The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the second Tuesday, and the
second regularly scheduled meeting of the month of October, 1987.

OPENING CEREMONIES
The invocation was given by The Reverend Gordon Grimes,
Cave Spring Baptist Church. The Pledge of Allegiance was recited
by all present.

REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF THE
AGENDA ITEMS
Chairman Johnson announced that Item 1, Park Bond
appropriation transfer for funding of Starkey Park athletic
fields would be delayed until Supervisor Nickens arrived. He
also announced that Item 2, Approval of the funding for sewer
extension to serve Perimeter East and West Ruritan Road, and Item
3, Approval of funding for sewer extension from Glade Creek
Interceptor to Route 460 had been postponed until the November
17th meeting.

IN RE:
PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS
Coy Daughtery from the Chapter of Ex-Prisoners of War
and Gene Tayloe from the Amvets presented five United States
flags that had been donated from various Veterans Associations.
These flags will be hung at public buildings that do not now have
flags. Supervisor McGraw and Supervisor Garrett both expressed
deep appreciation for the donated flags.
IN RE:
NEW BUSINESS
1. Approval for transfer of park bond funds for
Starkey Park athletic fields: This item was delayed at
Supervisor Nickens request.
2. Approval of Funding for sewer extension to serve
Perimeter East and West Ruritan Road: This item was postponed
until November 13, 1987.
3. Approval of funding for sewer extension from
Glade Creek Interceptor to Route 460: This item was postponed
until November 13, 1987.
4. Request from Valley Metro to extend service from
the Roanoke City limits along Brambleton Avenue to the state
office of Vocational Rehabilitation: Assistant County
Administrator John Chambliss advised that Supervisor Nickens has

met with Valley Metro and RADAR, and discussed this with the
Department of Rehabilitative Services and would like to begin
this service November 1st. This request will allow the service
to be extended to the Office of Rehabilitative Services and
proceed toward a satisfactory resolution for the request to
extend the service on the Cave Spring Corners or the area along
Postal Drive.
Supervisor Brittle stated that the Brambleton Avenue
merchants strongly desire the full extension of service to Cave
Spring Corners. He moved that the full extension to the Valley
Orthopedic Center be approved. Supervisor Garrett asked what the
subsidy would be to extend the service that far. Mr. Chambliss
responded that the last figure given by Valley Metro is a subsidy
of $400 per month to run through June 1988. Mr. Hodge requested
some flexibility in the motion, giving approval to the Office of
Rehabilitative Services with the flexibility to allow staff to
work with Valley Metro to extend the route if possible.
Supervisor Brittle amended the motion to reflect Mr. Hodge's
request and asked Mr. Chambliss to inform the Brambleton Avenue
Association of the motion. The motion was seconded by Supervisor
Garrett and carried by the following recorded vote:

REQUEST FOR PUBLIC HEARINGS
1. Request for public hearinq on November 17, 1987
at 7:00 p.m. for condemnation and riqht-of-entry for Starkey
Force Main and Gravity Sewer: Supervisor Johnson moved to set
the public hearing. The motion was seconded by Supervisor
Garrett and carried by the following recorded vote:
AYES: Supervisors Brittle, Garrett, McGraw, Johnson
NAYS: None
ABSENT: Supervisor Nickens

APPOINTMENTS:
1. Community Corrections Resources Board:
Supervisor Nickens previously nominated Edmund J. Kielty for a
one-year term, expiring August 13, 1988. He will be confirmed
on the Consent Agenda.
2. Court Service Unit Advisory Council/Youth and
Family Services Advisory Board: Supervisor Nickens had
previously requested the nomination of James L. Trout to the
unexpired term of Joseph D. Cronin. His term will expire on
March 22, 1989. Supervisor Nickens also nominated Cassidee R.

Nickens to serve as a youth member from William Byrd High School
to a one-year term expiring November 13, 1988. These nominations
will be confirmed under the Consent Agenda.
Supervisor McGraw nominated Molly Eller to a one-year
term as youth member from Glenvar High School.
3. Grievance Panel: Supervisor Nickens had
previously nominated R. Vincent Reynolds to a three-year term as
alternate. His appointment will be confirmed under the Consent
Agenda.
4. Mental Health Services of Roanoke Valley Board of
Directors: The Mental Health Association has recommended and
Chairman Johnson concurs that Dr. Henry J. Sullivan be nominated.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS:
Supervisor Brittle announced that Elizabeth Stokes
has an opportunity to travel to China as part of a people to
people exchange at a cost of $4,770 in March 1988. Mrs. Stokes
has advised that she could fund half this cost from her budget.
Supervisor Brittle moved that the County Administrator be
authorized to find funding for the other half of the trip. The
motion was seconded by Supervisor McGraw. The motion carried by
a unanimous voice vote. Mr. Hodge pointed out that it may be

necessary to find funding for other staff to travel to China also
as part of the economic development effort.
Supervisor Brittle
directed Mr. Hodge to inform Mrs. Stokes that the funding had
been approved.
Supervisor Johnson
advised that after attending
several drainage meetings, he feels that it is obvious that
drainage problems impact several localities. He moved to direct
the County Administrator to study the possibility of asking the
General Assembly to support a Drainage District Commission which
would include the area localities, similar to Airport Commission
and Landfill Board, and report back to the Board by the end of
the year. The motion was seconded by Supervisor McGraw and
carried by the following recorded vote:

Consent Agenda be, and hereby is, approved and concurred in as to
each item separately set forth in said section designated Items 1
through 6, inclusive, as follows:
1. Request for approval for a Raffle Permit from the
Fort Lewis Civic League.
2. Acceptance of water and sewer facilities serving
Castle Rock Farms, Section 6.
3. Acceptance of water facilities serving

CITIZENS' COMMENTS AND COMMUNICATIONS
Supervisor Brittle reported that he has heard recently
from many citizens that Roanoke County is doing a fine job in
recreation, public facilities, streets. He expressed
appreciation to the staff for their excellent response to the
county citizens.

COUNTY ADMINISTRATOR'S COMMENTS
County Administrator Elmer Hodge announced that
Ingersoll-Rand will be meeting with a delegation from Xuanhua,
China. Xuanhua has indicated an interest in a "Sister Community"

relationship with Roanoke County. Mr. Hodge announced there will
be a press conference concerning this on Friday, October 30th at
9 a.m.

NEW BUSINESS: (Continued)
1. Approval of transfer of park bond funds for
Starkey Park athletic fields: (this was delayed from earlier in
the session): Stephen Carpenter, Director of Parks &
Recreation reported that the Board had previously approved the
development of Starkey Park, with the bond monies to be used only
for park land acquisition. It was deemed necessary to provide
additional facilities after the lights at the Hidden Valley ball
fields were removed. The board approved one soccer field, one
baseball field and associated parking at Starkey Park, but funds
were not allocated. It is now necessary to allocate $67,010 to
fund these facilities. Staff recommends that the funds be
allocated from either balances in other park bond funds available
or the general fund.
Supervisor Johnson moved that $67,010 for Starkey Park
¡development be appropriated from the fund balance. The motion
was seconded by Supervisor McGraw and carried by the following

Chairman Johnson announced that a quorum of board
members will be in attendance at the annual Virginia Association
of Counties meeting at the Homestead, and directed the Deputy
Clerk to advise the other media.

petition to vacate a portion of a plat of Thorcrest Subdivision.
This vaca tion-'isnedessary to go forwàrd with the proposed
Valleypointe project. There is an old subdivision plat on record
that would have to be vacated. Michael Smeltzer, attorney for
the petitioner was present to answer questions.
No citizens were present to speak.
Supervisor Johnson moved to approve the first reading.

2. Ordinance accepting an offer for and authorizing
the lease of sur Ius real estate Old Bent Mountain Fire Station:
Mr. Mahoney advised that the County Administrator has
received an offer to lease the. Old. Bent Mountain Fire Station.
This property has been declared surplus by the Board. The second
reading will be November 17, 1987. No citizens were present to
speak on this ordinance.
Supervisor Garrett moved to approve the first reading of
the ordinance. The motion was seconded by Supervisor Nickens,

3. Ordinance accepting an offer for and authorizing
the sale of surplus real estate - well lot in Otterview Garden
Subdivision: Mr. Mahoney stated that the County had received
an offer from a citizen to purchase an abandoned well lot locate
on Laban Road. The second reading will be November 17, 1987. N
citizens were present to speak to this ordinance.
Supervisor Nickens moved to approve first reading of the
ordinance. The motion was seconded by Supervisor Johnson, and

1. Ordinance amending Ordinance No. 6987-9 authorizing

therein: Mr. Mahoney reported that the first reading of this
ordinance was on October 13, 1987. The county charter requires
that the acquisition of real estate be accomplished by ordinance
This ordinance would authorize an expedited procedure for
noncontroversial water, sewer, and drainage easements. No
citizens were present to speak to this ordinance.

ORDINANCE 102787-4 AMENDING ORDINANCE
NO. 6-9-87-9 AUTHORIZING THE COUNTY
ADMINISTRATOR TO ACCEPT THE DONATION OR
DEDICATION OF UTILITY AND RIGHT-OF-WAY
ROAD EASEMENTS AND IMPROVEMENTS THEREIN
WHEREAS, pursuant to the provisions of Section 18.04 of
he Charter of Roanoke County, first and second readings are
equired to pass all ordinances; and
WHEREAS, the Board of Supervisors adopted an ordinance
9, 1987, authorizing the County Administrator to accept
of dedications of utility and right-of-way road ease-
improvements therein upon concurrence of said Board of
upervisors; and

WHEREAS, upon passage of said ordinance, a more orderly
nd expeditious procedure of reviewing, approving, authorizing,
nd accepting donations or dedications of such interest in real
state has been accomplished; and
WHEREAS, a more orderly and expeditious procedure of

dedication of water, sewer, or drainage easements and other real
estate interests is desired; and
WHEREAS, a first reading of the proposed amended ordin-
ance was held on October 13, 1987; the second reading was held on
October 27, 1987.
THEREFORE, be ordained by the Board of Supervisors of
Roanoke County that Ordinance No. 6-9-87-9 be amended as follows:
1. That upon the proposed donation or dedication of a
utility, water, sewer, or drainage easement or other property
interest, or a right-of-way for road purposes and any improve-
ments or facilities constructed therein, and/or the donation or
dedication of any property interest upon which to construct or
maintain any improvements or facilities in connection therewith,
the County Administrator is hereby authorized to accept said dona
tion or dedication, upon the review and recommendation of the
County Engineer, or his designee, and upon the concurrence of the
Board of Supervisors by resolution.
2. That the County Administrator is authorized to exe-
cute such documents and take such actions on behalf of Roanoke
County as are necessary to accomplish the acquisition of these
property interests, all of which shall be upon form approved by
the County Attorney. The County Administrator may delegate this
authority as he deems appropriate.

PETITION OF J. F. DAVIS AND W. E.
CUNDIFF TO REZONE AN APPROXIMATE 19.4

RESIDENTIAL ESTATES TO CONSTRUCT SINGLE
FAMILY HOMES LOCATED ON THE EAST SIDE
OF ROUTE 758 IN THE HOLLINS MAGISTERIAL

APPROVED
Assistant County Administrator Timothy Gubala reported
that this petition was heard by the Planning Commission on August
4 and September 1, 1987 and they did approve recommendation on a
vote of 4 to 1. There are proffered conditions for the site
plan, which are improved over the previously submitted site plan.
Heywood Fralin, attorney for the petitioner was present.

He advised that the original petition was opposed by the the
planning staff and Planning Commission because of the number of
lots that fronted on Route 758. The present plan provides for 80
lots with 80 foot frontages and all entrances to lots are off
roads other than Route 758. The request for rezoning only

affects seven lots, the remaining portion is already zoned
Residential Estates. The developer has stated he will develop
the property to the south first so that if there is any use for
the industrial land he is willing to develop that land
commercially.
Supervisor Johnson stated he still feels that there are
problems with the lots off Carson Road. He also thanked the
developer for his cooperation in trying to solve the concerns the
County had with the rezoning.
Speaking in opposition to this proposed rezoning were:
1. Stuart Wamsley, 3768 Autumn Drive N. E.
2. Clifton P. Sloan, 3837 Carson Road
3. Bobby R. Combs, 3602 Belle Avenue N. E.
Their main concerns were the additional traffic being
generated by this development on the narrow roads.
Supervisor Johnson pointed out that even without the
rezoning, 73 homes would be built on the property. With the
rezoning the developer has agreed not to develop part of the
property until the County has an opportunity to market it for
economic development.
Supervisor Johnson moved to approve the petition with
proffered conditions. The motion was seconded by Supervisor
Garrett, and carried by the following recorded vote:

Mr. Gubala announced that this petition was heard by the
Planning Commission on October 6th. There were citizens present
at that time. They were not in opposition, but concerned with
the future impact on the neighborhood. Since the Planning
Commission meeting, there have been several discussions
concerning proffered conditions. The petitioner has voluntarily
proffered a number of conditions that the Board received prior to

tonight's meeting. Mr. Gubala briefly outlined those proffers.
The petitioner, Mr. Al Lingerfelt, President and Chief Executive
Officer of Lingerfelt Development Corporation, was present and
outlined the plans for the proposed rezoning done by Hayes, Seay,
Mattern and Mattern. He also showed slides of similar
developments he has completed in other areas.
Mr. Hodge pointed out that Mr. Lingerfelt and the
developer have reached an agreement that will be brought to the
Board for approval. This will include the exchange of the Ida
Mae Holland property.
Supervisor Johnson commended Mr. Lingerfelt for his
patience during the bureaucractic process of bringing this
request to completion. He also advised that this was the single
largest potential development in the history of Roanoke County.
No citizens spoke in support or opposition to the
project.
Supervisor Johnson moved to approve the petition with
the proffered conditions. The motion was seconded by Supervisor
Garrett, and carried by the following recorded vote:

IN RE: CITIZENS COMMENTS AND COMMUNICATIONS
1. Chuck Williams spoke concerning the poor condition
of the athletic fields at the new William Byrd Middle School.
Among the problems were lack of water to keep grass on the
fields, the rocks, etc. that are in the field. He feels that the
contractor did not live up to the specifications in the contract.
He presented photographs of the condition of the field.
County Attorney Paul Mahoney was directed to study the
specifications. He and County Administrator Elmer Hodge were
directed to meet with the School Board personnel and report back
to Mr. Williams and the Board of Supervisors on November 17,
1987.
2. Michael Ballard, 6438 Nell Drive, spoke concerning
the chemical plant being planned at the corner of Old Hollins
Road and Beaumont Drive. He invited all members of the Board of

Supervisors to attend the community meeting at Mountainview
Elementary School that Supervisor Johnson has set up to discuss
this issue.
Supervisor Johnson announced that he is concerned about
the proposed chemical plant and has set a community meeting for
October 28, 1987 with the area residents and County staff to
receive the concerns of the neighbors, and try to address their
concerns. He pointed out that the land is presently zoned to
allow for the chemical plant.
