The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
second regularly scheduled meeting of the month of August, 1986.

Chairman Brittle presented a resolution to Betty Desper
)f Total Action Against Poverty expressing the Board's support of
PAP's request for additional State funding.
Supervisor Johnson moved to approve the prepared
esolution. The motion was seconded by Supervisor McGraw.
RESOLUTION 8-26-86-176 SUPPORTING TOTAL
ACTION AGAINST POVERTY AND THEIR REQUEST
FOR FUNDS IN THE AMOUNT OF $3.6 MILLION
FROM THE COMMONWEALTH OF VIRGINIA
WHEREAS, Total Action Against Poverty has been
~esignated by the Roanoke County Board of Supervisors as the
fficial community action agency for this jurisdiction and is a
artner with Roanoke County in helping low income persons and
ommunities improve their capacity to sustain themselves and
mprove their standard of living¡ and
WHEREAS, Total Action Against Poverty has continued to
erve the low income citizens of this area with many critical
ducational and community development programs and benefited the
otal community with an economic impact of $920,470 paid in wages
nd services and a cost savings of $207,104¡ and
WHEREAS, community action programs across this
'ommonwealth have been drastically reduced with recent cutbacks
n federal funds, even before Gramm-Rudman, and this locality has
lready contributed to TAP in an effort to sustain the work of
his important agency¡ and

WHEREAS, the Commonwealth of Virginia has not until no
provided any funds to supplant revenue lost to the core funding
of community action, which makes possible the outreach, planning,
management, and service capability necessary to the continued
success of these agencies¡ and
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, Virginia, that the County
of Roanoke will continue to appoint a representative to the Boar
of Directors of Total Action Against Poverty, will continue to
work in every way with that agency to offer a "Hand Up" to its
low income residents, and will continue to provide local
financial support as we are able¡ and
BE IT FURTHER RESOLVED, that the County of Roanoke
supports the request that the Commonwealth of Virginia in its
1987 budget to set aside $3.6 million of state funds for the wor
of community action agencies throughout Virginia, the large
majority of those funds going to existing community action
agencies.
On motion of Supervisor Johnson, seconded by Supervisor McGraw,
and upon the following recorded vote:

A resolution of appreciation was also presented by
Chairman Brittle to Steve Bison of Bartlett Tree Service for
their donation of $600 of services to Youth Haven II.
Supervisor Nickens moved to approve the prepared
resolution. The motion was seconded by Supervisor Garrett.
RESOLUTION 8-26-86-177 EXPRESSING THE
APPRECIATION OF THE ROANOKE COUNTY BOARD
OF SUPERVISORS TO BARTLETT TREE SERVICE
FOR THEIR DONATION OF SERVICES TO YOUTH
HAVEN II
WHEREAS, in May of 1985, the Board of Supervisors
recognized the need for and approved the development of a home
for troubled girls in Roanoke County¡ and

WHEREAS, the buildings and grounds where the Youth
Haven II home will be located have required substantial
renovation and improvement¡ and
WHEREAS, Bartlett Tree Service has generously donated
their tree trimming services valued at $600.00 and in doing so,
have greatly improved both the safety and appearance of the
grounds¡ and
WHEREAS, this act of generosity and support is one that
expresses in a meaningful way the concern of this organization
for the troubled youth of the Roanoke Valley and further
demonstrates an admirable sense of civic responsibility.
NOW, THEREFORE, the Roanoke County Board of Supervisors
wishes to express its gratitude and the gratitude of all Roanoke
County citizens for the services provided by Bartlett Tree
ßervice for the youth of our community, the Youth Haven II
Þrogram, and Roanoke County.

Ms. Margaret Evans, a representative of the Roanoke

RESOLUTION 8-26-86-178 RECOGNIZING THE
66th ANNIVERSARY OF THE 19th AMENDMENT TO
THE CONSTITUTION OF THE UNITED STATES OF
AMERICA
WHEREAS, the United States is bounded upon the
þrinciples of freedom and equality for all people¡ and
WHEREAS, sixty-six years ago today, 26 August, 1986,
~fter many years of arduous work by dedicated women, the 19th

Amendment, which guarantees women the right to vote became part
of the Constitution of the United States of America¡ and
WHEREAS, this fundamental right was won some 72 years
after the Women's Suffrage Movement began¡ and
WHEREAS, it is appropriate to honor and recognize thes
gallant women who struggled to provide that right to succeeding
generations of American women.
NOW, THEREFORE, the Roanoke County Board of Supervisor
recognizes the 66th anniversary of the 19th Amendment and honors
those courageous women who worked and continue to work for the
rights of women everywhere in the United States and the world.
On motion of Supervisor Johnson, seconded by Supervisor Nickens
and upon the following recorded vote:

IN RE: NEW BUSINESS
l. Report on Sesquicentennial Activities - Mr. Hodge
introduced Bonnie Newlon and Steve Musslewhite, who updated the
Board on the activities of the Sesquicentennial Committee, Inc.
Ms. Newlon reported that Ms. Diedie Kagey would be preparing the
history book on Roanoke County.
2. Request for Approval to Upgrade Water Line In
Huntridge, Section 2 - Mr. Mike Webb, acting Director of
Engineering, reported that the water lines in this subdivision
need to be upgraded in order to connect with the Vinton/Route 46
water line. He also reported that the total estimated cost of
this improvement will be $14,437.50 and that funding was include
in last year's bond referendum.
Supervisor Brittle moved to approve staff's request.
The motion was seconded by Supervisor Nickens and carried by a
unanimous roll call vote.

3. Resolution of Support for Total Action Against
Poverty's Request for Funding From the State of Virginia - This
resolution was presented under the Proclamations, Resolutions,
Recognitions, and Awards portion of the agenda.
IN RE:
REQUESTS FOR PUBLIC HEARINGS
1. Request for a Public Hearing to Consider the
Tax-Exempt Status for Edinburgh Square Foundation, Inc. -
Supervisor Johnson moved to establish a public hearing for this
matter on September 23, 1985. The motion was seconded by
Supervisor Garrett and carried by a unanimous voice vote.
IN RE:
WORK SESSIONS
1. Presentation of the 1987 Legislative Program - Mr.
Mahoney, County Attorney, presented a memo to the Board
concerning issues to be included in the Legislative Packet.
Supervisor Nickens requested that the list be reduced to only
three or four issues as requested by the delegates. He also
requested that certain County issues be handled by the Virginia
Association of Counties. The Board directed Mr. Hodge to proceed
with the issues that VACO would adopt and that the County
Attorney report back to the Board on September 9, 1986,
concerning issues unique to Roanoke County.
IN RE:
APPOINTMENTS
Supervisor Garrett nominated Mr. Daniel Zahn to the
Industrial Development Authority and Ms. Betty Jo Anthony to the
Social Services Board.

Chairman Brittle requested that each Board member
appoint one person to the Roanoke County Commission on the
Constitution's Bicentennial in order to form a core committee.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor McGraw - Supervisor McGraw reported that th
next meeting of the Blue Ridge Region will be held on Thursday,
August 28, 1986, at the Bedford Armory.
Supervisor Garrett - Supervisor Garrett inquired about
citations for illegally parked vehicles in handicapped parking
spaces. Mr. Hodge reported that there have been problems becaus
spaces are not marked clearly but that staff is working on more
visible markings for handicapped spaces. Chairman Brittle
directed staff to investigate state laws concerning the
identification of handicapped spaces and return that information
to the Board of Supervisors.
Supervisor Johnson - Supervisor Johnson inquired about
upgrading roads in LaBellevue subdivision. Mr. Hubbard reported
that bids have been received and that Mr. Covey is currently
preparing a report for the next Board meeting.
Supervisor Johnson also inquired about the Conflict of
Interest laws. The Board directed Mr. Mahoney to obtain a copy
of Fairfax County's ordinance concerning Conflict of Interest an
copy it to each Board member. Mr. Mahoney was also directed to
prepare a draft ordinance for the Board's consideration.
Supervisor Brittle - Supervisor Brittle reported that
he has received a letter from Roanoke City Councilman David
Bowers requesting that copies of the Board's agendas be sent to
all Roanoke City Council members, Salem City Council members,
vinton Council members, and all city and town managers.

WHEREAS, Roanoke County wishes to assure a leadership
role in the 1986 United Way campaign.
NOW, THEREFORE, the Roanoke County Board of Supervisor
endorses Roanoke County's participation in the PACESETTER progra
held prior to the general united Way campaign and encourages
County employees to support the program.
FURTHER, the Board wishes to commend and thank those
employees who are giving of their time and efforts to coordinate
the PACESETTER program in Roanoke County.
The Board also wishes great success for the General
United Way campaign set to begin in early September.
On motion of Supervisor Nickens, seconded by Supervisor Johnson

CITIZENS' COMMENTS AND COMMUNICATIONS
Mr. G. E. Talbert was present to request that the Board
of Supervisors consider widening Sunnycrest Road (State Route
725) and also provide road clearing services during the winter.
:hairman Brittle directed John Hubbard, Assistant County
~dministrator of Public Facilities, to contact Mr. Talbert and
work with him to resolve the problems on that road.

PUBLIC HEARINGS
Public Hearing to Amend Section 21-38 of the County
Code to Provide for the Annual Assessment of Real
Estate. (ACTION TO BE TAKEN FOLLOWING SECOND READING -
~ohn Willey, Roanoke County Assessor was present to answer any
guestions the Board might have. He reported that Roanoke County
's the largest county not currently participating in annual
eassessment. This program is recommended for larger
'urisdictions by the State Department of Taxation and has no
ltimate beneficiary but has a great deal of interraction for the

government and the taxpayer. It also provides stabilized tax
rates and more quality assessments. It will stabilize budgetary
procedures, revenues, and cushion the impact on the taxpayer of
possible tax increases spread over a period of time rather than
at once.
Supervisor McGraw inquired if an annual Board of
Equalization will be allowed. Mr. Willey reported that there
would be no problem with that since the County has an option to
have either a permanent or a temporary Board. Mr. McGraw also
inquired about Use Value Taxation. Mr. Willey responded that hi
staff is now able to classify all the property that is in the
Land Use Program and that the County has returned to soil
classification levels of assessments through SLEAC.
Supervisor Nickens inquired about the correlation
between the assessed value and the market value today in Roanoke
County for residential and commercial/business/industrial. Mr.
Willey responded that Virginia has two mandates in relation to
assessments: primary mandate being fair market value, which is
accepted as being market value of the property as extinguished b
willing buyer and willing seller on the open market. The second
mandate, which is preferred by Courts throughout Virginia and th
Country is Uniformity in level of assessment. Annual assessment
will cope with Uniformity between levels of assessment.
Supervisor Garrett inquired about the impact of this
program on Mr. Willey's department. Mr. Willey reported that hi
department is currently running at a minimal acceptable level.
He felt that the current personnel and the new personnel added
will be sufficient to carry the workload.
Ms. Helenmary Topper, 339 Polly Circle, Salem,
Virginia, 24l53, reported to the Board that she was concerned
about the annual reassessment program. She reported that she
felt that the County was only seeking more money too quick
instead of trying to benefit the taxpayer. She also felt that

the decision to go with the annual assessment program was decided
before the public hearing.
Chairman Brittle reported that the public hearing is
held for citizens input and that the referendum is also being
held for the citizens to give their input on the proposed County
police department and water referendum.
Supervisor Nickens moved for a second reading and that
the Board concur with staff's recommendation for the annual
assessment. The motion was seconded by Supervisor Brittle.
Mr. Mahoney reported that the second reading must be
held before a motion can be made.
Supervisor Nickens withdrew his motion.
(886-2) Adoption of the Roanoke County Capital Improvement
Plan - Mr. Rob Stalzer, Director of Planning, Zoning,
and Grants, reported that in 1984 the Board requested the staff
and the Planning Commission to complete the Roanoke County
Comprehensive Development plan by June 30, 1985. An important
component of the Plan is the Capital Improvement Program. The
CIP is based on a five year time period, the 1986 fiscal year
through the 1991 fiscal year. It is intended that the CIP will
be amended and incorporated in an annual capital budget. In this
Program, staff has identified 119 new capital projects but in the
future, this number may increase or decrease depending upon the
needs of the County. Mr. Stalzer recommended that the Board
adopt or develop revenue and alternate funding strategies for
consideration for future CIP and capital project funding.
Mr. Wayland Winstead of the Planning Commission
reported to the Board that the process of identifying capital
projects needs to be a routine process for Roanoke County that is
continually updated over a period of time. For an organization
of this size, it is not unusual to have $90 million worth of
capital needs. He also reported that a revenue stream and
strategy must be developed that will help the County obtain the

process where routine revenue streams are identified to fund
capital improvements in the various sectors identified in the CIP
Chairman Brittle noted that each member of the Board
has been briefed on the CIP.
Supervisor Johnson expressed his appreciation to the
Planning Commission and staff for their efforts and hard work
expended on preparing this document.
Supervisor Garrett noted that this is a planning
document and does not imply that the County is going to spend
$92.5 million on capital projrcts and that the Plan is subject to
revision.
Supervisor Garrett moved to approve the adoption of the
staff recommendation of the Capital Improvement Plan. The motion
was seconded by Supervisor McGraw. The motion carried by a
unanimous roll call vote.
(886-3) Petition of LaMonte B. McChesney for a Special
Exception Permit to Operate a Used Car Lot - Mr.
LaMonte McChesney was present to answer any questions the Board
might have. He reported that he has vehicles on the property but
has not started the operation of his business. There was no one
present in opposition.
Supervisor Johnson moved to grant the request for a
Special Exception permit. The motion was seconded by Supervisor
McGraw and carried by a unanimous roll call vote.
Petition of W. S. Woody to Rezone a 0.52 Acre Lot From
B-2 to B-3 to Construct an Automobile Wash Located on
Garst Mill Road in the Windsor Hills Magisterial
District - Supervisor Garrett moved to table this
matter until September 23, 1986. The motion carried by a

Petition of Southwest Virginia Shopping Center
Associates to Rezone a Portion of a 5.17 Acre Parcel
from R-3 to B-2 to Construct a Shopping Center Located

on Williamson Road in the Hollins Magisterial
District - Mr. Mike Smeltzer was present on behalf of
Southwest Virginia Shopping Center to answer any questions the
Board might have. He presented drawings and maps of the proposed
building and its location. He reported that this rezoning is in
concurrence with the Land Use Guide and that the developer is
ready to begin construction. This project will generate
approximately $7.8 million. There was no one present in
opposition.
Supervisor Johnson moved to grant the petition. The
motion was seconded by Supervisor Garrett.

NOW, THEREFORE, BE IT ORDERED that the aforementioned
parcel of land, which is contained in the Roanoke County Tax Maps
as Parcel 27.18-3-13 and recorded in Deed Book 1102, Page 441 and
legally described below, be rezoned from Residential District R-3
to Business District B-2.

PROFFER OF CONDITIONS
TO THE HONORABLE SUPERVISORS OF ROANOKE COUNTY:
Being in accord with Section l5.l-49l.l et seq. of the
Code of virginia and Section 2l-l05E. of the Roanoke County
Zoning Ordinance, the Petitioner, Southwest Virginia Shopping
Center Association, a Utah Limited Partnership, hereby
voluntarily proffers to the Board of Supervisors of Roanoke
County, Virginia, the following conditions to the rezoning of th
above-referenced parcel of land:
1. The development of the Property will be in
accordance with the Preliminary Site Plan prepared
by Rogers & Reynolds, Architects, Inc., dated May

Board might have. No one was present in opposition.

Parcel Adjacent to the Lynn Haven Baptist Church in
Vinton. (ACTION TO BE TAKEN FOLLOWING THE SECOND
READING - Supervisor Nickens inquired if staff has been
in contact with the Church in regard to this request since the
last meeting. Mr. Hubbard responded that he has spoken with
Reverend Wayne because at one time there was confusion as to
which site the Church wanted to purchase. The first report
indicated that the Church wanted to purchase the well site but
after contacting Mr. Wayne, the Church wishes to purchase the
þther site in question. He reported that the Church realizes
~hat this property is across the creek and that they would be
~esponsible for constructing a bridge for access. Reverend Wayne
~esponded to Mr. Hubbard that this project is not scheduled for
~hree years but that the Church realizes the property has to be
Filled in since it is considerably lower than their present lot.
~r. Hubbard also explained to Mr. Wayne that the County may not
~e able to sell the property since it was purchased with a grant
rom the Federal Government.
Supervisor Nickens inquired about the period of time a
~ublic hearing could be continued. Mr. Mahoney reported that
here is no limitation according to the State Code.
Supervisor Nickens moved to table this matter to some
~ime in the not too distant future to enable the staff to

work out the details regarding this contract of sale. The motior

ANNUAL ASSESSMENT OF REAL ESTATE FOR
LOCAL TAXATION
WHEREAS, pursuant to the provisions of §18.04 of the

~mending the Roanoke County Code to provide for the annual

WHEREAS, Section 21-38, Article III of Chapter 21 of
the Roanoke County Code provides for the biennial general
reassessment and equalization of real estate for local taxation¡
and
WHEREAS, Section 58.l-325.B. of the Code of Virginia
(1950) as amended, authorizes the local governing body of a
county by ordinance to provide for the annual assessment and
equalization of real estate for local taxation¡ and
WHEREAS, the Board of Supervisors believes that annual
general reassessments will be more fair and equitable, and bette
reflect the fair market value of real estate in Roanoke County.
NOW, THEREFORE, BE IT ORDAINED by the Board of Super-
visors of Roanoke County, Virginia, as follows:
Sec. 21-38. B~eftft~a~ Annual general reassessments.
In lieu of the general reassessment requirements of
title 58.1 of the Code of Virginia, the board of supervisors her -
by provide for the 6~eftft~a~ annual reassessment and equaliza-
tion of real estate for the purpose of taxation, beginning with
the 6~eftft~a~ annual general reassessment to become effective
January 1, ~98~ 1988. All taxes for each eveft year on
such real estate shall be extended on the basis of the last gen-
eral or 6~eftft~a~ annual general reassessment made prior to
such year, except for changes that have been lawfully made. The
reassessment shall be made by the county assessor, who shall be
certified by the state tax commissioner. The reassessment
may must be completed during aft eft~~~e ~we yea~ the
annuar-period by employing the same standards of value for all
appraisals made during that period as provided by section 58.1-
3253 and made in accordance with all other applicable provisions
of title 58.1 of the Code of Virginia.
2. That the effective date of this ordinance shall be
September 1, 1986.
