The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the fourth Tuesday, and the
third regularly scheduled meeting of the month of February, 1985.
IN RE:
CALL TO ORDER
Vice Chairman Burton called the meeting to order at
3:08 p.m. in the absence of Chairman McGraw. The roll call was

EXECUTIVE SESSION
Supervisor Brittle moved to go into Executive Session
pursuant to the Code of Virginia Section 2.1-334 (a), (1), (2),
(4), and (6). The motion carried by a unanimous voice vote.
IN RE: OPEN SESSION
I Supervisor Nickens moved to return to Open Session at
4:10 p.m. The motion carried by a unanimous voice vote.
Work Session - Evaluation of Policy for Water Softeners
- John Hubbard, Superintendent of Public Facilities, reported on
developing a standard written procedure for evaluating citizen
requests for water softeners that will be based on proven factors.

Mr. Hubbard and his staff have found through their studies that
water softeners are not necessarily installed on systems with the
greatest need. Hi~ staff feels that a standard procedure is

needed to allow all systems to be evaluated on an equal basis.
When a customer requests that softeners be added to their water
system, the engineering staff will evaluate the customers that
will be affected. After this evaluation, questionnaires will be
sent to each affected citizen. Once the questionnaires are
returned, an evaluation form will be completed. When evaluating
these areas, strong emphasis will be placed on the capacity and
hardness of the well affected and the percentage of the affected
customers requesting softeners. A lesser emphasis will be placed
on the hardness of the system, the percentage of the entire water
system the affected well provides, and the number of customers
affected. A score will then be determined by the weights

assigned to each factor. If softening is not justified, the
request will be referred back to the person initiating the
request to inform them of the result of the County's evaluation.
If the request is justified, the engineering staff will prepare
preliminary costs for the project along with a time frame for
implementing the softeners. Upon receipt of the engineer's
information, the staff shall make a written report to the Board
of Supervisors for the necessary action.

Work Session - Terms of Human Services Committee
I
Members - Supervisor Minter reported that he felt that if the
County is going to consider funding private organizations, the
Human Services Committee is a must. Supervisor Nickens moved not
to reappoint a Human Services Committee after the terms expire on

February 28, 1985.
Supervisor Minter offered a substitute motion that the
staff immediately inquire to other governments and ask if they
would consider working with us on a regional Human Services
Committee and budget only a certain amount to funding and agree
to abide by the Regional Human Service Committee's
recommendations on how to break it up. The motion failed by the
following recorded vote:
AYES: Supervisor Minter
NAYS: Supervisors Brittle, Nickens, and Burton
ABSENT: Supervisor McGraw
Supervisor Nickens amended his earlier motion to read
that the County consider no request for funding agents of Human
Service Agencies other than those that exist at the pleasure of
Federal, State, and local governments. The motion resulted in a
split vote:
AYES: Supervisors Brittle and Nickens
NAYS: Supervisors Minter and Burton
ABSENT: Supervisor McGraw
Vice-Chairman Athena E. Burton announced that this

matter would be resolved at the next meeting on March 5, 1985,
because of the split vote.
Work Session - Task Force Study on Imposition of
Service Charges - Superintendent of Fiscal Management, John
Chambliss, reported that Section 58.1-3400 of the Code of
Virginia of 1950, as amended, allows a service charge in lieu of
real estate taxes on certain properties heretofore declared
exempt from real estate taxation. The service charge represents

a recovery of the cost for police and fire protection. This
section provides that the service charge for these services
cannot exceed 20 percent of the real estate tax rate. The
following properties are exempt from real estate taxation and the
I
service charge: properties owned by Federal government, State
government, Roanoke County and its agencies, institutions of
learning not conducted for profit, and churches's properties used
exclusively for religious worship or for the residence of the
minister. The service charge may be imposed upon other political
subdivisions of the State, cemeteries, and properties owned by
benevolent or charitable associations. The service charge will
be $.18 per $100 of assessed valuation. Should the County decide
to finance trash collection through property taxes, this rate
will have to be determined again. Supervisor Nickens moved to
disregard the recommendation of the staff to adopt an ordinance
service charge on tax exempt property. The motion carried by a

approving the service charge and to place no imposition of
unanimous voice vote.

CONSENT AGENDA
I
Supervisor Nickens requested that Items 6 and 9 be
removed from the Consent Agenda for further discussion. County
Attorney, Paul Mahoney, requested that Item 10 of the Consent
Agenda be amended to strike out "and" from second line from the
bottom and change "Director" of Fiscal Management to
"Superintendent" of Fiscal Management. Supervisor Nickens
questioned making Item 9, ordering of 18 new police vehicles,
part of the budgetary process. Superintendent of Fiscal
Management, John Chambliss, reported that the actual expenditure
will be rolled back into the current budget. County
Administrator, Don Flanders, reported that the County is ordering
the vehicles now to meet a deadline but funds will actually be

taken out of next year's budget.

BE IT RESOLVED by the Board of Supervisors of Roanoke

the amount of $26,400.00 for the annual maintenance agreements
for the hardware and purchased software on the Hewlett Packard
computer system for the period beginning March 1, 1985, be, and
same hereby is, ACCEPTED; and
2. That the County Administrator is hereby authorized

1. That the County Administrator is hereby authorized
to execute an agreement on behalf of the Board of Supervisors of

Roanoke County, Virginia, with the Town of Vinton to authorize
the enforcement of the County Building Code within the Town
limits of the Town of vinton. The County Building Code is the
Uniform Statewide Building Code and is currently enforced by the
County Building Department.
This agreement shall be effective
commencing July 1, 1985. This agreement shall be reviewed by the
County Attorney.

Vice-Chairman Athena E. Burton presented a proclamation
to Sharon Mays, Public Information Officer, proclaiming March 3
through March 9, 1985, as National Women's History Week.

WHEREAS, women have participated in every phase of
historical evolution including serving in the military, flying
airplanes, starting businesses, participating in numerous private
endeavors as well as playing prominent roles in the significant
social movements of our time, including suffrage, labor and civil
rights; and
WHEREAS, since the cultural, political and social

contributions of women have often been neglected, National
Women's History Week encourages the celebration of these
contributions to promote understanding of women's diverse roles
and to highlight their significant contributions to our society;

Bill Leech was present representing Mr. Wade Franklin.
He reported that he has worked with Rob Stalzer, Director of
Planning, and have incorporated the necessary changes. The
entrance has been changed from the center to the western end of
the property, which lines up with the median break in the highway
I
improving traffic flow. Mr. Franklin does intend to have a
left-hand turn lane built in the westbound lane on Peters Creek
Road. This new easement may be extended by the current property
owner to reach further into the land providing for future
development.

Mr. Leech and Mr. Stalzer have also worked out the
screening and buffering problems. Mr. Franklin has agreed to
place full size trees along the front of the property since the
land is just a bit below highway level. Mr. Leech reminded the
Board that the lights at the course are directed on the course
only. The petitioners have also agreed not to open until 1:00
p.m. on Sunday afternoons. Mr. Leech also reported that there
would only be 84 parking spaces instead of 90 as reported at the
February 12 Board meeting since they have reduced the number of
courses from three to two. Mr. Leech reported that Mr. Franklin
has already talked with Sheriff Foster about hiring off duty
deputies to patrol the area to prevent loitering.
Mr. William T. Singleton, 4921 North Spring Drive,
Roanoke, Virginia, Pastor of St. Phillip Lutheran Church,
directly across the street from the property in question, was
present in opposition to the development of this Putt-Putt
course, as he is concerned about vandalism.
Mr. Charlie Harris, of Harris Animal Hospital, the
property adjacent to the property in question. Mr. Harris is
concerned about the drainage in that area.
Mr. Franklin reported that he has contacted Balzer &
Associates, architectural engineers, to draw up a drainage plan.
Mr. Harvey O'Kahn, 8151 Otterview Road, Roanoke,
Virginia, was present in opposition to this Special Exception
Permit. He is concerned about the presence of the gameroom in
the neighborhood.
Supervisor Burton is concerned about the original land
use compatibility.
Mr. Franklin reported that there would be a maximum of
20 to 25 games placed in the gameroom. There would also be a 16
flavor ice cream parlor.
Supervisor Nickens moved for approval of the Special
Exception Permit with the following conditions: Type D Screening

and Buffering be installed where applicable or appropriate and
the rest to be approved by the Director of Planning for Roanoke
County; that the access to the property be gained by the driveway
to be constructed in alignment with Deer Branch Road and the

other property; that an off-duty county deputy be on duty on
Friday and Saturday and at other heavy traffic times as
determined by the franchise owner; that if the gameroom becomes a
nuisance through due process, the Board of Supervisors will have
the right to shut down the gameroom; that the left deceleration
lane be installed at the expense of the developer; that alcoholic
beverages will be prohibited on the premises; and the use of
drugs on the premises is also prohibited. The motion carried by

they would still proceed with their project. Mr. Mason also
reported that the portion of the site in the flood plain would be
the parking lot. Supervisor Minter moved for approval of the

ACCEPTING THE TOWN OF VINTON'S REQUEST
FOR INDUSTRIAL DEVELOPMENT BOND
ALLOCATIONS

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board hereby acknowledges and accepts
receipt of the Town of Vinton's request for an allocation of
$600,975 of Industrial Development Authority bonds for 1985
pursuant to Governor Robb's Executive Order 54 (85);and
2. That it is the intent of the Board to submit the
request of the Town of Vinton to the Commonwealth of Virginia
along with the County's request for its industrial development
bond allocation.

Supervisor Nickens requested staff to work more closely

Superintendent of Fiscal Management, John Chambliss, reported
that Dianne Hyatt has worked with Mr. Duff and Mr. Wingate in the

past weeks and they have been attempting to reconcile records.
Dr. Nickens requested that Mr. Chambliss and Mrs. Hyatt report
back to the Board in two months on their progress.
Supervisor Nickens requested an update on the status of
Route 11 and Route 460 relating to the Highway Department. John
Hubbard, Superintendent of Public Facilities, reported this this
'will be coming up in the Primary hearings with the Highway
Department in April.
Supervisor Burton - Asked Mr. Flanders about setting
priorities for the Community Block Grants. Supervisor Burton
also requested a work session on fire hydrants and would like a
review of the street light approval process. Mr. Hubbard

responded that a work session on street lights has been scheduled
for March 5, 1985.
IN RE:
REPORTS OF OFFICERS, DEPARTMENTS, AND COMMITTEES
1. County Attorney - Requested that the report on
arrest authority for Animal Control Officers be held over until
March 5, 1985.
2. Department of Public Facilities - Supervisor
Brittle read an earlier memorandum reporting that funds in the
amount of $14,167.00 have been set aside for the Ogden Center
parking lot paving. Supervisor Brittle requested that the Board
expend the funds for the paving of the parking lot and if
possible pave the access ramps. Supervisor Brittle also

presented a petition signed by citizens using that center.
Supervisor Nickens was concerned about the use of the Ogden
Center, that it might not provided adequate space and asked John
Hubbard if there was another access to Pinkard Court School
without traveling 220. He reported that his staff is looking at
a road that was in existence prior to 1932 and are checking into

having the Highway Department take over its maintenance.
Supervisor Brittle requested that if the Board does decide to
the County instead of as far away as pinkard Court. Supervisor

move the Ogden Center that they move it closer to the heart of
Burton asked about the leaks in the roof and found that they had
not been repaired and asked about some type of temporary repair.
Supervisor Nickens moved to authorize the expenditure of funds to
a maximum of $14,000.00 for paving of the parking lot to ensure
safety of citizens and eliminating vehicular hazards. Supervisor
Nickens called for questions. The vote on the call for questions
was as follows:
AYES: Supervisors Minter, Brittle,
NAYS: Supervisors Nickens, and Burton
The motion for questions failed by non-majority.

Supervisor Nickens requested a report on the
feasibility of relocating the Ogden Center to pinkard Court,
availability of other locations within the County, with the
understanding that the Parks and Recreation staff will
communicate with those senior citizens about the possible
relocation.
Mr. Hubbard also reported on the building contingency
fund. This report was to give a status to the Board of the funds
that the County has set aside for buildings contingency projects

and the projects the County has already made expenditures from.
The current balance is $747,844.00.
Mr. Hubbard reported that he is in the process of
meeting with Judge Koontz for the renovation of the second floor

of the Courthouse for the Appellate Court. Mr. Hubbard will be
back before the Board with recommendations and costs.

3. Department of Development - Rob Stalzer, Director
of Planning, presented the report accepting Hunters Trail into
the Secondary Highway System. Supervisor Minter moved to approve
the order accepting this road into the Secondary Highway System.

This matter came this day to be heard upon the
proceedings herein, and upon the application for Hunters Trail,
from Old Mountain Road to dead end, to be accepted and ;made a
part of the Secondary System of State Highways.

It appearing to the Board that drainage easements and a
50 foot right-of-way for said road have heretofore been dedicated
by virtue of certain maps known as Bellview Gardens, Section 3,
which map was recorded in Plat Book 9, Page 145, of the records
of the Clerk's Office of the Circuit Court of Roanoke County,
Virginia, on September ll, 1979 and Bellview Gardens, Section 4,
which map was recorded in Plat Book 9, Page l85, of the records
of the Clerk's Office of the Circuit Court of Roanoke County,
Virginia on March l8, 1981, and that by reason of the recordation
of said maps no report from a Board of Viewers, nor consent or
donation of right-of-way from the abutting property owners is
necessary. The Board hereby guarantees said right-of-way and
right for drainage.
NOW, THEREFORE, BE IT ORDERED that said road known as
Hunters Trail, from Old Mountain Road to dead end, and which is
shown on a certain sketch accompanying this Order, be, and the
same is hereby established as a public road to become a part of
the State Secondary System of Highways in Roanoke County, only
from and after notification of official acceptance of said street
or highway by the Virginia Department of Highways and
Transportation.

Mr. Stalzer reported on the alternatives for handling
Special Exception Permits. He reported to the Board that they
could determine to eliminate Special Exceptions and have them
permitted as uses by right in a particular zoning district. The
State Code does permit the Board of Zoning Appeals to be a
reviewing agency on any Special Exception if the Board of zoning
Appeals is the reviewing agency, there should be a list of

specific criteria or standards of review developed and forwarded
for the BZA to use in its determination. Supervisor Minter moved
for approval of the alternatives suggested by the Planning Staff.
Alternatives 2 and 3 will be sent to Planning Commission. The
motion carried by a unanimous voice vote.
Bill Threlkheld presented a list of priorities for
the Community Block Grant Program. Supervisor Minter moved to
approve the priorities to also be submitted to the Planning
Commission for their recommendations. The motion carried by the
following roll call vote:

ABSENT: Supervisor Steven A. McGraw
4. Department of Fiscal Management - Superintendent of
Fiscal Management, John Chambliss, reported on the advantages and
disadvantages of monthly billing for utilities. Mr. Chambliss
feels that if the County goes to a monthly billing system, a
monthly average of water, sewer, and trash collection should be
charged as the deposit. Mr. Chambliss and his staff would like
to research this prospect in more depth and come back to the
Board at a later date. Mr. Chambliss also desires to study a
"budget system" for the citizens such as Appalachian has.
Supervisor Nickens requested that questionnaires be sent out with
the next bills to get a general feeling of how the citizens will
react to the change in billing.
5. County Administrator - Mr. Flanders reported that
the Compensation Board meeting will be March 6, 1985, to evaluate
the budgetary requests of the various constitutional officers.
Mr. Flanders will relate to the Compensation Board that a
Supervisor will be present at that meeting.
County Administrator, Donald Flanders, gave an update
on the legislation results. He announced that the telephone
proposal to retain the authority to negotiate with C & P has been

removed from the County's authority through legislation and will
now be controlled by the State Corporation Commission. House
Bill 1256 which authorizes immune counties to petition for
charter authority for revenues passed both houses. The bill for
motel tax of 2 percent was also passed. There was $90,000.00
included in the State budget for the Virginia Water Project,
specifically for the Hollins Community Program, Mr. Edlich has
reported that the money will be turned over to Roanoke County to
use as a base for the Hollins Community Project. Mr. Flanders
does not expect the revenue sharing bill to pass.
Mr. Flanders reported that he has received a letter
from Senator Warner regarding the Army Corps of Engineers report
on West County. The Corps indicated that a solution satisfactory
to all interests is not available. Senator Warner is pursuing
other alternatives.
Mr. Flanders also reported that John Chambliss will be
attending on March 4, 1985, a meeting of the Water and Sewer
Authority to ascertain if there are any potentials for the County.
