The Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the
second Tuesday, and the first regularly scheduled meeting of the month
of February, 1993.

Supervisor Eddy added an item regarding the sewer and
water contracts with the City of Roanoke to the Executive
Session.

Mr. Mahoney asked that Item H-3, an ordinance
authorizing a lease with the Roanoke Valley Youth Soccer Club,
Inc. be continued to February 23, 1993.
IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS
h Introduction of the Cable Television Government
Access Manaqer. (Anne Marie Green, Public
Information Officer)
Ms. Green introduced Angela McPeak who was recently
hired as the Cable Television Government Access Manager.
Supervisor Nickens asked for a meeting with Ms. McPeak to discuss
future ideas for the government access channel.

h Presentation from the Roanoke Valley Poverty Task
Force. (Ted Edlich, Executive Director, Total
Action Áqainst Poverty)
Mr. Edlich reported that in 1991, local community
leaders and Total Action Again Poverty formed a 37-person task

force of various people from around the Roanoke Valley. The task
force studied long and short term solutions to problems facing
the poor, and developed 176 recommendations. Following a slide
presentation, Mr. Edlich highlighted the primary goals of the
task force. He also recognized Elizabeth Stokes, Roanoke
County's appointee to Total Action Against Poverty Board of
Directors.
h Request from the Social Services DeÐartment for
AÐÐroÐriation to the 1992-93 Budqet. (Reta Busher,
Manaqement and Budqet Director)

Ms. Busher advised that the State Department of Social
Services has changed its funding methodology for reimbursement to
localities. The State now allocates a portion of the funds at
the beginning of the budget year and supplements the local budget
periodically during the year, as needed. The County recently
received supplemental welfare grant funds of $209,252 that should
be appropriated to the Department of Social Ser~ices. Ms. Busher
advised that during the past 18 month period there were 700 new
Public Assistance cases, and in January 1993, there were 365 new
applications and 300 pending applications for Public Assistance.
Staff recommended appropriation of the state funds to the
Department of Social Services.
Following discussion, Supervisor Nickens
appropriate the funds. The motion carried by the

Mr. Harrington reported that the County Code requires
that Roanoke County property owners maintain their property free
of trash, but that frequently trash is being dumped without the
knowledge or consent of the property. The staff is proposing
that a $10,000 incentive fund be established to cover tipping
fees resulting from the cleanup of trash from roadside dumps.
Property owners would make written application and the County
would evaluate the application against criteria established to
administer the funds. Staff recommended that the $10,000 be
appropriated from the Board Contingency Fund.
In response to a question from Supervisor Eddy, Mr.
Harrington advised that funds would be used only to cover the
tipping fees.
Supervisor Johnson advised he would abstain because he
managed property that is currently being used as an illegal dump.
Supervisor Nickens moved to appropriate $10,000 from
the Board Contingency Fund. The motion carried by the following

SECTION 7-18. "PERMIT FEES" OF ARTICLE II.
"BUILDING CODE" OF CHAPTER 7, BUILDING
REGULATIONS OF THE ROANOKE COUNTY CODE TO
PERMIT MONTHLY BILLING OF CERTAIN PERMITS
WHEREAS, Section 7-18 of the Roanoke County Code
requires the payment of fees prior to the issuance of any permits
required by the buildin9 code or ordinance; and
WHEREAS, the Department - of Engineering & Inspections
has developed an automated billing system in conjunction with

other county departments to permit billing of contractors on a
monthly basis for such permits; and
WHEREAS, such a monthly billing procedure is designed
to 'improve customer service by permitting certain permits to be
obtained by phone, to reduce the volume of traffic to the County
Administration Center and to increase revenue; and
WHEREAS, the first reading of this ordinance was held
on January 26, 1993; and the second reading on February 9, 1993.
NOW, THEREFORE, BE IT ORDAINED by the Board of
Supervisors of the County of Roanoke, Virginia, as follows:
1. That Sec. 7-18. "Permit fees" of Article II. "BUILDING

CODE" of Chapter 7 BUILDING REGULATIONS of the Roanoke County
Code be amended and reenacted as follows:
Sec. 7-18. Permit fees.
No permit required by the building code adopted by Section
7-16 or by Section 7-17 shall be issued by the county until the
fees prescribed therefore by the Board of Supervisors have been

Mr. Obenshain reported that staff had addressed
questions raised by the Board at the January 26 meeting.
Regarding fees there were three options: (a) a flat fee based
upon size and duration of the parade; (b) an hourly fee of $15 -
$17.50 per hour per officer assigned to parade duty; and (c)
calculation of the actual cost of police services for each parade
which would be billed to the parade organizations. Regarding
notification of property owners along the parade route, staff
recommended that some general language to this effect could be
added to the code with details left to county staff and that the
actual notice include only the date, time and route of the
,parade. County Administrator Elmer Hodge recommended that
notification not be required. Staff further recommended that the

time period for filing an application be retained at 15 days
prior to the parade rather than 30 days.
In response to questions from Supervisor Eddy, Mr. Obenshain
advised that recommendations were made to protect first amendment
rights and that because foot races would not block both sides of
the street, notification would not be required.

CHAPTER 14 PARADES OF THE ROANOKE COUNTY CODE
WHEREAS, recent judicial decisions have raised concerns
about the ability of localities to charge fees for services
rendered by governmental employees, including law enforcement,
related to publicly permitted parades; and
WHEREAS, recent experience with parade permits in
Roanoke County has demonstrated the need for changes to the
County's current Parade Ordinance to clarify the authority of the
Chief of Police to deal with certain situations; and
WHEREAS, the first reading of this ordinance was held
on January 26, 1993; and the second reading was held on February
9, 1993.
BE IT ORDAINED by the Board of Supervisors of the

ARTICLE II. PERMIT
Sec. 14-21.
Required; exceptions.
(a) It shall be unlawful for any person to stage, present,
conduct, participate in, form or start a parade, unless a permit
has been issued for such parade pursuant to the provisions of
this article.
(b) This section shall not apply to:
(1) Funeral processions.
(2) Lawful picketing or o~her orderly processions on the
sidewalks that do not violate any state laws or county
ordinances.
(3) A governmental agency acting within the scope of its
functions.

Sec. 14-22.
Application--Generally.
A person seeking the issuance of a parade permit shall file
an application with the chief of police on forms provided by the
chief of police. Such ~pplication shall be filed not less than
fifteen (15) days before the date on which it is proposed to
conduct the parade. The application shall be signed by the

applicant and notarized and shall contain the following
information:
( 1) The name, address and telephone number of the person
seeking to conduct the parade.
(2) If the parade is proposed to be conducted for, on
behalf of or by an organization, the name, address and
telephone number of the headquarters of the
organization and of the authorized and responsible
heads of such organization.
(3) The name, address and telephone number of the person
who will be the parade chairman and who will be
responsible for its conduct.
(4) The date when the parade is to be conducted.
(5) The route to be traveled, t.he starting point and the
termination point.
(6) The approximate number of persons who, and animals and
vehicles which, will constitute the parade and the type
of animals and a description of the vehicles.
(7) The hours when such parade will start and terminate.-
(8) A statement as to whether the parade will occupy all or
only a portion of the width of the streets proposed to
be traversed.
(9) The location, by streets, of any assembly areas for the

Sec. 14-24.
Issuance or denial.
(a) The chief of police shall act upon an application for a
parade permit, within seven (7) days after the filing thereof, by
either issuing or denying the permit. If he denies the permit,
the chief of police shall mail to the applicant, by certified
mail, or have served upon the applicant, within seven (7) days
after the date upon which the application was filed, a notice of
his action stating the reasons for the denial of the permit. Any
person aggrieved shall have the right to appeal such denial or

granting of a parade permit to the circuit court of the county.
The appeal shall be taken within eight (8) days after receipt of
the notice of denial or granting of such permit.
(b) The chief of police shall issue a parade permit when,
from a consideration of the application and from such other
information as may otherwise be obtained, he finds that:
(1) The conduct of the parade will not substantially
interrupt the safe and orderly movement of other
traffic contiguous to its route.
(2) The conduct of the parade will not require the
diversion of so great a number of law-enforcement
officers of the county, to properly police the line of

movement and the areas contiguous thereto, as to
prevent normal police protection to the county.
(3) The conduct of the parade will not require the

diversion of so great a number of ambulances as to
prevent normal ambulance service to portions of the
county other than that to be occupied by the proposed
line of march and areas contiguous thereto.
(4) The concentration of persons, animals and vehicles at
assembly points of the parade will not unduly interfere
with proper fire and police protection of, or ambulance
service to, areas contiguous to such assembly areas.
(5) The conduct of the parade will not interfere with the
movement of fire-fighting or rescue squad equipment or
vehicles in route to a fire, accident scene or other
emergency.
(6) The proposed conduct of the participants in the parade
does not prêsent a clear and present danger of
violence.
(7) The parade is scheduled to move from its point of
origin to its point of termination expeditiously and
without unreasonable delays in route.
(8) The parade is not to be held for the sole purpose of
advertising any product, goods or event and is not
designed to be held purely for private profit. This
provision shall not prohibit signs identifying
organizations or sponsors furnishing or sponsoring
floats or tránsportation for the parade.

(c) The chief of police, in denying an application for a
parade permit, may authorize the conduct of the parade on a date,
at a time or over a route different from that named by the
applicant. An applicant desiring to accept, an alternative permit
shall, wi thin two (2) days after riotice of the action of the
chief of police, file a written notice of acceptance with the
chief of police. An alternative parade permit shall 'conform to
the requirement of and shall have the effect of a parade permit
under this chapter.

Mr. Hodge presented the revenue proj ections which show an
increase of
3.27%
or
$2,113,700.
Another potential

revenue
source is the $225,000 host locality fee when the new regional
landfill opens. Mr. Hodge explained that he did not include the
proposed increase in the Transient Occupancy tax because it had
not yet passed both the House and Senate.
Mr. Hodge advised that major known expenditures include

$270,000 to cover increased tipping fees for the new landfill,
$32,000 for modifications required by the Americans with
Disabilities Act, and $418,000 to fund the debt service deficit
incurred by the ßchools. Pending issues, include the sale of the
Ogden property; the County's share of the cost of replacing a
ladder for the Vinton ladder truck and decisions on whether to
raise the sewer rates or continue to supplement them from the
General Fund.

employee salary increases would be instituted and whether the
Board decided to reinstate leaf vacuum collection.
Following discussion, it was Board consensus not to include
leaf vacuum collection in the budget at this time, and to
