The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the second Tuesday, and the
first regularly scheduled meeting of the month of October, 1986.

Chairman Brittle called the meeting to order at 3:03
p.m. The roll call was taken.

The invocation was given by Queen E. Snell of St.
John's A.M.E. Church. The Pledge of Allegiance was recited by
all present.

COUNTY ADMINISTRATOR'S COMMENTS
Elmer Hodge noted the artwork that is displayed in the
:ommunity Room and introduced Ms. Martha Lalka and Mr. Steven
King of Roanoke County Schools who were responsible for
coordinating the artwork. Ms. Lalka reported that the present
artwork was done by Roanoke County art teachers, next month will
be high school artwork, January will feature junior high artwork,
~ebruary will feature elementary artwork, and then the pattern
will repeat. Ms. Lalka did note that the Gifted Program will
provide the artwork for May.
Chairman Brittle announced that Paul Mahoney has been
elected to the Local Government Attorney's Board of Directors.
Chairman Brittle also requested that Tommy Fuqua
'ntroduce the new Fire Marshal. Mr. Fuqua introduced Mr. Ken
3harp, the new Fire Marshal. He reported that Mr. Marshal had
~reviously been the Assistant Fire Marshal with Roanoke City.

REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF
AGENDA ITEMS
Mr. Hodge requested that Item F4 concerning the
execution of the Extra-territorial Arrest Agreement with the Town
~f vinton be delayed until October 28, 1986. Mr. Hodge also
equested that Item Jl concerning a request for a work session on
he park bond projects also be held over for thirty days.
Mr. Mahoney requested that Item II concerning the
ßecond reading of an ordinance concerning leaf burning be delayed
þntil October 28, 1986, in order to incorporate some suggestions
provided by the Fire Marshal.

Chairman Brittle presented a resolution of
congratulations to Sheriff O. S. Foster upon his department
receiving the AAA Safety Award.
Supervisor McGraw moved to approve the prepared
resolution. The motion was seconded by Supervisor Garrett.
RESOLUTION 10-14-86-207 COMMENDING THE
ROANOKE COUNTY SHERIFF'S DEPARTMENT FOR
THEIR RECEIPT OF AN AWARD OF EXCELLENCE
WHEREAS, the Roanoke County Sheriff's Department has a
longstanding tradition of excellence and is instrumental in
protecting the citizens of the County; and
WHEREAS, the department continues to respond to the
needs of the community with appropriate programs; and
WHEREAS, in the past nine years, the Sheriff's
Department has been recognized eight times for outstanding
performance by the American Automobile Association; and
WHEREAS, since 1982, the department has been awarded
three times the AAA Award of Excellence; and
WHEREAS, the department most recently received the AAA
Award of Excellence for its outstanding record in preventing
pedestrian fatalities and injuries through its 1985 Pedestrian
Safety Program; and
WHEREAS, the Award of Excellence is the highest honor
that the County can receive.
NOW, THEREFORE, BE IT RESOLVED that the Roanoke County
Board of Supervisors wishes to recognize the outstanding
performance of our Sheriff's Department.
AND FURTHER commends the department for its dedication
to making Roanoke County a safer place to live.
On motion of Supervisor McGraw, seconded by Supervisor Garrett,
and upon the following recorded vote:

Chairman Brittle also presented a proclamation
declaring October 1986 National Diabetes Research Month to Ms.
Charlotte Kidd of the Juvenile Diabetes Foundation. The Board
~oncurred with the proclamation by a unanimous voice vote.
PROCLAMATION
WHEREAS, diabetes, a chronic, metabolic disorder which
~dversely affect the body's ability to manufacture or utilize
insulin, now afflicts over twelve million Americans; and
WHEREAS, health care costs resulting from diabetes now
exceed $7 billion in the form of disability payments and lost
wage costs; and
WHEREAS, the cause and prevention of diabetes is still
unknown and the Juvenile Diabetes Foundation International, as
~ccredited voluntary health agency, has as its primary objective
the support and funding of research to prevent the complications
of diabetes and ultimately find a cure;
NOW, THEREFORE, the Roanoke County Board of
Supervisors, does hereby proclaim the month of October, 1986, as
DIABETES RESEARCH MONTH
in order to focus attention on the nature of the disease, and to
stimulate the interest and concern that will increase research
and lead to a cure.
A proclamation declaring October 12 - 18, 1986, as
Natural Resources Conservation Week was also presented by
:hairman Brittle to Mr. Lowell Gobble, VPI & SU Extension Agent
and Mr. Winton Shelor, Directors of the Blue Ridge Soil and Water
:onservation District. The Board also concurred with this
proclamation by a unanimous voice vote.
PROCLAMATION
WHEREAS, the natural resources of Roanoke County serve
¡present generations as they have in the past; and
WHEREAS, the youth of Roanoke County will always enjoy
~hese priceless resources; and

WHEREAS, the Virginia Association of Soil and Water
Conservation Districts and the Blue Ridge Soil and Water
Conservation District have set aside the week of October 12-18,
1986, as Natural Resources Conservation Week with the theme:
"Natural Resources: Sharing with the Future."
NOW, THEREFORE, the Roanoke County Board of Supervisor
does hereby recognize the week of October 12-18, 1986 as
NATURAL RESOURCES CONSERVATION WEEK
in Roanoke County, and calls upon its citizens of Roanoke County
to support this observance.
Chairman Brittle presented a proclamation declaring
October 13-19, 1986, as Animal Control Personnel Week to Kenneth
Hogan, Chief Animal Control Officer. The Board acknowledged
their concurrence by a unanimous voice vote.
PROCLAMATION
WHEREAS, the purpose and goal of animal control
agencies is to regulate, control and protect the animal
population; and
WHEREAS, animal control agencies accomplish these goal
by:
- educating and training animal control and human
agency personnel
- promoting an understanding of the responsibilities 0
animal control personnel and of the public in animal control
- exchanging information regarding animal control
programs and providing expertise and guidance on animal control
problems to city, county, and state officials
- identifying and making recommendations on problems
requiring further research
- providing a liaison with other professional
organizations and groups having related interests; and
WHEREAS, on behalf of the people of Virginia, Governor
Baliles has commended animal control personnel across the

Commonwealth for their efforts on behalf of the animal population
by a Certificate of Recognition.
NOW, THEREFORE, the Roanoke County Board of Supervisors
oes hereby proclaim the week of October 13-19, 1986, as
ANIMAL CONTROL PERSONNEL WEEK
in Roanoke County and calls its significance to the attention of
11 our citizens.
IN RE:
NEW BUSINESS
1. Recommendation of the Blue Ribbon Commission -
Brittle introduced the members of the Blue Ribbon
ommission and announced that they had met this afternoon at 2:00
prior to this Board meeting.
Ms. May Johnson, Mr. Joe Thomas, Mr. J. Carson Quarles,
r. Wayne Goodman, and Mr. Bill Cundiff all expressed their
hopes that the citizens of Roanoke County would vote to
the water referendum on November 4, 1986, because of the
need for water in the Valley.
2. Endorsement of the Water Bond Referendum by the
partnershi of the Roanoke Valle , the Roanoke Count
ducation Association, the Roanoke Count School Board, and the
oanoke Count Plannin Commission - Mr. Bob Bowman of the
Partnership of the Roanoke Valley reported to the Board
Executive Committee of the Partnership unanimously voted
n September 17, 1986, to endorse the proposed water reservoir.
Ms. Judith Boitnott of the Roanoke County Education
ssociation reported that on September 17, 1986, the Roanoke
ounty Education Association also voted to support the proposed
reservoir project.
Mr. Frank Thomas, Chairman of the Roanoke County School
announced that at their last meeting, the School Board

adopted a resolution by a unanimous vote to support the proposed
water reservoir.
Mr. Don Witt, Chairman of the Roanoke County Planning
Commission also presented a resolution adopted by the Planning
Commission which endorses the proposed water reservoir.
3. status Report on Referenda Issues
Water - Mr. Hodge reported that staff has studied
the possibility of not having a tax increase in the next fiscal
year to fund the water project if it is approved. Mr. John
Chambliss, Assistant County Administrator of Management Services
presented figures to the Board which indicate that the bond debt
for the water project can be paid without the need for an
increase in real estate taxes.
Supervisor Nickens moved that the Board adopt a
resolution expressing that there will be no real estate tax
increase.
Supervisor Johnson did not feel that this was the
appropriate time to adopt such a resolution.
Mr. Hodge requested that if this is not the proper tim
to pass such a resolution, that the Board should consider this a
commitment from staff.
John Hubbard presented an update on the water reservoi
project.
Sheriff Foster expressed his support of the Police
Department. He reported that his reasons for supporting the
Police Department, are his concern for the citizens of Roanoke
County and the concern of maintaining the quality of law
enforcement that has been established in the past.
Mr. Winton Shelor, President of the Masons Cove Civic
League expressed the support of the Civic League for the propose
water issue and the police department and offered his help and
the help of the Civic League to promote these issues.

4. Authorization to Execute Extra Territorial Arrest
~greement with the Town of Vinton - Mr. Hodge requested that this
item be held over until October 28, 1986.
5. Request for Approval of IDA Bonds for American
Balance Corporation - Mr. Gubala presented a request to the Board
~o approve the issuance of IDA bonds in the amount of $950,000 to
~erican Balance Corporation. This funding will allow American
~alance to renovate a vacant industrial building in Jamison
~ndustrial Park in Hollins. Mr. Gubala reported that this
þompany will provide approximately 110 employment positions.
Supervisor Johnson moved to approve the request. The
~otion was seconded by Supervisor Brittle.
RESOLUTION 10-14-86-208 APPROVING THE
ISSUANCE OF INDUSTRIAL DEVELOPMENT BONDS
BY THE INDUSTRIAL DEVELOPMENT AUTHORITY
IN THE AMOUNT OF $950,000 TO AMERICAN
BALANCE CORPORATION
WHEREAS, the Industrial Development Authority of
Roanoke County, Virginia (the Authority), has considered the
application of American Balance Corporation (the Company), 1824
Progress Street, S.E., Roanoke, Virginia, 24013, requesting the
ssuance of the Authority's industrial development revenue bond
'n an amount estimated at $950,000.00 (the Bond) to assist in the
inancing of the Company's acquisition, rehabilitation and
~quipping of two existing buildings with a square footage
otaling 59,500 square feet of which 1,500 square feet is planned
or office, 10,000 square feet for storage and the remaining for
nanufacturing (the Project) 7742 Enon Drive and adjacent thereto
(tax I.D. Nos. 2710-10-1, 2, and 3), in Roanoke County, Virginia,
~nd has held a public hearing thereon on October 2, 1986.
WHEREAS, Section 103(k} of the Internal Revenue Code of
~954, as amended, provides that the governmental unit having
purisdiction over the issuer of industrial development bonds and
þver the area in which any facility financed with the proceeds of

industrial development bonds is located must approve the issuancI
of the bonds; and
WHEREAS, the Authority issues its bonds on behalf of
Roanoke County, Virginia (the County), the Project is to be
located in the County and the Board of Supervisors of Roanoke
County, Virginia, (the Board) constitutes the highest elected
governmental officials of the County; and
WHEREAS, the Authority recommends that the Board of
Supervisors approve the issuance of the Bond; and
WHEREAS, a copy of the Authority's resolution approvin
the issuance of the Bond, subject to the terms to be agreed upon
and a certificate of the public hearing has been filed with the
Board of Supervisors.
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA:
1. The Board of Supervisors approves the issuance of
the Bond by the Authority for the benefit of the Company, as
required by Section 103(k), to permit the Authority to assist in
the financing of the Project.
2. The approval of the issuance of the Bond, as
required by Section 103(k), does not constitute an endorsement t
a prospective purchaser of the Bond or the creditworthiness of
the Project or the Company, and, as required by Section 15.1-138
of the Code of Virginia of 1950, as amended, the Bond shall
provide that neither the County nor the Authority shall be
obligated to pay the Bond or the interest thereon or other costs
incident thereto except from the revenues and moneys pledged
therefor and neither the faith and credit nor the taxing power 0
the Commonwealth, the County nor the Authority shall be pledged
thereto.
3. The County's "Local Allocation", as such term is
defined in Executive Order 54(85) issued January 23, 1986, as
revised (the Executive Order), having been depleted, the County

dministrator is hereby authorized and directed to timely file
IDB Forms 1 and 4 and take such further action as may be
necessary to secure a private activity bond allocation for
edication to the Project.
4. This resolution shall take effect immediately upon
its adoption.

6. Authorization to Contact VDH&T Concerning

7. Request to Increase Mileage Reimbursement for Use

RESOLUTION 10-14-86-209 AMENDING
RESOLUTION #84-86 ALLOWING MILEAGE
REIMBURSEMENT FOR MILEAGE IN THE USE OF A
PERSONAL VEHICLE FOR COUNTY BUSINESS
BE IT RESOLVED by the Board of Supervisors of Roanoke
ounty, Virginia, as follows:
1. That Resolution #84-86 adopted May 8, 1984,
llowing mileage reimbursement for the use of personal vehicles

rovide a reimbursement of 2l¢ per mile for the first 15,000

IN RE: FIRST READING OF ORDINANCES PURSUANT TO ROANOKE COUNTY
CHARTER, SECTION 18.4
The Deputy Clerk read the following first reading into
the record:
1. Ordinance authorizing the conveyance of .045 acres
of real estate to MRI Tanglewood Investments, Inc., in exchange
for 0.41 acres of real estate.
There was no one present to speak on this matter.
Supervisor Brittle moved to approve the first reading
of this ordinance. The motion was seconded by Supervisor Garret
and carried by a unanimous roll call vote.
IN RE:
SECOND READING OF ORDINANCES PURSUANT TO ROANOKE COUNT
CHARTER, SECTION 18.4
1. Ordinance amending Chapter 3, Air Pollution of the
Roanoke County Code by the addition of a new section numbered 3-)
and entitled Permitted Open Burning of Leaves from Trees
Mr. Mahoney requested that this item be held over unti
October 28, 1986, in order to allow time to add comments receive~
by the new Fire Marshal.
Chairman Brittle read the following second reading int)

2. Ordinance authorizing the conveyance of 7.58 acres
of real estate to McVitty Homes of Roanoke Valley, Inc., in
exchange for 7.96 acres of real estate.
Mr. Mahoney reported that the purpose of this ordinanc~
is to allow the exchange of two tracts of real estate.

Supervisor Nickens moved to approve the prepared
ordinance. The motion was seconded by Supervisor McGraw.
ORDINANCE 10-14-86-210 AUTHORIZING THE
CONVEYANCE OF 7.58 ACRES OF REAL ESTATE
TO McVITTY HOMES OF ROANOKE VALLEY,
INC. IN EXCHANGE FOR 7.96 ACRES OF REAL
ESTATE
BE IT ORDAINED by the Board of Supervisors of Roanoke
tounty, Virginia, as follows:
1. That pursuant to the provisions of §18.04 of the
charter of Roanoke County, a first reading on the disposition and
exchange of the hereinafter described real estate was held on
September 23, 1986. A second reading on this matter was held on
þctober 14, 1986. This real estate is located west of Salem near
State Route 643; and
2. That the conveyance of approximately 7.58 acres of
real estate from the Board of Supervisors of Roanoke to McVitty
Homes of Roanoke Valley, Inc. in exchange for approximately 7.96
acres is hereby authorized and approved; and
3. That the County Administrator is authorized to
execute such documents and take such actions on behalf of Roanoke
County as are necessary to accomplish the conveyance of this
property, all of which shall be upon form approved by the County
~ttorney.
In motion of Supervisor Nickens, seconded by Supervisor McGraw,
and upon the following recorded vote:

Supervisor McGraw - Supervisor McGraw expressed his

Directors as a representative of Region 10.

Supervisor Nickens requested that Mr. Hodge investigate
~he possibility of painting County buildings as noted in this
report by utilizing a community diversion program.

Supervisor Brittle moved to go into Executive Session
pursuant to the Code of Virginia 2.13-44 (a) (1) and (6). The
motion was seconded by Supervisor Johnson and carried by a
unanimous voice vote.

Supervisor Johnson moved to return to Open Session.
The motion was seconded by Supervisor McGraw and carried by a
unanimous voice vote.
