The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the second Tuesday, and the
first regularly scheduled meeting of the month of February, 1986.

Chairman Brittle called the meeting to order at 3:04
p.m. The roll call was taken.

The invocation was given by Bishop William E. Brown of
the Church of Jesus Christ of Latter Day Saints. The Pledge of
Allegiance was recited by all present.

Mr. Elmer C. Hodge, County Administrator, thanked
Bishop Brown for giving the invocation. He also announced that
Reta Busher of the Department of Fiscal Management has passed her
CPA exam and Kathy Claytor of the Personnel Department has passed
the examination of accreditation as a Professional Human
Resources. Mr. Hodge and the Board congratulated Ms. Busher and
Ms. Claytor on their accomplishments. Mr. Hodge also asked John
Hubbard, Superintendent of Public Facilities, to introduce the
new employee in his Department. Mr. Hubbard introduced John
Peters who is the County's Road Coordinator.
Chairman Brittle recognized Linda Lehe, Paralegal, who
was filling in as County Attorney in the absence of Paul Mahoney.

PROCLAMATIONS, RESOLUTIONS, AND AWARDS
Tiffany Rawling, Kristen Dalton, and Frances Arnold
were present to receive a resolution of congratulations on
winning the "Life, Be In It" coloring contest. Supervisor
Nickens moved to approve the prepared resolutions. The motion
was seconded by Supervisor Johnson.
RESOLUTION 2-11-86-29 OF CONGRATULATIONS
TO TIFFANY RAWLING
WHEREAS, the Roanoke County Recreation Division did
sponsor a "Life Be In It" coloring contest for five year old
children; and
WHEREAS, over 150 entries were received in all three
age divisions in the contest; and
WHEREAS, Tiffany Rawling was chosen as the winner of
her age division by James Daughtridge, Chairman of the Recreation
Commission, and Steven A. McGraw, member of the Roanoke County
Board of Supervisors; and
WHEREAS, it is appropriate for the Roanoke County Board
of Supervisors to recognize, commend and congratulate the youth
of our County when they excel in areas of artistic competition.

NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County that Tiffany Rawling be
congratulated upon winning the 1986 "Life Be In It" coloring
contest in the five year old age division.
BE IT FURTHER RESOLVED that this resolution be spread
in the records of the County and that a certified copy be
presented to Tiffany Rawling as a remembrance of her superlative
artistic effort.

WHEREAS, Kristen Dalton was chosen as the winner of her
age division by James Daughtridge, Chairman of the Recreation
Commission, and Steven A. McGraw, member of the Roanoke County
Board of Supervisors; and
WHEREAS, it is appropriate for the Roanoke County Board
of Supervisors to recognize, commend and congratulate the youth
of our County when they excel in areas of artistic competition.

TO FRANCES ARNOLD
WHEREAS, the Roanoke County Recreation Division did
sponsor a "Life Be In It" coloring contest for seven year old
children; and
WHEREAS, over 150 entries were received in all three
age divisions in the contest; and
WHEREAS, Frances Arnold was chosen as the winner of her
age division by James Daughtridge, Chairman of the Recreation
Commission, and Steven A. McGraw, member of the Roanoke County
Board of Supervisors; and
WHEREAS, it is appropriate for the Roanoke County Board
of Supervisors to recognize, commend and congratulate the youth
of our County when they excel in areas of artistic competition.

Supervisors of Roanoke County that Frances Arnold be
congratulated upon winning the 1986 "Life Be In It" coloring

In addition to receiving their resolutions, each winner
was presented with a Roanoke County baseball cap and a Roanoke
County pin.

Darrell Shell, Director of Parks and Recreation,
presented the winners with "Life, Be In It" bookbags. Mr. Shell
also displayed the pictures colored by each winner.
Chairman Brittle also presented a proclamation
declaring February "American History Month" to Mrs. Annie Cook
Aldrich, a member of the Breckinridge Chapter of the DAR.
Supervisor Nickens moved to approve the prepared proclamation.
The motion was seconded by Supervisor Garrett.
PROCLAMATION
WHEREAS, during the month of February, the citizens of
this nation will be celebrating the birthdays of two resolute
American patriots and famous Presidents, George Washington and
Abraham Lincoln; and
WHEREAS, the National Society Daughters of the American
Revolution and the James Breckinridge Chapter are sponsoring
February as "American History Month" throughout the nation; and
WHEREAS, it is becoming more and more important for each
resident of this great nation to have a true understanding of the
history of these United States.
NOW, THEREFORE, I, Alan H. Brittle, Chairman of the
Board of Supervisors of Roanoke County, Virginia, do hereby
proclaim the month of February, 1985, as AMERICAN HISTORY MONTH
in the County of Roanoke, and call upon all organizations and
schools to emphasize the study of American history during the
month of February in order that our citizens may better
appreciate the great spiritual strength and wisdom of our
forefathers and will assist in the building of a continuing
heritage of faith, fortitude and righteousness for future
generations.
On motion of Supervisor Nickens, seconded by Supervisor Garrett

IN RE:
NEW BUSINESS
1. Request from the School Board to Transfer $30,000
from the School Operating Fund to the Textbook Fund -
Superintendent of Fiscal Management, John Chambliss, reported to
the Board that this transfer is necessary due to the fact that
the cost of textbooks was substantially higher than anticipated.
Supervisor Nickens moved to approve the transfer. The motion was
seconded by Supervisor McGraw. The motion carried by the
following recorded vote:

NAYS: None
2. Carryover Appropriation of Year End Funds - Mr.
Chambliss reported that at the end of each fiscal year there are
capital items that have been ordered but not received by the
County. The funds to pay for these goods were budgeted in fiscal
year 1984-1985. Since the expenditures are actually occurring in
fiscal year 1985-86, it is necessary to carryover these budgeted
amounts from last year to the current year. The following
transfer of funds was recommended by the Department of Fiscal
Management.

Mr. Chambliss requested permission to transfer the
amounts listed above from the Reserve for Encumbrances (increase
of budgeted beginning balance) to the departmental budgets. This
transfer will have no effect on the County's unappropriated
balance.

Supervisor Nickens moved to concur with staff's request
The motion was seconded by Supervisor McGraw and carried by the

3. Approval of a Fee for Administrative Appeal to the
Board of zoning Appeals - Mr. Timothy Gubala, Superintendent of
the Department of Development, presented a request to the Board
of Supervisors that a fee be established for an administrative
appeal to the Board of Zoning Appeals (BZA). He reported that
costs for administrative appeals are expected to be higher than
for variances ($45 in comparison). Standard costs are a $25
legal ad fee, mailing costs of notices, and planning staff time.
In the case of an administrative appeal, extra involvement by the
County Attorney's Office can be expected. If the BZA acts
against the Zoning Administrator, litigation costs could be
incurred.
Supervisor Johnson was concerned about the fee
recommended by the County Administrator of $75. He reported that
he would agree with the recommendation but that if many cases
come up where citizens cannot pay the fee, the fee should be
reviewed.
Mr. Gubala also reported that surrounding localities do
impose fees.
Supervisor Garret moved to establish a fee of $75. The
motion was seconded by Supervisor Johnson and carried by the
following recorded vote:

4. Request to Apply for a Transportation Grant
Application - Mr. Gary Huff of the Department of Public
Facilities, reported that in order to obtain financial assistance
to operate the Cortran program, the County must apply for three

(3) types of funding. These are Administrative (50%); Fuel,
Tires, and Maintenance (95%); and Capital (95%) grants. He
reported that the projected budget for the 1986-87 fiscal year
for Cortran will be $147,509. If successful, $87,000 will be
obtained from the grants which would make Roanoke County's cost
$60,000. If unsuccessful, Cortran will have to be funded through
general funds in the amount of $101,829.
Mr. Hodge reported that if funding is not received
through the grant, private funding may be necessary.
Supervisor Johnson moved that the staff be authorized
to apply for grant assistance through the Virginia Department of
Highways and Transportation. The motion was seconded by
Supervisor Nickens.
RESOLUTION 2-11-86-35 REQUESTING STATE
AID FOR PUBLIC TRANSPORTATION
ADMINISTRATION EXPENSES, PUBLIC
TRANSPORTATION FUELS, LUBRICANTS, TIRES,
AND MAINTENANCE PARTS AND SUPPLIES, AND
PUBLIC TRANSPORTATION CAPITAL COSTS
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the County Administrator of Roanoke County is
authorized, for and on behalf of the Board of Supervisors of
Roanoke County, to execute and file an application with the
Virginia Department of Highways and Transportation, Commonwealth
of Virginia, for a grant of transportation funds authorized in
Chapter 755, Item 640 of the 1984-86 Acts of Assembly for State
Aid for Capital Costs in the amount of $9,880.00 to defray
ninety-five percent (95%) of the local matching share of Roanoke
County for equipment, facilities, and the associated costs of an
approved Federal Capital Grant, to accept from the Virginia
Department of Highways and Transportation grants in such amount
as may be awarded, and to authorize the Board of Supervisors of
Roanoke County to furnish to the Virginia Department of Highways
and Transportation such documents and other information as may be
required for processing the grant request; and

2. That the County Administrator of Roanoke County is
authorized, for and on behalf of Roanoke County, to execute and
file an application with the Virginia Department of Highways and
Transportation, Commonwealth of Virginia, for a grant of
transportation special revenues, Chapter 755, Budget Item 640 of
the 1984-86 Acts of Assembly in the amount of $57,817.50 for
fiscal year commencing July 1, 1986, to defray the public
transportation administrative expenses of Roanoke County and to
accept from the Virginia Department of Highways and
Transportation grants in such amount as may be awarded, and to
authorize the County Administrator to furnish to the Virginia
Department of Highways and Transportation such documents and
other information as may be required for processing the grant
request; and
3. That the County Administrator of Roanoke County is
authorized, for and on behalf of the Board of Supervisors of
Roanoke County, to execute and file an application with the
Virginia Department of Highways and Transportation, Commonwealth
of Virginia, for a grant of transportation fund authorized in
Chapter 755, Item 640 of the 1984-86 of the General Assembly in
the amount of $18,500.30, to defray the public transportation
fuels, lubricants, tires, and maintenance parts and supplies
expenses of Roanoke County and to accept from the Virginia
Department of Highways and Transportation grants in such amount
as may be awarded, and to authorize the County Administrator to
furnish to the Virginia Department of Highways and Transportation
such documents and other information as may be required for
processing the grant request; and
4. That the Board of Supervisors of Roanoke County
certifies: that the funds shall be used in accordance with the
requirements of the Appropriations Act of 1986; that Roanoke
County will provide matching funds of five (5%) percent capital;
five (5%) percent fuels, lubricants, tires, and maintenance parts

and supplies; and fifty (50%) percent administrative expenses as
required in such Act; that the record of receipts and
expenditures of funds granted Roanoke County as authorized in the
Acts of the General Assembly (Chapter 755, Appropriation Item
640) may be subject to audit by the Department of Highways and
Transportation and by the State Auditor of Public Accounts; and
that funds granted to Roanoke County for defraying the expenses
of public transportation fuels, lubricants, tires, and
maintenance parts and supplies of Roanoke County shall be used
only for such purposes as authorized in the Acts of General
Assembly; and
5. That the undersigned duly qualified and acting
County Administrator of Roanoke County on behalf of the Board of
Supervisors of Roanoke County, Virginia, certifies that the
foregoing is a true and correct copy of a resolution adopted at a
legally convened meeting of the Board of Supervisors of Roanoke
County held on February 11, 1986.

5. Request to the State Air Pollution Control Board to
Redesignate Portions of Roanoke County from Urban to Rural -
Timothy Gubala, Superintendent of the Department of Development,
reported that the State Air Pollution Control Board has required
the County to take three steps in order to comply with their
regulations on leaf and brush burning. The first step,
development of a revised leaf burning ordinance, is addressed in
a separate report on this agenda. The second step, preparation
of a revised map showing restricted and less-restricted burn
areas of the County, has been completed by the Department of
Development. The third step is for the Board of Supervisors to
formally request the State Air Pollution Control Board to amend

its regulations to redesignate portions of the County from urban
to rural. Mr. Gubala also reported that the State Air Pollution
Control Board has currently designated Roanoke County as a
completely urban County. By this designation, brush burning is
not allowed anywhere in the County since the State Air Pollution
Control Board's regulations provide that brush burning is only
permissible where refuse collection, either public or private, is
unavailable. Roanoke County provides refuse collection to all
areas. Since it will take several months for the state Air
Pollution Control Board to enact the change in their regulations,
they have agreed to enter into a consent agreement with the
County during the interim which would permit the County to
regulate the leaf and brush burning.
Supervisor Nickens moved to approve the request to the
State Air Pollution Control Board. The motion was seconded by
Supervisor Johnson.
RESOLUTION 2-11-86-36 REQUESTING THE
STATE AIR POLLUTION CONTROL BOARD TO
REDESIGNATE PORTIONS OF ROANOKE COUNTY
FROM URBAN TO RURAL
WHEREAS, numerous citizens of Roanoke County find it
necessary and convenient to burn brush on their property; and
WHEREAS, regulations of the State Air Pollution Control
Board prohibit such brush burning as long as all portions of the
County are designated urban; and
WHEREAS, the urban designation is inaccurate in that
large portions of the County are in fact entirely rural.
THEREFORE BE IT RESOLVED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
1. That the State Air Pollution Control Board
redesignate as "rural" those portions of Roanoke County indicated
on the map prepared by the Department of Development for this
purpose.

6. Revised Leaf Burning Ordinance - A revised leaf
burning ordinance was presented to the Board of Supervisors.
Supervisor Nickens moved that staff transmit this proposed
ordinance to the State Air Pollution Control Board and once they
have reviewed it, if they find no problem with it, then staff is
authorized to proceed with the necessary legal advertisement for
a public hearing by the Board of Supervisors. The motion was
seconded by Supervisor Johnson and carried by the following roll
call vote:

IN RE:
APPOINTMENTS
1. Court Service Unit Advisory Council/Youth and
Family Services Advisory Board - Supervisor McGraw nominated Mr.
Roger Smith and Mr. Gerald Curtis for additional terms. The
Board concurred by a unanimous voice vote.
2. Grievance Panel - Supervisor Garrett nominated Mr.
Joe W. Himes, 3239 Clearview Drive, Roanoke, Virginia. The Board
concurred by a unanimous voice vote.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Johnson - Supervisor Johnson reported that
he has received numerous letters and telephone calls from
concerned citizens who live in the airport impact zone. He asked
for the Board's unanimous consent to direct the two County
Representatives to the Airport Commission to address this as the
first problem or seek some redress for these citizens.
Supervisor McGraw also felt that this problem should be resolved

and reported that the citizens in that area are also experiencing
a declining property value and that more should be done for them
than a slightly reduced assessment. Supervisor Nickens also
shared Supervisor Johnson's concerns and supported his expression
that the citizens should receive some type of help. Supervisor
Nickens also reported that he has been contacted by some citizens
of Roanoke City experiencing the same problems. Supervisors
Garrett and Brittle also voiced their support of Mr. Johnson's
request. Chairman Brittle directed that a formal request be made
to the County representatives as soon as the Airport Commission
has been established.
Supervisor Garrett - Supervisor Garrett reported that
the Social Services Agency will not be covered by insurance under
the upcoming budget. He inquired if they were under the county's
insurance plan and directed staff to speak with Mrs. Lucas of the
Social Services Department or Mr. Steele to see what can be done
about this situation. Superintendent of Fiscal Management, John
Chambliss reported that in the past, the state has provided the
insurance for the Welfare Board and its employees. He is in the
process of finalizing the renewal coverages for the public
officials in liability insurance and this should be an extension
of that policy. Supervisor Johnson directed Mr. Chambliss to
check into sovereign immunity.
Supervisor McGraw - Supervisor McGraw reported that
House Bill 736 which places a 2 1/2 year moratorium on annexation
will be voted on Friday, February 14, 1986. He directed staff to
send a letter to delegates stating our support of House Bill 736.
Supervisor Brittle - Supervisor Brittle reported that
Bedford County has requested Roanoke County's support of their
resolution that their area not be chosen as a nuclear dump site.
He directed staff to send a letter of support to Bedford County.
Staff reported to Mr. Brittle that a resolution has been placed
on the February 25, 1986, Board of Supervisors agenda.

IN RE:
CONSENT AGENDA
Item 2 - Chairman Brittle requested that Item 2
concerning the bingo/raffle permit be removed until a policy
study is completed.
Item 3 - Ms. Betty Desper, Director of Resource
Development at TAP, reported that her organization is asking
officials from 11 jurisdictions in which they operate to support
an amendment to House Bill 30. This amendment requests
$5,000,000 per year to assist with funding 28 Community Action
Agencies throughout the Commonwealth of Virginia. Ms. Desper
requested that the Board correspond with Senator Emick supporting
this amendment.
Item 9 - Supervisor Johnson reported that on Thursday,
February 6, 1986, while in Richmond, he discovered that several
County roads were up for acceptance into the Highway System. He
inquired if there was a system that could be established so that
the County will be informed when a delegate is proposing
legislation on County roads. Chairman Brittle reported that this
should be a staff and board agenda item for further discussion.
Item 10 - Supervisor McGraw requested John Hubbard to
update the Board on projects at the new Courthouse. Mr. Hubbard
reported that the sagging beam and the access to the boiler
problems have been corrected. They are currently working on the
exit lights. Mr. Hubbard reported that he is currently working
with Elizabeth Stokes on the problems in her office.
Supervisor Nickens moved to approve the Consent Agenda
with the deletion of Item 2. The motion was seconded by
Supervisor Johnson.

RESOLUTION NO. 2-ll-86-38.A REQUESTING THE
VIRGINIA DEPARTMENT OF HIGHWAYS AND
TRANSPORTATION TO UTILIZE CERTAIN FUNDS
HERETOFORE APPROPRIATED BY THE BOARD OF
SUPERVISORS IN ITS SECONDARY ROUTE PLANT
MIX PROGRAM IN ROANOKE COUNTY
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board of Supervisors of Roanoke County,
having heretofore in fiscal year 1984-85 appropriated
certain funds which together with matching highway department
funds totaled $105,256.09 to be utilized in the secondary route
plant mix program in Roanoke County, of which $1,488.28 remained
unexpended during fiscal 1984-85; and
2. That the Board does hereby expressly request the
Virginia Department of Highways and Transportation to carryover
the aforesaid $1,488.28 into the 1985-86 fiscal year budget in
revenue sharing fund account thereof and in addition thereto
to match such funds as were appropriated by RESOLUTION NO. 85-55
in the amount of $50,000.00; and
3. That a duly attested copy of this resolution be
forthwith forwarded to the Virginia Department of Highways and
Transportation, Salem Residency Office.
On motion of Supervisor Nickens, seconded by Supervisor Johnson
and upon the following recorded vote:

RESOLUTION 2-ll-86-38.B AMENDING ROANOKE
COUNTY RECREATION COMMISSION BY-LAWS,
"MEETINGS"
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Article 5, Section 1 of the Roanoke County
Recreation Commission By-laws is hereby amended as follows:

A CERTAIN STREET LOCATED IN ROANOKE
COUNTY BE TAKEN BY THE STATE DEPARTMENT
OF HIGHWAYS AND TRANSPORTATION AS A RURAL
ADDITION AS MADE AND PROVIDED BY LAW
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Virginia Department of Highways and
Transportation is hereby requested to add a certain portion of a
certain street known as Airpoint Drive in the Airpoint Estates
Subdivision, Plat Book 6, page 46, situate in the Windsor Hills
Magisterial District (including a previously dedicated fifty (50)
foot right-of-way) that runs from Route 221 to Airpoint Road a
distance of 0.28 miles, to the Secondary System of Roanoke County
pursuant to Section 33.1-72.1 (Cl) of the Code of Virginia, 1950,
as amended;and
2. That this Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of fifty (50) feet with
necessary easements for cuts, fills, and drainage.
3. That this Board indicates there is no speculative
interest involved in this project.
(Section 33.l-72.l(Cl).

IN RE: EXECUTIVE SESSION
Chairman Brittle moved to go into Executive Session
pursuant to the Code of Virginia 2.l-344(a) (2) and (6) to
discuss acquisition of real estate and the airport commission.
The motion was seconded by Supervisor Johnson and carried by a
unanimous voice vote.

IN RE:
OPEN SESSION
Supervisor McGraw moved to return to Open Session. The
motion was seconded by Supervisor Nickens and carried by a
unanimous voice vote.
Supervisor McGraw moved to approve the prepared
resolution authorizing the purchase of certain property adjoining
Whispering Pines Park in order to expand Whispering Pines Park.
7.06 acres in the amount of $21,180 and 2.94 acres in the amount
of $8,000. The motion was seconded by Supervisor Johnson and
carried by the following roll call vote:
AYES: Supervisors McGraw, Johnson, Nickens, Garrett, and Brittle
NAYS: None
IN RE: REPORTS
The following reports were received by the Board of
Supervisors:
1. Monthly Project Status Report.
2. Board Training Session - Chairman Brittle reported
that the Board will adjourn this meeting to 1:00 p.m. Friday,
February 14, 1985, at Hollins College and will adjourn after
lunch on Sunday, February 16, 1986. The training session will
occur at the Moody Center in Janney Lounge.
3. Status Report on Capital Improvements Program.
