Roanoke County Board of Supervisors Roanoke County Administration Center 3738 Brambleton Avenue, SW Roanoke, Virginia 24018 January 10, 1989 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month of January, 1989. IN RE: CALL TO ORDER Chairman Garrett called the meeting to order at 3: 05 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Lee Garrett, Vice Chairman Richard Robers, Supervisors Bob L. Mahoney, 42 0 January 10, 1989 --'- ~ =9 r County Attorney, Clerk Mary H. Allen, Deputy IN RE: OPENING CEREMONIES , The invocation was given by John Chambliss, Assistant County Administrator. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF AGENDA ITEMS County Administrator Elmer Hodge requested that Item 7, a resolution endorsing a single economic development effort under the direction of the Regional Partnership be added. He also requested that the work session on Solid Waste Collection Plan for 1989-90 be deferred until the budget process. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS Mr. Hodge made the following announcements. (1) He advised that Bonnie Preas, Procurement, has received certification as a Professional Procurement Officer; (2) that Anne Marie Fedder has accepted appointment as Public Information Officer effective February 1, 1989; and (3) he introduced the new Assistant Director of Parks, Jim Jones. January 10, 1989 42 1 IN REi NEW BUSINESS 1. Reqµest of CBL Management for Count v particioation in extension of water lines. Director of Utilities Clifford Craig presented the report recommending that Roanoke County participate one-half the excess cost up to an amount of $41,000.00, in the form of a lump sum reimbursement agreement payable after acceptance of the water line and verification of the excess cost by Roanoke County. Mr. Craig advised that this was similar to other requests. Mr. Tingle with CBL Management was present and advised the Board members that they planned to pay part of the costs. Following discussion, Supervisor Robers moved to postpone this item to January 24, 1989 for a study of calculations of revenue which would include the County participation in the water line. The motion was seconded by Supervisor McGraw and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None 2. Reqµest for Plannina Commission review of Special Exception Permits for Demolition and Sanitary Landfills. ~2 2 January 10, 1989 =:¡: - A-11089-1 Jon Hartley presented the report. He reported that the current method for County approval of a landfill is through a Special Exception Permit from the Board of Supervisors. Presently, the Planning Commission has no authority to review and comment on the Special Except Permit, but if refuse from public sources is landfilled, they must determine if the proposal is consistent with the Comprehensive Plan. Staff recommends that the Planning Commission review and make recommendations to the Board of Supervisors on all Special Exception Permit applications for debris and sanitary landfills. Supervisor Nickens moved to approve the staff recommendation. The motion was seconded by Supervisor Robers and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None 3. Establishment of a Reimbursement policv for Committees. Commission and Boards. A-11089-2 Mr. Hodge advi sed that a study had been conducted to determine which committees, commissions and boards are now receiving reimbursement. He presented an chart showing which commi t tees are now being reimbursed for expenses and of which 42 3; January 10, 1989 commi t tees must travel for the purpose of determining action or recommendation. Mr. Hodge recommended that the Board of Zoning Appeals receive a salary in the future of $250 per member. Supervisor Johnson moved to approve the salary for the Board of Zoning Appeals and requested that they be informed of this action. The motion was seconded by Supervisor Nickens and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None 4. Reauest for amendment to the Employee Handbook to allow overtime leave or overtime Day for nonexemDt emplovees. A-11089-3 Mr. Hodge advised that the Sheriff's Department requested this option of taking overtime leave rather than overtime pay in an effort to reduce the budgetary impact of overtime pay. The handbook would extend this option to all employees. Staff recommends approval of this handbook amendment. The overtime leave would be used by the end of the following pay period. In response to a question from Supervisor RObers, Mr. Hodge explained that the option was for all employees instead of just those in the Sheriff's Department because it could cause confusion in the Fire and Rescue Department, qouls give 42 4 January 10, 1989 - flexibility to the other departments when necessary, and would standardize the policy for all employees. Supervisor Robers stated that while he could support this for the Sheriff and Fire and Rescue, he could not for the other departments. Supervisors Robers and Nickens expressed concern that this pOlicy could be abused by departments. Supervisor Robers moved to to apply this pOlicy only to the Sheriff's Department and Fire and Rescue Department but not to the other departments. There was no second and the motion died. Sheriff Kavanaugh was present and advised that this policy would give his department the flexibility to meet his needs. Supervisor Johnson expressed concern that this policy could impact the number of road officers because they would be taking additional time off. The Sheriff advised that the time off would be taken during the next pay period and if they do not take the time, they will be paid for those overtime hours. Supervisor Nickens advised that he would oppose the policy because he did not feel the employees would always have an option. Supervisor Nickens moved to deny the staff recommendation and make no changes to the overtime pay pOlicy. The motion was seconded by Supervisor Robers and carried by the following recorded vote: January 10, 1989 42 5 AYES: NAYS: Supervisors Robers, Nickens, Garrett Supervisors Johnson, McGraw 5. New Regional Landfill Sites. A-11089-4 Assistant County Administrator John Hubbard reported that the County has assumed the responsibility ,for siting the new regional landfill and has chosen five of the fifteen sites originally identified. An additional site has now been located in the Red Hill area off Route 220. Staff is requesting that this site be added to the other five as one of the top sites to go forward, and that the final report be delayed until after final testing. Supervisor Robers pointed out that this site was not even included in the top sites originally identified by consul tants and engineers. He felt that the County should proceed with the original plans and wait for the testing of the top five sites. Supervisor should be studied. McGraw advised that all possible sites Mr. Hodge explained the process that each site will go through and that this site had some features that should include it in the top sites. Supervisor Robers responded that he objected to an alteration of the five sites that were previously agreed upon. Mr. Hubbard reported that this site was 42 6 January 10, 1989 - originally not included because of the number of houses on the proposed site. The following citizens spoke in opposition to the proposed addition of the Red Hill Landfill Site: 1. Leona Harrison, 6409 Crowell Gap Road, who was opposed because her family had lived on the property for generations and are buried on the property. 2. Craig Gold, 6433 Crowell Gap Road, who was opposed to adding this site because it was not included in the sites presented to the landfill consultants and compared to the other sites, and involves more property owners than any other site. 3. O. W. Harrison, 6409 Crowell Gap Road, who was opposed to the site because it would take most of his property and it would difficult for him to move at his age. Supervisor Robers moved to deny the recommendation and not add the Red Hill site for testing. was no second and the motion died. Supervisor McGraw moved to add the Red Hill Site and approve the staff recommendation. ADDroval to aDDlv for grant to purchase CORTRAN ~ A11089-5 There was no discussion of this issue. Supervisor Nickens moved to authorization RADAR to apply for grant monies to pay for a new bus equiped with a handicapped lift. Adoption of Resolution endorsina a single economic effort under the direction of the Regional Supervisor Nickens presented the report advising that unified economic voice for economic development for the Roanoke Valley would increase funding for the Regional Partnership and would also present a unified marketing approach. Supervisor Nickens moved to adopt the prepared resolution. The motion was seconded by Supervisor McGraw and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None 42 8 January 10, 1989 - ---,. - RESOLUTION 11089-6 ENDORSING A SINGLE ECONOMIC DEVELOPMENT EFFORT UNDER THE DIRECTION OF THE REGIONAL PARTNERSHIP BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: WHEREAS, the Regional Partnership was established by the Counties of Roanoke and Botetourt, the Cities of Roanoke and Salem, and the Town of Vinton to present a regional economic development approach; and WHEREAS, this organization has aided the recruitment efforts of the Roanoke Valley, but has been hampered by limited financial resources; and WHEREAS, each participating locality has continued its indi vidual economic development endeavors, while allocating only a portion of its funds to the Regional Partnership; and WHEREAS, the economic development needs of the Roanoke Valley could be better served if the financial resources and personnel currently serving each jurisdiction could be directed by one organization, the Regional Partnership. THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County endorses the concept of one regional economic development organization in the Roanoke Valley, and recommends that all participating localities in the Regional Partnership -~ January 10, 1989 42 9 direct that their economic development financial resources and personnel be incorporated under this organization. FURTHER, The Board of Supervisors of Roanoke County, Virginia, directs that a copy of this resolution be forwarded to the governing bodies of the localities who participate in the Regional Partnership, and that they be requested to endorse this action. On motion of Supervisor Nickens, seconded by Supervisor McGraw, and upon the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None IN RE; REQUESTS FOR WORK SESSIONS 1. Reauest for a Work Session on January 24. 1989 on the Solid Waste Collection Plan for 1989-90. This item was deferred to the 1989-90 budget process. IN RE; REQUESTS FOR PUBLIC HEARINGS Mr. Hodge reminded the Board that a public hearing on the budget will be held on January 24, 1989. 430 January 10, 1989 - - IN RE: FIRST READING OF ORDINANCES 1 . Ordinance acceDting an offer for and authorizino the convevance of surplus propertv near the intersection of Huntino Hills Drive and Starkey Road. County Attorney Paul Mahoney presented the staff report. The surplus property is an old well lot that is no longer needed. The second reading will be January 24, 1989. No one was present to speak to the ordinance. Supervisor Nickens moved to approve first reading of the ordinance. The motion was seconded by Supervisor Garrett and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None 2. Ordinance amending and reenacting the Roanoke County Code to Drovide for a Drohibition uDon the location of certain tYDes of signs. Mr. Mahoney advised that this ordinance concerns general advertising signs such as billboards. Mr. Hodge reported that the Planning Commission established the sign committee at the request of the Board. The ordinance being requested today, is an "umbrella" ordinance until a new ordinance is written as a part of the Zoning Ordinance. January 10, 1989 43 1 Supervisor Nickens expressed concern that a representati ve from the sign industry was not serving on the sign committee and that they were not informed of the proposed ordinance. Chairman Garrett directed Mr. Hodge and the chairman of the Planning Commission to meet with members of the sign industry so that representation from that community can serve on the sign committee. The following citizens spoke concerning this ordinance. 1. Mr. F. T. Turner, Box 8246, Roanoke, President of Dominion Signs, was opposed to the ordinance because he felt that the ordinance was anti-business. He pointed out there was already regulations concerning signs in Roanoke County. He recommended that the sign committee be equally represented . between pro and con. 2. Frank Kinsey 3721 Hummingbird Lane, Vice President of Kinsey-Crane Sign Company. He advised they are willing to work with the County on a sign ordinance but were opposed to a prohibition of signs. He asked that this ordinance be used only as a temporary solution until a new sign ordinance is adopted. 3. Don Witt, 3332 Kenwick Trail, chairman of the Planning Commission described the process by which the sign committee would prepare the sign ordinance. 43 2 January 10, 1989 .~ Supervisor Garrett moved to approve first reading of the ordinance. Ordinance authori z ina the acquisition of an interest in an eiaht acre tract known as the North Clear Zone proDerty in exchanae for the convevance to the Citv of Roanoke of a reversionarv clause in the eiaht acre tract known as the Ida Mae Holland tract. . . No one was present to speak to the ord1nance. Supervisor Johnson moved to adopt the ordinance. The motion was seconded by Supervisor Robers and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, Nickens, Garrett NAYS: None ABSTAIN: Supervisor McGraw ORDINANCE 11089-7 AUTHORIZING THE ACQUISITION OF AN INTEREST IN AN EIGHT (8) ACRE TRACT KNOWN AS THE NORTH CLEAR ZONE PROPERTY IN EXCHANGE FOR THE CONVEYANCE TO THE CITY OF ROANOKE OF A REVERSIONARY CLAUSE IN THE EIGHT (8) ACRE TRACT KNOWN AS THE IDA MAE HOLLAND TRACT January 10, 1989 43 3 BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to provisions of Section 18.04 of the Charter of Roanoke County, a first reading concerning the acquisition of a reversionary interest from the City of Roanoke in the eight (8) acre tract known as the North Clear Zone property in exchange for the conveyance of a reversionary interest to the City of Roanoke in the eight (8) acre tract known as the Ida Mae Holland tract was held on December 13, 1988. A second reading on this matter was held on January 10, 1988. 2. That the acquisition of the reversionary interest in the eight (8) acres, more or less, known as the North Clear Zone property more particularly described as located adjacent to the Airport Clear Zone property in exchange for the conveyance of a reversionary interest to the City of Roanoke in the eight (8) acres, more or less, known as the Ida Mae Holland tract more particularly described as located adjacent to Thirlane Road and the Roanoke Regional Airport Commission property is hereby authorized and approved; and 3. Committees and Board A-11089-9 Supervisor Garrett directed that he be added to the Audit Committee, that Supervisor Nickens.. be appointed to a three- year term to the Community Corrections Policy Board and that the Consolidation Negotiating Committee be added with Supervisors Johnson and Nickens as Roanoke County's representatives. Supervisor Johnson moved that the appointments as amended be received and filed. Supervisor McGraw announced that the Grayson Commission has agreed to put forth sample bills for consideration. He also advised he had set up three community meetings in the Catawba Magisterial District to explain the initial consolidation process. 43 6 January 10, 1989 - - Supervisor Nickens moved that Paul Mahoney be added to the Consolidation Negotiation Committee. That Resolution 2988-7.k requesting acceptance of Lakemont Drive into the VDOT Secondary Road System is rescinded. 2. That this matter came this day to be heard upon the proceedings therein and upon the application for Lakemont Dr i ve, a section of road extending from Club Lane (Route 1443), 0.15 miles west of Valley Drive (Route 1442) , and extending in a westerly and then easterly direction 0.69 miles to the cul-de-sac pursuant to Section 33.1-72.1, Paragraph C-1 and funded pursuant to Section 33.1-75.1, Paragraph A of the Code of Virginia of 1950, as amended. 3. That this Board does guarantee the Commonwealth of Virginia an unrestricted right-of-way of 40 feet with necessary easements for drainage as recorded in Plat Book 9, Page 5, dated August 13, 1974 and other deeds of record in the Roanoke County Circuit Court Clerk's Office. 4. That this Board does certify that this road was open to public use prior to January 1, 1976, at which time it was open to and used by motor vehicles. 5. That this Board does certify that speculative interests are not involved. 6. That said road known as Lakemont Drive and which is shown on a certain sketch accompanying this resolution, be, and January 10, 1989 43 9 the same is hereby established as a public road to become a part of the state secondary system of highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Transportation. On motion of Supervisor Johnson, seconded by Supervisor McGraw and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None RESOLUTION 1089-8.a REQUESTING ACCEPTANCE OF SCARLET OAK DRIVE INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY ROAD SYSTEM BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That this matter came this day to be heard upon the proceedings herein, and upon the application of Scarlet Oak Drive from its intersection with Wood Haven Road (Route 628) to the existing Falls Development for a distance of 0.20 miles, to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said road have been dedicated by virtue of a certain map known as Extension of Scarlet Oak Drive recorded in Plat Book 11, Page 76, of the records of the Clerk's Office of the Circuit Court of Roanoke 44 0 ~ January 10, 1989 - County, Virginia, on December 21, 1988 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said right-of-way for drainage. 3. That said road known as Scarlet Oak Drive and which is shown on a certain sketch accompanying this Resolution, be, and the same is hereby established as public road to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Transportation. IN RE: CITIZEN COMMENTS AND COMMUNICATIONS Patrick Cosmato, business owner in Roanoke City and Roanoke County, expressed concern about the County taking a regional approach to issues including consolidation, and also about the regional airport commission, because of the structure of the commission which includes a majority of members from 442 January 10, 1989 - Roanoke City who are appointed officials. documentation that he felt supported his concerns.
