENTS AND COMMUNICATIONS
Mrs. Frances Lamb. willibv Road. advised that she moved
her single-wide trailer from property owned by her daughter to
property she owned because the County would not allow them to
subdivide the property to allow for her mobile home when her
daughter sold the remaining property.
She was informed by
Planning and Zoning that she could not locate a single-wide
trailer in Roanoke County and it was suggested that she move the
trailer onto the portion of her property located in Montgomery Co
where single-wide mobile homes are allowed.
She received a

permit from Montgomery County, but it was later discovered that
she had placed the mobile home in Roanoke County. She stated that
because the trailer is still located in Roanoke County and she
doesn't have a permit, she cannot get electricity.
Following discussion, Supervisor Nickens moved that a
temporary electrical permit be issued, and for Mr. Mahoney to
work with the Planning Department in Montgomery County to adjust
the boundary line so that he trailer would be in Montgomery
County. There was no vote and the motion was withdrawn.
The Board directed that the staff work with Mrs. Lamb
to resolve the problem.

Counsel, i.e. negotiations with the Town of vinton. The motion

RESOLUTION 11095-11 CERTIFYING EXECUTIVE MEETING WAS
HELD IN CONFORMITY WITH THE CODE OF VIRGINIA
WHEREAS, the Board of Supervisors of Roanoke County,
Virginia has convened an executive meeting on this date pursuant
to an affirmative recorded vote and in accordance with the
provisions of The Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia
requires a certification by the Board of Supervisors of Roanoke
County, Virginia, that such executi ve meeting was conducted in
conformity with Virginia law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
