The Roanoke County Board of Supervisors of Roanoke County,
Virginia, m6t this day at the Roanoke County Administration Center,
this being the second Tuesday, and the only regularly scheduled
meeting of the month of November.

OPENING CEREMONIES
The invocation was given by John M. Chambliss, Assistant
County Administrator. The Pledge of Allegiance was recited by all
present.
IN RE:
COOPERATION MEETINGS
Chairman Robers advised that he discussed with Vice Mayor
Howard Musser of the City of Roanoke, Roanoke City councilman Bev
Fitzpatrick and Mayor Jim Taliaferro of City of Salem the need for
cooperation on various projects that cross jurisdictional lines and
they agreed that quarterly or semi-annual joint meeting~ would be
beneficial to all concerned. He proposed that the respective staffs
would structure the meetings and the agenda would be limited to two
items from each jurisdiction.
Supervisor Robers moved that the Board of supervisors
participate in quarterly or semi-annual joint meetings with the City
of Roanoke, City of Salem, and Town of vinton during the next year in
order to address those issues that cross jurisdictional lines. The
motion carried by the following recorded vote:

RESOLUTION 111390-1 SUPPORTING CONTINUED
REGIONAL COOPERATION IN THE
ROANOKE VALLEY
WHEREAS, the referendum on the consolidation of the County
and City of Roanoke was held on November 6, 1990; and
WHEREAS, the proposed consolidation plan did I:1ot receive a
majority of votes from the citizens of Roanoke County; and
WHEREAS, the citizens of Roanoke County have made known
their interest in and support of cooperative efforts with the
neighboring jurisdictions in the Roanoke Valley; and
WHEREAS, the people of the Roanoke Valley currently have
various regional issues which must be resolved and regional projects
which must be completed; and
WHEREAS, the people uf the Roanoke Valley will all benefit
from continued cooperative efforts by the governing bodies of the five
localities; and
WHEREAS, it is in the best interest of the citizens of

Roanoke County that the Board of Supervisors and County staff support
and initiate joint projects and facilities with the other
jurisdictions of the Roanoke Valley.
NOW, THEREFORE, BE IT RESOLVED, that the Roanoke County
Board of Supervisors does hereby formally adopt a resolution in
support of regional cooperation and interjurisdictional problem-
solving: and further,
BE IT RESOLVED, that the Board of Supervisors urges the
governing bodies of the cities of Salem and Roanoke, Town of Vinton
and Botetourt County to join with them in making this commitment to
the citizens of the Roanoke Valley, and further,
BE IT RESOLVED that a copy of this resolution be transmitted
to the respective clerks for the governing bodies of the City of
Roanoke, City of Salem, Town of Vinton and County of Botetourt.
On motion of Supervisor Nickens to adopt the resolution and

1990 as American Education Week.
Mr. Bud McWhorter, President of the Roanoke County Education
Association, and Dr. Bayes Wilson, Superintendent, Roanoke County
Schools, were present to accept the proclamation.

~ Introduction of new Executive Director of the virainia
Association of Counties
Supervisor McGraw introduced Mr. James D. Campbell, who will
become the Executive Director for the Virginia Association of Counties
on December 1, 1990. Mr. Campbell was formerly employed by the
Virginia Municipal League.
~ Resolution of aÞÞreciation to Elmer C. Hodae, Jr. on
his fifth anniversary as Roanoke County Administrator.

RESOLUTION 111390-2 OF APPRECIATION TO ELMER C. HODGE ON HIS
FIFTH ANNIVERSARY AS ROANOKE COUNTY ADMINISTRATOR
WHEREAS, Elmer C. Hodge, Jr. has been County Administrator
for Roanoke County since November, 1985: and
WHEREAS, even before his official date of emploYment, he was
in the County, directing clean up operations after the 1985 flood; and
WHEREAS, Mr. Hodge has been responsible for a variety of
projects which have been greatly beneficial to the people of Roanoke
County and of the Valley as a whole: and
WHEREAS, these projects include the Roanoke County Charter,
the Roanoke Regional Airport Commission, the new Regional Landfill,
curbside and automated recycling, County-wide garbage collection, and
Spring Hollow Reservoir: and
WHEREAS, during Mr. Hodge's administration, the County has
received the All America City Award, four National Association of
Counties AChievement Awards, and two Virginia Municipal League
Achievement Awards.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County Board
of Supervisors does hereby express its appreciation and gratitude to
Elmer C. Hodge, Jr. on the occasion of his fifth anniversary serving
as Roanoke County Administrator: and

FURTHER, BE IT RESOLVED that the Board of Supervisors
extends its best wishes and encouragement for Mr. Hodge's continued
success and growth as the Administrator of the County of Roanoke.

NEW BUSINESS
~ Reauest for award of contract for water/sewer rate
analysis.

County Administrator Elmer Hodge advised that on June 12,
1990, Wheat First Securities suggested that the County conduct a rate
analysis that would provide a basis for funding of the Spring Hollow
water project.
Mr. Hodge advised that the County received six proposals to
perform the feasibility study and recommended that the award be made
to Burns & McDonnell at a cost of $60,000 from the utility Fund. It
was also suggested that the study be performed on water and sewer
since the cost increment is minimal if they are reviewed at the same
time.
In response to Supervisor Johnson's inquiry as to whether
Burns & McDonnell was the low bid, Finance Director Diane Hyatt
advised that the top two firms were chosen and negotiated with for the_

best price.
Supervisor Eddy was concerned that the directions to the
consultant were too vague, without policy decisions, and the cost for
the study was too great. He suggested designing a new RFP for new
conditions and getting new proposals.
Director of utilities Cliff Craig responded to Supervisor
Johnson that in his professional opinion, this was an appropriate
amount of money for the study and he would recommend the award.
After further discussion, Supervisor Johnson moved to
approve staff recommendation.
Supervisor Eddy made a substitute motion that the study be
limited to water and exclude sewage. The motion was denied by the
following recorded vote:

~ AÞÞroÞriation of funds for Allied sianal economic
develoÞment ÞrosÞect.

Finance Director Diane Hyatt advised that on October 23,
1990, Allied Signal announced their plans to construct a facility in
Western Roanoke County. The County agreed to donate $825,000 to the

Industrial Development Authority to purchase the land from Salem West
Corporation and the IDA will deed this land to Allied Signal
Corporation. The County agreed to extend water and sewer connections
to the construction site and to improve the road access at Route
11/460 up to $50,000.
Ms. Hyatt requested that the board appropriate $875,000 from
the unappropriated balance for the land acquisition and road
improvements. She reported that $650,000 for the sewer extensions is
available from unallocated bonds that were sold through the Virginia
Resource Authority, and $50,000 for the water extensions from the
Water Offsite Facility revenues.
Supervisor McGraw moved the staff recommendation to
appropriate funds to proceed with location of Allied Signal. The
motion carried by the following recorded vote:

Director of Planning and Zoning Terry Harrington advised
that a community meeting with Allied Signal has been scheduled for
November 27, 1990, at 7 p.m. at the Glenvar Library.
~ Annual Reþort from the Mental Health Services of the
Roanoke Valley
The report was presented by Dr. Henry J. Sullivan, Mental
Health Services Board Member appointed by Roanoke County, and Ms.
Mary Faron, resident of Roanoke County, spoke to the board about the

Director and Tom Chapman, Director of Administration, were present to
answer questions.
Supervisor Robers moved to receive and file the report. The
motion carried by the following recorded vote:

~ Reauest for additional funds to comÞlete Read Mountain
Fire station.

Mark Light, Deputy Chief of Fire & Rescue, advised that in
1985, the projected cost of a station in the Bonsack area with
Botetourt County was estimated to be $300,000: however, the projected
total cost will be $474,886. Deputy Chief Light requested that the
board appropriate $174,886 so that the project can be completed in
early 1991.
Supervisor Nickens expressed concern about including a
complete sprinkler system for the fire station in the contingency
fund.
In response to Supervisor Nickens question about the
financial involvement of Botetourt County, Mr. Hodge advised that
Botetourt County cannot contribute to the amount being requested at
this time but Botetourt County is donating the land, part of the
operating costs and the majority of the fire fighters.
Supervisor Johnson moved the staff recommendation to
appropriate $l74,886 to complete the Read Mountain Fire Station.

Supervisor Eddy made a substitute motion to reduce the
contingency fund to 5% and include an amount of money not to exceed
$10,000 for paving at the Back Creek Fire station. The motion was

Mr. Mahoney requested an appropriation of $6,800 for the
estimated cost of O. D. Page's consulting services during the cable
television franchise renewal negotiations. He advised that a portion
of these funds might be recovered from Cox Cable at the conclusion of
a successful negotiation.

p.m. for the board and staff to discuss future issues.

FIRST READING OF ORDINANCES
~ Ordinance amendina and reenactina ChaÞter 4,
Amusements. Section 4-99. "Binao Games and Raffles", of
the Roanoke County Code. Þrovidina for an increase in
the audit fee.
Mr. Mahoney was present to answer questions. The second
reading of this ordinance will be December 4, 1990. There was no one
present to speak to the ordinance.
Supervisor Eddy questioned whether under state law, if it
does not cost the 2% to conduct the audit, could the excess be put in
the County treasury. Mr. Mahoney advised that we are limited by the
state code authorizing the legislation.

In response to Supervisor Eddy's observation about a
typographical correction, Mr. Mahoney indicated it would be made

Mr. Mahoney was present to answer questions about the
ordinance which adopts the mandatory and optional provisions of the
Virginia Indoor Clean Air Act. The second reading will be December 4,
1990. There was no one present to speak to the ordinance.
Supervisor Nickens questioned whether the provision stating
that Roanoke County shall provide reasonable no-smoking areas was
construed to be inside or outside of the building. He expressed his
feeling that there could be a smoking policy that would require
smoking outside the building. Supervisor Johnson favored the intent

of the provision but did not believe the state Code sections require
this and should be left to the reasonable interpretation of the County
Administrator.
Supervisor Eddy pointed out that the enforcement of this
ordinance would be by the County Administrator and suggested that the
ordinance be publicized and brochures prepared when approved.
Supervisor Nickens asked if there was a prohibition under
state Code for governmental facilities to allow smoking in common
areas such as lobbies, restrooms. Mr. Mahoney stated that the state
Code for not smoking in common areas is limited to the educational
facilities but not governmental buildings.

ORDINANCE 111390-7 AUTHORIZING THE CONVEYANCE OF AN EASEMENT
TO THE ROANOKE GAS COMPANY
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That pursuant to the provisions of Section 16.01 of the
Charter of Roanoke County, the subject property has been declared to
be surplus and is being made available for other public uses, i.e. a
gas line easement within the existing water line easement: and
2. That pursuant to the provisions of Section 18.04 of the
Charter of Roanoke County, a first reading concerning the disposition
of the subject property was held on October 23, 1990: a second reading
was held on November 13, 1990; and
3. That the twenty (20) foot wide water line easement currently
exists across three residential properties in the Deer Run Estates
Subdivision: said easements were granted unto Roanoke County by deeds
of easement recorded in the Clerk's Office of the Circuit Court of

Roanoke County in Deed Book 1146, page 720: Deed Book 1146, page 724;
and Deed Book 1146, page 726: and
4. That the twenty (20) foot gas line easement for Roanoke Gas
Company, extending natural gas from Starmount Drive to Tinkerdale,
coincides with the existing water line easement of Roanoke County and
involves the joint use of said easement area: and
5. That the proceeds from the sale of the easement are to be
allocated to the capital reserves of Roanoke County; and
6. That the offer of the Roanoke Gas Company of One Dollar
($1.00) for the joint easement is hereby accepted and all other offers
are rejected; and
7. That the County Administrator is authorized to execute such
documents and take such actions on behalf of Roanoke County as are
necessary to accomplish the conveyance of said easement, all of which
shall be upon form approved by the County Attorney.

Supervisor Eddy nominated Richard L. Williams from the
Cave Spring District to serve a four-year term which will expire
October 24, 1994.

Supervisor Robers nominated Pam Glover from the Cave
Spring District.
Supervisor Nickens nominated C. W. Church williams from
the Vinton District.
Supervisor Johnson nominated David LaYman, from the
Hollins District.
Supervisor Johnson suggested to County Attorney Paul
Mahoney that during redistricting, consideration should be given to
putting the North Lakes Subdivision into one district. He also
requested that Mr. Mahoney consider how redistricting will affect
membership in the County committees, commissions and board.
Mr. Mahoney advised that a public hearing on
redistricting will probably be set for the second meeting in January,
1991.
~ Mental Health Services Community services Board
Supervisor Eddy nominated Dr. Henry Sullivan for
reappointment to a three-year term which will expire December 31,
1993.
~ Planning Commission
Supervisor McGraw introduced and nominated Marian
Chappelle from the Catawba District to fill the unexpired four-year
term of Wayland Winstead which will expire December 31, 1993.

Supervisor Johnson requested that a resolution of
appreciation be presented to Mr. Wayland Winstead at a December
meeting. Supervisor Johnson also requested that the appropriate
documentation for financial disclosure be sent to Mrs. Chappelle.

an unrestricted right-of-way of 50 feet with necessary easements for

record in the Roanoke County Clerk's Office.
3. That this Board does certify that this road was open to
public use prior to January 1, 1976, at which time it was open to and
used by motor vehicles.
4. That this Board does certify that speculative interests are
not involved.
5. That said road known as Remington Road and which is shown on
a certain sketch accompanying this resolution, be, an the same is
hereby established as a public road to become a part of the state
secondary system of highways in Roanoke County, only from and after
notification of official acceptance of said street or highway by the
Virginia Department of Transportation.

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
SuÞervisor Eddy: (1) He reported on his visit to the Bent
Mountain School which was dedicated last Sunday and made a tour of
Back Creek Elementary School in honor or American Education Week. (2)
He advised that he is now writing and mailing out a Windsor Hills
District newsletter at his personal expense. He offered to add anyone
interested to his mailing list. (3) He expressed appreciation that a
legislative item previously requested was not placed on the
legislative program. (4) He asked Paul Mahoney if redistricting
would affect the County Charter. Mr. Mahoney advised that no changes
to the County Charter would be necessary for the various alternatives
of redistricting and advised that a public hearing will be requested
for the second meeting in January. (5) He asked for an update on the
recorded message system because of the telephone directory deadline.
John Chambliss advised that staff should be prepared to make a final
proposal on the pricing and the system by the end of the month. (6)
He expressed his concern about Back Creek Fire station not being paved
before cold weather. Mr. Hodge will try to get better costs for
paving by combining the work to be done with other areas. (7) He
reported on the TV program concerning the consolidation aftermath and
complimented Supervisor McGraw on his performance.
SuÞervisor McGraw: (1) He reported on a discussion with
Howard Musser on the same television show about future cooperation
between Roanoke County and Roanoke City in negotiating the Cable TV

franchise and commented on a recent letter he sent to Mr. Musser. (2)
He will become president of the Virginia Association of Counties at
the annual meeting at The Homestead on November 18 - 20, 1990. Mr.
James D. Campbell will become the Executive Director of VACo effective
December 1, 1990.
(3) He commended the City of Roanoke for gaining
General Assembly approval to enact a bias-ban ordinance and asked the
County Attorney to determine what actions would be needed if Roanoke
County should make the same request. Mr. Mahoney will report back to
the board at the December 4, 1990 meeting. (4) He requested that the
County Attorney research the modified ward system for restrictions as
well as gains.
Mr. Mahoney commented that this could be done under
the County Charter without specific legislation.
(5) He recommended
pursuing a joint efficiency study of delivery of services in the
Roanoke Valley within the local governments.
SuÞervisor Nickens:

He requested reconsideration of
the Cooperation Resolution (Rll1390-1) before adjournment of the
meeting and
asked to include Botetourt County in the resolution.
SuÞervisor Robers: (1) He announced that Senator Warner has
agreed to help with the funding request in the Senate for the smart
highway. (2) He advised that Dr. Wade Gilley from George Mason
University believes that the Roanoke Valley will be one of one hundred
secondary economic development hubs of the next twenty years and the
smart highway could be the focus project. (3) He asked for an update
on the actions of staff with Roanoke City regarding the Airport

Commission being composed of citizens. Supervisor McGraw suggested
that Chairman Robers write a letter to Mayor Taylor about changing the
structure of the Airport Commission. Mr. Hodge and staff will draft
the letter.

IN RE: REPORT ON CORTRAN/RADAR TRANSPORTATION
Assistant County Administrator Don Myers presented the staff
report listing three alternatives for expanding CORTRAN services to
five days and until 6: 15 p.m. in the evening. This report was in
response to the request of Mr. Rich Boehler at the October 23, 1990
meeting.

Supervisor Nickens felt that this should have been a
separate agenda item and not a report.
It was board consensus that
staff should bring back an agenda item with fiscal recommendation for
funding on a trial basis at the December 4, 1990 meeting. Supervisor
Nickens requested that the County Attorney research the question of
whether Valley Metro would be required by Federal statutes to provide
comparable services for the handicapped since the County does not pay
a subsidy.

increased schedule when approved be publicized and
would like to see the dispatching services increased.

Mr. Harrington advised that an analysis of the safety of the

facility, the design of the facility, signage that must be posted, and
the requirements for submittal of the application were part of the
staff review of this request. The Roanoke County Police Department
met with the applicants last summer and reviewed the standards in the
design of the facility.
Mr. Harrington advised that the main issue is the proximity
of the facility to the County's Whispering Pines Park which abuts the
property on two sides. The Department of Parks & Recreation has
significant concerns regarding the noise and safety aspects of the
facility.
Mr. Ed Natt, attorney for the petitioner, advised that he
had requested a continuance by letter, and was not prepared to go
forward since the staff report was not received until after the newly
established deadline for automatic continuances enacted by the Board.
He advised that the request for a continuance must be in before the
staff report comes out. He advised that the petitioner would like an
opportunity to meet with the neighbors.
In response to Supervisor McGraw's concern about having a
second public hearing in the event of a continuance, Mr. Mahoney
advised that the board could hear comments tonight but defer a
decision until the petitioner has an opportunity make a presentation.
It was the consensus of the board to proceed with the public hearing.
~ Darlene Hess. 2882 Carvins Code Road. Salem, presented
a petition signed by 150 citizens opposed to the
shooting range because of the safety, noise, and

property values.
It was Board consensus that the petitioner set up a meeting
with the concerned citizens in the area to explain their plans.
Supervisor McGraw moved to continue the public hearing until
the December 18, 1990 board meeting.

IN RE:
CITIZENS' COMMENTS AND COMMUNICATIONS
1. Lela E. Blewett. 958 Halifax circle requested that the
board change the ordinance which allows only two dogs per household in
Roanoke County.
Mrs. Blewett has been cited by the Animal Control
Officer to dispose of one dog by November 27, 1990.
2. Mike Vinyard. spoke in support of Ms. Blewett and
inquired why there was no ordinance concerning cat ownership.
Supervisor Nickens requested that at an appropriate time in
the future, preparation of a cat ordinance should be considered.
Supervisor McGraw
suggested
revisiting
the
zoning
ordinance.
Supervisor Eddy inquired as to why the ordinance was written to allow
only two dogs and suggested delaying enforcement against Ms. Blewett
pending research by staff.
Supervisor Eddy moved that in the matter of the number of

dogs allowed under these circumstances, enforcement of that particular
aspect of the zoning law be deferred until the board receives a report
from staff regarding the appropriate number of dogs for households to
keep and take formal action.
Supervisor Eddy restated his motion that enforcement of this
particular case be deferred until the staff reports back to the board
on all aspects of the issue of number of dogs and zoning
classifications.
The motion resulted in a tie vote and the County
Attorney ruled that the decision should be brought back to the next
board meeting for vote.

REQUESTS TO ADD, DELEGATE OR CHANGE THE ORDER OF

Supervisor Eddy asked that the Hotel Roanoke/Conference
Center and the cable TV franchise be discussed. County
Administrator Elmer Hodge responded he would add these to the
agenda.
IN RE:
LANDFILL
Assistant County Administrator John Hubbard advised the
board on the progress of the smith Gap site. He described plans
for the rail transportation of the refuse to the site and advised
that Roanoke City is willing to set up transfer sites. He
explained that refuse trucks will bring refuse to transfer sites
which will be loaded on rail road cars and brought to the
landfill by rail.
In response to a question from Supervisor Eddy
regarding negotiations with other localities, Mr. Hodge responded
there are two options: the locality could join the Resource
Authority as a partner in the landfill or could contract with the
County for use of the landfill. Staff is still working on the
specifics of an agreement.
Supervisor Robers asked if the county's financial
position would be stronger in the bond market if there were

separate regional authorities for water, sewer and landfill. Mr.
Hodge responded that he would asked the County's financial
consultant.
Supervisor Nickens suggested that the Roanoke County
Resource Authority go on record in requesting the state for an
extension of time and increase in capacity for use of the current
landfill. He further suggested that a letter from the Board of
Supervisors be sent to the others localities participating in the
current Landfill Board expressing concern about Landfill Board
member John Parrott's recent emplo~ent with Olver and
Associates, the landfill consultant.
Following discussion on allowing other localities to
join the County landfill, Mr. Hodge advised he will set up a
meeting of the Landfill citizens Advisory Committee to discuss
this issue. Supervisor Nickens suggested that inclusion of a
surcharge to the host locality should be considered in the
negotiations.
Mr. Hubbard presented the proposed timetable for the
landfill. He advised that this will go to the bond market in
November 1991 and the projected date for completion of
construction is January 1993.
IN RE: SEWAGE TREATMENT
Clifford Craig, Director of utilities updated the board
members on negotiations with Roanoke City on the sewage treatment
plant. The participating localities have held two meetings.
Roanoke City's primary need is the sewage treatment plant, while

Roanoke County's need is for lines.
In response to a question xrom Supervisor Johnson he
advised that the plant can be expanded within one to one and a
half years. Mr. Hodge added that there is a tentative agreement
with Roanoke City and they are still working on bonding methods.
Mr. Hodge advised that the staff will keep the board informed on
negotiations and that a proposed agreement with the city is
expected by February 1991.

WATER SUPPLY
Assistant County Administrator John Hubbard reported
that the rate study should be completed by February 1991 and will
be brought to the Board of Supervisors. other projected plans
include bidding the project in May 1991, going to the bond market

between June and August 1991 and awarding construction in July
1991.

1991-91 BUDGET PROCESS
1. Budaet Calendar
Director of Management and Budget Reta Busher presented
a proposed calendar of dates for the 1991-92 budget process.
There was board consensus to set the public hearing for
citizen comment on tax rates at a different meeting than when the
tax rates are approved. Mr. Hodge and Ms. Busher responded that
staff would bring back a revised calendar to the board.
Supervisor Eddy suggested that a percentage of the
General Fund be allocated to human service agencies in the 1991-
92 budget instead of an arbitrary dollar amount. Supervisor

Nickens reminded the staff that the Therapeutics Program should
be budgeted on a cost sharing basis with participating localities
in future budgets.
Director of Finance Diane Hyatt announced she will set
up an Audit Committee meeting in December.
~ School Budaet:
Dr. Bayes Wilson, School Superintendent, was present
and updated the Board members on future construction plans. He
advised that the projected 1991-92 enrollment is estimated at
13,200. He further advised that the state does not plan any new
mandates and may even reduce curren~ mandates.
~ state school budaet reductions
Dr. Wilson advised that th~ $60,000 duty free lunch
will be eliminated and the estimated reduction of state funds is
$1.5 to $2 million plus state tax.
Dr. Wilson also announced that Roanoke City is
requesting legislation to share state funding for students who
live in one locality and attend school in another locality.
Currently 700 students from outside Roanoke County attend County
schools with funding of $1200 per student. The funds would be
eliminated if this legislation is passed.

IN RE:
FORENSIC LABORATORY
Don Myers, Assistant County Administrator, reported
that the current lab located in Roanoke City does not meet
standards and is inadequate. Several years ago, the County
donated 2.5 acres next to the Public Safety Center for
construction of a new forensic laboratory. However, the project
is low on a list of state construction priorities and unless
alternate funding is found, it is doubtful the project will be
completed.
Following discussion, Mr. Hodge advised that staff will
study alternative sources of the funding to assure completion of
the project in Roanoke County.
IN RE:
REGIONAL JAIL
Mr. Myers presented the background on the proposed
regional jail and announced that the only remaining localities
involved are Roanoke County, Roanoke City and Salem. A needs
assessment has been completed recommending a minimum security

facility with 300 beds. Construction costs are estimated at $12
million with state funding of $6 million. Roanoke County's share
would be $1 million.
There was board consensus to continue discussion with
the other localities and report progress back to the board
members.
IN RE:
REDISTRICTING
County Attorney Paul Mahoney recommended that a
committee be established consisting of Planning Director Terry
Harrington, Registrar Elizabeth Leah and himself to begin the
redistricting process. He announced there will be a public
hearing on the issue at the January 22, 1991 board meeting.
He asked for board direction on how they should proceed.
Following discussion, there was board consensus to correct errors
made in past redistricting by splitting subdivisions and school
districts between magisterial district. The Board members also
supported a study of the possibility of adding an at-large
chairman and at-large vice chairman.' Supervisor Nickens also
suggested that the committee work with the Fifth Planning
District Commission.
IN RE:
OTHER ISSUES
~ Cable television neaotiations with Cox Cable:
Supervisor McGraw updated the board members on
negotiations and announced there will be a meeting on November
28. He reported that it may be necessary to adopt an ordinance

authorizing an extension of the contract with Cox Cable until
negotiations are complete.
~ Hotel Roanoke/Conference Center Pro;ect:
Mr. Hodge advised that it will not be necessary for the
Board of Supervisors to make a decision on whether to participate
in this project at this time. He will keep the board informed at
future meetings.
~ VDOT Round Table Meetina:
Mr. Hodge announced that a meeting will be held with
staff from the Virginia Department of Transportation on November
30, 1990 at 10:00 a.m. Supervisor Eddy and he will be attending.

~ Recyclina Advisory Committee:
Supervisor Eddy advised that there are two members
still to be appointed to this committee representing the business
community. The board members directed Clerk Mary Allen to
contact businesses involved in recycling and the Fifth Planning
District Commission for suggested members.
~ Referendum on School Board AÞÞointments
Supervisor Eddy asked whether this issue could be
placed before the voters again. County Attorney Paul Mahoney
responded that he will investigate the code requirement for the

length of time before a referendum can be brought back to the
voters and advise the Board.

The Board members directed Mr. Hodge to place an item
on the December 4, 1990 agenda allocating mat.ching funds for the

IN RE:
LEGISLATIVE REQUESTS
County Attorney Paul Mahoney presented to the
legislators the following list of requests adopted by the Board
of Supervisors for consideration during the 1991 session of the
General Assembly:
1. Joint collection of taxes by a County and a town
with a single tax bill.
2. Return of a portion of the lottery proceeds to the
locality.
3. Authorization for local governments to assess user
charges to recover the costs of administering the construction,
operation and maintenance of a stormwater management program.
4. Extension of time to secure a qualifying industry
for industrial access road funding.
5. State funding of human service needs to reach a
goal of 80/20 reimbursement for administrative costs and to fund
all positions needed as shown on case load standards.
6. Authorization to require a current rabies
certificate of vaccination as a prerequisite for securing a dog
license.
6. Assignment of the same priority to the payment of
debts of the estate of a decedent for local taxes as provided
debts and taxes to the state.
7. Approval of funding for the construction of the
Regional Forensic Science Laboratory.
8. Restriction of the power of the judiciary to revise

matter except in case of fraud or direction violation of law.

impose up to a ten percent tax on the gross receipts of all bingo

Delegate Cranwell questioned the stormwater utility fee
request and was informed the county did not wish to make it
retroactive. There was a discussion on funding and building the
forensic laboratory.
Delegate Cranwell advised that stat.e redistricting will
be held the first two weeks of April. Those present discussed
methods of keeping better count of residents.
