The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
second regularly scheduled meeting of the month of November,
1986.

Mr. Hodge presented brochures to the Board, developed

AGENDA ITEMS
Chairman Brittle announced that public hearing 1186-2,
~he petition of Nicholas Munger, has been withdrawn upon the
~equest of the petitioner. He also announced that item G, work
ßession on the Capital Improvements Program, will be heard
Following Item L, Citizens' Comments and Communications.
Mr. Hodge requested that a report concerning Route 419
be added under New Business as Item E5 and that a report
~oncerning the sinkhole on Sierra and Fenwick be added to the
~onsent Agenda as Item K8.

Chairman Brittle presented a resolution of appreciation
o the Roanoke Junior Womens Club for their donation of $6,000 to
Wouth Haven II. Ms. Camille Cabanass and Ms. Barbara Shores of

Supervisor McGraw moved to approve the prepared
resolution. The motion was seconded by Supervisor Johnson.
RESOLUTION 11-25-86-231 EXPRESSING THE
APPRECIATION OF THE BOARD OF
SUPERVISORS TO THE ROANOKE JUNIOR
WOMEN'S CLUB FOR THEIR DONATION TO
YOUTH HAVEN II
WHEREAS, in May of 1985, the Board of Supervisors
recognized the need for and approved the development of a home
for troubled girls in Roanoke County; and
WHEREAS, the building where the Youth Haven II home
will be located has required substantial renovation and
improvement; and
WHEREAS, the Roanoke Junior Women's Club has generousl
donated $6,000 for the construction of the Youth Haven II
conference room, and in doing so, have greatly improved the
quality of the building and the program; and
WHEREAS, this act of generosity and support is one tha
expresses in a meaningful way the concern of this organization
for the troubled youth of the Roanoke Valley and further
demonstrates an admirable sense of civic responsibility.
NOW, THEREFORE, the Roanoke County Board of Supervisor
wishes to express its gratitude and the gratitude of all Roanoke
County citizens for the donation of the Roanoke Junior Women's
Club for the youth of our community, the Youth Haven II program,
and Roanoke County.
On motion of Supervisor McGraw, seconded by Supervisor Johnson,
and upon the following recorded vote:

Chairman Brittle presented a proclamation declaring
December 1986 "Christmas Seal Month" to Laura Wimmer, Regional
Director of the American Lung Association.

Supervisor Nickens moved to approve the prepared
proclamation. The motion was seconded by Supervisor Johnson and
carried by a unanimous roll call vote.
PROCLAMATION
WHEREAS, the American Lung Association of Virginia,
Roanoke Region, is an organization that promotes lung health; and
WHEREAS, the activities of this association include
many programs and services which include Freedom From Smoking
Clinics, adult and child lung disease programs, second-hand smoke
health programs, and the Family Asthma Programs; and
WHEREAS, additional services are made possible by
support groups for patients suffering with Chronic Obstructive
Pulmonary Disease and persons who have quit smoking, patient
assistance, and school health education programs; and
WHEREAS, funds also support research at the state and
national levels for the purpose of preventing and controlling
lung disease.
NOW, THEREFORE, We, the Roanoke County Board of
Supervisors, in cooperation with the American Lung Association of
Virginia, do hereby proclaim December 1986, as
CHRISTMAS SEAL MONTH
Chairman Brittle also presented a certificate to Ms.
Bonnie Preas, Contract Supervisor in the Department of
Procurement, acknowledging her certification as a professional
public buyer.
Chairman Brittle also introduced Ms. Janet Johnstone,
who recently began her employment with Roanoke County as public
information officer.
IN RE:
NEW BUSINESS
1. Progress Report Concerning Services Provided to
Roanoke County Citizens by the Mental Health Services of Roanoke

Valley - Ms. Helen Sublette presented a report updating the Boaré
on certain services provided to County citizens by the Mental
Health Services of Roanoke Valley.
2. Health Insurance Coverage for Retired County
Employees - Supervisor Johnson informed Mr. Cook, Director of
Human Resources, that there may be a study resolution introduced
in the Senate which will possibly establish a state commission or
health insurance. If this occurs, the state will create a pool
for all employees and local government employees to provide
insurance. He directed Mr. Cook to please keep the Board
informed on this issue.
Supervisor Johnson moved to approve staff
recommendation. The motion was seconded by Supervisor Nickens
and carried by a unanimous roll call vote.
3. Authorization to Execute an Agreement to Reimburse
Boone, Boone, & Loeb, Inc., for Costs Incurred To Install
Off-Site Water Facilities to Canterbury Park and Adjoining Lands
- Supervisor Nickens moved to authorize the execution of this
agreement. The motion was seconded by Supervisor Garrett and
carried by the following recorded vote:
AYES: Supervisors McGraw, Garrett, Johnson, and Nickens

ABSTAINED: Supervisor Brittle
4. Petition of Jonathan Rogers for Allowance of Claim
- Mr. Jonathan Rogers reported to the Board that he obtained a
judgment against Mr. C. M. Davis. At that time, he had planned
to execute this judgment through a Sheriff's sale, however, he
was advised that Mr. Davis had a $3,000 bond with the County. HE
reported that Mr. Anderson, Roanoke County Treasurer, feels that
the County is entitled to this bond money since Mr. Davis owes
personal property taxes for an automobile owned by Renta
Corporation which is owned by Mr. Davis.

Linda Lehe, Assistant County Attorney, reported that
the County has judgments against Mr. Davis and his corporation
and recommended that the County retain the funds.
Supervisor Johnson moved to deny Mr. Rogers' request.
The motion was seconded by Supervisor Brittle and carried by a
unanimous roll call vote.
5. Route 419 Improvements - Mr. John Peters, Road
Coordinator, reported to the Board that the improvements included
in the six-year plan for Starkey Road and Ogden Road could have
an adverse impact on traffic on Route 419 in the vicinity of
Tanglewood Mall. In order to eliminate these potential problems,
the Highway Department has prepared a preliminary plan for
improving Route 419 from Route 220 to Route 800. In addition,
the preliminary 419 Corridor Study by the Fifth Planning District
Commission indicates that this part of Route 419 has an accident
frequency 7 times that of the average accident rate.
Supervisor Brittle moved to approve the prepared
resolution. The motion was seconded by Supervisor Garrett.
Supervisor Johnson inquired if the railroad trestle
would have to be removed. Mr. Peters reported that that portion
of Route 419 does not require a turning lane. He also reported
that if this project is funded, it will be expedited so that
there is not a time lag between the Starkey and Ogden project and
the proposed 419 project.
Chairman Brittle requested that the record reflect that
the speed at which this item came to the County from the Highway
Department did not allow time for notification of all the
property owners on Route 419.
RESOLUTION ll-l5-86-235 REQUESTING THE
VIRGINIA DEPARTMENT OF HIGHWAYS AND
TRANSPORTATION PRIMARY FUNDING FOR
HIGHWAY IMPROVEMENTS TO ROUTE 419
WHEREAS, Route 419 (Electric Road) is the most heavily
traveled primary highway in the Salem District; and

WHEREAS, the daily traffic count on Route 419 is sub-
stantially in excess of the statewide average for similar primar1
highways; and
WHEREAS, the accident rate on Route 419 is more than
seven times the statewide average for similar primary highways.
NOW, THEREFORE, BE IT RESOLVED that the Board of Super-
visors of Roanoke County, Virginia does hereby request state fun(~
ing from the Virginia Department of Highways and Transportation
to construct improvements to Route 419 (Electric Road) from RoutE
220 (Franklin Road) to Route 800 (Chaparrel Drive) within RoanokE
County, Virginia, in accordance with the recommendations contain-
ed in the "419 Corridor Study" from the Municipal Planning Organi~
zation of the 5th Planning District Commission.
BE IT FURTHER RESOLVED that funding for these highway
improvements to Route 419 be from primary highway construction
funds.
BE IT FINALLY RESOLVED that this request for funding
from the Virginia Department of Highways and Transportation is ir
addition to those primary highway priorities previously identi-
fied and conveyed to the Virginia Department of Highways and
Transportation at the November 13 preallocation hearing.
On motion of Supervisor Brittle, seconded by Supervisor Garrett
and upon the following recorded vote:

Chairman Brittle requested that a work session be
scheduled on December 16, 1986, at 2:30 p.m., to discuss the

Supervisor McGraw - Supervisor McGraw reported that he

Supervisor Nickens directed that a resolution be place
on the next Consent Agenda which will increase the tippage fees
to cover future land acquisition for the landfill.

Supervisor Nickens moved to approve the Consent Agenda
with the addition of Item K8 concerning the sinkhole on Sierra
and Fenwick. The motion was seconded by Supervisor Johnson.

FIRST READING OF ORDINANCES
The Deputy Clerk read the following first readings int
the record:
1. Ordinance amending Chapter 22 of the 1985 Roanoke
County Code, "Water", to reduce the fees for separate fire
service.
Supervisor Brittle moved to approve the first reading
of the ordinance. The motion was seconded by Supervisor Nickens
and carried by a unanimous roll call vote.
Mr. Hodge reported that staff will bring more
information to the Board concerning this ordinance at the next
meeting and noted that the ordinance may have to be changed.
2. Ordinance accepting an offer for and authorizing
the conveyance of 3.92 acres of surplus real estate, Hidden
valley Junior High School property.
Mr. Mahoney reported that he has received an offer fro
a citizen and that other citizens can still make an offer on thi
property.
Supervisor Garrett moved to approve the first reading
of this ordinance. The motion was seconded by Supervisor Nicken
and carried by a unanimous roll call vote.
IN RE:
SECOND READING OF ORDINANCES
The Deputy Clerk read the following second readings
into the record:
1. Ordinance accepting an offer for and authorizing
the conveyance of surplus real estate, a well lot on View Avenue.
Mr. Mahoney reported that he has received an offer fro
Harris Simmons in the amount of $1,200.00 to purchase this
property.

ORDINANCE 11-25-86-237 ACCEPTING AN OFFER
FOR AND AUTHORIZING THE CONVEYANCE OF
SURPLUS REAL ESTATE, A WELL LOT ON VIEW
AVENUE
BE IT ORDAINED by the Board of Supervisors of Roanoke
:ounty, Virginia, as follows:
1. That pursuant to the provisions of §18.04 of the
~harter of Roanoke County, a first reading concerning the sale
~nd disposition of the hereinafter described real estate was held
~n November 11, 1986. A second reading on this matter was held
~n November 25, 1986. This real estate consists of a well and
storage building lot located off View Avenue, Tax Map No.
77.14-5.73.
2. That offers having been received for the well lot
ocated off View Avenue, the offer of Harris Simmons in the
imount of $1,200.00 is hereby accepted and all other offers are
ejected; and
3. That the County Administrator is authorized to exe-
þute such documents and take such actions on behalf of Roanoke
tounty as are necessary to accomplish the conveyance of said pro-

ORDINANCE 11-25-238 AUTHORIZING THE
ACQUISITION OF 110 ACRES OF REAL ESTATE
FROM THE YOUNG MEN'S CHRISTIAN
ASSOCIATION
BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That pursuant to the provisions of §18.04 of the
Charter of Roanoke County a first reading concerning the
acquisition of the hereinafter described real estate was held on
November 11, 1986. The second reading on this matter was held 0
November 25, 1986. This real estate consists of approximately
110 acres of real estate, including improvements, identified by
Roanoke County Tax Map No. 83.00-1-6.
2. That the County shall acquire this real estate
pursuant to the terms of an agreement entered into between the
Board of Supervisors of Roanoke County and the Young Men's
Christian Association. This agreement provides in part that the
purchase price for this property is $200,000.00, said purchase
price to be paid $40,000 upon delivery of the deed and the
balance to be paid in four equal annual installments. The
payment of the balance of the price shall be subject to future
appropriations made by the County. The repayment of the balance
of the purchase price shall be secured by a deed of trust
pursuant to the provisions of §15.l-262 of the Code of Virginia,
1950, as amended.
3. That the County Administrator is authorized to
execute the aforementioned agreement and such documents and take
such actions on behalf of Roanoke County as are necessary to
accomplish the acquisition of said real estate, all of which
shall be upon a form approved by the County Attorney. Further
this acquisition of real estate shall be subject to a judicial
proceeding commenced by the Young Men's Christian Association to
authorize the sale of said real estate.

IN RE: PUBLIC HEARINGS
1186-1. Petition of REGION PROPERTIES to rezone 44.39 acres
from R-l, Residential, to R-3, Residential, to
construct townhomes and/or detached homes located on
the east side of Merriman Road at Ranchcrest Road in
the Cave Spring Magisterial District. (Held Over From
October 28, 1986)
Supervisor Brittle reported that he met with the
citizens involved in this rezoning earlier.
Mr. E. E. Haynes, 5508 Ingleside Drive, SW, Roanoke,
Virginia, 24018, was present on behalf of the citizens opposing
~his rezoning. He requested that the Board approve the
~evelopment of single family homes only instead of townhomes.
Supervisor Brittle moved to rezone this property from
~-l to R-2 instead of R-3 as requested. The motion was seconded
~y Supervisor McGraw and carried by a unanimous roll call vote.

Permit to operate a part-time beauty shop in her home,
located at 4789 Vintage Lane in the Catawba Magisterial
District.
Ms. Lucille Boyd was present to answer any questions

There was no one present in opposition to this matter.
Supervisor McGraw moved to approve the Special
~xception permit request. The motion was seconded by Supervisor
~rittle and carried by a unanimous roll call vote.

Petition of WILLIAM C. and CAROLYN B. LAUB for vacation
of a drainage easement on the survey plat of Lot 8 and
Lot 9 of Heidelberg Estates in order to relocate the
easement 30 feet to the north in the Catawba
Magisterial District.
Mr. William C. Laub was present to answer any questions
he Board might have. He reported that this request to vacate a
rainage easement will allow him to adjust property lines on
everal parcels of land that he owns.

Mr. Jeff Straum of Balzer & Associates was present on
behalf of the petitioner. He presented site plans of the
development of the proposed parcel.
Mr. James T. Anderson, 4915 Colonial Avenue, Roanoke,
Virginia, was present in opposition to the rezoning request.
Mr. Rudy Cox of Rudy Cox Realty reported that the
petitioner is requesting rezoning back to what this property was
originally zoned.

Supervisor Johnson requested that this matter be
