IN RE: PROCLAMATION, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Presentation of Plaque to Roanoke County for participation in the Constitution's Bicentennial: E. Laban Johnson, Chairman of the Roanoke Valley Bicentennial Commission was present to present a framed plaque from the State Commission to Roanoke County in recognition of the County's participation in the Constitution's Bicentennial activities. 2. Resolution of Conqratulations to Department Employees of the Year and County Employee of the Year: D. Keith Cook, Director of Human Resources, reported this was the first year of the Employee of the Year Program. Fifteen employees were nominated by their departments for this honor. Mr. Cook presented those employees to the Board of Supervisors, and they received Resolutions of Congratulation and Sesquicentennial Cups. Following recognition of the Department Employee of the Year awards, the County Employee of the Year award was presented to Janice Stout, Personnel Assistant in the Department of Human Resources. She was chosen by a committee composed of five representatives from the Employee Advisory Committee. Supervisor Johnson moved to approve the prepared resolutions. The motion was seconded by Supervisor McGraw RESOLUTION OF CONGRATULATIONS TO JANICE K. STOUT UPON HER SELECTION AS ROANOKE COUNTY EMPLOYEE OF THE YEAR BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, The Board of Supervisors of Roanoke County, Virginia approved an Employee of the Year Program in November 1986; and WHEREAS, the purpose of this program is to recognize outstanding employees and encourage excellence in performance of job duties; and WHEREAS, a committee appointed by the County Administrator and made up of five representatives from the Employee Advisory Committee selected the 1986 Roanoke County Employee of the Year from a group of departmental nominees; and WHEREAS, Janice K. Stout was selected by this committee as the 1986 Employee of the Year, and WHEREAS, Janice K. Stout is deserving of special recognition by the Board of Supervisors of Roanoke County, and the citizens of Roanoke County for her outstanding contributions made during the year 1986. NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation to Janice K. Stout for her excellent performance, and capable, loyal, and dedicated service to the citizens of Roanoke County; and FURTHER, the Board of Supervisors of Roanoke County offers its congratulations to Janice K. Stout for being selected as Employee of the Year for 1986. ,- 4:~8' April 14, 1987 RESOLUTION 41487-1 OF CONGRATULATIONS TO FIFTEEN COUNTY EMPLOYEES UPON THEIR SELECTION AS A DEPARTMENTAL EMPLOYEE OF THE YEAR 1986 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, The Board of Supervisors of Roanoke County, Virginia approved an Employee of the Year Program in November 1986 to recognize outstanding employees and encourage excellence in performance of job duties; and WHEREAS, fifteen finalists were nominated by their individual departments based on criteria which included excellence in the performance of job duties, display of service to the public and to fellow employees, and contribution of money-saving or labor-saving ideas; and WHEREAS, these fifteen employees are also the finalists in the Employee of the Year Program; and WHEREAS, they are deserving of special recognition by the Board of Supervisors of Roanoke County, and the citizens of Roanoke County for their outstanding contributions to the County during 1986, and WHEREAS, these employees will be present to receive individual resolutions congratulating them for receiving this honor. Presentation on the Green Hill Horse Center: Supervisor McGraw, a member of the Horse Center Advisory Committee recognized the Chairman of the Committee, Don Sutten, and introduced the members of the committee who were present. Mr. Sutton announced that the committee had completed the planning stage of the center. A concept plan has now been devised on the 30 acre site, and each phase has been accepted by the Committee. Each phase will be implemented as funds become available. Mr. Eldon Karr presented a slide show showing the plans for the horse center. Mr. Karr stated that the horse center is part of the Park Master Plan for Roanoke County. Chairman Johnson commended the committee and Mr. Karr on their work, and pointed out the importance of this being a joint effort between the public sector and private citizen involvement. 2. Request for Approval of a Safety Belt ,Policy: Director of Human Resources D. Keith Cook announced that his department has developed a Safety Belt Policy in County vehicles. This policy has been reviewed with the Employee Advisory Committee and Employee Safety Task Force Committee for suggestions and recommendations. Mr. Cook outlined the policy and plans for implementation, and recommended that the policy begin on July 1, 1987. This would allow time for an educational program for the employees. Mr. Cook also announced the State of Virginia has also passed a similar policy which will go into effect on January 1, 1988. ë~ 4:40" April 14, 1987 Supervisor Nickens suggested that the Safety Council of Southwest Virginia be involved in the educational process. Supervisor Brittle moved to approve the safety belt policy. Request for Approval of Rabies Prevention Program for Cats: Kenneth Hogan, Chief Animal Control Officer reported that rabid cats are now a much more serious problem than in years past. Mr. Hogan presented color-coded maps showing the spread of rabies throughout Virginia. While rabies has not become a problem in the Roanoke Valley, surrounding localities have already experienced an upsurge in the number of rabid animals. Of the confirmed cases of rabies in Virginia from 1980 to 1986, there were 3 rabid dogs and 29 rabid cats. Supervisor Brittle asked if Mr. Hogan had a projection on the number of cats that might be picked up. Mr. Hogan responded that most of the animals will be unadoptable and euthanized. Supervisor Nickens was concerned that the amount of time spent picking up cats might take away time spent answering complaints of dogs running at large. He questioned the enforceability of the proposed ordinance, and suggested that the item be postponed. Mr. Hodge responded that the item is only for discussion at this time, and the proposed ordinance must go through first and second reading of the ordinance before it is passed. Supervisor McGraw moved to approve a Rabies prevention program and moved forward with the first reading of the ordinance. Request for Approval of Industrial Access Funds for Bolling Steel: Timothy Gubala, Assistant County Administrator for Community Development reported that in 1979, Roanoke County initiated an Industrial Access request for Bolling Steel off Route 11/460. The original request was dropped because of the drainage problems and exorbitant cost of constructing the road. Staff has since been meeting with them to find other alternatives. There is now an adjacent landowner willing to donate land for a right-of-way. With the donation, the construction is estimated to cost only $50,000 to $60,000 and would come from next year's fiscal allocation. Supervisor Nickens moved to request Industrial Access Funds for Bolling Steel and accept the right of way from the adjoining property owner. Ordinance authorizing acquisition of a drainage easement from the Trustees of Fort Lewis Christian Church: County Attorney Paul Mahoney reported that in November of 1986, the Board of Supervisors accepted the donation of an easement for drainage purposes from the trustees of the Fort Lewis Christian t\l\'Z, April l4, 1987 Church. Since then, the trustees have changed their mind, and voted to ask for the fair market value of the property, which is $120.00. This will be paid from a subdivision bond. This drainage easement will resolve a drainage problem in the Fort Lewis Village Subdivision. Supervisor McGraw moved to rescind the previous Board action and approve the first reading of the ordinance. The motion was seconded by Supervisor Nickens and carried by the following recorded vote: AYES: Supervisors Brittle, Garrett, McGraw, Nickens, Johnson NAYS: None ABSENT: None IN RE: SECOND READING OF ORDINANCES 1. Ordinance authorizing the acquisition of Easements, North Lakes water Line Interconnection: Mr. Mahoney announced that this ordinance authorizes the acquisition of easements across real estate of approximately five property owners, and is necessary to complete the North Lakes Water Line Interconnection Project. The first reading was held on March 24, 1987. Supervisor Johnson moved to approve the second reading of the ordinance. The motion was seconded by Supervisor Garrett. ORDINANCE 41487-5 AUTHORIZING THE ACQUISITION OF EASEMENTS, NORTH LAKES WATER LINE INTERCONNECTION PROJECT BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: l. That pursuant to the provisions of Section l8.04 of the Charter of Roanoke County, a first reading concerning the acquisition of five easements for the North Lakes Water Line Interconnection Project was held on March 24, 1987. That these easements are for underground water lines for North Lakes Water Line Interconnection Project. This project will replace existing poor quality well water and will provide a necessary utility service to the citizens of Roanoke County. 3. That the County Administrator is authorized to exe- cute such documents and take such actions on behalf of Roanoke County as are necessary to accomplish the conveyance of said pro- perty, all of which shall be upon form approved by the County Attorney. On motion of Supervisor Johnson, seconded by Supervisor Garrett, and upon the following recorded vote: AYES: Supervisors Brittle, Garrett, Nickens, Johnson NAYS: None ABSTAIN: Supervisor McGraw 2. Ordinance accepting an offer for and authorizinq the sale of real estate, The Old Courthouse in Salem, Virginia: Mr. Mahoney announced that the first reading of this ordinance was held on March 24, 1987. Mr. Mahoney stated he had received a written offer on the property and requested an Executive Session prior to taking action on the ordinance. IN RE: EXECUTIVE SESSION At 3:05 p.m. Supervisor Nickens moved to go into Executive Session pursuant to the Code of Virginia, Section 2.1-344 (a) (2) to consider a real estate matter. Ordinance accepting an offer for and authorizing the sale of real estate, The Old Courthouse in Salem, Virginia (Continued): Chairman Johnson asked if anyone was present to speak concerning this ordinance. Lee B. Eddy, a member of the Planning Commission, spoke to the Board, stating that the Planning Commission had unanimously passed a resolution that action not take place on the sale of the Old Courthouse until the public had heard about the proposed sale and had an opportunity to express their views. He suggested that a decision be deferred until other citizens and organizations be given the opportunity to give advice or opinion. Supervisor McGraw asked if the deed could contain a clause that the property revert to the County if it ceases to be used as intended. Mr. Mahoney responded this could be done. Chairman Johnson pointed out that the public has had ample opportunity to be aware of this action, due to newspaper articles and TV reports on the subject. County Administration Elmer Hodge also announced that First and Second Reading of Ordinances serve the purpose of informing the public of this type of action, and he has also discussed this with various media, the judges and Salem officials. ---- -- 445.. ">.'--"-',._.- - ._-~~- ..__.- .. ~ .- Supervisor Johnson moved to approve the second reading of the ordinance approving the sale of the Old Courthouse to Roanoke College in the amount of $500,000. Supervisor Nickens seconded the motion. Supervisor Nickens asked if the motion could be amended to include clauses in the document protecting the historical integrity of the Courthouse and establishing a payment schedule. Bill Walton, Vice President of Roanoke College responded the college would agree to such clauses. ORDINANCE 41487-6 ACCEPTING AN OFFER FOR AND AUTHORIZING THE SALE OF REAL ESTATE, THE OLD COURTHOUSE IN SALEM, VIRGINIA BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: l. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke County, a first reading concerning the sale and disposition of the hereinafter-described real estate was held on March 24, 1987. A second reading and public hearing on this matter was held on April 14, 1987. This real estate con- sists of approximately 1.265 acre located on College Avenue and East Main Streets in the City of Salem, Virginia, and is known as the old County Courthouse; and 2. That an offer has been received for this property, said offer from Roanoke College in the amount of $500,000, and is hereby accepted. All other offers are hereby rejected. 3. That the County Administrator is authorized to exe- cute such documents and take such actions on behalf of Roanoke County as are necessary to accomplish the conveyance of said pro- perty, all of which shall be upon form approved by the County Attorney. On motion of Supervisor Johnson with a clause in the contract that will protect the historical integrity of the Old '1 ,t\ l\ ñ ... April 14, 1987 Courthouse and set a payment schedule, seconded by Supervisor Nickens and the following recorded vote: AYES: Supervisors Brittle, Garrett, McGraw, Nickens, Johnson NAYS: None IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Brittle announced that T. D. Steele has requested a letter from the Board of Supervisors in support of a Certificate of Need for a 120 bed nursing facility near Buck Mountain Road. Supervisor Brittle moved that the Chairman draft such a letter. Supervisor Johnson seconded the motion. Supervisor Nickens asked if rezoning was necessary for the nursing facility. He was concerned that if a letter of support was sent by the Board, and then later the Board must hear a rezoning on the matter, it could place the Board in a difficult situation. County Attorney Paul Mahoney stated that if a rezoning was necessary, he would not recommend a letter of support be sent. Chairman Johnson asked Assistant County Administrator Tim Gubala to investigate to see if a rezoning would be necessary and report back to the Board by the end of the meeting. Supervisor Garrett asked if handicapped people could be deputized to issue citations to those parked in handicapped spaces. Chairman Johnson directed County Attorney Paul Mahoney to study this issue for legalities and report back to the Board of Supervisors on April 28, 1987. Mr. Mahoney stated the present ordinance is written well, but enforceability is the problem. Chairman Johnson directed Mr. Mahoney to review the possibility of adding stronger enforcement measures to the ordinance, and report back to the Board of Supervisors. IN RE: CONSENT AGENDA Supervisor Nickens moved approval of the Consent Agenda with the correction to Item L-2. Supervisor Garrett seconded the motion. RESOLUTION NO. 41487-7 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM L - CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: l. That that certain section of the agenda of the Board of Supervisors for April 14, 1987, designated as Item L - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 3, inclusive, as follows: 1. Acceptance of water and sewer lines in Cave Spring Office Park. 2. Authorization to request Industrial Access Funds for Southwest Industrial Park. 3. Approval of a Raffle Permit for North Cross School. 2. That the Clerk to the Board is hereby authorized and directed where required by law to set forth upon any of said items the separate vote tabulation for any such item pursuant to this resolution. Accounts Paid for March 1987 5. Unappropriated Fund Balance. IN RE: BUDGET WORK SESSION Chairman Johnson announced that the budget preparation has been a difficult process this year. Following adoption of this budget, Chairman Johnson proposed that the School Board, the Board of Supervisors, and both staffs meet together to look at the finances and capital needs of the County for the next five years, so that all are aware of the revenues and constraints. Chairman Johnson moved that $200,000 from the sale of the Old Courthouse, $100,000 from the Unappropriated Fund Balance, $50,000 from the Board Contingency Fund, and $l50,000 anticipated from the sale of unnamed real estate be affixed to the Roanoke County School budget under Item l7Bl. Supervisor Garrett seconded the motion. Bayes Wilson, Superintendent of Schools explained Item l7Bl was the instruction account which pays the salaries of teachers, principals, counselors, aides, school secretaries, and certain supply accounts. Supervisor Johnson responded his intent is that these funds be used for an 8 percent raise in teacher's salaries. Mr. Wilson advised their top 449 . . Supervisor Nickens stated that there is an excess of $600,000 that was not budgeted to be utilized in the current operating budget, but is money that is expended or earmarked for expenditures. His concern is that this is the fifth year that the Board was going to live within its resources and not spend non-recurring revenue, and yet now the Board is going to spend another $500,000 of non-recurring revenue for recurring expenses. Supervisor Nickens asked Mr. Wilson how he funded 18 additional personnel positions when they were not budgeted. Mr. Wilson responded some of that surplus was budgeted in the School Bus Fund, and some was budgeted in the Textbook Fund, and some were unbudgeted. There is some confusion as to what the surplus actually is. There were 18 positions cut from last year's budget. They later found they needed eight of the positions and planned to request extra sales tax if necessary. They anticipate approximately $90,000 surplus this year which will go into the School Bus Fund. Supervisor Nickens made a substitute motion to Supervisor Johnson's motion to lower the amount to $300,000, to increase the decal fee by $5.00 which woul,d generate an additional $200,000, and that the Fund Balance be restored by $100,000 and $100,000 be used to fund CORTRAN. There was no second, and the substitute died. Supervisor McGraw stated that he was concerned with giving teachers an 8 percent raise while other County employees will receive only a 5 percent raise, and was also concerned with using non-recurring revenues for this purpose. Supervisor Brittle felt that there was much to do in the area of consolidating services between the County and School division in areas of recreation, transportation and others. .. There is also a potential $lOO,OOO iability which has beendiscussed in Executive Session, and a YMCA payment that has not been budgeted for. There was further discussion on funding for other items uch as the Blue Ridge Region, Cultural Enrichment, Human and the continuation of Roanoke County Today. Supervisor Johnson's motion carried by the following vote: Supervisor Brittle, Garrett, Johnson Supervisors McGraw, Nickens Supervisor Johnson moved to adopt the Roanoke County udget as amended by his previous motion. Supervisor Brittle the motion. Supervisor Nickens requested a substitute motion to mend the budget by the following: that the Human Services udget be funded at $24,600; that the Cultural Enrichment fund be iverted to fund CORTRAN; that the Blue Ridge Region be funded in he amount of $l,OOO; that the Municipal Clerk's Association be eleted; that the League of Women Voters funding be deleted; and hat Mental Health Service budget be reduced by two percent, and that the County Administrator amend the budget to reflect these hanges. Supervisor McGraw seconded the motion, and the motion by the following recorded vote: Supervisors McGraw, Nickens Supervisors Brittle, Garrett, Johnson Supervisor Nickens requested a substitute motion that ould delete the $38,000 from the Board Contingency Fund and the 20,000 budgeted for the Cultural Enrichment Fund, and that those unds be diverted to CORTRAN funding. Supervisor Johnson moved to adopt the school budget with the additional funds of $500,000. IN RE: LETTER OF SUPPORT FOR CERTIFICATE OF NEED FOR A NURSING FACILITY Chairman Johnson removed from the table this issue which was discussed earlier. Supervisor Brittle stated that he has found there is a portion of the T. D. Steele property which will require a rezoning, and he is therefore withdrawing his motion. IN RE: EXECUTIVE SESSION At 5:l5 p.m., Chairman Johnson moved to go into Executive Session pursuant to the Code of Virginia Section 452 April 14, 1987 2.1-344 (a) (l} to discuss a personnel matter; and (6) to discuss a legal matter, the Reynolds litigation.
