The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the second Tuesday, and the
first regularly scheduled meeting of the month of September,
1990.

Vice Chairman McGraw called the meeting to order at
3:07 p.m. The roll call was taken.

Mr. Nester was present to receive the resolution and a

RESOLUTION 91290-1 EXPRESSING THE APPRECIATION OF
THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO G.
ROY NESTER FOR TWENTY-FIVE YEARS OF SERVICE TO
ROANOKE COUNTY
WHEREAS, G. Roy Nester was first employed on September
1, 1965, as aide to the Engineer and County Executive; and
WHEREAS, G. Roy Nester worked his way up to the
highest supervisory grades in the County by becoming
Superintendent of Public Works, Director of Facilities, Director
of Buildings and Grounds, and Assistant Director of General
Services; and
WHEREAS, G. Roy Nester was instrumental in the
early development and County execution of residential trash
collection, municipal utilities support, street sign
installation, landfill operations, and buildings and grounds
maintenance of County facilities; and
WHEREAS, during his long tenure of service, G. Roy
Nester monitored, managed, and coordinated the expenditure of
millions of dollars year after year, and he continually produced
operational savings which were to the benefit of the County
taxpayers; and

WHEREAS, G. Roy Nester has proven through his
actions his personal loyalty and dedications to Roanoke County
and its welfare.
NOW, THEREFORE, BE I~ RESOLVED, that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
and the appreciation of the citizens of Roanoke County to G. Roy
Nester for twenty-five years of capable, loyal and dedicated
service to Roanoke County.
FURTHER, the Board of Supervisors does express its best
wishes for a happy, restful, and productive retirement.

system which has received national recognition for its teachers,
students and administration; and
WHEREAS, an outstanding school system produces
outstanding students who likewise gain national recognition for
their accomplishments; and

WHEREAS, MELVIN HENRY PETERS, a sophomore at Arnold
Burton Technology Center is the First Place winner in national
competition held in Tulsa, Oklahoma in June 1990, sponsored by
the National Vocational Industrial Clubs of America (VICA); and
WHEREAS, he was recognized for this honor for cabinet
making after winning First Place in the state and District to
qualify for the national competition; and
WHEREAS, MELVIN HENRY PETERS is deserving of special
commendation for his SUccessful achievement and continued efforts
towards excellence.
THEREFORE, BE IT RESOLVED ~hat the Board of Supervisors
of Roanoke County, Virginia offers its sincere congratulations to
MELVIN HENRY PETERS for his outstanding accomplishment; and
FURTHER, the Board of Supervisors expresses its pride
in this achievement and extends its best wishes to him for
continued Success in future endeavors.

Presentation and Resolution of Support for the I-81
.
Corridor Plan
R-91290-4
Wayne strickland, chairman of the I-81 Corridor Council,
outlined the research that the committee will undertake to study
the future economic development potential of the I-81 corridor
west of Blue Ridge. They plan to begin the process now and will
have a plan underway in two years.
Supervisor Nickens moved to adopt the resolution. The

RESOLUTION 91290-4 SUPPORTING A STRATEGIC
DEVELOPMENT PLAN BY THE I-81 CORRIDOR COUNCIL
WHEREAS, a planning study of the I-81 corridor is vital to
the future of western Virginia, and
WHEREAS, the 1-81 Corridor Council has submitted an
application to the U. S. Economic Development Administration for
technical assistance funds in the amount of $25,000 to begin this

project matched by $8,000 from the Planning District Commissions
in western Virginia, and
WHEREAS, this study would include many aspects that would be
of benefit to the County of Roanoke.
THEREFORE, BE IT RESOLVED that the Board of Supervisors of
Roanoke County, Virginia does hereby express it strong support
for implementation of a strategic Development Plan by the I-81
Corridor Council, and
FURTHER, the Board of Supervisors of Roanoke County,
Virginia urges approval of the I-81· Corridor Council's
application to the U. S. Economic Development Administration for
technical assistance funds.

County Attorney Paul Mahoney advised that at the August 28,
1990 meeting, the Board of Supervisors directed him to prepare a
resolution establishing that all future appointments of persons
to citizen boards, committees and commission be Roanoke County
residents. There was no discussion on this issue.

RESOLUTION 91290-5 ADOPTING A POLICY CONCERNING THE
APPOINTMENT OF PERSONS TO SERVE UPON CITIZEN BOARDS AND
COMMISSIONS; ESTABLISHING RESIDENCY REQUIREMENTS FOR
ALL APPOINTMENTS
BE IT RESOLVED, By the Board of Supervisors of Roanoke
County, Virginia:
1. That it is the policy of Roanoke County that the
appointment of persons to the various citizen boards and
commissions of Roanoke County shall be based upon a consideration
of the residency of the appointee. It is hereby declared that
it is in the pUblic's interest that ~ppointees to the various
citizen boards and commissions serving the public purposes and
needs of the residents and taxpayers of Roanoke County shall be
residents of the County, and that such consideration serves a
valid public purpose.
2. That the appointment of persons to serve upon citizen
boards and commissions shall be based upon a consideration of the
residency of the appointee, it being the policy of this Board to
appoint persons who are bona fide residents of Roanoke County.
3. That the appointment of persons to serve upon citizen
boards and commissions shall be based upon a consideration of the
residency of the appointee, it being the policy of this Board to
appoint persons to achieve a geographic balance so that all
magisterial or election districts are represented.
4. That this policy shall apply to all boards and
commissions that are appointed within the discretion of the Board
of Supervisors of Roanoke County, Virginia. This policy shall

not apply to the appointment of members to boards and
commissions, the membership of which is mandated by state or
federal statute or regulation or which is established by
agreement or contract.
5. That the effective date of this resolution shall be
September 12, 1990.

Garland Kidd, Director of Vocational and Adult
Education advised that the School Board has received a $50,000
grant ($25,000 for 1990-91 and $25,OpO for 1991-91) for a 2 + 2
program in early childhood development. This will be a joint
project with other local school systems. There was no discussion
of the issue.
Supervisor Johnson moved to appropriate the grant. The

~ Adoption of a policv statement concerninq consolidation
for emDlovee responses to citizen inauiries.
Mr. Mahoney stated that the Board requested that a
policy statement regarding consolidation that had been
distributed to County employees on July 17 be placed on the
agenda for discussion.
Supervisors Eddy and Nickens offered
modifications to the statement. Mr. Mahoney and County
.
Administrator Elmer Hodge explained that the purpose of the
statement was to give the employees direction on how to respond
to citizen inquiries regarding consolidation.
Supervisor Nickens moved to rescind the memorandum from
the County Attorney regarding the policy statement on
consolidation and that the County Attorney draft an appropriate
memorandum to employees retracting the earlier memorandum. The
motion carried by the following recorded vote:

BE IT RESOLVED by the Board of Supervisors of Roanoke

County, Virginia, as follows:
1. That for calendar year 1990 the regular meetings of the
Board of Supervisors of Roanoke County, Virginia, shall be held
at the Roanoke County Administration Center on Brambleton Avenue,
S.W., Roanoke, Virginia. The meeting dates as set forth in
Resolution 1390-1 for calendar year 1990 are amended as follows:
Wcdne3day, November 14, 1990 at 3:00 p.m. and 7:00 p.m.
Tuesdav. November 13. 1990 at 3:00 p.m. and 7:00 p.m.
2. That the Clerk shall cause a copy of this Resolution to
be published in the Roanoke Times & World News once a week for
two successive weeks prior to the date of this meeting, and shall

Supervisor Eddy moved to set the public hearing for
October 23, 1990. The motion carried by the following recorded

FIRST READING OF ORDINANCES
~
Ordinance rescindinq Ordinance 81490-6, imDosinq or
increasinq user fees for the Parks and Recreation Department and
appropriation of funds.
Supervisor Johnson moved to approve first reading of the
ordinance.
Supervisor Eddy advised that he felt that the adults
participating in outdoor adventure should be charged the fee
that was originally recommended in tþe ordinance. Mr. Hodge
advised it would be difficult to administer different fees for
adults and youth participating in the same program.
Supervisors Johnson, McGraw and Nickens supported using the
funds that have been collected from the increased fees toward
maintenance of the fields. Supervisor Eddy stated he felt that
the supplemental funds should go in the fund balance and that
staff should decide how it should be spent. Mr. Hodge agreed
with Mr. Eddy.

Supervisor McGraw offered a substitute motion to approve
first reading and that $160,000 be allocated from the fund
balance, that $85,421 be used to replace the lost User fees and
that the remaining balance remain with Parks and Recreation to be
used for maintenance of fields and other such parks and
recreation needs. The motion carried by the following recorded

Beveraqes of Chapter 21 of the Roanoke County Code, Taxation, to
increase the criminal penalties for failure to file the required
returns or to collect or Dav the tax imposed bv this article.
Mr. Mahoney advised that the ordinance would increase
the criminal penalties to those businesses who fail to file or
pay meals tax collections.
County Treasurer Alfred Anderson spoke in support of
the proposed ordinance.

WHEREAS, Jerry Garrett and Martha Garrett have requested
that the Board of Supervisors of Roanoke County, Virginia vacate
a 15-foot drainage easement located on the west property line of
Lot 11, Block 3, Penn Forest Subdivision, Cave Spring Magisterial
District; and
WHEREAS, Section 15.1-482 (b) of the 1950 Code of Virginia,
as amended, requires that such action be accomplished by the
adoption of an ordinance by the governing body; and,

WHEREAS, notice has been given as required by Section 15.1-
431 of the 1950 Code of Virginia, as amended, and a public hear-
ing and first reading of this ordinance was held on August 28,
1990; and the second reading of this ordinance was held on

County, Virginia, as follows:
1. That a 15-foot drainage easement located on Lot 11,
Block 3, Penn Forest Subdivision (P.B. 5, page 82), Cave Spring
Magisterial District, be, and hereby is, vacated pursuant to
Section 15.1-482(b) of the 1950 Code of Virginia, as amended;
and,
2. That this ordinance shall be in full force and effect
thirty (30) days after its final passage.
All ordinances or
parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed.
3. That Jerry Garrett and Martha Garrett shall record a

certified copy of this ordinance with the Clerk of the Circuit
Court and shall pay all fees required to accomplish this transac-
tion.

WHEREAS, Gorman R. Howell and Sidney Maupin have requested
that the Board of Supervisors of Roanoke County, Virginia vacate
a 20-foot drainage easement as shown on the resubdivision of
Tract 3, Southwest Industrial Park Plat (P.B. 10, page 163), Cave
Spring Magisterial District; and
WHEREAS, Section 15.1-482 (b) of the 1950 Code of Virginia,
as amended, requires that such action be accomplished by the
adoption of an ordinance by the governing body; and,

vacated and relocated to the proposed common lot line of Lots 1
and 2 as shown on the map of Phase II of the Southwest Industrial
Park pursuant to Section 15.1-482(b) of the 1950 Code of
Virginia, as amended; and,
2. That this ordinance shall be in full force and effect
thirty (30) days after its final passage.
All ordinances or
parts of ordinances in conflict with the provisions of this
ordinance be, and the same hereby are, repealed.

Magisterial District resident, to complete the one-year unexpired
term of Murry K. White. The term will expire March 31, 1991.

RESOLUTION 91290-10 APPROVING AND CONCURRING
IN CERTAIN ITEMS SET FORTH ON THE BOARD OF
SUPERVISORS AGENDA FOR THIS DATE DESIGNATED
AS ITEM J - CONSENT AGENDA
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the certain section of the agenda of the Board
of Supervisors for September 12, 1990 designated as Item J-
Consent Agenda be, and hereby is, approved and concurred in as to
each item separately set forth in said section designated Items 1
September 12, 1990

through 7, inclusive, as follows:
1. Approval of Minutes - August 14, 1990
2. Confirmation of Committee Appointment to the Landfill
citizens Advisory Committee.
3. Acknowledgement from the Virginia Department of Transp-
ortation of the acceptance of Melissa Drive, Melissa
Circle, and the abandonment and addition of portions of
Route 660 and Route 711.
4. Resolution of Support for a local share of the Virginia
lottery proceeds.
5. Approval of Raffle Permit and one-time only Bingo Game
for Penn Forest Elementary School PTA.

6. Donation of a sanitary sewer easement located in Lot 4,
Block 2, section 8, SteepleHunt of Canterbury.
7. Donation of a sanitary sewer easement located on lot
line of Lot 19A, Block 3, Section 6, SteepleHunt of
Canterbury.
2. That the Clerk to the Board is hereby authorized
and directed where required by law to set forth upon any of said
items the separate vote tabulation for any such item pursuant to
this resolution.
On motion of Supervisor Johnson to adopt resolution,
and carried by the following recorded vote:

RESOLUTION 91290-10.c SUPPORTING LEGISLATION
TO RETURN TO LOCALITIES A SHARE OF THE LOT-
TERY FUNDS
WHEREAS, the General Assembly of Virginia enacted legisla-

tion to provide for a state lottery, providing that all monies
recei ved from the sale of lottery· tickets, less payments for
prizes and compensation of agents, shall be placed in a special
fund known as the "State Lottery Fund", and
WHEREAS, the Counties and cities of the Commonwealth of
Virginia have become unduly dependent upon local taxation because
of underfunded and unfunded State mandates and the loss of
Federal Revenue Sharing monies, and
WHEREAS, it would be fair and equitable that a share of the
revenue generated by the sale of lottery tickets be returned to
the respective localities of sale.
NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors
of Roanoke County, Virginia support~ legislation to amend Section
58.1-4022 of the Code of Virginia, effective July 1, 1992, to
require the Treasurer of Virginia to transfer to the local
governing bodies of the Commonwealth of Virginia a sum equal to
ten percent of the gross receipts from the sale of lottery
tickets in each jurisdiction to be used as the local governing
bodies deem appropriate for the best interests of their citizens.
BE IT FURTHER RESOLVED, that a copy of this resolution be
sent to the appropriate state officials, the Virginia Association
of Counties, and the Virginia Municipal League.
On motion of Supervisor Johnson to adopt resolution, and
carried by the following recorded vote:

REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Eddv:
(1) Asked for an update on the Cable TV
.
Franchise Agreement Negotiations. Supervisor McGraw advised that
three members of the Cable TV Committee are reviewing the
agreement, and they are trying to get the best franchise at the
least cost, and also hope to include more rural areas. (2)
Asked for a report at the September 25 meeting regarding a
brochure to be mailed to citizens regarding the consolidation
referendum.
(3) Heard from the County Administrator that there
will be a press conference on September 13 regarding analysis of
the SDN Market Research Report.
( 4) Updated the Board on a
meeting he attended where representatives from Lexington/Fayette
County spoke on consolidation in their community.
(5) Asked for

an update on the budget shortfall.
Mr. Hodge stated that they
still don't have the exact figures available from the State. (6)
Asked for a Board Report on September 25 regarding Total Action
Against Poverty's request for funding for their Transitional
Living Center.
Supervisor Johnson:
reported on the Regional Airport
Commission Retreat and advised that the County Members of the
Commission recommended citizen appointees to the Commission. He
asked for a discussion of this issue at the October 9 meeting.

Supervisor McGraw: reported on his travels with members of
the Police Department and advised he was impressed with their
professionalism.

the purpose of a joint work session with the Planning Commission.
