The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
second regularly scheduled meeting of the month of September,
1986.

The invocation was given by the Reverend Margaret Tyree
þf Grandin Court Baptist Church. The Pledge of Allegiance was
recited by all present.
Chairman Brittle introduced Mr. J. B. Varney, Chairman
þf the Botetourt County Board of Supervisors and thanked him for
attending this meeting.
IN RE:
COUNTY ADMINISTRATOR'S COMMENTS
Mr. Hodge requested that Chairman Brittle present an
~conomic development award to Timothy W. Gubala, Assistant County
~dministrator of Community Development.
Chairman Brittle presented a framed certificate to Mr.
þubala. He explained that Mr. Gubala earned this certificate for
Þompleting a three year course at the University of Oklahoma.
The certificate was awarded from the Economic Development
Institute sponsored by the American Economic Development Council,
Inc.
IN RE:
PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS
Chairman Brittle presented a resolution of appreciation
to Ms. Marion Danco, President of the Roanoke Council of Garden
Clubs, for their donation of landscaping materials and services
~o the Youth Haven II program. Ms. J. B. Graham, Civic Chairman
and Mrs. Bayer of the Council of Garden Clubs were also present
~o accept the resolution.
Supervisor Brittle moved to approve the prepared
~esolution. The motion was seconded by Supervisor Garrett.

WHEREAS, in May of 1985, the Board of Supervisors
recognized the need for and approved the development of a home
for troubled girls in Roanoke County; and
WHEREAS, the buildings and grounds where the Youth
Haven II home will be located have required substantial
renovation and improvement; and
WHEREAS, the Roanoke Council of Garden Clubs, Inc., ha
generously donated landscaping materials and services valued up
to $750.00 and in doing so, have greatly improved both the safet
and appearance of the grounds; and
WHEREAS, this act of generosity and support is one tha
expresses in a meaningful way the concern of this organization
for the troubled youth of the Roanoke Valley and further
demonstrates an admirable sense of civic responsibility.
NOW, THEREFORE, the Roanoke County Board of Supervisor
wishes to express its gratitude and the gratitude of all Roanoke
County citizens for the services provided by the Roanoke Council
of Garden Clubs, Inc., for the youth of our community, the Youth
Haven II Program, and Roanoke County.
On motion of Supervisor Brittle, seconded by Supervisor Garrett,
and upon the following recorded vote:
AYES: Supervisors Garrett, Nickens, Johnson, and Brittle

Chairman Brittle also presented a proclamation
declaring the month of September Adult Illiteracy Awareness Mont
to Ms. Sandra Stromberg, Public Information Officer of Literacy
Volunteers of America--Roanoke Valley.
Supervisor Garrett moved to approve the prepared
Proclamation. The motion was seconded by Supervisor Johnson and
carried by a unanimous roll call vote with Supervisor McGraw
absent.
PROCLAMATION

WHEREAS, 27 million Americans are functionally
illiterate; and
WHEREAS, on August 27, 1986, a Presidential
Proclamation was issued declaring September 1986, Adult
Illiteracy Awareness Month; and
WHEREAS, Literacy Volunteers of America--Roanoke Valley
was established in March 1986, as part of a national movement to
reduce adult illiteracy in America; and
WHEREAS, more than 1.5 million Virginians are severely
handicapped by functional illiteracy, according to Virginia
Department of Education statistics published in 1985; and
WHEREAS, Literacy Volunteers of America--Roanoke Valley
is dedicated to raising the level of awareness and addressing the
problem of illiteracy in the Roanoke Valley through the
development of teaching methods, recruitment, and training of
volunteers to tutor adult learners; and
WHEREAS, it is appropriate and fitting to focus
attention upon the problem of illiteracy in Roanoke County;
NOW, THEREFORE, we, the Roanoke County Board of
Supervisors, do hereby proclaim the month of September 1986,
~dult Illiteracy Month and September 21-28, 1986, Literacy Week
for Roanoke County and call upon our citizens to observe the
month with appropriate programs, ceremonies, and activities.
IN RE:
NEW BUSINESS
1. Endorsement of the Bond Referendum by Roanoke
Walley Chamber of Commerce and the Roanoke County-Salem Chamber
þf Commerce - Mr. John Schear of the Roanoke County-Salem Chamber
þf Commerce reported to the Board that at the last Board of
þirectors meeting, the Chamber unanimously endorsed the water
referendum and the establishment of a police department in
Roanoke County.

Mr. Bill Hawkins of the Roanoke Valley Chamber of
Commerce reported to the Board that the Chamber applauds the
County for their efforts, dedication, and determination in
dealing with the difficult issues of the water and police
department. He presented the following resolution from the
Chamber endorsing the the Bond Referendum.
RESOLUTION
WHEREAS, the need for adequate supplies of high qualit
water is important to all of the citizens of the valley; and
WHEREAS, growth and industrial development are
dependent upon adequate water supplies; and
WHEREAS, Roanoke County has developed a plan for the
Spring Hollow Reservoir to insure that the needed water supply i
available; Therefore
BE IT RESOLVED By the Board of Directors of the Roanok
Valley Chamber of Commerce that it strongly endorses the Bond
Referendum and urges all citizens to support this most important
project.
2. Appointments to the Blue Ribbon Bond Committee -
Chairman Brittle announced that Ms. May Johnson, Mr. Bill
Cundiff, Mr. Joe Thomas, Mr. Carson Quarles, and Mr. Wayne
Goodman will be serving on the Blue Ribbon Commission. He also
announced that the first meeting of this commission will be
October 14, 1986, at 2:00 p.m.
3. Request to Enter into Firefighting Mutual Aid
Agreement with Botetourt County - Chairman Brittle announced tha
Mr. J. B. Varney, Chairman of the Botetourt County Board of
Supervisors and Chief Corbett of the Troutville Fire Department
were present.
Tommy Fuqua, Fire and Rescue Chief reported that this
agreement will provide the best possible services to citizens in
both localities and requested that the Board authorize the Count
Administrator to execute the agreement.

Supervisor Johnson moved to approve staff
vecommendation to authorize the County Administrator to move
forward with this agreement. The motion was seconded by
Supervisor Nickens and carried by a unanimous roll call vote with
Supervisor McGraw absent.
Mr. J. B. Varney reported that he has received
notification from the Blue Ridge Fire Station that they would
like to participate in such an agreement.
4. Request to Increase Building and Trade Permit
Reinspection Fees - Mr. Skip Ninninger, Chief Building Official,
-eported to the Board that there has been an increase in
necessary reinspections. The fee for reinspection is currently
$10 and Mr. Ninninger requested that the Board increase the fee
LO $20.00.
Supervisor Nickens moved to approve the recommendation
rom the staff to increase the fee to $20.00. The motion was
seconded by Supervisor Brittle and carried by a unanimous roll
:all vote with Supervisor McGraw absent.
5. Request for Application of Green Hill Park Grant -
3ary Huff, Buildings and Grounds, was present to request that the
Board authorize him to apply for a grant to be used for the
þonstruction of Green Hill Park.
Supervisor Nickens moved to concur with staff
~ecommendation. The motion was seconded by Supervisor Garrett.
RESOLUTION 9-23-86-199 AUTHORIZING
THE SUBMISSION OF A GRANT
APPLICATION IN THE AMOUNT OF
$600,000 FOR GREEN HILL PARK
BE IT RESOLVED by the Board of Supervisors of Roanoke
tounty, Virginia, as follows:
1. That the County of Roanoke is hereby authorized and
~irected to cause to be prepared and to be submitted a certain
grant application in the amount of $600,000, the same to be used
æor the construction of a certain park on County-owned property
~n the Green Hill area of Roanoke County; and

2. That the Board does hereby express its intent to
appropriate a sum not to exceed one-half of the grant amount, to
wit: $300,000 as the County's share of such construction costs;
and
3. That the County Administrator be, and hereby is,
authorized and directed to execute such grant application on
behalf of Roanoke County upon a form approved by the County
Attorney.
On motion of Supervisor Nickens, seconded by Supervisor Garrett,
and upon the following recorded vote:
AYES: Supervisors Garrett, Nickens, Johnson, and Brittle

ABSENT: Supervisor McGraw
6. Funding Options for Park Access Roads - Gary Huff
reported to the Board that the County was allocated $200,000 in
1984 for park access roads. Six projects were to be completed
with this $200,000. However, when these projects were bid, the
bid was returned at approximately $240,000. Since this is over
the amount allocated to the County, it was necessary to drop two
of the smaller projects. This reduced the bid to approximately
$160,000. The Board expressed a concern that the County had
essentially "lost monies" and directed Mr. Hodge·to work with Mr
Huff and Mr. Peters to try to obtain additional monies to fund
the two parks that had to be deleted from the project list.
Supervisor Johnson moved to approve staff
recommendation and directed that the County Administrator bring
forward a report on the possibilities of obtaining the additiona
funding for the two park projects that were deleted from the lis .
The motion was seconded by Supervisor Garrett and carried by a
unanimous roll call vote with Supervisor McGraw absent.
7. Request for Application of Green Hill Park Access
Grant - Gary Huff presented a report to the Board to approve
application of a grant for Green Hill Park.

RESOLUTION 9-23-86-201 AUTHORIZING
THE SUBMISSION OF A GRANT
APPLICATION FOR GREEN HILL PARK
ACCESS
BE IT RESOLVED by the Board of Supervisors of Roanoke
~ounty, Virginia, as follows:
1. That the Board, being owner of a certain park
situate, lying and being in Roanoke County, to wit: Green Hill
Park, does hereby authorize a certain grant application in the
sum of $200,000 be forthwith submitted to the Commonwealth of
lTirginia, Department of Highways and Transportation and the
)ivision of Parks and Recreation, in order to have the access
oad serving said park taken into the secondary highway system;

2. That the County Administrator be, and hereby is,
uthorized and directed to cause the requisite grant application
o be prepared and submitted, the same to contain among other
)rovisions such as certification of right-of-way and zoning, as
nay be required in the premises, all of which shall be in form
pproved by the County Attorney; and
3. That an attested copy of this resolution be
ttached to and submitted with such grant application.

8. Industrial Access Funding for Southwest Industrial
~ - Brent Sheffler, Department of Development, presented a
~equest to the Board of Supervisors to authorize the County
~dministrator to request industrial access funding from the State
~nd to execute a County/State agreement to allow the County to

administer the construction for road improvements at Southwest
Industrial Park.
Supervisor Nickens moved to concur with staff
recommendation. The motion was seconded by Supervisor Johnson
and carried by a unanimous roll call vote with Supervisor McGraw
absent.
9. Request to Exercise Option to Purchase Several
Tracts for Spring Hollow Reservoir - Mr. John Hubbard reported
that three property options on land for the Spring Hollow
reservoir will expire within the next two months. He requested
permission to exercise these options in the amount of $39,739.20
The options include the purchase of 14.40 acres of Tax Map
72.00-1-17, all of Tax Map 83.00-1-2, and 62 acres of Tax Map
83.00-1-1. Mr. Hubbard reported that the funds required for
these options are available in the CIP fund.
Supervisor Nickens moved to concur with staff
recommendation. The motion was seconded by Supervisor Garrett
and carried by a unanimous roll call vote with Supervisor McGraw
absent.
10. Recommendation of the Human Services Committee for
1986/87 Funding - Chairman Brittle moved to approve the
recommended funding for the Human Services Committee.
Supervisor Nickens requested that the motion be amende
to exclude funding for the Adult Care Center of Roanoke Valley.
He reported that he is on the Board of Directors of the Adult
Care Center and could not vote on that portion of funding.
Supervisor Brittle accepted the amendment. The motion
was seconded by Supervisor Johnson and carried by a unanimous
roll call vote with Supervisor McGraw absent.

funding for the Adult Care Center of Roanoke Valley. The motion
was seconded by Supervisor Johnson and carried by the following

RESOLUTION 9-23-86-205.A ENDORSING THE
BLUE RIDGE REGION OF VIRGINIA
WHEREAS, the Roanoke Valley is located within a region
having many economic attributes; and
WHEREAS, a group of Roanoke Valley businessmen in
~onjunction with local government is desirous of marketing the
~alley and Region for purposes of Economic Development; and
WHEREAS, this group has been meeting since March 12,
986, to refine the concept of regionally marketing this section
)f Virginia; and
WHEREAS, the region is now established as the Blue
~idge Region of Virginia and committees and by-laws have been
=stablished.
NOW, THEREFORE, BE IT RESOLVED, that Roanoke County is
charter member of the Blue Ridge Region of Virginia and
1eartily endorses its formation and development to market West
:entral Virginia as an economic area for future regional growth
~nd development that will benefit all citizens residing within

RESOLUTION 9-23-86-205.C IN SUPPORT OF
STATE FUNDING FOR THE CARDINAL CRIMINAL
JUSTICE ACADEMY
WHEREAS, the Commonwealth of Virginia, Department of
Criminal Justice Services is conducting a study of the state's
criminal justice training delivery system; and
WHEREAS, the Sheriff of Roanoke County and the Roanoke
County Board of Supervisors train deputies and other law enforce
ment personnel at the Cardinal Criminal Justice Academy in Salem
Virginia; and
WHEREAS, the establishment of the Cardinal Criminal
Justice Academy was accomplished through the joint cooperative
efforts of several local governments; and
WHEREAS, as a result of the excellent and rigorous
training provided by this Academy many localities are utilizing
its facilities and training program.
NOW, THEREFORE BE IT RESOLVED that the Board of
Supervisors of Roanoke County, Virginia hereby supports state
funding of the Cardinal Criminal Justice Academy. The deputy
clerk is hereby directed to forward a certified copy of this res -
lution to the Department of Criminal Justice Services and to mem
bers of the local legislative delegation.

RESOLUTION 9-23-86-205.H CONCERNING THE
CONSTITUTION'S BICENTENNIAL CELEBRATION

WHEREAS, September 17, 1987, marks the 200th
anniversary of the U. S. Constitution; and
WHEREAS, the Chairman of the Roanoke County Board of
Supervisors and the Mayor of the City of Roanoke have jointly
proclaimed September 17, 1987, U. S. Constitution Day; and
WHEREAS, the Constitution was designated to maintain in
perpetuity our unique form of democracy; and
WHEREAS, through this written document, the United
States has provided liberty and stability for its citizens for
more than a century - a claim no other government in the world
can make; and
WHEREAS, the Bicentennial offers the opportunity for
Americans to rededicate themselves to the great principles that
have formed the basis of our national strength and prosperity;
and
WHEREAS, the observance of the Bicentennial of the
Constitution through forming a single Bicentennial Community is
of Valleywide interest.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County
Board of Supervisors joins the City of Roanoke and any other area
jurisdictions to form a single Bicentennial Community, and that
the Board of Supervisors is hereby authorized to appoint members
to a broad-based, non-partisian Bicentennial Commission to be
composed of an equal number of members appointed by Roanoke City
and any other participating jurisdictions.

Roanoke County Code, adding a new section number 3-2 and entitleë

Mr. Steve Waldrop, agent for Super 8 Developers of
Aberdeen, South Dakota, was present to answer any questions the
Board might have. He reported that the proposed project will be
a 62 unit motel on Thirlane Road. The approximate cost of this
project will be $600,000 plus a parcel to lease to a restaurant
which will cost an additional $120,000 to $150,000. He reported
that the project currently provides for development of the front
2.5 acres and leave the balance natural unless site drainage
requirements are needed on the back of the property. Mr. Waldro
also reported that T. P. Parker & Son has worked on the site
concerning street access, they have applied to the Highway
Department and they have requested a single entrance to take car

William L. Martin, representing Mr. Thompson, was
present to answer any questions the Board might have. He
presented additional plat copies of the property in question to
the Board of Supervisors. He also presented copies of the floor
plan of the proposed apartments to the Board members. Mr.
Thompson plans to construct four apartments which rent for
approximately $400 per month on this lot.
Supervisor Johnson inquired about the inadequate yard
distances. Mr. Martin responded that the petitioner is currently
making arrangements to adjust this problem. Supervisor Johnson
advised Mr. Martin that if the petition is granted, these yard
distance requirements must be satisfied before construction is
permitted to begin.
Mr. David Ragland, 7435 Plantation Road, NW, Roanoke,
Virginia, was present in opposition to the rezoning request. He
presented a petition signed by citizens of that area who are
opposed to the rezoning. The citizens are concerned that the
rezoning would decrease property value and they do not feel like
the property is large enough to accommodate the apartment
building.
Supervisor Johnson moved to continue this matter for
thirty days.

986-7 Public Hearing on the tax-exempt status for Edinburg
Square Foundation, Inc.
Paul Mahoney reported to the Board that Edinburg Squar
Foundation has applied for tax-exempt status, specifically,
exemption from local real estate taxes. Mr. Mahoney reported
that staff recommends denial of the request so that the Board
will be consistent and uniform with prior actions.
Mr. Robert McNichol, 5015 Williamson Road, Roanoke,
Virginia, requested that the Board support the tax-exempt status
for Edinburg Square Foundation, Inc., pursuant to Section
30-19.04 of the Code of Virginia of 1950 as amended. Mr.
McNichols reported that he and his staff have been working for
several years to obtain this tax-exempt status. Edinburg Square
Foundation is a 50lC3 tax exempt foundation in conformance with
the IRS's strictest standards for non-profit organizations. The
purpose of Edinburg Square Foundation is to provide safe and
decent housing for low income elderly. It will provide housing
for people with an incomes of $10,150 or less, 62 years of age 0
older, or physically handicapped. He reported that the Board of
Directors receives no compensation. The project will employ fou
people and will provide $300,000 per year in monies to the local
economy. The property is currently leased and occupation will
begin October 1, 1986. The League of Older Americans of Roanoke
Valley and The Independent Odd Fellows of Mountaindale Lodge #49
are sponsors of Edinburg Square. Mr. McNichol reported that his
organization must be successful before the local governing body
in order to present the tax-exempt petition to the General
Assembly. Tax-exempt status is critical at this time since
Edinburg Square does not have the funds to pay the taxes under
the current budget and if it is required that they pay taxes,

Housing and Urban Development must be petitioned for rental
ncrease which will increase the cost to the residents.
Chairman Brittle advised Mr. McNichol that his
Jrganization may go to the General Assembly with approval, denial
)r no action of the local governing body.
Mr. Bruce Bloodworth, President of the Board of
birectors of the League of Older Americans, 120 Trinkle Avenue,
~E, Roanoke, Virginia, was also present to request that the Board
3upport the petition for tax-exempt status.
Mr. Ronkeith Adkins, 3057 Timberlane Ave., SW, Roanoke,
lTirginia, was also present to request support of this petition.
~r. Adkins reported that there is a great need for housing of
his type in the Valley.
Mr. McNichol reported that currently Edinburg Square
þwes $162,700 which was spent for interim financing to make this
)roject work.
Supervisor Nickens inquired about the per unit rate.
~r. McNichol reported that the rent per unit will be $464 but
hat residents will only pay $100. This rent does include water,
ewer, and garbage however, a utility allowance is made available
or electricity. Supervisor Nickens asked what the projected
tility cost would be. Mr. McNichol responded that the utility
'ost is approximately $60 for a one bedroom and $50 for a studio.

llowed toward that $60. Mr. McNichol responded that it is a
tility allowance that will be paid to the resident for the
lectricity based on their income. Ms. Mary Elyn Lauth,
dministrator of Edinburg Square, 5151 Mason Park Drive, Roanoke,
irginia, reported that all of the tenants receive the full
tility allowance which is subtracted from their rent, if 30
ercent of their adjusted income yields $100 of rent, they would

apartment for rent, retaining $60.00 to offset the electrical
bill.
Supervisor Nickens also inquired about a situation
where a tenant fails to make his rent payment. Mr. McNichol
reported that if a tenant can no longer afford to make his renta
payment, arrangements will be made with Social Services to aid i
making the payment, also, if a tenant's income falls, the rent
will be adjusted accordingly.
Supervisor Nickens asked about the total amount of
indebtedness on the structure and the period of morgage
indebtedness. Mr. McNichol responded that the mortgage
indebtedness is approximately $3,751,000 for a period of 40 year
at 9.25 percent interest.
Supervisor Nickens asked if tenants are paying up to
$100 in rent, where the other $364 of rent will be obtained. Mr
McNichol responded that there is a Section 8 subsidy from Housin
and Urban Development which pays the balance.
Supervisor Nickens also inquired about the property
after the mortgage is paid. Mr. McNichol reported that, assumin
the property is in good condition, it becomes the property,
without a mortgage, of Edinburg Square Foundation, and they in
turn, can reduce the rents as permitted since they are chartered
to do so as a benevolent charitable non-profit organization, or
it could be transferred to another non-profit organization under
the supervision of a Circuit Court judge.
Ms. Lauth reported to the Board that when a tenant is
unable to pay rent, their income is recertified so that their
rent will decrease accordingly. Assistant is provided from
various social service organiations. Ms. Lauth stressed the fac
that a tenant will not be removed from Edinburg Square because
they do not have the funds to pay rent.
Mr. Ed Natt reported that in order to determine
tax-exempt status, there are two issues involved. The first

issue is the provisions of the constitution of Virginia, which is
a legal issue, whether we fall in those categories and number
two, the precedent that the Board is setting in regard to other
establishments within Roanoke County. Mr. Natt stressed to the
Board that Article X, Section VI, of the Constitution which
states that organizations are taxable unless they fall into one
of the following categories: property used for the purposes of a
charitable, benevolent organization.
Supervisor Garrett inquired as to whom would make the
determination as to occupants. Ms. Lauth responded that there is
a required process established by federal regulations.
Applications must be accepted and processed on a first come first
serve basis. However, once the applications are accepted, each
prospective tenant must fill out a detailed application which
lists all of their income and assets. A paper is then signed to
allow Edinburg Square to investigate the stated income at source.
After these papers are returned, assets are totalled to see if
the perspective tenant meets eligibility requirements. If they
do not meet the income eligibility, letters are sent stating that
they are not eligible to live there, then the first 96 that are
eligible, are then offered apartments. Edinburg Square currently
has all 96 units filled, and in addition have a waiting list of
175 eligible people. The average turn over is at the most ten
units per year. At that rate, the current waiting list will last
for 17 1/2 years.
Supervisor Johnson inquired if the Board has ever
granted tax-exempt status to a 50lC3 entity. Mr. Mahoney
responded that to his knowledge the Board has never granted
tax-exempt status to such an organization. Mr. Mahoney also
stressed to the Board that they should continue in uniformity.
Supervisor Nickens moved to deny the petition for
tax-exempt status. The motion was seconded by Supervisor Brittle
and carried by the following recorded vote:
