The Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the
second Tuesday, and the first regularly scheduled meeting of the month
of February, 1994.

CALL TO ORDER
Chairman Minnix called the meeting to order at 3: 05 p.m.
The roll call was taken.

Chairman Minnix advised that recipients of the
Retirement Resolutions would be unable to attend the meeting and
asked that the resolutions be moved to the Consent Agenda, Item
10.
Mr. Mahoney asked that action be deferred on the second
reading of ordinance concerning the conveyance of Old County
School Board Offices and Annex until after the Executive Session.
Mr. Mahoney added an item to Executive Session: Section
2.1-344 A (7) Potential litigation with Lingerfelt Associates.
Supervisor Eddy added a Resolution Amending Resolution
11095-8 as Item 11 on the Consent Agenda.

Chairman Minnix advised that the recipients could not
attend this meeting and moved the resolutions to Item 10 of the
Consent Agenda. He asked that Ms. Allen make arrangements to

have the resolutions personally presented by him to the employees
at a time convenient to them.
~ Presentation from the Southwestern Virqinia Second
Harvest Food Bank.
Chairman Minnix accepted the award from Pamela Irvine,
Director, Southwestern Virginia Second Harvest Food Bank. Ms.
Irvine expressed appreciation to the Board of Supervisors for
allowing the food bank to use space at the Public Service Center
donated by Roanoke County following their fire in December 1989.

BRIEFINGS
~ QuarterlY Undate on Snrinq Hollow Water proiect
(Gary
Robertson. utility Director)
Gary Robertson and John Bradshaw, Hayes, Seay, Mattern
& Mattern, made presentations to the Board.
Mr. Robertson reported on the Water Treatment Plant,
advising that two of the three 2-million gallon concrete tanks
are complete, site grading is 95% complete, and raw and finished
water lines between the reservoir and plant are complete. He
also reported on the status of the Glenvar Pump Station, the
South Transmission Lines, and advised that staff will be meeting
with local civic groups in March/April to discuss alternate
routes for the North Transmission Line. The cost will be

approximately $3.5 million and will be paid by savings realized
from other portions of the project.
John Bradshaw, Hayes, Seay, Mattern and Mattern,
reported on the dam as follows: with the pool at 1335 feet the
reservoir is doing fine. They are still observing a net inflow
into the pool at this elevation which is better than was
expected. When pumping stops, there is a continual increase in
the level of the pool which is a positive factor, even with
evaporation, the expected losses from dam seepage and the
reservoir seepage which was less than they anticipated.
Mr. Bradshaw advised that they expect a reversal of
this trend at maximum pool of 1410 feet with seepage through the
dam and reservoir a little greater. Mr. Bradshaw emphasized that
they were confident that this will be a manageable amount which
they expected, and that the grouting has reduced the amount of
outflow. He reported that they did not feel that the seepage in
any way endangers stability, function or safety of the dam. He
advised that all dams experience seepage, but roller compacted
concrete dams have a tendency to heal themselves.
Mr. Bradshaw recommended a test grouting program in the
end portions of the gallery to confirm the water source and
assist in the natural healing process. The test grouting program
will last approximately 30 days. He reported that the filling of
the reservoir is on schedule and will be completed well in
advance to support the treatment plant. He advised that the

Spring Hollow Reservoir is a good, stable, sound project for the
Valley.
Mr. Robertson advised that the additional grouting is
estimated to cost $50,000. Following the test, staff will
determine whether to recommend additional grouting.

NEW BUSINESS
~ Request for Annroval of Amendment to Inteqrated
Automated Library System contract to Allow
Botetourt County to Join the System. (Snencer
Watts. Library Director)

Mr. Watts advised that in 1990, Roanoke County entered
into a contract with the cities of Salem and Roanoke to establish
and maintain a joint automated library system. Botetourt County
was invited to join at that time but was unable to do so. On May
12, 1994, Botetourt County formally applied for membership as a
full partner. Based on terms outlined by the Roanoke Area
Libraries (RAL) Committee, an amendment to the original contract
has been drafted. Mr. Watts reported that Botetourt's
participation in RAL will reduce shared operational costs and
central site capital costs for the original partners with
Roanoke's net savings approximately $4,500 for next year.
In response to a question, Mr. Watts advised that
Botetourt County did not have to share in the original cost

because the main frame computer has depreciated substantially and
they will have to pay for the future costs.
Supervisor Johnson moved to approve the amendment. The

Donation

Mr. Allen reported that Fairfax County recently
established a Organ and Tissue Donation and Transplantation
commission and encouraged other localities in Virginia to
establish a similar commission. At the January 24 Board meeting,
several Board members indicated their support for a commission to
promote awareness of organ and tissue donation, education the
community and improve opportunities ..for donations.
Ms. Allen
advised that she contacted Alleghany Health Director Dr. Molly
Rutledge who expressed support for a commission made up of
members of the Alleghany Health District and the City of Roanoke.
Staff recommended that a resolution be adopted supporting the
creation
of
a
regional
Organ
and
Tissue
Donation
and
Transplantation Commission and that members of the Alleghany

Health District and the City of Roanoke be invited to
participate.
Supervisor Nickens moved to approve the resolution.

RESOLUTION 21495-2 SUPPORTING THE ESTABLISHMENT OF A
REGIONAL COMMISSION ON ORGAN AND TISSUE DONATION AND
TRANSPLANTATION
WHEREAS, almost 38,000 people in the United States are
currently on a waiting list to receive Organ and Tissue donations
and transplantations; and
WHEREAS, statistics received from the United Network
for Organ Sharing, UNOS, indicate there were 40,147 donors, which
resulted in 92,619 transplanted organs in the United States in
the past five years; and
WHEREAS, the number of patients on the waiting list for
organ transplants increased 108% and the median waiting time
increased for most patients, and the total deaths for persons on
the solid organ transplant waiting list increased 98% from 1988 _
1993; and
WHEREAS, these statistics clearly establish a dramatic
need for increased awareness, coordination and education to
stimulate action on Organ and Tissue donations, and knowledge of
transplantations before the situation becomes even more critical;
and

WHEREAS, Fairfax County, Virginia has established a
volunteer commission on Organ and Tissue Donation and
Transplantation and is urging that other local governments
implement a similar local commission.
THEREFORE, BE IT RESOLVED by the Board of Supervisors
of Roanoke county, Virginia as follows:
(1) That the Board of Supervisors supports the
formation of a Commission on Organ and Tissue Donation and
Transplantation; (2) That the Board of Supervisors encourages
the localities in the Alleghany Health District and the City of
Roanoke to join with Roanoke County in creating a regional
commission;
(3) That the Clerk to the Board of Supervisors is
directed to forward copies of this resolution to the governing
bodies of jurisdictions in the Alleghany Health District and the
City of Roanoke requesting that they take action similar to that
taken by the Roanoke County Board of Supervisors so that a
Commission on Organ and Tissue Donation and Transplantation may
be established.

credit of the Off-site Sewer Fees for the Beasley

Mr. Robertson advised that Boone, Boone and Loeb, Inc.
has submitted a preliminary plan for 201 residential lots
adjacent to the Blue Ridge Parkway near Cotton Hill Road. The
development requires that a sewer pump station be constructed in
order to provide public sewer and construction costs are
estimated at $80,000. Under County policy, the pump station
would be eligible for credits of up to one-half of the off-site
fees which will be $100,500. The developer has asked for credit
of $50,250.
Discussion followed on whether this should be tied to
Boone getting a permit from the Blue Ridge Parkway to put a sewer
pipe under the parkway and whether it could be used to determine
development along the parkway. Supervisor Nickens advised a
recent three-day meeting with parkway officials, developers and
County staff resolved some of the issues regarding development
which would still protect the parkway. Following discussion,
Supervisor Johnson called for the question. The motion carried

Mr. Mahoney advised that this ordinance would authorize
donation of an easement to Appalachian Power Company for an
overhead electric service line across Whispering pines Park for
lighting the ball fields.
Supervisor Johnson moved to approve the first reading
and set the second reading for February 28, 1995. The motion

Drainaae Easement to the Commonwealth of Virqinia
at the New Forensic Laboratory. (John Chambliss.

Mr. Chambliss advised that this easement will convey
the water from the joint-use parking lot at the Forensic
Laboratory to the retention facility being constructed by the
Commonwealth and should help flooding problems at the Public
Safety Center and Northside Schools.
Supervisor Kohinke moved to approve the first reading
and set the second reading for February 28, 1995. The motion

RESOLUTION 21495-4.c OPPOSING FEDERAL AND STATE FUNDING
REDUCTIONS TO TOTAL ACTION AGAINST POVERTY (TAP) AND
THE FEDERAL COMMUNITY SERVICES BLOCK GRANT PROGRAM
WHEREAS, the Community Action Agency, Total Action
Against Poverty (TAP) has provided programs for disadvantaged
citizens in the Roanoke Valley for 30 years, serving as an
outstanding model of success throughout the united states; and
WHEREAS, TAP aids individuals through the following
programs and many others:
Headstart, Comprehensive Health
Investment Project; Summer Youth Employment Program, Drug
Elimination, Literary, Vocational Education, Women's Resource
Center and Southwest VA Second Harvest Food Bank; and
WHEREAS, these programs are designed to help citizens
off the cycle of poverty and welfare and to become productive
self-supporting citizens; and
WHEREAS, TAP is in jeopardy of losing $625,005 in

federal funding and $136,846 in state funding which would have a
severe impact on their ability to continue to help low-income
residents move towards self-sufficiency.
THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia, strongly supports federal and state
funding of Total Action Against Poverty; and
FURTHER, the Board of Supervisors urges our state and
federal officials to
continue the Federal Community Services
Block Grant Program and the State Community Services Block Grant
Program.

Richard L. Francisco was first employed in
July, 1964, as a Motor Equipment Operator I in the Solid Waste
Division of the General Services Department; and also served as a
Refuse Collector in the Solid Waste Division; and
WHEREAS,
Mr. Francisco exhibited his commi tment to
serving the citizens of Roanoke County by his excellent
attendance record during his 30 years of employment, and his
willingness to volunteer for extra duty during the floods of

1985, and 1989, and Hurricane Hugo; and
WHEREAS,
Mr. Francisco is a charter member of the
Quarter Century Club of Roanoke County, having been recognized
for his service in 1990; and

life for its citizens.

that the Board of

ranks to the position of Deputy Sheriff-Sergeant in July, 1972,
and again promoted to the rank of First Sergeant of the Court

Sergeant Kane has been an outstanding ball
player for the Roanoke County Sheriff's Office softball teams in

25 years; and

Sergeant Kane, through his employment with
Roanoke County, has been instrumental in improving the quality of

the Sheriff's Office; and
WHEREAS, Deputy Sheriff Sifers was promoted to Deputy
Sheriff-Sergeant in October, 1981; and
WHEREAS, Sergeant Sifers fought the elements, whether
it be rain or shine, as a School Crossing Guard to assure that
our children got to and from school safely for twelve consecutive
years; and
WHEREAS, Sergeant Sifers, through her employment with
Roanoke County, has been instrumental in improving the quality of
life for its citizens.
NOW, THEREFORE, BE IT RESOLVED,
that the Board of
Supervisors of Roanoke County, Virginia,

life for its citizens.

RESOLUTION 21495-4.m AMENDING RESOLUTION 11095-8
APPROVING THE SUBMISSION OF THREE ISTEA TRANSPORTATION
ENHANCEMENT PROGRAM APPLICATIONS
WHEREAS, the Board of Supervisors of Roanoke County,
Virginia adopted Resolution 11095-8 on January 10, 1995, and
WHEREAS, the County of Roanoke desires to amend this
resolution to clarify its obligation with respect to certain
projects; and

WHEREAS, in accordance with Commonwealth Transportation
Board construction allocation procedures, it is necessary that a
request by resolution be received from the local government in
order that the Virginia Department of Transportation program an
enhancement
project in the County of Roanoke, Virginia.
WHEREAS, the County of Roanoke is submitting one
project
application and has reviewed two additional transportation
enhancement project applications.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Supervisors
amends Resolution 11095-8, adopted January 10, 1995 as follows:
1.

Board

Commonwealth
Transportation Board to establish the following improvement
projects:
Hanging Rock Rails-to-Trails Project
"Virginia's civil War Trails" - Hanging Rock
site
Garst Mill Park & Trail Project
BE IT FURTHER RESOLVED, that the County of Roanoke,
Virginia hereby agrees to pay 20 percent of the total cost for
planning and
design, right-of-way, and construction of thC3C projects the
Garst Mill Park and Trail Proiect. and that, if the County of

Roanoke, Virginia subsequently elects to cancel any of these
projects, the County of Roanoke, Virginia hereby agrees to
reimburse the Virginia Department of Transportation for the total
amount of the costs expended by the Department through the date
the Department is notified of such cancellation for the Hanqina
Rock Rails to Trails proiect. the "Virqinia Civil War Trails"
Hanqinq Rock site and the Garst Mill Park and Trail Proiect.
On motion of Supervisor Johnson to adopt the

IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
SUDervisor Kohinke: (1) He asked about a ground
breaking ceremony for the new police firing range. Mr. Hodge
responded that staff will plan one. (2) He advised that any
proposed date is agreeable with him for the joint meeting with
the vinton Town Council. (3) He asked whether the Parks and
Recreation CIP fund applied to school playgrounds. Pete Haislip
advised affirmatively, and reported that the program will be
ongoing with February 28, 1995 the deadline for this year. (4)
He attended the Economic Development Partnership breakfast, and
went to Richmond to attend legislative Day at the General
Assembly on February 9 and the Chairman's Institute on February
10.

Supervisor Eddv: (1) He asked the staff about the
transfer of land at the old landfill to the Roanoke Valley
Resource Authority. Mr. Mahoney advised that Roanoke City had
taken positive action and Vinton will take action next week. He
anticipates filing documents by the end of the month. (2) He
asked about the traffic officer at the corner of Plantation Road
and Hollins Road. Mr. Hodge responded that traffic is heavy
throughout the day and they are still planning to install the
traffic light. (3) He reported that Planning Director Terry
Harrington has met with the property owners on Postal Drive
regarding Kevin Orcott's complaints that rezoning conditions are
not being upheld, and they are attempting to resolve problems.
Supervisor Nickens: (1) He expressed appreciation to
the employees in the departments of refuse , utilities, public
safety and other who worked outside during the recent ice and
snow storms and suggested recognition of some sort. Supervisor
Minnix will publish thanks in The County Siqnal and send out a
letter on behalf of the Board. (2) He received information from
Montgomery County, MD on an excellent program for spaying and
neutering of animals. He suggested that the Police Department
review this information to see if something similar could be done
in Virginia. (3) He advised that the results of teacher salary
comparisons over 30 years shows County teacher salaries are the
lowest in the Valley. He asked that attention be given to
tracking salaries.

Supervisor Johnson: (1) He asked Mr. Hodge for an
update on the energy improvements at Burlington Elementary
School. (2) He attended the Employee Advisory Committee luncheon
where employees asked for support from the Board for longevity
raises. (3) He asked staff to finalize information regarding
costs for the new Cave Spring High School to determine when to go
forward with plans.
Supervisor Minnix: (1) He is submitting the names of
Don Witt, Charles Blankenship and Richard Kelly to Wayne
Strickland, Executive Director, Fifth Planning District
Commission, to serve on the Open Space Steering Committee. (2)
He reported that he, Mr. Hodge, and Supervisor Kohinke attended
Legislative Day at the General Assembly, and that they met with
representatives from Roanoke Valley who are aware of problems at
the local level.

accept an offer from the City of Salem for $600,000. The motion

BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the County School Board of Roanoke County has
declared this property to be surplus property by resolution
adopted January 12, 1995; and
2. That pursuant to the provisions of Section 16.01
of the Charter of Roanoke County, the subject property has been
declared to be surplus by the Board of Supervisors of Roanoke
County and is being made available for public sale; and

2. That pursuant to the provisions of Section 18.04
of the Charter of Roanoke County, a first reading was held on
January 24, 1995; and a second reading was held on February 14,
1995 concerning the sale and disposition of a certain parcels of
real estate located in the City of Salem known as the old County
School Board Offices and Annex (Tax Map Nos. 146-9-5, 146-9-6,
146-9-7); and
3. That an offer having been received for said
property, the offer of City of Salem to purchase this property
for $600.000 is hereby accepted; and
4. That all net proceeds from the sale of this real
estate are to be allocated to the Capital Projects Fund; and
5. That the County Administrator is authorized to
execute such documents and take such actions on behalf of Roanoke
County as are necessary to accomplish the conveyance of said
property, all of which shall be upon form approved by the County
Attorney.
On motion of Supervisor Johnson to adopt the ordinance
accepting the offer from the City of Salem for $600,000, and

Supervisor Eddy asked for Board consent to discuss
proposed legislation in the General Assembly concerning local
