The Roanoke County Board of Supervisors of Roanoke
County, Virginia, met this day at the Roanoke County
Administration Center, this being the third Tuesday, and the
fourth regularly scheduled meeting of the month of September,
1985.

Chairman McGraw called the meeting to order at 3:02 p.m.

EXECUTIVE SESSION
Supervisor Burton moved to go into Executive Session
pursuant to the Code of Virginia Section 2.1-344 (a), (l), (2),
(4), and (6). The motion carried by a unanimous voice vote.

4:20 p.m. The motion carried by a unanimous voice vote.

Supervisor Nickens requested that Items 8 and 9 be

of Item 1. Supervisor Brittle requested the removal of Item 3
and Supervisor McGraw requested that Items 4 and 16 also be
removed for discussion.
Item 1 - Supervisor Burton requested that Supervisor

Brittle attend the public hearing on the proposed hazardous waste

I facility siting regulations.
Item 3 - Supervisor Brittle inquired if this item
required action by the Board. County Attorney, Paul Mahoney,
reported that it was just an informative item, no action is
required.
Item 4 - Supervisor McGraw thanked Ms. Sally Turner,
Administrative Analyst, for her efforts on the newspaper.
Item 8 - Supervisor Nickens felt that there was still
some need for discussion concerning the County Pay and
Classification Plan and personnel management relations with the
Constitutional Officers. Chairman McGraw directed Keith Cook,
Personnel Director, to set up further discussions with the

Constitutional Officers.
Mr. Cook reported that Mr. Wayne Compton, Commissioner
of Revenue, has communicated to him that he would like for his
office to remain within the County system. Chairman McGraw also
directed Mr. Cook to send letters from the Board to each
Constitutional Officer stating that the Board wants to work with
them in their decision.
Item 9 - Supervisor Nickens directed staff to send a
letter of support to the Charlotte County Board of Supervisors
stating the County's support of their legislative package
concerning amendments to the present Animal Control laws.
Item 16 - Chairman McGraw directed staff to send a

letter to the appropriate Roanoke City officials advising them of
the following available dates to meet to discuss the proposed
airport expansion. The dates are October 8 and October 22 in the
evenings and October 18 and October 25 in the mornings.
Supervisor Nickens moved to approve the Consent Agenda.

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Resolution No. 85-109.c adopted by the Board

of Supervisors on June 25, 1985, be, and hereby is, rescinded;
and
2. That the Virginia Department of Highways and
Transportation is hereby requested to add a section of road
beginning 0.02 miles southwest of Route #878, extending southwes1

Transportation is hereby requested to add a section of road from
Route 1818 to a northwest deadend, distance of 0.02 miles, to the
Secondary System of Roanoke County pursuant to Section 33.1-229
of the Code of Virginia, 1950, as amended; and
3. That this Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of fifty (50) feet with
necessary easements for cuts, fills and drainage.
On motion of Supervisor Nickens and the following recorded vote:

1. That those certain bids set forth as follows in the
following words and figures be, and hereby are, accepted, upon
all and singular the terms and conditions of the invitation to

bid, the specifications of the County of Roanoke, the bidder's
proposals, and the provisions of this resolution, to-wit:
A. Contractual agreement to provide geological
services for ground water development - Geotechnics,
Inc. - not to exceed $6,000.00 per well for ten (10)
wells.

B. Contractual agreement to repair and/or replace
the existing roof at the Public Service Center -
Ronald L. Custer Roofing Company - not to exceed
$46,850.00.
2. That the County Administrator is hereby authorized
and directed to execute the necessary documents on behalf of
Roanoke County upon a form approved by the County Attorney; and
3. That all other bids are hereby rejected and the
Clerk is directed to so notify such bidders and express the
County's appreciation for the submission of their bids.

ALLOW ENCROACHMENT ON DRAINAGE EASEMENT,

1. That there is hereby authorized a waiver to allow a
dwelling to encroach upon a drainage easement, said dwelling and
easement being located on a 0.32 acre parcel of real estate

situate on Warwood Drive adjoining Lot 1, Block 1, Section 1,
Bear Ridge and Lot 1, Block 3, Section 2, Hidden Valley Court;
and
2. That the applicant for this wavier, K. W. Builders,
Inc. shall indemnify and hold harmless Roanoke County from any
and all damages or claims arising from the encroachment of this
dwelling on the drainage easement. Further the applicant agrees
to reimburse the County for any and all costs the County may
incur as a result of any repairs necessary to the drainage pipe
within this easement subject to the encroachment.
3. That the Acting County Administrator and County
Attorney is hereby authorized to execute such documents as may be

necessary to accomplish the purposes of this resolution.

IN RE: REPORTS OF OFFICERS, DEPARTMENTS, AND COMMITTEES
1. Industrial Development Authority - Mr. Timothy
Gubala, Superintendent of the Department of Development,
presented a request from Atelier, Inc. for IDA bonds. Supervisor
Nickens moved to approve the request.
RESOLUTION 85-168 APPROVING
THE ISSUANCE OF IDA BONDS FOR
ATELIER, INC.
BE IT RESOLVED by the Board of Supervisors of Roanoke

County, Virginia, as follows:
WHEREAS the Industrial Development Authority of Roanoke
County, Virginia (the Authority), has considered the application
of Atelier, Inc., a Virginia corporation (the Company),
requesting the issuance of the Authority's industrial development
revenue bond in an amount estimated at $1,000,000 (the Bond) to

assist in the financing of the Company's construction and
equipping of an office facility (the Project) at 4818 Starkey
Road in Roanoke County, Virginia, and has held a public hearing
thereon on September 23, 1985; and
WHEREAS, Section 103(k) of the Internal Revenue Code of
1954, as amended, provides that the governmental unit having
jurisdiction over the issuer of industrial development bonds and
over the area in which any facility financed with the proceeds of
industrial development bonds is located must approve the
issuance of the bonds; and
WHEREAS, the Authority issues its bonds on behalf of
Roanoke County, virginia (the County), the Project is to be
located in the County, and the Board of Supervisors of
RoanokeCounty, Virginia, constitutes the highest elected
governmental officials of the County; and
WHEREAS, the Authority recommends that the Board of
Supervisors approve the issuance of the Bond; and
WHEREAS, a copy of the Authority's resolution approving
the issuance of the Bond, subject to the terms to be agreed upon,
and a certificate of the public hearing have been filed with the
Board of Supervisors;
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE
COUNTY, VIRGINIA:
1. The Board of Supervisors approves the issuance of
the Bond by the Authority for the benefit of the Company, as
required by Section 103(k}, to permit the Authority to assist in
the financing of the Project.
2. The approval of the issuance of the Bond, as
required by Section 103(k), does not constitute an endorsement tc
a prospective purchaser of the Bond of the creditworthiness of
the Project or the Company, and, as required By §15.1-1380 of thE
Code of Virginia of 1950, as amended, the Bond shall provide that
neither the County nor the Authority shall be obligated to pay
the Bond or the interest thereon or other costs incident thereto

except from the revenues and moneys pledged therefor and neither
the faith nor credit nor the taxing power of the Commonwealth,
the County, or the Authority shall be pledged thereto.

3. This Resolution shall take effect immediately

2. Department of Fiscal Management - No report
3. Department of Public Facilities - John Hubbard,
Superintendent of the Department of Public Facilities, reported
on street naming procedures for the E911 System. Chairman McGraw
suggested changing Route 311 named Catawba Valley Drive in Mr.
Hubbard's report to Catawba Drive.
Supervisor Nickens moved to approve staff's

recommendations. The motion carried by a unanimous voice vote.
Mr. Hubbard reported this his order accepting Cherokee
Hills Drive located in the Catawba Magisterial District for
submission into the Virginia Department of Highways and
Transportation Secondary System be held over since the work has
not been completed on the road. The report will be heard October
8, 1985.
Mr. Hubbard also presented a resolution accepting
Verndale Road into the rural addition system. This will include
that portion from Route 115 (Plantation Road) to State Route 1869
(Meadowcrest Street). Supervisor Minter moved to approve the

prepared resolution.
RESOLUTION NO. 85-158 RECOMMENDING THAT A

Verndale Drive for 0.13 miles to Plantation Road, state Route

BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Resolution No. 85-125.E adopted by the Board of
Supervisors on July 23, 1985, be, and hereby is, rescinded; and
2. That the Virginia Department of Highways and
Transportation is hereby requested to add a section of Bunker
Hill Drive (Route 1616) in the Cave Spring Magisterial District
beginning at a point 0.05 miles west of the intersection of
Bunker Hill Drive and York Avenue (Route 1617) for a distance of
0.05 miles is hereby recommended as a rural addition pursuant to
Section 33.1-72.1(Cl) of the 1950 Code of Virginia, as amended;
and
3.
That this Board does guarantee the Commonwealth of

necessary easements for cuts, fills and drainage.

4. Department of Development - Mr. Arnold
Covey,Department of Development, presented a resolution to the

Boardregarding the granting of permission to the City of Roanoke
Redevelopment and Housing to exercise its power within the County
of Roanoke. Supervisor Nickens felt that there were County
citizens who are in housing that needs to be upgraded but the
County does not need project housing.
Mr. Sam Darby of Glenn, Flippin, Feldmann & Darby,
representing Mr. Bruce Hobart, reported that the rent costs for
low to moderate housing would be $14,000 to 22,000 per year which
would include utilities.
Supervisor Nickens felt that even though there is a
shortage of this type of housing and residents need repairs to
their homes, most would not relocate.
Supervisor Brittle requested more information on the

project.
Supervisor Nickens moved to reject the project.
Supervisor Minter offered a substitute motion to
obtain more information.
Supervisor Brittle suggested that the Board table this
matter.
Supervisor Minter withdrew his motion.
Supervisor Nickens withdrew his motion and moved to
table this matter until such time that staff can provide the
Board with more detailed information.

The Reverend Roger Kluttz, st. John's Lutheran Church
gave the invocation. The Pledge of Allegiance was recited by all
present.

PROCLAMATIONS, RESOLUTIONS, AND AWARDS
Chairman McGraw presented a proclamation declaring
September 25th through October 1st, 1985, "National Roller
Skating Week" to Tommy Fuqua.

WHEREAS, roller skating has entertained American families
for 122 years; and
WHEREAS, roller skating has been identified as a favorite
recreation for American teen-agers; and
WHEREAS, roller skating is endorsed by the American Heart
Association and the president's Council on Physical Fitness and
Sports as an outstanding aerobic sport; and
WHEREAS, the roller skating industry has continually strivec
to promote good will, honesty and integrity in our community.
NOW, THEREFORE, I, Steven A. McGraw, Chairman of the Board
of Supervisors of Roanoke County, do hereby proclaim September 25
through October 1, 1985 as

Petition of Leon G. and Dorothy
W. Brown for a Special Exception
Permit to place a mobile home on a
29.2 acre tract located on the
north side of Route 622 (Bradshaw
Road) approximately 6-1/2 miles
west of State Route 311 in the
Catawba Magisterial District.
CONTINUED FROM SEPTEMBER 13, 1985
APPROVED
Mr. Leon Brown was present to answer any questions the
Board might have. He reported to the Board that he would occupy
the mobile home.
Mr. R. W. Butterworth, Route 4, Salem, Virginia, was
present to oppose the special exception permit. He reported that
he had requested Mr. Brown to present an affidavit stating that
he would not rent the mobile home. If he received this affidavit
he would have withdrawn his opposition. To date, he has not
received an affidavit.

Supervisor Nickens reported that he would accept a
public statement on record that Mr. Brown will live in the mobile
home as a permanent resident.
Supervisor Nickens moved to approve the special
exception with a public statement that Mr. Brown would live in
the mobile home as a permanent resident. Mr. Brown consented to
live in the mobile home as a permanent resident.
Supervisor Brittle called for questions on the motion.

BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That Section 5-2 of Chapter 5, Animals and Fowl, be
amended to read and provide as follows:
I
Section 5-2. Lot boundary line constitute fences as to livestock
and poultry; permitting livestock and poultry to run
at large.
(a) The boundary line of each lot or tract of land in
the county is hereby constituted a lawful fence as to any
livestock and poultry domesticated by man.
(b) It shall be unlawful and a Class 4 misdemeanor for
the owner or any person in charge or control of any livestock and

poultry domesticated by man to permit the same to run at large
beyond the boundaries of his own land.
(c) In addition to any penalty imposed for a violation
of any provision of Section 5-2, such violation is hereby
declared a public nuisance and any person suffering injury or
damage therefrom may seek the correction, removal or abatement of
such nuisance through appropriate suit in equity.
2. That this amendment shall be in full force and
effect from and after its passage.

IN RE: REPORTS OF OFFICERS, DEPARTMENTS, AND COMMITTEES

4. Department of Development - Mr. Covey was also
scheduled to present a report on the Redevelopment Housing
Authority. The Board concurred that this report has no impact
since the resolution regarding the granting of permission to the
City of Roanoke Redevelopment and Housing to exercise its power
within the County of Roanoke was tabled.
Mr. Gubala reported that he would be meeting with the

Roanoke Valley Homebuilders Association and requested that this
matter be held over.
A resolution was presented to the Board to appoint a
new Zoning Administrator. Supervisor Burton moved to approve the
prepared resolution.

RESOLUTION 85-160 RESCINDING RESOLUTION
NO. 3215, AND APPOINTING THE ROANOKE
COUNTY ZONING ADMINISTRATOR
WHEREAS, Section 15.1-491 (d) of the Code of Virginia,
I
1950, as amended, authorizes the appointment or designation of a
zoning administrator; and
WHEREAS, Section 21-101 of the Roanoke County Code
provides that the zoning chapter shall be enforced by a zoning
administrator who shall be appointed by the governing body, and
who shall serve at the pleasure of the governing body; and
WHEREAS, Resolution No. 3215, adopted August 10, 1982,
appointed Claude Lee Zoning Administrator; and
WHEREAS, the Board of Supervisors desires to emphasize
the importance of fair, impartial, speedy and effective
enforcement of the provisions of the Zoning Ordinance by
allocating additional resources and personnel to this endeavor.

NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County, Virginia, as follows:
1. That Resolution No. 3215 is hereby rescinded and
repealed.
2. That the Director of the Division of Planning,
Zoning and Community Development be, and hereby is, appointed the
Roanoke County Zoning Administrator. Further this Zoning
Administrator is hereby authorized to appoint such deputies or
assistants to assist him at his discretion. Said deputies or
assistants shall be County employees of the Department of
Development.
3. That an attested copy of this Resolution be
forthwith delivered to the Clerks of the Circuit Court and

General District Court of Roanoke County.

5. Personnel Department - Chairman McGraw announced

6. County Attorney - Paul Mahoney, County Attorney,
presented a resolution to the Board which revises the County Code
to place the Department of Procurement under the supervision of

the County Administrator. Supervisor Minter moved to approve the
prepared resolution.
ORDINANCE 85-161 AMENDING AND REVISING
THE ROANOKE COUNTY CODE, CHAPTER 2,
ORGANIZATIONAL STRUCTURE OF COUNTY
ADMINISTRATION, PLACING DEPARTMENT OF
PROCUREMENT UNDER THE SUPERVISION OF
THE COUNTY ADMINISTRATOR, AND CHAPTER
17, PROCUREMENT
WHEREAS, Section 15.1-117 (12) of the Code of Virginia,
1950, as amended, provides that the County Administrator shall
act as purchasing agent for the county; and
WHEREAS, Section 15.1-127 of the Code of Virginia, etc.
directs that centralized competitive purchasing shall be done by
the County Administrator.

IT IS HEREBY ORDAINED by the Board of Supervisors of
Roanoke County, Virginia, as follows:
CHAPTER 2. ADMINISTRATION
ARTICLE II. ORGANIZATIONAL STRUCTURE OF COUNTY ADMINISTRATION

(4) Department of fiscal management which office shall
be directly managed by the superintendent of fiscal management
and shall have such other employees as from time to time may be
authorized by the board, and within such department shall be the
following divisions: Division of delinquent collections and

e€ ~feeöfeffiefi~ sefvieest, automated services division (managed
by a director of data processing) and division of real estate
assessment (managed by a county assessor who shall be appointed

of fiscal planning of the county, shall make advisory reports to
the superintendent of fiscal management as may be required by
such superintendent.

CHAPTER 17. PROCUREMENT CODE
ARTICLE I. IN GENERAL

Sec. 17-4. Purchasing system crated; purchasing agent generally.
(a) There is hereby created a purchasing system for
the county to operate under the direction and supervision of the
sö~efifi~efiðefi~ e€ €isea~ ffiafia~effiefi~ county administrator, who
shall be the purchasing agent for the county. The purchasing
agent may delegate the administrative purchasing responsibility
to a responsible subordinate, upon feeeææefiða~iefi e€ ~Ae eeöfi~Y
aðffiifiis~fa~ef afið approval of the board of supervisors. The
purchasing agent and such designated subordinate shall be bonded,
the form and amount of bond to be determined by the board of
supervisors.
This ordinance shall be in full force and effect from
and after its passage.

Supervisor Minter moved to appoint Jack Council as the
Director of Procurement. The motion carried by the following
recorded vote:

Mr. Mahoney requested that his report on funding of
emergency medical services during daylight hours be held over to
October 8, 1985.
Mr. Mahoney also presented a request from the School
Board for a budget adjustment to the 1985-1986 budget. Because of
an increase in enrollment, five more teachers are needed.
Supervisor Nickens moved to approve the prepared resolution.

RESOLUTION 85-162 AUTHORIZING AN
ADJUSTMENT TO THE 1985-86 SCHOOL
OPERATING BUDGET
WHEREAS, the student enrollment in Roanoke County
schools for 1985-86 is greater than the estimate used for
staffing purposes which has resulted in the employment of five
additional teachers by the Roanoke County School Board to relieve
oversize class loads; and

WHEREAS, the 1985-86 school operating budget does not
include the additional revenue to be gained through the state aid
formula for the increased enrollment nor the additional
expenditure for the employment of five extra teaching personnel;

and
WHEREAS, on September 12, 1985, the County School Board
adopted a resolution requesting the Board of Supervisors to
adjust the 1985-86 school operating budget.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of Roanoke County that the 1985-86 school operating
budget accounts are hereby adjusted in the amount of $100,000;
said amount representing an amount of additional state aid
to be received based on anticipated student enrollment for the
period September, 1985 through March, 1986.

RESOLUTION 85-164 AUTHORIZING THE
EXECUTION OF DOCUMENTS FOR APPLICATION
FOR TELEPHONE SERVICE FOR THE
INSTALLATION OF ENHANCED 911 SERVICE
BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Acting County Administrator is hereby
authorized to execute such documents as may be deemed necessary
to apply for telephone service as required for the installation
of enhanced 911 service; and
2. That universal emergency number 911 services
provide the general public with the means of simple and direct
telephone access to public safety answering points engaged in

assisting local governments in protecting the safety and property
of the general public; and
3. That this application for service is in accordance
with the general regulations tariff of the Chesapeake & Potomac
Telephone Company, and includes the rates and charges applicable
to this service (miscellaneous service arrangements tariff).

7. Human Services Committee - Mr. Bruce Prillaman,
Chairman of the Human Services Committee presented a report to
the Board on the Human Services funding. Chairman McGraw
commended the Committee on their efforts. Dianne Hyatt,
Superintendent of Fiscal Management, reported that last year the
Board funded $64,000 for Human Services agencies and this year
$48,000 was funded. Supervisor Nickens moved to approve the
prepared resolution.
Supervisor Minter commended the Board on their hard
work.
Supervisor Burton informed the public that the

amount of funding was reduced this year because the amount was
based on a percentage of expected revenue sharing funds. It was
earlier estimated that the revenue sharing would be nonexistent
or reduced.

Jim Daughtridge to the Recreation Commission.

IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
1. Supervisor Brittle - No report.
2. Supervisor Burton - Supervisor Burton inquired
about the support of Senate Bill 1570 (Garcia matter). Mr.
Mahoney asked her to wait on making a motion since he and Mr.
Cook are working on a report involving costs to the County and
amount of overtime.
3. Supervisor Nickens - Supervisor Nickens requested a
bond referendum update. Ms. Sally Turner, Administrative

Analyst, reported that she has been working with the advertising
firm to assist the County in audio visual reports and is in the
process of preparing a brochure. She also reported that she has
met with a group of citizens who have formed a steering committee.
This committee has representatives from allover the County and
has divided itself into subcommittees. These subcommittees are

working throughout the County. Ms. Turner has also prepared a
list of meeting dates with various citizen groups and is seeking
volunteers from Board members.
Supervisor Burton reported that she, Tim Gubala, and
John Chambliss met with the Roanoke Valley Chamber of Commerce
and they have voiced their support of the bond referendum.
4. Supervisor Minter - No report.
5. Supervisor McGraw - Supervisor McGraw requested the
mobile home ordinance amendments. He also reported that the
Clerk of Circuit Court, Elizabeth Stokes, has requested funds
inthe amount of $1,000 for the ceremony unveiling the Judges'
portraits.

Supervisor Nickens moved to go into Executive Session
pursuant to the Code of Virginia 2.1-344 (a) (1) (2) (4) and (6).

Supervisor Brittle moved to return to Open Session.
The motion carried by a unanimous voice vote.
County Attorney, Paul Mahoney, reported that he has
received bona fide offers on the Starkey School property and the
North 11 property. According to policy, the Board has received
these offers and will accept any other offers until 5 p.m. on
October 4. The Board will make a decision at its next meeting on
October 8, 1985.
Mr.Mahoney also reported that the Bid Committee has
chosen Bolt advertising for the bond referendum. The Board has
concurred with the Bid Committee's choice.
The Board decided on the following meeting dates for
November and December: November 13 and 26 and December 3 and 10.
The December 24 meeting has been cancelled as well as the

November 5 meeting. Emergency meeting dates will be December 17,
18, or 19.
Mr. Mahoney also reported that he has received a

complaint from Mr. Tommy Fuqua on vehicle maintenance. It was
decided that Mr. Mahoney and Supervisor Burton will bring this
matter to the attention of the committee at the October meeting.
