The Roanoke County Board of Supervisors of Roanoke County,
Virginia, met this day at the Roanoke County Administration Center¡
this being the first Tuesday, and the first regularly scheduled
meeting of the month of August, 1989.

Chairman Garrett called the meeting to order at 3:00 p.m.
The roll call was taken.

OPENING CEREMONIES
The invocation was given by the Reverend Quentin White,
Bethel AME Church. The Pledge of Allegiance was recited by all
present.

County Administrator Hodge added Item B.3, a resolution
requesting VDOT for maintenance to drainage pipes on Taney Drive.

PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS
1. Recoanition of Treasurer Alfred Anderson for receiving
desianation as Certified Finance Official.
Supervisor Nickens recognized Mr. Anderson for his recent
certification¡whic he received through the National Continuing
Education Certificate Training Program.

Roanoke County was notified by one of the property owners on
Farmington Drive that new culverts and a driveway entrances
were being installed in MUdlick Creek by Mr. David Hauser. Mr.
Hauser was requested by the County to remove his facilities or
verify by a drainage study that the driveway and culvert were not
causing drainage problems to other property owners. By letter
dated March 1, 1989, Mr. Hauser was given until August 1 to
resolve the concern and as of July 25th, Mr. Hauser has not
addressed the problem. Mr. Henry requested that the Board
authorize the County Attorney to file with the Circuit Court an
injunction to require Mr. Hauser to complete the work.
Supervisor Robers moved to approve the staff
recommendation. The motion was seconded by Supervisor McGraw,
and carried by the following recorded vote:

2. ADproval of new Dosition in the Office of the
Sheriff

Sheriff Michael Kavanaugh advised that the Governor has
approved additional funding for ten emergency law enforcement
positions and Roanoke County was chosen as one of the localities
to receive one of these positions. The state Compensation Board
will fund this position at $17,277 and additional funds of $869

snould be appropr1ated to supplement the salary. The new
position would allow an additional uniform patrol officer on the
third patrol platoon. Staff recommended accepting the State
compensation Board allocation and the appropriation of an
additional $869 from the Board Contingency Fund. The vehicle,
uniform and other equipment will be funded from within the
existing Sheriff's budget.
In response to a question from Supervisor Robers,
Sheriff Kavanaugh advised this new position will be a road
officer.
Supervisor Nickens moved to approve the staff
recommendation. The motion was seconded by Supervisor McGraw,
and carried by the following recorded vote:

3. Resolution reauesting VDOT for maintenance to
drainaqe pipes on Taney Drive
Mr. Hodge advised that residents in Taney Drive have
experienced flooding in their homes recently due to insufficient
drainage. He requested that a resolution be sent to the Virginia
Department of Transportation requesting inspection of the
drainage pipes and that the necessary repairs be made to
alleviate the flooding problems.
Supervisor Johnson moved to adopt the prepared
resolution. The motion was seconded by Supervisor McGraw, and

RESOLUTION 8889-3 REVUESTING ASSISTANCE TO RESOLVE
DRAINAGE PROBLEMS ON TANEY DRIVE
WHEREAS, the residents living on Taney Drive have
experienced flooding in their homes recently, and
WHEREAS, efforts to correct this problem by maintaining
the drainage pipes have not successfully resolved this problem.
BE IT RESOLVED that the Board of Supervisors of Roanoke
County, Virginia respectfully requests that the Virginia
Department of Transportation investigate the drainage problems on
Taney Drive and that they make the necessary repairs under their
maintenance program to alleviate the flooding problems.
On motion of Supervisor Johnson, seconded by Supervisor
McGraw, and carried by the following recorded vote:

FIRST READING OF ORDINANCES
1. Ordinance authorizinq conveyance of riqhts of way in
Hollins Community DeveloDment Proiect for acceDtance
into the State Secondary System.
Assistant County Administrator Joseph Obenshain presented the
staff report advising that property originally conveyed to Roanoke

County for the road improvements as part of the Hollins Community
Development Project must now be conveyed to Botetourt County so that
the roads may be accepted into the Secondary System. No one was
present to speak on the ordinance and there was no discussion.
Supervisor Johnson moved to approve first reading of the
ordinance. The motion was seconded by Supervisor Robers and carried by
the following recorded vote:

2. Ordinance authorizinq the dedication of County well
lots for benefit of the DeDartment of Health.
Mr. Obenshain reported that the Board needs to authorize the
dedication of four well lots to be used exclusively for wells because
the Department of Health requires this action in order for the wells
to be put into operation. No one was present to speak on this
ordinance and there was no discussion.
Supervisor Garrett moved to approve first reading of the
ordinance. The motion was seconded by Supervisor McGraw and carried
by the following recorded vote:

Mr. Obenshain presented the staff report. There was no one
to speak on the ordinance and no discussion.

was seconded by Supervisor McGraw and carried by the following

ORDINANCE 8889-4 ACCEPTING AN OFFER FOR AND
AUTHORIZING THE CONVEYANCE OF SURPLUS REAL ESTATE ON
ROUTE 1832 (BARRENS ROAD)
BE IT ORDAINED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
I. That pursuant to the provisions of Section 16.01 of the
Charter of Roanoke County, the subject property is being made
available for other public uses by conveyance to the Virginia
Department of Transportation.
2. That pursuant to the provisions of Section 18.04 of the
Charter of Roanoke County, a first reading on this ordinance was held
on July 25, 1989; and a second reading was held on August 8, 1989,
concerning the conveyance of certain real estate located along Route
1832 (Barrens Road) identified on Sheets 3 and 4 of the plans for
Route 1832, State Highway Project 1832-080-196, C50l. The conveyance
of this real estate consists of 566 square feet of land in fee, 305

~quare feet in permanen~ dra1nage easement, and 4,966 square feet in
temporary construction easement.
3. That the offer of the Virginia Department of
Transportation in the amount of $3,695.00 is hereby accepted and the
conveyance of the real estate described above to the Virginia
Department of Transportation for other public uses is hereby
authorized and approved.
4. That the County Administrator is authorized to execute
such documents and take such actions as may be necessary to accomplish
the conveyance of this property, all of which shall be upon form
approved by the County Attorney.

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
SUDervisor McGraw announced that the Grayson Commission
will be meeting on August 14, 1989.
SUDervisor Nickens expressed concern about law
enforcement and advised he had received letters and telephone
calls from citizens expressing the same concerns. He asked for
Board of Supervisors concurrence to direct the County
Administrator to restudy the possibility of a police department

to proviðe law entorcement and a Sheriff's Department for jail
and court coverage. He further requested that a report be
brought to the August 22 meeting regarding whether there would be
a state funding decrease by having a pOlice department. He asked
that this information be brought back in time for a possible
referendum in November. The board members concurred with his
recommendation by a unanimous voice vote.

JOINT WORK SESSION WITH PLANNING COMMISSION
Chairman Garrett reported that all members of the Board

uL 5upervisors were present and Planner Jon Hartley advised that

all members of the Planning Commission were present.
1. Economic Development Activities. i.e. Proposed
Industrial Land Rezonings
Economic Developmen Director Tim Gubala present the
report. He updated the Board and Planning Commission on the
75/25 pOlicy. He advised that the Board directed the staff to
complete a review of industrial sites and to make recommendations
for further participation in industrial sites during the fiscal
year.
Supervisor McGraw stated he felt the County needed
three staff people selling Roanoke County. In response to a
question from Supervisor Robers, Mr. Hodge advised that they had
not yet contacted the people from Northern Virginia. There was a
discussion on better marketing efforts by the Regional
Partnership on behalf of Roanoke County.
2. Zonina Ordinance Revision Update
Planning Commission member Don Witt presented an update
on the Sign Ordinance, reporting that a Sign subcommittee was
formed in January 1989 made up of business men and individuals
from the sign industry.
They met for six months and have now
come up with a proposed ordinance. Mr. Witt advised that the
Planning Commission has been studying the sign ordinance and will
hold a public hearing in September. He outlined the changes to
the proposed ordinance.

Planner Jon Hartley reported on changes to the Zoning
Ordinance as it pertains Rural Preserve areas, specifically in
the Catawba Valley. Recommendations included reducing permitted

densities in rural areas. He advised the Board that changes in
the Catawba Valley area will serve as a model for other rural
areas.
Planner Dale Castellow reported on the Commercial
Development Subcommittee recommendations for the Zoning Ordinance
revision. This subcommittee has recommended revision of the B-3
Special Commercial District and creation of Neighborhood
Commercial Districts, Planned Commercial Districts and
Interchange Commercial Districts. In response to a question from
Supervisor Johnson regarding the legality of these changes, he
advised that they are working with County Attorney Paul Mahoney
on this issue.
Jon Hartley presented the proposed changes to the
rezoning process, recommending the reduction of paperwork and use
of first and second reading of ordinances for rezoning petitions
instead of final orders and proffer of conditions. Mr. Hartley
also outlined future projects that the Planning Commission and
Planning staff will be working on which included the 1990 census,
redistricting, the Land Use Plan update and the Roanoke River
Corridor study.
