The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the third Tuesday, and the
second regularly scheduled meeting of the month of December'l
1987.

OPENING CEREMONIES
The invocation was given by The Reverend Sam Crews.
The Pledge of Allegiance was recited by all present.
IN RE:
COUNTY ADMINISTRATOR'S COMMENTS
County Administrator Elmer Hodge introduced Elizabeth
Stokes, Clerk of Circuit Court, and Mr. Black, a professional
portrait restorer, who updated the board on the progress in
restoring the portraits at the old Courthouse.
There are fifty
pictures that must still be restored, and additional funds will
be necessary to complete the restoration.
Mr. Hodge also announced that Roanoke County was
recognized and received an award from the Safety Council of
Southwest Virginia, and asked Director of Human Resources Keith
Cook to describe the awards. Mr. Cook stated that the award was
in recognition of the Defensive Driving Course given to drivers
of County vehicles, and for the employee Seat Belt Program.

Chairman Johnson presented his state of the Count
remarks, outlining the accomplishments of the County during 1987.
"The Board of Supervisors began this year with
commitment to regional cooperation and long-range planning an
development. Given the events of the past few weeks and th
accomplishments of the past eleven months, it would seem that w
have made major strides toward those goals.
We have this year witnessed a fully operationa

recycling project in the history of the Commonwealth of Virginia.
o 0 0 0 Another first for the Commonwealth of Virginia also was
realized when Roanoke and Botetourt Counties jointly agreed to
operate a public library. The building, now nearing completion,
is located in the Bonsack area.
o 0 0 0 With the support of our School Board, we were able to
open our first public safety building. For the first time in
many years, our employees in the Sheriff's Department, Fire &
Emergency Services, and Data processing have the necessary office
space to do their jobs. They can also park their cars without
fear of being ticketed.
o 0 0 0 We have entered for the first time a private/public
sector venture to operate a park and equestrian center at Green
Hill in West Roanoke County.
o 0 0 0 In October of this year, we brought on line our E9-1-l
System. Quite possibly, our single most important advancement.

We were able to fashion this year our first ma ·0
drainage improvements program with our newly developed $200,000
drainage account.
Our capital improvements efforts extend across th
board from libraries and parks to schools.
Major projects
included the headquarters library on 419, completion of a major
portion of our Kessler Mill Center, Green Hill Park, pinkar
Court Center, as well as additions at Mason Cove Elementar
School, Northside High School, Glenvar Elementary and High
School, Cave Spring Elementary and High School, and an 8.9
million dollar junior high school in vinton.
Our efforts to sustain these needed improvements was
supported by our economic development activities.
Our goal of
75/25 received a major boost with the announcement of¡

Valleypointe, our proposed 200 million dollar development in
north County.
Coupled with recent projects, such as Colonade
Park and the Southwest Industrial Park, we have truly turned the
corner toward our goal of a more equitable distribution of our
tax base.
The financial integrity of Roanoke County has also
been sustained as will be evidenced by our final audit figures to
be released today. In short, it was a very good year.

However, the road to progress is often times paved with
controversy. This year is no different. Several of our major
projects have been subjected to much public debate. This is as
it should be. Constructive criticism is not only welcomed, it is
encouraged. Our deliberations and discussions have been
strengthened because of this process.
Our agenda for next year is already filling up. Our
Sesquicentennial activities, the celebration of our l50th
birthday, recodification of our zoning ordinance, the Spring
Hollow permitting process and the ramifications of school funding
changes recommended by JLARC will no doubt move center stage next
month.
As for 1987, we can without reservation declare it an
eventful year. For those of you who shared in this process - you
have our heartfelt gratitude. If the essence of this board could
be captured in words, it was done some 200 years ago in 1787 by
our own Thomas Jefferson when Mr. Jefferson stated, "We are
always equal to what we undertake with resolution." This
statement certainly characterizes both your attitude and your
work ethic. While there is much left to do, you can certainly
take great pride in a job well done.

HOLLINS COMMUNITY DEVELOPMENT PROJECT
WHEREAS, in the spring of 1985, monies in the form of
grants, loans, and revenue sharing funds were allocated by Virgi
Water Project, Inc., Farmers' Home Administration, Virgi
Department of Transportation, Virginia Department of Housing
Community Development, and the counties of Roanoke and Botetourt to
and housing rehabilitation in the Hollins community; and
fund the installation of water and sewer lines, road improvemen s,
WHEREAS, since the approval of the funds, many steps h ve
been taken to improve the quality of life in the Hollins communi y;
and
WHEREAS, many individuals and organizations have gen r-
ously donated goods and services and in doing so, have grea ly
community; and
improved health and safety conditions and the appearance of he
meaningfully expresses sensitivity to the needs of the citizens
WHEREAS, this act of generosity and support is one t at
further demonstrates an admirable sense of civic responsibility.

counties of Botetourt and Roanoke, the Roanoke County Board of Sup r-

Chairman Johnson presented a
resolution and gift to Thomas Blaylock in appreciation of his
term as Commonwealth's Attorney. Mr. Blaylock thanked the board
for their support and recognition.

RESOLUTION 121587-2 OF APPRECIATION TO
THOMAS M. BLAYLOCK FOR HIS
SERVICE AS COMMONWEALTH'S ATTORNEY
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, Thomas M. Blaylock has been employed by
Roanoke County since 1978; was appointed as Commonwealth's
Attorney in September 1981; and was successfully elected to that
position in a special election in 1982 and reelected in 1984; and
WHEREAS, during his tenure in office, Mr. Blaylock was
active in the Virginia Association of Commonwealth's Attorneys,

serving on the Board of Governors; the National District
Attorneys Association; the Virginia Trial Lawyers Association;
the American Trial Lawyers Association; the Virginia Network for
Victims and Witnesses; and was selected the Outstanding Young
citizen for 1986 by the Cave Spring Jay Cee's.
WHEREAS, Mr. Blaylock did at all times act with
distinction, exhibiting his outstanding ability to serve the best
interest of all the citizens of Roanoke County.
NOW, THEREFORE, BE IT RESOLVED that the Board of
Supervisors of Roanoke County does express its deepest
appreciation and the appreciation of the citizens of Roanoke
County to Thomas M. Blaylock for his years of capable, loyal and
dedicated service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best
wishes for continued success in all his future endeavors.

RESOLUTION 121587-3 OF APPRECIATION TO
SHERIFF O. S. FOSTER UPON HIS RETIREMENT
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, Sheriff Foster has served a total of 34 years
and 8 months in police service, 31 years and 6 months of this
service in the Roanoke Valley; and
WHEREAS, Sheriff o. S. Foster was first elected Sheriff
of Roanoke County in 1967, and was reelected in 1971, 1975, 1979
and 1983, making him the first sheriff to be elected to a fifth
term in the history of Roanoke County; and
WHEREAS, Sheriff Foster has held leadership positions
in numerous law enforcement organizations including the Virginia
Sheriff's Association, the National Sheriff's Association, the

American Law Enforcement Association, the Roanoke County
Transportation Safety Commission, and the Roanoke Valley Law
Enforcement Council; and
WHEREAS, during his tenure, he has received many honors
and awards for his involvement in law enforcement and his
volunteer efforts; and
WHEREAS, because of Sheriff Foster's leadership skills,
the Roanoke County Sheriff's Department has gained recognition as
one of the most modern and effective departments in the
Commonwealth of Virginia.
NOW, THEREFORE BE IT RESOLVED that the Board of
Supervisors of Roanoke County expresses its deepest appreciation
and the appreciation of the citizens of Roanoke County to Sheriff
o. S. Foster for his many years of capable, loyal and dedicated
service to Roanoke County; and
FURTHER, the Board of Supervisors does express its best
wishes for a happy, restful and productive retirement.

WHEREAS, Alan H. Brittle was first elected to the
Roanoke County Board of Supervisors from the Cave Spring
Magisterial District in 1983; and
WHEREAS, Supervisor Brittle served the County 0 I
Roanoke tirelessly and selflessly for a period of four years,1
devoting many hours to the business of Roanoke County, both as a
member of the Board and as Chairman of the Roanoke County Boar
of Supervisors for 1986, and in all capacities, Supervisor
Brittle served capably the citizens of the County.
WHEREAS, during his term, Supervisor Brittle als
served with distinction on the Fifth Planning District Commission
Executive Board, Clean Valley Committee, and the Local Government
Advisory Council.

IN RE:
NEW BUSINESS
1. Presentation of the 1987 Audit Report: County
Administrator Elmer Hodge announced that the annual audit for the
year ended June 30, 1987 had been completed. Director of Finance
Diane Hyatt and Director of the Budget Reta Busher presented
the results of the audit report conducted by Peat, Marwick, Main
and Company. The County again received a Certificate of
Achievement for Excellence in Financing Reporting. Ms. Hyatt and
Ms. Busher provided the board with the current financial position
of the County and summary of costs compared with other
localities.

Ms. Busher advised that the staff recommends acceptin
the audit and that the board appropriate the net addition 0
$1,052,806 to the fund balance.
Supervisor Johnson moved to approve the staf

2. Presentation on the Ses uicentennial Activities:
Executive Director Kathy Davis introduced Jean Glontz, Chairma
of the Sesquicentennial Committee and Stephen Musselwhite,
Chairman of the Sesquicentennial Committee. Ms. Davis thanke
the members of the various committees working on th
Sesquicentennial. She also announced that the Commissioner of
Revenue will be distributing a calendar of events in January.
She presented to the board a packet of information outlining the
events planned for 1988.
Ms. Davis, Ms. Glontz and Mr. Musselwhite presente
mementoes to the board members.
3. Authorization to amend the 1987 holiday schedule:
Director of Human Resources Keith Cook advised that when the
Board approved the 1987 holiday schedule, they also authorized
the closing of county offices on any day appointed by the

Governor of Virginia. The state will close their offices for
half days on December 24th and December 31st.
Supervisor Brittle moved to approve these additional half
days off. The motion was seconded by Supervisor McGraw, and
carried by the following recorded vote:

4. Authorization to amend the restrictive covenants
for Mountain View Farm Technoloqical Park: Chairman Johnson
requested that this be postponed until the January 12th meeting
in order to ensure that the proper specific legal language is
included in the agreement. He also directed Mr. Hodge to contact
the area residents and invite them to the meeting.
IN RE: REQUESTS FOR WORK SESSIONS
Chairman Johnson requested a work session on individual
wastewater treatment plants for January 26, 1988.
N RE: REQUESTS FOR PUBLIC HEARINGS
1. Request for a public hearing pursuant to Section
5.1-29.14 of the 1950 Code of Virqinia as amended authorizinq

County Attorney Paul Mahoney requested that the board authorize a
public hearing on this issue, because the state code requires a
public hearing to impose fees. The first reading of the propose
ordinance will be held on January 12th and the second reading an
public hearing be held on January 26th.
Supervisor Nickens requested that the costs involved b
included in the board report.
Supervisor Nickens moved to approve the public hearing.

Supervisor Johnson requested that the Director of
Parks and Recreation contract vendors about the possibility of

donation of equipment for a gymnasium at the Public Safety Center.
Supervisor Johnson also requested that the Department of Human
Resources include a study of a possible wellness program during
the pay for performance and healthcare studies.

Supervisor Nickens asked why the cost to lease-purchase
the mechanical arm refuse collection vehicle had risen. Mr.
Hodge responded that this was because he had requested a delay in

beginning the program. The cost of the vehicles has not
increased. Supervisor Johnson added that originally the savings
would be generated by the resignation of employees who would not
have to be replaced. When the program was delayed employees had
to be replaced. Supervisor Nickens asked if there was another
way to acquire the pilot vehicle than the lease-purchase. Mr.
Hodge responded that in order to continue the brush collection,
they decided to use the money that was planned for the purchase.
Supervisor Nickens moved to approve Item J-5 after

1. Charles Houghton, 6846 Briar Ridqe Cr. spok
requested that Cotton Hill Road be included in the Six-Year
Construction Plan and presented a petition on this request.
2. J. F. Tobey, Jr.,2493 Timberview Road spoke
requesting that Timberview Road be included in the Six-Year

Construction plan and stated he had previously written to the
County requesting this inclusion.
3. Shelly Rosenbloom, 3275 Timberview Road, also
requesting that Timberview Road be included. Mr. Rosenbloom
drives a County school bus on this street.
4. Monte J. Looney, 7612 Countrywood Drive, spoke
concerning Route 221, a primary highway. He advised that
petitions have been sent to the Highway Department requesting
improvements to this highway.
5. Charles Henderson, 7604 Mt. Chestnut Road,
requested additional improvements to this road.
Chairman Johnson explained to the citizens the process
by which the Highway Department makes improvements.
Supervisor Johnson asked why the estimates are so much
higher than they were previously. Fred Altizer, from the Va.
Department of Transportation, responded that the lower estimates
are based on the preliminary facts. The estimates are revised
after further study.
Supervisor McGraw asked about the situation in the
Cherokee Hills subdivision. Mr. Altizer advised that a cutoff
date of January 1, 1976 was established to allow for matching
funds. Cherokee Hills was platted in 1977. There is a conflict
of dates and those roads cannot be constructed using state
matching funds under the present laws.

Assistant County Administrator Timothy Gubala announced
this was heard on December 1st by the Planning Commission, and
there was considerable concerns voiced by residents of the County
and the City of Roanoke. These concerns included increased
traffic on Glen Heather, devaluation of homes, increase in
accidents, storm drainage problems. The Planning Commission
recommended approval of the petition on a 3-2 vote.

Ed Natt, attorney for the petitioner, presented th
proposed plans for the property. The land is presently zoned R-
and the proposed plans call for a Burger King to be located an
the Hop-In presently there will be relocated. There will be on
entrance on Route 419 and two entrances on Glen Heather Drive
The entrances on Glen Heather will avoid use of the Route 41
entrance. Mr. Natt addressed concerns of site visibility 0
Route 419 and Glen Heather. This meets all the site distance
pursuant to VDOT's requirements. There are three school buse
from the city and two from the county using Glen Heather Driv
and they will not be on that road during peak hours that th
Burger King will be operating. At this intersection there ha
been one accident from January through October. Theyestimat
850 vehicles will visit the facility over a 24 hour period 0
time. Mr. Natt pointed out this facility would not violate th
Land Use Plan for the 419 area.

The following citizens spoke in support of the proposed
rezoning:
1. A. S. Powell, 3635 Bond Street
Mr. Natt advised that the neighbors had been approached
about the possibility of closing the two openings onto Glen
Heather. He had not received a response from them.
Supervisor Garrett stated that he felt this could be a
very unsafe situation. He also read portions of a letter from a
Roanoke City planner who stated that a fast-food restaurant would
adversely affect the Glen Heather neighborhood and promote
further commercial development in the area and increase traffic
volume in the residential area. He asked Fred Altizer if there
could be a traffic light placed at the intersection. Mr. Altizer
stated this could only determined by a traffic count and
engineering analysis and one has not been done. It could be done
if the situation was warranted. Supervisor Garrett pointed out
that the proposed restaurant will generate an additional 1,700
vehicles trips per day. He advised that the response he had
received was about 4 to 1 against the proposed rezoning.

Supervisor Nickens asked Rob Stalzer, Director 0
Planning, to provide him with a traffic count of Glen Heathe
approaching Route 419. Mr. Stalzer's stated this was from th
City of Roanoke and the traffic count was 730 cars. Superviso
Nickens stated he felt that the biggest concerns seem to be abou
the safety on Glen Heather.
Supervisor Nickens moved to delay this petition t
January 26, 1988 to allow the petitioners an opportunity to mee
with the neighborhood. The motion was seconded by Superviso
Garrett.
Supervisor Brittle pointed out that the present zonin I
could be used for many things such as multi-family residences,
high rise buildings, and many other uses of which the residents
would not approve. The motion carried by the following recorde

Mr. Gubala advised that there was no opposition to this

There are
conditions related to the density of the development. The
Planning Commission voted unanimously to recommend approval with

Ed Natt, attorney for the petitioner, outlined the plans
for the proposed rezoning. He stated he was aware that there
were some concerns about the rezoning.
Supervisor Johnson advised he had concerns about the
density of 16.7 units per acre. He expressed appreciation to the
petitioner for his work in trying to solve the problems. He also
stated that he had received information that may benefit the
petitioner that was not available to the Planning Commission.
Peter Williams, the petitioner, advised that he had met
with the other owners of the property and had worked out what
they thought was the best use of the property.
Michael Oliver, 5604 Daytona Road, spoke as a
representative of Stewart Sandwich Company which is located
adjacent to the tract. He requested a proffer of fencing along

REQUESTING VACATION OF A SANITARY SEWER
EASEMENT ON LOT 12A, SECTION 2,
KINGSTON COURT IN THE WINDSOR HILLS

Mr. Gubala stated that this is an administrative matter.
The developers were required to adjust the lot lines because a
house they built on Lot 11 encroached into Lot 12. The staff
recommends approval with the condition that the existing manhole
and cleanout be shifted back into the limits of the new easement.
Supervisor Nickens expressed concern that a developer
would build a house encroaching on an adjoining lot. He felt
this type of situation should be avoided in the future, or it may
be necessary to move the house rather than adjust the easements.
Attorney Ed Natt pointed out that sometimes these shifts
are errors because the stakes are inadvertently moved during the
process. Doug Dalton, the developer, explained that he was

enter upon and take such property and commence said sanitary
sewer improvements in order to replace the Starkey Sewage
Treatment Plant due to the economic infeasibility to upgrade the

State Water Control Board and provide long-term sewer capacity
for the health, safety, and welfare of its citizens and to
thereafter institute and conduct appropriate condemnation
proceedings as to said sanitary sewer easements; and
3. That pursuant to the provisions of Section 15.1-
238(e) of the 1950 Code of Virginia, as amended, and pursuant to
notice and public hearing as made and provided therein, the Board
does hereby invoke all and singular the rights and privileges and
provisions of said Section 15.l-238(e) as to the vesting of
powers in the County pursuant to Section 33.1-119 through Section
33.1-129 of the 1950 Code of Virginia, as amended, all as made
and provided by law.

WHEREAS, the Board of Supervisors of Roanoke County,
Virginia, had designated, upon the recommendation of the Elec-

in the City of Salem, Virginia, as the central absentee voter
election district; and
WHEREAS, as a result of the sale of the courthouse and
the relocation of the office of the Registrar of Roanoke County
to the Roanoke County Administration Center, the Electoral Board
of Roanoke County recommended to the Board of Supervisors of Roa-
noke County the relocation and establishment of the central absen-
tee voter election district in the Roanoke County Administration
Center for all elections held within Roanoke County.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervi-
sors of Roanoke County, Virginia, as follows:
1. That the first reading on this ordinance was held
on December 15, 1987; and the second reading was waived pursuant
to the emergency measure clause of Section 18.04 of the Roanoke
County Charter.
2. That the relocation and establishment of the cen-
tral absentee voter election district in the Roanoke County Admin-
istration Center for all elections held within Roanoke County is
hereby authorized and approved.
3. That the County Administrator is hereby authorized
to take such actions and to execute such documents as may be nec-
essary to accomplish these purposes, all upon form approved by
the County Attorney.

Chairman Garrett expressed appreciation for the support
of the Board. He also thanked former Chairman Johnson for his

He reminded the board and staff that

of Roanoke County and many sesquicentennial events are being
planned. He also pointed out that other government business will

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
WHEREAS, the Board of Supervisors does hereby express
its profound and most sincere appreciation to Bob L. Johnson for
his dedication, creativity and excellence in the performance of
his many vital responsibilities during his tenure as Chairman of
the Roanoke County Board of Supervisors during 1987; and
WHEREAS, Bob L. Johnson has served with great
distinction during this period of time; and it is altogether
fitting and proper that his enlightened concern, meaningful
initiative and hours of devotion to the needs of the citizens of
Roanoke County be duly recognized and honored.
NOW, THEREFORE BE IT RESOLVED that the Roanoke County
